		<official-title>To amend title 5, United States Code, to provide for
		  investigative leave requirements with respect to Senior Executive Service
		  employees, and for other purposes.</official-title>

		<section id="HE786FB0C4B924AB0915644F10D1F87C9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Government Employee Accountability
			 Act</short-title></quote>.</text>
		</section><section commented="no" id="HF29C7892D1C6451C90D57D5C38A52498"><enum>2.</enum><header>Suspension for 14
			 days or less for senior executive service employees</header><text display-inline="no-display-inline">Paragraph (1) of <external-xref legal-doc="usc" parsable-cite="usc/5/7501">section 7501</external-xref> of title 5,
			 United States Code, is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="HA73620440293404FA3E53551ACA62619" style="USC">
				<paragraph id="HAF7177D4F629432D92F00474F7192CFC"><enum>(1)</enum><text display-inline="yes-display-inline"><quote>employee</quote> means—</text>
					<subparagraph commented="no" id="H73ACF8B205A54FC9BEE8C3CEEFD2927B"><enum>(A)</enum><text>an individual in
				the competitive service who is not serving a probationary or trial period under
				an initial appointment or who has completed 1 year of current continuous
				employment in the same or similar positions under other than a temporary
				appointment limited to 1 year or less; or</text>
					</subparagraph><subparagraph commented="no" id="HC2C4B0911C7A4B36B2A3CC45763F3E4A"><enum>(B)</enum><text>a career appointee
				in the Senior Executive Service who—</text>
						<clause commented="no" id="HCD4D0444CB2B4B03A8F21364E5339B59"><enum>(i)</enum><text>has completed the
				probationary period prescribed under section 3393(d); or</text>
						</clause><clause commented="no" id="HE873BB76535045B880C8F396BF2FB16B"><enum>(ii)</enum><text>was covered by
				the provisions of subchapter II of this chapter immediately before appointment
				to the Senior Executive Service;
				and</text>
						</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H59C14D709A724A9F9B14AD1C8EE9A0A8"><enum>3.</enum><header>Investigative
			 leave and termination authority for Senior Executive Service employees</header>
			<subsection id="HF94FC591C7CD450E909873212E00317C"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 75 of title
			 5, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HCD3632718C0640009EDC76D4EC56A34E" style="USC">
					<subchapter id="HDFDF836D033D44D49ED38A4F62613476"><enum>VI</enum><header>Investigative
				leave for Senior Executive Service employees</header>
						<section id="H6B042C0F197847869F5B72EE759020CD"><enum>7551.</enum><header>Definitions</header><text display-inline="no-display-inline">For the purposes of this subchapter—</text>
							<paragraph id="H5D7D59118AF949F49319AF4233900F1B"><enum>(1)</enum><text>the term
				<quote>employee</quote> has the meaning given such term in section 7541;
				and</text>
							</paragraph><paragraph id="HF29BE9552C1646929F9EC1236B5A79E8"><enum>(2)</enum><text display-inline="yes-display-inline">the term <quote>investigative leave</quote>
				means a temporary absence without duty for disciplinary reasons that, except as
				provided in section 7553(b)(4), shall not exceed a period of more than 90
				days.</text>
							</paragraph></section><section display-inline="no-display-inline" id="HBDC7BD36DFC44ECF877B6A1B3947A2D9" section-type="subsequent-section"><enum>7552.</enum><header>Actions
				covered</header><text display-inline="no-display-inline">This subchapter
				applies to investigative leave.</text>
						</section><section id="HE1436386C48A490D96FE370934679DCB"><enum>7553.</enum><header>Cause and
				procedure</header>
							<subsection id="H7495DD82A7EA40EDAC24BEA5548E4CCD"><enum>(a)</enum><header>Placing on
				investigative leave</header>
								<paragraph id="id9065E16CD9164F82A13AA6BA1F0917A0"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Under regulations
				prescribed by the Office of Personnel Management, an agency may place an
				employee on investigative leave, without loss of pay and without charge to
				annual or sick leave, only for alleged misconduct, neglect of duty,
				malfeasance, or misappropriation of funds.</text>
								</paragraph><paragraph id="HB20655C321AE4936869C961A461D1246"><enum>(2)</enum><header>Without
				pay</header><text>If an agency determines that the alleged conduct of an
				employee is serious or flagrant, the agency may place the employee on
				investigative leave without pay.</text>
								</paragraph></subsection><subsection id="HFBDA778A385646DBB93A6412AA27C7ED"><enum>(b)</enum><header>Review</header>
								<paragraph id="id8C2E94B3BCC94557A860FE4B003C3D23"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">At the end of each
				45-day period during a period of investigative leave, the agency employing the
				employee on investigative leave shall review the investigation of the alleged
				misconduct, neglect of duty, malfeasance, or misappropriation of funds by the
				employee.</text>
								</paragraph><paragraph id="HEAB08C4DB91349D4A8515FA532FED22C"><enum>(2)</enum><header>Report</header><text>Not
				later than 5 business days after the end of each 45-day period described in
				paragraph (1), an agency shall submit a report describing the review under
				paragraph (1) to the Committee on Homeland Security and Governmental Affairs of
				the Senate and the Committee on Oversight and Government Reform of the House of
				Representatives.</text>
								</paragraph><paragraph id="H403BC184F59E46C0A61A5F07B19DDB0C"><enum>(3)</enum><header>Action</header><text>At
				the end of a period of investigative leave implemented under this section, the
				agency shall—</text>
									<subparagraph id="HDAFD9B63A89D41728D3685B379C685AB"><enum>(A)</enum><text>remove an employee
				placed on investigative leave under this section;</text>
									</subparagraph><subparagraph id="HC637FFEF537E437987D459254E8F5AD9"><enum>(B)</enum><text>suspend the
				employee without pay; or</text>
									</subparagraph><subparagraph id="H3C1437DA87724E82A846C8242721991F"><enum>(C)</enum><text>reinstate or
				restore the employee to duty.</text>
									</subparagraph></paragraph><paragraph id="H602E291F94934DAC90BF8B1CDCA61CA6"><enum>(4)</enum><header>Extension of
				period</header><text>An agency may extend the period of investigative leave
				with respect to an employee for 1 additional period not to exceed 90
				days.</text>
								</paragraph></subsection><subsection id="H95262F1BDC704109A21F862CFBDA7E37"><enum>(c)</enum><header>Procedure</header><text display-inline="yes-display-inline">An employee against whom an action under
				this subchapter is proposed is entitled to, before being placed on
				investigative leave under this section—</text>
								<paragraph id="HA9689397EAF34B30B02785773B75AA3E"><enum>(1)</enum><text display-inline="yes-display-inline">at least 30 days advance written notice,
				stating specific reasons for the proposed action, unless—</text>
									<subparagraph id="HFD7A28FBFB1E4666B3C7F7E85E39795F"><enum>(A)</enum><text>there is
				reasonable cause to believe that the employee has committed a crime for which a
				sentence of imprisonment can be imposed; or</text>
									</subparagraph><subparagraph id="H22481999B6994917B12DF5A273A39D50"><enum>(B)</enum><text display-inline="yes-display-inline">the agency determines that the conduct of
				the employee with respect to which an action covered by this subchapter is
				proposed is serious or flagrant, in accordance with regulations prescribed by
				the Office of Personnel Management;</text>
									</subparagraph></paragraph><paragraph id="H47712DD1A08345C5AEDFA8F56BA0853E"><enum>(2)</enum><text display-inline="yes-display-inline">a reasonable time, but not less than 7
				days, to answer orally and in writing and to furnish affidavits and other
				documentary evidence in support of the answer;</text>
								</paragraph><paragraph id="H78B1E7DE0F3F49FA8250C6E8820A0E52"><enum>(3)</enum><text display-inline="yes-display-inline">be represented by an attorney or other
				representative; and</text>
								</paragraph><paragraph id="H9A73F14628BD47668E54AA8295B67840"><enum>(4)</enum><text display-inline="yes-display-inline">a written decision and specific reasons
				therefor at the earliest practicable date.</text>
								</paragraph></subsection><subsection id="HB5DFB486756849D5BBF727D26699418F"><enum>(d)</enum><header>Hearings
				permissible</header><text display-inline="yes-display-inline">An agency may
				provide, by regulation, for a hearing which may be in lieu of or in addition to
				the opportunity to answer provided under subsection (c)(2).</text>
							</subsection><subsection id="H7560735048DC4F799AB1F5F38E3DF8A5"><enum>(e)</enum><header>Appeal</header><text>An
				employee against whom an action is taken under this section is entitled to
				appeal to the Merit Systems Protection Board under section 7701.</text>
							</subsection><subsection id="H04106C186FF84C8989ABA3BC335D2CC9"><enum>(f)</enum><header>Materials</header><text display-inline="yes-display-inline">Copies of the notice of proposed action,
				the answer of the employee when written, and a summary thereof when made
				orally, the notice of decision and reasons therefor, and any order effecting an
				action covered by this subchapter, together with any supporting material, shall
				be maintained by the agency and shall be furnished to the Merit Systems
				Protection Board upon its request and to the employee affected upon the
				employee’s request.</text>
							</subsection></section></subchapter><subchapter id="HE3031B493255422BA830BCB556F32393"><enum>VII</enum><header>Removal of
				Senior Executive Service employees</header>
						<section id="H40BBA6D9BF7D4D198C09BB167F2BABD4"><enum>7561.</enum><header>Definition</header><text display-inline="no-display-inline">For purposes of this subchapter, the term
				<quote>employee</quote> has the meaning given such term in section 7541.</text>
						</section><section id="H63EE658E5C0242399AA8C644F7E066D0"><enum>7562.</enum><header>Removal of
				Senior Executive Service employees</header>
							<subsection id="H3F0D67AB0C844A49BEFC52CC97E7394D"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Notwithstanding any
				other provision of law, the head of an agency may remove an employee for
				neglect of duty, misappropriation of funds, or malfeasance if the head of the
				agency—</text>
								<paragraph id="H713F7F652F8D4DE8955508D8BCC43AB9"><enum>(1)</enum><text display-inline="yes-display-inline">determines that the employee acted in a
				manner that endangers the interest of the agency mission;</text>
								</paragraph><paragraph id="H017CABB474B64D288DD1D4D97719DBDE"><enum>(2)</enum><text display-inline="yes-display-inline">considers the removal to be necessary or
				advisable in the interests of the United States; and</text>
								</paragraph><paragraph id="H755A031C58C54296B99FFDCDC29FED9F"><enum>(3)</enum><text display-inline="yes-display-inline">determines that the procedures prescribed
				in other provisions of law that authorize the removal of the employee cannot be
				used in a manner that the head of the agency considers consistent with the
				efficiency of the Government.</text>
								</paragraph></subsection><subsection id="HB61F68690EEA439B9BF986F363E85CF4"><enum>(b)</enum><header>Procedure</header><text display-inline="yes-display-inline">An employee removed under this
				section—</text>
								<paragraph id="id87065710B02B41368ECFE8AC24ADB70D"><enum>(1)</enum><text display-inline="yes-display-inline">shall be notified of the reasons for such
				removal;</text>
								</paragraph><paragraph id="idDAF2B64795F14C5DA5B33D501AF95D11"><enum>(2)</enum><text display-inline="yes-display-inline">is entitled to submit, within 30 days after
				the notification, to the official designated by the head of the agency
				statements or affidavits to show why the employee should be restored to
				duty;</text>
								</paragraph><paragraph id="id6737E14D676C4DB589B5876774BCF2A3"><enum>(3)</enum><text display-inline="yes-display-inline">shall be provided a written response by the
				head of the agency if statements and affidavits are submitted under paragraph
				(2); and</text>
								</paragraph><paragraph id="idEEEBB4F2946A41F088273F1DB6E9A4CC"><enum>(4)</enum><text display-inline="yes-display-inline">may be restored to duty if the head of the
				agency determines it appropriate.</text>
								</paragraph></subsection><subsection id="H5E44436C908D4141B5329BEBC2F9764F"><enum>(c)</enum><header>Notice</header><text display-inline="yes-display-inline">If the head of an agency removes an
				employee under the authority under this section, the head of the agency shall
				notify Congress of the removal and the reasons for the removal.</text>
							</subsection><subsection id="H32D6D5F8852C49DDA949CE794A000F08"><enum>(d)</enum><header>Appeal</header><text>An
				employee against whom an action is taken under this section is entitled to
				appeal to the Merit Systems Protection Board under section 7701.</text>
							</subsection><subsection id="HEF42F5FD74C24BAB9789D758876D8508"><enum>(e)</enum><header>Records</header><text display-inline="yes-display-inline">Copies of the notice of proposed action,
				the answer of the employee when written, a summary of the answer when made
				orally, the notice of decision and reasons therefor, and any order effecting an
				action covered by this section, together with any supporting material, shall be
				maintained by the agency and shall be furnished to the Merit Systems Protection
				Board upon its request and to the employee affected upon the request of the
				employee.</text>
							</subsection><subsection id="H37F226A463834ED4B33DAC9635533294"><enum>(f)</enum><header>Other
				employment</header><text display-inline="yes-display-inline">A removal under
				this section shall not affect the right of the employee removed to seek or
				accept employment with any other agency if that employee is declared eligible
				for such employment by the Director of the Office of Personnel
				Management.</text>
							</subsection><subsection id="HD81963DCB896490C9ACFF84888406351"><enum>(g)</enum><header>No
				delegation</header><text display-inline="yes-display-inline">The authority of
				the head of the agency under this section may not be
				delegated.</text>
							</subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HAEC25CE61ECD41588AE43FE7E015E586"><enum>(b)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/75">chapter 75</external-xref> of title 5, United States Code, is amended by adding
			 after the item relating to section 7543 the following:</text>

			<subsection commented="no" id="H07FD446B98B743BF94F5D0E24B33D9B5"><enum>(a)</enum><header>Reinstatement in
			 the Senior Executive Service</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/3593">Section 3593</external-xref> of title 5, United
			 States Code, is amended—</text>
				<paragraph commented="no" id="H427023434D5146A19616F2022E5B2194"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(2), by inserting
			 <quote>misappropriation of funds,</quote> after <quote>malfeasance,</quote>;
			 and</text>
				</paragraph><paragraph commented="no" id="H746267A8536F44B59DF78F0A54B5EC1C"><enum>(2)</enum><text>in subsection (b),
			 by striking <quote>or malfeasance</quote> and inserting <quote>malfeasance, or
			 misappropriation of funds</quote>.</text>
