<distribution-code display="yes">II</distribution-code><congress>113th CONGRESS</congress><session>1st Session</session><legis-num>S. 1584</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date>October 28, 2013</action-date><action-desc><sponsor name-id="S313">Mr. Sanders</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 38, United States Code, to provide replacement automobiles for certain disabled veterans and members of the Armed Forces, and for other purposes.</official-title></form><legis-body><section id="id872B6AEF494E45AEBB3BD5D664DC6A8A" section-type="section-one"><enum>1.</enum><header>Replacement automobiles for certain disabled veterans and members of Armed Forces</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/3903">Section 3903</external-xref> of title 38, United States Code, is amended by striking subsection (a) and inserting the following new subsection (a):</text><quoted-block display-inline="no-display-inline" id="id1D5DDC2283DB443FABD0892BD873665E" style="OLC"><subsection id="idF4F856C285D342A49226DB9513F9A8CC"><enum>(a)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idE4796A78F51C477C9363C49F4E77633F"><enum>(1)</enum><text>Subject to paragraph (2) and except as provided in paragraph (3), an eligible person entitled to receive an automobile or other conveyance under the provisions of this chapter is entitled—</text><subparagraph id="id6EA641F88AA84874836F08B62E1ED102" indent="up1"><enum>(A)</enum><text>to receive only one automobile or other conveyance under the provisions of this chapter; and</text></subparagraph><subparagraph id="idA6DA6B9017B14EDAB63EBB32122B6E66" indent="up1"><enum>(B)</enum><text>to replace such automobile or other conveyance twice under the provisions of this chapter.</text></subparagraph></paragraph><paragraph id="idD4BFFDD93ACD4AABB7CAC4D91FE0A054" indent="up1"><enum>(2)</enum><text>Except as provided in paragraph (3), the aggregate amount that the Secretary may expend under subsection (a) of section 3902 of this title for an eligible person (including amounts expended for replacement automobiles or other conveyances) shall not exceed the amount set forth in such subsection (as adjusted from time to time under subsection (e) of such section).</text></paragraph><paragraph id="idC6A67EB8191B48EABE3DB4BD152D5FF6" indent="up1"><enum>(3)</enum><text>The Secretary may provide or assist in providing an eligible person with a replacement automobile or other conveyance under this chapter that is not subject to the limitations of paragraphs (1) and (2) and does not count against the eligible person's entitlement under this chapter if—</text><subparagraph id="id6C43310D0E504226BC37674915964A5F"><enum>(A)</enum><text>the Secretary receives satisfactory evidence that the automobile or other conveyance of the eligible person previously purchased with assistance under this chapter was destroyed—</text><clause id="idF58679EF436F4DC99B2805F56CA896B2"><enum>(i)</enum><text>as a result of a natural or other disaster, as determined by the Secretary; and</text></clause><clause id="id262089F35CCA462FA6F2942C136D1C37"><enum>(ii)</enum><text>through no fault of the eligible person; and</text></clause></subparagraph><subparagraph id="id8A5A4D67385E4BE8B8A0939D521F7760"><enum>(B)</enum><text>the eligible person does not otherwise receive from a property insurer compensation for the loss.</text></subparagraph></paragraph><paragraph id="id809D27C655A84950BA0C9BB0FE8111A2" indent="up1"><enum>(4)</enum><text>No payment shall be made under this chapter for the repair or maintenance of an automobile or other conveyance.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idC079B902F81E43D7B502916A0622AED2"><enum>2.</enum><header>Codification of cost-of-living adjustment in amounts of assistance for providing automobiles for certain disabled veterans and members of the Armed Forces</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/3902">Section 3902(a)</external-xref> of title 38, United States Code, is amended by striking <quote>$18,900</quote> and inserting <quote>$30,000</quote>.</text></section></legis-body></bill>
