<section id="idA752956B91A4429F8C6F313622871ACD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Border Patrol Agent Pay Reform Act of 2013</short-title></quote>.</text></section>
<section id="id8D065BEC5FDB40F7B8C7B6BCCBF158E1"><enum>2.</enum><header>Border patrol rate of pay</header>
<subsection id="id5904B4E06E2E4AC8BE7E93A592153A60"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purposes of this Act are—</text>
<paragraph id="idEA9ADB5553D54B459E949ACE3BB4B5E4"><enum>(1)</enum><text display-inline="yes-display-inline">to strengthen U.S. Customs and Border Protection and ensure border patrol agents are sufficiently ready to conduct necessary work and that agents will perform overtime hours in excess of a 40-hour work week based on the needs of the employing agency; and</text></paragraph>
<paragraph id="idE5C847863CE5462F8568A309D69A400E"><enum>(2)</enum><text display-inline="yes-display-inline">to ensure U.S. Customs and Border Protection has the flexibility to cover shift changes and retains the right to assign scheduled and unscheduled work for mission requirements and planning based on operational need.</text></paragraph></subsection>
<subsection id="idA07F2D3D08334889AFAA26BE69A5708F"><enum>(b)</enum><header>Rates of pay</header><text>Subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/55">chapter 55</external-xref> of title 5, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/5/5549">section 5549</external-xref> the following:</text>

<section id="id411774EA009C48BFBF2F8049DCF10537"><enum>5550.</enum><header>Border patrol rate of pay</header>
<subsection id="id548FC95FFAD9458D9A0FD5F6E6A1E79A"><enum>(a)</enum><header>Definitions</header><text>In this section—</text>
<paragraph id="id7491b4cc4a434343a3c61a31fa9bd448"><enum>(1)</enum><text>the term <term>available to work</term> means a border patrol agent is generally and reasonably accessible by U.S. Customs and Border Protection to perform unscheduled duty based on the needs of U.S. Customs and Border Protection;</text></paragraph>
<paragraph id="idebe21323a6ce41cbb20b5f5efe518d64"><enum>(2)</enum><text>the term <term>border patrol agent</term> means an individual who is performing functions included under position classification series 1896 (Border Patrol Enforcement) of the Office of Personnel Management, or any successor thereto, including performing covered border patrol activities;</text></paragraph>
<paragraph id="id6ACF561C5F224996B292DFD6F81FB38E"><enum>(3)</enum><text>the term <term>covered border patrol activities</term> means a border patrol agent is—</text>
<subparagraph id="id48bbaae14894442480ba1e67846ba925"><enum>(A)</enum><text>detecting and preventing illegal entry and smuggling of aliens, commercial goods, narcotics, weapons, or contraband into the United States;</text></subparagraph>
<subparagraph id="id28D34C8A0E9D4B538B0F6880D0072021"><enum>(B)</enum><text>arresting individuals suspected of conduct described in subparagraph (A);</text></subparagraph>
<subparagraph id="id6A4D1A6387C54A1E88201C7340068CE8"><enum>(C)</enum><text>attending training authorized by U.S. Customs and Border Protection;</text></subparagraph>
<subparagraph id="id8df65b81e78a4597b36b457a6059cdd1"><enum>(D)</enum><text>on approved annual, sick, or administrative leave;</text></subparagraph>
<subparagraph id="idb2ef19aaf2d4427b886caff077fe2bc6"><enum>(E)</enum><text>on ordered travel status;</text></subparagraph>
<subparagraph id="id0e5cbd18271f49d387498061d29671b4"><enum>(F)</enum><text>on official time, within the meaning of section 7131;</text></subparagraph>
<subparagraph id="idf5bb76bba0654cb3bd48de4da002f06a"><enum>(G)</enum><text>on excused absence with pay for relocation purposes;</text></subparagraph>
<subparagraph id="id1f4c922af9e949ae89ca24ec12825926"><enum>(H)</enum><text>on light duty due to injury or disability;</text></subparagraph>
<subparagraph id="idb8078ce565964ccea8c7df8e321cd4d8"><enum>(I)</enum><text>performing administrative duties or mission critical work assignments while maintaining law enforcement authority;</text></subparagraph>
<subparagraph id="ide26d1e41d521458284ed670490d84dde"><enum>(J)</enum><text>caring for the canine assigned to the border patrol agent, which may not exceed 1 hour per day; or</text></subparagraph>
<subparagraph id="id215FE1A4053D431CA11B8C64460DC445"><enum>(K)</enum><text>engaged in an activity similar to an activity described in subparagraphs (A) through (J) while temporarily away from the regular duty assignment of the border patrol agent;</text></subparagraph></paragraph>
<paragraph id="id3250E6DB626C4D1B93C7069FA33F7B73"><enum>(4)</enum><text>the term <term>level 1 border patrol rate of pay</term> means the hourly rate of pay equal to 1.25 times the otherwise applicable hourly rate of basic pay of the applicable border patrol agent;</text></paragraph>
<paragraph id="idDFC9CC8F76C44425A4E174445BE7C7A3"><enum>(5)</enum><text>the term <term>level 2 border patrol rate of pay</term> means the hourly rate of pay equal to 1.125 times the otherwise applicable hourly rate of basic pay of the applicable border patrol agent; and</text></paragraph>
<paragraph id="id4890cc770b254517b0eac7e3a82abe84"><enum>(6)</enum><text>the term <term>work period</term> means a 14-day biweekly pay period.</text></paragraph></subsection>
<subsection id="id8ACB3A6AB0A1475B8D1A48F77996A31B"><enum>(b)</enum><header>Receipt of border patrol rate of pay</header>
<paragraph id="id71650DF413054484A21CA8EB82D5ABAD"><enum>(1)</enum><header>Voluntary election</header>
<subparagraph id="idC7FF59F2FBD34FD9A218B35065756DDE"><enum>(A)</enum><header>In general</header><text>Not later than 30 days before the first day of each year beginning after the date of enactment of this section, a border patrol agent shall make an election whether the border patrol agent shall, for the following year—</text>
<clause id="idC7DFA29A870E4162B904CAF95B9FA54C"><enum>(i)</enum><text>be assigned to the level 1 border patrol rate of pay;</text></clause>
<clause id="id11055D557EED471E9733966AEA4E85A9"><enum>(ii)</enum><text>be assigned the level 2 border patrol rate of pay; or</text></clause>
<clause id="id9E60B46B31304AE4BB418AB35895D32B"><enum>(iii)</enum><text>decline to be assigned the level 1 border patrol rate of pay or the level 2 border patrol rate of pay.</text></clause></subparagraph>
<subparagraph id="id9411B7C6967749358274D911788C5E7E"><enum>(B)</enum><header>Procedures</header><text>The Director of the Office of Personnel Management shall establish procedures for elections under subparagraph (A).</text></subparagraph>
<subparagraph id="id77E48B7FC8F744E1AFFB5D62BA53D2D3"><enum>(C)</enum><header>Information regarding election</header><text>Not later than 60 days before the first day of each year beginning after the date of enactment of this section, U.S. Customs and Border Protection shall provide each border patrol agent with information regarding each type of election available under subparagraph (A) and how to make such an election.</text></subparagraph>
<subparagraph id="id0E4102EC916E4814846AB7D3B163E602"><enum>(D)</enum><header>Failure to elect</header><text>A border patrol agent who fails to make a timely election under subparagraph (A) shall be deemed to have made an election to be assigned to the level 1 border patrol rate of pay under subparagraph (A)(i).</text></subparagraph>
<subparagraph id="idC27B348813CD4CC2BE7F912D02F1FABC"><enum>(E)</enum><header>Sense of Congress</header><text>It is the sense of Congress that U.S. Customs and Border Protection should take such action as is necessary to ensure that not more than 10 percent of the border patrol agents stationed at a location decline to be assigned to the level 1 border patrol rate of pay or the level 2 border patrol rate of pay.</text></subparagraph></paragraph>
<paragraph id="id708BDFA0F427432B93047FDD61FFCBB1"><enum>(2)</enum><header>Level 1 border patrol rate of pay</header><text>For a border patrol agent who has in effect an election under paragraph (1)(A)(i)—</text>
<subparagraph id="id72AE99AD2B5F4E7A95B7BC45C3986FFC"><enum>(A)</enum><text>the border patrol agent shall be scheduled to work, for 5 days per week—</text>
<clause id="id7AEC8D9B19F346B9A05CF86BD2FE177E"><enum>(i)</enum><text>8 hours of regular time per day; and</text></clause>
<clause id="idE03C65835B2E479E9A5FB75B563165DF"><enum>(ii)</enum><text>2 additional hours of scheduled overtime during each day the border patrol agent is scheduled to work under clause (i);</text></clause></subparagraph>
<subparagraph id="id19E39731A0CB49129264B6E811D475CF"><enum>(B)</enum><text>for the hours of regular time work described in subparagraph (A)(i), the border patrol agent shall receive pay at the level 1 border patrol rate of pay;</text></subparagraph>
<subparagraph id="id850663D418624649B8F83D3FAAE7E1D3"><enum>(C)</enum><text>for the hours of regularly scheduled overtime work described in subparagraph (A)(ii), the border patrol agent shall not receive—</text>
<clause id="idA3186A9F533247F9AF3D7DF72AF751DA"><enum>(i)</enum><text>additional compensation under this section or any other provision of law; or</text></clause>
<clause id="id44BEA160EAD6447A8B6802D553F7F344"><enum>(ii)</enum><text>compensatory time off;</text></clause></subparagraph>
<subparagraph id="id0BD73DFDFF2A4DA6ACBDDAAFA692DE07"><enum>(D)</enum><text>any hours during which the border patrol agent is available to work during a work period shall be included in the hours of regular time or regularly scheduled overtime scheduled under subparagraph (A);</text></subparagraph>
<subparagraph id="idB98AC93615CC48D6A379A9DCF1E068AC"><enum>(E)</enum><text>shall receive compensatory time off or pay at the overtime hourly rate of pay for hours of work in excess of 100 hours during a work period, as determined in accordance with section 5542(a)(7); and</text></subparagraph>
<subparagraph id="id00f65e1fa9484766a2f7d176fcd64bfb"><enum>(F)</enum><text>shall be charged leave in increments of 8 hours for 1 shift of leave, regardless of the length of the shift.</text></subparagraph></paragraph>
<paragraph id="idDB7AC57D88854E018E606CA72BCCC637"><enum>(3)</enum><header>Level 2 border patrol rate of pay</header><text>For a border patrol agent who has in effect an election under paragraph (1)(A)(ii)—</text>
<subparagraph id="id9CC739ED03474B5492FCF0FD2B453697"><enum>(A)</enum><text>the border patrol agent shall be scheduled to work, for 5 days per week—</text>
<clause id="id2D1BA0C34B37449F8921E20E2C30826E"><enum>(i)</enum><text>8 hours of regular time per day; and</text></clause>
<clause id="id8BA07C6AEF7C4A888A20E17E3FF7ED0E"><enum>(ii)</enum><text>1 additional hour of scheduled overtime during each day the border patrol agent is scheduled to work under clause (i);</text></clause></subparagraph>
<subparagraph id="id31A3AAD4515E4C0A961CF672FCB48546"><enum>(B)</enum><text>for the hours of regular time work described in subparagraph (A)(i), the border patrol agent shall receive pay at the level 2 border patrol rate of pay;</text></subparagraph>
<subparagraph id="idDAB5F6FF8A894454BE6E08F0DED5579B"><enum>(C)</enum><text>for the hours of regularly scheduled overtime work described in subparagraph (A)(ii), the border patrol agent shall not receive—</text>
<clause id="id6F363D7FE19547989FACDE8551478C10"><enum>(i)</enum><text>additional compensation under this section or any other provision of law; or</text></clause>
<clause id="id930D11EBFE81440BA0D52108F9851308"><enum>(ii)</enum><text>compensatory time off;</text></clause></subparagraph>
<subparagraph id="id6B7D935BDB174795A9FA31055F6D6EA9"><enum>(D)</enum><text>any hours during which the border patrol agent is available to work during a work period shall be included in the hours of regular time or regularly scheduled overtime scheduled under subparagraph (A);</text></subparagraph>
<subparagraph id="id4792E6C2453842ABB01A81128B21FAF7"><enum>(E)</enum><text>shall receive compensatory time off or pay at the overtime hourly rate of pay for hours of work in excess of 90 hours during a work period, as determined in accordance with section 5542(a)(7); and</text></subparagraph>
<subparagraph id="idD445A9F22497408AA30F7F38A8FDFD7B"><enum>(F)</enum><text>shall be charged leave in increments of 8 hours for 1 shift of leave, regardless of the length of the shift.</text></subparagraph></paragraph>
<paragraph id="idC7352844360647C785FB82979F830807"><enum>(4)</enum><header>Basic border patrol rate of pay</header><text>For a border patrol agent who has in effect an election under paragraph (1)(A)(iii)—</text>
<subparagraph id="id343A0EA64298436FB129E9C242588A4C"><enum>(A)</enum><text>the border patrol agent shall be scheduled to work 8 hours of regular time per day and 5 days per week;</text></subparagraph>
<subparagraph id="id8F03BD5773F54E139C2B211CE75B66FC"><enum>(B)</enum><text>any hours during which the border patrol agent is available to work during a work period shall be included in the hours of regular time scheduled under subparagraph (A); and</text></subparagraph>
<subparagraph id="id9940855AB6514C3DBD0216B400ECB312"><enum>(C)</enum><text>the border patrol agent shall receive compensatory time off or pay at the overtime hourly rate of pay for hours of work in excess of 80 hours during a work period, as determined in accordance with section 5542(a)(7).</text></subparagraph></paragraph></subsection>
<subsection id="id5B294E6799CF4E3D8AB0CC06BD2C2586"><enum>(c)</enum><header>Eligibility for other premium pay</header><text>A border patrol agent—</text>
<paragraph id="idC8CB09DCAC454E0DBC0C9DA72D1588D7"><enum>(1)</enum><text>shall receive premium pay for night work in accordance with subsections (a) and (b) of section 5545 and Sunday and holiday pay in accordance with section 5546, without regard to the election of the border patrol agent under subsection (b)(1)(A), except that section 5546(d) shall not apply and eligibility for pay for, and the rate of pay for, any overtime work shall be determined in accordance with this section and section 5542(a)(7); and</text></paragraph>
<paragraph id="idD6E3CF132AA74F5AB93707FE0B6895BA"><enum>(2)</enum><text>shall not be eligible for any other form of premium pay under this title, except as provided in section 5542(a)(7).</text></paragraph></subsection>
<subsection id="id24A413FBA7044836BAD3A0A682D05194"><enum>(d)</enum><header>Treatment as basic pay</header><text>Any pay received at the level 1 border patrol rate of pay or the level 2 border patrol rate of pay or pay described in subsection (b)(3)(B) shall be treated as part of basic pay for—</text>
<paragraph id="idD87655EDA70042468D58C9DE78A380BB"><enum>(1)</enum><text>purposes of sections 5595(c), 8114(e), 8331(3), and 8704(c);</text></paragraph>
<paragraph id="idAF21E649C11D4054B8A32B1CE9FF05C5"><enum>(2)</enum><text>any other purpose that the Office of Personnel Management may by regulation prescribe; and</text></paragraph>
<paragraph id="idF9C9535F72D24CA38283983CCD8D5F77"><enum>(3)</enum><text>any other purpose expressly provided for by law.</text></paragraph></subsection>
<subsection id="idA5488D0FD69D4CE9A77726732EF5E538"><enum>(e)</enum><header>Authority To require overtime work</header><text>Nothing in this section shall be construed to limit the authority of U.S. Customs and Border Protection to require a border patrol agent to perform hours of overtime work in accordance with the needs of U.S. Customs and Border Protection, including if needed in the event of a local or national emergency.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="id62DB853ABC774F0B90CFD997DFDD6B2C"><enum>(c)</enum><header>Overtime work</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/5542">Section 5542(a)</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text>

<paragraph id="idD965B1504D0440AD9199EDFCA410C896" indent="up1"><enum>(7)</enum>
<subparagraph commented="no" display-inline="yes-display-inline" id="id49A2714E9B9D4A1684EF78392DBB42E8"><enum>(A)</enum><text>In this paragraph, the term <term>border patrol agent</term> has the meaning given that term in section 5550.</text></subparagraph>
<subparagraph id="idFA2A07FE3C5B4851921EB3C7519B0E29" indent="up1"><enum>(B)</enum><text>Notwithstanding the matter preceding paragraph (1) or paragraphs (1) and (2), for a border patrol agent who has in effect an election to be assigned to the level 1 border patrol rate of pay under section 5550(b)(1)(A)(i)—</text>
<clause id="idD9A057B1A927462BB3BF24F36F5A81F5"><enum>(i)</enum><text>except as provided in subparagraph (E), hours of work in excess of 100 hours during a 14-day biweekly pay period shall be overtime work; and</text></clause>
<clause id="id7FDBD22EC92F440AA90FDC249BFCF350"><enum>(ii)</enum><text>the border patrol agent—</text>
<subclause id="idDAA1C59C82074A89B9775A914896A787"><enum>(I)</enum><text>shall receive pay at the overtime hourly rate of pay (as determined in accordance with paragraphs (1) and (2)) for hours of overtime work that are officially ordered or approved in advance of the work assignment; and</text></subclause>
<subclause id="idA9170C33961B4E48BB2CED224339D705"><enum>(II)</enum><text>shall receive compensatory time off for any hours of overtime work that are not hours of overtime work described in subclause (I).</text></subclause></clause></subparagraph>
<subparagraph id="idCA3B7361F82E4448B4A0400840DB8B2B" indent="up1"><enum>(C)</enum><text>Notwithstanding the matter preceding paragraph (1) or paragraphs (1) and (2), for a border patrol agent who has in effect an election to be eligible for the level 2 border patrol rate of pay under section 5550(b)(1)(A)(ii)—</text>
<clause id="idC568E08AEA2F48D8A44F0907BB0BBDF8"><enum>(i)</enum><text>except as provided in subparagraph (E), hours of work in excess of 90 hours during a 14-day biweekly pay period shall be overtime work; and</text></clause>
<clause id="id766476A5B38748429BB0B760F47005B4"><enum>(ii)</enum><text>the border patrol agent—</text>
<subclause id="idF156477F62064AF3B14F94B4DB56E042"><enum>(I)</enum><text>shall receive pay at the overtime hourly rate of pay (as determined in accordance with paragraphs (1) and (2)) for hours of overtime work that are officially ordered or approved in advance of the work assignment; and</text></subclause>
<subclause id="id69C3C84DB7964E1C90224A130D4296F4"><enum>(II)</enum><text>shall receive compensatory time off for any hours of overtime work that are not hours of overtime work described in subclause (I).</text></subclause></clause></subparagraph>
<subparagraph id="idFDA7B6FDC2AA4607AC36806ABB4F8081" indent="up1"><enum>(D)</enum><text>Notwithstanding the matter preceding paragraph (1) or paragraphs (1) and (2), for a border patrol agent who has in effect an election under section 5550(b)(1)(A)(iii)—</text>
<clause id="idD927931EFA534FF9836E7DFCADA3EC61"><enum>(i)</enum><text>except as provided in subparagraph (E), hours of work in excess of 80 hours during a 14-day biweekly pay period shall be overtime work; and</text></clause>
<clause id="idCF9C25BDE44749DBA5B69AE3046E016C"><enum>(ii)</enum><text>the border patrol agent—</text>
<subclause id="id3FA54EC6FC3F4B958135839279BABDA5"><enum>(I)</enum><text>shall receive pay at the overtime hourly rate of pay (as determined in accordance with paragraphs (1) and (2)) for hours of overtime work that are officially ordered or approved in advance of the work assignment; and</text></subclause>
<subclause id="id3E0E51157FC74130801A0EE7E9C96AAC"><enum>(II)</enum><text>shall receive compensatory time off for any hours of overtime work that are not hours of overtime work described in subclause (I).</text></subclause></clause></subparagraph>
<subparagraph id="id1EB87F97B4F84437BD45574116C7F44C" indent="up1"><enum>(E)</enum>
<clause commented="no" display-inline="yes-display-inline" id="id8E347984C34E441B881D9C0D560CF27F"><enum>(i)</enum><text>Except as provided in clause (ii), during a 14-day biweekly pay period, a border patrol agent shall not perform and may not receive compensatory time off for more than 8 hours of overtime work.</text></clause>
<clause id="id1e8a93ec093e41e9822d7589d9b0b89a" indent="up1"><enum>(ii)</enum><text>U.S. Customs and Border Protection may, as it determines appropriate, waive the limitation under clause (i) for hours of overtime work, but such waiver must be approved in advance of any work being performed that would be subject to compensatory time under subsection (B)(ii)(II), (C)(ii)(II), or (D)(ii)(II).</text></clause></subparagraph>
<subparagraph id="id78CF199F70A54E85881CABF551C87FC9" indent="up1"><enum>(F)</enum><text>A border patrol agent—</text>
<clause id="id32CDE42911D449F9A69A29D80DF7C9E8"><enum>(i)</enum><text>may not earn more than 240 hours of compensatory time off during a year; and</text></clause>
<clause id="idB7FB069F56734F0CBAAE4B9C59B06502"><enum>(ii)</enum><text>shall use any hours of compensatory time off not later than 1 year after the date on which the compensatory time off is accrued.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="id9FC2DB5F54F447BBADEE14529991E55F"><enum>(d)</enum><header>Technical and conforming amendments</header>
<paragraph id="id0B464AC22A86405B9DA217EB0A001120"><enum>(1)</enum><text>Section 13(a) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/213">29 U.S.C. 213(a)</external-xref>) is amended—</text>
<subparagraph id="id5BA548BE44294A5C8198AD2A69B5E990"><enum>(A)</enum><text>in paragraph (16), by striking <quote>or</quote> after the semicolon;</text></subparagraph>
<subparagraph id="idF9924EADE6EF4B7F867462DA140A63CA"><enum>(B)</enum><text>in paragraph (17), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph>
