		<official-title>To foster market development of clean energy fueling
		  facilities by steering infrastructure installation toward designated Clean
		  Vehicle Corridors. </official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Clean Vehicle Corridors
			 Act</short-title></quote>.</text>
		</section><section id="id7ABB19EB424743DABC3CF6C4F57FA4E0"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following
			 findings:</text>
			<paragraph id="id93f506a82e834dc1bb0c857612a862cc"><enum>(1)</enum><text>Traditional
			 transportation refueling networks are well-established, but market
			 uncertainties continue to hamper the full use of cleaner alternative domestic
			 energy resources.</text>
			</paragraph><paragraph id="id7D039D690D444FAD84C80909F6E3E30A"><enum>(2)</enum><text>Despite
			 considerable investor interest, higher capital costs and an uncertain consumer
			 base has limited expansion of cleaner alternative refueling options and its
			 customer base.</text>
			</paragraph><paragraph id="id7B8DD4E6B6594F6FB77637ACE6A8C5B3"><enum>(3)</enum><text>Reduced emissions
			 and energy independence are important factors at a National level, but they are
			 not a sufficient inducement to create large-scale changes.</text>
			</paragraph><paragraph id="id89ee04541bfe40179909c26ff4422fbe"><enum>(4)</enum><text>While
			 American-made fuels provide many energy security and environmental benefits, a
			 significant portion of imported oil continues to be consumed as diesel fuel in
			 on-road motor vehicles.</text>
			</paragraph><paragraph id="idFC7D71FD83FA4CB4A5D4109DB7F6246E"><enum>(5)</enum><text>Motor vehicles
			 fueled by domestically generated, cleaner alternative transportation fuels,
			 such as compressed natural gas, liquefied natural gas, propane, electricity,
			 hydrogen, and advanced biofuels, can pay for themselves over time, but sales of
			 such vehicles, other than return-to-base vehicles, have been hampered because
			 of insufficient refueling infrastructure.</text>
			</paragraph><paragraph id="id0265ab02e0814ed3bedf5fde5fccc969"><enum>(6)</enum><text>Simultaneous
			 facilitation of infrastructure development and a robust customer base is needed
			 to avoid penalizing current users or early adopters.</text>
			</paragraph><paragraph id="id515898D7D1E44835A9757F7E64F388C0"><enum>(7)</enum><text>Facilitating
			 focused infrastructure development along designated routes will foster an
			 expansion of cleaner alternative fuel vehicles and increase the likelihood for
			 commercial success.</text>
			</paragraph><paragraph id="idC3761A4E71BE4956B2FFA516CE227CFB"><enum>(8)</enum><text>Eliminating the
			 logistical barriers that are delaying infrastructure development along Clean
			 Vehicle Corridors will—</text>
				<subparagraph id="id45E71A496D6549C2AF603EC18780D21B"><enum>(A)</enum><text>provide cleaner
			 alternative refueling stations with a larger customer base;</text>
				</subparagraph><subparagraph id="id0BB5D6EFC90E4A538F6639BCCF9C8685"><enum>(B)</enum><text>attract more
			 buyers to the purchase of clean vehicles; and</text>
				</subparagraph><subparagraph id="id4BCD6207EA2241A694B81F719CB874E1"><enum>(C)</enum><text>provide new
			 market outlets for clean fuel providers.</text>
				</subparagraph></paragraph></section><section id="id3f8a5d62e2594a37b2c06f29d11a8fde"><enum>3.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text>
			<paragraph id="id0f700b65908a486da27fc9bc06d76555"><enum>(1)</enum><text>to provide market
			 certainty to drive private and commercial capital investment in clean
			 transportation options;</text>
			</paragraph><paragraph id="iddff3db2b151c4e44a10ea28317ca7397"><enum>(2)</enum><text>to promote clean
			 transportation technologies that will—</text>
				<subparagraph id="id9dd059d6a9be498ebd180fea6a8e2a43"><enum>(A)</enum><text>lead to increased
			 diversity and dissemination of cleaner alternative fuel options; and</text>
				</subparagraph><subparagraph id="id378b9637f3d0428c888d70e4c73ae621"><enum>(B)</enum><text>enable the United
			 States to bridge the gap from foreign energy imports to secure, domestically
			 produced energy; and</text>
				</subparagraph></paragraph><paragraph id="id4d133ab17e4446f1b58de2e2e504a92b"><enum>(3)</enum><text>to facilitate
			 clean transportation incentives that will—</text>
				<subparagraph id="id2064176177384482b58418cfac5ad7c3"><enum>(A)</enum><text>attract a
			 critical mass of clean transportation vehicles that will give cleaner
			 alternative fueling stations an assured customer base and market
			 certitude;</text>
				</subparagraph><subparagraph id="iddd1f6a99ae3d413db618759d503fc553"><enum>(B)</enum><text>provide for
			 ongoing increases in energy demands;</text>
				</subparagraph><subparagraph id="idbf1b159d0afd4e52be3cea23235a82db"><enum>(C)</enum><text>support the
			 growth of jobs and businesses in the United States;</text>
				</subparagraph><subparagraph id="id6434b8b8d94b4d5fb92fe7186b1e521d"><enum>(D)</enum><text>reduce emissions
			 by motor vehicles;</text>
				</subparagraph><subparagraph id="id7E501B659A3840EAA48966C7942B0A7A"><enum>(E)</enum><text>decrease our
			 Nation's use of foreign oil; and</text>
				</subparagraph><subparagraph id="idFE925055612F4AFC9B1B01D7CAFFAA99"><enum>(F)</enum><text>encourage
			 innovation in transportation energy and technology.</text>
				</subparagraph></paragraph></section><section id="id33ccdf13a3a5408dbdbef059ce9548ea"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="id56da4a8f578d4378abc387d68f639ef5"><enum>(1)</enum><header>Cleaner
			 alternative fuels</header><text>The term <term>cleaner alternative fuels</term>
			 includes—</text>
				<subparagraph id="id71343da172eb484094eb83e3f07178e0"><enum>(A)</enum><text>compressed
			 natural gas;</text>
				</subparagraph><subparagraph id="id1712b08226ad4b8fa7eae4d5e10b1cf8"><enum>(B)</enum><text>liquefied natural
			 gas;</text>
				</subparagraph><subparagraph id="id0fe805b492dc4f7e8600ef17af83ea32"><enum>(C)</enum><text>liquefied
			 petroleum gas (also known as propane);</text>
				</subparagraph><subparagraph id="ida9c9049876c041b3b48b3fafc5d29ba8"><enum>(D)</enum><text>plug-in
			 electric;</text>
				</subparagraph><subparagraph id="id56b046ab057e4a16a46937c9e37d5a10"><enum>(E)</enum><text>advanced biofuels
			 (as defined in section 211(o)(1)(B)(i) of the Clean Air Act (42 U.S.C.
			 7545(o)(1)(B)(i));</text>
				</subparagraph><subparagraph id="idbf9289295e2f44cb83b20fc3c7bad077"><enum>(F)</enum><text>hydrogen;
			 and</text>
				</subparagraph><subparagraph id="id5c99be6c0e0e4e759316663bb3ce06d6"><enum>(G)</enum><text>other fuels
			 designated by the Secretary.</text>
				</subparagraph></paragraph><paragraph id="idc1a58b2ec576454cbfe49079cab66576"><enum>(2)</enum><header>Clean
			 cities</header><text>The term <term>Clean Cities</term> means the voluntary
			 public-private partnership and technology deployment program managed by the
			 Department of Energy to meet goals in the Alternative Motor Fuels Act of 1988
			 (<external-xref legal-doc="public-law" parsable-cite="pl/100/494">Public Law 100–494</external-xref>), the Clean Air Act Amendments of 1990 (Public Law
			 101–549), and the Energy Policy Act of 1992 (<external-xref legal-doc="public-law" parsable-cite="pl/102/486">Public Law 102–486</external-xref>).</text>
			</paragraph><paragraph id="ided0adfbd0b934fe48a97c913ef6465f9"><enum>(3)</enum><header>Highways</header><text>The
			 term <term>highways</term> is limited to roadways that are part of—</text>
				<subparagraph id="id74f2ecc5a6d64061aa7d296355c7df07"><enum>(A)</enum><text>the National
			 Highway System, as established by the Federal Highway Administration;</text>
				</subparagraph><subparagraph id="idbdb5e34bf3f5472ab6ef4ea4a8f61bb1"><enum>(B)</enum><text>the Dwight D.
			 Eisenhower National System of Interstate and Defense Highways;</text>
				</subparagraph><subparagraph id="idc85e14cb603349b9aefbf45585d8ef29"><enum>(C)</enum><text>the National
			 Truck Network, as authorized by the Surface Transportation Assistance Act of
			 1982 (<external-xref legal-doc="public-law" parsable-cite="pl/97/424">Public Law 97–424</external-xref>) and established by the Federal Highway Administration;
			 and</text>
				</subparagraph><subparagraph id="idf1862a698e8b4dda98f252098dbd6a64"><enum>(D)</enum><text>other roadways
			 most critical to trucks as determined by the Office of Freight Management and
			 Operations in the Federal Highway Administration and authorized by the Moving
			 Ahead for Progress in the 21st Century Act (MAP–21) (Public Law
			 112–141).</text>
				</subparagraph></paragraph><paragraph id="id237edd70cc114c988a53ce00c4764663"><enum>(4)</enum><header>Supporting
			 infrastructure</header><text>The term <term>supporting infrastructure</term>
			 includes fueling stations, rest stops, travel plazas, and other service areas
			 on public or private property that are found to be most practically located
			 along a Clean Vehicle Corridor.</text>
			</paragraph></section><section id="id88DE07635F65437DACD8F9BCC5266ABD"><enum>5.</enum><header>Clean Vehicle
			 Corridors Program</header>
			<subsection id="id2e3e2fd877e94d8d8cfd7da121f1acf1"><enum>(a)</enum><header>Corridor
			 designations</header>
				<paragraph id="idBBF785833BB642A0BE564AA4F944DD89"><enum>(1)</enum><header>In
			 general</header><text>Not later than 1 year after the date of the enactment of
			 this Act, the Secretary of Transportation (referred to in this section as the
			 <quote>Secretary</quote>) shall designate not fewer than 5 <quote>Clean Vehicle
			 Corridors</quote> along Federal highways, interstates, or other contiguous
			 highways.</text>
				</paragraph><paragraph id="id8BA1CC12685949BBA2C0B1FF1EA267EE"><enum>(2)</enum><header>Consultation</header><text>Before
			 making a designation under paragraph (1), the Secretary shall—</text>
					<subparagraph id="id490BB2BA08D74C7AA6CCF06DC66E2644"><enum>(A)</enum><text>consult with the
			 Secretary of Energy regarding the analysis of data collected by both agencies
			 at cleaner alternative fueling projects authorized by this Act and other Acts
			 to better understand usage patterns and petroleum displacement to inform
			 Corridor designation;</text>
					</subparagraph><subparagraph id="idCC72B07E504A4AFD8F2B14E222DA250E"><enum>(B)</enum><text>receive approval
			 from the Secretary of Energy;</text>
					</subparagraph><subparagraph id="ida26b86bafd08488fb486c31c864ac35d"><enum>(C)</enum><text>consult with the
			 Secretary of Commerce, the Secretary of the Interior, and the Administrator of
			 the Environmental Protection Agency;</text>
					</subparagraph><subparagraph id="idd02b5747002b48b6a6a8774dff965727"><enum>(D)</enum><text>consult with
			 State, Tribal, and local governments through whose jurisdictions the proposed
			 corridor runs or abuts;</text>
					</subparagraph><subparagraph id="idEA448DE3795D483EB0DFAE8FF5855327"><enum>(E)</enum><text>gather
			 information from Federal, State, Tribal, and local governments, nongovernmental
			 organizations, businesses, Clean Cities, and individuals to help determine
			 which highways should be included in the corridors designated under paragraph
			 (1);</text>
					</subparagraph><subparagraph id="id4bbdbe81c9ba430c8691b85c45e310f6"><enum>(F)</enum><text>consider existing
			 programs, whether Federal, State, Tribal, local, or private, which can be
			 leveraged to achieve the purposes of this Act;</text>
					</subparagraph><subparagraph id="idbfae800bf3904a86b1c6e61d6c0112ae"><enum>(G)</enum><text>give preference
			 to corridors that connect Clean Cities, as designated by the Department of
			 Energy; and</text>
					</subparagraph><subparagraph id="idC064B2F0FF344B11B9E3444490445E64"><enum>(H)</enum><text>give
			 consideration to air quality nonattainment areas, as determined by the
			 Administration of the Environmental Protection Agency.</text>
					</subparagraph></paragraph></subsection><subsection id="id589cc53391a44e0aa1906427271a13b5"><enum>(b)</enum><header>Infrastructure
			 development for cleaner alternative fuels</header>
				<paragraph id="idC0A4F73C226C4E329918BE3407415948"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Transportation shall encourage the
			 addition of cleaner alternative fuel options and other supporting
			 infrastructure along Clean Vehicle Corridors. These refueling stations should
			 provide at least 1 cleaner alternative fuel and allow any motor vehicle that
			 operates on such fuels to refuel at distances comfortably within 1 tank range
			 without the need for prior arrangement. Existing and private facilities should
			 be encouraged to be included in the Clean Vehicle Corridors network.</text>
				</paragraph><paragraph id="id7c6b0b11316c4d32a93c056749c498dd"><enum>(2)</enum><header>Incentives</header><text>To
			 promote Clean Vehicle Corridors, the Secretary may provide waivers to statutory
			 restrictions for cleaner alternative fuel projects and vehicles along Clean
			 Vehicle Corridors, including—</text>
					<subparagraph id="idd871c52279d14b639ca858ea2baa6bc8"><enum>(A)</enum><text>modifying HOV/HOT
			 lane restrictions under <external-xref legal-doc="usc" parsable-cite="usc/23/166">section 166</external-xref> of title 23, United States Code, to
			 accommodate vehicles using cleaner alternative fuels;</text>
					</subparagraph><subparagraph id="idf8a8779eaa4c40d3863a266cdb03589f"><enum>(B)</enum><text>modifying weight
			 limits under <external-xref legal-doc="usc" parsable-cite="usc/23/127">section 127</external-xref> of title 23, United States Code, to accommodate the
			 additional weight to vehicles caused by cleaner alternative fuel technology
			 such as fuel cylinders for natural gas or auxiliary power sources;</text>
					</subparagraph><subparagraph id="id18e4de34ac294720bacb7974283f76a0"><enum>(C)</enum><text>deeming Clean
			 Vehicle Corridor projects designated under subsection (a) as eligible projects
			 for an increased Federal funding share under section 1116 of the Moving Ahead
			 for Progress in the 21st Century Act (MAP–21) (<external-xref legal-doc="public-law" parsable-cite="pl/112/141">Public Law 112–141</external-xref>);</text>
					</subparagraph><subparagraph id="idA1FCACD692834FA3A6C57FE7B7D5F223"><enum>(D)</enum><text>allowing owners
			 and operators of publicly owned supporting infrastructure to designate parking
			 spaces that are conveniently located near major facilities for use by vehicles
			 that use cleaner alternative fuels;</text>
					</subparagraph><subparagraph id="id8B477F68ED5A46729138E35BC895D574"><enum>(E)</enum><text>allowing the
			 inclusion of cleaner alternative fueling infrastructure projects in State
			 energy conservation plans, in accordance with section 362(d)(5) of the Energy
			 Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6322">42 U.S.C. 6322(d)(5)</external-xref>); and</text>
					</subparagraph><subparagraph id="id4BBA0A65BB414A34904A198C9F997D67"><enum>(F)</enum><text>giving areas
			 surrounding Clean Cities a priority preference for Department of Energy funding
			 opportunities.</text>
					</subparagraph></paragraph></subsection><subsection id="id2f4c15a2ba71411e8d672ec36d1ee612"><enum>(c)</enum><header>Information and
			 resources on Clean Vehicle Corridors</header>
				<paragraph id="id23B0C1D5EC91491493F1169DAC2B5705"><enum>(1)</enum><header>Website</header>
					<subparagraph id="idBF9F6A619C0145238F7216FB5C1BF1A8"><enum>(A)</enum><header>In
			 general</header><text>The Secretary of Transportation shall maintain a publicly
			 accessible website containing information and resources for Clean Vehicle
			 Corridors.</text>
					</subparagraph><subparagraph id="id0f9a2accf5604482bc32ac718d9bf0af"><enum>(B)</enum><header>Best
			 practices</header><text>The Secretary, in consultation with Federal agencies,
			 Tribes, States, and Clean Cities, shall—</text>
						<clause id="id3D7A5C2D655E4C3AAB9287DDD8C5014E"><enum>(i)</enum><text>identify best
			 practices and case studies of communities and complementary programs that have
			 successfully promoted cleaner alternative fuel use; and</text>
						</clause><clause id="idBDAA050147C54CDCB0252E5F94EAD3B2"><enum>(ii)</enum><text>post the
			 information described in clause (i) on the website referred to in subparagraph
			 (A).</text>
						</clause></subparagraph><subparagraph id="id1ad0eee31a404d65b0c8045ab8c32910"><enum>(C)</enum><header>Available
			 mechanisms</header><text>The Secretary shall—</text>
						<clause id="id77E9A86FF672487D86AB0A10EF55778F"><enum>(i)</enum><text>identify all
			 existing technical and financial mechanisms available to promote the
			 development of cleaner alternative fuel infrastructure; and</text>
						</clause><clause id="id6F4B33D6C0E24B2AA25BDC85FB87FA2A"><enum>(ii)</enum><text>post the
			 information described in clause (i) on the website referred to in subparagraph
			 (A).</text>
						</clause></subparagraph><subparagraph id="ide33c2b9696214a24bbc113ce02029a29"><enum>(D)</enum><header>Hyperlink</header><text>The
			 Secretary shall ensure that the website referred to in subparagraph (A) is
			 linked to the Alternative Fuels Data Center maintained by the Department of
			 Energy.</text>
					</subparagraph></paragraph><paragraph id="id87961623defb4fdfbfbc28a1ccdf5c52"><enum>(2)</enum><header>Data
			 gathering</header><text>The Secretary shall collaborate with the Secretary of
			 Energy and all relevant Clean Vehicle Corridor stakeholders to collect data on
			 cleaner alternative fueling station usage patterns, including energy
			 consumption, performance, petroleum displacement, and other factors deemed
			 important by the Secretaries to inform Corridor designation and
			 performance.</text>
				</paragraph><paragraph id="id9F390A726A3E4E2FB6B9877FAC395403"><enum>(3)</enum><header>Interstate
			 compacts</header>
					<subparagraph id="id8885276086DB43F393753763ACBFF79A"><enum>(A)</enum><header>Establishment</header><text>Two
			 or more contiguous States may enter into an interstate compact to establish
			 Clean Vehicle Corridor partnerships to facilitate planning for and siting of
			 necessary facilities within those States.</text>
					</subparagraph><subparagraph id="id67460f9b80d248c2b005c6e67c8aa4cf"><enum>(B)</enum><header>Technical
			 assistance</header>
						<clause id="id0526F5C199D74C188BC404A5B5131754"><enum>(i)</enum><header>In
			 general</header><text>The Secretary, in consultation with the Secretary of
			 Energy, the Secretary of Commerce, the Secretary of the Interior, and the
			 Administrator of the Environmental Protection Agency, may provide technical
			 assistance to interstate compact partnerships established pursuant to
			 subparagraph (A).</text>
						</clause><clause id="id6ff72e64f04d4b549c4345e65af7c4cf"><enum>(ii)</enum><header>Federal
			 authority</header><text>Nothing contained in clause (i) or in any compact may
			 be construed—</text>
							<subclause id="id449CC05B50734ECB9BCD88BDB55B78B7"><enum>(I)</enum><text>to limit the
			 applicability of any Federal law;</text>
							</subclause><subclause id="id5AA0969FB87A467E9604FB23BA5957AB"><enum>(II)</enum><text>to diminish or
			 otherwise impair the jurisdiction of any Federal agency; or</text>
							</subclause><subclause id="idD02FEC0652D74AD399CA78D50CEEAA32"><enum>(III)</enum><text>to alter,
			 amend, or otherwise affect any Federal law governing the judicial review of any
			 action taken pursuant to any compact.</text>
							</subclause></clause></subparagraph><subparagraph id="iddf506cd5a304420d9f5f9ba50ffdf4cb"><enum>(C)</enum><header>Congressional
			 review</header><text>Each compact established pursuant to subparagraph (A)
			 shall acknowledge that Congress may withdraw its consent under this paragraph
			 every 3 years after the compact has taken effect.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
