		  the rule allowing discharge as a nonpriority claim of governmental claims
		  arising from the disposition of farm assets under chapter 12
		  bankruptcies.</official-title></form><legis-body><section id="id2AF15F24CE124C1D918B97AC80492DA6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Family Farmer Bankruptcy Clarification
			 Act of 2013</short-title></quote>.</text></section><section id="id0350C2B784904672B6F0C9D381F9CDF5" section-type="subsequent-section"><enum>2.</enum><header>Clarification of rule
			 allowing discharge to governmental claims arising from the disposition of farm
			 assets under chapter 12 bankruptcies</header><subsection id="idA657EF833598442DA359D2A00F7E1C99"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subchapter II of
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/11/12">chapter 12</external-xref> of title 11, United States Code, is amended by adding at the end the
			 following:</text><quoted-block display-inline="no-display-inline" id="idAAF4ED3797CB4B9B921B88B95C9199A5" style="USC"><section id="id37c021b192544305a5166c063934c6ab"><enum>1232.</enum><header>Claim by a
				governmental unit based on the disposition of property used in a farming
				operation</header><subsection id="idb6b48fbe61f247c18ba0acc30a341d8c"><enum>(a)</enum><text>Any unsecured
				claim of a governmental unit against the debtor or the estate that arises
				before the filing of the petition, or that arises after the filing of the
				petition and before the debtor’s discharge under section 1228, as a result of
				the sale, transfer, exchange, or other disposition of any property used in the
				debtor’s farming operation—</text><paragraph id="idEA83854FEEC84B9BA9F68E174C25016A"><enum>(1)</enum><text>shall be treated
				as an unsecured claim arising before the date on which the petition is
				filed;</text></paragraph><paragraph id="id482A97B838CF44B4ABB28E878D6056D1"><enum>(2)</enum><text>shall not be
				entitled to priority under section 507;</text></paragraph><paragraph id="idEE142D31921047DCB1259AA5F7D12A7A"><enum>(3)</enum><text>shall be provided
				for under a plan; and</text></paragraph><paragraph id="id64026E87096C4E59AB74FA90F5D93557"><enum>(4)</enum><text>shall be
				discharged in accordance with section 1228.</text></paragraph></subsection><subsection id="id011b1306207647d8a6ad92670831c1a1"><enum>(b)</enum><text>For purposes of
				applying sections 1225(a)(4), 1228(b)(2), and 1229(b)(1) to a claim described
				in subsection (a) of this section, the amount that would be paid on such claim
				if the estate of the debtor were liquidated in a case under chapter 7 of this
				title shall be the amount that would be paid by the estate in a chapter 7 case
				if the claim were an unsecured claim arising before the date on which the
				petition was filed and were not entitled to priority under section 507.</text></subsection><subsection id="id11f39b05d9424b3187c9099d63d21547"><enum>(c)</enum><text>For purposes of
				applying sections 523(a), 1228(a)(2), and 1228(c)(2) to a claim described in
				subsection (a) of this section, the claim shall not be treated as a claim of a
				kind specified in section 523(a)(1).</text></subsection><subsection id="idf4be0309eeb5422eabdd99bbd16084fc"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idAD0C82777EF14F169E749E91FDCEDDDB"><enum>(1)</enum><text>A governmental unit may
				file a proof of claim for a claim described in subsection (a) that arises after
				the date on which the petition is filed.</text></paragraph><paragraph id="idD9E66072777B492D82A93CBEFE0E0D02" indent="up1"><enum>(2)</enum><text>If a debtor files a tax return after
				the filing of the petition for a period in which a claim described in
				subsection (a) arises, and the claim relates to the tax return, the debtor
				shall serve notice of the claim on the governmental unit charged with the
				responsibility for the collection of the tax at the address and in the manner
				designated in section 505(b)(1). Notice under this paragraph shall state that
				the debtor has filed a petition under this chapter, state the name and location
				of the court in which the case under this chapter is pending, state the amount
				of the claim, and include a copy of the filed tax return and documentation
				supporting the calculation of the claim.</text></paragraph><paragraph id="id2FC80012D41C4AC294C70F0DD9ED8732" indent="up1"><enum>(3)</enum><text>If notice of a claim has been served
				on the governmental unit in accordance with paragraph (2), the governmental
				unit may file a proof of claim not later than 180 days after the date on which
				such notice was served. If the governmental unit has not filed a timely proof
				of the claim, the debtor or trustee may file proof of the claim that is
				consistent with the notice served under paragraph (2). If a proof of claim is
				filed by the debtor or trustee under this paragraph, the governmental unit may
				not amend the proof of claim.</text></paragraph><paragraph id="idC2CAB5EB7DBA4E0CA27860ECA44DAAB0" indent="up1"><enum>(4)</enum><text>A claim filed under this subsection
				shall be determined and shall be allowed under subsection (a), (b), or (c) of
				section 502, or disallowed under subsection (d) or (e) of section 502, in the
				same manner as if the claim had arisen immediately before the date of the
				filing of the
				petition.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id3D2DE52D12A041ED846B278DFB747315"><enum>(b)</enum><header>Technical and
			 conforming amendments</header><paragraph id="id042C0AE581C746B8875005D317B3F6AC"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subchapter II of
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/11/12">chapter 12</external-xref> of title 11, United States Code, is amended—</text><subparagraph id="idD1A4145E3DE545A9A140978BDCA1E5C2"><enum>(A)</enum><text display-inline="yes-display-inline">in section 1222(a)—</text><clause id="id0662FC4DB16A41FBA1F5B03E282A4AE9"><enum>(i)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking
			 <quote>unless—</quote> and all that follows through <quote>the holder</quote>
			 and inserting <quote>unless the holder</quote>;</text></clause><clause id="idB61BD142405E4A8FB22221A4F7362321"><enum>(ii)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking
			 <quote>and</quote> at the end;</text></clause><clause id="id6DE9F5C77EFA4C7A9D2635A03EFB9D1E"><enum>(iii)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking the period at
			 the end and inserting <quote>; and</quote>; and</text></clause><clause id="id39C49D9A64FF4365B2F20FB7FE94D5A5"><enum>(iv)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idB1117DAF0830440395EA729C79A9C11F" style="OLC"><paragraph id="idD386D90529EE4FEE9C4ED412124DCB99"><enum>(5)</enum><text display-inline="yes-display-inline">subject to section 1232, provide for the
				treatment of any claim by a governmental unit of a kind described in section
				1232(a).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id4ED07B57C39D4473A0EF8BDAF7A629B5"><enum>(B)</enum><text>in section
			 1228—</text><clause id="id81E1E3931DB045E49A30273F2C5CDC36"><enum>(i)</enum><text>in
			 subsection (a)—</text><subclause id="idF6E1BF71FC9F4A60BA9714DCC8DB7AFE"><enum>(I)</enum><text>in the matter
			 preceding paragraph (1)—</text><item commented="no" display-inline="no-display-inline" id="id3A5E081FA4DE483DB39A878D24989F7C"><enum>(aa)</enum><text>by inserting a
			 comma after <quote>all debts provided for by the plan</quote>; and</text></item><item commented="no" display-inline="no-display-inline" id="id21BBE94859CD41C2A5D0249A2884597C"><enum>(bb)</enum><text>by inserting a
			 comma after <quote>allowed under section 503 of this title</quote>; and</text></item></subclause><subclause id="id6D8112BC2015413391F8D2B558BAE5D0"><enum>(II)</enum><text>in paragraph
			 (2), by striking <quote>the kind</quote> and all that follows and inserting
			 <quote>a kind specified in section 523(a) of this title, except as provided in
			 section 1232(c).</quote>; and</text></subclause></clause><clause id="idC8C3E946461A4A06AC4AF699CB21D321"><enum>(ii)</enum><text>in
			 subsection (c)(2), by inserting <quote>, except as provided in section
			 1232(c)</quote> before the period at the end; and</text></clause></subparagraph><subparagraph id="id06405223A3014042989BFB98DEB12AB7"><enum>(C)</enum><text>in section
			 1229(a)—</text><clause id="id6BDC21FC858F431FA72C10D3947BF30D"><enum>(i)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking
			 <quote>or</quote> at the end;</text></clause><clause id="id8C826BCDB40F487F840822AC7030DDDC"><enum>(ii)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking the period at
			 the end and inserting <quote>; or</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idED3B0E5C4F80461AAA907A3DCFB8CF99"><enum>(iii)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idBF5C5A39F1ED45F7A1122C644D65B359" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="id390EB1C0F5D243AD9D6FB6B016236FC4"><enum>(4)</enum><text>provide for the
				payment of a claim described in section 1232(a) that arose after the date on
				which the petition was
				filed.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3E3412599C9B4BE1ADD015CEA3926DCC"><enum>(2)</enum><header>Table of
			 sections</header><text>The table of sections for subchapter II of chapter 12 of
			 title 11, United States Code, is amended by adding at the end the
			 following:</text><quoted-block id="idacfac652-74b2-4312-b4a4-4d2126b7cc0a" style="USC"><toc><toc-entry idref="id37c021b192544305a5166c063934c6ab" level="section">1232. Claim by a governmental unit based on the disposition of
				property used in a farming
				operation.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idD8E4F860280448268E001DB715F8972A"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to any
			 bankruptcy case that—</text><paragraph id="idD6D776C6CD2146959E54A444DB9E3FC1"><enum>(1)</enum><text>is pending on the
			 date of enactment of this Act and relating to which an order of discharge under
			 <external-xref legal-doc="usc" parsable-cite="usc/11/1228">section 1228</external-xref> of title 11, United States Code, has not been entered; or</text></paragraph><paragraph id="id9C21991F67DD4C2B830C90C116FAC434"><enum>(2)</enum><text>commences on or
			 after the date of enactment of this Act.</text></paragraph></subsection></section></legis-body></bill>
