			 FISA Amendments Act of 2008 sunset</header>
				<paragraph id="idd4413dc6-dc29-42bd-b96a-42ef9f80d983"><enum>(1)</enum><header>Modification</header><text>Section
			 403(b)(1) of the FISA Amendments Act of 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/261">Public Law 110–261</external-xref>; 50 U.S.C.
			 1881 note) is amended by striking <quote>December 31, 2017</quote> and
			 inserting <quote>June 1, 2015</quote>.</text>
				</paragraph><paragraph id="id981db899-3827-4c48-994e-bdf18c86afba"><enum>(2)</enum><header>Technical
			 and conforming amendments</header><text>Section 403(b)(2) of such Act (Public

					<subparagraph commented="no" display-inline="no-display-inline" id="id8826d1b6-cb1f-46ba-8bc6-cc67caf7fe65"><enum>(A)</enum><text>section 2709
			 of title 18, United States Code, is amended to read as such provision read on
			 October 25, 2001;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id37b67603-253a-4e22-a4ec-bfa31d0a49e5"><enum>(B)</enum><text>section
			 1114(a)(5) of the Right to Financial Privacy Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/12/3414">12 U.S.C. 3414(a)(5)</external-xref>)
			 is amended to read as such provision read on October 25, 2001;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide2aa3dda-a291-4b1d-a974-08e811cc565e"><enum>(C)</enum><text>subsections
			 (a) and (b) of section 626 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681u">15 U.S.C. 1681u</external-xref>)
			 are amended to read as subsections (a) and (b), respectively, of the second of
			 the 2 sections designated as section 624 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681u">15 U.S.C. 1681u</external-xref>)
			 (relating to disclosure to the Federal Bureau of Investigation for
			 counterintelligence purposes), as added by section 601 of the Intelligence
			 Authorization Act for Fiscal Year 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/93">Public Law 104–93</external-xref>; 109 Stat. 974), read
			 on October 25, 2001;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6fc89c57-75c5-43a0-934c-5b54c7ed99cb"><enum>(D)</enum><text>section 627
			 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681v">15 U.S.C. 1681v</external-xref>) is repealed; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id51c5b344-3a71-4cdc-9e97-04e686939a90"><enum>(E)</enum><text>section 802
			 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3162">50 U.S.C. 3162</external-xref>) is amended to read as
			 such provision read on October 25, 2001.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idab69f468-99bc-43ee-9eb1-f039737e9712"><enum>(2)</enum><header display-inline="yes-display-inline">Transition provision</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1), the
			 provisions of law referred to in paragraph (1), as in effect on May 31, 2015,
			 shall continue to apply on and after June 1, 2015, with respect to any
			 particular foreign intelligence investigation or with respect to any particular
			 offense or potential offense that began or occurred before June 1, 2015.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE58E384FBA334D4895898DF4765B365D"><enum>(3)</enum><header>Technical and
			 conforming amendments</header><text>Effective June 1, 2015—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id7237E4298BCA423982A76AC2AD950E91"><enum>(A)</enum><text>section 3511 of
			 title 18, United States Code, is amended—</text>
						<clause commented="no" display-inline="no-display-inline" id="idB3D10EBB419142F6989194917A83BBD4"><enum>(i)</enum><text>in subsections
			 (a), (c), and (d), by striking <quote>or 627(a)</quote> each place it appears;
			 and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idA3291CBC9A4A4A009B8A43BFF9E5EF70"><enum>(ii)</enum><text>in subsection
			 (b)(1)(A), as amended by section 6(b) of this Act, by striking <quote>section
			 626 or 627 of the Fair Credit Reporting Act (15 U.S.C. 1681u and 1681v)</quote>
			 and inserting <quote>section 626 of the Fair Credit Reporting Act (15 U.S.C.
			 1681u)</quote>;</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDF48BCB2347D485EB2115BE29CCBEE6E"><enum>(B)</enum><text>section 118(c) of

			 sections for the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681">15 U.S.C. 1681 et seq.</external-xref>) is amended
			 by striking the item relating to section 627.</text>
					</subparagraph></paragraph></subsection></section><section id="id938C3C86658845CC8461FBF92E987DD5"><enum>3.</enum><header>Factual basis
			 for and issuance of orders for access to tangible things</header>
			<subsection id="idD3B13DA90DCC47378EDFDB81EE33D885"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 501 of the
			 Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861</external-xref>) is
			 amended—</text>
				<paragraph id="idF89AB9A201D846C5935C4ABF138BBF0C"><enum>(1)</enum><text>in the section
			 heading, by striking <quote><header-in-text level="section" style="OLC">certain
			 business records</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">tangible things</header-in-text></quote>;</text>
				</paragraph><paragraph id="idDC0FCC2D96654FD381F535ED7FF80BFA"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)(2), by striking
			 subparagraphs (A) and (B) and inserting the following:</text>

							</clause><clause id="idC9D6FD457A7B4DCFBFAB4AB45726A9D8"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id517B0695ADEE4637994916962D3AEE47"><enum>(I)</enum><text>pertain to a foreign
				power or an agent of a foreign power;</text>
								</subclause><subclause id="id367F460F40A34221BD0B9C4D783291F9" indent="up1"><enum>(II)</enum><text>are relevant to the activities of a
				suspected agent of a foreign power who is the subject of such authorized
				investigation; or</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="idAF47E63AD9274345B1CFFD15D98E5A7F" indent="up1"><enum>(III)</enum><text>pertain to an individual in contact
				with, or known to, a suspected agent of a foreign power; and</text>
								</subclause></clause></subparagraph><subparagraph id="ID6b7de10644b34fc4bd031d361cf23288"><enum>(B)</enum><text>a statement of
				proposed minimization procedures.</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idE81AFD5B2077441EA02250C4909BE4D1"><enum>(3)</enum><text>in subsection
			 (c)—</text>
					<subparagraph id="id4FDE50A490B5458BAE8B2FD12D41B961"><enum>(A)</enum><text>in paragraph
			 (1)—</text>
						<clause id="idE498BDCCD25C44E59726BD70646C7C8C"><enum>(i)</enum><text>by
			 inserting <quote>and that the proposed minimization procedures meet the
			 definition of minimization procedures under subsection (g)</quote> after

			 is amended by adding at the end the following:</text>

			 following:</text>

						<paragraph commented="no" display-inline="no-display-inline" id="id8b18b314-bcd9-4eba-b474-3a513b21901f"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>minimization
				procedures</term> means—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id485b2187-da93-4165-a6b4-dad6f4addf6c"><enum>(A)</enum><text display-inline="yes-display-inline">specific procedures, that are reasonably
				designed in light of the purpose and technique of an order for the installation
				and use of a pen register or trap and trace device, to minimize the retention,
				and prohibit the dissemination, of nonpublicly available information known to
				concern unconsenting United States persons consistent with the need of the
				United States to obtain, produce, and disseminate foreign intelligence
				information;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddd101b69-d70c-43c5-9970-341ed626dbde"><enum>(B)</enum><text display-inline="yes-display-inline">procedures that require that nonpublicly
				available information, which is not foreign intelligence information, shall not
				be disseminated in a manner that identifies any United States person, without
				the consent of such person, unless the identity of such person is necessary to
				understand foreign intelligence information or assess its importance;
				and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id32cee1c0-830e-469b-af91-1966f8ff2dee"><enum>(C)</enum><text display-inline="yes-display-inline">notwithstanding subparagraphs (A) and (B),
				procedures that allow for the retention and dissemination of information that
				is evidence of a crime which has been, is being, or is about to be committed
				and that is to be retained or disseminated for law enforcement
				purposes.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida4492d10-2dcf-418a-9a92-2811a2aad344"><enum>(2)</enum><header display-inline="yes-display-inline">Pen registers and trap and trace
			 devices</header><text display-inline="yes-display-inline">Section 402 of the
			 Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1842">50 U.S.C. 1842</external-xref>) is
			 amended—</text>
					<subparagraph id="id7E28BA09253D4E3B883FE90174883370"><enum>(A)</enum><text>in subsection
			 (d)(1), by striking <quote>the judge finds</quote> and all that follows and
			 inserting the following: “the judge finds—</text>
						<quoted-block display-inline="no-display-inline" id="idFDA29C5283124636800D12810F1E5343" style="OLC">
							<subparagraph id="IDffdc97ee6613477b8665d6b311c79602" indent="up1"><enum>(A)</enum><text>that the application satisfies the
				requirements of this section; and</text>
							</subparagraph><subparagraph id="ID6932aceee51c4071a68f63042f269ff0" indent="up1"><enum>(B)</enum><text>that, if there are exceptional
				circumstances justifying the use of minimization procedures in a particular
				case, the proposed minimization procedures meet the definition of minimization
				procedures under this title.</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id67450b43-e8fb-4d7e-9198-684b889d2b2b"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="idf32db047-5d5f-418b-8a5e-6af6bf6484c0" style="OLC">
							<subsection commented="no" display-inline="no-display-inline" id="id55fc979f-63df-4231-98c7-7b3323838469"><enum>(h)</enum><text display-inline="yes-display-inline">At or before the end of the period of time
				for which the installation and use of a pen register or trap and trace device
				is approved under an order or an extension under this section, the judge may
				assess compliance with any applicable minimization procedures by reviewing the
				circumstances under which information concerning United States persons was
				retained or
				disseminated.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id154a6c68-cefb-427e-8c3b-336c94965c45"><enum>(3)</enum><header display-inline="yes-display-inline">Emergencies</header><text display-inline="yes-display-inline">Section 403 of the Foreign Intelligence
			 Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1843">50 U.S.C. 1843</external-xref>) is amended—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ida16535e1-c82a-4473-b8b8-691b46f35fd0"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating subsection (c) as
			 subsection (d); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9089d332-16c6-44a5-af96-415f7f2ea845"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting after subsection (b) the
			 following:</text>
						<quoted-block display-inline="no-display-inline" id="id7b86b8a4-98f0-4bf7-a016-3ba62d104f5f" style="OLC">
							<subsection commented="no" display-inline="no-display-inline" id="idf54b891a-70db-4c82-85a0-cd08cbe227e9"><enum>(c)</enum><text display-inline="yes-display-inline">If the Attorney General authorizes the
				emergency installation and use of a pen register or trap and trace device under
				this section, the Attorney General shall require that minimization procedures
				be followed, if
				appropriate.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd8826675-d114-4200-ac00-c0d5e7b11f3d"><enum>(4)</enum><header display-inline="yes-display-inline">Use of information</header><text display-inline="yes-display-inline">Section 405(a)(1) of the Foreign
			 Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1845">50 U.S.C. 1845(a)(1)</external-xref>) is amended by
			 striking <quote>provisions of this section</quote> and inserting
			 <quote>minimization procedures required under this title</quote>.</text>
				</paragraph></subsection><subsection id="id1DF31B51DBC44C62ABC85F02BFBA3A08"><enum>(c)</enum><header>Transition
			 procedures</header>
				<paragraph id="id091CAD92BA3D4BE99A893CFD2A512FCA"><enum>(1)</enum><header>Orders in
			 effect</header><text>Notwithstanding the amendments made by this Act, an order
			 entered under section 402(d)(1) of the Foreign Intelligence Surveillance Act of
			 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1842">50 U.S.C. 1842(d)(1)</external-xref>) that is in effect on the effective date of the
			 amendments made by this section shall remain in effect until the expiration of
			 the order.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5768C7B1155C47149A7452944E8DACDD"><enum>(2)</enum><header>Extensions</header><text>A
			 request for an extension of an order referred to in paragraph (1) shall be
			 subject to the requirements of the Foreign Intelligence Surveillance Act of
			 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>), as amended by this Act.</text>
				</paragraph></subsection></section><section id="id6335e547-9ad3-4e70-ad14-295e70890893"><enum>5.</enum><header>Limitations
			 on disclosure of national security letters</header>
			<subsection id="id7536795c-6c25-4e9a-857f-f12f301d2bcd"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2709">Section 2709</external-xref> of title 18, United States Code, is amended
			 by striking subsection (c) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id96a99b15-7f4e-481a-9756-e4d970badfad" style="OLC">
					<subsection id="ide110467a-faea-43f0-abc8-9e3c8e27d387"><enum>(c)</enum><header>Prohibition
				of certain disclosure</header>
						<paragraph id="id781f9ff3-5666-4691-8622-01c7c1b610b3"><enum>(1)</enum><header>Prohibition</header>
							<subparagraph id="id62582bd9-0ce5-4adf-88bf-1136435b8732"><enum>(A)</enum><header>In
				general</header><text>If a certification is issued under subparagraph (B) and
				notice of the right to judicial review under paragraph (3) is provided, no wire
				or electronic communication service provider, or officer, employee, or agent
				thereof, that receives a request under subsection (a), shall disclose to any
				person that the Director of the Federal Bureau of Investigation has sought or
				obtained access to information or records under this section.</text>
							</subparagraph><subparagraph id="id8985ae92-ccdb-4deb-81bd-f1c6ea1189aa"><enum>(B)</enum><header>Certification</header><text>The
				requirements of subparagraph (A) shall apply if the Director of the Federal
				Bureau of Investigation, or a designee of the Director whose rank shall be no
				lower than Deputy Assistant Director at Bureau headquarters or a Special Agent
				in Charge of a Bureau field office, certifies that, absent a prohibition of
				disclosure under this subsection, there may result—</text>
								<clause id="idbf42c9e5-3002-4c53-9847-a26d129a4219"><enum>(i)</enum><text>a danger to
				the national security of the United States;</text>
								</clause><clause id="id2dfaec0f-608d-42cb-87a4-ad6cdc01d02b"><enum>(ii)</enum><text>interference
				with a criminal, counterterrorism, or counterintelligence investigation;</text>
								</clause><clause id="id16a4a767-baff-4858-865d-19bacd125ef1"><enum>(iii)</enum><text>interference
				with diplomatic relations; or</text>
								</clause><clause id="id25772468-ac8b-487a-b5e7-078ff73c001c"><enum>(iv)</enum><text>danger to
				the life or physical safety of any person.</text>
								</clause></subparagraph></paragraph><paragraph id="idd840aaa0-ae2d-4ce4-ac45-2ce42d3a5fcc"><enum>(2)</enum><header>Exception</header>
							<subparagraph id="idf58cddb9-d405-4d3c-8b4f-b904cc6a4246"><enum>(A)</enum><header>In
				general</header><text>A wire or electronic communication service provider, or
				officer, employee, or agent thereof, that receives a request under subsection
				(a) may disclose information otherwise subject to any applicable nondisclosure
				requirement to—</text>
								<clause id="id3614e18c-5b70-4d14-9659-1bcf580f9f64"><enum>(i)</enum><text>those persons
				to whom disclosure is necessary in order to comply with the request;</text>
								</clause><clause id="id432b1ca2-87e4-42a7-870e-e8876cd4350e"><enum>(ii)</enum><text>an attorney
				in order to obtain legal advice or assistance regarding the request; or</text>
								</clause><clause id="id28acaba7-f18e-4ea4-ada4-2dce951318f8"><enum>(iii)</enum><text>other
				persons as permitted by the Director of the Federal Bureau of Investigation or
				the designee of the Director.</text>
								</clause></subparagraph><subparagraph id="idFBE37D3B35EA44AB89E95E5F9AF7FF01"><enum>(B)</enum><header>Persons
				necessary for compliance</header><text>Upon a request by the Director of the
				Federal Bureau of Investigation or the designee of the Director, those persons
				to whom disclosure will be made under subparagraph (A)(i) or to whom such
				disclosure was made before the request shall be identified to the Director or
				the designee.</text>
							</subparagraph><subparagraph id="id6918fec0-a2ec-4429-b416-f0e773fa5498"><enum>(C)</enum><header>Nondisclosure
				requirement</header><text>A person to whom disclosure is made under
				subparagraph (A) shall be subject to the nondisclosure requirements applicable
				to a person to whom a request is issued under subsection (a) in the same manner
				as the person to whom the request is issued.</text>
							</subparagraph><subparagraph id="id05d305a1-2f86-46fd-a003-d055bfc0fa87"><enum>(D)</enum><header>Notice</header><text>Any
				recipient that discloses to a person described in subparagraph (A) information
				otherwise subject to a nondisclosure requirement shall inform the person of the
				applicable nondisclosure requirement.</text>
							</subparagraph></paragraph><paragraph id="id5d640c23-475e-4bcd-bb09-a2c6cb198620"><enum>(3)</enum><header>Right to
				judicial review</header>
							<subparagraph id="idf6f2aac7-7998-46f6-b6ce-40832fa24d02"><enum>(A)</enum><header>In
				general</header><text>A wire or electronic communications service provider that
				receives a request under subsection (a) shall have the right to judicial review
				of any applicable nondisclosure requirement.</text>
							</subparagraph><subparagraph id="id030a8b35-498d-430f-997e-6026a486b559"><enum>(B)</enum><header>Notification</header><text>A
				request under subsection (a) shall state that if the recipient wishes to have a
				court review a nondisclosure requirement, the recipient shall notify the
				Government.</text>
							</subparagraph><subparagraph id="id471a6b9c-329a-43b7-b799-1a9de49151fb"><enum>(C)</enum><header>Initiation
				of proceedings</header><text>If a recipient of a request under subsection (a)
				makes a notification under subparagraph (B), the Government shall initiate
				judicial review under the procedures established in section 3511 of this title,
				unless an appropriate official of the Federal Bureau of the Investigation makes
				a notification under paragraph (4).</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8897783d-8991-435d-a599-d6ce5ee3b500"><enum>(4)</enum><header>Termination</header><text>In
				the case of any request for which a recipient has submitted a notification
				under paragraph (3)(B), if the facts supporting a nondisclosure requirement
				cease to exist, an appropriate official of the Federal Bureau of Investigation
				shall promptly notify the wire or electronic service provider, or officer,
				employee, or agent thereof, subject to the nondisclosure requirement that the
				nondisclosure requirement is no longer in
				effect.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id7e1d2505-b66e-45ac-aee9-cc80f2683e0b"><enum>(b)</enum><header>Identity of
			 financial institutions and credit reports</header><text>Section 626 of the Fair
			 Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681u">15 U.S.C. 1681u</external-xref>) is amended by striking subsection (d)
			 and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id6a691279-29a5-4bfc-886c-de95c02832de" style="OLC">
					<subsection id="id89d5b50d-3d26-4780-ad25-962c02f5c418"><enum>(d)</enum><header>Prohibition

							<subparagraph id="idf8767a8c-b381-4641-8701-2b07868a9a1f"><enum>(A)</enum><header>In
				general</header><text>If a certification is issued under subparagraph (B) and
				notice of the right to judicial review under paragraph (3) is provided, no
				consumer reporting agency, or officer, employee, or agent thereof, that
				receives a request or order under subsection (a), (b), or (c), shall disclose
				or specify in any consumer report, that the Federal Bureau of Investigation has
				sought or obtained access to information or records under subsection (a), (b),
				or (c).</text>
							</subparagraph><subparagraph id="id32002943-bdd5-4fd5-a348-72457d59135c"><enum>(B)</enum><header>Certification</header><text>The
				requirements of subparagraph (A) shall apply if the Director of the Federal
				Bureau of Investigation, or a designee of the Director whose rank shall be no
				lower than Deputy Assistant Director at Bureau headquarters or a Special Agent
				in Charge of a Bureau field office, certifies that, absent a prohibition of

								</clause><clause id="id4e329b27-e987-4070-b11d-c8b0e16927c3"><enum>(iv)</enum><text>danger to
				the life or physical safety of any person.</text>
								</clause></subparagraph></paragraph><paragraph id="id7fa4f547-59c3-418f-9749-261e3982af2e"><enum>(2)</enum><header>Exception</header>
							<subparagraph id="idf8a8971e-9370-4364-8686-cec1c40efdbd"><enum>(A)</enum><header>In
				general</header><text>A consumer reporting agency, or officer, employee, or
				agent thereof, that receives a request or order under subsection (a), (b), or
				(c) may disclose information otherwise subject to any applicable nondisclosure
				requirement to—</text>
								<clause id="id1afd2382-1217-4988-9a65-fde1f3311e19"><enum>(i)</enum><text>those persons
				to whom disclosure is necessary in order to comply with the request or
				order;</text>
								</clause><clause id="idd029f519-83f8-4254-ab35-8e96484bf146"><enum>(ii)</enum><text>an attorney
				in order to obtain legal advice or assistance regarding the request or order;
				or</text>
								</clause><clause id="id27c2dcf5-fb2f-4cb8-8d17-b89da0df0ead"><enum>(iii)</enum><text>other
				persons as permitted by the Director of the Federal Bureau of Investigation or
				the designee of the Director.</text>
								</clause></subparagraph><subparagraph id="id5AA81DE9F35040DDAB6F1D4CEB2AA123"><enum>(B)</enum><header>Persons
				necessary for compliance</header><text>Upon a request by the Director of the
				Federal Bureau of Investigation or the designee of the Director, those persons
				to whom disclosure will be made under subparagraph (A)(i) or to whom such
				disclosure was made before the request shall be identified to the Director or
				the designee.</text>
							</subparagraph><subparagraph id="id34d942f5-4694-4d77-a1c5-4ce9b9873871"><enum>(C)</enum><header>Nondisclosure
				requirement</header><text>A person to whom disclosure is made under
				subparagraph (A) shall be subject to the nondisclosure requirements applicable
				to a person to whom a request or order is issued under subsection (a), (b), or
				(c) in the same manner as the person to whom the request or order is
				issued.</text>
							</subparagraph><subparagraph id="id83e66c7e-0167-4b3e-bd8f-94e0b4e5fcb0"><enum>(D)</enum><header>Notice</header><text>Any
				recipient that discloses to a person described in subparagraph (A) information
				otherwise subject to a nondisclosure requirement shall inform the person of the
				applicable nondisclosure requirement.</text>
							</subparagraph></paragraph><paragraph id="id91efc1c0-3cec-4968-a64a-9d039f837312"><enum>(3)</enum><header>Right to
				judicial review</header>
							<subparagraph id="id621aef60-32ca-40d1-9464-42fef9da72de"><enum>(A)</enum><header>In
				general</header><text>A consumer reporting agency that receives a request or
				order under subsection (a), (b), or (c) shall have the right to judicial review
				of any applicable nondisclosure requirement.</text>
							</subparagraph><subparagraph id="idda30673d-1805-4b57-b358-bc95a8e3dbde"><enum>(B)</enum><header>Notification</header><text>A
				request or order under subsection (a), (b), or (c) shall state that if the
				recipient wishes to have a court review a nondisclosure requirement, the
				recipient shall notify the Government.</text>
							</subparagraph><subparagraph id="idc004b4ee-d74f-4b1b-b685-5179eed369d7"><enum>(C)</enum><header>Initiation
				of proceedings</header><text>If a recipient of a request or order under
				subsection (a), (b), or (c) makes a notification under subparagraph (B), the
				Government shall initiate judicial review under the procedures established in
				<external-xref legal-doc="usc" parsable-cite="usc/18/3511">section 3511</external-xref> of title 18, United States Code, unless an appropriate official of
				the Federal Bureau of Investigation makes a notification under paragraph
				(4).</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idec02643e-e30d-4d39-b0d2-3ef19c0ff2c8"><enum>(4)</enum><header>Termination</header><text>In
				the case of any request or order for which a consumer reporting agency has
				submitted a notification under paragraph (3)(B), if the facts supporting a
				nondisclosure requirement cease to exist, an appropriate official of the
				Federal Bureau of Investigation shall promptly notify the consumer reporting
				agency, or officer, employee, or agent thereof, subject to the nondisclosure
				requirement that the nondisclosure requirement is no longer in
				effect.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id153a1004-f260-40a9-9cbf-c5de819621c3"><enum>(c)</enum><header>Disclosures
			 to Governmental agencies for counterterrorism purposes</header><text>Section
			 627 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681v">15 U.S.C. 1681v</external-xref>) is amended by striking
			 subsection (c) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id36d738f1-ddc7-4981-a0da-da8141458fc9" style="OLC">
					<subsection id="idd9b37ff4-9f2b-4a2e-a8bb-af831f40d580"><enum>(c)</enum><header>Prohibition
				of certain disclosure</header>
						<paragraph id="id507787a5-8214-41a1-b961-bb2c6888e697"><enum>(1)</enum><header>Prohibition</header>
							<subparagraph id="id8288662b-ee91-46f5-886d-23f3a451aefc"><enum>(A)</enum><header>In
				general</header><text>If a certification is issued under subparagraph (B) and
				notice of the right to judicial review under paragraph (3) is provided, no
				consumer reporting agency, or officer, employee, or agent thereof, that
				receives a request under subsection (a), shall disclose to any person or
				specify in any consumer report, that a government agency has sought or obtained
				access to information under subsection (a).</text>
							</subparagraph><subparagraph id="ide1706381-3318-4e60-80b7-3e1247930f9d"><enum>(B)</enum><header>Certification</header><text>The
				requirements of subparagraph (A) shall apply if the head of a government agency
				authorized to conduct investigations of, or intelligence or counterintelligence
				activities or analysis related to, international terrorism, or a designee,
				certifies that, absent a prohibition of disclosure under this subsection, there
				may result—</text>
								<clause id="id0a42d0de-54bf-4431-992c-dc4e65a198ab"><enum>(i)</enum><text>a danger to
				the national security of the United States;</text>
								</clause><clause id="idb29c9a65-a011-47b6-aefd-bae6781d45dd"><enum>(ii)</enum><text>interference
				with a criminal, counterterrorism, or counterintelligence investigation;</text>
								</clause><clause id="id793f835b-6d84-4e08-97ce-b1252e5ec731"><enum>(iii)</enum><text>interference
				with diplomatic relations; or</text>
								</clause><clause id="ida85cf065-5a11-4949-95bb-1defca320de8"><enum>(iv)</enum><text>danger to
				the life or physical safety of any person.</text>
								</clause></subparagraph></paragraph><paragraph id="id7bd1508a-b612-466f-82ff-4f97d4163d31"><enum>(2)</enum><header>Exception</header>
							<subparagraph id="id5bae4fec-f3d7-471b-a2e9-dc06841e4f80"><enum>(A)</enum><header>In
				general</header><text>A consumer reporting agency, or officer, employee, or
				agent thereof, that receives a request under subsection (a) may disclose
				information otherwise subject to any applicable nondisclosure requirement
				to—</text>
								<clause id="id106ee67a-70a6-4b86-9064-5397d65f7fef"><enum>(i)</enum><text>those persons
				to whom disclosure is necessary in order to comply with the request;</text>
								</clause><clause id="id4a6d1704-926d-404d-baa5-52b80489dc13"><enum>(ii)</enum><text>an attorney
				in order to obtain legal advice or assistance regarding the request; or</text>
								</clause><clause id="idf52cf3f9-18ba-48ab-b71f-858c12db111d"><enum>(iii)</enum><text>other
				persons as permitted by the head of the government agency authorized to conduct
				investigations of, or intelligence or counterintelligence activities or
				analysis related to, international terrorism, or a designee.</text>
								</clause></subparagraph><subparagraph id="id7BAC30ABAF3B434EA6FD7B6F889D9543"><enum>(B)</enum><header>Persons
				necessary for compliance</header><text>Upon a request by the head of a
				government agency authorized to conduct investigations of, or intelligence or
				counterintelligence activities or analysis related to, international terrorism,
				or a designee, those persons to whom disclosure will be made under subparagraph
				(A)(i) or to whom such disclosure was made before the request shall be
				identified to the head of the government agency or the designee.</text>
							</subparagraph><subparagraph id="id325e51f0-c0d3-4d1f-93f7-b27f23681947"><enum>(C)</enum><header>Nondisclosure
				requirement</header><text>A person to whom disclosure is made under
				subparagraph (A) shall be subject to the nondisclosure requirements applicable
				to a person to whom a request is issued under subsection (a) in the same manner
				as the person to whom the request is issued.</text>
							</subparagraph><subparagraph id="ide0f3a894-4a08-442a-9ec0-af57b039ff5a"><enum>(D)</enum><header>Notice</header><text>Any
				recipient that discloses to a person described in subparagraph (A) information
				otherwise subject to a nondisclosure requirement shall inform the person of the
				applicable nondisclosure requirement.</text>
							</subparagraph></paragraph><paragraph id="id30d4afd8-3349-4bd0-8a8d-4da407c78ef9"><enum>(3)</enum><header>Right to
				judicial review</header>
							<subparagraph id="idfb3dc4f0-0872-4e9a-859e-d02305d8dd95"><enum>(A)</enum><header>In
				general</header><text>A consumer reporting agency that receives a request under
				subsection (a) shall have the right to judicial review of any applicable
				nondisclosure requirement.</text>
							</subparagraph><subparagraph id="id10bb638d-8557-44a6-8a5b-1174ba63f288"><enum>(B)</enum><header>Notification</header><text>A
				request under subsection (a) shall state that if the recipient wishes to have a
				court review a nondisclosure requirement, the recipient shall notify the
				government.</text>
							</subparagraph><subparagraph id="id2e044c8f-33b1-4717-b414-fe52778b0302"><enum>(C)</enum><header>Initiation
				of proceedings</header><text>If a recipient of a request under subsection (a)
				makes a notification under subparagraph (B), the government shall initiate
				judicial review under the procedures established in <external-xref legal-doc="usc" parsable-cite="usc/18/3511">section 3511</external-xref> of title 18,

				the case of any request for which a consumer reporting agency has submitted a
				notification under paragraph (3)(B), if the facts supporting a nondisclosure
				requirement cease to exist, an appropriate official of the government agency
				authorized to conduct investigations of, or intelligence or counterintelligence
				activities or analysis related to, international terrorism shall promptly
				notify the consumer reporting agency, or officer, employee, or agent thereof,
				subject to the nondisclosure requirement that the nondisclosure requirement is
				no longer in
				effect.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id0f260240-f1ad-4753-afd3-8d888fd1dca9"><enum>(d)</enum><header>Financial
			 records</header><text>Section 1114(a)(5) of the Right to Financial Privacy Act
			 of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/12/3414">12 U.S.C. 3414(a)(5)</external-xref>) is amended by striking subparagraph (D) and
			 inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id416be3cb-a7e6-4a02-b8d3-cb16ce389fac" style="OLC">
					<subparagraph id="ida9cd8132-930b-4107-8d9d-ce90becfdd47" indent="up2"><enum>(D)</enum><header>Prohibition of certain
				disclosure</header>
						<clause id="id11c7bb0b-3f84-4f2f-851a-a1a39dfbff47"><enum>(i)</enum><header>Prohibition</header>
							<subclause id="idcb1176c5-a719-4e28-8a89-eb63e04d9cf3"><enum>(I)</enum><header>In general</header><text>If a
				certification is issued under subclause (II) and notice of the right to
				judicial review under clause (iii) is provided, no financial institution, or
				officer, employee, or agent thereof, that receives a request under subparagraph
				(A), shall disclose to any person that the Federal Bureau of Investigation has
				sought or obtained access to information or records under subparagraph
				(A).</text>
							</subclause><subclause id="id51b17ffc-30e7-473e-bf84-c4bb43f5a86e"><enum>(II)</enum><header>Certification</header><text>The
				requirements of subclause (I) shall apply if the Director of the Federal Bureau
				of Investigation, or a designee of the Director whose rank shall be no lower
				than Deputy Assistant Director at Bureau headquarters or a Special Agent in
				Charge of a Bureau field office, certifies that, absent a prohibition of
				disclosure under this subparagraph, there may result—</text>
								<item id="id4653e484-0eaa-4c57-8ebc-bcb33616eb0c"><enum>(aa)</enum><text>a danger to the national security of the
				United States;</text>
								</item><item id="ide812dca6-08e8-42b4-ab21-9d0ae7a2a08c"><enum>(bb)</enum><text>interference with a criminal,
				counterterrorism, or counterintelligence investigation;</text>
								</item><item id="idd9ea5190-a9fe-46ae-b58d-c06e76314440"><enum>(cc)</enum><text>interference with diplomatic relations;
				or</text>
								</item><item id="id7922ebc1-f0da-4448-95b4-0014f7ef35a5"><enum>(dd)</enum><text>danger to the life or physical safety of
				any person.</text>
								</item></subclause></clause><clause id="idf5d52511-57c2-4990-8fb1-f921563ca67b"><enum>(ii)</enum><header>Exception</header>
							<subclause id="idece8238f-0fd8-4fda-a4d3-b4ef33b384c5"><enum>(I)</enum><header>In general</header><text>A
				financial institution, or officer, employee, or agent thereof, that receives a
				request under subparagraph (A) may disclose information otherwise subject to
				any applicable nondisclosure requirement to—</text>
								<item id="id2690b089-9525-4c0a-b882-b75a9b608952"><enum>(aa)</enum><text>those persons to whom disclosure is
				necessary in order to comply with the request;</text>
								</item><item id="id7f63bd93-934d-4491-afbd-488738357285"><enum>(bb)</enum><text>an attorney in order to obtain legal
				advice or assistance regarding the request; or</text>
								</item><item id="ide4072c18-34f3-46b4-bbad-fb8045bd2225"><enum>(cc)</enum><text>other persons as permitted by the
				Director of the Federal Bureau of Investigation or the designee of the
				Director.</text>
								</item></subclause><subclause id="id5B514CB4A130451F96A7B331BDD795BA"><enum>(II)</enum><header>Persons necessary for
				compliance</header><text>Upon a request by the Director of the Federal Bureau
				of Investigation or the designee of the Director, those persons to whom
				disclosure will be made under subclause (I)(aa) or to whom such disclosure was
				made before the request shall be identified to the Director or the
				designee.</text>
							</subclause><subclause id="idb3f843dd-06f7-4ea5-90a5-9780c296edb6"><enum>(III)</enum><header>Nondisclosure
				requirement</header><text>A person to whom disclosure is made under subclause
				(I) shall be subject to the nondisclosure requirements applicable to a person
				to whom a request is issued under subparagraph (A) in the same manner as the
				person to whom the request is issued.</text>
							</subclause><subclause id="idd241e843-4b1b-4737-87a2-bfecbc3797d9"><enum>(IV)</enum><header>Notice</header><text>Any
				recipient that discloses to a person described in subclause (I) information
				otherwise subject to a nondisclosure requirement shall inform the person of the
				applicable nondisclosure requirement.</text>
							</subclause></clause><clause id="id4be5f6a5-8b41-44cd-8736-659c57d24884"><enum>(iii)</enum><header>Right to judicial review</header>
							<subclause id="idd9ef7fa9-9841-409b-b4c2-c48bd10e53df"><enum>(I)</enum><header>In general</header><text>A
				financial institution that receives a request under subparagraph (A) shall have
				the right to judicial review of any applicable nondisclosure
				requirement.</text>
							</subclause><subclause id="id3c7ed1fd-fed1-464d-bd43-c03c1884eec2"><enum>(II)</enum><header>Notification</header><text>A
				request under subparagraph (A) shall state that if the recipient wishes to have
				a court review a nondisclosure requirement, the recipient shall notify the
				Government.</text>
							</subclause><subclause id="idbb14a88b-58c3-4934-a7f9-365d4cb3b0ac"><enum>(III)</enum><header>Initiation of
				proceedings</header><text>If a recipient of a request under subparagraph (A)
				makes a notification under subclause (II), the Government shall initiate
				judicial review under the procedures established in <external-xref legal-doc="usc" parsable-cite="usc/18/3511">section 3511</external-xref> of title 18,
				United States Code, unless an appropriate official of the Federal Bureau of
				Investigation makes a notification under clause (iv).</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id675c467a-f5ed-4ee7-9216-9ed440657b29"><enum>(iv)</enum><header>Termination</header><text>In the
				case of any request for which a financial institution has submitted a
				notification under clause (iii)(II), if the facts supporting a nondisclosure
				requirement cease to exist, an appropriate official of the Federal Bureau of
				Investigation shall promptly notify the financial institution, or officer,
				employee, or agent thereof, subject to the nondisclosure requirement that the
				nondisclosure requirement is no longer in
				effect.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idd6d8ddfe-1d83-4435-a7da-797188863717"><enum>(e)</enum><header>Requests by
			 authorized investigative agencies</header><text>Section 802 of the National
			 Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3162">50 U.S.C. 3162</external-xref>), is amended by striking subsection (b)
			 and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id3829a85b-9433-475f-8098-c1965fdf4214" style="OLC">
					<subsection id="idd8dc6fb7-1ff8-48f1-9f6d-0e6bc1f5e209"><enum>(b)</enum><header>Prohibition
				of certain disclosure</header>
						<paragraph id="id68de3c7d-8044-4a78-abf5-f49eb954876d"><enum>(1)</enum><header>Prohibition</header>
							<subparagraph id="id5ad24b15-0ce3-403b-aa33-9bc04fdcdc0c"><enum>(A)</enum><header>In
				general</header><text>If a certification is issued under subparagraph (B) and
				notice of the right to judicial review under paragraph (3) is provided, no
				governmental or private entity, or officer, employee, or agent thereof, that
				receives a request under subsection (a), shall disclose to any person that an
				authorized investigative agency described in subsection (a) has sought or
				obtained access to information under subsection (a).</text>
							</subparagraph><subparagraph id="id41d4a949-30e2-4e99-99fe-09323dc25c2f"><enum>(B)</enum><header>Certification</header><text>The
				requirements of subparagraph (A) shall apply if the head of an authorized
				investigative agency described in subsection (a), or a designee, certifies
				that, absent a prohibition of disclosure under this subsection, there may
				result—</text>
								<clause id="ided81fdad-c7d1-4db3-aca8-bd5e98831d0b"><enum>(i)</enum><text>a danger to
				the national security of the United States;</text>
								</clause><clause id="idd6814c78-70f7-4c5d-87c0-faf34428ad1a"><enum>(ii)</enum><text>interference
				with a criminal, counterterrorism, or counterintelligence investigation;</text>
								</clause><clause id="id44e38075-010e-4fdd-bb76-f95716a19841"><enum>(iii)</enum><text>interference
				with diplomatic relations; or</text>
								</clause><clause id="idb3948a51-d2b5-4736-a5ad-de65f0b8ddb6"><enum>(iv)</enum><text>danger to
				the life or physical safety of any person.</text>
								</clause></subparagraph></paragraph><paragraph id="idf4099c72-95f9-4615-8141-4c4bc80651a7"><enum>(2)</enum><header>Exception</header>
							<subparagraph id="id000ddeca-ea98-491b-8398-49f657f5dffc"><enum>(A)</enum><header>In
				general</header><text>A governmental or private entity, or officer, employee,
				or agent thereof, that receives a request under subsection (a) may disclose
				information otherwise subject to any applicable nondisclosure requirement
				to—</text>
								<clause id="id829f2818-64d3-4134-addd-2987dcd7b656"><enum>(i)</enum><text>those persons
				to whom disclosure is necessary in order to comply with the request;</text>
								</clause><clause id="id3496a517-a6d5-4ef1-ac84-e14020b4cc0d"><enum>(ii)</enum><text>an attorney
				in order to obtain legal advice or assistance regarding the request; or</text>
								</clause><clause id="id67d4f050-85e9-4a46-a902-7ab4f0e511ba"><enum>(iii)</enum><text>other
				persons as permitted by the head of the authorized investigative agency
				described in subsection (a).</text>
								</clause></subparagraph><subparagraph id="idB35F862AD9CB4AB995F42F7B65CD2E90"><enum>(B)</enum><header>Persons
				necessary for compliance</header><text>Upon a request by the head of an
				authorized investigative agency described in subsection (a), or a designee,
				those persons to whom disclosure will be made under subparagraph (A)(i) or to
				whom such disclosure was made before the request shall be identified to the
				head of the authorized investigative agency or the designee.</text>
							</subparagraph><subparagraph id="ide837a1e6-f79c-4982-9deb-bb69830b172c"><enum>(C)</enum><header>Nondisclosure
				requirement</header><text>A person to whom disclosure is made under
				subparagraph (A) shall be subject to the nondisclosure requirements applicable
				to a person to whom a request is issued under subsection (a) in the same manner
				as the person to whom the request is issued.</text>
							</subparagraph><subparagraph id="idea223450-9500-4e8e-835e-327f575c29f9"><enum>(D)</enum><header>Notice</header><text>Any
				recipient that discloses to a person described in subparagraph (A) information
				otherwise subject to a nondisclosure requirement shall inform the person of the
				applicable nondisclosure requirement.</text>
							</subparagraph></paragraph><paragraph id="id58f33987-2caf-4ccd-a4c3-146a2984c3af"><enum>(3)</enum><header>Right to
				judicial review</header>
							<subparagraph id="iddebc1334-93e3-44f6-9d92-a7cf6c94bb15"><enum>(A)</enum><header>In
				general</header><text>A governmental or private entity that receives a request
				under subsection (a) shall have the right to judicial review of any applicable
				nondisclosure requirement.</text>
							</subparagraph><subparagraph id="id4466b422-fe67-4ca9-b34a-638f55ca4a2a"><enum>(B)</enum><header>Notification</header><text>A
				request under subsection (a) shall state that if the recipient wishes to have a
				court review a nondisclosure requirement, the recipient shall notify the
				Government.</text>
							</subparagraph><subparagraph id="idbc113ff3-660d-4b65-86f2-507566ac8b51"><enum>(C)</enum><header>Initiation
				of proceedings</header><text>If a recipient of a request under subsection (a)
				makes a notification under subparagraph (B), the Government shall initiate
				judicial review under the procedures established in <external-xref legal-doc="usc" parsable-cite="usc/18/3511">section 3511</external-xref> of title 18,
				United States Code, unless an appropriate official of the authorized
				investigative agency described in subsection (a) makes a notification under
				paragraph (4).</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0e1f92c3-150d-4c66-966f-a2599d19a577"><enum>(4)</enum><header>Termination</header><text>In
				the case of any request for which a governmental or private entity has
				submitted a notification under paragraph (3)(B), if the facts supporting a
				nondisclosure requirement cease to exist, an appropriate official of the
				authorized investigative agency described in subsection (a) shall promptly
				notify the governmental or private entity, or officer, employee, or agent
				thereof, subject to the nondisclosure requirement that the nondisclosure
				requirement is no longer in
				effect.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="idb2209697-b598-45bb-a481-d07cd9c99f3c"><enum>6.</enum><header>Judicial
			 review of FISA orders and national security letters</header>
			<subsection id="id41486335-a493-4786-a3c2-a18f9dc870f4"><enum>(a)</enum><header>FISA</header><text>Section
			 501(f)(2) of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C.
			 1861(f)(2)) is amended—</text>
				<paragraph id="id040c5368-a716-4368-bbf9-8256e65c49b9"><enum>(1)</enum><text>in
			 subparagraph (A)—</text>
					<subparagraph id="idc1edc359-bb1e-45d8-889b-d16f17c6f103"><enum>(A)</enum><text>in clause
			 (i)—</text>
						<clause id="id841ab411-290d-4bcb-83dc-7a1765d909e1"><enum>(i)</enum><text>by striking
			 <quote>a production order</quote> and inserting <quote>a production order or
			 nondisclosure order</quote>; and</text>
						</clause><clause id="id3a614005-9b10-47bf-9ee8-acf44547371e"><enum>(ii)</enum><text>by striking
			 <quote>Not less than 1 year</quote> and all that follows; and</text>
						</clause></subparagraph><subparagraph id="id8a5f6100-4b6b-46b8-a9a9-5e0291cb2e42"><enum>(B)</enum><text>in clause
			 (ii), by striking <quote>production order or nondisclosure</quote>; and</text>
					</subparagraph></paragraph><paragraph id="ida83020fa-2cf5-4952-8a89-93742488dd40"><enum>(2)</enum><text>in
			 subparagraph (C)—</text>
					<subparagraph id="idd12edba7-18cb-4b08-863e-00ea59a78bbf"><enum>(A)</enum><text>by striking
			 clause (ii); and</text>
					</subparagraph><subparagraph id="idbf0118cd-5e5f-41f6-804d-eebce43f2e12"><enum>(B)</enum><text>by
			 redesignating clause (iii) as clause (ii).</text>
					</subparagraph></paragraph></subsection><subsection id="id77f36baa-fc87-44e6-bf6d-66dd0a391ef0"><enum>(b)</enum><header>Judicial
			 review of national security letters</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/3511">Section 3511(b)</external-xref> of title 18,
			 United States Code, is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="id4607eb31-8a71-49a5-ba0e-c9490a484496" style="OLC">
					<subsection id="id711266b3-4ade-43aa-a7ca-25aec800455a"><enum>(b)</enum><header>Nondisclosure</header>
						<paragraph id="id9802164c-e608-4f29-a701-1f3324bdaffc"><enum>(1)</enum><header>In
				general</header>
							<subparagraph id="id3a005cee-ee01-4a3e-bca0-fdbc77a80fac"><enum>(A)</enum><header>Notice</header><text>If
				a recipient of a request or order for a report, records, or other information
				under section 2709 of this title, section 626 or 627 of the Fair Credit
				Reporting Act (15 U.S.C. 1681u and 1681v), section 1114 of the Right to
				Financial Privacy Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/12/3414">12 U.S.C. 3414</external-xref>), or section 802 of the National
				Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3162">50 U.S.C. 3162</external-xref>), wishes to have a court review a
				nondisclosure requirement imposed in connection with the request or order, the
				recipient shall notify the Government.</text>
							</subparagraph><subparagraph id="id86e76d57-5ca4-4015-bef3-c638c7ba06a0"><enum>(B)</enum><header>Application</header><text>Not
				later than 30 days after the date of receipt of a notification under
				subparagraph (A), the Government shall apply for an order prohibiting the
				disclosure of the existence or contents of the relevant request or order. An
				application under this subparagraph may be filed in the district court of the
				United States for the judicial district in which the recipient of the order is
				doing business or in the district court of the United States for any judicial
				district within which the authorized investigation that is the basis for the
				request or order is being conducted. The applicable nondisclosure requirement
				shall remain in effect during the pendency of proceedings relating to the
				requirement.</text>
							</subparagraph><subparagraph id="idf8b6c320-4c66-416d-ae2e-38b4374c9ad2"><enum>(C)</enum><header>Consideration</header><text>A
				district court of the United States that receives an application under
				subparagraph (B) should rule expeditiously, and shall, subject to paragraph
				(3), issue a nondisclosure order that includes conditions appropriate to the
				circumstances.</text>
							</subparagraph></paragraph><paragraph id="idc1dc1ef9-d5f9-4a64-ab18-a0bd1d868f68"><enum>(2)</enum><header>Application
				contents</header><text>An application for a nondisclosure order or extension
				thereof under this subsection shall include a certification from the Attorney
				General, Deputy Attorney General, an Assistant Attorney General, or the
				Director of the Federal Bureau of Investigation, or in the case of a request by
				a department, agency, or instrumentality of the Federal Government other than
				the Department of Justice, the head or deputy head of the department, agency,
				or instrumentality, containing a statement of specific facts indicating that,
				absent a prohibition of disclosure under this subsection, there may
				result—</text>
							<subparagraph id="id353e4c6d-51fe-405e-9209-f897b92b3f80"><enum>(A)</enum><text>a danger to
				the national security of the United States;</text>
							</subparagraph><subparagraph id="id83ee5744-0d16-4e5c-b9cb-dfa4cf72b881"><enum>(B)</enum><text>interference
				with a criminal, counterterrorism, or counterintelligence investigation;</text>
							</subparagraph><subparagraph id="id07308386-5c4b-4362-8a7b-138ac5aa62b0"><enum>(C)</enum><text>interference
				with diplomatic relations; or</text>
							</subparagraph><subparagraph id="idaeea9af8-fbdb-4802-a616-68de9ba194ab"><enum>(D)</enum><text>danger to the
				life or physical safety of any person.</text>
							</subparagraph></paragraph><paragraph id="id5eb66235-df47-4a8c-8c0e-9cd4ad6bf9ce"><enum>(3)</enum><header>Standard</header><text>A
				district court of the United States shall issue a nondisclosure requirement
				order or extension thereof under this subsection if the court determines,
				giving substantial weight to the certification under paragraph (2), that there
				is reason to believe that disclosure of the information subject to the
				nondisclosure requirement during the applicable time period will result
				in—</text>
							<subparagraph id="idb4ce2a7e-0e1b-47d5-8534-813ba8d5752c"><enum>(A)</enum><text>a danger to
				the national security of the United States;</text>
							</subparagraph><subparagraph id="id786c9753-6daa-4003-97b4-ed043dccf694"><enum>(B)</enum><text>interference
				with a criminal, counterterrorism, or counterintelligence investigation;</text>
							</subparagraph><subparagraph id="id58d70962-a881-4848-b747-9978f830226a"><enum>(C)</enum><text>interference
				with diplomatic relations; or</text>
							</subparagraph><subparagraph id="id3ed4463c-0d72-4303-b79b-0e8aca5612bc"><enum>(D)</enum><text>danger to the
				life or physical safety of any
				person.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idaa295c7e-9eb4-474e-b78e-d3224a3a4779"><enum>(c)</enum><header>Minimization</header><text>Section
			 501(g)(1) of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C.
			 1861(g)(1)) is amended by striking <quote>Not later than</quote> and all that
			 follows and inserting <quote>At or before the end of the period of time for the
			 production of tangible things under an order approved under this section or at
			 any time after the production of tangible things under an order approved under
			 this section, a judge may assess compliance with the minimization procedures by
			 reviewing the circumstances under which information concerning United States
			 persons was retained or disseminated.</quote>.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id18070bc6-eeea-4634-86e5-81e21e2419ab"><enum>7.</enum><header>Certification
			 for access to telephone toll and transactional records</header>
			<subsection commented="no" display-inline="no-display-inline" id="idd34feb58-462f-442f-898b-289560e415a1"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 2709 of title
			 18, United States Code, as amended by this Act, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idF18E4F7F9CB3498B910A85930270AF3A"><enum>(1)</enum><text>by striking
			 subsection (e);</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id28CFABE960BA412295D2484E2CA0CABE"><enum>(2)</enum><text>by redesignating
			 subsections (c) and (d) as subsections (d) and (e), respectively; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id79A951CACAC2461CBE6384971A6B6342"><enum>(3)</enum><text>by inserting
			 after subsection (b) the following:</text>

						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idbb074770-ac7a-432c-b5a2-d09e4e7507c0"><enum>(b)</enum><header>Identity of
			 financial institutions and credit reports</header><text>Section 626 of the Fair
			 Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681u">15 U.S.C. 1681u</external-xref>), as amended by this Act, is
			 amended—</text>
				<paragraph id="id5D9415BF1A1A48C4B9B656DD9DB5D280"><enum>(1)</enum><text>by striking
			 subsection (h);</text>
				</paragraph><paragraph id="id6A757FB7E45246CE9A206F6AD43559F8"><enum>(2)</enum><text>by redesignating
			 subsections (d), (e), (f), and (g) as subsections (e), (f), (g), and (h),
			 respectively; and</text>
				</paragraph><paragraph id="idA1844390D086480EB79B91A692128657"><enum>(3)</enum><text>by inserting
			 after subsection (c) the following:</text>

								</clause><clause id="id840C8569ED74426BA4CDEEA4D62DB392"><enum>(ii)</enum><text>with respect to
				the second report submitted under paragraph (2) or (3), and each report
				thereafter, the 6-month period ending on the last day of the second month
				before the date for submission of the report; and</text>
								</clause></subparagraph><subparagraph id="id2323EC75BDFA43B49343F45FD5D36B3A"><enum>(B)</enum><text>the term
				<term>United States person</term> has the meaning given that term in section
				101 of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C.

				(<external-xref legal-doc="usc" parsable-cite="usc/15/1681u">15 U.S.C. 1681u</external-xref>), section 627 of the Fair Credit Reporting Act (15 U.S.C.
				1681v), or section 802 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3162">50 U.S.C. 3162</external-xref>)
				during the applicable period.</text>
							</subparagraph><subparagraph id="id4595898EBB3F45EB8EFD762175F3634E"><enum>(B)</enum><header>Contents</header><text>Each
				report under subparagraph (A) shall include, for each provision of law
				described in subparagraph (A)—</text>
								<clause id="id5F8754DDAC4F417481535D044406FEFF"><enum>(i)</enum><text>the number of
				authorized requests under the provision, including requests for subscriber
				information; and</text>

				2010 and 2011</header><text>Not later than January 1, 2014, the Inspector
				General of each element of the intelligence community that conducts an
				assessment under this subsection shall submit to the Committee on the Judiciary
				and the Select Committee on Intelligence of the Senate and the Committee on the
				Judiciary and the Permanent Select Committee on Intelligence of the House of
				Representative a report containing the results of the assessment for calendar
				years 2010 and 2011.</text>

			 amended—</text>

			 (b)—</text>

				<term>intelligence community</term> has the meaning given that term in section
				3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>);</text>
							</paragraph><paragraph id="id9A2847DAABA74706A6FDC1396FF6852B"><enum>(2)</enum><text>the term
				<term>national security letter</term> means a request for information
				under—</text>
								<subparagraph id="IDac9add12cf994632886bbf1246b62749"><enum>(A)</enum><text>section 2709(a)
				of title 18, United States Code (to access certain communication service
				provider records);</text>
								</subparagraph><subparagraph id="ID2551105e72af4fd0a4346cb2bcc7ebe6"><enum>(B)</enum><text>section
				1114(a)(5)(A) of the Right to Financial Privacy Act of 1978 (12 U.S.C.
				3414(a)(5)(A)) (to obtain financial institution customer records);</text>
								</subparagraph><subparagraph id="ID5d618a3e271c4343be1d9d37f94d382d"><enum>(C)</enum><text>section 802 of
				the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3162">50 U.S.C. 3162</external-xref>) (to obtain financial
				information, records, and consumer reports);</text>
								</subparagraph><subparagraph id="ID608eb424584f49b5a39c83de91010dee"><enum>(D)</enum><text>section 626 of
				the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681u">15 U.S.C. 1681u</external-xref>) (to obtain certain financial
				information and consumer reports); or</text>
								</subparagraph><subparagraph id="IDe2bb97d12bfd4a87a47530a1f04fabd1"><enum>(E)</enum><text>section 627 of
				the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681v">15 U.S.C. 1681v</external-xref>) (to obtain credit agency
				consumer records for counterterrorism investigations); and</text>
								</subparagraph></paragraph><paragraph id="id760CBED6553D4AA6A8DA66C16B4FC9CA"><enum>(3)</enum><text>the term
				<term>United States person</term> has the meaning given that term in section
				101 of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C.
				1801).</text>
							</paragraph></subsection><after-quoted-block>;
				</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ID047103c21ab84d14b160bed8c1acf6b8"><enum>(4)</enum><text>by redesignating
			 subsections (d), (e), and (f) as subsections (e), (f), and (g),
			 respectively;</text>
				</paragraph><paragraph id="id682C0790F102408090064E56DA136FFE"><enum>(5)</enum><text>by inserting
			 after subsection (c) the following:</text>

				general</header><text>For the period beginning on January 1, 2010 and ending on
				December 31, 2013, the Inspector General of each element of the intelligence
				community outside of the Department of Justice that issued national security
				letters in the intelligence activities of the element of the intelligence
				community shall—</text>
								<subparagraph id="IDc522bf4d284747d58eb34b4a2f6c2cd7"><enum>(A)</enum><text>examine the use
				of national security letters by the element of the intelligence community
				during the period;</text>
								</subparagraph><subparagraph id="IDaccba17526ed448a91ae50bbf121b6ad"><enum>(B)</enum><text>describe any
				noteworthy facts or circumstances relating to the use of national security
				letters by the element of the intelligence community, including any improper or
				illegal use of such authority;</text>
								</subparagraph><subparagraph id="ID5a9f3e20d8f64cd0acdcff6dccaed601"><enum>(C)</enum><text>assess the
				importance of information received under the national security letters to the
				intelligence activities of the element of the intelligence community;
				and</text>
								</subparagraph><subparagraph id="ID764004f3d16e47218634ed40ce495e35"><enum>(D)</enum><text>examine the
				manner in which information received under the national security letters was
				collected, retained, analyzed, and disseminated.</text>
								</subparagraph></paragraph><paragraph id="IDbf8b9369ef1c43a195c70bdb29158b9f"><enum>(2)</enum><header>Submission
				dates for assessment</header>
								<subparagraph id="ID09496f34f8714ec7bfbe9bb118c5afe3"><enum>(A)</enum><header>Calendar years
				2010 and 2011</header><text>Not later than January 1, 2014, the Inspector
				General of each element of the intelligence community that conducts an

								</subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ID11794dd6439945e28562f82f2d7df26a"><enum>(6)</enum><text>in subsection

			 and trap and trace devices</header>
				<paragraph id="ID6c512c0350ea4a97b748bc8452b05d61"><enum>(1)</enum><header>Audits</header><text>The
			 Inspector General of the Department of Justice shall perform comprehensive
			 audits of the effectiveness and use, including any improper or illegal use, of
			 pen registers and trap and trace devices under title IV of the Foreign
			 Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1841">50 U.S.C. 1841 et seq.</external-xref>) during the
			 period beginning on January 1, 2010 and ending on December 31, 2013.</text>
				</paragraph><paragraph id="ID84399e60d2824c2c80dae19b269597eb"><enum>(2)</enum><header>Requirements</header><text>The
			 audits required under paragraph (1) shall include—</text>
					<subparagraph id="IDeba866d438124ac39d0cc40102fc6b78"><enum>(A)</enum><text>an examination of
			 the use of pen registers and trap and trace devices under title IV of the
			 Foreign Intelligence Surveillance Act of 1978 for calendar years 2010 through
			 2013;</text>
					</subparagraph><subparagraph id="IDd6d1e75ee8994bdb930b4ce1adeeed75"><enum>(B)</enum><text>an examination of
			 the installation and use of a pen register or trap and trace device on
			 emergency bases under section 403 of the Foreign Intelligence Surveillance Act
			 of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1843">50 U.S.C. 1843</external-xref>);</text>
					</subparagraph><subparagraph id="ID15b3341f23fc4a749f441068f19d9ebb"><enum>(C)</enum><text>any noteworthy
			 facts or circumstances relating to the use of a pen register or trap and trace
			 device under title IV of the Foreign Intelligence Surveillance Act of 1978,
			 including any improper or illegal use of the authority provided under that
			 title; and</text>
					</subparagraph><subparagraph id="ID1cd1ec1f4f8b49dd8e09f73ba2d40fec"><enum>(D)</enum><text>an examination of
			 the effectiveness of the authority under title IV of the Foreign Intelligence
			 Surveillance Act of 1978 as an investigative tool, including—</text>
						<clause id="IDf1a1a18f11ac47318c5b54c585b9aca4"><enum>(i)</enum><text>the
			 importance of the information acquired to the intelligence activities of the
			 Federal Bureau of Investigation;</text>
						</clause><clause id="ID973f8ad669a74b239e65f6ea6df29afc"><enum>(ii)</enum><text>the manner in
			 which the information is collected, retained, analyzed, and disseminated by the
			 Federal Bureau of Investigation, including any direct access to the information
			 provided to any other department, agency, or instrumentality of Federal, State,
			 local, or tribal governments or any private sector entity;</text>
						</clause><clause id="ID81b69c0370464bb9b12803b75b734ccf"><enum>(iii)</enum><text>with respect to
			 calendar years 2012 and 2013, an examination of the minimization procedures of
			 the Federal Bureau of Investigation used in relation to pen registers and trap
			 and trace devices under title IV of the Foreign Intelligence Surveillance Act
			 of 1978 and whether the minimization procedures adequately protect the
			 constitutional rights of United States persons;</text>
						</clause><clause id="ID31b0043a09d5497192a2da668b591196"><enum>(iv)</enum><text>whether, and how
			 often, the Federal Bureau of Investigation used information acquired under a
			 pen register or trap and trace device under title IV of the Foreign
			 Intelligence Surveillance Act of 1978 to produce an analytical intelligence
			 product for distribution within the Federal Bureau of Investigation, to the
			 intelligence community, or to another department, agency, or instrumentality of
			 Federal, State, local, or tribal governments; and</text>
						</clause><clause id="ID451803a697204e6eb0f17fb0bd700872"><enum>(v)</enum><text>whether, and how
			 often, the Federal Bureau of Investigation provided information acquired under
			 a pen register or trap and trace device under title IV of the Foreign
			 Intelligence Surveillance Act of 1978 to law enforcement authorities for use in
			 criminal proceedings.</text>
						</clause></subparagraph></paragraph><paragraph id="ID4e9da4d38e6a444f9710fb900b6eafb6"><enum>(3)</enum><header>Submission
			 dates</header>
					<subparagraph id="ID894d5531c6b448ec95f7a945b601ca18"><enum>(A)</enum><header>Calendar years
			 2010 and 2011</header><text>Not later than January 1, 2014, the Inspector
			 General of the Department of Justice shall submit to the Committee on the
			 Judiciary and the Select Committee on Intelligence of the Senate and the
			 Committee on the Judiciary and the Permanent Select Committee on Intelligence
			 of the House of Representatives a report containing the results of the audits
			 conducted under paragraph (1) for calendar years 2010 and 2011.</text>
					</subparagraph><subparagraph id="IDf9c81e53ccc0485fbad83bea47ae521d"><enum>(B)</enum><header>Calendar years
			 2012 and 2013</header><text>Not later than January 1, 2015, the Inspector
			 General of the Department of Justice shall submit to the Committee on the
			 Judiciary and the Select Committee on Intelligence of the Senate and the
			 Committee on the Judiciary and the Permanent Select Committee on Intelligence
			 of the House of Representatives a report containing the results of the audits
			 conducted under paragraph (1) for calendar years 2012 and 2013.</text>
					</subparagraph></paragraph><paragraph id="ID5825948f43354cd1a37992d55cb7860f"><enum>(4)</enum><header>Intelligence
			 assessment</header>
					<subparagraph id="IDa3ba34f897194cf883e70438317825c3"><enum>(A)</enum><header>In
			 general</header><text>For the period beginning January 1, 2010 and ending on
			 December 31, 2013, the Inspector General of any element of the intelligence
			 community outside of the Department of Justice that used information acquired
			 under a pen register or trap and trace device under title IV of the Foreign
			 Intelligence Surveillance Act of 1978 in the intelligence activities of the
			 element of the intelligence community shall—</text>
						<clause id="ID3a3c177db705440a9e30000ac364b339"><enum>(i)</enum><text>assess the
			 importance of the information to the intelligence activities of the element of
			 the intelligence community;</text>
						</clause><clause id="ID12885c6e3a3f4c749c24e5d90e021bef"><enum>(ii)</enum><text>examine the
			 manner in which the information was collected, retained, analyzed, and
			 disseminated;</text>
						</clause><clause id="IDec3b2420b3fb4bb5a43a48bd33dc6f3a"><enum>(iii)</enum><text>describe any
			 noteworthy facts or circumstances relating to orders under title IV of the
			 Foreign Intelligence Surveillance Act of 1978 as the orders relate to the
			 element of the intelligence community; and</text>
						</clause><clause id="ID235e19ab521b47b882146ed3453244bb"><enum>(iv)</enum><text>examine any
			 minimization procedures used by the element of the intelligence community in
			 relation to pen registers and trap and trace devices under title IV of the
			 Foreign Intelligence Surveillance Act of 1978 and whether the minimization
			 procedures adequately protect the constitutional rights of United States
			 persons.</text>
						</clause></subparagraph><subparagraph id="ID18e581afbed84f0083faff7f0117dd81"><enum>(B)</enum><header>Submission
			 dates for assessment</header>
						<clause id="ID121c92445d6344b1ab8de31b8f07ea9b"><enum>(i)</enum><header>Calendar years
			 2010 and 2011</header><text>Not later than January 1, 2014, the Inspector
			 General of each element of the intelligence community that conducts an
			 assessment under this paragraph shall submit to the Committee on the Judiciary
			 and the Select Committee on Intelligence of the Senate and the Committee on the
			 Judiciary and the Permanent Select Committee on Intelligence of the House of
			 Representative a report containing the results of the assessment for calendar
			 years 2010 and 2011.</text>
						</clause><clause id="IDf18a5411bbda412e8eb93dafbf9fc52d"><enum>(ii)</enum><header>Calendar years
			 2012 and 2013</header><text>Not later than January 1, 2015, the Inspector
			 General of each element of the intelligence community that conducts an
			 assessment under this paragraph shall submit to the Committee on the Judiciary
			 and the Select Committee on Intelligence of the Senate and the Committee on the
			 Judiciary and the Permanent Select Committee on Intelligence of the House of
			 Representative a report containing the results of the assessment for calendar
			 years 2012 and 2013.</text>
						</clause></subparagraph></paragraph><paragraph id="IDb3b1d00cd1954c03afea171b46126389"><enum>(5)</enum><header>Prior notice to
			 attorney general and director of national intelligence; comments</header>
					<subparagraph id="ID9f745f9aa9ea46d3a833721501c8d763"><enum>(A)</enum><header>Notice</header><text>Not
			 later than 30 days before the submission of any report under paragraph (3) or
			 (4), the Inspector General of the Department of Justice and any Inspector
			 General of an element of the intelligence community that submits a report under
			 this subsection shall provide the report to the Attorney General and the
			 Director of National Intelligence.</text>
					</subparagraph><subparagraph id="ID355801affabc42a3a63954ba53b74e8f"><enum>(B)</enum><header>Comments</header><text>The
			 Attorney General or the Director of National Intelligence may provide such
			 comments to be included in any report submitted under paragraph (3) or (4) as
			 the Attorney General or the Director of National Intelligence may consider
			 necessary.</text>
					</subparagraph></paragraph><paragraph id="ID28fc91b5fc9a432ca6b6f9339e808734"><enum>(6)</enum><header>Unclassified
			 form</header><text>Each report submitted under paragraph (3) and any comments
			 included in that report under paragraph (5)(B) shall be in unclassified form,
			 but may include a classified annex.</text>

			 this section—</text>
				<paragraph id="id2BEBD7A5F9F64075B43E9ACFCF8B0ABF"><enum>(1)</enum><text>the terms
			 <term>Attorney General</term>, <term>foreign intelligence information</term>,
			 and <term>United States person</term> have the meanings given those terms in
			 section 101 of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C.
			 1801);</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0177B290E704426994A95B35EB1E8C99"><enum>(2)</enum><text>the term
			 <term>intelligence community</term> has the meaning given that term in section
			 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>);</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD3368B5D637F4F699ECC24FD7E78B673"><enum>(3)</enum><text>the term
			 <term>minimization procedures</term> has the meaning given that term in section
			 401 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1841">50 U.S.C. 1841</external-xref>), as
			 amended by this Act; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7EB75E9BB2CA40C989F69FD19FCA7301"><enum>(4)</enum><text>the terms
			 <term>pen register</term> and <term>trap and trace device</term> have the
			 meanings given those terms in <external-xref legal-doc="usc" parsable-cite="usc/18/3127">section 3127</external-xref> of title 18, United States
			 Code.</text>
				</paragraph></subsection></section><section id="idB0D7A25BF2C54C49B6503C0BD1FE498C"><enum>11.</enum><header>Delayed notice
			 search warrants</header><text display-inline="no-display-inline">Section
			 3103a(b)(3) of title 18, United States Code, is amended by striking <quote>30
			 days</quote> and inserting <quote>7 days</quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id436E5AE619094E9A937EF3118E06AF66"><enum>12.</enum><header>Inspector
			 General reviews</header>
			<subsection commented="no" display-inline="no-display-inline" id="id420651E5E527477E91E7720D5FBEB15F"><enum>(a)</enum><header>Agency
			 assessments</header><text>Section 702(l)(2) of the Foreign Intelligence
			 Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1881a">50 U.S.C. 1881a(l)(2)</external-xref>) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id0053ADF1DDA44EBB833EA7339CBD902F"><enum>(1)</enum><text>in the matter
			 preceding subparagraph (A), by striking <quote>authorized to acquire foreign
			 intelligence information under subsection (a)</quote> and inserting <quote>with
			 targeting or minimization procedures approved under this
			 section</quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC5F18E15A34A4996AA6DA2B6F667A907"><enum>(2)</enum><text>in subparagraph

			 General of the Intelligence Community review</header><text>Section 702(l) of
			 the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1881a">50 U.S.C. 1881a(l)</external-xref>) is
			 amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idE6E7F5B518CE439596BDFDE1C8001BCB"><enum>(1)</enum><text>by redesignating
			 paragraph (3) as paragraph (4); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id57ACF4CB40B9478E80E5630B0A3567B3"><enum>(2)</enum><text>by inserting
			 after paragraph (2) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id899BBF01DD9747B3919424A6DAB57B68" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="IDD8492E5389AB4BADAA05302B0853D4E6"><enum>(3)</enum><header display-inline="yes-display-inline">Inspector General of the Intelligence
				Community review</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="id806A9438164F4B6D98088153DD4B6521"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Inspector General of the Intelligence
				Community is authorized to review the acquisition, use, and dissemination of
				information acquired under subsection (a) in order to review compliance with
				the targeting and minimization procedures adopted in accordance with
				subsections (d) and (e) and the guidelines adopted in accordance with
				subsection (f), and in order to conduct the review required under subparagraph
				(B).</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1D02BB821A7C4C77BC5F0BD7668F7FAD"><enum>(B)</enum><header>Mandatory
				review</header><text display-inline="yes-display-inline">The Inspector General
				of the Intelligence Community shall review the procedures and guidelines
				developed by the intelligence community to implement this section, with respect
				to the protection of the privacy rights of United States persons,
				including—</text>
								<clause commented="no" display-inline="no-display-inline" id="idF772B65F16D745188089DF28E588760F"><enum>(i)</enum><text>an evaluation of
				the limitations outlined in subsection (b), the procedures approved in
				accordance with subsections (d) and (e), and the guidelines adopted in
				accordance with subsection (f), with respect to the protection of the privacy
				rights of United States persons; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id851F32201A154546A98020302AC79C49"><enum>(ii)</enum><text>an evaluation of
				the circumstances under which the contents of communications acquired under
				subsection (a) may be searched in order to review the communications of
				particular United States persons.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE1588DA03BAF4347AB376A8A1053F823"><enum>(C)</enum><header>Consideration
				of other reviews and assessments</header><text>In conducting a review under
				subparagraph (B), the Inspector General of the Intelligence Community should
				take into consideration, to the extent relevant and appropriate, any reviews or
				assessments that have been completed or are being undertaken under this
				section.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID70524455066149CB8DDFCF86E6609AAF"><enum>(D)</enum><header>Report</header><text>Not
				later than December 31, 2014, the Inspector General of the Intelligence
				Community shall submit a report regarding the reviews conducted under this
				paragraph to—</text>
								<clause id="IDE4E4B4FA65F44A3BAF25DEB5CBEF4506"><enum>(i)</enum><text>the Attorney
				General;</text>
								</clause><clause id="ID99FBA4AF54D64FB49A5A41B6CCA91859"><enum>(ii)</enum><text>the Director of
				National Intelligence; and</text>
								</clause><clause id="ID7E3D0A93B8FC4BFDB1A4A4B88FC0201C"><enum>(iii)</enum><text>consistent with
				the Rules of the House of Representatives, the Standing Rules of the Senate,
				and Senate Resolution 400 of the 94th Congress or any successor Senate
				resolution—</text>
									<subclause id="ID4BDA20F2E2054092AE151FFAFA6666FC"><enum>(I)</enum><text>the congressional
				intelligence committees; and</text>
									</subclause><subclause id="IDA0D2AEF1A421432BAC63F6024E9D380A"><enum>(II)</enum><text>the Committee on
				the Judiciary of the Senate and the Committee on the Judiciary of the House of
				Representatives.</text>
									</subclause></clause></subparagraph><subparagraph id="idcfa3ae7e4c0e41ebb5f5f7f6b9e9d0b8"><enum>(E)</enum><header>Public
				reporting of findings and conclusions</header><text>In a manner consistent with
				the protection of the national security of the United States, and in
				unclassified form, the Inspector General of the Intelligence Community shall
				make publicly available a summary of the findings and conclusions of the review
				conducted under subparagraph
				(B).</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idc84379aeb178452d8184b92b1e00bc16"><enum>(c)</enum><header>Annual
			 reviews</header><text display-inline="yes-display-inline">Section 702(l)(4)(A)
			 of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C.
			 1881a(l)(4)(A)), as redesignated by subsection (b)(1), is amended—</text>
				<paragraph id="id1843601C8DF24FCDA1395B92DF2C7DC0"><enum>(1)</enum><text display-inline="yes-display-inline">in the matter preceding clause (i)—</text>
					<subparagraph id="id20078C8CC5E44F458F779A931274138C"><enum>(A)</enum><text display-inline="yes-display-inline">in the first sentence—</text>
						<clause id="idDC7BD6401FDF4C1E8EC1AF9761026213"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>conducting an
			 acquisition authorized under subsection (a)</quote> and inserting <quote>with
			 targeting or minimization procedures approved under this section</quote>;
			 and</text>
						</clause><clause id="id111B178D676C41429FB5DD9A6D049E2C"><enum>(ii)</enum><text>by
			 striking <quote>the acquisition</quote> and inserting <quote>acquisitions under
			 subsection (a)</quote>; and</text>
						</clause></subparagraph><subparagraph id="id3A9199EA506B4775B039CAEA4E1AD7AD"><enum>(B)</enum><text>in the second
			 sentence, by striking <quote>The annual review</quote> and inserting <quote>As
			 applicable, the annual review</quote>; and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id712821041c5047729bc7cc22977a9dd5"><enum>(2)</enum><text>in clause (iii),
			 by inserting <quote>United States persons or</quote> after <quote>later
			 determined to be</quote>.</text>
				</paragraph></subsection></section><section id="id87F686D9EC6842D6BDA2B528D688DBA8"><enum>13.</enum><header>Electronic
			 surveillance</header><text display-inline="no-display-inline">Section
			 105(c)(1)(A) of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C.
			 1805(c)(1)(A)) is amended by inserting <quote>with particularity</quote> after
			 <quote>description</quote>.</text>
		</section><section id="id1632A64D7B4245F9A41A5D87A645FB6E"><enum>14.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act or an amendment
			 made by this Act, or the application of the provision to any person or
			 circumstance, is held to be unconstitutional, the remainder of this Act and the
			 amendments made by this Act, and the application of the provisions of this Act
			 and the amendments made by this Act to any other person or circumstance, shall
			 not be affected thereby.</text>
		</section><section id="id75EE6004157B4DD0BE8B4066F5A1A103"><enum>15.</enum><header>Offset</header><text display-inline="no-display-inline">Of the unobligated balances available in the
			 Department of Justice Assets Forfeiture Fund established under section
			 524(c)(1) of title 28, United States Code, $5,000,000 are permanently rescinded
			 and shall be returned to the general fund of the Treasury.</text>
		</section><section id="idA5BFCCDAC76B41DC90AD83CA2AD0BA7C"><enum>16.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendments made by
			 sections 3, 4, 5, 6, 7, and 11 shall take effect on the date that is 120 days
			 after the date of enactment of this Act.</text>
