which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 49, United States Code, to direct the Assistant Secretary of Homeland Security (Transportation Security Administration) to establish an Aviation Security Advisory Committee, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" id="H7B147CD0D73749BB9BC77BAEB450F746" style="OLC"><section id="H631DC2CD7B3F48EFB2A4155E3324FE93" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Aviation Security Stakeholder Participation Act of 2013</short-title></quote>.</text></section><section id="H5A4CAD0B296240A7A61ED11998A52711"><enum>2.</enum><header>Aviation Security Advisory Committee</header><subsection id="H626EA51DAB094D5ABCDF949A71E60D35"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/449">chapter 449</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block id="H54FDA0BDD8C243959555021759697A47" style="USC"><section id="H8853829B224E40F0AA5D885436E8B0B8"><enum>44946.</enum><header>Aviation Security Advisory Committee</header><subsection id="H1E508D6A829747129B4FB09B401FBFD5"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Assistant Secretary shall establish within the Transportation Security Administration an advisory committee to be known as the <term>Aviation Security Advisory Committee</term>.</text></subsection><subsection id="H8AA24B5CB02741D2A7303F02279E723C"><enum>(b)</enum><header>Duties</header><paragraph id="H87AE0865F1DB454A9B6ECB784A7FCFD4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Assistant Secretary shall consult the Advisory Committee on aviation security matters, including on the development, refinement, and implementation of policies, programs, rulemaking, and security directives pertaining to aviation security, while adhering to sensitive security guidelines.</text></paragraph><paragraph id="HEFECF68FFB994B799E720405FAED0F8C"><enum>(2)</enum><header>Recommendations</header><subparagraph id="HAB8EB3BC12AF420FA413E0A8E7460133"><enum>(A)</enum><header>In general</header><text>The Advisory Committee shall develop, at the request of the Assistant Secretary, recommendations for improvements to aviation security.</text></subparagraph><subparagraph id="HB46F7FBE7A13435D8A5A24D66A01806F"><enum>(B)</enum><header>Recommendations of subcommittees</header><text>Recommendations agreed upon by the subcommittees established under this section shall be approved by the Advisory Committee for transmission to the Assistant Secretary.</text></subparagraph></paragraph><paragraph id="H32E94487E3E24D5DA38A6EB59DF17E67"><enum>(3)</enum><header>Periodic reports</header><text>The Advisory Committee shall periodically submit to the Assistant Secretary—</text><subparagraph id="HF006A1F7F38346F1806A72EB7C814E50"><enum>(A)</enum><text>reports on matters identified by the Assistant Secretary; and</text></subparagraph><subparagraph id="H139A5DBA81614B54B75929496AAF611E"><enum>(B)</enum><text>reports on other matters identified by a majority of the members of the Advisory Committee.</text></subparagraph></paragraph><paragraph id="H300228FE161745B9A14DD615FF27329F"><enum>(4)</enum><header>Annual report</header><text display-inline="yes-display-inline">The Advisory Committee shall submit to the Assistant Secretary an annual report providing information on the activities, findings, and recommendations of the Advisory Committee, including its subcommittees, for the preceding year.</text></paragraph><paragraph id="HD105603E8AE34C7BB7BAF4C76DF29ED6"><enum>(5)</enum><header>Feedback</header><text display-inline="yes-display-inline">Not later than 90 days after receiving recommendations transmitted by the Advisory Committee under paragraph (4), the Assistant Secretary shall respond in writing to the Advisory Committee with feedback on each of such recommendations, an action plan to implement any of such recommendations with which the Assistant Secretary concurs, and a detailed justification for why any of such recommendations have been rejected.</text></paragraph><paragraph id="H3FA561F060894D5098C3B77A5ECD2BEF"><enum>(6)</enum><header>Congressional notification</header><text>Not later than 30 days after providing written feedback to the Advisory Committee in accordance with paragraph (5), the Assistant Secretary shall brief the Committee on Homeland Security of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate on such feedback.</text></paragraph><paragraph id="HEC0BD476A742472785793169C9F64748"><enum>(7)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Prior to briefing the Committee on Homeland Security of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate in accordance with paragraph (6), the Assistant Secretary shall submit to such committees a report containing information relating to the recommendations transmitted by the Advisory Committee in accordance with paragraph (4).</text></paragraph></subsection><subsection id="HFFABE51801964991B9FF7A2B497C6745"><enum>(c)</enum><header>Membership</header><paragraph id="HBD23BFD8D31C4A77BF3974973E5F2D8C"><enum>(1)</enum><header>Appointment</header><subparagraph id="HEFC87F9637DD4A28AE21F9FC9C3F64F9"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this section, the Assistant Secretary shall appoint the members of the Advisory Committee.</text></subparagraph><subparagraph id="H57A9EABDD99A46B085EFBAB08487B75F"><enum>(B)</enum><header>Composition</header><text>The membership of the Advisory Committee shall consist of individuals representing not more than 34 member organizations. Each organization shall be represented by one individual (or the individual’s designee).</text></subparagraph><subparagraph id="HADA8A8CD73C14C719683C4941E0E4828"><enum>(C)</enum><header>Representation</header><text display-inline="yes-display-inline">The membership of the Advisory Committee shall include representatives of air carriers, all-cargo air transportation, indirect air carriers, labor organizations representing air carrier employees, aircraft manufacturers, airport operators, airport construction and maintenance contractors, labor organizations representing employees of airport construction and maintenance contractors, general aviation, privacy organizations, the travel industry, airport-based businesses (including minority-owned small businesses), businesses that conduct security operations at airports, aeronautical repair stations, passenger advocacy groups, the aviation technology security industry (including biometrics), victims of terrorist acts against aviation, and law enforcement and security experts.</text></subparagraph></paragraph><paragraph id="H4E475422CDEF4A9C8D80275A6FF29C6E"><enum>(2)</enum><header>Removal</header><text>The Assistant Secretary may review the participation of a member of the Advisory Committee and remove such member for cause at any time.</text></paragraph><paragraph id="HB211EFCA712E490D9A487DCBE1D083A1"><enum>(3)</enum><header>Prohibition on compensation</header><text>The members of the Advisory Committee shall not receive pay, allowances, or benefits from the Government by reason of their service on the Advisory Committee.</text></paragraph><paragraph id="H91D6E2E054844BC199CB9BF8081A78E3"><enum>(4)</enum><header>Meetings</header><text>The Assistant Secretary shall require the Advisory Committee to meet at least semiannually and may convene additional meetings as necessary.</text></paragraph></subsection><subsection id="H47572141D02141EEAD63AF4F1DFAEF21"><enum>(d)</enum><header>Air cargo security subcommittee</header><paragraph id="HBADCACBF89454EF0BC9D36DA1F26E53F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Assistant Secretary shall establish within the Advisory Committee an air cargo security subcommittee to provide recommendations on air cargo security issues, including the implementation of the air cargo security programs established by the Transportation Security Administration to screen air cargo on passenger aircraft and all-cargo aircraft in accordance with established cargo screening mandates.</text></paragraph><paragraph id="H21A72FCEA2424D829FFA8791158059E7"><enum>(2)</enum><header>Meetings and reporting</header><text display-inline="yes-display-inline">The subcommittee shall meet at least quarterly and submit to the Advisory Committee for inclusion in the annual report required under subsection (b)(4) information, including recommendations, regarding air cargo security. Such submissions shall include recommendations to improve the Transportation Security Administration’s cargo security initiatives established to meet the requirements of section 44901(g).</text></paragraph><paragraph id="HCBF7DFF7B09147F0A80F272259E4A60D"><enum>(3)</enum><header>Membership</header><text display-inline="yes-display-inline">The subcommittee shall—</text><subparagraph id="H234D6360D8D246F5AF9A7844ED71B53F"><enum>(A)</enum><text>include members of the Advisory Committee with expertise in air cargo operations; and</text></subparagraph><subparagraph id="H69C5EAAA980A4E95B60CBFC93A23375E"><enum>(B)</enum><text>be cochaired by a Government and industry official.</text></subparagraph></paragraph></subsection><subsection id="HFA9CEB1B5DCF4BFBB81EA7910C3C9414"><enum>(e)</enum><header>General aviation security subcommittee</header><paragraph id="H983A88D9D16248BA8EA7BFDF546BA14A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Assistant Secretary shall establish within the Advisory Committee a general aviation subcommittee to provide recommendations on transportation security issues for general aviation facilities, general aviation aircraft, and helicopter operations at general aviation and commercial service airports.</text></paragraph><paragraph id="H3B8F59F67D9A4F9BADEC96B6412F5016"><enum>(2)</enum><header>Meetings and reporting</header><text display-inline="yes-display-inline">The subcommittee shall meet at least quarterly and submit to the Advisory Committee for inclusion in the annual report required under subsection (b)(4) information, including recommendations, regarding aviation security at general aviation airports.</text></paragraph><paragraph id="H781E04A6E9734CE78832434DDDA475C4"><enum>(3)</enum><header>Membership</header><text display-inline="yes-display-inline">The subcommittee shall—</text><subparagraph id="H57FBC74C8F404AB4878960468B975935"><enum>(A)</enum><text>include members of the Advisory Committee with expertise in general aviation; and</text></subparagraph><subparagraph id="H38E269EDF6AF40D0A0A593F7A519D23D"><enum>(B)</enum><text>be cochaired by a Government and industry official.</text></subparagraph></paragraph></subsection><subsection id="HAB039558367F4BDA82733B9312DE8C3D"><enum>(f)</enum><header>Perimeter security, exit lane security, and access control subcommittee</header><paragraph id="H4136761411F945B788812694A09FDACF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Assistant Secretary shall establish within the Advisory Committee an airport perimeter security, exit lane security, and access control subcommittee to provide recommendations on airport perimeter security, exit lane security at commercial service airports, and access control issues.</text></paragraph><paragraph id="H4FB90DB92EE64928AB39C046E4178971"><enum>(2)</enum><header>Meetings and reporting</header><text display-inline="yes-display-inline">The subcommittee shall meet at least quarterly and submit to the Advisory Committee for inclusion in the annual report required under subsection (b)(4) information, including recommendations, regarding improving perimeter security, exit lane security at commercial service airports, and access control procedures at commercial service and general aviation airports.</text></paragraph><paragraph id="H20239793F6D9402189280E37BBFEF399"><enum>(3)</enum><header>Membership</header><text display-inline="yes-display-inline">The subcommittee shall—</text><subparagraph id="H057C24658E5B45E1A24845B4A0E589BE"><enum>(A)</enum><text>include members of the Advisory Committee with expertise in airport perimeter security and access control issues; and</text></subparagraph><subparagraph id="H9CE47F2FCCF2481989C75AF3B5D0CBE7"><enum>(B)</enum><text>be co-chaired by a Government and industry official.</text></subparagraph></paragraph></subsection><subsection id="HC6A69B099A23467DBCC5628BA83B7421"><enum>(g)</enum><header>Risk-Based subcommittee</header><paragraph commented="no" id="H9720FCE7ACA44C4C8DD94143B065F9A9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Assistant Secretary shall establish within the Advisory Committee a risk-based subcommittee to provide recommendations on passenger screening policies and cargo.</text></paragraph><paragraph commented="no" id="H45D1329321D24698BAEE983E8CA598D3"><enum>(2)</enum><header>Meetings and reporting</header><text>The subcommittee shall meet at least quarterly and submit to the Advisory Committee for inclusion in the annual report required under subsection (b)(4) information, including recommendations, regarding the Transportation Security Administration’s risk-based security programs.</text></paragraph><paragraph id="H239BCEC7F82047CEAC1D99BEF5493E8B"><enum>(3)</enum><header>Membership</header><text>The subcommittee shall—</text><subparagraph commented="no" id="HD4714528213B4071B23E06988469236B"><enum>(A)</enum><text>include members of the Advisory Committee with expertise in passenger advocacy and airport security operations; and</text></subparagraph><subparagraph id="H04F7797D0B664B75959639AA0C5FE5C2"><enum>(B)</enum><text>be cochaired by a Government and industry official.</text></subparagraph></paragraph></subsection><subsection id="HB16A75A50957413389B86B6EF263D328"><enum>(h)</enum><header>Security technology subcommittee</header><paragraph id="H0D29F532680A4533B5CFD6D25B2441A9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Assistant Secretary shall establish within the Advisory Committee a security technology subcommittee to provide recommendations on security technology issues, including harmonization of security technology standards and requirements.</text></paragraph><paragraph id="HBE9AD9C541F14F0DA1942B1F2774E941"><enum>(2)</enum><header>Meetings and reporting</header><text>The subcommittee shall meet at least quarterly and submit to the Advisory Committee for inclusion in the annual report required under subsection (b)(4) information, including recommendations, regarding security technology. Such submissions shall include recommendations to improve the Transportation Security Administration’s utilization of security technology and harmonization of security technology standards and requirements. All recommendations shall be in furtherance of aviation security and technology neutral.</text></paragraph><paragraph id="H2D2FFC700E934EE5B0DCC3EA9E309EAF"><enum>(3)</enum><header>Membership</header><text>The subcommittee shall—</text><subparagraph id="H16F568B53D5C4A92A52D5D226A2DCFE1"><enum>(A)</enum><text>include members of the Advisory Committee with expertise in checkpoint, baggage, and air cargo security technology; and</text></subparagraph><subparagraph id="H5462D4E2B05B4C7188A77DBA0BE89D18"><enum>(B)</enum><text>be co-chaired by a Government and industry official.</text></subparagraph></paragraph></subsection><subsection id="H1703A72855CF4CD9828A86295ECAE320"><enum>(i)</enum><header>Other subcommittees</header><text>The Assistant Secretary, in consultation with the Advisory Committee, may establish within the Advisory Committee any other subcommittee that the Assistant Secretary and Advisory Committee determine necessary.</text></subsection><subsection id="HBE745696150849AE9ECD768ACD9D56FC"><enum>(j)</enum><header>Subject matter experts</header><text display-inline="yes-display-inline">Each subcommittee under this section shall include subject matter experts with relevant expertise who are appointed by the respective subcommittee chairperson.</text></subsection><subsection commented="no" id="HE7BEEB5B3E534E56A81C931C6CA35412"><enum>(k)</enum><header>Nonapplicability of FACA</header><text display-inline="yes-display-inline">The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Advisory Committee and its subcommittees.</text></subsection><subsection id="H4235106AECE04AFD82B8FF86CD579341"><enum>(l)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H2D5D8878BD0145E1BC1AA368EB96AFB0"><enum>(1)</enum><header>Advisory Committee</header><text display-inline="yes-display-inline">The term <term>Advisory Committee</term> means the Aviation Security Advisory Committee established under subsection (a).</text></paragraph><paragraph commented="no" id="HBE2F853AD5BB41D3866EC4EBFD2E56F3"><enum>(2)</enum><header>Assistant Secretary</header><text display-inline="yes-display-inline">The term <term>Assistant Secretary</term> means the Assistant Secretary of Homeland Security (Transportation Security Administration).</text></paragraph><paragraph id="H2E60BB18D0434EDFACC7BF729A434ACA"><enum>(3)</enum><header>Perimeter security</header><text>The term <term>perimeter security</term>—</text><subparagraph id="H1849D368B4DB4FDE9323B65EA0DC5CD0"><enum>(A)</enum><text display-inline="yes-display-inline">means procedures or systems to monitor, secure, and prevent unauthorized access to an airport, including its airfield and terminal; and</text></subparagraph><subparagraph id="HBC66DD6239614D17A46EC949444D5C80"><enum>(B)</enum><text display-inline="yes-display-inline">includes the fence area surrounding an airport, access gates, and access controls.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD16E4BC82A74402D9D9F9E52D3F6A008"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The analysis for subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/449">chapter 449</external-xref> of title 49, United States Code, is amended by adding at the end the following new item:</text><quoted-block display-inline="no-display-inline" id="H1096665E8E634B6BADD1B67D02C58582" style="USC"><toc container-level="quoted-block-container" idref="H54FDA0BDD8C243959555021759697A47" lowest-bolded-level="division-lowest-bolded" lowest-level="section" quoted-block="no-quoted-block" regeneration="yes-regeneration"><toc-entry idref="H8853829B224E40F0AA5D885436E8B0B8" level="section">44946. Aviation Security Advisory Committee.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
