		  <quote><short-title>Quality Data, Quality Healthcare Act of 2013</short-title></quote>.</text></section><section id="idF9895CA69EB3415B814797A1204DBC9A"><enum>2.</enum><header>Expanding the availability of medicare data</header><subsection id="idF65D4AE64170433588888FA0D10159C6"><enum>(a)</enum><header>Expanding use of medicare data by qualified entities</header><text display-inline="yes-display-inline">Section 1874(e) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395kk">42 U.S.C. 1395kk(e)</external-xref>) is amended—</text><paragraph id="id077B71281013475387E504E7F96B8AF8"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (3), in the first sentence, by inserting <quote>or, such claims data in sufficient detail to identify cost and utilization, as appropriate</quote> before the period at the end; and</text></paragraph><paragraph id="idA68C91CD74D9488B8CC6102F8F317183"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="id59747753FD2C44C38AB0A95FC0CC1EDC" style="OLC"><paragraph id="idC67D0D2BB6AC4E359B942A271E801F38"><enum>(5)</enum><header>Expanding use of medicare data by qualified entities</header><subparagraph id="idFA592A0CEE5C409DA8BF55ABC26FAB07"><enum>(A)</enum><header>In general</header><text>Beginning January 1, 2014, notwithstanding paragraph (4)(B) and the second sentence of paragraph (4)(D), a qualified entity may—</text><clause id="id4C9909F1D32143418E7052F097D45E56"><enum>(i)</enum><text>use data received by such entity under this section, and information derived from the evaluation described in paragraph (4)(D), for additional non-public analyses (as determined appropriate by the Secretary); or</text></clause><clause id="idB6E7ECDB80D746C894B52E184A3274E9"><enum>(ii)</enum><text>subject to subparagraph (C), provide or sell such data and analyses to entities described in subparagraph (B) for non-public use (including for the purposes of assisting providers of services and suppliers to develop and participate in quality and patient care improvement activities, including developing new models of care).</text></clause></subparagraph><subparagraph id="id79FEEFD0E3704E38B2308704B5A553B7"><enum>(B)</enum><header>Entities described</header><text>The entities described in this subparagraph are the following:</text><clause id="id24ce02466d324d4cae9fb47ec5dd7f64"><enum>(i)</enum><text>A health care provider.</text></clause><clause id="id60C3190CA3014DBFBCA931588AE08D98"><enum>(ii)</enum><text>A health insurance issuer (as defined in section 2791 of the Public Health Service Act).</text></clause><clause id="idAD806845957249BC98B04BC22867D931"><enum>(iii)</enum><text>An employer (as defined in section 3(5) of the Employee Retirement Insurance Security Act of 1974).</text></clause><clause id="id5DA98F874A0F41A9981E55A9B9096A49"><enum>(iv)</enum><text>Any organization affiliated with or representing an entity described in clause (i), (ii), or (iii),  such as a medical society.</text></clause><clause id="idf17fe9dbcb08484b9ec962733f312e19"><enum>(v)</enum><text>A public health authority (as defined for purposes of the Health Insurance Portability and Accountability Act of 1996).</text></clause><clause id="idF6407FDDB4D142978E0E5349C87FCD75"><enum>(vi)</enum><text>A State or local government agency.</text></clause><clause id="id8c4eda465fec4e93a5be69432870aac3"><enum>(vii)</enum><text>A research organization that certifies that it will only use the data or analyses for the public good and not for proprietary purposes.</text></clause><clause id="id56c20623d6084d289f4f3381e8f45479"><enum>(viii)</enum><text>Any other entity the Secretary determines appropriate to further the goals of this paragraph.</text></clause></subparagraph><subparagraph id="id448072E873784ED5A2D8944DCBB112C5"><enum>(C)</enum><header>Requirements</header><clause id="id8F7DE15C56EE432AAC4EC7152AC91B18"><enum>(i)</enum><header>Data use agreement</header><text>A qualified entity may only provide data or analysis to an entity under subparagraph (A)(ii) pursuant to a data use agreement with the entity. Under such agreement, the entity—</text><subclause id="id67C643C951E448E5BBB70E6921A5C9FF"><enum>(I)</enum><text>may not re-sell such data or analyses; and</text></subclause><subclause id="id9D6FD47C2E0D432A8D108D65D07ACFA9"><enum>(II)</enum><text>shall comply with the privacy and security policies of the qualified entity in using such data or analyses.</text></subclause></clause><clause id="id93C71596399B4444B179BCF77E867987"><enum>(ii)</enum><header>Civil money penalty</header><subclause id="idE9A10F4E7E844D6F879A257FB8963ACB"><enum>(I)</enum><header>In general</header><text>If the Secretary determines that an entity described in subparagraph (B) knowingly used such data and analyses for purposes other than as authorized under this paragraph, the entity shall be subject to  a civil money penalty in an amount determined by the Secretary for each such violation.</text></subclause><subclause id="idC5517F45DF0043AFA72BDE18AC2E3D26"><enum>(II)</enum><header>Procedures</header><text>The provisions of section 1128A (other than subsections (a) and (b) of such section) shall apply to a civil money penalty under subclause (I) in the same manner as such provisions apply to a penalty or proceeding under section 1128A(a).</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="ida50654064d484c56a1660ac9768abc05"><enum>(b)</enum><header>Access to medicare data to qualified clinical data registries To facilitate quality improvement</header><text>Section 1848(m)(3)(E) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-4">42 U.S.C. 1395w–4(m)(3)(E)</external-xref>) is amended by adding at the end the following new clause:</text><quoted-block display-inline="no-display-inline" id="id14D71894BE094FE8A7D8A2A08D0703DF" style="OLC"><clause id="id804980F09BCC40F88A6B3CE1D165025F"><enum>(vi)</enum><header>Access to medicare data to facilitate quality improvement</header><subclause id="id3854B6EB11D64594886A807D9A00A359"><enum>(I)</enum><header>In general</header><text>Consistent with applicable laws and regulations with respect to privacy and other relevant matters, beginning January 1, 2014, the Secretary shall, subject to subclause (II), provide claims data under this title (in a form and manner determined to be appropriate) to qualified clinical data registries under this subparagraph for purposes of linking such data with clinical outcomes data and preforming and disseminating risk-adjusted, scientifically valid research to support quality improvement.</text></subclause><subclause id="idA1650E418A344C088073D4A2E743F3D9"><enum>(II)</enum><header>Limitation</header><text>A qualified clinical data registry may not publicly report any data made available under subclause (I) that individually identifies a provider of services or supplier unless the registry obtains the consent of the provider of services or supplier prior to such reporting.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
