<distribution-code display="yes">II</distribution-code><congress>113th CONGRESS</congress><session>1st Session</session><legis-num>S. 1566</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date>September 30, 2013</action-date><action-desc><sponsor name-id="S324">Mrs. Shaheen</sponsor> (for herself, <cosponsor name-id="S197">Mr. McCain</cosponsor>, <cosponsor name-id="S057">Mr. Leahy</cosponsor>, <cosponsor name-id="S253">Mr. Durbin</cosponsor>, <cosponsor name-id="S293">Mr. Graham</cosponsor>, <cosponsor name-id="S362">Mr. Kaine</cosponsor>, and <cosponsor name-id="S308">Mr. Cardin</cosponsor>) introduced the following bill; which was read twice, considered, read the third time, and passed</action-desc></action><legis-type>A BILL</legis-type><official-title>To extend the period during which Iraqis who were employed by the United States Government in Iraq may be granted special immigrant status and to temporarily increase the fee or surcharge for processing machine-readable nonimmigrant visas.</official-title></form><legis-body style="OLC"><section id="idE99EF45A4FA9491C8C22EC61EFF160E6" section-type="section-one"><enum>1.</enum><header>Short-term extension of special immigrant program</header><text display-inline="no-display-inline">Section 1244(c)(3) of the National Defense Authorization Act for Fiscal Year 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1157">8 U.S.C. 1157</external-xref> note) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id4CC86DBB410144D4BD9D257C6287EBCE" style="OLC"><subparagraph id="id19092B9730534B5AA1378B83B997D94E"><enum>(C)</enum><header>Fiscal year 2014</header><clause id="id7DEA138538FB4F25AB5C599A3C21D44D"><enum>(i)</enum><header>In general</header><text>Except as provided in clauses (ii) and (iii), the total number of principal aliens who may be provided special immigrant status under this section during the first 3 months of fiscal year 2014 shall be the sum of—</text><subclause id="idDE05F17BD6044FBF8E50CE057797FC13"><enum>(I)</enum><text>the number of aliens described in subsection (b) whose application for special immigrant status under this section is pending on September 30, 2013; and</text></subclause><subclause id="id7DF8A67647AE4B089C0E9DAC2FEB6B8E"><enum>(II)</enum><text>2,000.</text></subclause></clause><clause id="id716F8D821F9449609A40E3F07494F9B2"><enum>(ii)</enum><header>Employment period</header><text>The 1-year period during which the principal alien is required to have been employed by or on behalf of the United States Government in Iraq under subsection (b)(1)(B) shall begin on or after March 20, 2003, and end on or before September 30, 2013.</text></clause><clause id="id3E9CFAC6473E4D71BC875AC37E053BDC"><enum>(iii)</enum><header>Application deadline</header><text>The principal alien seeking special immigrant status under this subparagraph shall apply to the Chief of Mission in accordance with subsection (b)(4) not later than December 31, 2013.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idB167913E44874E3E99D170F7356DF446"><enum>2.</enum><header>Temporary fee increase for certain consular services</header><subsection id="id01229745f27c4dea82eb565c0b3bdbb6"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, the Secretary of State, not later than January 1, 2014, shall increase the fee or surcharge authorized under section 140(a) of the Foreign Relations Authorization Act, Fiscal Years 1994 and 1995 (<external-xref legal-doc="public-law" parsable-cite="pl/103/236">Public Law 103–236</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/8/1351">8 U.S.C. 1351</external-xref> note) by $1 for processing machine-readable nonimmigrant visas and machine-readable combined border crossing identification cards and nonimmigrant visas.</text></subsection><subsection id="iddfdac69a54e44784b57f3f8c92d05b34"><enum>(b)</enum><header>Deposit of amounts</header><text>Notwithstanding section 140(a)(2) of the Foreign Relations Authorization Act, Fiscal Years 1994 and 1995 (<external-xref legal-doc="public-law" parsable-cite="pl/103/236">Public Law 103–236</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/8/1351">8 U.S.C. 1351</external-xref> note), the additional amount collected pursuant the fee increase authorized under subsection (a) shall be deposited in the general fund of the Treasury.</text></subsection><subsection id="id820a2cfb9f844a2093011f9d56aa6676"><enum>(c)</enum><header>Sunset provision</header><text>The fee increase authorized under subsection (a) shall terminate on the date that is 2 years after the first date on which such increased fee is collected.</text></subsection></section></legis-body></bill>
