		<official-title>To amend the Higher Education Act of 1965 to improve
		  education and prevention related to campus sexual violence, domestic violence,
		  dating violence, and stalking.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Campus Sexual Violence Elimination
			 Act</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id182b3f17-9025-4156-86b0-1697cf8c0c79" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Campus sexual violence, domestic violence,
			 dating violence, and stalking education and prevention</header>
			<subsection commented="no" display-inline="no-display-inline" id="idbca69466-133e-45c1-971b-16312f05d8aa"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 485(f) of the Higher Education Act
			 of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092(f)</external-xref>) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id0f0a358e-ae3d-43e3-9ae6-7d7236c2efc0"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id3cdf22f4-1e9a-4fbe-83ff-2aaa86fdca92"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (C)(iii), by striking the
			 period at the end and inserting <quote>, when the victim of such crime elects
			 or is unable to make such a report.</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6ed93cc4-36d7-46b6-82dc-0dc6cf7d0bf8"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (F)—</text>
						<clause commented="no" display-inline="no-display-inline" id="ide9794fff-47bf-4645-843b-1eb001d184d2"><enum>(i)</enum><text display-inline="yes-display-inline">in clause (i)(VIII), by striking
			 <quote>and</quote> after the semicolon;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id075e71e3-a3cf-4151-82cd-2c1d9e3030f5"><enum>(ii)</enum><text display-inline="yes-display-inline">in clause (ii)—</text>
							<subclause commented="no" display-inline="no-display-inline" id="id08e66718-2bee-4de9-a5d5-4a4d14eb2c7d"><enum>(I)</enum><text display-inline="yes-display-inline">by striking <quote>sexual
			 orientation</quote> and inserting <quote>national origin, sexual orientation,
			 gender identity,</quote>; and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id9a97453b-1ec6-4374-8abf-977adf0f0bb2"><enum>(II)</enum><text display-inline="yes-display-inline">by striking the period and inserting
			 <quote>; and</quote>; and</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id6b2fb054-9531-4e90-88c7-9526c645bfe6"><enum>(iii)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="idd13ecd82-ab18-43c8-b769-d0a69befe1dd" style="OLC">
								<clause commented="no" display-inline="no-display-inline" id="idcab576d1-f0ca-46a2-9435-c3d201740c35"><enum>(iii)</enum><text display-inline="yes-display-inline">of domestic violence, dating violence, and
				stalking incidents that were reported to campus security authorities or local
				police
				agencies.</text>
								</clause><after-quoted-block>;</after-quoted-block></quoted-block>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide60d56b9-5d83-4a66-962f-1b514e3294b1"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (3), by inserting <quote>,
			 that withholds the names of victims as confidential,</quote> after <quote>that
			 is timely</quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida420af52-3409-4479-a907-e32598963b08"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (6)(A)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id479a2ef9-5bda-48d8-9fe1-ec60eb9b0846"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating clauses (i), (ii), and
			 (iii) as clauses (ii), (iii), and (iv), respectively;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7b12a364-493d-4b12-895b-b441ea126f10"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting before clause (ii), as
			 redesignated by subparagraph (A), the following:</text>
						<quoted-block display-inline="no-display-inline" id="id15a164a5-afea-4a88-8618-1bba18960d06" style="OLC">
							<clause commented="no" display-inline="no-display-inline" id="id70c61f55-0aef-42d3-9878-f394e0b37804" indent="up2"><enum>(i)</enum><text display-inline="yes-display-inline">The terms <term>dating violence</term>,
				<term>domestic violence</term>, and <term>stalking</term> have the meaning
				given such terms in section 40002(a) of the Violence Against Women Act of 1994
				(<external-xref legal-doc="usc" parsable-cite="usc/42/13925">42 U.S.C. 13925(a)</external-xref>).</text>
							</clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id11dc3796-1bec-4189-8565-578aeecc5f99"><enum>(C)</enum><text display-inline="yes-display-inline">by inserting after clause (iv), as
			 redesignated by subparagraph (A), the following:</text>
						<quoted-block display-inline="no-display-inline" id="idf0d2f195-7672-4773-9494-b7b0d3ab95de" style="OLC">
							<clause commented="no" display-inline="no-display-inline" id="idb64eb9e9-494b-4155-bc80-5d811ff35dd2" indent="up2"><enum>(v)</enum><text display-inline="yes-display-inline">The term <term>sexual assault</term> means
				an offense classified as a forcible or nonforcible sex offense under the
				uniform crime reporting system of the Federal Bureau of
				Investigation.</text>
							</clause><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd0c38c7b-caf0-40e5-95b8-d3d4cff05030"><enum>(4)</enum><text display-inline="yes-display-inline">in paragraph (7)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id1d34dc10-a37b-43cd-bb31-aa5c3115138c"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>paragraph (1)(F)</quote>
			 and inserting <quote>clauses (i) and (ii) of paragraph (1)(F)</quote>;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id88266954-baa4-45eb-8dd3-93c3c01c8ac6"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting after <quote>Hate Crime
			 Statistics Act.</quote> the following: <quote>For the offenses of domestic
			 violence, dating violence, and stalking, such statistics shall be compiled in
			 accordance with the definitions used in section 40002(a) of the Violence
			 Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/13925">42 U.S.C. 13925(a)</external-xref>).</quote>;</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4e17d459-da96-4d3c-8dd4-4bc144dd99f1"><enum>(5)</enum><text display-inline="yes-display-inline">by striking paragraph (8) and inserting the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="ida83b1d89-fa68-4755-b758-d4775df4d331" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="id084e0b10-4d0a-4300-a4c6-905644065365" indent="up1"><enum>(8)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idab07d0af-58a2-4f89-9a7e-facc942a9123"><enum>(A)</enum><text display-inline="yes-display-inline">Each institution of higher education
				participating in any program under this title, other than a foreign institution
				of higher education, shall develop and distribute as part of the report
				described in paragraph (1) a statement of policy regarding—</text>
								<clause commented="no" display-inline="no-display-inline" id="id98e8281a-9421-4928-abbc-f309683948c6" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">such institution’s programs to prevent
				domestic violence, dating violence, sexual assault, and stalking; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="iddcdfeee1-d49c-4ca7-b655-d6ec84816371" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">the procedures that such institution will
				follow once an incident of domestic violence, dating violence, sexual assault,
				or stalking has been reported, including a statement of the standard of
				evidence that will be used during any institutional conduct proceeding arising
				from such a report.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5f5321d4-dbcf-4daf-b098-539838288f49" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The policy described in
				<internal-xref legis-path="(8)(A)">subparagraph (A)</internal-xref> shall
				address the following areas:</text>
								<clause commented="no" display-inline="no-display-inline" id="idb2a6f1f2-2c8a-4059-a9c8-b05ba31b3e8e"><enum>(i)</enum><text display-inline="yes-display-inline">Education programs to promote the awareness
				of rape, acquaintance rape, domestic violence, dating violence, sexual assault,
				and stalking, which shall include—</text>
									<subclause commented="no" display-inline="no-display-inline" id="ida766f7ac-b9fa-4433-ae82-621b59ecbbbf"><enum>(I)</enum><text display-inline="yes-display-inline">primary prevention and awareness programs
				for all incoming students and new employees, which shall include—</text>
										<item commented="no" display-inline="no-display-inline" id="id3e8a6011-3d08-4d7e-bc4a-77e82ac05b65"><enum>(aa)</enum><text display-inline="yes-display-inline">a
				statement that the institution of higher education prohibits the offenses of
				domestic violence, dating violence, sexual assault, and stalking;</text>
										</item><item commented="no" display-inline="no-display-inline" id="idd829c7f3-70e6-44d5-ba00-b1720642f967"><enum>(bb)</enum><text display-inline="yes-display-inline">the
				definition of domestic violence, dating violence, sexual assault, and stalking
				in the applicable jurisdiction;</text>
										</item><item commented="no" display-inline="no-display-inline" id="id5d4da19a-5c60-47e7-a7c3-cb22ea760658"><enum>(cc)</enum><text display-inline="yes-display-inline">the
				definition of consent, in reference to sexual activity, in the applicable
				jurisdiction;</text>
										</item><item commented="no" display-inline="no-display-inline" id="id80d0c68e-d089-4064-8532-357df81c20b0"><enum>(dd)</enum><text display-inline="yes-display-inline">safe
				and positive options for bystander intervention that may be carried out by an
				individual to prevent harm or intervene when there is a risk of domestic
				violence, dating violence, sexual assault, or stalking against a person other
				than such individual;</text>
										</item><item commented="no" display-inline="no-display-inline" id="id57b48cf3-9f8e-4358-a614-9ab7bfebc976"><enum>(ee)</enum><text display-inline="yes-display-inline">information on risk reduction to recognize
				warning signs of abusive behavior and how to avoid potential attacks;
				and</text>
										</item><item commented="no" display-inline="no-display-inline" id="id92c54bc3-44bc-456f-bb13-0015aed3ba38"><enum>(ff)</enum><text display-inline="yes-display-inline">the
				information described in clauses (ii) through (vii); and</text>
										</item></subclause><subclause commented="no" display-inline="no-display-inline" id="id3c36ba0c-8cc4-4633-a943-357f6eaa20de"><enum>(II)</enum><text display-inline="yes-display-inline">ongoing prevention and awareness campaigns
				for students and faculty, including information described in items (aa) through
				(ff) of <internal-xref legis-path="(8)(B)(i)(I)">subclause
				(I)</internal-xref>.</text>
									</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id1024ad50-cdce-4f8a-b5e0-ae3f1eaf7aa4"><enum>(ii)</enum><text display-inline="yes-display-inline">Possible sanctions or protective measures
				that such institution may impose following a final determination of an
				institutional disciplinary procedure regarding rape, acquaintance rape,
				domestic violence, dating violence, sexual assault, or stalking.</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idda243283-a668-43f2-a980-86d70572ea19"><enum>(iii)</enum><text display-inline="yes-display-inline">Procedures victims should follow if a sex
				offense, domestic violence, dating violence, sexual assault, or stalking has
				occurred, including information in writing about—</text>
									<subclause commented="no" display-inline="no-display-inline" id="idf2312c31-cb4a-4404-a207-3fb7b4135b7d"><enum>(I)</enum><text display-inline="yes-display-inline">the importance of preserving evidence as
				may be necessary to the proof of criminal domestic violence, dating violence,
				sexual assault, or stalking, or in obtaining a protection order;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="id89fe3e47-555c-4cf4-91e5-432a027ed94c"><enum>(II)</enum><text display-inline="yes-display-inline">to whom the alleged offense should be
				reported;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="id962f9d42-7028-4ac4-af1c-325f9e298bfd"><enum>(III)</enum><text display-inline="yes-display-inline">options regarding law enforcement and
				campus authorities, including notification of the victim's option to—</text>
										<item commented="no" display-inline="no-display-inline" id="iddd25cef4-f52e-4b57-a21d-c7c2e53b8157"><enum>(aa)</enum><text display-inline="yes-display-inline">notify proper law enforcement authorities,
				including on-campus and local police;</text>
										</item><item commented="no" display-inline="no-display-inline" id="id94022720-498f-4177-b3c8-244feb1941c0"><enum>(bb)</enum><text display-inline="yes-display-inline">be
				assisted by campus authorities in notifying law enforcement authorities if the
				victim so chooses; and</text>
										</item><item commented="no" display-inline="no-display-inline" id="id550baee9-4352-497a-8f70-2d4984fa4620"><enum>(cc)</enum><text display-inline="yes-display-inline">decline to notify such authorities;
				and</text>
										</item></subclause><subclause commented="no" display-inline="no-display-inline" id="idcc37b36e-ad6c-4511-aa62-899357931311"><enum>(IV)</enum><text display-inline="yes-display-inline">where applicable, the rights of victims and
				the institution's responsibilities regarding orders of protection, no contact
				orders, restraining orders, or similar lawful orders issued by a criminal,
				civil, or tribal court.</text>
									</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id270c7875-e7fb-4502-8e1d-bcb2d57f8afc"><enum>(iv)</enum><text display-inline="yes-display-inline">Procedures for institutional disciplinary
				action in cases of alleged domestic violence, dating violence, sexual assault,
				or stalking, which shall include a clear statement that—</text>
									<subclause commented="no" display-inline="no-display-inline" id="id1527eab9-80ec-4142-bab9-3df0fc38d99b"><enum>(I)</enum><text display-inline="yes-display-inline">such proceedings shall—</text>
										<item commented="no" display-inline="no-display-inline" id="id4df63329-9b79-4cd8-a974-614eb278c0cf"><enum>(aa)</enum><text display-inline="yes-display-inline">provide a prompt, fair, and impartial
				investigation and resolution;</text>
										</item><item commented="no" display-inline="no-display-inline" id="idc59d4935-2d33-4287-8266-6558ba02ed92"><enum>(bb)</enum><text display-inline="yes-display-inline">be
				conducted by officials who receive annual training on the issues related to
				domestic violence, dating violence, sexual assault, and stalking and how to
				conduct an investigation and hearing process that protects the safety of
				victims and promotes accountability; and</text>
										</item><item commented="no" display-inline="no-display-inline" id="id7C8CA015DAAE4C758EB9565F2CB59E8D"><enum>(cc)</enum><text>use the preponderance of the evidence
				standard;</text>
										</item></subclause><subclause commented="no" display-inline="no-display-inline" id="id26612af8-729d-4ce7-807f-830ed76cf22a"><enum>(II)</enum><text display-inline="yes-display-inline">the accuser and the accused are entitled to
				the same opportunities to have others present during an institutional
				disciplinary proceeding, including the opportunity to be accompanied to any
				related meeting or proceeding by an advisor of their choice; and</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="idadd7bcad-ba25-436f-a81e-4e26b956bdc6"><enum>(III)</enum><text display-inline="yes-display-inline">both the accuser and the accused shall be
				simultaneously informed, in writing, of—</text>
										<item commented="no" display-inline="no-display-inline" id="idcb2bfc44-05a9-4aa1-b7cd-13dbb1976559"><enum>(aa)</enum><text display-inline="yes-display-inline">the
				outcome of any institutional disciplinary proceeding that arises from an
				allegation of domestic violence, dating violence, sexual assault, or
				stalking;</text>
										</item><item commented="no" display-inline="no-display-inline" id="id1590b795-23d4-445a-804f-50e6cddad5d8"><enum>(bb)</enum><text display-inline="yes-display-inline">the
				institution's procedures for the accused and the victim to appeal the results
				of the institutional disciplinary proceeding;</text>
										</item><item commented="no" display-inline="no-display-inline" id="id3b0eca7d-4c23-4938-8ae1-4c66dab8454f"><enum>(cc)</enum><text display-inline="yes-display-inline">any
				change to the results that occurs prior to the time that such results become
				final; and</text>
										</item><item commented="no" display-inline="no-display-inline" id="id3fe63d47-d2ed-4882-a7b3-d77cd0fbe853"><enum>(dd)</enum><text display-inline="yes-display-inline">when
				such results become final.</text>
										</item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id895391e3-cc3e-4c1c-9eec-52ca323fe14c"><enum>(v)</enum><text display-inline="yes-display-inline">Information about how the institution will
				protect the confidentiality of victims, including how publicly available
				recordkeeping will be accomplished without the inclusion of identifying
				information about the victim, to the extent permissible by law.</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id023b2d03-5bf3-4045-8531-35cad7f776cf"><enum>(vi)</enum><text display-inline="yes-display-inline">Written notification of students and
				employees about existing counseling, health, mental health, victim advocacy,
				legal assistance, and other services available for victims both on-campus and
				in the community.</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id69b06920-54b5-4463-b793-5a312fa48ae9"><enum>(vii)</enum><text display-inline="yes-display-inline">Written notification of victims about
				options for, and available assistance in, changing academic, living,
				transportation, and working situations, if so requested by the victim and if
				such accommodations are reasonably available, regardless of whether the victim
				chooses to report the crime to campus police or local law enforcement.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6c9fa84e-ad87-48d0-b572-eab481cbfd4c" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">A
				student or employee who reports to an institution of higher education that the
				student or employee has been a victim of domestic violence, dating violence,
				sexual assault, or stalking, whether the offense occurred on or off campus,
				shall be provided with a written explanation of the student or employee's
				rights and options, as described in clauses (ii) through (vii) of subparagraph
				(B).</text>
							</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd9100156-1354-46ad-b402-171d3d9da298"><enum>(6)</enum><text display-inline="yes-display-inline">in paragraph (9), by striking <quote>The
			 Secretary</quote> and inserting <quote>The Secretary, in consultation with the
			 Attorney General of the United States,</quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida668e528-7da8-4601-96f6-a3959fe1d707"><enum>(7)</enum><text display-inline="yes-display-inline">by striking paragraph (16) and inserting
			 the following:</text>
					<quoted-block display-inline="no-display-inline" id="id01c8f88b-589f-46af-9ef0-68a859ff1097" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="id639c0c7c-7d72-4937-be22-982b8f5bc2d1" indent="up1"><enum>(16)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id48918b03-1b68-4bc2-b5d1-d114227221d5"><enum>(A)</enum><text display-inline="yes-display-inline">The Secretary shall seek the advice and
				counsel of the Attorney General of the United States concerning the
				development, and dissemination to institutions of higher education, of best
				practices information about campus safety and emergencies.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb4195856-3097-4d84-a19f-e66ddc36d579" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The Secretary shall seek the advice and
				counsel of the Attorney General of the United States and the Secretary of
				Health and Human Services concerning the development, and dissemination to
				institutions of higher education, of best practices information about
				preventing and responding to incidents of domestic violence, dating violence,
				sexual assault, and stalking, including elements of institutional policies that
				have proven successful based on evidence-based outcome
				measurements.</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb2f2cdb4-f0f7-4e67-accd-b63f75bf23e6"><enum>(8)</enum><text display-inline="yes-display-inline">by striking paragraph (17) and inserting
			 the following:</text>

				institution participating in any program under this title shall retaliate,
				intimidate, threaten, coerce, or otherwise discriminate against any individual
				for exercising their rights or responsibilities under any provision of this
				subsection.</text>

			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall take effect with respect to the annual security report under
			 section 485(f)(1) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092(f)(1)</external-xref>)
			 prepared by an institution of higher education 1 calendar year after the date
			 of enactment of this Act, and each subsequent calendar year.</text>
