		electricity standard</header><subsection id="HBBFCA2384FB24712BAF02616D73300DC"><enum>(a)</enum><header>In
		general</header><text display-inline="yes-display-inline">Title VI of the
		Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2601">16 U.S.C. 2601 et seq.</external-xref>) is
		amended by adding at the end the following:</text><quoted-block id="H22501F749D9D4F16BE70B7F9939F6C96"><section id="HDEEEE375558642FDA6006FD829880068"><enum>610.</enum><header>Renewable
		  electricity standard</header><subsection id="H635CB49B0524474BBD36938E08CE104E"><enum>(a)</enum><header>Definitions</header><text>In
		  this section:</text><paragraph id="H87B0906E382744B78F595D2272E5D189"><enum>(1)</enum><header>Base quantity of
		  electricity</header><subparagraph id="idA7F93E39E8654B648356573125B088B7"><enum>(A)</enum><header>In
		  general</header><text>The term <term>base quantity of electricity</term> means
		  the total quantity of electric energy sold by a retail electric supplier,
		  expressed in terms of kilowatt hours, to electric customers for purposes other
		  than resale during the most recent calendar year for which information is
		  available.</text></subparagraph><subparagraph id="id2546B0725BDB4760BBC604FF555A630E"><enum>(B)</enum><header>Exclusions</header><text>The
		  term <term>base quantity of electricity</term> does not include—</text><clause id="HC9445CB807994B05AF50B551C6AFE42D"><enum>(i)</enum><text display-inline="yes-display-inline">electric energy that is not incremental
		  hydropower generated by a hydroelectric facility; and</text></clause><clause id="HF90476C302144198AFBEFF5FE5A90076"><enum>(ii)</enum><text display-inline="yes-display-inline">electricity generated through the
		  incineration of municipal solid waste.</text></clause></subparagraph></paragraph><paragraph id="HBA325EBADF1A484B000662AB00C2B730"><enum>(2)</enum><header>Biomass</header><subparagraph id="H1D39728042A94BF9006477EBF953F007"><enum>(A)</enum><header>In
		  general</header><text>The term <term>biomass</term> means—</text><clause id="HEB73C6EFD9234C53A8D326AB6CDB2261"><enum>(i)</enum><text>cellulosic (plant
		  fiber) organic materials from a plant that is planted for the purpose of being
		  used to produce energy;</text></clause><clause id="H24B6B55B8FCB491E8E0047DEFE960088"><enum>(ii)</enum><text>nonhazardous
		  plant or algal matter that is derived from—</text><subclause id="H147A3604638E404C00F3AE002400572B"><enum>(I)</enum><text>an
		  agricultural crop, crop byproduct, or residue resource; or</text></subclause><subclause id="H80D1888193BD4878AF907FAC5303E94C"><enum>(II)</enum><text display-inline="yes-display-inline">waste, such as landscape or right-of-way
		  trimmings (but not including municipal solid waste, recyclable postconsumer
		  waste paper, painted, treated, or pressurized wood, wood contaminated with
		  plastic, or metals);</text></subclause></clause><clause id="H43E29A834897423494BC5AF687F82F3"><enum>(iii)</enum><text display-inline="yes-display-inline">animal waste or animal byproducts;
		  and</text></clause><clause id="H9209234BEA9B4B66A3FBC6FA56AA9F11"><enum>(iv)</enum><text>landfill
		  methane.</text></clause></subparagraph><subparagraph id="H24EB5C076B0F4E86929DDF9428881E85"><enum>(B)</enum><header>National forest
		  land and certain other public land</header><text display-inline="yes-display-inline">In the case of organic material removed
		  from National Forest System land or from public land administered by the
		  Secretary of the Interior, the term <term>biomass</term> means only organic
		  material from—</text><clause id="id0155DED75D77461890E5A43B6C97F1B9"><enum>(i)</enum><text display-inline="yes-display-inline">ecological forest restoration;</text></clause><clause id="id63737EA6ED6A4ED69E5DD8772C17D42B"><enum>(ii)</enum><text display-inline="yes-display-inline">precommercial thinnings;</text></clause><clause id="id794BF07432D74D238168BB256253F69E"><enum>(iii)</enum><text display-inline="yes-display-inline">brush;</text></clause><clause id="idAC1849598B6445BEA3E2444984CDCB78"><enum>(iv)</enum><text display-inline="yes-display-inline">mill residues; or</text></clause><clause id="id1B5F132DB615459DA5D8642752755262"><enum>(v)</enum><text display-inline="yes-display-inline">slash.</text></clause></subparagraph><subparagraph id="H2214698FA2C447FE8978DC98EBF773C5"><enum>(C)</enum><header>Exclusion of
		  certain Federal land</header><text display-inline="yes-display-inline">Notwithstanding subparagraph (B), the term
		  <term>biomass</term> does not include material or matter that would otherwise
		  qualify as biomass if the material or matter is located on the following
		  Federal land:</text><clause id="H23A569DDD89342B79100E93F8B013D3B"><enum>(i)</enum><text display-inline="yes-display-inline">Federal land containing old growth forest
		  or late successional forest unless the Secretary of the Interior or the
		  Secretary of Agriculture determines that the removal of organic material from
		  the land—</text><subclause id="idAF75028900BE4951B1B49AE26C7EF4A7"><enum>(I)</enum><text display-inline="yes-display-inline">is appropriate for the applicable forest
		  type; and</text></subclause><subclause id="id326CF4DE7ED348D399488F163AD157C1"><enum>(II)</enum><text display-inline="yes-display-inline">maximizes the retention of—</text><item id="id48CA360A28B6435F93B47677750D3DDB"><enum>(aa)</enum><text display-inline="yes-display-inline">late-successional and large and old growth
		  trees;</text></item><item id="idAF4CA0831B4A47AD91D3D2C60EC48AD6"><enum>(bb)</enum><text display-inline="yes-display-inline">late-successional and old growth forest
		  structure; and</text></item><item id="idB3FFE914F4474C6DA455DF59B8FB8391"><enum>(cc)</enum><text display-inline="yes-display-inline">late-successional and old growth forest
		  composition.</text></item></subclause></clause><clause id="H6D76A4DBE8AF498FA6F76B7CEF4F9BC6"><enum>(ii)</enum><text display-inline="yes-display-inline">Federal land on which the removal of
		  vegetation is prohibited, including components of the National Wilderness
		  Preservation System.</text></clause><clause id="H25E91C0EC6204D68A28306D01EFD9E39"><enum>(iii)</enum><text display-inline="yes-display-inline">Wilderness study areas.</text></clause><clause id="H11E8E336133D45D4956EC9C569439E33"><enum>(iv)</enum><text display-inline="yes-display-inline">Inventoried roadless areas.</text></clause><clause id="H8E5C85746E1446F291F4D600CF417E82"><enum>(v)</enum><text display-inline="yes-display-inline">Components of the National Landscape
		  Conservation System.</text></clause><clause id="H6252DE0E2B8F4CA18455427D5DB5E96"><enum>(vi)</enum><text display-inline="yes-display-inline">National Monuments.</text></clause></subparagraph></paragraph><paragraph id="H6F926C0A9F194D1584D2FC2B96FFA067"><enum>(3)</enum><header>Existing
		  facility</header><text>The term <term>existing facility</term> means a facility
		  for the generation of electric energy from a renewable energy resource that is
		  not an eligible facility.</text></paragraph><paragraph id="HFB3C11D38FB143AEA39B35A4CFA5500"><enum>(4)</enum><header>Incremental
		  hydropower</header><text display-inline="yes-display-inline">The term
		  <term>incremental hydropower</term> means additional generation that is
		  achieved from increased efficiency or additions of capacity made on or
		  after—</text><subparagraph id="id6C8A5741EDA44E168364B8F37161C524"><enum>(A)</enum><text display-inline="yes-display-inline">the date of enactment of this section;
		  or</text></subparagraph><subparagraph id="idF7708B9347BC49738D20006EA25EB531"><enum>(B)</enum><text display-inline="yes-display-inline">the effective date of an existing
		  applicable State renewable portfolio standard program at a hydroelectric
		  facility that was placed in service before that date.</text></subparagraph></paragraph><paragraph id="H8A5F90DBD85C495987F9062801D28EB9"><enum>(5)</enum><header>Indian
		  land</header><text>The term <term>Indian land</term> means—</text><subparagraph id="HB441E3643AC04E9F87D59E6200BAFA03"><enum>(A)</enum><text>any land within
		  the limits of any Indian reservation, pueblo, or rancheria;</text></subparagraph><subparagraph id="H0FC2BF4A04CA47888E0072FFAA861C2E"><enum>(B)</enum><text>any land not
		  within the limits of any Indian reservation, pueblo, or rancheria title to
		  which on the date of enactment of this section was held by—</text><clause id="id5A40D545ACFC452EAE780D3BC8E8F500"><enum>(i)</enum><text>the
		  United States for the benefit of any Indian tribe or individual; or</text></clause><clause id="idB3A51540AB0D403FB7B574232D0A5F63"><enum>(ii)</enum><text>any
		  Indian tribe or individual subject to restriction by the United States against
		  alienation;</text></clause></subparagraph><subparagraph id="HA661592B19324B41B048406DB1199162"><enum>(C)</enum><text>any dependent
		  Indian community; or</text></subparagraph><subparagraph id="H454B170FFD2742129C96071799E904FE"><enum>(D)</enum><text>any land conveyed
		  to any Alaska Native corporation under the Alaska Native Claims Settlement Act
		  (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph id="HD9984C917FE440339B4563D433A2E1A6"><enum>(6)</enum><header>Indian
		  tribe</header><text>The term <term>Indian tribe</term> means any Indian tribe,
		  band, nation, or other organized group or community, including any Alaskan
		  Native village or regional or village corporation as defined in or established
		  pursuant to the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>),
		  that is recognized as eligible for the special programs and services provided
		  by the United States to Indians because of their status as Indians.</text></paragraph><paragraph id="H4182279382974C9AA2F42E1587E809A"><enum>(7)</enum><header>Renewable
		  energy</header><text>The term <term>renewable energy</term> means electric
		  energy generated by a renewable energy resource.</text></paragraph><paragraph id="H3EAEB4E30A1E4A8D82DB6C2366EF1D59"><enum>(8)</enum><header>Renewable energy
		  resource</header><text display-inline="yes-display-inline">The term
		  <term>renewable energy resource</term> means solar, wind, ocean, tidal,
		  geothermal energy, biomass, landfill gas, incremental hydropower, or
		  hydrokinetic energy.</text></paragraph><paragraph id="HA39E6D67CCD44FCE9FE97C9C970398C"><enum>(9)</enum><header>Repowering or
		  cofiring increment</header><text>The term <term>repowering or cofiring
		  increment</term> means—</text><subparagraph id="H12A4CAE6F6C241EFADE9916E2DF787C9"><enum>(A)</enum><text>the additional
		  generation from a modification that is placed in service on or after the date
		  of enactment of this section, to expand electricity production at a facility
		  used to generate electric energy from a renewable energy resource;</text></subparagraph><subparagraph id="H0638D3739F554A1A835082D9E8149D9F"><enum>(B)</enum><text>the additional
		  generation above the average generation during the 3-year period ending on the
		  date of enactment of this section at a facility used to generate electric
		  energy from a renewable energy resource or to cofire biomass that was placed in
		  service before the date of enactment of this section; or</text></subparagraph><subparagraph id="H385F35F8B89848CF87D61E3CF2269EB1"><enum>(C)</enum><text display-inline="yes-display-inline">the portion of the electric generation from
		  a facility placed in service on or after the date of enactment of this section,
		  or a modification to a facility placed in service before the date of enactment
		  of this section made on or after January 1, 2001, associated with cofiring
		  biomass.</text></subparagraph></paragraph><paragraph id="HFEEFE71463B04408856674CB6B964829"><enum>(10)</enum><header>Retail electric
		  supplier</header><subparagraph id="id41FD131E9E5C4099A055AB5D413072CD"><enum>(A)</enum><header>In
		  general</header><text display-inline="yes-display-inline">The term <term>retail
		  electric supplier</term> means a person that sells electric energy to electric
		  consumers that sold not less than 1,000,000
		  megawatt hours of electric energy to electric consumers for purposes other than
		  resale during the preceding calendar year.</text></subparagraph><subparagraph id="id82AA545180594C7184154B55934DB138"><enum>(B)</enum><header>Inclusion</header><text display-inline="yes-display-inline">The term <term>retail electric
		  supplier</term> includes a person that sells electric energy to electric
		  consumers that, in combination with the sales of any affiliate organized after
		  the date of enactment of this section, sells not less than 1,000,000 megawatt
		  hours of electric energy to consumers for purposes other than resale.</text></subparagraph><subparagraph id="id0B8EEFB96F934780A296754EF3479A68"><enum>(C)</enum><header>Sales to parent
		  companies or affiliates</header><text display-inline="yes-display-inline">For
		  purposes of this paragraph, sales by any person to a parent company or to other
		  affiliates of the person shall not be treated as sales to electric
		  consumers.</text></subparagraph><subparagraph id="H861881B364F34A7781DA4EE797DC34"><enum>(D)</enum><header>Governmental
		  agencies</header><clause id="idCDCDDA5D7C284765AD031A71D9064C63"><enum>(i)</enum><header>In
		  general</header><text>Except as provided in clause (ii), the term <term>retail
		  electric supplier</term> does not include—</text><subclause id="idC9BB9127EB2643B18C43861E9CBA9A20"><enum>(I)</enum><text>the United
		  States, a State, any political subdivision of a State, or any agency,
		  authority, or instrumentality of the United States, State, or political
		  subdivision; or</text></subclause><subclause id="idD2023E1CC02341A39F31B21119FA34D2"><enum>(II)</enum><text>a
		  rural electric cooperative.</text></subclause></clause><clause id="id32F7EFAAA45F41F3B9C5E78E39AA6F89"><enum>(ii)</enum><header>Inclusion</header><text>The
		  term <term>retail electric supplier</term> includes an entity that is a
		  political subdivision of  a State, or an agency, authority, or instrumentality
		  of the United States, a State, a political subdivision of a State, a rural
		  electric cooperative that sells electric energy to electric consumers, or any
		  other entity that sells electric energy to electric consumers that would not
		  otherwise qualify as a retail electric supplier if the entity notifies the
		  Secretary that the entity voluntarily agrees to participate in the Federal
		  renewable electricity standard program.</text></clause></subparagraph></paragraph></subsection><subsection id="H12316032EBFD482DA54FEFF7ACE4953"><enum>(b)</enum><header>Compliance</header><text display-inline="yes-display-inline">For calendar year 2014 and each calendar
		  year thereafter, each retail electric supplier shall meet the requirements of
		  subsection (c) by submitting to the Secretary, not later than April 1 of the
		  following calendar year, one or more of the following:</text><paragraph id="HBF94DDF9F862421593171B7993AE12FD"><enum>(1)</enum><text display-inline="yes-display-inline">Federal renewable energy credits issued
		  under subsection (e).</text></paragraph><paragraph id="HE6B632833FDB4D0293919442BCC7ECD7"><enum>(2)</enum><text display-inline="yes-display-inline">Certification of the renewable energy
		  generated and electricity savings pursuant to the funds associated with State
		  compliance payments as specified in subsection (e)(4)(G).</text></paragraph><paragraph id="H32D97238657842FB85C52DCA33148302"><enum>(3)</enum><text>Alternative
		  compliance payments pursuant to subsection (h).</text></paragraph></subsection><subsection id="idEF1CDA7CCC6F4E819CFB2F622E20D74F"><enum>(c)</enum><header>Required annual
		  percentage</header><text>For each of calendar years 2014 through 2039, the
		  required annual percentage of the base quantity of electricity of a retail
		  electric supplier that shall be generated from renewable energy resources, or
		  otherwise credited towards the percentage requirement pursuant to subsection
		  (d), shall be the applicable percentage specified in the following

		  credits</header><paragraph id="id5238DFE8A2374664A84171702E708302"><enum>(1)</enum><header>In
		  general</header><text>A retail electric supplier may satisfy the requirements
		  of subsection (b)(1) through the submission of Federal renewable energy
		  credits—</text><subparagraph id="HBCF6FDD0420949FDA9518D70B1151DDB"><enum>(A)</enum><text>issued to the
		  retail electric supplier under subsection (e);</text></subparagraph><subparagraph id="HDDCA8171996E4712B20369B180E5F799"><enum>(B)</enum><text>obtained by
		  purchase or exchange under subsection (f); or</text></subparagraph><subparagraph id="HAED0CE1F561347D0AFFBB64584F90087"><enum>(C)</enum><text>borrowed under
		  subsection (g).</text></subparagraph></paragraph><paragraph id="HD01C3385DF654B6900A77FCCE431CF94"><enum>(2)</enum><header>Federal
		  renewable energy credits</header><text display-inline="yes-display-inline">A
		  Federal renewable energy credit may be counted toward compliance with
		  subsection (b)(1) only once.</text></paragraph></subsection><subsection id="HBC35D82C70E54DC4A0C31B1FD3A7D407"><enum>(e)</enum><header>Issuance of
		  Federal renewable energy credits</header><paragraph id="id2A638256833A415B9002191BC25C71AC"><enum>(1)</enum><header>In
		  general</header><text display-inline="yes-display-inline">Not later than 1 year
		  after the date of enactment of this section, the Secretary shall establish by
		  rule a program—</text><subparagraph id="id7AC5D52F48F748259823B7FAE2370EA1"><enum>(A)</enum><text display-inline="yes-display-inline">to verify and issue Federal renewable
		  energy credits to generators of renewable energy;</text></subparagraph><subparagraph id="id9B081E9005514E05ABCF4639F8F36924"><enum>(B)</enum><text display-inline="yes-display-inline">to track the sale, exchange, and retirement
		  of the credits; and</text></subparagraph><subparagraph id="id454BD9FDFB1346BBA7D6758A185B116D"><enum>(C)</enum><text display-inline="yes-display-inline">to enforce the requirements of this
		  section.</text></subparagraph></paragraph><paragraph id="idA306CA84D5744BB591DD140E9898AFC0"><enum>(2)</enum><header>Existing
		  non-Federal tracking systems</header><text display-inline="yes-display-inline">To the maximum extent practicable, in
		  establishing the program, the Secretary shall rely on existing and emerging
		  State or regional tracking systems that issue and track non-Federal renewable
		  energy credits.</text></paragraph><paragraph id="H5E63E39E0DC74A00BC5ECD579232E5E7"><enum>(3)</enum><header>Application</header><subparagraph id="id64A5A9C86A8841348569A5A0451BDAA9"><enum>(A)</enum><header>In
		  general</header><text>An entity that generates electric energy through the use
		  of a renewable energy resource may apply to the Secretary for the issuance of
		  renewable energy credits.</text></subparagraph><subparagraph id="id8F7EE383246E43EFB3F15BCBC05B9CD7"><enum>(B)</enum><header>Eligibility</header><text>To
		  be eligible for the issuance of the credits, the applicant shall demonstrate to
		  the Secretary that—</text><clause id="id342CAB597D2749E09F879D2F14E0315A"><enum>(i)</enum><text>the
		  electric energy will be transmitted onto the grid; or</text></clause><clause id="id7F3E82C1E00049DFA7FB04E61BE35ADA"><enum>(ii)</enum><text>in
		  the case of a generation offset, the electric energy offset would have
		  otherwise been consumed onsite.</text></clause></subparagraph><subparagraph id="idF2454F41BDDB47EF8D30269C4FDD0B05"><enum>(C)</enum><header>Contents</header><text>The
		  application shall indicate—</text><clause id="HF2EE48EC378C4470A5DA45545781B74E"><enum>(i)</enum><text>the
		  type of renewable energy resource that is used to produce the
		  electricity;</text></clause><clause id="HCBAD17090D07472CB1007FC82D26858C"><enum>(ii)</enum><text>the
		  location at which the electric energy will be produced; and</text></clause><clause id="HA5E19D1A952B4C2E00925D00DD4EE9B5"><enum>(iii)</enum><text>any
		  other information the Secretary determines appropriate.</text></clause></subparagraph></paragraph><paragraph id="H9EF7E16DCDC64F1BBDF16F4C0085CE56"><enum>(4)</enum><header>Quantity of
		  Federal renewable energy credits</header><subparagraph id="H7E2DBB68F45346D8A2CCF1C3F2F17C"><enum>(A)</enum><header>In
		  general</header><text>Except as otherwise provided in this paragraph, the
		  Secretary shall issue to a generator of electric energy 1 Federal renewable
		  energy credit for each kilowatt hour of electric energy generated by the use of
		  a renewable energy resource at an eligible facility.</text></subparagraph><subparagraph id="H6C027BF4A88B4AD78F9C1574864F5220"><enum>(B)</enum><header>Incremental
		  hydropower</header><clause id="id6F03A926539E421BB2E7C7FC111C17D0"><enum>(i)</enum><header>In
		  general</header><text display-inline="yes-display-inline">For purpose of
		  compliance with this section, Federal renewable energy credits for incremental
		  hydropower shall be based on the increase in average annual generation
		  resulting from the efficiency improvements or capacity additions.</text></clause><clause id="id880C21A22DE04F16B33B508FEC8E7724"><enum>(ii)</enum><header>Water flow
		  information</header><text display-inline="yes-display-inline">The incremental
		  generation shall be calculated using the same water flow information that
		  is—</text><subclause id="id7D316387BF99459BA4ECBA2F88E8CA30"><enum>(I)</enum><text display-inline="yes-display-inline">used to determine a historic average annual
		  generation baseline for the hydroelectric facility; and</text></subclause><subclause id="id03DBF836D6094E45B3626E06989B5485"><enum>(II)</enum><text display-inline="yes-display-inline">certified by the Secretary or the Federal
		  Energy Regulatory Commission.</text></subclause></clause><clause id="idB7215D3EE1B24B51AEDBBD4FA7AA978D"><enum>(iii)</enum><header>Operational
		  changes</header><text display-inline="yes-display-inline">The calculation of
		  the Federal renewable energy credits for incremental hydropower shall not be
		  based on any operational changes at the hydroelectric facility that is not
		  directly associated with the efficiency improvements or capacity
		  additions.</text></clause></subparagraph><subparagraph id="H4116300ECD874A3594E30000435017A5"><enum>(C)</enum><header>Indian
		  land</header><clause id="id9A431E377EB9423DA4ED81D3121BA738"><enum>(i)</enum><header>In
		  general</header><text>The Secretary shall issue 2 renewable energy credits for
		  each kilowatt hour of electric energy generated and supplied to the grid in a
		  calendar year through the use of a renewable energy resource at an eligible
		  facility located on Indian land.</text></clause><clause id="idC633689AA34D400D81FAEA773E01A20B"><enum>(ii)</enum><header>Biomass</header><text>For
		  purposes of this paragraph, renewable energy generated by biomass cofired with
		  other fuels is eligible for 2 credits only if the biomass was grown on the
		  land.</text></clause></subparagraph><subparagraph id="H0DFD51BFF1464A748F98009FA59E9894"><enum>(D)</enum><header>On-site eligible
		  facilities</header><clause id="idFD59CFE1E29E4EEA8E762EBDD7DE285F"><enum>(i)</enum><header>In
		  general</header><text display-inline="yes-display-inline">In the case of
		  electric energy generated by a renewable energy resource at an on-site eligible
		  facility that is not larger than 1 megawatt in capacity and is used to offset
		  all or part of the requirements of a customer for electric energy, the
		  Secretary shall issue 3 renewable energy credits to the customer for each
		  kilowatt hour generated.</text></clause><clause id="H35FBE579DBF244D3AFD4DE4D3F84D3F0"><enum>(ii)</enum><header>Indian
		  land</header><text display-inline="yes-display-inline">In the case of an
		  on-site eligible facility on Indian land, the Secretary shall issue not more
		  than 3 credits per kilowatt hour.</text></clause></subparagraph><subparagraph id="H7DE8B1F114464EC0008488F3948BADA"><enum>(E)</enum><header>Combination of
		  renewable and nonrenewable energy resources</header><text display-inline="yes-display-inline">If both a renewable energy resource and a
		  nonrenewable energy resource are used to generate the electric energy, the
		  Secretary shall issue the Federal renewable energy credits based on the
		  proportion of the renewable energy resources used.</text></subparagraph><subparagraph id="H4519DDB1D40D4FAE8403003C50B83633"><enum>(F)</enum><header>Retail electric
		  suppliers</header><text display-inline="yes-display-inline">If a generator has
		  sold electric energy generated through the use of a renewable energy resource
		  to a retail electric supplier under a contract for power from an existing
		  facility and the contract has not determined ownership of the Federal renewable
		  energy credits associated with the generation, the Secretary shall issue the
		  Federal renewable energy credits to the retail electric supplier for the
		  duration of the contract.</text></subparagraph><subparagraph id="H8E24C17FDB294983A3ECD45C008926E0"><enum>(G)</enum><header>Compliance with
		  State renewable portfolio standard programs</header><text display-inline="yes-display-inline">Payments made by a retail electricity
		  supplier, directly or indirectly, to a State for compliance with a State
		  renewable portfolio standard program, or for an alternative compliance
		  mechanism, shall be valued at 1 credit per kilowatt hour for the purpose of
		  subsection (b)(2) based on the quantity of electric energy generation from
		  renewable resources that results from the payments.</text></subparagraph></paragraph></subsection><subsection id="H382B8A8A45404C07B365A824E2C5563D"><enum>(f)</enum><header>Renewable energy
		  credit trading</header><paragraph id="id15EE24409A3041C9BD999935E95BE011"><enum>(1)</enum><header>In
		  general</header><text>A Federal renewable energy credit may be sold,
		  transferred, or exchanged by the entity to whom the credit is issued or by any
		  other entity that acquires the Federal renewable energy credit, other than
		  renewable energy credits from existing facilities.</text></paragraph><paragraph id="id90941ADF3D7B45578D26271C2CD90E7A"><enum>(2)</enum><header>Carryover</header><text>A
		  Federal renewable energy credit for any year that is not submitted to satisfy
		  the minimum renewable generation requirement of subsection (c) for that year
		  may be carried forward for use pursuant to subsection (b)(1) within the next 3
		  years.</text></paragraph><paragraph id="H7254B25F551143478F76B441F9A1E97B"><enum>(3)</enum><header>Delegation</header><text display-inline="yes-display-inline">The Secretary may delegate to an
		  appropriate market-making entity the administration of a national tradeable
		  renewable energy credit market for purposes of creating a transparent national
		  market for the sale or trade of renewable energy credits.</text></paragraph></subsection><subsection id="H9BE364C01085466F8500F6C6DAE25671"><enum>(g)</enum><header>Renewable energy
		  credit borrowing</header><paragraph id="id51D43ABF092E4D228F32A2B0460AC2EB"><enum>(1)</enum><header>In
		  general</header><text>Not later than December 31, 2014, a retail electric
		  supplier that has reason to believe the retail electric supplier will not be
		  able to fully comply with subsection (b) may—</text><subparagraph id="HB0FF49FA26BD4B8E8F003C70D792ACB3"><enum>(A)</enum><text display-inline="yes-display-inline">submit a plan to the Secretary
		  demonstrating that the retail electric supplier will earn sufficient Federal
		  renewable energy credits within the next 3 calendar years that, when taken into
		  account, will enable the retail electric supplier to meet the requirements of
		  subsection (b) for calendar year 2014 and the subsequent calendar years
		  involved; and</text></subparagraph><subparagraph id="H472E3F6FEE4E42ECB161CA00F0C31CFC"><enum>(B)</enum><text display-inline="yes-display-inline">on the approval of the plan by the
		  Secretary, apply Federal renewable energy credits that the plan demonstrates
		  will be earned within the next 3 calendar years to meet the requirements of
		  subsection (b) for each calendar year involved.</text></subparagraph></paragraph><paragraph id="idFABD4E88DDCB4E78841DCF1E9EEE2DD6"><enum>(2)</enum><header>Repayment</header><text>The
		  retail electric supplier shall repay all of the borrowed Federal renewable
		  energy credits by submitting an equivalent number of Federal renewable energy
		  credits, in addition to the credits otherwise required under subsection (b), by
		  calendar year 2022 or any earlier deadlines specified in the approved
		  plan.</text></paragraph></subsection><subsection id="idB473DE7CB5004244ABBB64D053F25935"><enum>(h)</enum><header>Alternative
		  compliance payments</header><text display-inline="yes-display-inline">As a
		  means of compliance under subsection (b)(4), the Secretary shall accept payment
		  equal to the lesser of—</text><paragraph id="H0E4EE0841CD34ED0983CD8FE56C733A5"><enum>(1)</enum><text display-inline="yes-display-inline">200 percent of the average market value of
		  Federal renewable energy credits and Federal energy efficiency credits for the
		  applicable compliance period; or</text></paragraph><paragraph id="HDC029CB18C004C598E28038673B255B5"><enum>(2)</enum><text display-inline="yes-display-inline">3 cents per kilowatt hour (as adjusted on
		  January 1 of each year following calendar year 2006 based on the implicit price
		  deflator for the gross national product).</text></paragraph></subsection><subsection id="H302C6741FB32401D9E40A6F1104B767F"><enum>(i)</enum><header>Information
		  collection</header><text>The Secretary may collect the information necessary to
		  verify and audit—</text><paragraph id="H758014D59F1A4223BDB9ABA3A2367926"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idAD6F10E711E74454877CBEEA4D410D7B"><enum>(A)</enum><text display-inline="yes-display-inline">the annual renewable energy generation of
		  any retail electric supplier; and</text></subparagraph><subparagraph id="id8F8BAF003664495BB515C7E524429CAB" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Federal renewable energy credits submitted
		  by a retail electric supplier pursuant to subsection (b)(1);</text></subparagraph></paragraph><paragraph id="HD1E6C5D801EA4CE28FE4023B88DD15F6"><enum>(2)</enum><text>the
		  validity of Federal renewable energy credits submitted for compliance by a
		  retail electric supplier to the Secretary; and</text></paragraph><paragraph id="HDD59B6BAC6544AFD8C7615E32913AC02"><enum>(3)</enum><text>the
		  quantity of electricity sales of all retail electric suppliers.</text></paragraph></subsection><subsection id="H871C8A21A1D94331B9314807155E04B1"><enum>(j)</enum><header>Environmental
		  savings clause</header><text>Incremental hydropower shall be subject to all
		  applicable environmental laws and licensing and regulatory requirements.</text></subsection><subsection id="HCD0D7EC26A634334BC32C21DD6D078E"><enum>(k)</enum><header>State
		  programs</header><paragraph id="id3BC28AFF6FE5448ABF1CFAED8335F2CF"><enum>(1)</enum><header>In
		  general</header><text display-inline="yes-display-inline">Nothing in this
		  section diminishes any authority of a State or political subdivision of a
		  State—</text><subparagraph id="HA05A01BD11024FAF93CE977597BC280"><enum>(A)</enum><text display-inline="yes-display-inline">to adopt or enforce any law (including
		  regulations) respecting renewable energy, including programs that exceed the
		  required quantity of renewable energy under this section; or</text></subparagraph><subparagraph id="H13D08BA6C7C24F610089B301072DF9C9"><enum>(B)</enum><text display-inline="yes-display-inline">to regulate the acquisition and disposition
		  of Federal renewable energy credits by retail electric suppliers.</text></subparagraph></paragraph><paragraph id="id0B0BA365E39B44CBA92EE2B1C1905D04"><enum>(2)</enum><header>Compliance with
		  section</header><text>No law or regulation referred to in paragraph (1)(A)
		  shall relieve any person of any requirement otherwise applicable under this
		  section.</text></paragraph><paragraph id="idCB51E4F1F60A48119B26D88F38B685A5"><enum>(3)</enum><header>Coordination
		  with State program</header><text>The Secretary, in consultation with States
		  that have in effect renewable energy programs, shall—</text><subparagraph id="id230B06B913234308BAB3AEA45087802B"><enum>(A)</enum><text>preserve the
		  integrity of the State programs, including programs that exceed the required
		  quantity of renewable energy under this section; and</text></subparagraph><subparagraph id="id37D50C77C1BD4A66A8247D3FA574FA3E"><enum>(B)</enum><text>facilitate
		  coordination between the Federal program and State programs.</text></subparagraph></paragraph><paragraph id="id7E9AA1A212D94DC984D4E77433BC7CA0"><enum>(4)</enum><header>Existing
		  renewable energy programs</header><text>In the regulations establishing the
		  program under this section, the Secretary shall incorporate common elements of
		  existing renewable energy programs, including State programs, to ensure
		  administrative ease, market transparency and effective enforcement.</text></paragraph><paragraph id="id98336B83BC234355829BFC98E7E1FA99"><enum>(5)</enum><header>Minimization of
		  administrative burdens and costs</header><text>In carrying out this section,
		  the Secretary shall work with the States to minimize administrative burdens and
		  costs to retail electric suppliers.</text></paragraph></subsection><subsection id="HC252DEAC3D844A068C19F3E2CAFD1B14"><enum>(l)</enum><header>Recovery of
		  costs</header><text display-inline="yes-display-inline">An electric utility
		  that has sales of electric energy that are subject to rate regulation
		  (including any utility with rates that are regulated by the Commission and any
		  State regulated electric utility) shall not be denied the opportunity to
		  recover the full amount of the prudently incurred incremental cost of renewable
		  energy obtained to comply with the requirements of subsection (b).</text></subsection><subsection id="HF4108B03E6D14E1A994DEA7541CA3B97"><enum>(m)</enum><header>Program
		  review</header><paragraph id="id1A6F27F3DD514A728CADE00CCE7739B5"><enum>(1)</enum><header>In
		  general</header><text>The Secretary shall enter into an arrangement with the
		  National Academy of Sciences under which the Academy shall conduct a
		  comprehensive evaluation of all aspects of the program established under this
		  section.</text></paragraph><paragraph id="id0C7B725C8C70459CB8FC36322AED7F5D"><enum>(2)</enum><header>Evaluation</header><text>The
		  study shall include an evaluation of—</text><subparagraph id="H4F1DA34386BA4EB6A3E625AA79D02F02"><enum>(A)</enum><text>the effectiveness
		  of the program in increasing the market penetration and lowering the cost of
		  the eligible renewable energy technologies;</text></subparagraph><subparagraph id="H8FC248108C8242149C98B271FAD6C535"><enum>(B)</enum><text>the opportunities
		  for any additional technologies and sources of renewable energy emerging since
		  the date of enactment of this section;</text></subparagraph><subparagraph id="H1DE11C04E4964BF099CFC68E9DABFAC2"><enum>(C)</enum><text>the impact on the
		  regional diversity and reliability of supply sources, including the power
		  quality benefits of distributed generation;</text></subparagraph><subparagraph id="H5ABCDE56C3BB445298CD1462D513C102"><enum>(D)</enum><text>the regional
		  resource development relative to renewable potential and reasons for any
		  investment in renewable resources; and</text></subparagraph><subparagraph id="HE3150929E7AB464BA1C35C8FCF1FEE38"><enum>(E)</enum><text>the net
		  cost/benefit of the renewable electricity standard to the national and State
		  economies, including—</text><clause id="id88CE315F9BF941BF8BAB73BDED330355"><enum>(i)</enum><text>retail power
		  costs;</text></clause><clause id="id5B5FE0A58EAC451594E74F21925A6874"><enum>(ii)</enum><text>the
		  economic development benefits of investment;</text></clause><clause id="id82F199DDADC24E93A0834CDA7922ABA2"><enum>(iii)</enum><text>avoided costs
		  related to environmental and congestion mitigation investments that would
		  otherwise have been required;</text></clause><clause id="idBD61EC3A23834CC49575A0D15C70728C"><enum>(iv)</enum><text>the
		  impact on natural gas demand and price; and</text></clause><clause id="id595FC8E75AD043EE8258004993A2FB14"><enum>(v)</enum><text>the
		  effectiveness of green marketing programs at reducing the cost of renewable
		  resources.</text></clause></subparagraph></paragraph><paragraph id="idF73A849386E04092886A5A661BA515B2"><enum>(3)</enum><header>Report</header><text>Not
		  later than January 1, 2018, the Secretary shall transmit to Congress a report
		  describing the results of the evaluation and any recommendations for
		  modifications and improvements to the program.</text></paragraph></subsection><subsection id="HBF02DA9CCA7440ECB502BE2714138077"><enum>(n)</enum><header>State renewable
		  energy account</header><paragraph id="id7288EC142C214E1F88BC9E875F84EEF9"><enum>(1)</enum><header>In
		  general</header><text display-inline="yes-display-inline">There is established
		  in the Treasury a State renewable energy account.</text></paragraph><paragraph id="H801A90F0D7384CFD8F4E7F32DEE97B58"><enum>(2)</enum><header>Deposits</header><text>All
		  money collected by the Secretary from the alternative compliance payments under
		  subsection (h) shall be deposited into the State renewable energy account
		  established under paragraph (1).</text></paragraph><paragraph id="H89265580366D476CB4F731AABB10B879"><enum>(3)</enum><header>Grants</header><subparagraph id="id5CE29AD8E088425392688236BB68B11F"><enum>(A)</enum><header>In
		  general</header><text display-inline="yes-display-inline">Proceeds deposited in
		  the State renewable energy account shall be used by the Secretary, subject to
		  annual appropriations, for a program to provide grants—</text><clause id="id4C142558D8F749D6A239F6E401977646"><enum>(i)</enum><text display-inline="yes-display-inline">to the State agency responsible for
		  administering a fund to promote renewable energy generation for customers of
		  the State or an alternative agency designated by the State; or</text></clause><clause id="id8A70F8183F9544578448638E4366CE60"><enum>(ii)</enum><text display-inline="yes-display-inline">if no agency described in clause (i), to
		  the State agency developing State energy conservation plans under section 362
		  of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6322">42 U.S.C. 6322</external-xref>).</text></clause></subparagraph><subparagraph id="id53C7D78535144068B360AC83335313FC"><enum>(B)</enum><header>Use</header><text display-inline="yes-display-inline">The grants shall be used for the purpose
		  of—</text><clause id="idFDFA6B0F5F3A4E0180503E85BB1E8069"><enum>(i)</enum><text display-inline="yes-display-inline">promoting renewable energy production;
		  and</text></clause><clause id="id2B4C5C6F97A7440992E4ACAD3EDBC693"><enum>(ii)</enum><text display-inline="yes-display-inline">providing energy assistance and
		  weatherization services to low-income consumers.</text></clause></subparagraph><subparagraph id="H8817AF8FFFF042B19E86418CF762864C"><enum>(C)</enum><header>Criteria</header><text display-inline="yes-display-inline">The Secretary may issue guidelines and
		  criteria for grants awarded under this paragraph.</text></subparagraph><subparagraph id="idEA789D65FD9549AEB9E47788BE1AB36C"><enum>(D)</enum><header>State-approved
		  funding mechanisms</header><text display-inline="yes-display-inline">At least
		  75 percent of the funds provided to each State for each fiscal year shall be
		  used to promote renewable energy production through grants, production
		  incentives, or other State-approved funding mechanisms.</text></subparagraph><subparagraph id="idC984CEC2C5F84BDBA819F78D7B13F08D"><enum>(E)</enum><header>Allocation</header><text display-inline="yes-display-inline">The funds shall be allocated to the States
		  on the basis of retail electric sales subject to the renewable electricity
		  standard under this section or through voluntary participation.</text></subparagraph><subparagraph id="idDB38177AF2B34F18A5AD8874C9440F06"><enum>(F)</enum><header>Records</header><text display-inline="yes-display-inline">State agencies receiving grants under this
		  paragraph shall maintain such records and evidence of compliance as the
		  Secretary may
		  require.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="ID12893634b2d047b7a02c53972e7c7fd6"><enum>(b)</enum><header>Table of
		contents amendment</header><text>The table of contents of the Public Utility
		Regulatory Policies Act of 1978 (16 U.S.C. prec. 2601) is amended by adding at
		the end of the items relating to title VI the following:</text><quoted-block display-inline="no-display-inline" id="idA66E47E524C84507BB8DC074EEBC680C" style="OLC"><toc><toc-entry bold="off" level="section">Sec. 609. Rural and remote
