		<official-title>To authorize the Secretary of Veterans Affairs and the
		  Secretary of the Army to reconsider decisions to inter or honor the memory of a
		  person in a national cemetery, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Alicia Dawn Koehl Respect for
			 National Cemeteries Act</short-title></quote>.</text>
		</section><section id="idcfd6ceb012af40e795bdcf995e772448"><enum>2.</enum><header>Authority to
			 reconsider decisions of Secretary of Veterans Affairs or Secretary of the Army
			 to inter the remains or honor the memory of a person in a national
			 cemetery</header>
			<subsection id="id97250200c86044de9e188f2e5b637f6c"><enum>(a)</enum><header>Authority To
			 reconsider prior decisions</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/2411">Section 2411</external-xref> of title 38, United
			 States Code, is amended—</text>
				<paragraph id="id227EC3294B1B42579AC69D375F446F7B"><enum>(1)</enum><text>by redesignating
			 subsection (d) as subsection (e); and</text>
				</paragraph><paragraph id="idAD322DED9A38425AB4B30AED9E364CDF"><enum>(2)</enum><text>by inserting
			 after subsection (c) the following new subsection (d):</text>
					<quoted-block display-inline="no-display-inline" id="id96b887e3da0a4c28904bc3022d906196" style="OLC">
						<subsection id="idc005547effd94aab9752f844c1374f84"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id15C67CB3F356457782EC12E9EA588A95"><enum>(1)</enum><text>In a case described in
				paragraph (2)(A), the appropriate Federal official may reconsider a decision
				to—</text>
								<subparagraph id="idb7dd00dda00445a6aa17e7db1e44cc9d" indent="up1"><enum>(A)</enum><text>inter the remains of a person in a
				cemetery in the National Cemetery Administration or in Arlington National
				Cemetery; or</text>
								</subparagraph><subparagraph id="id235df667ce3c41f79dc6f57a2151317f" indent="up1"><enum>(B)</enum><text>honor the memory of a person in a
				memorial area in a cemetery in the National Cemetery Administration (described
				in section 2403(a) of this title) or in such an area in Arlington National
				Cemetery (described in section 2409(a) of this title).</text>
								</subparagraph></paragraph><paragraph id="idd708c0b6df214940ae44569f1c664d25" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id5F56068303F244DD926311F68FCB94EA"><enum>(A)</enum><text>A case described in
				this paragraph is a case in which the appropriate Federal official receives
				information that a person described in subparagraph (B) may have committed a
				Federal capital crime or a State capital crime but was not convicted of such
				crime by reason of such person not being available for trial due to death or
				flight to avoid prosecution.</text>
								</subparagraph><subparagraph id="idb064323e6cc04bbc869804db4f94d9c2" indent="up1"><enum>(B)</enum><text>A person described in this
				subparagraph is a person—</text>
									<clause id="idE51AA7FC18D74946B4D0F506D6E25C9C"><enum>(i)</enum><text>whose remains have been interred in a
				cemetery in the National Cemetery Administration or in Arlington National
				Cemetery; or</text>
									</clause><clause id="id0e2a4519b4134444ab8d46747830940a"><enum>(ii)</enum><text>whose memory has been honored in a
				memorial area in a cemetery in the National Cemetery Administration or in such
				an area in Arlington National Cemetery.</text>
									</clause></subparagraph></paragraph><paragraph id="idbe2c975b99f44ecc86abb1f190d4e724" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id8E53D0C92ADB46BFA14B3F7B91A85D9A"><enum>(A)</enum><text>If in a case described
				in paragraph (2), the appropriate Federal official finds, based upon a showing
				of clear and convincing evidence and after an opportunity for a hearing in a
				manner prescribed by the appropriate Federal official, that the person had
				committed a Federal capital crime or a State capital crime but had not been
				convicted of such crime by reason of such person not being available for trial
				due to death or flight to avoid prosecution, the appropriate Federal official
				shall provide notice to the deceased person’s next of kin or other person
				authorized to arrange burial or memorialization of the deceased person of the
				decision of the appropriate Federal official to disinter the remains of the
				deceased person or to remove a memorial headstone or marker memorializing the
				deceased person.</text>
								</subparagraph><subparagraph id="id3A416B2945C34C9FAC645DCEE62E7938" indent="up1"><enum>(B)</enum><text>Notice under subparagraph (A) shall
				be provided by the appropriate Federal official as follows:</text>
									<clause id="id5937BE822B5D42BFBFAF745520D672D5"><enum>(i)</enum><text>By the Secretary in accordance with
				section 5104 of this title.</text>
									</clause><clause id="idC977117D1AB04FAD93EA99D80144CDEA"><enum>(ii)</enum><text>By the Secretary of Defense in
				accordance with such regulations as the Secretary of Defense shall prescribe
				for purposes of this subsection.</text>
									</clause></subparagraph></paragraph><paragraph id="id168a883a09bb41ea889f1520ef4e66ad" indent="up1"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id8BAC286124C14DEC83D3C3D018F7C530"><enum>(A)</enum><text>Notwithstanding any
				other provision of law, the next of kin or other person authorized to arrange
				burial or memorialization of the deceased person shall be allowed a period of
				60 days from the date of the notice required by paragraph (3) to file a notice
				of disagreement with the Federal official that provided the notice.</text>
								</subparagraph><subparagraph id="id9FF8CD5450F344ECAB70A3ADA15D3FCC" indent="up1"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id785F23114BE44897A897F61EC103ACF1"><enum>(i)</enum><text>A notice of
				disagreement filed with the Secretary under subparagraph (A) shall be treated
				as a notice of disagreement filed with the Board of Veterans’ Appeals under
				chapter 71 of this title, and shall be decided by the Board in accordance with
				the provisions of that chapter.</text>
									</clause><clause id="idB9C0779D579149918465DB23AC1C26A5" indent="up1"><enum>(ii)</enum><text>A notice of disagreement filed with
				the Secretary of Defense under subparagraph (A) shall be decided in accordance
				with such regulations as the Secretary of Defense shall prescribe for purposes
				of this subsection.</text>
									</clause></subparagraph></paragraph><paragraph id="idf6238aa1f4694cd292fba4564c59b55e" indent="up1"><enum>(5)</enum><text>When the decision of the appropriate
				Federal official to disinter the remains or remove a memorial headstone or
				marker of the deceased person becomes final either by failure to appeal the
				decision in accordance with paragraph (4)(A) or by a decision pursuant to
				paragraph (4)(B), the appropriate Federal official may take any of the
				following actions:</text>
								<subparagraph id="ide835c2975cc94c898a96187a1a0af204"><enum>(A)</enum><text>Disinter the remains of the person
				from the cemetery in the National Cemetery Administration or in Arlington
				National Cemetery and provide for the reburial or other appropriate disposition
				of the disinterred remains in a place other than a cemetery in the National
				Cemetery Administration or in Arlington National Cemetery.</text>
								</subparagraph><subparagraph id="idaf6dc1c5515f4c52af24ca5986de3c47"><enum>(B)</enum><text>Remove from a memorial area in a
				cemetery in the National Cemetery Administration or in Arlington National
				Cemetery any memorial headstone or marker placed to honor the memory of the
				person.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id819308cdbc534aaa9dd067f67412ab9a"><enum>(b)</enum><header>Applicability</header><text>The
			 amendments made by subsection (a) shall apply with respect to any interment or
			 memorialization conducted by the Secretary of Veterans Affairs or the Secretary
			 of the Army in a cemetery in the National Cemetery Administration or in
			 Arlington National Cemetery after the date of the enactment of this Act.</text>
			</subsection></section><section id="id7531E35066DD4960918D90D9520A6F34"><enum>3.</enum><header>Disinterment of
			 remains of Michael LaShawn Anderson from Fort Custer National Cemetery</header>
			<subsection id="idFB94AEB5B5C2401FA62C6A8BA61D1C29"><enum>(a)</enum><header>Disinterment of
			 remains</header><text>The Secretary of Veterans Affairs shall disinter the
			 remains of Michael LaShawn Anderson from Fort Custer National Cemetery.</text>
			</subsection><subsection id="idD8DFB0AABB4140FD8A9ED58741652AC3"><enum>(b)</enum><header>Notification of
			 Next-of-Kin</header><text>The Secretary of Veterans Affairs shall—</text>
				<paragraph id="id77b5a698be834e9489bf6cf2e7b687ba"><enum>(1)</enum><text>notify the
			 next-of-kin of record for Michael LaShawn Anderson of the impending
			 disinterment of his remains; and</text>
				</paragraph><paragraph id="ida0a3efee734f4e748bea02a445013985"><enum>(2)</enum><text>upon
			 disinterment, relinquish the remains to the next-of-kin of record for Michael
			 LaShawn Anderson or, if the next-of-kin of record for Michael LaShawn Anderson
			 is unavailable, arrange for an appropriate disposition of the remains.</text>
				</paragraph></subsection></section></legis-body>
