			 title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Older Americans Act Reauthorization Act of 2013</short-title></quote>.</text></section><section id="id807E8AC3C74B4D14B22AD1AC3C65EEE5"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 102 of the Older Americans Act of
			 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3002">42 U.S.C. 3002</external-xref>) is amended—</text><paragraph id="idA94D76405F6A4DAFA98804794E9C9D56"><enum>(1)</enum><text display-inline="yes-display-inline">by striking paragraph (1) and inserting the
			 following:</text><quoted-block display-inline="no-display-inline" id="idCC5709A5D6984418B478EC8B402ED58D" style="OLC"><paragraph id="id8B257534BE6A4D3C87CD9B82CE6CF9EF"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>abuse</term> means the knowing infliction of physical or
				psychological harm or the knowing deprivation of goods or
				services that are necessary to meet essential needs or to avoid physical or
				psychological
				harm.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id1013CA64B2F64A2FBE3457087BC4FE9B"><enum>(2)</enum><text>by striking paragraph (4) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="idA027C281CA0242EB9CCE2BC2528DB30D" style="OLC"><paragraph id="id2c056b8324b54d1a8a31dac6384c6a38"><enum>(4)</enum><text>The term <term>Aging and Disability Resource Center</term> means an entity, network, or  consortium established by a State as part of the State system of long-term care, to provide a coordinated and integrated system for older individuals and individuals with disabilities (as defined in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>)), and the caregivers of older individuals and individuals with disabilities,  that provides—</text><subparagraph id="ida7c52ee3d66445e0b07122282109c636"><enum>(A)</enum><text>comprehensive information on the full range of available public and private long-term care programs, options, service providers, and resources within a community, including information on the availability of integrated long-term care services, and Federal or State programs that provide long-term care services and supports through home and community-based service programs;</text></subparagraph><subparagraph id="ideaefba89c6db4487b0a18a91d5dbf818"><enum>(B)</enum><text>person-centered counseling to assist individuals in assessing their existing or anticipated long-term care needs and goals, and developing and implementing a person-centered plan for long-term care that is consistent with the desires of such an  individual and designed to meet the individual's specific needs, goals, and circumstances;</text></subparagraph><subparagraph id="idd8205d5640a44e87a06d8f67235b16f1"><enum>(C)</enum><text>access for individuals to the full range of publicly supported long-term care services and supports  for which the individuals may be eligible, including home and community-based service options, by serving as a convenient point of entry for such programs and supports; and</text></subparagraph><subparagraph id="id79c4c71049eb4b7b85892ba49737ce95"><enum>(D)</enum><text>in cooperation with area agencies on aging, centers for independent living described in part C of title VII    of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/796f">29 U.S.C. 796f et seq.</external-xref>), and other community-based entities, information and referrals regarding  available home and community-based services for individuals who are at risk for residing in, or who reside in, institutional settings, so that the individuals have the choice to remain in or to return to the community.</text></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="idDF88721FB44F41E08DE48B69D8524549"><enum>(3)</enum><text>in paragraph (14)(B), by inserting <quote>oral health,</quote> after <quote>bone density,</quote>;</text></paragraph><paragraph id="id8020D6A66BEB4209AAA257BEBEB5F1FE"><enum>(4)</enum><text>by striking
			 paragraph (17) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="id8BB5C59016244F18AD68692A7F22627D" style="OLC"><paragraph id="id56a3868bbf974784a672a001dbdac393"><enum>(17)</enum><text>The term
				<term>elder justice</term> means—</text><subparagraph id="id4ae993a90be0438c8fef0b6b00181cc5"><enum>(A)</enum><text>from a societal
				perspective, efforts to—</text><clause id="ida305a5bb1fed44ecbc743a023526fe9a"><enum>(i)</enum><text>prevent, detect,
				treat, intervene in, and prosecute elder abuse, neglect, and exploitation;
				and</text></clause><clause id="idf6a7d22a57af45ed9072a4da8e5ca229"><enum>(ii)</enum><text>protect older
				individuals with diminished capacity while maximizing their autonomy;
				and</text></clause></subparagraph><subparagraph id="id000444ca1ccc46c7bce4827837685e6f"><enum>(B)</enum><text>from an
				individual perspective, the recognition of an older individual’s rights,
				including the right to be free of abuse, neglect, and
				exploitation.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idC2DFEDB3736741B0B5CC641768209564"><enum>(5)</enum><text display-inline="yes-display-inline">in paragraph (18)(A), by striking
			 <quote>term <term>exploitation</term> means</quote> and inserting <quote>terms
			 <term>exploitation</term> and <term>financial exploitation</term> mean</quote>;
			 and</text></paragraph><paragraph id="id70A45EDB8C6644CA96E25272ED15D4BC"><enum>(6)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id1845BCA9BC9F4071BBED771E569E1D17" style="OLC"><paragraph id="idbb6de904276c4a958532981d0bb63199"><enum>(55)</enum><text>The term
				<term>adult protective services</term> means such
				services provided to adults as the Secretary may specify and includes services
				such as—</text><subparagraph id="id83024e50a85e483fb265e3a284bf092f"><enum>(A)</enum><text>receiving reports
				of adult abuse, neglect, or exploitation;</text></subparagraph><subparagraph id="idbea8193a21344ac29b5383b423b71ce9"><enum>(B)</enum><text>investigating
				the reports described in subparagraph (A);</text></subparagraph><subparagraph id="id94b9a9fcea7d40c889280f31a40d86f9"><enum>(C)</enum><text>case planning,
				monitoring, evaluation, and other casework and services; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id86c263de9fe045aba76622a7c82141c0"><enum>(D)</enum><text>providing, arranging
				for, or facilitating the provision of  medical, social service,
				economic, legal, housing, law enforcement, or other protective, emergency, or
				support
				services.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id4C09D10994774446A63C61C2DB5BDAEF"><enum>3.</enum><header>Administration
			 on Aging</header><subsection id="id717663A826C14223A81E6FF0F1941359"><enum>(a)</enum><header>Best
			 practices</header><text>Section 201 of the Older Americans Act of 1965 (42
			 U.S.C. 3011) is amended—</text><paragraph id="idC812A6008E9F4208BDD8AFDF6BB41F5B"><enum>(1)</enum><text>in subsection
			 (d)(3)—</text><subparagraph id="idA9FCB055B87147D1956608A9A8031C26"><enum>(A)</enum><text>in subparagraph
			 (K), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="idA73C8FBBFD5E459881381EFA858789F0"><enum>(B)</enum><text>in subparagraph
			 (L)—</text><clause id="id8EECCE4119714B1FBF246D7335D142EF"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>Older Americans Act
			 Amendments of 1992</quote> and inserting <quote><short-title>Older Americans Act Reauthorization Act of 2013</short-title></quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id8A70C90E9B8C494DBB6F4E5D7CCEAA80"><enum>(ii)</enum><text>by striking
			 <quote>712(h)(4).</quote> and inserting <quote>712(h)(5); and</quote>;
			 and</text></clause></subparagraph><subparagraph id="id3438F51113C84C2C91BC8EE9123EF2F5"><enum>(C)</enum><text>by adding at the
			 end the following:</text><quoted-block display-inline="no-display-inline" id="id3F65127009154E5B9197EAC81C9D4F74" style="OLC"><subclause id="ided6937f0f0cd4cfba057047b573af7ac" indent="up3"><enum>(M)</enum><text>collect and analyze best practices
				related to responding to elder abuse, neglect, and exploitation in long-term care facilities, and publish
				a report of such best practices.</text></subclause><after-quoted-block>;
				and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" id="id72912F1244FE4A4EA719CCBC379D0551"><enum>(2)</enum><text>in subsection
			 (e)(2), in the matter preceding subparagraph (A), by inserting <quote>, and in
			 coordination with the heads of State adult protective services programs and the Director of the Office of Long-Term Care Ombudsman Programs</quote> after <quote>and
			 services</quote>.</text></paragraph></subsection><subsection id="id4DAE6E3705634640829013BAABBDF09A"><enum>(b)</enum><header>Training</header><text>Section
			 202 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3012">42 U.S.C. 3012</external-xref>) is amended—</text><paragraph id="id5213134AC6414E678469C4E378178811"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="idE252B09207BA4B64A1E70289568D83E1"><enum>(A)</enum><text>in paragraph (5), by inserting <quote>health and economic</quote> before <quote>needs of older individuals</quote>;</text></subparagraph><subparagraph id="id404CC0C9A59745C99A27384A5AD970F0"><enum>(B)</enum><text>in paragraph (7), by inserting <quote>health and economic</quote> before <quote>welfare</quote>;</text></subparagraph><subparagraph id="id54474E6C44294F2C91A1641DBAC90508"><enum>(C)</enum><text>in paragraph (14), by inserting <quote>(including the Health Resources and Services Administration)</quote> after <quote>other agencies</quote>;</text></subparagraph><subparagraph id="id4D0A8B72BE8244DFA5709B2793F31771"><enum>(D)</enum><text>in paragraph (27),  by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="id743236B9AFB345728D5EE5112D5298A3"><enum>(E)</enum><text>in paragraph (28), by striking the period and inserting  a semicolon; and</text></subparagraph><subparagraph id="idBA915EEFE6214956B04F16283A9F5210"><enum>(F)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id8DE55E8B6FB44583BFF4975348695E38" style="OLC"><paragraph id="id30954e50d2d941bfa0fe736afd6b33ee"><enum>(29)</enum><text>provide information and technical assistance to States, area agencies on aging, and service providers, in collaboration with relevant Federal agencies, on providing efficient, person-centered transportation services, including across geographic boundaries;</text></paragraph><paragraph id="id24a6f88fe9fa4dd58bdb377b8e43ad80"><enum>(30)</enum><text>identify model programs and provide information and technical assistance to States, area agencies on aging, and service providers (including providers operating multipurpose senior centers), to support the modernization of multipurpose senior centers; and</text></paragraph><paragraph id="id3017fb0ce878411f8dc42aefe87013e5"><enum>(31)</enum><text>provide technical assistance to and share best practices with States, area agencies on aging, and Aging and Disability Resource Centers, on how to collaborate and coordinate services with health care entities, such as Federally-qualified health centers, as defined in section 1905(l)(2)(B)
				of the Social Security Act (42 U.S.C. 
				1396d(l)(2)(B)), in order to improve care coordination for individuals with multiple chronic illnesses.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id3B348B63A5F0426087BDA49621481816"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="id4AC4E796D7924672898F73C707C1A1FF"><enum>(A)</enum><text>in paragraph (5)—</text><clause id="idF8475B5FB1DB4DF7AD96691A91374608"><enum>(i)</enum><text>in subparagraph (B), by striking <quote>and</quote> after the semicolon;</text></clause><clause id="idB7D75F2D4E2A41FEBB9C55C3775A73B0"><enum>(ii)</enum><text>in subparagraph (C), by inserting <quote>and</quote> after the semicolon;  and</text></clause><clause id="idB4E34A34F54F4D5F8B2F6FEE64831502"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id513654F0BD204B6F8B07215800ECD3BF" style="OLC"><subparagraph id="id128EA5C67CBB4AAC8E7A8CA94BB6EB54"><enum>(D)</enum><text>when feasible, developing, in consultation with States and national organizations, a consumer-friendly tool to assist older individuals and their families in choosing home and community-based services, with a particular focus on ways for consumers to assess how providers protect the health, safety, welfare, and rights, including the rights provided under section 314, of older individuals;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id344589009AB842B68A310C6886688653"><enum>(B)</enum><text>in paragraph (8)—</text><clause commented="no" id="idB3D4D02E401C441BB4BBC809828953C8"><enum>(i)</enum><text>in subparagraph (B), by inserting <quote>to identify and articulate goals of care and</quote> after <quote>individuals</quote>;</text></clause><clause id="id63355221040C40E493A944607CEBB6B6"><enum>(ii)</enum><text>in subparagraph (D)—</text><subclause id="idB9AD414A19914AF8A23D5CBAA973BA34"><enum>(I)</enum><text>by inserting <quote>respond to or</quote> before <quote>plan</quote>; and</text></subclause><subclause id="id2197A780D1CD42819BBBC5422FBA794B"><enum>(II)</enum><text>by striking <quote>future long-term care needs; and</quote> and inserting <quote>long-term care needs;</quote>;</text></subclause></clause><clause id="idA30559C875AC4D28954091611DC44F52"><enum>(iii)</enum><text>in subparagraph (E), by adding <quote>and</quote> at the end; and</text></clause><clause id="id7F7A2084DA85422389E9B7562310A63C"><enum>(iv)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id81B4D02D0E29442698EAAFD1BFA83866" style="OLC"><subparagraph id="id0d35fff93e19447387d32b8c40655225"><enum>(F)</enum><text>to provide information and referrals regarding available home and community-based services for individuals who are at risk for residing in, or who reside in, institutional settings, so that the individuals have the choice to remain in or to return to the community.</text></subparagraph><after-quoted-block>; and </after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="idEF4E04F44F854E4C8BB9468B2598BED9"><enum>(3)</enum><text>by adding at
			 the end the following:</text><quoted-block display-inline="no-display-inline" id="id417D5B2914BE4640AA74B20B1DDC9B88" style="OLC"><subsection id="id7a28d382ffc84f0d97610dd6bdcbfa66"><enum>(g)</enum><text>The Assistant
				Secretary shall, as appropriate, ensure that programs authorized under this Act
				include appropriate training in the prevention of abuse, neglect, and
				exploitation and provision of services that address elder justice and the
				exploitation of older
				individuals.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="id3A0BB863BA4343A69B6CB683D21E0DCC"><enum>(c)</enum><header>Authorization
			 of appropriations</header><text display-inline="yes-display-inline">Section 216
			 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3020f">42 U.S.C. 3020f</external-xref>) is amended—</text><paragraph commented="no" id="id8C0E94BC317144A9A7EBA7720FE3649F"><enum>(1)</enum><text>in subsection
			 (a), by striking <quote>2007, 2008, 2009, 2010, and 2011</quote> and inserting
			 <quote>2014, 2015, 2016, 2017, and 2018</quote>;</text></paragraph><paragraph commented="no" id="id73EA0D30E3D24C228BB30C07662B65ED"><enum>(2)</enum><text>in subsection

			 community programs on aging</header><subsection id="id19BEF03D37F84BFC9B654C9C1B3E6EEC"><enum>(a)</enum><header>Authorization of appropriations</header><text>Section 303 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3023">42 U.S.C. 3023</external-xref>) is amended—</text><paragraph id="idF93981B15DE347A2A172BE1F41F33EDB"><enum>(1)</enum><text>in subsection (a)(1), by striking <quote>fiscal years 2007</quote> and all that follows and inserting <quote>each of fiscal years 2014 through 2018.</quote>;</text></paragraph><paragraph id="idAC01CB17E6834728B536C7B7E5662E2E"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="id86C67A5FD606419DAE717DB297BB63BD"><enum>(A)</enum><text>in paragraph (1),  by striking <quote>fiscal years 2007</quote> and all that follows and inserting <quote>each of fiscal years 2014 through 2018.</quote>; and</text></subparagraph><subparagraph id="idF04AA79FD00C46949373A3793E8F4AF0"><enum>(B)</enum><text>in paragraph (2), by striking <quote>fiscal years 2007</quote> and all that follows and inserting <quote>each of fiscal years 2014 through 2018.</quote>;</text></subparagraph></paragraph><paragraph id="id610D1A6B61174C41A5FA7711326BC000"><enum>(3)</enum><text>in subsection (d), by striking <quote>fiscal years 2007</quote> and all that follows and inserting <quote>each of fiscal years 2014 through 2018.</quote>; and</text></paragraph><paragraph id="idE29BC6132D3C46979E4181EB8B790C80"><enum>(4)</enum><text>in subsection (e)(2), by striking <quote>2011</quote> and inserting <quote>2011 and each of fiscal years 2014 through 2018</quote>.</text></paragraph></subsection><subsection id="idE68AB8BEEDE948AF936D1F7AABDECA3D"><enum>(b)</enum><header>Conforming amendment</header><text>Section 304(b) of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3024">42 U.S.C. 3024(b)</external-xref>) is amended by striking <quote>subpart 1 of</quote>.</text></subsection><subsection id="idACC4EA68FAD04E798CF3005DE9DA2462"><enum>(c)</enum><header>Planning and service areas</header><text>Section 305(b)(5)(C)(i)(III) of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3025">42 U.S.C. 3025(b)(5)(C)(i)(III)</external-xref>) is amended  by striking <quote>planning and services areas</quote> and inserting <quote>planning and service areas</quote>.</text></subsection><subsection id="id5DA6C953ED664F46BF1A3044214F9CC3"><enum>(d)</enum><header>Area plans</header><text>Section 306 of the Older Americans Act of 1965 (42
			 U.S.C. 3026) is amended—</text><paragraph id="idBAE360A53605498684D62B0D5AAA6CD4"><enum>(1)</enum><text>in subsection
			 (a)—</text><subparagraph id="id43A2C24513E04B37A496F4845FF1BED4"><enum>(A)</enum><text>in paragraph (1), by striking <quote>establishment, maintenance, or construction of multipurpose senior centers,</quote> and inserting <quote>establishment, maintenance, modernization, or construction of multipurpose senior centers (including a plan to use the skills and services of older individuals in paid and unpaid work, including multigenerational and older individual to older individual work),</quote>; and</text></subparagraph><subparagraph id="idBB034EF1C59F447B93F2F23A1C1428F3"><enum>(B)</enum><text>in paragraph (6)—</text><clause id="id4452A76FF1EB4D47BCA2A9F46EC08559"><enum>(i)</enum><text>in subparagraph
			 (G), by adding <quote>and</quote> at the end; and</text></clause><clause id="idF1F24062BD3C4B83BE73529D31336798"><enum>(ii)</enum><text>by adding at the

				with the State agency and with the State agency responsible for elder abuse
				prevention services, increase public awareness of elder abuse, neglect, and
				exploitation, and remove barriers to education, prevention, investigation, and treatment of elder abuse neglect, and exploitation education, as
				appropriate;</text></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="idD0791FB57CD54A2DA52A7F66C65172E1"><enum>(2)</enum><text>in subsection
			 (b)(3)—</text><subparagraph id="id22AF400F245C4C7D8E07269C5729C8AD"><enum>(A)</enum><text>in subparagraph
			 (J), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="id0490DE6DFFC546868F6BDE69AD9B0565"><enum>(B)</enum><text>by redesignating

				provider of in-home and community care to, and is the primary caregiver for, a

				blood, marriage, or adoption, of the child;</text></clause><clause id="idfed5ed3f0721472a9b31ea204a38b5ca"><enum>(ii)</enum><text>is the primary
				caregiver of the child because the biological or adoptive parents are unable or
				unwilling to serve as the primary caregivers of the child; and</text></clause><clause id="id1920b67e267c447c9a202b1f207c0025"><enum>(iii)</enum><text>has a legal
				relationship to the child, such as legal custody, adoption,  or guardianship, or is raising
				the child informally; and</text></clause></subparagraph><subparagraph id="id0E10616A9DD54F588F449B991584A219"><enum>(C)</enum><text>in the case of a
				caregiver for an individual with a disability, is the parent, grandparent, or
				other relative by blood, marriage, or adoption, of the individual with a

				capacity who have no known legal representative and are unable to communicate consent, in order for the Ombudsman to carry out the functions and duties described in paragraphs (3)(A)(i) and (5)(B)(vi) of subsection (a).</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id03A40C78AEE24137A9FC27D588B2B40C"><enum>(4)</enum><text>by striking subsection (f)
			 and inserting the following:</text><quoted-block display-inline="no-display-inline" id="idABA67F6E034A4C2DBDBFD72A0BB51D07" style="OLC"><subsection id="id6fe1fd2b8b3a4d5d8cbb0ea84537740c"><enum>(f)</enum><header>Conflict of interest</header><paragraph id="id238ca81d1242408683f62323c518c730"><enum>(1)</enum><header>Individual conflict of interest</header><text>The State agency shall—</text><subparagraph id="id8ba67927a1cd46349766db3a2cec4a84"><enum>(A)</enum><text>ensure that no individual, or member of the immediate family of an individual, involved in the designation of the Ombudsman (whether by appointment or otherwise) or the designation of an entity designated under subsection (a)(5), is subject to a conflict of interest;</text></subparagraph><subparagraph id="idc8e6df509fae4cd893719d6fd12581bb"><enum>(B)</enum><text>ensure that no officer or employee of the Office, representative of a local Ombudsman entity, or member of the immediate family of the officer, employee, or representative, is subject to a conflict of interest; and</text></subparagraph><subparagraph id="id0244730eaafe409ba981287bf2c3aa4d"><enum>(C)</enum><text>ensure that the Ombudsman—</text><clause id="id4921a2f297da47b69192ece892f7cbd2"><enum>(i)</enum><text>does not have a direct involvement in the licensing or certification of a long-term care facility or of a provider of a long-term care service;</text></clause><clause id="id97003d7972b84b228933a1bc280e1350"><enum>(ii)</enum><text>does not have an ownership or investment interest (represented by equity, debt, or other financial relationship) in a long-term care facility or a long-term care service;</text></clause><clause id="id7e965ce57aa9486d8819e22fc26b386f"><enum>(iii)</enum><text>is not employed by, or participating in the management of, a long-term care facility or a related organization, and has not been employed by such a facility or organization within 1 year before the date of the determination involved;</text></clause><clause id="id5f9b475e51b54dadb09dfb17f96c04c8"><enum>(iv)</enum><text>does not receive, or have the right to receive, directly or indirectly, remuneration (in cash or in kind) under a compensation arrangement with an owner or operator of a long-term care facility;</text></clause><clause id="id8fde7f634f5445eda5150fd8f238ca80"><enum>(v)</enum><text>does not have management responsibility for, or operate under the supervision of an individual with management responsibility for, adult protective services; and</text></clause><clause id="id4b7e20d2db0d4e54b51be2a4bf201c4e"><enum>(vi)</enum><text>does not serve as a guardian or in another fiduciary capacity for residents of long-term care facilities in an official capacity (as opposed to serving as a guardian or fiduciary for a family member, in a personal capacity).</text></clause></subparagraph></paragraph><paragraph id="id4100c1ab7476411fb7eacb948d5f2705"><enum>(2)</enum><header>Organizational conflict of interest</header><subparagraph id="id7F40106E4EE64D358150F0AB3334DBD7"><enum>(A)</enum><header>In general</header><text>The State agency shall comply with subparagraph (B)(i) in a case in which the Office poses an organizational conflict of interest, including a situation in which the Office is placed in an organization that—</text><clause id="id7120075c39f74bbeb508c13c75faab6e"><enum>(i)</enum><text>is responsible for licensing, certifying or surveying long-term care services in the State;</text></clause><clause id="id4cf0f246f6824b18bb008f31a8b7b4f0"><enum>(ii)</enum><text>is an association (or an affiliate of such an association) of long-term care facilities, or of any other residential facilities for older individuals;</text></clause><clause id="idc0751db88c154271880722f2c11e57bb"><enum>(iii)</enum><text>provides
				long-term care services, including programs carried out under a Medicaid waiver
				approved under section 1115 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1315">42 U.S.C. 1315</external-xref>) or
				under subsection (c) or (b) of section 1915 of the Social Security Act (42
				U.S.C. 1396n), or under a Medicaid State plan amendment under subsection (i),
				(j), or (k) of section 1915 of the Social Security Act (42 U.S.C.
				1396n);</text></clause><clause id="id3ef740d85ad044c6a4995832e1af0e9e"><enum>(iv)</enum><text>provides long-term care case management;</text></clause><clause id="idb912f90f282f44ea9d4058284d801aa3"><enum>(v)</enum><text>sets rates for long-term care services;</text></clause><clause id="id7a55a73392d049169533a89c8c498a28"><enum>(vi)</enum><text>provides adult protective services;</text></clause><clause id="id4dac3b933ae04a89a1f8e156e230fe15"><enum>(vii)</enum><text>is responsible for eligibility determinations for the Medicaid program carried out under title XIX, of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395 et seq.</external-xref>, 1396 et seq.);</text></clause><clause id="id7ad8a5716be2465da09e8d73e048c5eb"><enum>(viii)</enum><text>conducts preadmission screening for placements in facilities described in clause (ii); or</text></clause><clause id="idee0b4ee58ef84ceea19c48d0bd23c6c9"><enum>(ix)</enum><text>makes decisions regarding admission or discharge of individuals to or from such facilities.</text></clause></subparagraph><subparagraph id="id657699a8dd264deba53db57fd354ff4a"><enum>(B)</enum><header>Identifying, removing, and remedying organizational conflict</header><clause id="id2d0bac803a1c4fe4a523d7fa4b502197"><enum>(i)</enum><header>In general</header><text>The State agency may not operate the Office or carry out the  program, directly, or by contract or other arrangement with any public agency or nonprofit private organization, in a case in which there is an organizational conflict of interest (within the meaning of subparagraph (A)) unless such conflict of interest has been—</text><subclause id="ide2e4604e107e4d3b8131f4161ad962aa"><enum>(I)</enum><text>identified by the State agency;</text></subclause><subclause id="id7b134847fb59436eb76f0098c3e3c125"><enum>(II)</enum><text>disclosed by the State agency to the Assistant Secretary in writing; and</text></subclause><subclause id="id0745221869644d4f82aa3b2370556495"><enum>(III)</enum><text>remedied in accordance with this subparagraph.</text></subclause></clause><clause id="id8597a6b66d2647e9b568e842d2495651"><enum>(ii)</enum><header>Action by Assistant Secretary</header><text>In a case in which a potential or actual organizational conflict of interest (within the meaning of subparagraph (A)) involving the Office is disclosed or reported to the Assistant Secretary by any person or entity, the Assistant Secretary shall require that the State agency, in accordance with the policies and procedures established by the State agency under  section 705(a)(5)(D)(iii)—</text><subclause id="ide98d7391bd65404db0071ada7dee70a7"><enum>(I)</enum><text>remove the conflict; or</text></subclause><subclause id="idd1852cabe7404ae98133cc63f31ff4e8"><enum>(II)</enum><text>submit, and obtain the approval of the Assistant Secretary for, an adequate remedial plan that indicates how the Ombudsman will be unencumbered in fulfilling all of the functions specified in subsection (a)(3).</text></subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id339A5FB385B44420ACB20105D1EAA2D0"><enum>(5)</enum><text>in subsection
			 (h)—</text><subparagraph id="idD5BFB13EF6FE43B6988399B94FBA6724"><enum>(A)</enum><text>in paragraph (3)(A)(i), by striking <quote>older</quote>;</text></subparagraph><subparagraph id="id001F7BEAB4AB49C8B2CB222C07E70769"><enum>(B)</enum><text>in paragraph (4),
			 by striking all that precedes <quote>procedures</quote> and inserting the
			 following:</text><quoted-block display-inline="no-display-inline" id="id3029490242374BCEA6DABE78C94989C6" style="OLC"><paragraph id="id1667986FEFCF42FFBEFCFEA1C278DD89"><enum>(4)</enum><text>strengthen and
				update</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id81E6FA6C99344FD0926CC0B660C28516"><enum>(C)</enum><text>by redesignating
			 paragraphs (4) through (9) as paragraphs (5) through (10), respectively;</text></subparagraph><subparagraph id="idC12C47A4B8E64E9C8DE9C2ADD8DAA621"><enum>(D)</enum><text>by inserting
			 after paragraph (3) the following:</text><quoted-block display-inline="no-display-inline" id="idB88F93E39C33448795E2845FEECE7CC0" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="ID43d982e48dcb484b9516eab129f60492"><enum>(4)</enum><text display-inline="yes-display-inline">ensure that the Ombudsman or a designee
				participates in training provided by the National Ombudsman Resource Center
				established in section
				202(a)(18);</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id6A375C44D0F4424BA998BE699AAD759D"><enum>(E)</enum><text>in paragraph (6)(A), as redesignated by subparagraph (B) of this paragraph, by striking <quote>paragraph (4)</quote> and inserting <quote>paragraph (5)</quote>;</text></subparagraph><subparagraph id="IDf221d3d1838041ff81e84de45132f7c8"><enum>(F)</enum><text>in paragraph
			 (7)(A), as redesignated by subparagraph (B) of this paragraph, by striking

			 elder abuse, neglect, and exploitation</header><text>Section 721 of the
			 Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3058i">42 U.S.C. 3058i</external-xref>) is amended—</text><paragraph id="idAAC92C5535544774B9CBB2AED4F924BA"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="idFE2DD498AD6143EDBFF303B9E8F2B89E"><enum>(A)</enum><text>by redesignating paragraphs (5) through (12) as paragraphs (6) through (13), respectively;</text></subparagraph><subparagraph id="idB5D3E33A51624BD9B81962C9700D7053"><enum>(B)</enum><text>by inserting after paragraph (4) the following:</text><quoted-block display-inline="no-display-inline" id="id1438A1318C3C4A10BB6FDACE975A43A9" style="OLC"><paragraph id="ide46719a6b23640508aacad681097d55b"><enum>(5)</enum><text>promoting the submission of

			 inserting <quote>and behavioral</quote> after <quote>mental</quote>.</text></subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="idADDD23D88A71450B9AF3562D053030A1"><enum>10.</enum><header>Study on transportation services</header><subsection id="id8f4455309ecc4cbab9dceb2fdf435c57"><enum>(a)</enum><header>Study</header><paragraph id="id71ffcd99f69340bd8c1f97d277ed9dd6"><enum>(1)</enum><header>In general</header><text>Because access to transportation services is critical for millions of older individuals in the United States, to allow them to maintain independence, health, and quality of life, the Comptroller General of the United States shall conduct a study of transportation services for older individuals.</text></paragraph><paragraph id="id3fc366cc63054e8fab870db3801acea0"><enum>(2)</enum><header>Contents</header><text>In conducting the study, the Comptroller General—</text><subparagraph id="id2f9b2304a8654ec7944dbbc4e26a4de4"><enum>(A)</enum><text>shall identify challenges and barriers affecting the aging network in providing, accessing, or coordinating efficient and effective transportation services, including challenges and barriers in coordinating services with Federal agencies and programs such as the Department of Transportation and Medicaid program under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>); and</text></subparagraph><subparagraph id="id566e0247c16543289f40a8bf1d74c043"><enum>(B)</enum><text>shall examine any Federal program requirements that may result in challenges or barriers to the coordination of transportation services within the aging network at the local level.</text></subparagraph></paragraph></subsection><subsection id="id48ee0cbcb793407295a7a4f852322c8e"><enum>(b)</enum><header>Report</header><text>Not later than 18 months after the date of enactment of this Act, the Comptroller General shall issue a report. The report shall contain a detailed description of the findings and conclusions of the study, including any recommendations for administrative and other changes to enhance transportation services provided by the aging network. The Comptroller General shall submit the report to the Committee on Education and the Workforce of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate.</text></subsection></section><section id="id19D0D18C4C1942E1800B3C644ECEF2B8"><enum>11.</enum><header>Guidance on serving Holocaust survivors</header><subsection id="id1729ad57c97645439c95237805631f93"><enum>(a)</enum><header>In general</header><text>Because the services under the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3001">42 U.S.C. 3001 et seq.</external-xref>)  are critical to meeting the urgent needs of Holocaust survivors to age in place with dignity, comfort, security, and quality of life, the Assistant Secretary for Aging shall issue guidance to States, that shall be applicable to States, area agencies on aging, and providers of services for older individuals, with respect to serving Holocaust survivors, including guidance on promising practices for conducting outreach to that population. In  developing the guidance, the Assistant Secretary for Aging shall consult with experts and organizations serving Holocaust survivors, and shall take into account the possibility that the needs of Holocaust survivors may differ based on geography.</text></subsection><subsection id="idcc0e6e04e28f4510b501d5e11cff8846"><enum>(b)</enum><header>Contents</header><text>The guidance shall include the following:</text><paragraph id="id56786905169a4f5d891e92b95be6f42c"><enum>(1)</enum><text>How nutrition service providers may meet the special health-related or other dietary needs of participants in  programs under the Older Americans Act of 1965, including needs based on religious, cultural, or ethnic requirements.</text></paragraph><paragraph id="id580513e3d8b5468f80b6cdab75a4f183"><enum>(2)</enum><text>How transportation service providers may address the urgent transportation needs of Holocaust survivors.</text></paragraph><paragraph id="id72c56e1e75a943f98264ca3259d3a770"><enum>(3)</enum><text>How  State long-term care ombudsmen may address the unique needs of residents of long-term care facilities for whom institutional settings may produce sights, sounds, smells, emotions, and routines, that can induce panic, anxiety, and retraumatization as a result of experiences from the Holocaust.</text></paragraph><paragraph id="ide274455c8ee046d485e810a1039ca6c9"><enum>(4)</enum><text>How supportive services providers may consider the unique needs of Holocaust survivors.</text></paragraph><paragraph id="id1edc48ada7984d7a9909507c953d4dfe"><enum>(5)</enum><text>How other services provided under that Act, as determined by the Assistant Secretary for Aging, may serve Holocaust survivors.</text></paragraph></subsection><subsection id="id9e16739ac0f04044b7e21527380f4edd"><enum>(c)</enum><header>Date of issuance</header><text>The guidance described in subsection (a) shall be issued not later than 180 days after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
