		  provide enhanced penalties for marketing controlled substances to
		  minors.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section commented="no" display-inline="no-display-inline" id="idb1b903ca-7df6-4487-916d-3668375585a6" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Saving Kids From Dangerous Drugs Act
			 of 2013</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id7a51d5d8-5d84-49f3-8396-c029ffa7c571" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Offenses involving controlled substances
			 marketed to minors</header><text display-inline="no-display-inline">Section 401
			 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841</external-xref>) is amended by adding at the
			 end the following:</text><quoted-block display-inline="no-display-inline" id="idC80CF813DA8E4D2C92EA4567510AC9E4" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="idb57d6369-b21b-4d6b-ac24-05c8ad6f86f9"><enum>(i)</enum><header display-inline="yes-display-inline">Offenses involving controlled substances
				marketed to minors</header><paragraph commented="no" display-inline="no-display-inline" id="id0be57456-75e8-47c3-a413-3804fb347262"><enum>(1)</enum><header display-inline="yes-display-inline">Unlawful act</header><text display-inline="yes-display-inline">Except as authorized under this title,
				including paragraph (3), it shall be unlawful for any person at least 18 years
				of age to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3C847FA483244BFF8640C4FA2AA85051"><enum>(A)</enum><text display-inline="yes-display-inline">knowingly or intentionally manufacture or
				create a controlled substance listed in schedule I or II that is—</text><clause commented="no" display-inline="no-display-inline" id="id9f3f5a1f-e23f-4c72-ad1c-b8e45396c188"><enum>(i)</enum><text display-inline="yes-display-inline">combined with a beverage or candy
				product;</text></clause><clause commented="no" display-inline="no-display-inline" id="id7aa8328f-7b5d-40ce-bc61-e3c62891e7e8"><enum>(ii)</enum><text display-inline="yes-display-inline">marketed or packaged to appear similar to a
				beverage or candy product; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id99f77a35-f4d1-4a7a-9f56-3f062288b641"><enum>(iii)</enum><text display-inline="yes-display-inline">modified by flavoring or coloring;
				and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id18F581B9FA6A4678A4E6DDACA2E64BD1"><enum>(B)</enum><text>know, or have
				reasonable cause to believe, that the combined, marketed, packaged, or modified
				controlled substance will be distributed, dispensed, or sold to a person under
				18 years of age.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5a7968a1-80c9-47cf-adde-d94521c2982f"><enum>(2)</enum><header display-inline="yes-display-inline">Penalties</header><text display-inline="yes-display-inline">Except as provided in section 418, 419, or
				420, any person who violates paragraph (1) of this subsection shall be subject
				to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id8ffd35d4-8f31-4eab-8249-d76c1dabba8e"><enum>(A)</enum><text display-inline="yes-display-inline">an additional term of imprisonment of not
				more than 10 years for a first offense involving the same controlled substance
				and schedule; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3009bf96-ab16-4068-b3cb-4fd7df84fadb"><enum>(B)</enum><text display-inline="yes-display-inline">an additional term of imprisonment of not
				more than 20 years for a second or subsequent offense involving the same
				controlled substance and schedule.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id907693c1-a710-4a2b-9469-50351c2d7f78"><enum>(3)</enum><header display-inline="yes-display-inline">Exceptions</header><text display-inline="yes-display-inline">Paragraph (1) shall not apply to any
				controlled substance that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id8a18c18e-314e-42f0-b2b2-2cf463864704"><enum>(A)</enum><text display-inline="yes-display-inline">has been approved by the Secretary under
				section 505 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355</external-xref>), if the
				contents, marketing, and packaging of the controlled substance have not been
				altered from the form approved by the Secretary; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id38c39bd0-74ce-4ce8-94f9-0f7b20882720"><enum>(B)</enum><text display-inline="yes-display-inline">has been altered at the direction of a
				practitioner who is acting for a legitimate medical purpose in the usual course
				of professional
				practice.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" id="id11CC67331A824A219B666D39228604BC" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Sentencing Guidelines</header><text display-inline="no-display-inline">Pursuant to its authority under section 994
			 of title 28, United States Code, and in accordance with this section, the
			 United States Sentencing Commission shall review its guidelines and policy
			 statements to ensure that the guidelines provide an appropriate additional
			 penalty increase to the sentence otherwise applicable in Part D of the
			 Guidelines Manual if the defendant was convicted of a violation of section
			 401(i) of the Controlled Substances Act, as added by section 2 of this
			 Act.</text></section></legis-body></bill>
