		  resiliency, increase industrial competitiveness, and promote local economic
		  development by helping public and private entities to assess and implement
		  energy systems that recover and use waste heat and local renewable energy
		  resources.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Local Energy Supply and Resiliency
			 Act of 2013</short-title></quote>.</text>
		</section><section id="id30d52e461b6642e193c88123eb4e9a34"><enum>2.</enum><header>Findings and
			 purposes</header>
			<subsection id="id0C238F4C823E4379ABF3A956427DF331"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds that—</text>
				<paragraph id="id7df393ef5ab64ad4978c1d1af554709c"><enum>(1)</enum><text>a quantity of
			 energy that is more than—</text>
					<subparagraph id="idA7215D29303E439BBC573D850F95F206"><enum>(A)</enum><text>27 percent of the
			 total energy consumption in the United States is released from power plants in
			 the form of waste heat; and</text>
					</subparagraph><subparagraph id="id7C04E5A462BB4353ADCDF7CA96D1BB5D"><enum>(B)</enum><text>36 percent of the
			 total energy consumption in the United States is released from power plants,
			 industrial facilities, and other buildings in the form of waste heat;</text>
					</subparagraph></paragraph><paragraph id="id53fe49de6def45c2b3724d98e1f2f430"><enum>(2)</enum><text>waste heat can
			 be—</text>
					<subparagraph id="idC0FCD7D15F0F4875B118C74F4F1AC453"><enum>(A)</enum><text>recovered and
			 distributed to meet building heating or industrial process heating
			 requirements;</text>
					</subparagraph><subparagraph id="id51AB630E9F15411FB430DB6EA470F61D"><enum>(B)</enum><text>converted to
			 chilled water for air conditioning or industrial process cooling; or</text>
					</subparagraph><subparagraph id="idE336808F623F48F29106FFA9AB2DD905"><enum>(C)</enum><text>converted to
			 electricity;</text>
					</subparagraph></paragraph><paragraph id="id1dc07fd6675f48de9227528a9314ba62"><enum>(3)</enum><text>renewable energy
			 resources in communities in the United States can be used to meet local thermal
			 and electric energy requirements;</text>
				</paragraph><paragraph id="idfa298b1622d949e1a12d2eef1e0f6df1"><enum>(4)</enum><text>use of local
			 energy resources and implementation of local energy infrastructure can
			 strengthen the reliability and resiliency of energy supplies in the United
			 States in response to extreme weather events, power grid failures, or
			 interruptions in the supply of fossil fuels;</text>
				</paragraph><paragraph id="id68cfd693fc1141a9a5e30b99110ff311"><enum>(5)</enum><text>use of local
			 waste heat and renewable energy resources—</text>
					<subparagraph id="id284c63d9bcd54bb4b1b915def9c51a8f"><enum>(A)</enum><text>strengthens
			 United States industrial competitiveness;</text>
					</subparagraph><subparagraph id="idC86006B248E24DDEA2C36712F3400C2D"><enum>(B)</enum><text>helps reduce
			 reliance on fossil fuels and the associated emissions of air pollution and
			 carbon dioxide;</text>
					</subparagraph><subparagraph id="id668F9CDB7EE24392B6575C164354805E"><enum>(C)</enum><text>increases energy
			 supply resiliency and security; and</text>
					</subparagraph><subparagraph id="idDDD39D70C18B469B927EE406BE9D51F6"><enum>(D)</enum><text>keeps more energy
			 dollars in local economies, thereby creating jobs;</text>
					</subparagraph></paragraph><paragraph id="idcf6fe339abd641348fcda2447c7adf83"><enum>(6)</enum><text>district energy
			 systems represent a key opportunity to tap waste heat and renewable energy
			 resources;</text>
				</paragraph><paragraph id="idcd5128d00d9541aca1216b69e071e123"><enum>(7)</enum><text>district energy
			 systems are important for expanding implementation of combined heat and power
			 (CHP) systems because district energy systems provide infrastructure for
			 delivering thermal energy from a CHP system to a substantial base of end
			 users;</text>
				</paragraph><paragraph id="idd8ce570c75c54ac3acd1b72bd78097e2"><enum>(8)</enum><text>district energy
			 systems serve colleges, universities, hospitals, airports, military bases, and
			 downtown areas;</text>
				</paragraph><paragraph id="id29320ad5a5b44ddcae6ddc2c61ba8e2e"><enum>(9)</enum><text>district energy
			 systems help cut peak power demand and reduce power transmission and
			 distribution system constraints by—</text>
					<subparagraph id="id35f52ac502c945df9e6b3a916620b05a"><enum>(A)</enum><text>shifting power
			 demand through thermal storage;</text>
					</subparagraph><subparagraph id="idfe9c46f17cb849909f0eafe86d4d8bc3"><enum>(B)</enum><text>generating power
			 near load centers with a CHP system; and</text>
					</subparagraph><subparagraph id="id134b31a9cbb64e2385f41cb6e16bbd27"><enum>(C)</enum><text>meeting air
			 conditioning demand through the delivery of chilled water produced with heat
			 generated by a CHP system or other energy sources;</text>
					</subparagraph></paragraph><paragraph id="ideb743f37404f459791dd2e06a4b3deba"><enum>(10)</enum><text>evaluation and
			 implementation of district energy systems—</text>
					<subparagraph id="id76ac50bbde264418b1a3a540664a2ec6"><enum>(A)</enum><text>is a complex
			 undertaking involving a variety of technical, economic, legal, and
			 institutional issues and barriers; and</text>
					</subparagraph><subparagraph id="id5b43dc96e7994d429310d7945b6f2629"><enum>(B)</enum><text>often requires
			 technical assistance to successfully navigate these barriers; and</text>
					</subparagraph></paragraph><paragraph id="idb1b926c3ae354c12a9ec4f3fb7142b4e"><enum>(11)</enum><text>a major
			 constraint to the use of local waste heat and renewable energy resources is a
			 lack of low-interest, long-term capital funding for implementation.</text>
				</paragraph></subsection><subsection id="id7c0a3d1b98b14fbe8676718cb646e546"><enum>(b)</enum><header>Purposes</header><text>The
			 purposes of this Act are—</text>
				<paragraph id="id69d9196a2d5a444196b942a2a22dd2f7"><enum>(1)</enum><text>to encourage the
			 use and distribution of waste heat and renewable thermal energy—</text>
					<subparagraph id="id4c4f70884f734d1dbeb5e750e44e2ae6"><enum>(A)</enum><text>to reduce fossil
			 fuel consumption;</text>
					</subparagraph><subparagraph id="id4ecbb05dfbb245178b5584cc60709d19"><enum>(B)</enum><text>to enhance energy
			 supply resiliency, reliability, and security;</text>
					</subparagraph><subparagraph id="id1cd49875ce0a4bc9996cc8372bd544b0"><enum>(C)</enum><text>to reduce air
			 pollution and greenhouse gas emissions;</text>
					</subparagraph><subparagraph id="id721467357dfb477d82762429c0385754"><enum>(D)</enum><text>to strengthen
			 industrial competitiveness; and</text>
					</subparagraph><subparagraph id="id52c8fb1abf3e42998be8f6fc43041e7f"><enum>(E)</enum><text>to retain more
			 energy dollars in local economies; and</text>
					</subparagraph></paragraph><paragraph id="idcbf1d55fb59e48bb894fff2f2f25f237"><enum>(2)</enum><text>to facilitate the
			 implementation of a local energy infrastructure that accomplishes the goals
			 described in paragraph (1) by—</text>
					<subparagraph id="ide3abcf193ae44f0e9840da8c32d2788a"><enum>(A)</enum><text>providing
			 technical assistance to evaluate, design, and develop projects to build local
			 energy infrastructure; and</text>
					</subparagraph><subparagraph id="id29cd6d3c46584541a2bc653a898ee401"><enum>(B)</enum><text>facilitating
			 low-cost financing for the construction of local energy infrastructure through
			 the issuance of loan guarantees.</text>
					</subparagraph></paragraph></subsection></section><section id="idA6C6AC27BD184394843D7622BFC2ADFB"><enum>3.</enum><header>Definitions</header>
			<paragraph id="ida3efbf9d4bfc4cdca5a900d4bd68d268"><enum>(1)</enum><header>Combined heat
			 and power system</header><text>The term <term>combined heat and power
			 system</term> or <term>CHP system</term> means generation of electric energy
			 and heat in a single, integrated system that meets the efficiency criteria in
			 clauses (ii) and (iii) of section 48(c)(3)(A) of the Internal Revenue Code of
			 1986, under which heat that is conventionally rejected is recovered and used to
			 meet thermal energy requirements.</text>
			</paragraph><paragraph id="id260a4e2f0d364fe1b8fbc977f629beb2"><enum>(2)</enum><header>District energy
			 system</header><text>The term <term>district energy system</term> means a
			 system that provides thermal energy to buildings and other energy consumers
			 from 1 or more plants to individual buildings to provide space heating, air
			 conditioning, domestic hot water, industrial process energy, and other end
			 uses.</text>
			</paragraph><paragraph id="idF608E5CE7B714806A36203A9C77730E6"><enum>(3)</enum><header>Loan guarantee
			 program</header><text>The term <term>Loan Guarantee Program</term> means the
			 Local Energy Infrastructure Loan Guarantee Program established under section
			 5.</text>
			</paragraph><paragraph id="idcfe95a9557ba4fce9b82209152737a13"><enum>(4)</enum><header>Local energy
			 infrastructure</header><text>The term <term>local energy infrastructure</term>
			 means a system that—</text>
				<subparagraph id="id69D9B71D584A41C59F0944719A1C4343"><enum>(A)</enum><text>recovers or
			 produces useful thermal or electric energy from waste energy or renewable
			 energy resources;</text>
				</subparagraph><subparagraph id="id8F548E34DCE74E84B940D90782FF3631"><enum>(B)</enum><text>generates
			 electricity using a combined heat and power system;</text>
				</subparagraph><subparagraph id="id463E91F2E97A42938AE12775C357397F"><enum>(C)</enum><text>distributes
			 electricity in microgrids;</text>
				</subparagraph><subparagraph id="id14b01bdf783c432d843646764546b96b"><enum>(D)</enum><text>stores thermal
			 energy; or</text>
				</subparagraph><subparagraph id="id93280E10C063416199708F879FFC55CA"><enum>(E)</enum><text>distributes
			 thermal energy or transfers thermal energy to building heating and cooling
			 systems via a district energy system.</text>
				</subparagraph></paragraph><paragraph id="id59d94f5b99104e00a85d6661d472565d"><enum>(5)</enum><header>Microgrid</header><text>The
			 term <term>microgrid</term> means a group of interconnected loads and
			 distributed energy resources within clearly defined electrical boundaries
			 that—</text>
				<subparagraph id="id0E7136E1222D4787A2B52E8082E03CC4"><enum>(A)</enum><text>acts as a single
			 controllable entity with respect to the grid; and</text>
				</subparagraph><subparagraph id="idFF9B28A60D384D0793673FF4E43BA88D"><enum>(B)</enum><text>can connect and
			 disconnect from the grid to enable the microgrid to operate in both
			 grid-connected or island-mode.</text>
				</subparagraph></paragraph><paragraph id="id2f10320dec084d59b8cf9a9c60204ce6"><enum>(6)</enum><header>Renewable
			 energy resource</header><text>The term <term>renewable energy resource</term>
			 means—</text>
				<subparagraph id="id082a33c6a1a8499996efd91c881dc8dc"><enum>(A)</enum><text>closed-loop and
			 open-loop biomass (as defined in paragraphs (2) and (3), respectively, of
			 <external-xref legal-doc="usc" parsable-cite="usc/26/45">section 45(c)</external-xref> of the Internal Revenue Code of 1986);</text>
				</subparagraph><subparagraph id="ida0d1eb3b006c47089a37d26fb37bf5ba"><enum>(B)</enum><text>gaseous or liquid
			 fuels produced from the materials described in subparagraph (A);</text>
				</subparagraph><subparagraph id="iddc313f99ae204450adac6767d0c7581a"><enum>(C)</enum><text>geothermal energy
			 (as defined in section 45(c)(4) of such Code);</text>
				</subparagraph><subparagraph id="id16e3740f911c41709f7387f41901fcff"><enum>(D)</enum><text>municipal solid
			 waste (as defined in section 45(c)(6) of such Code); or</text>
				</subparagraph><subparagraph id="idc1557307480b4834b14aa08d50278e49"><enum>(E)</enum><text>solar energy
			 (which is used, undefined, in section 45 of such Code).</text>
				</subparagraph></paragraph><paragraph id="id9940429ca62449e2af6e2ba59798b4ca"><enum>(7)</enum><header>Renewable
			 thermal energy</header><text>The term <term>renewable thermal energy</term>
			 means—</text>
				<subparagraph id="idebb46290be274bedb202181f6fdecc2d"><enum>(A)</enum><text>heating or
			 cooling energy derived from a renewable energy resource;</text>
				</subparagraph><subparagraph id="idcae6857570154e43a39ccc8afcb36e83"><enum>(B)</enum><text>natural sources
			 of cooling such as cold lake or ocean water; or</text>
				</subparagraph><subparagraph id="idbe860590329d4e30ad75bef046d1efbd"><enum>(C)</enum><text>other renewable
			 thermal energy sources, as determined by the Secretary.</text>
				</subparagraph></paragraph><paragraph id="id4C752E104743473F9B2E19DE095E4A5C"><enum>(8)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Energy.</text>
			</paragraph><paragraph id="id9b27848b85a6480db6eb2bb798551593"><enum>(9)</enum><header>Thermal
			 energy</header><text>The term <term>thermal energy</term> means—</text>
				<subparagraph id="idb147b9f716844417acce13d7c9599c5b"><enum>(A)</enum><text>heating energy in
			 the form of hot water or steam that is used to provide space heating, domestic
			 hot water, or process heat; or</text>
				</subparagraph><subparagraph id="idfcdd4d18fef943558fd6a4c6da348798"><enum>(B)</enum><text>cooling energy in
			 the form of chilled water, ice or other media that is used to provide air
			 conditioning, or process cooling.</text>
				</subparagraph></paragraph><paragraph id="id6ebe73057bbf4e29a0c8ba3072dd04df"><enum>(10)</enum><header>Waste
			 energy</header><text>The term <term>waste energy</term> means energy
			 that—</text>
				<subparagraph id="id17CB01DE4D0349F3B32951FE6AFD838F"><enum>(A)</enum><text>is contained
			 in—</text>
					<clause id="id7f7081319f1844a4be6048103b69bda4"><enum>(i)</enum><text>exhaust gases,
			 exhaust steam, condenser water, jacket cooling heat, or lubricating oil in
			 power generation systems;</text>
					</clause><clause id="id800004eee61f46bba5d762ad55c07118"><enum>(ii)</enum><text>exhaust heat,
			 hot liquids, or flared gas from any industrial process;</text>
					</clause><clause id="id4b2fae03ffbe4650afe1721870832f7e"><enum>(iii)</enum><text>waste gas or
			 industrial tail gas that would otherwise be flared, incinerated, or
			 vented;</text>
					</clause><clause id="id5185926c8148466593a604f5113461fc"><enum>(iv)</enum><text>a
			 pressure drop in any gas, excluding any pressure drop to a condenser that
			 subsequently vents the resulting heat;</text>
					</clause><clause id="id1151a3005851444498bef411fa9b6afe"><enum>(v)</enum><text>condenser water
			 from chilled water or refrigeration plants; or</text>
					</clause><clause id="id31c820f00d3d430eb5257a560febd4df"><enum>(vi)</enum><text>any other form
			 of waste energy, as determined by the Secretary; and</text>
					</clause></subparagraph><subparagraph id="idB38C2A1A00E84839AB9EC0A8473D430A"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id64750FF7A9914AA58C09759855222B38"><enum>(i)</enum><text>in the case of an
			 existing facility, is not being used; or</text>
					</clause><clause id="idB0523EB124DC4D12BB8F49F649B12AFC" indent="up1"><enum>(ii)</enum><text>in the case of a new facility, is
			 not conventionally used in comparable systems.</text>
					</clause></subparagraph></paragraph></section><section id="idd48295ce42ce4bb2b43457f21ff00448"><enum>4.</enum><header>Technical
			 assistance program</header>
			<subsection id="idAB27C9758BFE4881A1DD3D5ED0BCCE39"><enum>(a)</enum><header>Establishment</header>
				<paragraph id="id1dc3ef3321ad4101935a16300f074a1f"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall establish a program to disseminate
			 information and provide technical assistance, directly or through grants
			 provided so that recipients may contract to obtain technical assistance, to
			 assist eligible entities in identifying, evaluating, planning, and designing
			 local energy infrastructure.</text>
				</paragraph><paragraph id="id39be9d6a3e1343f3a4808e69c7f88848"><enum>(2)</enum><header>Technical
			 assistance</header><text>The technical assistance under paragraph (1) shall
			 include assistance with 1 or more of the following:</text>
					<subparagraph id="id5bba07d3c0834ed2b4120775a1e8d38a"><enum>(A)</enum><text>Identification of
			 opportunities to use waste energy or renewable energy resources.</text>
					</subparagraph><subparagraph id="id7403b1e42f9f497eb394f6f07dbe8e94"><enum>(B)</enum><text>Assessment of
			 technical and economic characteristics.</text>
					</subparagraph><subparagraph id="idff83e8182cd94e27a99e609f7571ef2e"><enum>(C)</enum><text>Utility
			 interconnection.</text>
					</subparagraph><subparagraph id="idad2732c3342b4129b8312ea8e39ef0b8"><enum>(D)</enum><text>Negotiation of
			 power and fuel contracts.</text>
					</subparagraph><subparagraph id="id700ba7100f324245a0da9267c2a2bab3"><enum>(E)</enum><text>Permitting and
			 siting issues.</text>
					</subparagraph><subparagraph id="idd1c0ef71b84947eba306ed4420702597"><enum>(F)</enum><text>Marketing and
			 contract negotiations.</text>
					</subparagraph><subparagraph id="id129d0fd972aa4e16b89063c342d68c4a"><enum>(G)</enum><text>Business planning
			 and financial analysis.</text>
					</subparagraph><subparagraph id="id97c624b6741c4e8587567cebb832b23e"><enum>(H)</enum><text>Engineering
			 design.</text>
					</subparagraph></paragraph><paragraph id="idd6f90eb2525f4e72ae2cde2e9293a6d1"><enum>(3)</enum><header>Information
			 dissemination</header><text>The information dissemination under paragraph (1)
			 shall include—</text>
					<subparagraph id="id6906e6d31cf3460a8347169ffc572986"><enum>(A)</enum><text>information
			 relating to the topics identified in paragraph (2), including case studies of
			 successful examples; and</text>
					</subparagraph><subparagraph id="idfe5fd9ef05864838a39324c76f7ef5c6"><enum>(B)</enum><text>computer software
			 for assessment, design, and operation and maintenance of local energy
			 infrastructure.</text>
					</subparagraph></paragraph></subsection><subsection id="id9f87976dadda4e16b98036569c3496f2"><enum>(b)</enum><header>Eligible
			 entity</header><text>Any nonprofit or for-profit entity shall be eligible to
			 receive assistance under the program established under subsection (a).</text>
			</subsection><subsection id="idf149e76e15ea474aa83d3b417976998b"><enum>(c)</enum><header>Eligible
			 costs</header><text>On application by an eligible entity, the Secretary may
			 award grants to an eligible entity to provide funds to cover not more
			 than—</text>
				<paragraph id="id04fc4540b2f740c7aa5ac49745853038"><enum>(1)</enum><text>100 percent of
			 the cost of initial assessment to identify local energy opportunities;</text>
				</paragraph><paragraph id="id13c30fbbb8684ca08da08a12a733f1b1"><enum>(2)</enum><text>75 percent of the
			 cost of feasibility studies to assess the potential for the implementation of
			 local energy infrastructure;</text>
				</paragraph><paragraph id="id66670c65bd4544c591aea9c5cd4ad18f"><enum>(3)</enum><text>60 percent of the
			 cost of guidance on overcoming barriers to the implementation of local energy
			 infrastructure, including financial, contracting, siting, and permitting
			 issues; and</text>
				</paragraph><paragraph id="ide63a0c12e93744239767a2c612477a42"><enum>(4)</enum><text>45 percent of the
			 cost of detailed engineering of local energy infrastructure.</text>
				</paragraph></subsection><subsection id="id449ef2f31070465b8fdd7b672984b7d1"><enum>(d)</enum><header>Applications</header>
				<paragraph id="id0f956259f4d24da9bf90226b580e82f7"><enum>(1)</enum><header>In
			 general</header><text>An eligible entity desiring technical assistance under
			 this section shall submit an application to the Secretary at such time, in such
			 manner, and containing such information as the Secretary may require under the
			 rules and procedures adopted under subsection (f).</text>
				</paragraph><paragraph id="id91f59b3edbc64ba19e8ccb71abe6c9dd"><enum>(2)</enum><header>Application
			 process</header><text>The Secretary shall seek applications for technical
			 assistance under this section—</text>
					<subparagraph id="idD792249C51D34F4F8D841A154E50933B"><enum>(A)</enum><text>on a competitive
			 basis; and</text>
					</subparagraph><subparagraph id="idF8E3533EB0344ABEAC88792663ED9FD0"><enum>(B)</enum><text>on a periodic
			 basis, but not less frequently than once every 12 months.</text>
					</subparagraph></paragraph></subsection><subsection id="ide900374cb8314b8f912830a8ac3d74bb"><enum>(e)</enum><header>Priorities</header><text>In
			 evaluating projects, the Secretary shall give priority to projects that have
			 the greatest potential for—</text>
				<paragraph id="iddad2709a09ac49ce9d80766424cc90f2"><enum>(1)</enum><text>maximizing
			 elimination of fossil fuel use;</text>
				</paragraph><paragraph id="id0b3b62c91f694d68bd9288b974b4ead9"><enum>(2)</enum><text>strengthening the
			 reliability of local energy supplies and boosting the resiliency of energy
			 infrastructure to the impact of extreme weather events, power grid failures,
			 and interruptions in supply of fossil fuels;</text>
				</paragraph><paragraph id="id4ad00028677e43fe942b30156a45dd70"><enum>(3)</enum><text>minimizing
			 environmental impact, including regulated air pollutants, greenhouse gas
			 emissions, and use of ozone-depleting refrigerants;</text>
				</paragraph><paragraph id="id5348e0a526d94278bae3e673b85330aa"><enum>(4)</enum><text>facilitating use
			 of renewable energy resources;</text>
				</paragraph><paragraph id="idcd9737b29899423f8fe8248dd568fcdf"><enum>(5)</enum><text>increasing
			 industrial competitiveness; and</text>
				</paragraph><paragraph id="idf200dd8cffe34c81a54778e9c2ec2edc"><enum>(6)</enum><text>maximizing local
			 job creation.</text>
				</paragraph></subsection><subsection id="idf11919a3938b4e2b8454cb91ae777e34"><enum>(f)</enum><header>Rules and
			 procedures</header><text>Not later than 180 days after the date of enactment of
			 this Act, the Secretary shall adopt rules and procedures for the administration
			 of the program established under this section, consistent with the provisions
			 of this Act.</text>
			</subsection><subsection id="idce7baed164f04758babb870e2728410c"><enum>(g)</enum><header>Authorization
			 of appropriations</header><text>There is authorized to be appropriated to carry
			 out this section $150,000,000 for the period of fiscal years 2014 through 2018,
			 to remain available until expended.</text>
			</subsection></section><section id="id7ec0a359f93b458e89ca65e7a45e0e2d"><enum>5.</enum><header>Loan guarantees
			 for local energy infrastructure</header>
			<subsection id="id5d766679cbbe4aa186d19ef796185f66"><enum>(a)</enum><header>Local energy
			 infrastructure loan guarantee program</header>
				<paragraph id="id866c675e04df446e82ea430bbbd474e0"><enum>(1)</enum><header>In
			 general</header><text>Title XVII of the Energy Policy Act of 2005 (42 U.S.C.
			 16511 et seq.) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id6fef6a79caef43ae8f8ac4594a47c7e7" style="OLC">
						<section id="id3b3b7fbc8a8b47d08546d03a9c49e856"><enum>1706.</enum><header>Local energy
				infrastructure loan guarantee program</header>
							<subsection id="id6e2e5a23248d4f4c80005ae384b94bed"><enum>(a)</enum><header>In
				general</header><text>The Secretary may make guarantees under this section for
				commercial or innovative projects defined as <quote>local energy
				infrastructure</quote> in section 3 of the <short-title>Local Energy Supply and Resiliency Act of
				2013</short-title>.</text>
							</subsection><subsection id="id09aac0de58924ea4af40dd2b02987edc"><enum>(b)</enum><header>Modification of
				existing authority</header><text>The Secretary shall reserve $4,000,000,000 of
				the loan guarantee authority remaining under section 1703 to provide loan
				guarantees under this section.</text>
							</subsection><subsection id="id2c3d8b8c304e4ebc997c57e987d2bc25"><enum>(c)</enum><header>Use of other
				appropriated funds</header><text>To the maximum extent practicable, the
				Secretary shall use funds appropriated to carry out section 1703 that remain
				unobligated as of the date of enactment of this section for the cost of loan
				guarantees under this
				section.</text>

				</paragraph><paragraph id="idf018c47fd5274a6c8c7eacc74e443a44"><enum>(2)</enum><header>Table of
			 contents amendment</header><text>The table of contents for the Energy Policy
			 Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15801">42 U.S.C. 15801 et seq.</external-xref>) is amended by inserting after the item
			 relating to section 1705 the following new item:</text>

			 1994 (<external-xref legal-doc="usc" parsable-cite="usc/12/4702">12 U.S.C. 4702(16)</external-xref>) is amended—</text>
			<paragraph id="id4524493549534306A224DD3DED336E7A"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A)(ii), by striking
			 <quote>or</quote> at the end;</text>
			</paragraph><paragraph id="idC52AE02803764E2D9B99F3A1E476103F"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking the period
			 at the end and inserting <quote>; or</quote>; and</text>
			</paragraph><paragraph id="id1C27C160B7CA4E11BEDA7DB437E54CE7"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
