			 references</header>
			<subsection id="idF22EA0E0DA804BB0B7F3912B614FB780"><enum>(a)</enum><header>Short
			 title</header><text display-inline="yes-display-inline">This Act may be cited
			 as the <quote><short-title>Cruise Passenger Protection
			 Act</short-title></quote>.</text>
			</subsection><subsection id="idDCA27C46164D40319A9CA1B6081A2E2C"><enum>(b)</enum><header>References to
			 title 46, United States Code</header><text>Except as otherwise expressly
			 provided, wherever in this Act an amendment or repeal is expressed in terms of
			 an amendment to, or repeal of, a section or other provision, the reference
			 shall be considered to be made to a section or other provision of title 46,
			 United States Code.</text>
			</subsection></section><section id="idF02F563193C247C3934A98C8E756ED25"><enum>2.</enum><header>Cruise vessel
			 subchapter</header><text display-inline="no-display-inline">Chapter 35 is
			 amended:</text>
			<paragraph id="idB7E54F98170345339854CBE1B67F8E9C"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting before section 3501 the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="idEBED2437104C4D8E8466E1D23EF24B46" style="USC">
					<subchapter id="idEE9D4D975DEA4C63BADBC5D0BFC2759C" style="OLC"><enum>I</enum><header>General
				provisions</header>
					</subchapter><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="idB6592EAABA554A0C9EFDE83E1BA80A86"><enum>(2)</enum><text>by inserting
			 before section 3507 the following:</text>

			</paragraph></section><section id="id218AC675BA8D43C59D603C64B626BFF5"><enum>3.</enum><header>Application</header><text display-inline="no-display-inline">Chapter 35, as amended by section 2 of this
			 Act, is further amended by inserting before section 3523 the following:</text>
			<quoted-block display-inline="no-display-inline" id="id71B236C1DB7B42219D0737A5188DCE36" style="USC">
				<section id="id00E6A3AD4F9949C2B2634ED6763D960D"><enum>3521.</enum><header>Application</header>
					<subsection id="id2CBAF909337E465AAF703761B7B49848"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">This subchapter
				applies to a passenger vessel (as defined in section 2101(22)) that—</text>
						<paragraph id="id7955848580484E7C85C26131A2D4B11A"><enum>(1)</enum><text display-inline="yes-display-inline">is authorized to carry at least 250
				passengers;</text>
						</paragraph><paragraph id="idC6B49E0F21EA46AC93546CAAACDB9E56"><enum>(2)</enum><text>has on board
				sleeping facilities for each passenger;</text>
						</paragraph><paragraph id="idD0369864DB6A475B9E34E7EAC4097C67"><enum>(3)</enum><text>is on a voyage
				that embarks or disembarks passengers in the United States; and</text>
						</paragraph><paragraph id="idF463990910EF41A19B8BB04D850A7FF9"><enum>(4)</enum><text>is not engaged on
				a coastwise voyage.</text>
						</paragraph></subsection><subsection id="idFF4A9E1E3FF64C3FBA6A585240332463"><enum>(b)</enum><header>Federal and
				State vessels</header><text>This subchapter does not apply to a vessel of the
				United States operated by the Federal Government or a vessel owned and operated
				by a
				State.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id7B70FE0B9A844BE2BE97681948C2DA5A"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">Chapter 35, as amended by section 3 of this
			 Act, is further amended by inserting after section 3521 the following:</text>
			<quoted-block display-inline="no-display-inline" id="idABF6649602944D82B0368B286A4BC866" style="USC">
				<section id="id6C3DC6EE367E45FB94C2C2328EC8021D"><enum>3522.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter:</text>
					<paragraph id="id04DA494A540045178A8B1463BEE14339"><enum>(1)</enum><header>Commandant</header><text>The
				term <term>Commandant</term> means the Commandant of the Coast Guard.</text>
					</paragraph><paragraph id="idFD139E130AB54904A242D4D41D3F9157"><enum>(2)</enum><header>Owner</header><text>The
				term <term>owner</term> means the owner, charterer, managing operator, master,
				or other individual in charge of a vessel.</text>
					</paragraph><paragraph id="idEB66E64D9E874447A2CFF3AC9718F31D"><enum>(3)</enum><header>Secretary</header><text>Except
				as otherwise expressly provided, the term <term>Secretary</term> means the
				Secretary of the department in which the Coast Guard is
				operating.</text>
					</paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idEE0DCB8170E7465DB43920006771F167"><enum>5.</enum><header>Passenger vessel
			 consumer service improvements</header>
			<subsection id="id0B84E1ABA88548E58850D798C9D8B872"><enum>(a)</enum><header>In
			 general</header><text>Chapter 35, as amended by section 2 of this Act, is
			 further amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id3629BB302C2D441DBF2836B61CB2FC37" style="USC">
					<section id="id7C65BD4C70D041D081ED153F0BBB5F7F"><enum>3525.</enum><header>Passenger
				vessel consumer service improvements</header>
						<subsection id="idC685C8F1435B4738A12DAE011B344745"><enum>(a)</enum><header>Passage
				contracts</header>
							<paragraph id="id0F331AD13E21465D938F4115A1830D94"><enum>(1)</enum><header>In
				general</header><text>Not later than 1 year after the date of enactment of the
				<short-title>Cruise Passenger Protection
				Act</short-title>, the Secretary of Transportation shall develop standards for
				use by an owner of a passenger vessel to provide a prospective passenger with a
				summary that highlights key terms in the passage contract upfront and before
				they are binding. In developing the standards, the Secretary of Transportation
				may consult with other Federal agencies, persons with expertise on admiralty
				and maritime law, consumer advocates, industry representatives, and such other
				persons as the Secretary of Transportation considers necessary.</text>
							</paragraph><paragraph id="id265A8F0C797D46549E8F1D294264FC3A"><enum>(2)</enum><header>Recommendations</header><text>The
				standards shall include recommendations regarding the following:</text>
								<subparagraph id="id6CD988BC5ABF481581B19641952C719C"><enum>(A)</enum><header>Appearance</header><text>The
				standards shall recommend style, formatting, and placement that ensures that
				the summary is conspicuous.</text>
								</subparagraph><subparagraph id="idBE727082E7BA44AC8759DD1167F46E0D"><enum>(B)</enum><header>Language</header><text>The
				standards shall recommend terminology that ensures that the summary is clear,
				unambiguous, unmistakable, and, to the greatest extent possible, uniform,
				concise, and not complex.</text>
								</subparagraph></paragraph><paragraph id="id0F4CCB20293947E2847D82FDCE6B931F"><enum>(3)</enum><header>Periodic
				review</header><text>The Secretary of Transportation shall periodically review
				and update, as appropriate, the standards.</text>
							</paragraph><paragraph id="id4B3144C755874ABFB415A152C25EFE56"><enum>(4)</enum><header>Requirements</header><text>Not
				later than 180 days after the date that the standards are developed, an owner
				of a passenger vessel shall—</text>
								<subparagraph id="idD802032EAC8A48908DFA599BBACCE17B"><enum>(A)</enum><text>provide each
				prospective passenger with a summary in accordance with those standards;</text>
								</subparagraph><subparagraph id="id4EE01645834F42F2AF42DF78C8FDD7A1"><enum>(B)</enum><text>include a
				prominently accessible link to the summary on each Internet website that the
				owner maintains for prospective passengers to purchase or book passage on the
				passenger vessel; and</text>
								</subparagraph><subparagraph id="idF5DAF9F0F5E749E0B5C6EFC0F2D995E3"><enum>(C)</enum><text>include the
				summary in any promotional literature or advertising, through any medium of
				communication in the United States offering passage or soliciting passengers
				for ocean voyages anywhere in the world, that the Secretary of Transportation
				considers necessary to adequately notify a prospective passenger of the key
				terms in the passage contract before they are binding.</text>
								</subparagraph></paragraph><paragraph id="id69FE4D5DBF6846C59CE6A7B537AD5261"><enum>(5)</enum><header>Preemption</header><text>The
				standards developed under this subsection shall preempt any related State
				standards that require a summary that provides less information to a
				prospective passenger than that required to be provided under this subsection,
				as determined by the Secretary of Transportation.</text>
							</paragraph></subsection><subsection id="idFF81B763F9D34A978C9BCBE1F4E3D53D"><enum>(b)</enum><header>Consumer
				complaints</header>
							<paragraph id="id6FDF1FFA67FD4FE1A6BFB0206AA6F703"><enum>(1)</enum><header>Toll-free
				hotline; Internet website link</header><text>The Secretary of Transportation
				shall—</text>
								<subparagraph id="idE10A12BE447442A883E4E6F10F36FBF8"><enum>(A)</enum><text>establish a
				consumer complaints toll-free hotline telephone number for passenger
				use;</text>
								</subparagraph><subparagraph id="idD53DA7538517488F854CC12AF7631791"><enum>(B)</enum><text>establish a
				consumer complaints link for passenger use on the Internet website under
				section 3526(i); and</text>
								</subparagraph><subparagraph id="idADDFE477A1DD49DE89AF73D979C55BDD"><enum>(C)</enum><text>notify the public
				of—</text>
									<clause id="id6FBCB0D7DA4C4F7EB03BCC53B2E202D9"><enum>(i)</enum><text>the telephone
				number under subparagraph (A); and</text>
									</clause><clause id="id8D301B301FA74ED2B42508947ED45B59"><enum>(ii)</enum><text>the Internet
				website under section 3526(i).</text>
									</clause></subparagraph></paragraph><paragraph id="id72C2795CD44345CDA0943448B1066AB3"><enum>(2)</enum><header>Website</header><text>The
				Secretary of Transportation shall maintain a statistical compilation of all
				consumer complaints on the Internet website under section 3526(i) that provides
				a numerical accounting of each category of consumer complaint. The data shall
				be updated not less frequently than quarterly, be aggregated by passenger
				vessel, and identify each passenger vessel by name.</text>
							</paragraph><paragraph id="id115B77CED7904DD3A05EC0FF8CC4A403"><enum>(3)</enum><header>Investigations
				of consumer complaints</header><text>The Secretary of Transportation, in
				coordination with other relevant Federal agencies, may investigate consumer
				complaints from passengers, including—</text>
								<subparagraph commented="no" id="id06BBB06D7F4B4B2AA99F39AC962FB262"><enum>(A)</enum><text>cancellations,
				delays, and port skipping;</text>
								</subparagraph><subparagraph commented="no" id="idA99E598DD06648D398F7BBB69CF49DDC"><enum>(B)</enum><text>lost, damaged,
				and delayed baggage;</text>
								</subparagraph><subparagraph commented="no" id="idF720F72E8A0F4F0582EBBBFAFBBAE491"><enum>(C)</enum><text>conditions on
				board the passenger vessel;</text>
								</subparagraph><subparagraph commented="no" id="id78E97D73FC1442AC9E596A593BB068CC"><enum>(D)</enum><text>problems in
				obtaining refunds for unused or lost tickets or fare adjustments;</text>
								</subparagraph><subparagraph commented="no" id="id021B80A5A33A4E9CAE4B46432E9CD3A4"><enum>(E)</enum><text>incorrect or
				incomplete information about fares, discount fare conditions and availability,
				overcharges, and fare increases;</text>
								</subparagraph><subparagraph commented="no" id="idF2D710D77B54436A8AD8F4FA23D6CB2E"><enum>(F)</enum><text>deceptive or
				misleading advertising; and</text>
								</subparagraph><subparagraph commented="no" id="idBC6A7A4C1A9F4778A702226119937ED8"><enum>(G)</enum><text>compliance with
				Federal regulations.</text>
								</subparagraph></paragraph><paragraph commented="no" id="id947C32A716AC48199BC3232470A728C0"><enum>(4)</enum><header>Referral to
				Federal agency</header><text>The Secretary of Transportation may refer any
				complaint received under this subsection to the Attorney General or relevant
				Federal agency for action, as appropriate.</text>
							</paragraph><paragraph id="id978B7B0700124F3F9FA134B81A3D8F60"><enum>(5)</enum><header>Notice to
				passengers.</header>
								<subparagraph id="idE40814B56B1644C6B2C531DEA52FB7E5"><enum>(A)</enum><header>Internet
				websites</header><text>Each owner of a passenger vessel shall include in a
				conspicuous location on each Internet website that the owner of a passenger
				vessel maintains for passengers to purchase or book passage on a passenger
				vessel—</text>
									<clause id="idAB070EAA6663410B95A006CDB80725CE"><enum>(i)</enum><text>the telephone
				number under paragraph (1); and</text>
									</clause><clause id="idA15B0C53A4714A97872580E4FD5D6D6F"><enum>(ii)</enum><text>any other
				information necessary for a passenger to submit a consumer complaint for
				resolution.</text>
									</clause></subparagraph><subparagraph id="id0E551D96B0444AFC883174C6B92E78CC"><enum>(B)</enum><header>Boarding
				documentation</header><text>The owner of a passenger vessel shall include the
				telephone number and Internet address for consumer complaints under paragraph
				(1) on—</text>
									<clause commented="no" id="id2B90C7AF60F944F0820748D35023581C"><enum>(i)</enum><text>any promotional
				literature or advertising, through any medium of communication in the United
				States offering passage or soliciting passengers for ocean voyages on passenger
				vessels, that the Secretary of Transportation considers necessary to adequately
				notify a prospective passenger of the telephone number and Internet address;
				and</text>
									</clause><clause commented="no" id="id00B5A96D0B1C48B8AE8E33FFA446F21F"><enum>(ii)</enum><text>any electronic
				confirmation of the purchase of passage on a passenger vessel.</text>
									</clause></subparagraph></paragraph></subsection><subsection commented="no" id="idB93D354C4EC74E1281CC6ACB6D3C9CCF"><enum>(c)</enum><header>Penalties</header>
							<paragraph commented="no" id="idA22EFBBF77C241C3A434E8A66374A5E7"><enum>(1)</enum><header>Civil
				penalty</header><text>The Secretary of Transportation may impose on any person
				that violates this section or a regulation under this section a civil penalty
				of not more than $25,000 for each day during which the violation continues,
				except that the maximum penalty for a continuing violation is $50,000.</text>
							</paragraph><paragraph commented="no" id="id999A2EDE1B8245E4A7D7F89B8A666C24"><enum>(2)</enum><header>Criminal
				penalty</header><text>Any person that willfully violates this section or a
				regulation under this section shall be fined not more than $250,000 or
				imprisoned not more than 1 year, or both.</text>
							</paragraph></subsection><subsection id="id99E0FCA56D344BB796CD96C4D88F9275"><enum>(d)</enum><header>Regulations</header><text>The
				Secretary of Transportation shall issue such regulations as are necessary to
				implement this section.</text>
						</subsection><subsection id="idD7F2DDDCAE67453F9ED6D9B1477C9DC1"><enum>(e)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="id9C0FEB16BFED43D2BBC157B91D02497A"><enum>(1)</enum><header>Key
				terms</header><text>The term <term>key terms</term> includes terms related to
				undisclosed costs and fees, indemnification, waivers, limitations on liability,
				notice of claim and actions, time limitations, arbitration, forum, and
				jurisdiction.</text>
							</paragraph><paragraph id="id0625C7ADF9454006973B95F7D3075F25"><enum>(2)</enum><header>Passage
				contract</header><text>The term <term>passage contract</term> means a binding
				agreement for passage on a passenger vessel.</text>
							</paragraph><paragraph id="id09F66A5061D9488BAC0587CC64061F69"><enum>(3)</enum><header>Passenger</header><text>The
				term <term>passenger</term> means a citizen of the United States carried on a
				passenger vessel.</text>
							</paragraph><paragraph id="idD05CF375488F428084EC73B9A07160D3"><enum>(4)</enum><header>Passenger
				vessel</header><text>The term <term>passenger vessel</term> means a passenger
				vessel (as defined in section 2101) to which this subchapter
				applies.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id13C536C575E849DA914BF34140165DE1"><enum>(b)</enum><header>Bill of
			 rights</header><text display-inline="yes-display-inline">Not later than 180
			 days after the date of enactment of the <short-title>Cruise Passenger Protection Act</short-title>, the
			 Secretary of Transportation shall determine whether any of the enumerated
			 rights in the international cruise line passenger bill of rights, that was
			 adopted by the members of the Cruise Lines International Association, are
			 enforceable under Federal law. The Secretary shall include in the standards
			 developed under <external-xref legal-doc="usc" parsable-cite="usc/46/3525">section 3525(a)</external-xref> of title 46 United States Code, a statement
			 informing a prospective passenger—</text>
				<paragraph id="id083378C976564D0B96A912CB43716C3C"><enum>(1)</enum><text display-inline="yes-display-inline">that the bill of rights is legally
			 enforceable and that the passenger has a private right of action to enforce the
			 bill of rights; and</text>
				</paragraph><paragraph id="idA01A0DE3DD9A464890091334C68AB64C"><enum>(2)</enum><text>of any legal
			 action that a prospective passenger may take to enforce the bill of
			 rights.</text>
				</paragraph></subsection><subsection id="id0AAB1A4748BD4BEE9C891D2FC3012BBA"><enum>(c)</enum><header>Advisory
			 Committee for Passenger Vessel Consumer Protection</header>
				<paragraph id="id04AB3C3D5E184683BDCEF73A7724E2D0"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Transportation (referred to in this
			 subsection as the <quote>Secretary</quote>) shall establish an advisory
			 committee for passenger vessel consumer protection to advise the Secretary in
			 carrying out activities relating to passenger vessel customer service
			 improvements.</text>
				</paragraph><paragraph id="id04F517DDFD83425AB99073656D38D88D"><enum>(2)</enum><header>Membership</header><text>The
			 Secretary of Transportation shall appoint the members of the advisory
			 committee, which shall be comprised of 1 representative each of—</text>
					<subparagraph id="id5A0C7F6809C24944A1172660CFB02D07"><enum>(A)</enum><text>owners of
			 passenger vessels;</text>
					</subparagraph><subparagraph id="idD5158BF1F123489B9F0DB9EA7FF19BBD"><enum>(B)</enum><text>international
			 industry-related associations;</text>
					</subparagraph><subparagraph id="id4A4BD01DE539451DA18F8564E5FDD3C7"><enum>(C)</enum><text>State or local
			 governments with expertise in consumer protection matters;</text>
					</subparagraph><subparagraph id="id3CFD610E0C6F4E2C9AF3EF756307D2E6"><enum>(D)</enum><text>nonprofit public
			 interest groups with expertise in consumer protection matters;</text>
					</subparagraph><subparagraph id="id547D5E85BBC649E192B82FB064D833E5"><enum>(E)</enum><text>nonprofit public
			 interest groups with expertise in victim assistance; and</text>
					</subparagraph><subparagraph id="idFFCFA4F6AC40404A8324C11F83B53463"><enum>(F)</enum><text>relevant Federal
			 agencies, as determined by the Secretary of Transportation.</text>
					</subparagraph></paragraph><paragraph id="idA2F5A024DDDC48FE98EA1E3675FC85CE"><enum>(3)</enum><header>Vacancies</header><text>A
			 vacancy in the advisory committee shall be filled in the manner in which the
			 original appointment was made.</text>
				</paragraph><paragraph commented="no" id="id4BA9E00CFF56463F85CCAF34DF0D4D65"><enum>(4)</enum><header>Travel
			 expenses</header><text>Members of the advisory committee shall serve without
			 pay, but shall receive travel expenses, including per diem in lieu of
			 subsistence, in accordance with subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United
			 States Code.</text>
				</paragraph><paragraph id="id2CC2E5BE4CCA4779BF738BF569AFA3DB"><enum>(5)</enum><header>Chair</header><text>The
			 Secretary of Transportation shall designate, from among the individuals
			 appointed under paragraph (2), an individual to serve as chair of the advisory
			 committee.</text>
				</paragraph><paragraph id="idE1C785F9DE654DE08B6CF278DFA82E57"><enum>(6)</enum><header>Duties</header><text>The
			 duties of the advisory committee shall include—</text>
					<subparagraph id="idE23DBE0110FB4BDAA801BA030662EDDC"><enum>(A)</enum><text>evaluating
			 existing passenger vessel consumer protection programs or services;</text>
					</subparagraph><subparagraph id="id24C10AE29C8D4698A693F1B3FF68FE7E"><enum>(B)</enum><text>recommending
			 improvements to the programs or services under subparagraph (A), as
			 necessary;</text>
					</subparagraph><subparagraph id="id9D94F9B7F4384C56AFB399206F6DCE55"><enum>(C)</enum><text>recommending
			 additional passenger vessel consumer protection programs or services, as
			 necessary; and</text>
					</subparagraph><subparagraph id="id65969DD8ABB146DFA826708E2E887E39"><enum>(D)</enum><text>recommending to
			 the Secretary key terms in a passage contract that should be highlighted
			 upfront, such as—</text>
						<clause id="idA11DAE502BEC4943BBB82A4FE88AC975"><enum>(i)</enum><text>products and
			 services available on board the passenger vessel for an undisclosed cost or fee
			 or otherwise are not included in the price of passage;</text>
						</clause><clause id="idCC30EF4E4F1E4C03A26699C98FBC424C"><enum>(ii)</enum><text>the country
			 under which the passenger vessel is registered or flagged;</text>
						</clause><clause id="id52F077A7C39E4B3595580AB6FEFAC222"><enum>(iii)</enum><text>if the
			 passenger vessel leaves the admiralty and maritime jurisdiction of the United
			 States, a passenger may be subject to the law of a foreign country;</text>
						</clause><clause id="idA6D799027F1341BCB35B2804E4B5A0A9"><enum>(iv)</enum><text>the passenger
			 vessel may not accept responsibility for any health care services provided to a
			 passenger by medical staff on board the passenger vessel;</text>
						</clause><clause id="idFBD9003B4662451B8187FAB8725CB5C4"><enum>(v)</enum><text>the
			 maximum amount an owner of a passenger vessel will reimburse a passenger for
			 lost or stolen property while on board the passenger vessel; and</text>
						</clause><clause id="id92DFBD3BC0CF44139AE4266DB370A6E3"><enum>(vi)</enum><text>where to file a
			 notice of claim or initiate any legal action against the owner of the passenger
			 vessel.</text>
						</clause></subparagraph></paragraph><paragraph id="id4FF51C8AB25944BA8872C98A2EF778BB"><enum>(7)</enum><header>Report to
			 Congress</header><text>Not later than February 1 of each of the first 2
			 calendar years beginning after the date of enactment of this Act, the Secretary
			 shall transmit to Congress a report containing—</text>
					<subparagraph id="idDBD0DD49275540F79FEDEBE2D423E829"><enum>(A)</enum><text>the
			 recommendations made by the advisory committee during the preceding calendar
			 year; and</text>
					</subparagraph><subparagraph id="idB7D686A5397E49B4913C90775082D4E9"><enum>(B)</enum><text>an explanation of
			 whether and how the industry has implemented each recommendation and, for each
			 recommendation not implemented, the industry's reason for not implementing the
			 recommendation.</text>
					</subparagraph></paragraph><paragraph id="idA73C4F69976645CC909824DEF0A823F9"><enum>(8)</enum><header>Definition of
			 passenger vessel</header><text>In this subsection, the term <term>passenger
			 vessel</term> has the meaning given the term in <external-xref legal-doc="usc" parsable-cite="usc/46/3525">section 3525</external-xref> of title 46,
			 United States Code.</text>
				</paragraph></subsection></section><section id="id2A889E59B3904DF486BAB94CCF2D4D77"><enum>6.</enum><header>Crime reporting
			 and public notice</header>
			<subsection id="id40578B4917E44F0D9A8472317BF7C955"><enum>(a)</enum><header>Availability of
			 log book and entries to FBI and other investigators</header><text>Section
			 3523(g)(1), as redesignated under section 2 of this Act, is amended—</text>
				<paragraph id="id331C9581E8AD451885E2DA1928D68323"><enum>(1)</enum><text>in subparagraph
			 (A), by striking <quote>in a centralized location readily accessible to law
			 enforcement personnel,</quote>; and</text>
				</paragraph><paragraph id="id1D43C103C5374611851DDD7D3A39428E"><enum>(2)</enum><text>in subparagraph
			 (B), by striking <quote>make such log book available</quote> and inserting
			 <quote>make the log book and all entries therein available, whether the log
			 book and entries are maintained on board the vessel or at a centralized
			 location off the vessel, </quote>.</text>
				</paragraph></subsection><subsection id="id0129EB2B767E4C0D9FAC3ED1D519572D"><enum>(b)</enum><header>Deadline To
			 notify Federal Bureau of Investigation regarding certain
			 incidents</header><text>Section 3523(g)(3)(A)(i), as redesignated under section
			 2 of this Act, is amended—</text>
				<paragraph id="idCA13221EC04D4DB0BF5257499846D232"><enum>(1)</enum><text>by striking
			 <quote>shall contact</quote> and inserting <quote>subject to subparagraph (C),
			 shall contact</quote>; and</text>
				</paragraph><paragraph id="idB6261D40F74744E9A3C8FBAAC8B7378C"><enum>(2)</enum><text>by striking
			 <quote>after the occurrence on board the vessel of an incident
			 involving</quote> and inserting <quote>, but not later than 4 hours, after an
			 employee of the vessel is notified of an incident on board the vessel allegedly
			 involving</quote>.</text>
				</paragraph></subsection><subsection id="idC159ED8A09AC4EC3B3E8CD19170335C9"><enum>(c)</enum><header>Reports before
			 departure</header><text>Section 3523(g)(3), as redesignated under section 2 of
			 this Act, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id36A9CF48CF4245A6B2C1EFF922512BC0" style="USC">
					<subparagraph id="id10BF5AB77D1E485DB6CF7257753A3F4C"><enum>(C)</enum><header>Reports before
				departure</header><text>If an employee of a vessel to which this subchapter
				applies is notified of an incident under subparagraph (A)(i) while the vessel
				is within the admiralty and maritime jurisdiction of the United States and en
				route to a United States port or at a United States port, the owner of the
				vessel (or the owner's designee) shall contact the nearest Federal Bureau of
				Investigation Field Office or Legal Attache not later than the time specified
				under subparagraph (A)(i) or before the vessel departs port, whichever is
				earlier.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idF25141E89B794009B4266CF4B48BF058"><enum>(d)</enum><header>Reports to
			 United States consulates</header><text>Section 3523(g)(3), as amended by
			 section 6(c) of this Act, is further amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id3BF8297B21384D499D8552EF865BF7E5" style="USC">
					<subparagraph id="id8486A75F27884DFE9A7A6BA6CDF6CDD1"><enum>(D)</enum><header>Reports to
				United States consulates</header><text>If an incident under subparagraph (A)(i)
				allegedly involves an offense by or against a United States national, in
				addition to contacting the nearest Federal Bureau of Investigation Field Office
				or Legal Attache under that subparagraph, the owner of a vessel to which this
				subchapter applies (or the owner's designee) shall contact the United States
				consulate at the next port of call not later than the time specified under
				subparagraph
				(A)(i).</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id14BCF857862145F2AB703EB9C5CE6478"><enum>(e)</enum><header>Reports to
			 Secretary of Transportation; incidents and details</header><text>Section
			 3523(g)(3)(A), as redesignated under section 2 of this Act, is amended—</text>
				<paragraph id="idE2C05BE898904687BAFE176F1A8A1970"><enum>(1)</enum><text>in clause (ii),
			 by striking <quote>the incident to an Internet based portal maintained by the
			 Secretary</quote> and inserting <quote>each incident under clause (i),
			 including the details under paragraph (2), to the Internet based portal
			 maintained by the Secretary of Transportation under section 3526(i)</quote>;
			 and</text>

			 under section 2 of this Act, is amended—</text>

				</paragraph></subsection></section><section id="id17F030EC115C485E95AF681D75E66DD6"><enum>7.</enum><header>Crime
			 prevention, documentation, and response requirements</header>
			<subsection id="idAE27B9DD87AE4FCAACB062588B75F4F7"><enum>(a)</enum><header>Maintenance and
			 placement of video surveillance equipment</header><text>Section 3523(b)(1), as
			 redesignated under section 2 of this Act, is amended—</text>
				<paragraph id="idC0CD9C1B0ED64E49A62E9A470A0F104A"><enum>(1)</enum><text>by inserting
			 <quote>(A) <header-in-text level="subparagraph" style="USC">In
			 General.—</header-in-text></quote> before <quote>The owner</quote> and
			 resetting the text accordingly;</text>
				</paragraph><paragraph id="id418C6FB2218B4CFCB0C5AC0A09649E38"><enum>(2)</enum><text>by striking
			 <quote>, as determined by the Secretary</quote>; and</text>
				</paragraph><paragraph id="idC87112A10FD64C45AC805E2880727779"><enum>(3)</enum><text>by adding at the
			 end, the following:</text>

						<subparagraph id="idAA366EE7C0A34314B6625BC831114217"><enum>(B)</enum><header>Placement of
				video surveillance equipment</header><text>With regard to the placement of
				video surveillance equipment on a vessel under subparagraph (A), the owner
				shall—</text>
							<clause id="id5B2613E500F149EABAD7D04103F8748F"><enum>(i)</enum><text>place video
				surveillance equipment in each passenger common area where a person has no
				reasonable expectation of privacy;</text>
							</clause><clause id="id7370381DD4574FB2AC51CC178938A938"><enum>(ii)</enum><text>place video
				surveillance equipment in other areas where a person has no reasonable
				expectation of privacy; and</text>
							</clause><clause id="idEB903351A029402282FD5A80046D26D6"><enum>(iii)</enum><text>place video
				surveillance equipment in each area identified under clauses (i) and (ii) in a
				manner that provides optimum surveillance of that
				area.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idF9778FB4849E4A1FB0352012788B07AE"><enum>(b)</enum><header>Access to video
			 records</header><text>Section 3523(b), as redesignated under section 2 of this
			 Act, is amended—</text>
				<paragraph id="id482361AB10944E669D5FD7806DAD9D4D"><enum>(1)</enum><text>by redesignating
			 paragraph (2) as paragraph (3); and</text>
				</paragraph><paragraph id="idF22478FAA24D4F419338157AB58DA270"><enum>(2)</enum><text>in paragraph (3),
			 as redesignated—</text>
					<subparagraph id="id0D174477A1CD4DC3BC951DCB62EBA755"><enum>(A)</enum><text>by inserting
			 <quote>(A) <header-in-text level="subparagraph" style="USC">Law
			 enforcement.—</header-in-text></quote> before <quote>The owner</quote> and
			 resetting the text accordingly; and</text>
					</subparagraph><subparagraph id="idE530DAA15D344E2880BA2511A9B0A9C5"><enum>(B)</enum><text>by adding at the
			 end, the following:</text>

							<subparagraph commented="no" id="idDE9157F76CB540EE877F51323DB56AF8"><enum>(B)</enum><header>Civil
				actions</header><text>The owner of a vessel to which this subchapter applies
				shall provide to any individual or the individual's legal representative, upon
				written request, a copy of all records of video surveillance—</text>
								<clause commented="no" id="idCE71312CA3A24F82B439592B797361A7"><enum>(i)</enum><text>in which the
				individual is a subject of the video surveillance; and</text>
								</clause><clause commented="no" id="id39A2B9DBB99C4304A062B313EF9E040F"><enum>(ii)</enum><text>that may provide
				evidence in a civil action.</text>
								</clause></subparagraph><subparagraph id="id215E5E29C27D4DFBB02FDDD1E32886B8"><enum>(C)</enum><header>Limited
				access</header><text>Except as provided under subparagraphs (A) and (B), the
				owner of a vessel to which this subchapter applies shall ensure that access to
				records of video surveillance is limited to the purposes under this
				section.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="idBDFE0BC751F44440BDDBB84051F593F1"><enum>(c)</enum><header>Notice of video
			 surveillance</header><text>Section 3523(b), as amended by section 7(b) of this
			 Act, is further amended by inserting before paragraph (3), the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="idE2C7DC755B474A5DB3F176954D723657" style="OLC">
					<paragraph id="id94F688A6FB69474D8886B3C7F32F4FC7"><enum>(2)</enum><header>Notice of video
				surveillance</header><text>The owner of a vessel to which this subchapter
				applies shall provide clear and conspicuous signs on board the vessel notifying
				the public of the presence of video surveillance
				equipment.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id4EF28371E5A5456491C69FC28E76EB53"><enum>(d)</enum><header>Retention
			 requirements</header><text>Section 3523(b), as amended by section 7(c) of this
			 Act, is further amended by adding at the end, the following:</text>
				<quoted-block display-inline="no-display-inline" id="idEBCED734504441649D83EECE9C94AF42" style="OLC">
					<paragraph id="idD4906C8C452449F5BC54E69E5A46F4C5"><enum>(4)</enum><header>Retention
				requirements</header>
						<subparagraph id="id60DE4A191B82461E8D82FBAA9C760788"><enum>(A)</enum><header>In
				general</header><text>The owner of a vessel to which this subchapter applies
				shall retain all records of video surveillance for a voyage for not less than
				30 days after the completion of the voyage. If an incident described in
				subsection (g)(3)(A)(i) is alleged and reported to law enforcement, all records
				of video surveillance from the voyage that the Federal Bureau of Investigation
				determines are relevant shall—</text>
							<clause id="id427444EA8BFB427D829D62F57B0D0D4D"><enum>(i)</enum><text>be provided to
				the Federal Bureau of Investigation; and</text>
							</clause><clause id="id5FC907A3A95945BE91A9714F5EE5998E"><enum>(ii)</enum><text>be preserved by
				the vessel owner for not less than 5 years from the date of the alleged
				incident.</text>
							</clause></subparagraph><subparagraph id="id281337BF9F8944DB8D2D27AE3A7F682A"><enum>(B)</enum><header>Interim
				standards</header><text>Not later than 180 days after the date of enactment of
				the <short-title>Cruise Passenger Protection
				Act</short-title>, the Commandant, in consultation with the Federal Bureau of
				Investigation, shall promulgate interim standards for the retention of records
				of video surveillance.</text>
						</subparagraph><subparagraph id="idAC2E432071434A89A03585B2576F5D91"><enum>(C)</enum><header>Final
				standards</header><text>Not later than 1 year after the date of enactment of
				the <short-title>Cruise Passenger Protection
				Act</short-title>, the Commandant, in consultation with the Federal Bureau of
				Investigation, shall promulgate final standards for the retention of records of
				video surveillance.</text>
						</subparagraph><subparagraph id="id7DC756619CC94404A5D95B44F585B4FF"><enum>(D)</enum><header>Considerations</header><text>In
				promulgating standards under subparagraphs (B) and (C), the Commandant
				shall—</text>
							<clause id="id9CA0C1FCE5354E379C2F04F1D76E4F55"><enum>(i)</enum><text>consider factors
				that would aid in the investigation of serious crimes, including crimes that go
				unreported until after the completion of a voyage;</text>
							</clause><clause id="idAA6FDAE88EB94F348C0246A37A3834A7"><enum>(ii)</enum><text>consider the
				different types of video surveillance systems and storage requirements in
				creating standards both for vessels currently in operation and for vessels
				newly built;</text>
							</clause><clause id="id722EC2B6E75A49448E2150261A2BAF39"><enum>(iii)</enum><text>consider
				privacy, including standards for permissible access to and monitoring and use
				of the records of video surveillance; and</text>
							</clause><clause id="id8B6388BFD88C4F75A7EDCCD1F43606E8"><enum>(iv)</enum><text>consider
				technological advancements, including requirements to update
				technology.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id7A14D2C730A24950AE67B461F6840339"><enum>(e)</enum><header>Authority To
			 provide assistance to victims of crimes on board passenger
			 vessels</header><text display-inline="yes-display-inline">Chapter 35, as
			 amended by section 5 of this Act, is further amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id12E06602FCB2420FB6683C28219067FB" style="OLC">
					<section id="idF92FFA0057604BA98496B4F6974DBFC7"><enum>3526.</enum><header>Assistance to
				victims of crimes on board certain passenger vessels</header>
						<subsection id="id7F5340F784164746888B7354BEB47E20"><enum>(a)</enum><header>Purpose</header><text>The
				purpose of this section is to provide to a passenger who is an alleged victim
				of an incident described under section 3523(g)(3)(A)(i)—</text>
							<paragraph id="id0E14ED5940FF483AB7ED3BDDA2AFF143"><enum>(1)</enum><text>a written summary
				of rights;</text>
							</paragraph><paragraph id="idE769756A136D477082F29D4E11B6BAEF"><enum>(2)</enum><text>a primary point
				of contact within the Federal Government; and</text>
							</paragraph><paragraph id="idDFCA6640E2DD489A8EDB98AACEE77847"><enum>(3)</enum><text>a means of
				obtaining immediate, free, and confidential support services.</text>
							</paragraph></subsection><subsection id="idD3EB727774F545A7805D534FBEBBC17E"><enum>(b)</enum><header>Director of
				victim support services</header>
							<paragraph id="idFC66E4E9E0FF43B4A95F56C8F091EB04"><enum>(1)</enum><header>Interim
				designation</header><text>The Secretary of Transportation shall designate an
				interim director of victim support services. The interim director shall be an
				employee of the Department of Transportation and shall serve in the position
				until a final designation is made under paragraph (2).</text>
							</paragraph><paragraph id="idBA16F515F0304127A84963FB41213020"><enum>(2)</enum><header>Final
				designation</header><text>Not later than 180 days after the date of enactment
				of the <short-title>Cruise Passenger Protection
				Act</short-title>, the Secretary of Transportation, in consultation with the
				Department of Justice and other relevant Federal agencies, shall—</text>
								<subparagraph id="id8862F70E4D78429CBE461C50FC4339F2"><enum>(A)</enum><text>designate an
				employee of the Federal Government to serve as the director of victim support
				services under this section; and</text>
								</subparagraph><subparagraph id="id9B7A2AD40B6F442FBB2BF0DC4B97EF82"><enum>(B)</enum><text>determine an
				effective way to publicize the toll-free telephone number under subsection (c)
				and the availability of support services.</text>
								</subparagraph></paragraph><paragraph id="idAC0EB73E050849D59CEF1232C87C9461"><enum>(3)</enum><header>Responsibilities</header><text>The
				director of victim support services shall—</text>
								<subparagraph id="idADD0E7F60FAC4FAD8E0AE89A854DEA59"><enum>(A)</enum><text>be responsible
				for acting as a primary point of contact within the Federal Government for the
				passenger described in subsection (a);</text>
								</subparagraph><subparagraph id="id59FA1394DD0843189474ABADF99ACAAA"><enum>(B)</enum><text>coordinate with 1
				or more non-profit organizations or other entities that can provide the types
				of support services described under subsection (d);</text>
								</subparagraph><subparagraph id="id42D7E368874C4AB9AABD1DA06976D508"><enum>(C)</enum><text>establish a
				process for the passenger described in subsection (a) to obtain the appropriate
				types of support services described under subsection (d);</text>
								</subparagraph><subparagraph id="id6ED03A2DBFE847018F561B24885D9B3E"><enum>(D)</enum><text>recommend a
				process for the passenger described in subsection (a) to obtain an appropriate
				continuum of care;</text>
								</subparagraph><subparagraph id="id4C130C53F812461BB41DCB9AB9AB718D"><enum>(E)</enum><text>recommend a
				process for the passenger described in subsection (a) to obtain information on
				the status of any related criminal investigation;</text>
								</subparagraph><subparagraph id="id52273F8E6DBE454AA37A01668CF3F6BB"><enum>(F)</enum><text>develop guidance,
				consistent with the purpose of this section, for the security guide under
				section 3523(c)(1), including a process to ensure that an owner of a passenger
				vessel provides a copy of the security guide to a passenger immediately after
				the vessel is notified that the passenger is an alleged victim of an incident
				described under subsection (g)(3)(A)(i);</text>
								</subparagraph><subparagraph id="id2BA98F1AA39648D786C64B4E9F54B9D4"><enum>(G)</enum><text>periodically
				update that guidance, as necessary; and</text>
								</subparagraph><subparagraph id="id2E15C3F34C834B6D967BE4A1BEEE6228"><enum>(H)</enum><text>be the primary
				liaison between the passenger described in subsection (a) and—</text>
									<clause id="id4D6393B61B834F18A50ECDF0A09EB52E"><enum>(i)</enum><text>the owner of the
				passenger vessel;</text>
									</clause><clause id="id008C386AFF0B4DD8AA9FF1E9EE9BC01C"><enum>(ii)</enum><text>any relevant
				Federal agency;</text>
									</clause><clause id="id78B4182F8012406983B3B991B21297E0"><enum>(iii)</enum><text>any relevant
				United States embassy or United States consulate; and</text>
									</clause><clause id="idE7B6B68F42A54E5FACECDB5D5DD0A1EA"><enum>(iv)</enum><text>any other person
				that the director of victim support services considers necessary to carry out
				the purpose of this section.</text>
									</clause></subparagraph></paragraph></subsection><subsection id="idCFFFB7CD765449F598A192EE860A8824"><enum>(c)</enum><header>Toll-Free
				telephone number</header><text>The Secretary of Transportation shall establish
				a toll-free telephone number, available 24 hours each day, that a passenger
				described in subsection (a) can call to initiate the process under subsection
				(b)(3)(C).</text>
						</subsection><subsection id="id3B66A320465C4623AE404099ACE49E9C"><enum>(d)</enum><header>Support
				services</header><text>The director of victim support services shall determine
				the types of support services that a passenger described in subsection (a) can
				obtain, such as—</text>
							<paragraph id="idDE8643CB1AC74E98960935979014B3F6"><enum>(1)</enum><text>directions on how
				to report an incident described under section 3523(g)(3)(A)(i) to appropriate
				authorities;</text>
							</paragraph><paragraph id="idF180D13978394DDA95F05A20EBC2E62C"><enum>(2)</enum><text>an explanation of
				or assistance completing necessary forms to report an incident described under
				section 3523(g)(3)(A)(i);</text>
							</paragraph><paragraph id="idB8E099E0438B423A8FC0C4584AEC64FD"><enum>(3)</enum><text>an explanation of
				how or assistance to obtain support services under this section;</text>
							</paragraph><paragraph id="id6D5320C26F5248A091C2E4E1B1C954A6"><enum>(4)</enum><text>arranging, if
				appropriate, for mental health and counseling services;</text>
							</paragraph><paragraph id="id644DCA980D8A42D483115EDEB1329449"><enum>(5)</enum><text>arranging, if
				possible, for education regarding and advocacy during applicable criminal
				justice proceedings; and</text>
							</paragraph><paragraph id="id65968E7609BD4E37B17CE99A4895E1DE"><enum>(6)</enum><text>communicating
				with that passenger as to the roles of the organization, government agencies,
				and the owner of the passenger vessel involved with respect to the incident and
				the post-incident activities.</text>
							</paragraph></subsection><subsection commented="no" id="id53627B703D064C03AC5FB65A616BD79F"><enum>(e)</enum><header>Summary of
				rights</header><text>Not later than 180 days after the date of enactment of the
				<short-title>Cruise Passenger Protection
				Act</short-title>, the Secretary of Transportation, in consultation with the
				Department of Justice, other relevant Federal agencies, non-profit public
				interest groups with expertise in victim assistance, and such other persons
				that the Secretary of Transportation considers necessary, shall—</text>
							<paragraph commented="no" id="idDBB2AF15FDFA417D8EDAE32A53CDD51B"><enum>(1)</enum><text>determine what
				rights a passenger described in subsection (a) may have under law, such as the
				right to contact the Federal Bureau of Investigation to report the crime, the
				right to contact the director of victim support services, and the right to
				speak confidentially to Federal law enforcement, the director of victim support
				services, and any other third-party victim advocate without any representative
				or employee of the passenger vessel present;</text>
							</paragraph><paragraph commented="no" id="id12D7C6C068A54E858696870909E06004"><enum>(2)</enum><text>develop a written
				summary of those rights; and</text>
							</paragraph><paragraph commented="no" id="idC903CC7478584B73B42C7ECF1073C31C"><enum>(3)</enum><text>establish a
				process for a passenger described in subsection (a) to receive the written
				summary of rights as soon as practicable after an alleged incident described
				under section 3523(g)(3)(A)(i).</text>
							</paragraph></subsection><subsection id="idC99D14B78C4E40C492F277A0C228F06E"><enum>(f)</enum><header>Guardians and
				relatives</header><text>If a passenger described in subsection (a) is deceased
				or is a minor, or under such other circumstances that the director of victim
				support services considers necessary, the director may provide support services
				under this section to a guardian or relative of that passenger.</text>
						</subsection><subsection id="id2A543600FCA045D99CCBF46147CC820B"><enum>(g)</enum><header>Use of
				passenger vessel resources</header><text>As appropriate, the resources of the
				passenger vessel should be used to the greatest extent possible to carry out
				the purpose under this section.</text>
						</subsection><subsection id="id76A0D2CC428F4EFEBF0A48B6FB6B33D7"><enum>(h)</enum><header>Statutory
				construction</header><text>Nothing in this section may be construed as limiting
				the obligations that an owner of a passenger vessel may have in providing
				assistance to a passenger who is an alleged victim of an incident described
				under section 3523(g)(3)(A)(i).</text>
						</subsection><subsection commented="no" id="idF39AB63A572140D08CB18FFC0A57A34C"><enum>(i)</enum><header>Availability of
				incident data via Internet</header>
							<paragraph commented="no" id="id3B084D5B34814D488C7E07036228E5C7"><enum>(1)</enum><header>In
				general</header><text>The Secretary of Transportation shall maintain a
				statistical compilation of all incidents described in section 3523(g)(3)(A) on
				an Internet website that provides a numerical accounting of the missing persons
				and alleged crimes duly recorded in each report filed under paragraph (3) of
				that section. Each such incident shall be included in the statistical
				compilation irrespective of its investigative status. The data shall be updated
				not less frequently than quarterly, be aggregated by cruise line, identify each
				cruise line by name, identify each crime and alleged crime as to whether it was
				committed or allegedly committed by a passenger (as defined in section 2101) or
				crew member, identify each crime and alleged crime as to whether it was
				committed or allegedly committed against a minor, and identify the number of
				alleged individuals overboard. The Secretary of Transportation shall ensure
				that the compilation, data, and any other information provided on the Internet
				website is in a user-friendly format.</text>
							</paragraph><paragraph commented="no" id="idF93EF015C5484FFF8AFE1DCEF680E0BE"><enum>(2)</enum><header>Access to
				website</header><text>Each owner of a passenger vessel shall include a
				prominently accessible link to the Internet website maintained by the Secretary
				of Transportation under paragraph (1) on each Internet website that the owner
				maintains for prospective passengers to purchase or book passage on the
				passenger vessel.</text>
							</paragraph></subsection><subsection id="id19D580643B2E40C8860A9C5FEE45AAF6"><enum>(j)</enum><header>Regulations</header><text>The
				Secretary of Transportation shall issue such regulations as are necessary to
				implement this section.</text>
						</subsection><subsection id="id043401A17F1746F189607E29608238C8"><enum>(k)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="id2A7BFE41E5D4480CBE1926F97EB6DCFF"><enum>(1)</enum><header>Passenger</header><text>Except
				as expressly provided otherwise, the term <term>passenger</term> means a
				citizen of the United States carried on a passenger vessel without regard to
				whether the individual purchased passage on the passenger vessel or is employed
				by the owner of the passenger vessel.</text>
							</paragraph><paragraph commented="no" id="idEBD58C73F79447DFB9A2402162FE4CF3"><enum>(2)</enum><header>Passenger
				vessel</header><text>The term <term>passenger vessel</term> means a passenger
				vessel (as defined in section 2101) to which this subchapter
				applies.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idA70F8B81FD2D476D824ACCD484437041"><enum>(f)</enum><header>Study</header><text>Not
			 later than 1 year after the date of enactment of this Act, the Secretary of
			 Transportation, in coordination with the Secretary of the department in which
			 the Coast Guard is operating, Attorney General, and heads of other relevant
			 Federal agencies, shall conduct a study to determine the feasibility of having
			 an individual on board each passenger vessel (as defined in section 3526 of
			 title 46, United States Code) to provide victim support services, including the
			 support services under <external-xref legal-doc="usc" parsable-cite="usc/46/3526">section 3526(d)</external-xref> of title 46, United States Code, and
			 related safety and security services, and shall report the findings to
			 Congress. The study shall include consideration of the cost, the benefit to
			 passengers, jurisdiction, and logistics.</text>
			</subsection><subsection commented="no" id="idCB4BFD2A7F52499CA27E861DE75F1C1C"><enum>(g)</enum><header>Criminal
			 activity prevention and response guide</header><text>Section 3523(c)(1), as
			 amended by section 6(f) of this Act, is further amended—</text>
				<paragraph commented="no" id="id1DB42D68DAA74E599C4CEC9A7702433A"><enum>(1)</enum><text>in subparagraph
			 (A)—</text>
					<subparagraph commented="no" id="id2306EA6CC376495F9D1BECB6A28F1FB5"><enum>(A)</enum><text>by redesignating
			 clause (ii) as clause (vi);</text>
					</subparagraph><subparagraph commented="no" id="id6FACD3A2A88641348A0B603545248411"><enum>(B)</enum><text>by inserting
			 after clause (i), the following:</text>
						<quoted-block display-inline="no-display-inline" id="id11E8C1A1F4AA43B89BB7F41B56005665" style="OLC">
							<clause commented="no" id="idD3260E71627F44A8AF4CBF9C732C35CB"><enum>(ii)</enum><text>describes the
				availability of support services under section 3526, including any contact
				information provided by the Secretary of Transportation or director of victim
				support services under that section;</text>
							</clause><clause commented="no" id="idBB5A73D55DFB425DB6A34CFBD804BCD5"><enum>(iii)</enum><text>includes the
				summary of rights under section 3526;</text>
							</clause><clause commented="no" id="idF686C11E10AE487894A2CFFBA47B683E"><enum>(iv)</enum><text>includes the
				summary under section 3525(a);</text>
							</clause><clause commented="no" id="id7C4434AE09B148B48AE265D9D0198E91"><enum>(v)</enum><text>includes the
				toll-free hotline telephone number and consumer complaints Internet website
				link under section
				3525(b);</text>
							</clause><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph commented="no" id="id1A7F4BB00E4B461E87AB4DAA79E997DB"><enum>(C)</enum><text>by inserting
			 <quote>and</quote> at the end of clause (vi), as redesignated; and</text>
					</subparagraph><subparagraph commented="no" id="idDA3A8643703D4CEDAB1A4B1599F68F4C"><enum>(D)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id6D16890EAB824EB5959CB06ACB962E38" style="OLC">
							<clause commented="no" id="id10A63CD80B8C41129FECE74EC3AD9D98"><enum>(vii)</enum><text>includes such
				other information as the Secretary of Transportation recommends under section
				3526(b)(3)(F);</text>
							</clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" id="idD4866FC54048495EBDF9DE031C9D34DE"><enum>(2)</enum><text>by amending
			 subparagraph (B) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="idF6EEC4AECED24C40AFFADAFA84AB835F" style="OLC">
						<subparagraph commented="no" id="id91C97E4ED30D45E8A735AA29BE43C52A"><enum>(B)</enum><text>provide a copy of
				the security guide to—</text>
							<clause commented="no" id="id4AAEBE4094824CB393DEB84DB3059D6B"><enum>(i)</enum><text>the Secretary of
				Transportation for review;</text>
							</clause><clause commented="no" id="idFB889FC938F648BBB32F0B5E3156A171"><enum>(ii)</enum><text>the Federal
				Bureau of Investigation for comment; and</text>
							</clause><clause commented="no" id="idFE269C34EA314124A1A913486BA1B399"><enum>(iii)</enum><text>a passenger
				immediately after the vessel is notified that the passenger is an alleged
				victim of an incident described under subsection (g)(3)(A)(i);
				and</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id368F4618B4354ABD832461BA3403F8B8"><enum>(h)</enum><header>Minimum number
			 of medical staff</header><text>Not later than 1 year after the date of
			 enactment of this Act, the Secretary of Transportation shall determine and
			 require, by regulation, a minimum number of medical staff, and appropriate
			 qualifications, under <external-xref legal-doc="usc" parsable-cite="usc/46/3523">section 3523(d)(3)</external-xref> of title 46, United States Code, that
			 should be available on a vessel per 1,000 passengers.</text>
			</subsection><subsection id="idA849504F9CC548BDB50737093984D92C"><enum>(i)</enum><header>Maintenance of
			 supplies To prevent sexually transmitted diseases</header><text>Section
			 3523(d)(1), as redesignated by section 2 of this Act, is amended by inserting
			 <quote>(taking into consideration the length of the voyage and the number of
			 passengers and crewmembers that the vessel can accommodate)</quote> after
			 <quote>a sexual assault</quote>.</text>
			</subsection><subsection id="id2664A88E354140A9AD41FD25395AE934"><enum>(j)</enum><header>Sexual assault;
			 contact information</header><text>Section 3523(d)(5)(A), as redesignated by
			 section 2 of this Act, is amended by striking <quote>the United States Coast
			 Guard,</quote>.</text>
			</subsection><subsection id="id0AC37712B80544EDBA54CE85335F933A"><enum>(k)</enum><header>Sexual assault;
			 private telephone line</header><text>Section 3523(d)(5)(B), as redesignated by
			 section 2 of this Act, is amended by inserting <quote>under section 3526
			 or</quote> after <quote>the information and support services
			 available</quote>.</text>
			</subsection><subsection id="id13C28DCF09B34D53AC00B62FCAABE17C"><enum>(l)</enum><header>Crime scene
			 preservation training; certification of organizations by
			 MARAD</header><text>Section 3524(a), as redesignated by section 2 of this Act,
			 is amended by striking <quote>may certify</quote> and inserting <quote>shall
			 certify</quote>.</text>
			</subsection><subsection id="idD74057827EFE4153BF53D91C64BD0C3B"><enum>(m)</enum><header>Crew access to
			 passenger staterooms; procedures and restrictions</header><text>Section
			 3523(f), as redesignated by section 2 of this Act, is amended—</text>
				<paragraph id="idBC6B9C9616F34A0F90D63466C40AF51C"><enum>(1)</enum><text>in paragraph
			 (1)—</text>

			 reviewed annually, and updated as necessary.</quote>.</text>
				</paragraph></subsection></section><section id="id830F3CA9FE3F4259B67598698E397EFE"><enum>8.</enum><header>Passenger vessel
			 security and safety requirements</header>
			<subsection id="id06762772C5194ADBA2FF7928E49BB29B"><enum>(a)</enum><header>Vessel design,
			 equipment, construction, and retrofitting requirements</header><text>Section
			 3523(a), as redesignated by section 2 of this Act, is amended—</text>
				<paragraph id="idC2793762A040437288A9328B28581A73"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph commented="no" id="id1F6B59E247FF4A2DA8ACB7936A84577A"><enum>(A)</enum><text>in the matter

					</subparagraph></paragraph><paragraph id="id6095B49300274E5BA3F89989626138EF"><enum>(2)</enum><text>by adding at the
			 end the following:</text>

			 exterior deck</header><text>Section 3523(l), as redesignated by section 2 of
			 this Act, is amended to read as follows—</text>

			</subsection></section><section commented="no" id="id481D5A9134A746FAA5EB98A3E504391E"><enum>9.</enum><header>Enforcement</header>
			<subsection commented="no" id="id6448E8AF747B4262A0ED63999E1984A0"><enum>(a)</enum><header>Information
			 sharing</header>
				<paragraph commented="no" id="id2A76954E285F42CDA83941B7850C8DAA"><enum>(1)</enum><header>In
			 general</header><text>To the extent not prohibited by other law, the head of a
			 designated agency shall make available to another head of a designated agency
			 any information necessary to carry out the provisions of subchapter II of
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/35">chapter 35</external-xref> of title 46, United States Code. The provision by the head of a
			 designated agency of any information under this subsection to another head of a
			 designated agency shall not constitute a waiver, or otherwise effect, any
			 privilege any agency or person may claim with respect to that information under
			 Federal or State law.</text>
				</paragraph><paragraph commented="no" id="id93BC169977A14E668B080F9B81D7653F"><enum>(2)</enum><header>Definition of
			 head of a designated agency</header><text>In this subsection, the term
			 <term>head of a designated agency</term> means the Secretary of Transportation,
			 Secretary of Homeland Security, or Attorney General.</text>

				under section 60105 of any vessel of the owner of a vessel to which this
				subchapter applies, wherever the vessel is found, if the owner of the
				vessel—</text>
							<paragraph commented="no" id="id7CFD1133B4B24080AAFE146A38B525A5"><enum>(1)</enum><text>commits an act or
				omission for which a penalty may be imposed under this subchapter; or</text>
							</paragraph><paragraph commented="no" id="id87450EFD2CC6450794CDF90BA48C439F"><enum>(2)</enum><text>fails to pay a
				penalty imposed on the owner under this subchapter.</text>
							</paragraph></subsection><subsection commented="no" id="id69DD4D790A9741D78D515C995ED0D601"><enum>(b)</enum><header>Denial of
				entry</header><text>The Secretary of the department in which the Coast Guard is
				operating may deny entry into the United States to a vessel to which this
				subchapter applies if the owner of the vessel—</text>
							<paragraph commented="no" id="idC2B04009E75A4315BCBC0FFD7FA710ED"><enum>(1)</enum><text>commits an act or
				omission for which a penalty may be imposed under this subchapter; or</text>
							</paragraph><paragraph commented="no" id="id22EE83AD4A954AA1AE4285E5477DA558"><enum>(2)</enum><text>fails to pay a
				penalty imposed on the owner under this
				subchapter.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			 conforming amendments</header>
