		  discharge of oil in connection with the explosion on, and sinking of, the
		  mobile offshore drilling unit Deepwater Horizon.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Gulf Coast Oil Recovery Zone Tax
			 Relief and Economic Recovery Act</short-title></quote>.</text></section><section id="idFC675DFD97844940ADC1A82AFF9B0807"><enum>2.</enum><header>Recovery zone;
			 Gulf oil spill</header><text display-inline="no-display-inline">For purposes of
			 this Act—</text><paragraph id="id4CA9DF5A98D94CA5968E624FEBFE7F95"><enum>(1)</enum><header>Recovery
			 zone</header><text display-inline="yes-display-inline">The term <term>Recovery
			 Zone</term> means the following counties and parishes affected by the Gulf oil
			 spill:</text><subparagraph id="id41EEE6FB09C54627B4494EC354A50B2D"><enum>(A)</enum><text>The counties of
			 Escambia, Santa Rosa, Okaloosa, Walton, Bay, Gulf, Franklin, and Wakulla in the
			 State of Florida.</text></subparagraph><subparagraph id="id4EB8FEE2706943958A683925AB8C1C8E"><enum>(B)</enum><text>The counties of
			 Hancock, Harrison, and Jackson in the State of Mississippi.</text></subparagraph><subparagraph id="id629B1B1077A4431D9E49E68501513F6B"><enum>(C)</enum><text>The counties of
			 Mobile and Baldwin in the State of Alabama.</text></subparagraph><subparagraph id="id9656987BC62A4235B0AB193A706FFE3E"><enum>(D)</enum><text>The parishes of
			 Orleans, St. Tammany, St. Bernard, Plaquemines, Jefferson, Lafourche,
			 Terrebonne, St. Mary, Iberia, Vermilion, and Cameron in the State of
			 Louisiana.</text></subparagraph></paragraph><paragraph id="H54A215B7A9924FD28AE9572DDADA9BAA"><enum>(2)</enum><header>Gulf Oil
			 Spill</header><text display-inline="yes-display-inline">The term <term>Gulf oil
			 spill</term> means the discharge of oil by reason of the explosion on, and
			 sinking of, the mobile offshore drilling unit Deepwater Horizon.</text></paragraph></section><section id="id10AD8FD09124406C886A8E4F79E54541"><enum>3.</enum><header>Non-recognition
			 of income from insurance proceeds which are reinvested in the recovery
			 zone</header><subsection id="id564867C1462B4BB89082534A374F2A8E"><enum>(a)</enum><header>In
			 general</header><text>For purposes of the Internal Revenue Code of 1986,
			 amounts received from any qualified Gulf oil spill payment shall be recognized
			 only to the extent that the amount realized exceeds the qualified investments
			 made by the taxpayer with respect to such qualified Gulf oil spill
			 payment.</text></subsection><subsection id="idB1CF5F71F8E3434D80EDBECC0135F109"><enum>(b)</enum><header>Qualified Gulf
			 oil spill payment</header><text>For purposes of this section, the term
			 <term>qualified Gulf oil spill payment</term> means—</text><paragraph id="id18F2239B4D894E068B4435226ADAF97B"><enum>(1)</enum><text>any proceeds or
			 payments from insurance received in connection with the Gulf oil spill,
			 or</text></paragraph><paragraph id="idFC21CFFBDD7A4E62997BC609717C4CCF"><enum>(2)</enum><text>any payment for
			 damages attributable to the Gulf oil spill under section 1002 of the Oil
			 Pollution Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/33/2702">33 U.S.C. 2702</external-xref>).</text></paragraph></subsection><subsection id="idBEFD7A8DEB484149A053C54D82B81FE5"><enum>(c)</enum><header>Qualified
			 investment</header><text>For purposes of this section—</text><paragraph id="id8884B29A66424B45AA553964CFA8826A"><enum>(1)</enum><header>In
			 general</header><text>The term <term>qualified investment</term> means, with
			 respect to any qualified Gulf oil spill payment, the sum of the qualified
			 recovery zone investments which are made by the taxpayer before the date which
			 is 5 years after the later of—</text><subparagraph id="idC32622B09DEE4337BD4EE6A4D5D1AEF1"><enum>(A)</enum><text>the date of the
			 qualified Gulf oil spill payment, or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6AC3B6B14AA04A53874F6E351A94A82C"><enum>(B)</enum><text>the date of the
			 enactment of this Act.</text></subparagraph></paragraph><paragraph id="id56169540168E4AD8816C690A8A022D58"><enum>(2)</enum><header>Qualified
			 recovery zone investment</header><text>The term <term>qualified recovery zone
			 investment</term> means the sum of—</text><subparagraph id="id243C001B9E9748C3AFF32BB05A1662E6"><enum>(A)</enum><text>amounts paid or
			 incurred for tangible property (to which section 168 of the Internal Revenue
			 Code of 1986 applies) acquired by purchase (within the meaning of section
			 179(d)(2) of such Code) for use in the active conduct of a recovery zone trade
			 or business property, plus</text></subparagraph><subparagraph id="idC4BA88CFB72041EFABD66907778A4FB7"><enum>(B)</enum><text>amounts paid or
			 incurred for start-up expenditures (as defined in section 195(c)) in connection
			 with a qualified recovery zone trade or business.</text></subparagraph></paragraph><paragraph id="id6DBF39B44977418CA215F29086893529"><enum>(3)</enum><header>Qualified
			 recovery zone trade or business</header><text>The term <term>qualified recovery
			 zone trade or business</term> means—</text><subparagraph id="idE65EDBBA39CB49AB8E9BF71C7FE8CAC0"><enum>(A)</enum><text>any commercial or
			 charter fishing business operating in the recovery zone, or</text></subparagraph><subparagraph id="id2FAF8F20D64341B49F156B8D7B25D405"><enum>(B)</enum><text>any hotel,
			 lodging, recreation, entertainment, or restaurant business located in the
			 recovery zone.</text></subparagraph></paragraph></subsection><subsection commented="no" id="idDDE0871BAE794860B954A91BE5640ECE"><enum>(d)</enum><header>Reduction in
			 basis</header><text>For purposes of section 1016 of the Internal Revenue Code
			 of 1986, the basis in any qualified investment shall be reduced (but not below
			 zero) by an amount equal to the amount that bears the same ratio to such basis
			 (determined without regard to this subsection) as the amount of qualified Gulf
			 oil spill payments received by the taxpayer bears to the amount of qualified
			 investments made by the taxpayer with respect to such qualified Gulf oil spill
			 payments.</text></subsection><subsection id="idd8271592cdf145efadf75e764fef0a44"><enum>(e)</enum><header>Effective
			 date</header><text>This Act shall apply with respect to amounts received from
			 any qualified Gulf oil spill payment and qualified investments made in taxable
			 years ending after April 20, 2010.</text></subsection></section></legis-body></bill>
