<distribution-code display="yes">II</distribution-code><congress>113th CONGRESS</congress><session>1st Session</session><legis-num>S. 1682</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20131112">November 12, 2013</action-date><action-desc><sponsor name-id="S309">Mr. Casey</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 38, United States Code, to make certain clarifications and improvements in the academic and vocational counseling programs administered by the Secretary of Veterans Affairs, and for other purposes.</official-title></form><legis-body id="HCC6B5D23E4F24958A72C6CF45C6EAB04" style="OLC"><section id="H135F3073D2F34C058A2933D58AAEDD25" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Education Counseling Act of 2013</short-title></quote>.</text></section><section id="HC47F46CD3B344839BD58752A0AFF9265" section-type="subsequent-section"><enum>2.</enum><header>Clarification and improvement of the provision of academic and vocational counseling to eligible veterans by the Secretary of Veterans Affairs</header><subsection id="H53D4D209369C452E90596CE2901C5E68"><enum>(a)</enum><header>Academic Counseling and Educational Information Service</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/3697A">Section 3697A</external-xref> of title 38, United States Code, is amended—</text><paragraph id="HAD5C31A9614343E7858FA64B03F91C43"><enum>(1)</enum><text>in subsection (a), by striking <quote>counseling services, including</quote> and inserting <quote>a program of counseling services, to be known as the <term>Academic Counseling and Educational Information Service</term>. Such counseling services shall include</quote>;</text></paragraph><paragraph id="H57987BD74A3B450687C25A2F7192B9D4"><enum>(2)</enum><text>in subsection (e)—</text><subparagraph id="id0C26162B12EC46E1A619A4CDC0551BE9"><enum>(A)</enum><text>by inserting <quote>(1)</quote> before <quote>The Secretary shall</quote>; and</text></subparagraph><subparagraph id="id16F585C0BE22440DB0399F9F949F3DD0"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idEB0B7EAABE4D4FF187908FA1354185CD" style="OLC"><paragraph id="id7FEF635C6ECB427BA1C4179DD5DC4C38" indent="up1"><enum>(2)</enum><text>In making such information available under this subsection, the Secretary shall make available information about the definitions, eligibility requirements, and services provided under this section and information about how the counseling services provided under this section differ from the services provided under section 3104(a)(2) of this title.</text></paragraph><paragraph id="id3A0E0039D60F4AA2954614F634D80892" indent="up1"><enum>(3)</enum><text>At a minimum, the Secretary shall make such information available to an individual described in subsection (b) before the individual applies for educational assistance described in subsection (b)(1).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H05AEEA36DE3746C4BD5F81B2FFB98DA1"><enum>(3)</enum><text>by adding at the end the following new subsections:</text><quoted-block display-inline="no-display-inline" id="HE44EE9B7F2894F94B4C86D4C69EF7E4D" style="USC"><subsection id="H1EB86D8BF7D54DAFABE6847D9C618034"><enum>(f)</enum><text display-inline="yes-display-inline">The Secretary shall maintain an Internet website on which—</text><paragraph id="H9E1B015B06E84104875FD5A6A7C828D2"><enum>(1)</enum><text>a person is able to request counseling services under this section in such a manner that clearly distinguishes such services from counseling services available under section 3104(a)(2) of this title; and</text></paragraph><paragraph id="H4D777249563243E3987913516AA83204"><enum>(2)</enum><text display-inline="yes-display-inline">an individual receiving counseling services under this section is able to receive such services using a web-based counseling tool and to confidentially access aptitude tests.</text></paragraph></subsection><subsection id="H8370081227B34E23BA8D59B12CB9B63F"><enum>(g)</enum><text display-inline="yes-display-inline">The primary goal of the counseling services provided under this section is to provide to individuals assistance in—</text><paragraph id="H9964293A910142EBB12E1B7A939B6D4B"><enum>(1)</enum><text>pursuing postsecondary education and training opportunities;</text></paragraph><paragraph id="HB92E7EC8C9E442418098E2407266F26A"><enum>(2)</enum><text>obtaining information regarding available postsecondary educational and training opportunities;</text></paragraph><paragraph id="H7CDBE97B944444C0A80EF637723F4822"><enum>(3)</enum><text>obtaining career-related information and data on available postsecondary educational and training opportunities;</text></paragraph><paragraph id="HC40EF3A32A564534BAE50D5E72DC2BF9"><enum>(4)</enum><text>selecting a program of education or training; and</text></paragraph><paragraph id="H8E80BADF9D8B4A1C81323D342287BBD9"><enum>(5)</enum><text>addressing other needs relating to education.</text></paragraph></subsection><subsection id="HBCEEFC6CF8EE4918B9DBA5C06236B0DD"><enum>(h)</enum><text>Services provided under this section are different from the services provided under section 3104(a)(2) of this title and do not involve rehabilitation services.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HAD304EDEE0844394AA32E8268206616A"><enum>(b)</enum><header>Vocational rehabilitation counseling</header><paragraph id="H5A2254E54D574C6390BB589EE9D03361"><enum>(1)</enum><header>Electronic application</header><text display-inline="yes-display-inline">Section 3102 of such title is amended by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="HC579867E41704E509E8DED917BBF1087" style="USC"><subsection id="HAA6FD2A5FD8040A0822CE7828D619B5F"><enum>(c)</enum><header>Electronic application for benefits</header><text>The Secretary shall maintain an Internet website on which a person is able to submit an application for benefits under this chapter.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H1B1118F1C5BA44E19EF4C7B5B9B0AB92"><enum>(2)</enum><header>Clarification regarding eligibility</header><text>Veterans are only eligible for counseling services provided under <external-xref legal-doc="usc" parsable-cite="usc/38/3104">section 3104(a)(2)</external-xref> of title 38, United States Code, if they are entitled to a rehabilitation program under chapter 31 of such title. Not all veterans who are transitioning from service on active duty in the Armed Forces are eligible for such services.</text></paragraph><paragraph id="H5A0307908F4848AFB1C2CDF1FD3786C8"><enum>(3)</enum><header>Goal of program</header><text display-inline="yes-display-inline">The primary goal of the counseling services provided under <external-xref legal-doc="usc" parsable-cite="usc/38/3104">section 3104(a)(2)</external-xref> of title 38, United States Code, is to help veterans eligible for such services to prepare for, obtain, and retain employment.</text></paragraph></subsection></section></legis-body></bill>
