		</action>
		<legis-type>A BILL</legis-type>
		<official-title>To increase oversight of the Revolving Fund of the Office
		  of Personnel Management, strengthen the authority to terminate or debar
		  employees and contractors involved in misconduct affecting the integrity of
		  security clearance background investigations, enhance transparency regarding
		  the criteria utilized by Federal departments and agencies to determine when a
		  security clearance is required, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Security Clearance Oversight and
			 Reform Enhancement Act</short-title></quote>.</text>
		</section><section id="id4585294D78BA41649ECC6E97796BC5FF"><enum>2.</enum><header>Oversight of the
			 Revolving Fund of the Office of Personnel Management</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/5/1304">Section 1304(e)</external-xref> of title 5, United States
			 Code, is amended—</text>
			<subsection id="id707A12ABC8C942C0B6420AC9262DCD7A"><enum>(a)</enum><text display-inline="yes-display-inline">in paragraph (1), in the first sentence, by
			 inserting before the period the following: <quote>, and for the cost of audits,
			 investigations, and oversight activities relating to the fund and the functions
			 financed by the fund, conducted by the Inspector General of the Office</quote>;
			 and</text>
			</subsection><subsection id="idC2DFBF18A0A54C95889A61143CFBCD6D"><enum>(b)</enum><text>in paragraph (5),
			 by adding at the end the following: <quote>Each budget submitted under this
			 paragraph shall include an estimate from the Inspector General of the Office of
			 the amount required to pay the reasonable expenses to adequately audit,
			 investigate, and perform other oversight activities relating to the fund and
			 the functions financed by the fund for the applicable fiscal year, which shall
			 not exceed 0.33 percent of the total budgetary authority requested in the
			 budget estimates submitted to Congress by the Office for that fiscal
			 year.</quote>.</text>
			</subsection></section><section id="id2E8E3DD3E17E42F384B092162535DCC9"><enum>3.</enum><header>Termination and
			 debarment of individuals involved in misconduct affecting the integrity of the
			 background investigations program of the Office of Personnel
			 Management</header>
			<subsection id="id8CC206A4EF6C45EEBCFBBEB8F9A9C2D3"><enum>(a)</enum><header>Termination and
			 Debarment</header><text>The Office of Personnel Management shall terminate or
			 debar an individual employed or contracted by the Office of Personnel
			 Management if the Office of Personnel Management determines, based upon a
			 preponderance of the evidence, that the individual was involved in misconduct
			 affecting the integrity of the background investigations program of the Office
			 of Personnel Management, including, but not limited to—</text>
				<paragraph id="id9AAF350D262B4C14B24DB0E3B9CCD9DE"><enum>(1)</enum><text>falsification of
			 a background investigation report;</text>
				</paragraph><paragraph id="id723E8C78FF6242A0AE95FB5348BB3F66"><enum>(2)</enum><text>fraud relating to
			 a background investigation report;</text>
				</paragraph><paragraph id="idF6320F441745478B98A62C40047190C6"><enum>(3)</enum><text>failure to review
			 a background investigation report;</text>
				</paragraph><paragraph id="id4B32AC57A81D405090CDC2B07CB22A6C"><enum>(4)</enum><text>impersonation of
			 a Federal law enforcement officer; or</text>
				</paragraph><paragraph id="id5FD59CB0E4E944C68604788AB701D2D1"><enum>(5)</enum><text>abuse of
			 authority relating to the employment or contract by the Office of Personnel
			 Management.</text>
				</paragraph></subsection><subsection id="idD890C362B9B94AA1804E9197D87B2552"><enum>(b)</enum><header>Procedures for
			 determination of termination and debarment</header>
				<paragraph id="id7DC0181627B04B3D81A498900E9827B0"><enum>(1)</enum><header>Establishment
			 of procedures</header><text>The Office of Personnel Management shall establish
			 procedures under which the Office of Personnel Management shall determine
			 whether an employee or contractor should be terminated or debarred under
			 subsection (a).</text>
				</paragraph><paragraph id="id20C2D20BA3964D44A3B9A96780980C5A"><enum>(2)</enum><header>Due
			 process</header><text>Notwithstanding chapters 5 and 75 of title 5, United
			 States Code, the procedures established under paragraph (1) shall ensure
			 that—</text>
					<subparagraph id="id10E04DE059694E158CD9BA0D7A5B009C"><enum>(A)</enum><text>the employee or
			 contractor is provided with notice and opportunity to be heard; and</text>
					</subparagraph><subparagraph id="id8E274E61BACD493699F1F95129174E2A"><enum>(B)</enum><text>the determination
			 whether to terminate, debar, or reinstate the employee or contractor is made
			 expeditiously.</text>
					</subparagraph></paragraph></subsection></section><section id="id67D9F8B2341B42CE8967B78BCE55BF3C"><enum>4.</enum><header>Director of
			 National Intelligence guidance on determinations of positions requiring a
			 security clearance</header>
			<subsection id="id5EDE350214AB44C6B0A21C151CE57244"><enum>(a)</enum><header>Guidance</header><text>Not
			 later than 180 days after the date of the enactment of this Act, the Director
			 of National Intelligence shall issue guidance for the departments and agencies
			 of the Federal Government to be used by such departments and agencies
			 to—</text>
				<paragraph id="id93533821150D4E91A9A963BAFFE52718"><enum>(1)</enum><text display-inline="yes-display-inline">determine whether the occupant of a
			 position requires a security clearance for the performance of the duties of
			 such position; and</text>
				</paragraph><paragraph id="id3273F15EB8FD43E2BDB95670D6BE0B77"><enum>(2)</enum><text display-inline="yes-display-inline">periodically review and, if necessary,
			 revise the designation of a position as requiring a security clearance for the
			 performance of the duties of such position.</text>
				</paragraph></subsection><subsection id="id450D500BB97446B78B2060580445E57A"><enum>(b)</enum><header>Procedures</header><text display-inline="yes-display-inline">The guidance described under subsection (a)
			 shall include such procedures for the discharge of the guidance as the Director
			 of National Intelligence considers appropriate.</text>
