		<official-title>To establish an improved regulatory process for injurious
		  wildlife to prevent the introduction and establishment in the United States of
		  nonnative wildlife and wild animal pathogens and parasites that are likely to
		  cause harm.</official-title>

		<section id="HEA31112B8227413B914481AC936B8AB8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Invasive Fish and Wildlife Prevention
			 Act</short-title></quote>.</text>
		</section><section id="H858621DE85FA4D4D9BFBE919EBA790BE"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to establish an
			 improved regulatory process for injurious wildlife to prevent the introduction
			 and establishment in the United States of nonnative wildlife and wild animal
			 pathogens and parasites that are likely to cause—</text>
			<paragraph id="H5D42F32C6E7F46629008BCAF73D03D33"><enum>(1)</enum><text>economic or
			 environmental harm; or</text>
			</paragraph><paragraph id="H122E2C16A1464F3DA595354CC0CFF4F0"><enum>(2)</enum><text>harm to humans or
			 animal health.</text>
			</paragraph></section><section id="H3415B589CBEF4BC69CFA4961AC2C927D"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="HEF840B1E92EA4111ABCAC1F3C55E8857"><enum>(1)</enum><header>Approved
			 wildlife sanctuary</header><text>The term <quote>approved wildlife
			 sanctuary</quote> means a sanctuary that cares for wildlife species
			 that—</text>
				<subparagraph id="H53DA415A7428478A998C401C15C083B0"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="HE202CEE23597428986A3B3A9368B44E1"><enum>(i)</enum><text>is a corporation that is
			 exempt from taxation under section 501(a) of the Internal Revenue Code 1986 and
			 described in sections 501(c)(3) and 170(b)(1)(A)(vi) of that Code;</text>
					</clause><clause id="idA0B193B5CDAD4A4B985A25FF04B1F0E7" indent="up1"><enum>(ii)</enum><text>does not commercially trade in
			 animals regulated under this Act, including offspring, parts, and byproducts of
			 those animals; and</text>
					</clause><clause id="idC714A89DAE9B415A97C6EF279684EC18" indent="up1"><enum>(iii)</enum><text>does not propagate animals
			 regulated under this Act; and</text>
					</clause></subparagraph><subparagraph id="H130E7BD4256C446D953F718D55C98C61"><enum>(B)</enum><text>meets any
			 additional criteria that the Service determines are necessary and consistent
			 with the purpose of this Act.</text>
				</subparagraph></paragraph><paragraph id="HD79AF8F67BA74C6A91FAABB946BC81FE"><enum>(2)</enum><header>Aquatic nuisance
			 species task force</header><text>The term <quote>Aquatic Nuisance Species Task
			 Force</quote> means the Aquatic Nuisance Species Task Force established under
			 section 1201 of the Nonindigenous Aquatic Nuisance Prevention and Control Act
			 of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4702">16 U.S.C. 4702</external-xref>).</text>
			</paragraph><paragraph id="idA4DB8C53FB5B4A29AB4FE86068F655F2"><enum>(3)</enum><header>Director</header><text>The
			 term <term>Director</term> means the Director of the United States Fish and
			 Wildlife Service.</text>
			</paragraph><paragraph id="H62D2409FFB0E4080BB8DA9D74CBEB625"><enum>(4)</enum><header>Fund</header><text>The
			 term <quote>Fund</quote> means the Injurious Wildlife Prevention Fund
			 established by section 16(a).</text>
			</paragraph><paragraph id="H0FF1A106F309491387FA7BA39705A1D0"><enum>(5)</enum><header>Import</header><text>The
			 term <quote>import</quote> means to bring into, or introduce into, or attempt
			 to bring into, or introduce into, any place subject to the jurisdiction of the
			 United States, regardless of whether the bringing into or introduction
			 constitutes an importation within the meaning of the customs laws of the United
			 States.</text>
			</paragraph><paragraph id="H3B514509BB364D5594BB9F9BCE947324"><enum>(6)</enum><header>Indian
			 tribe</header><text>The term <quote>Indian tribe</quote> has the meaning given
			 the term in section 4 of the Indian Self-Determination and Education Assistance
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>).</text>
			</paragraph><paragraph id="HB31CF41DA62043958FE139D136B9731E"><enum>(7)</enum><header>National
			 invasive species council</header><text>The term <quote>National Invasive
			 Species Council</quote> means the National Invasive Species Council established
			 by Executive Order 13112 on February 8, 1999 (64 Fed. Reg. 6183).</text>
			</paragraph><paragraph id="HD5E92AA247984901BB0FEE7F88868B2F"><enum>(8)</enum><header>Native</header><text>The
			 term <quote>native</quote>, with respect to a wildlife taxon, means a wildlife
			 taxon that historically occurred or currently occurs in the United States,
			 other than as a result of an intentional or unintentional introduction by
			 humans.</text>
			</paragraph><paragraph id="HE08CB08470274947BB87A49FC4FA1C9C"><enum>(9)</enum><header>Nonnative
			 wildlife taxon</header>
				<subparagraph id="H3F4ADC07C5CC47C9BC1501D09E996427"><enum>(A)</enum><header>In
			 general</header><text>The term <quote>nonnative wildlife taxon</quote> means
			 any family, genus, species, or subspecies of live animal that is not native to
			 the United States, regardless of whether the animal was born or raised in
			 captivity.</text>
				</subparagraph><subparagraph id="H7C4FE869FFB14574935ED98532142AE0"><enum>(B)</enum><header>Inclusions</header><text>The
			 term <quote>nonnative wildlife taxon</quote> includes any viable egg, sperm,
			 gamete, or other reproductive material or offspring of an animal of a family,
			 genus, species, or subspecies described in subparagraph (A).</text>
				</subparagraph><subparagraph id="H359AE5300C4F4383A227DAA396A02C16"><enum>(C)</enum><header>Exclusions</header><text>The
			 term <quote>nonnative wildlife taxon</quote> does not include—</text>
					<clause id="HD425C52950EE46DF8C36B495527E2392"><enum>(i)</enum><text>any
			 taxon that is—</text>
						<subclause id="H96F2C1FFFA1B4851AC6265C27E5B226F"><enum>(I)</enum><text>specifically
			 defined or regulated as a plant pest or approved for biological control
			 purposes under the Plant Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/7/7701">7 U.S.C. 7701 et seq.</external-xref>); or</text>
						</subclause><subclause id="HC2C6DA48494D4A44A84CB66DD7FD4564"><enum>(II)</enum><text>defined or
			 regulated as a threat to livestock or poultry under the Animal Health
			 Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/7/8301">7 U.S.C. 8301 et seq.</external-xref>); or</text>
						</subclause></clause><clause id="H419FF24282D347FD8E77EF38BBF2ADFF"><enum>(ii)</enum><text>any
			 common and clearly domesticated species or subspecies, including—</text>
						<subclause id="H27757129DCBF456990DDBC4C579BA637"><enum>(I)</enum><text>cat (Felis
			 catus);</text>
						</subclause><subclause id="H40E69E41657940819C9962D368921DD9"><enum>(II)</enum><text>cattle or oxen
			 (Bos taurus);</text>
						</subclause><subclause id="H4325B42433AE4B258914981BD6CE5E9D"><enum>(III)</enum><text>chicken (Gallus
			 gallus domesticus);</text>
						</subclause><subclause id="H244C1DE1BEBD4EBD8F33A37CFE9B46D6"><enum>(IV)</enum><text>common canary
			 (Serinus canaria domesticus);</text>
						</subclause><subclause id="H721AEA3B62B740E0B76BA212D7AA5991"><enum>(V)</enum><text>dog (Canis lupus
			 familiaris);</text>
						</subclause><subclause id="H161415E5FA8D43F79B852C21B88EB561"><enum>(VI)</enum><text>donkey or ass
			 (Equus asinus);</text>
						</subclause><subclause id="HC5536C060CC04B8AA39E29E992DAB08A"><enum>(VII)</enum><text>domesticated
			 members of the family Anatidae (geese);</text>
						</subclause><subclause id="H5017B13806574128923D9862E7A7DC6C"><enum>(VIII)</enum><text>duck
			 (domesticated Anas spp.);</text>
						</subclause><subclause id="HEABF306827034E9884A27C5480A29CBE"><enum>(IX)</enum><text>domesticated
			 ferret (Mustela furo);</text>
						</subclause><subclause id="H0C5127839E8B4819A14E5E2676C2C391"><enum>(X)</enum><text>gerbil (Meriones
			 unguiculatus);</text>
						</subclause><subclause id="H68D13AF360AC42E181E3D0EA7F58761A"><enum>(XI)</enum><text>goat (Capra
			 aegagrus hircus);</text>
						</subclause><subclause id="H9636CEB06C2142EE97015A129121C796"><enum>(XII)</enum><text>guinea pig or
			 Cavy (Cavia porcellus);</text>
						</subclause><subclause id="HCDF212289E80489A9FF5199A06915B7E"><enum>(XIII)</enum><text>goldfish
			 (Carassius auratus auratus);</text>
						</subclause><subclause id="HA1125EB221ED41738EBD862E36033DD0"><enum>(XIV)</enum><text>domesticated
			 hamsters (Cricetulus griseus, Mesocricetus auratus, Phodopus campbelli,
			 Phodopus sungorus, and Phodopus roborovskii);</text>
						</subclause><subclause id="H2699ED8B0FF04E83A4722D6CDF54B628"><enum>(XV)</enum><text>horse (Equus
			 caballus);</text>
						</subclause><subclause id="H31AD69DD20F7402FACFDEE06DD457ACC"><enum>(XVI)</enum><text>llama (Lama
			 glama);</text>
						</subclause><subclause id="H32E81153ED374469B0DD1B72A98DE263"><enum>(XVII)</enum><text>mule or hinny
			 (Equus caballus x E. asinus);</text>
						</subclause><subclause id="H321C42CE9FDA4079882AAA81BFA4F02C"><enum>(XVIII)</enum><text>pig or hog
			 (Sus scrofa domestica);</text>
						</subclause><subclause id="HB60D8BB412D2444A9613BF19F88336F3"><enum>(XIX)</enum><text>domesticated
			 varieties of rabbit (Oryctolagus cuniculus);</text>
						</subclause><subclause id="H1E8EAC8770744FD3BB84920963DB80D1"><enum>(XX)</enum><text>sheep (Ovis
			 aries); or</text>
						</subclause><subclause id="H38EB2203B5C845369AD7CB22E4F90AA0"><enum>(XXI)</enum><text>any other
			 species or subspecies that the Director determines to be common and clearly
			 domesticated.</text>
						</subclause></clause></subparagraph></paragraph><paragraph id="H1200A21DD37D4323886F7153C346090C"><enum>(10)</enum><header>Person</header><text>The
			 term <quote>person</quote> means—</text>
				<subparagraph id="H272BE124F6434CB4A8C23536D278F823"><enum>(A)</enum><text>an individual,
			 corporation, partnership, trust, association, or other private entity;</text>
				</subparagraph><subparagraph id="H52B77DE86CCE47BA8A7710C9AA090E2F"><enum>(B)</enum><text>any officer,
			 employee, agent, department, or instrumentality of the Federal Government, or
			 of any tribal government, or of any State, municipality, or political
			 subdivision of a State, or of any foreign government; and</text>
				</subparagraph><subparagraph id="H784936C879534A79B23D2BA46A4606A6"><enum>(C)</enum><text>any other entity
			 subject to the jurisdiction of the Federal United States.</text>
				</subparagraph></paragraph><paragraph id="HE5A84493AAF74268987CE4040559D57F"><enum>(11)</enum><header>Qualified
			 institution</header><text>The term <quote>qualified institution</quote> means
			 an institution that is determined by the Director to be—</text>
				<subparagraph id="HBFF4917D61B44A08A52ED569209D0862"><enum>(A)</enum><text>for scientific,
			 veterinary, or medical research or education, or a zoo or aquarium accredited
			 by the Association of Zoos and Aquariums; or</text>
				</subparagraph><subparagraph id="H1D96987C09ED453A829FB6299CF734E8"><enum>(B)</enum><text>an approved
			 wildlife sanctuary.</text>
				</subparagraph></paragraph><paragraph id="H0AD9F8BE203242DEAE018E5CABBC8379"><enum>(12)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="HE8A037BAAC2847F8B722D8D2BAB7B1FF"><enum>(13)</enum><header>State</header><text>The
			 term <quote>State</quote> means—</text>
				<subparagraph id="H9955D6D019B849E7B5C4C0CC200949EA"><enum>(A)</enum><text>each of the
			 several States of the United States;</text>
				</subparagraph><subparagraph id="H9EBA4F8D03994778BB1EB8B38AC8483B"><enum>(B)</enum><text>the District of
			 Columbia;</text>
				</subparagraph><subparagraph id="H0BC07FE02C544EF1BBEAA2BF86E58ADA"><enum>(C)</enum><text>the Commonwealth
			 of Puerto Rico;</text>
				</subparagraph><subparagraph id="HAF4C6146F22143708E16460CE4176855"><enum>(D)</enum><text>Guam;</text>
				</subparagraph><subparagraph id="H0B2BCCF02E6F486CA53AF3509D2CFB54"><enum>(E)</enum><text>American
			 Samoa;</text>
				</subparagraph><subparagraph id="HE13A372DF84049A68E8442690A1C072F"><enum>(F)</enum><text>the Commonwealth
			 of the Northern Mariana Islands;</text>
				</subparagraph><subparagraph id="HFD2E9C26718B4F74BEB453469FA5EB15"><enum>(G)</enum><text>the Federated
			 States of Micronesia;</text>
				</subparagraph><subparagraph id="H40737BDC17E34AABAA6CEB7C8191F11F"><enum>(H)</enum><text>the Republic of
			 the Marshall Islands;</text>
				</subparagraph><subparagraph id="H60F17EBA80D94EDD90511FA339EFF220"><enum>(I)</enum><text>the Republic of
			 Palau; and</text>
				</subparagraph><subparagraph id="HCC0E031F6BFD4B9A8EAA2D4B8A6D0AEB"><enum>(J)</enum><text>the United States
			 Virgin Islands.</text>
				</subparagraph></paragraph><paragraph id="H2F316C405028446D977FF17D891BBBE8"><enum>(14)</enum><header>United
			 States</header><text>The term <quote>United States</quote> means—</text>
				<subparagraph id="H1F5F8B83791648189D8B802D98D4C669"><enum>(A)</enum><text>the States;
			 and</text>
				</subparagraph><subparagraph id="HC957F99F93324C3580F6F23814B6EF7C"><enum>(B)</enum><text>any land and
			 water, including the territorial sea and the Exclusive Economic Zone, within
			 the jurisdiction or sovereignty of the Federal Government.</text>
				</subparagraph></paragraph></section><section id="HC9134878C2B4476B954CDF9DEFC7F310"><enum>4.</enum><header>Proposals for
			 regulation of nonnative wildlife taxa</header>
			<subsection id="H6DE94CE8ED3D481F8FA9BC0F2061859D"><enum>(a)</enum><header>Proposals</header><text>Any
			 person or entity, or the Director, at the discretion of the Director, may
			 propose the regulation of, or revised regulation of, 1 or more taxa.</text>
			</subsection><subsection id="H63C61333B31140D89B9AD4FD8336407D"><enum>(b)</enum><header>Information</header><text>A
			 proposal by a person or agency should include adequate information to allow the
			 Director to determine whether the taxon meets the criteria for designation as
			 Injurious I or Injurious II under section 5(a)(1)(A).</text>
			</subsection><subsection id="H1E9A8A92C3B74A43B625AA39A5A3950E"><enum>(c)</enum><header>Public and
			 agency comment</header>
				<paragraph id="id399FDC37CAF54C00AF4A2CDE0217F2E9"><enum>(1)</enum><header>In
			 general</header><text>Upon receipt of a proposal that the Director determines
			 to be complete, and for any proposal the Director elects to prepare, the
			 Director shall publish notice of the proposal in the Federal Register and
			 provide an opportunity for at least 60 days of public comment.</text>
				</paragraph><paragraph id="idB642F7201C3B4D1A8680845E4797EF3F"><enum>(2)</enum><header>Regulations for
			 complete proposals</header><text>Not later than 180 days after the date of
			 enactment of this Act, the Secretary, acting through the Director, shall
			 promulgate regulations on the criteria for complete proposals.</text>
				</paragraph></subsection><subsection id="HF6F95CCAA92246F581E9ADCE03D9160A"><enum>(d)</enum><header>Determination</header><text>Not
			 later than 180 days after the date of publication of a proposal under
			 subsection (c), or as soon thereafter as is feasible, the Director shall make a
			 determination as to whether the proposal should be approved or
			 disapproved.</text>
			</subsection><subsection id="H745425EB0DED4381846284D64C15B88F"><enum>(e)</enum><header>Notice of
			 determination</header><text>The Director shall—</text>
				<paragraph id="HEF3B3624E10149C28FA261FCF0FB1B26"><enum>(1)</enum><text>publish in the
			 Federal Register notice of the determination made under subsection (d);
			 and</text>
				</paragraph><paragraph id="HF7BA297DFCEF47D5832DDBC9A2B71668"><enum>(2)</enum><text>make the basis for
			 the determination available on a publicly available Federal Internet
			 site.</text>
				</paragraph></subsection></section><section id="H0921897C34E14047BEDFD6E7C09ECEE1"><enum>5.</enum><header>Scientific risk
			 assessment and risk determination regulations</header>
			<subsection id="H0FEE642441FE4BC594D230D99D6289CC"><enum>(a)</enum><header>Assessment and
			 determination</header>
				<paragraph id="HCEB8B48A85F140F29955F117D82CD831"><enum>(1)</enum><header>In
			 general</header><text>The Secretary, acting through the Director, shall
			 promulgate regulations—</text>
					<subparagraph id="H336746647E954369B1B8EAB96CC47239"><enum>(A)</enum><text>to further specify
			 the criteria for regulating a nonnative wildlife taxon as—</text>
						<clause id="H927057B5B009478B960DBC5208F5E746"><enum>(i)</enum><text>an
			 Injurious I taxon, which shall be a taxon—</text>
							<subclause id="H3D5A62C919DC43B8AE37048ABDAF993F"><enum>(I)</enum><text>that the Director
			 determines—</text>
								<item id="H13B81B6785D04709917CD2DB44583D0A"><enum>(aa)</enum><text>to be
			 injurious to human beings, the interests of agriculture, horticulture, or
			 forestry, or wildlife or wildlife resources of the United States; and</text>
								</item><item id="H312625538BF541EEBB0F6681636E4ADB"><enum>(bb)</enum><text>to
			 have a high degree of potential harm and is a taxon with which qualified
			 institutions have not previously had significant experience in maintaining
			 successfully in captivity and preventing escapes or releases; and</text>
								</item></subclause><subclause id="HA58790CD55EE43D4ABEA303E17412A7A"><enum>(II)</enum><text>except as
			 provided in section 12, the importation and transportation of which in
			 interstate commerce shall be conducted only pursuant to a permit issued under
			 section 12 to a qualified institution; or</text>
							</subclause></clause><clause id="HE3803A73D99443A5BE432D1416CF93AD"><enum>(ii)</enum><text>an
			 Injurious II taxon, which shall be a taxon—</text>
							<subclause id="H5DD2AF6B07BF4B759C85C5683FCFCDD6"><enum>(I)</enum><text>that the Director
			 determines—</text>
								<item id="H8D4BE250C189413CAC00903AA89EF799"><enum>(aa)</enum><text>to be
			 injurious to human beings, the interests of agriculture, horticulture, or
			 forestry, or wildlife or wildlife resources of the United States; but</text>
								</item><item id="HDC7511596E6547B4AB7A1341ACCDC736"><enum>(bb)</enum><text>to
			 have a degree of potential for harm that is less than the degree of potential
			 harm of an Injurious I taxon or is a taxon with which qualified institutions
			 have previously had significant experience in maintaining successfully in
			 captivity and preventing escapes or releases; and</text>
								</item></subclause><subclause id="H9EF1BFF21E064722B6C77FB40E416F51"><enum>(II)</enum><text>for which no
			 permit is required if the taxon is—</text>
								<item id="H6D44B37C6F364B7C98DC7053F1A62633"><enum>(aa)</enum><text>imported to a
			 qualified institution;</text>
								</item><item id="HC8FBECD34AB34A758B130BDD03CC7B45"><enum>(bb)</enum><text>transported in
			 interstate commerce and intrastate commerce to and among qualified
			 institutions; or</text>
								</item><item id="H37BF186674854491913598CBFAF67556"><enum>(cc)</enum><text>held
			 by a qualified institution;</text>
								</item></subclause></clause></subparagraph><subparagraph id="H894A7C39E7AC4256929A7835AA83AEC1"><enum>(B)</enum><text>to establish a
			 process for assessing and analyzing the risks of taxa that may have been, or
			 foreseeably could be, imported into, or found in interstate commerce within,
			 the United States; and</text>
					</subparagraph><subparagraph id="H72BEFF22FDE24A79A6381416750747EE"><enum>(C)</enum><text>that may also
			 provide for cases in which exceptions or additions to the Injurious I taxon or
			 Injurious II taxon criteria may be necessary to address extraordinary
			 risks.</text>
					</subparagraph></paragraph><paragraph id="HDD1B63353E474931BC03B0DC80F1BDC4"><enum>(2)</enum><header>Basis,
			 availability, and review</header><text>The Director shall—</text>
					<subparagraph id="H6DB16E2C33DC43DCA1BD4BE71CC6C666"><enum>(A)</enum><text>ensure that the
			 risk assessment and risk determination processes conducted under this section
			 are based on sound science; and</text>
					</subparagraph><subparagraph id="HEA1D90C539DB4624B19C2781DC890C4B"><enum>(B)</enum><text>make the results
			 of each such assessment and determination available to the public.</text>
					</subparagraph></paragraph><paragraph id="H99F475F80FE049D7889A415D5846F4BA"><enum>(3)</enum><header>Previously
			 listed taxa</header><text>Each wildlife taxon previously designated by statute
			 or by the Secretary as injurious under <external-xref legal-doc="usc" parsable-cite="usc/18/42">section 42(a)</external-xref> of title 18, United States
			 Code (including under any regulation promulgated under that authority), shall,
			 after the effective date of the final regulations promulgated under this
			 subsection, be promptly designated by the Director as an Injurious I taxon or
			 Injurious II taxon under this subsection, based on a determination by the
			 Director of whether the taxon meets the criteria described in clause (i) or
			 (ii), respectively, of paragraph (1)(A).</text>
				</paragraph><paragraph id="HD9E6EC2978C442308BDA7FB0CEDC749D"><enum>(4)</enum><header>Deadlines</header>
					<subparagraph id="HA0DB35E11EC242BEB8BF3AA94444B631"><enum>(A)</enum><header>Proposed
			 regulations</header><text>Not later than 1 year after the date of enactment of
			 this Act, the Secretary shall publish in the Federal Register a proposed
			 version of the regulations required under this subsection.</text>
					</subparagraph><subparagraph id="H109F20ED721E40C797BACFAA027BF159"><enum>(B)</enum><header>Final
			 regulations</header><text>Not later than 18 months after the date of enactment
			 of this Act, the Secretary shall promulgate final regulations required under
			 this subsection, including a public notification of the process for submission
			 of a proposal under section 4(a).</text>
					</subparagraph><subparagraph id="H992F0E2FC24747DBAC4B380E1065E942"><enum>(C)</enum><header>Additional
			 requirement of pre-import risk screening for all taxa novel to the united
			 states</header>
						<clause id="HDDB2D895E38A41BE8DF3C54A2372B608"><enum>(i)</enum><header>In
			 general</header><text>Not later than 3 years after the date of enactment of
			 this Act, the Secretary shall by regulation—</text>
							<subclause id="H55D5F0C2DBAF4E05A649F6206C444C2C"><enum>(I)</enum><text>define the phrase
			 <quote>non-native wildlife taxa novel to the United States</quote> for the
			 purpose of this section; and</text>
							</subclause><subclause id="HDC1C5134A2C842E1A3A7E6469740B972"><enum>(II)</enum><text>set forth a
			 process to ensure that all unregulated non-native wildlife taxa novel to the
			 United States are thereafter reviewed by the Director prior to allowance of
			 their importation to the United States to determine whether they should be
			 regulated under any of clause (i) or (ii) of paragraph (1)(A).</text>
							</subclause></clause><clause id="H5C5B0D75AB7241F9AAA65DF5DCC0CC43"><enum>(ii)</enum><header>Avoidance of
			 new incentives</header><text>In promulgating the regulation under clause (i),
			 the Secretary shall seek to avoid creating a new incentive for animal importers
			 to import novel taxa prior to the effective date of the regulation.</text>
						</clause><clause id="H4E900A6F0C6E45849BEED3733F95A9CB"><enum>(iii)</enum><header>New regulation
			 for imports of taxa novel to the united states</header><text>Not later than 1
			 year after the date of promulgation of the regulation under clause (i), the
			 Secretary shall implement the regulation.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="HEAAA5883769E46DB8C4C7CDEFB7CDE11"><enum>(b)</enum><header>Scientific risk
			 assessment</header><text>The regulations promulgated under subsection (a) shall
			 require consideration, in an initial scientific risk assessment of a taxon, of
			 at least—</text>
				<paragraph id="H6236D2CD783C42B595A2382B77634431"><enum>(1)</enum><text>the scientific
			 name and native range of the taxon;</text>
				</paragraph><paragraph id="HC6CEB38B3BDF40F091E2D803E3020D21"><enum>(2)</enum><text>whether the taxon
			 has established or spread, or caused harm to the economy, the environment, or
			 the health of other animal species in the United States or in an ecosystem
			 similar to an ecosystem in the United States;</text>
				</paragraph><paragraph id="HAAE10761879C424FB1B3C7683BD4B8B3"><enum>(3)</enum><text>whether
			 environmental conditions suitable for the establishment or spread of the taxon
			 exist or will exist in the United States;</text>
				</paragraph><paragraph id="H4D7B164A5C0E4D6CA3D224F20EB738FF"><enum>(4)</enum><text>the likelihood of
			 establishment and spread of the taxon;</text>
				</paragraph><paragraph id="H0FADA60AA16441DCBD475CADBA7E6049"><enum>(5)</enum><text>whether the taxon
			 will cause harm to human beings, to the interests of agriculture, horticulture,
			 forestry, or to wildlife or the wildlife resources of the United States;</text>
				</paragraph><paragraph id="H3F4EEFB49EC1416CB07F159EB499C09A"><enum>(6)</enum><text>whether the taxon
			 will damage land, water, or facilities of the National Park System or other
			 public land;</text>
				</paragraph><paragraph id="H2E9D2436686742DDB4B7C333CCEE02FE"><enum>(7)</enum><text>the best available
			 scientific risk screening systems or predictive models that apply to the taxon;
			 and</text>
				</paragraph><paragraph id="H76AB7A16C34D44D6B89B846B3B837F74"><enum>(8)</enum><text>other factors
			 important to assessing risks, if any, associated with the taxon, in accordance
			 with the purpose of this Act.</text>
				</paragraph></subsection><subsection id="H6468DD21B41340DA96FCA3F192ABD300"><enum>(c)</enum><header>Risk
			 determination</header><text>Prior to designating any nonnative wildlife taxon
			 as an Injurious I taxon or Injurious II taxon under subsection (a), after
			 conducting a risk assessment, the Director shall prepare a risk determination
			 that takes into consideration—</text>
				<paragraph id="H0131BD350AA5441E86064546B52556E9"><enum>(1)</enum><text>the results of the
			 risk assessment; and</text>
				</paragraph><paragraph id="HA4DA6DD461A5495695223C8CC5159A75"><enum>(2)</enum><text>at a
			 minimum—</text>
					<subparagraph id="H71BFF9C0D570432587AA68600BA3D40B"><enum>(A)</enum><text>the capabilities
			 and any efforts of States, local governments, and Indian tribes to address the
			 risks, if any, identified by the Director with respect to the taxon, including
			 the results of any risk assessments conducted for the taxon that are available
			 to the Director;</text>
					</subparagraph><subparagraph id="H1A75E0BE5DE94545A87A1B0E659A6D06"><enum>(B)</enum><text>the potential for
			 reduction, mitigation, control, and management of any risks identified;
			 and</text>
					</subparagraph><subparagraph id="H6E1F39E13D5C45B3934669050AD0B283"><enum>(C)</enum><text>whether any risks
			 identified already are adequately addressed under other applicable law.</text>
					</subparagraph></paragraph></subsection><subsection id="H602C5BEEE4C24D998C45F6AE27B68A1F"><enum>(d)</enum><header>Discretionary
			 analysis</header>
				<paragraph id="HAB2378AF1136489EBE4553261D388CE4"><enum>(1)</enum><header>In
			 general</header><text>In preparing the risk determination for a taxon, the
			 Director may consider the economic, social, and cultural impacts of a decision
			 on whether to regulate the taxon.</text>
				</paragraph><paragraph id="H589F543A33E740F289FB9B7CF3849F78"><enum>(2)</enum><header>Other
			 requirements</header><text>This section shall satisfy the requirements of, and
			 apply in lieu of any other requirement to complete an analysis under, any other
			 law (including a regulation or Executive order) on economic, social, or
			 cultural impact.</text>
				</paragraph></subsection><subsection id="H3BC358ECE5C44848A1228F879B4C407F"><enum>(e)</enum><header>Notice and
			 consultation</header><text>In promulgating regulations under subsection (a),
			 the Director shall notify and consult with, at a minimum—</text>
				<paragraph id="H4DD0380ADAAD49CAB33B45057B00FCCC"><enum>(1)</enum><text>affected States,
			 Indian tribes, qualified institutions, and other stakeholders;</text>
				</paragraph><paragraph id="HBCCD6D60242346AB8AC6BF055F239859"><enum>(2)</enum><text>the Aquatic
			 Nuisance Species Task Force;</text>
				</paragraph><paragraph id="H9DB529F85C6449E19C7927C028705EC0"><enum>(3)</enum><text>the National
			 Invasive Species Council;</text>
				</paragraph><paragraph id="H2DD4FC5F61744C699811A2C7CBFCC614"><enum>(4)</enum><text>the Department of
			 Agriculture;</text>
				</paragraph><paragraph id="HBD4158A9296543089FDC4D558F17F812"><enum>(5)</enum><text>the Centers for
			 Disease Control and Prevention; and</text>
				</paragraph><paragraph id="HBA2C143103A145EB89DC87F9E8F1D30C"><enum>(6)</enum><text>the National
			 Oceanic and Atmospheric Administration.</text>
				</paragraph></subsection></section><section id="H29A0B80768D64D18A559BE11B0DBBC9D"><enum>6.</enum><header>Emergency
			 temporary designation</header>
			<subsection id="HEFA31B838DA046019E49DE86E81EA580"><enum>(a)</enum><header>In
			 general</header><text>If the Director determines an emergency exists because an
			 unregulated nonnative wildlife taxon poses an imminent threat of harm to
			 individuals in or wildlife of the United States, or the economy or environment
			 of the United States, the Director may immediately temporarily designate the
			 nonnative wildlife taxon as Injurious I in accordance with section
			 5(a)(1)(A)(i).</text>
			</subsection><subsection id="HB46920257C6C4B50B0D953BFF608FC0F"><enum>(b)</enum><header>Notice of
			 temporary designation</header><text>The Director shall promptly—</text>
				<paragraph id="HD6F82F42EC9142639864533D84305799"><enum>(1)</enum><text>publish in the
			 Federal Register notice of each temporary designation under this subsection;
			 and</text>
				</paragraph><paragraph id="H05B811E0475E4A49B1485FBF9BE54E78"><enum>(2)</enum><text>make the basis for
			 the designation available on a publicly available Federal Internet site and
			 through other appropriate means.</text>
				</paragraph></subsection><subsection id="H48E37D0404BC4495BC24AFE2FDE5A0B7"><enum>(c)</enum><header>Determination</header><text>Not
			 later than 1 year after temporarily designating a nonnative wildlife taxon
			 using the emergency authority under this section, the Director shall—</text>
				<paragraph id="H79AEC6EBFE394394A2585CF602622423"><enum>(1)</enum><text>make a final
			 determination regarding whether the taxon should be further regulated under
			 either of clause (i) or (ii) of section 5(a)(1)(A);</text>
				</paragraph><paragraph id="H32EEC17F4DD64F2894E59531EB743016"><enum>(2)</enum><text>publish notice of
			 that final determination in the Federal Register; and</text>
				</paragraph><paragraph id="HEF35A95769A6448BA1013965D535048D"><enum>(3)</enum><text>make the basis for
			 the determination available on a publicly available Federal Internet
			 site.</text>
				</paragraph></subsection><subsection id="H0D17C50A33D648449B3793F17141C075"><enum>(d)</enum><header>Limitation on
			 procedures</header><text>The procedures under sections 4 and 5 of this Act and
			 <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States Code, shall not apply to temporary
			 designations under this section.</text>
			</subsection><subsection id="HAD2B3AEA72D248F8A4532E7D564FC93B"><enum>(e)</enum><header>State
			 requests</header><text>If the Governor of a State requests a temporary
			 emergency designation under this section, the Director shall respond promptly
			 with a written determination on the request.</text>
			</subsection></section><section id="HF91509D5DC2041FD848C368BD7D2BB3B"><enum>7.</enum><header>Information on
			 imported animals</header>
			<subsection id="H5B60EEE0F42D42D6BD09DE995978691D"><enum>(a)</enum><header>Improved
			 information</header><text>The Director shall—</text>
				<paragraph id="HF31686A0F0474BB78AE63F0CEE4FF44F"><enum>(1)</enum><text>not later than 18
			 months after the date of enactment of this Act, establish an electronic
			 database that describes, using scientific names to the species level (or
			 subspecies level, if applicable), all quantities of imports of all live
			 wildlife, and the regulatory status of the wildlife, in a form that permits
			 that information to be rapidly accessed; and</text>
				</paragraph><paragraph id="H939F66F07BAD4163AA0C2559423FC2E1"><enum>(2)</enum><text>not later than 30
			 days after the date of importation of wildlife described in paragraph (1), make
			 the information described in that paragraph (other than confidential business
			 information associated with those imports that is protected under other Federal
			 law) available on a publicly available Federal Internet site.</text>
				</paragraph></subsection><subsection id="H715D46C872594B9683DEAD11A24ACB87"><enum>(b)</enum><header>Annual report of
			 information</header><text>Not later than 3 years after the date of enactment of
			 this Act, and not later than each April 1 thereafter, the Director shall issue,
			 including on a publicly available Federal Internet site, a report that
			 includes, at a minimum, a description of—</text>
				<paragraph id="H07A0C875A3E54DB983B42F99BD4E2AE7"><enum>(1)</enum><text>all nonnative
			 wildlife imported, using scientific names of the wildlife to the species or
			 subspecies level, to the extent known; and</text>
				</paragraph><paragraph id="HFE127252385A4DC4977ECC7AAE43AD83"><enum>(2)</enum><text>cumulative
			 quantities of imported wildlife and the regulatory status of the
			 wildlife.</text>
				</paragraph></subsection><subsection id="HB57DF391B73847B983357B5E3045F2CD"><enum>(c)</enum><header>Monitoring
			 import information</header><text>In consultation with inspection, customs, and
			 border officials in the Departments of Agriculture and Homeland Security, the
			 Director shall regularly—</text>
				<paragraph id="HD7E57F06EAD04BE78CAAEA861426F3C5"><enum>(1)</enum><text>monitor the
			 identities and quantities of nonnative wildlife taxa being imported, with
			 particular emphasis on wildlife newly in the import trade to the United States;
			 and</text>
				</paragraph><paragraph id="H558B9DD961F849A7958D30F47BF4E8B9"><enum>(2)</enum><text>determine, to the
			 maximum extent practicable, whether the newly traded taxa would meet the
			 criteria for regulation, and should be regulated, under any of clause (i) or
			 (ii) of section 5(a)(1)(A).</text>
				</paragraph></subsection></section><section id="H450DDC5D34D4499C836D16AD4B99D3F1"><enum>8.</enum><header>Injurious
			 wildlife determinations</header>
			<subsection id="HE120B82059F344C0AA4FBDD2457A0FD4"><enum>(a)</enum><header>In
			 general</header><text>Immediately upon the date of enactment of this Act, the
			 Secretary shall make more rapid determinations on proposals for regulation of
			 wildlife under <external-xref legal-doc="usc" parsable-cite="usc/18/42">section 42</external-xref> of title 18, United States Code.</text>
			</subsection><subsection id="HD0D0E18A46CD4469A55218E91E15EFED"><enum>(b)</enum><header>Streamlining of
			 determinations</header><text>In carrying out subsection (a) and other
			 provisions of this Act, the Secretary—</text>
				<paragraph id="H6BEAAFEBC653462DB7B86BE3385AF932"><enum>(1)</enum><text>shall use the best
			 available scientific risk screening systems or predictive models that apply to
			 the taxon under consideration;</text>
				</paragraph><paragraph id="HB6D5D40329DE4017BD365620F6915561"><enum>(2)</enum><text>shall forego
			 time-consuming optional administrative steps, unless the Secretary determines
			 the steps to be essential; and</text>
				</paragraph><paragraph id="HC3D9FC72DEC44869BDBB155577B79899"><enum>(3)</enum><text>notwithstanding
			 chapter 6, and <external-xref legal-doc="usc" parsable-cite="usc/5/804">section 804,</external-xref> of title 5, United States Code, may forego economic
			 impact analyses.</text>
				</paragraph></subsection></section><section id="H2D274BF5A2634685BDA1BD6C8EBA56F9"><enum>9.</enum><header>Effect on
			 injurious wildlife provision</header><text display-inline="no-display-inline">This Act and the regulations promulgated
			 under this Act shall take precedence over any conflicting regulation
			 promulgated under <external-xref legal-doc="usc" parsable-cite="usc/18/42">section 42</external-xref> of title 18, United States Code.</text>
		</section><section id="H31ED5FE4644C47E081F46E80D9ABB172"><enum>10.</enum><header>Prevention of
			 wildlife pathogens and parasites</header>
			<subsection id="H88C2AFCD589E4D61BFC92C83FCB5C3CF"><enum>(a)</enum><header>In
			 general</header><text>The Secretary shall have the primary authority to
			 prevent, and the primary responsibility for preventing, the importation of, and
			 interstate commerce in, wildlife pathogens and harmful parasites.</text>
			</subsection><subsection id="H24C8852061C84C4F90C088617BC0116D"><enum>(b)</enum><header>Regulations</header>
				<paragraph id="H236EB0A7A3764FA9A831C749775B7281"><enum>(1)</enum><header>In
			 general</header><text>In addition to regulations required under section 5(a),
			 the Secretary shall promulgate such regulations as are necessary—</text>
					<subparagraph id="H6095A012E10F454CABC9FCBAB3D9AE12"><enum>(A)</enum><text>to minimize the
			 likelihood of introduction or dissemination of any disease or harmful parasite
			 of native or nonnative wildlife; and</text>
					</subparagraph><subparagraph id="H433E36B5BCFC4353B31DF21BA95A4AA5"><enum>(B)</enum><text>to impose any
			 additional necessary import restrictions, including management measures, health
			 certifications, quarantine requirements, specifications for conveyances,
			 holding water, and associated materials, shipment and handling requirements,
			 and other measures that the Secretary determines to be necessary—</text>
						<clause id="H093C4263E8C646DDA8ABC6711A3A151E"><enum>(i)</enum><text>to
			 prevent the importation of, and interstate commerce in, wildlife pathogens and
			 harmful parasites; and</text>
						</clause><clause id="H6942498107C04711A09BFF7621AE14F1"><enum>(ii)</enum><text>to
			 address—</text>
							<subclause id="HC5F12237EB744769B71C3F86826E8DCA"><enum>(I)</enum><text>a
			 particular taxon;</text>
							</subclause><subclause id="H7E00795A16DC4E809FB68BD9D1B17B74"><enum>(II)</enum><text>the place of
			 origin of a particular taxon; and</text>
							</subclause><subclause id="H0CDEE4946D0B4758A0560B819BADABD5"><enum>(III)</enum><text>the conveyance
			 and materials associated with wildlife transport.</text>
							</subclause></clause></subparagraph></paragraph></subsection><subsection id="H837144A7F4B04F20A8B3E1908B4BB8C4"><enum>(c)</enum><header>Relationship to
			 other authorities</header>
				<paragraph id="H579E7A39D2114A4D8694A4217514B01D"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), the Secretary shall
			 exclude from regulation under this section any pathogen, parasite, or host
			 taxon that is—</text>
					<subparagraph id="H11F2F922F7134B06A1F712CA3CF3811E"><enum>(A)</enum><text>defined or
			 regulated by the Department of Health and Human Services as a threat to humans
			 under section 361 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/264">42 U.S.C. 264</external-xref>);</text>
					</subparagraph><subparagraph id="H1BEFFC8853234A76BC5290F293EB961F"><enum>(B)</enum><text>defined or
			 regulated by the Department of Agriculture as a threat to livestock or poultry
			 under the Animal Health Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/7/8301">7 U.S.C. 8301 et seq.</external-xref>); or</text>
					</subparagraph><subparagraph id="HAEDC36982F6442DA9C77BB9F2704068D"><enum>(C)</enum><text>specifically
			 defined or regulated by the Department of Agriculture as a plant pest or
			 approved for biological control purposes under the Plant Protection Act (7
			 U.S.C. 7701 et seq.).</text>
					</subparagraph></paragraph><paragraph id="HD2ACC3CE63F649529C6A2040353813EB"><enum>(2)</enum><header>Exception</header><text>The
			 Secretary may regulate a pathogen, parasite, or host taxon described in any of
			 subparagraphs (A) through (C) of paragraph (1) to the extent that the taxon
			 also poses a wildlife disease risk.</text>
				</paragraph></subsection><subsection id="H3CDB46BAACBB4DFAB114F20BFD06431A"><enum>(d)</enum><header>Coordination</header>
				<paragraph id="HD3C878BE75464C14A595492BF19A1BBA"><enum>(1)</enum><header>In
			 general</header><text>In promulgating regulations under and otherwise carrying
			 out this section and section 7, the Secretary shall consult and coordinate
			 with—</text>
					<subparagraph id="H1168AAA86F8C4F7296B1DD5F03B2BCE6"><enum>(A)</enum><text>other Federal
			 agencies and departments with authority to regulate taxa;</text>
					</subparagraph><subparagraph id="H9EF30468AAFE45F9B612666B85FECCF1"><enum>(B)</enum><text>State wildlife
			 agencies;</text>
					</subparagraph><subparagraph id="H584207CFC19B48B0BCA9112707D76390"><enum>(C)</enum><text>State
			 veterinarians; and</text>
					</subparagraph><subparagraph id="H229F48AD158441F2A7191C8A01A2D5DA"><enum>(D)</enum><text>other officials
			 with related authorities.</text>
					</subparagraph></paragraph><paragraph id="H7CD03758AB9741539117BD1FED84DADE"><enum>(2)</enum><header>Consultation by
			 secretary of agriculture</header><text>In any case in which the Secretary of
			 Agriculture participates in the World Organization for Animal Health, the
			 Secretary of Agriculture shall confer and consult with the Secretary on any
			 matters relating to prevention of wildlife diseases that may threaten the
			 United States.</text>
				</paragraph></subsection></section><section id="H56CD84E4613D440A92249BF26D951A59"><enum>11.</enum><header>Prohibitions</header>
			<subsection id="H30567BC8BA6A40EB9F41D19072A25E15"><enum>(a)</enum><header>Prohibitions</header><text>Except
			 as provided in this section or section 12, it shall be unlawful for any person
			 subject to the jurisdiction of the United States—</text>
				<paragraph id="H39809D9B92E748798C780FEB3E7872DE"><enum>(1)</enum><text>to import into the
			 United States any nonnative wildlife taxon the Director has designated as
			 Injurious I or Injurious II under section 5(a)(1)(A) or under section 6, or to
			 knowingly possess such an animal, or the descendant of such an animal, that was
			 imported in violation of this subsection;</text>
				</paragraph><paragraph id="H8941B91273D34A998BB0A714D71B8017"><enum>(2)</enum><text>to engage in
			 interstate commerce for any nonnative wildlife taxon described in paragraph
			 (1), or to knowingly possess such an animal, or the descendant of an animal,
			 that was transported in interstate commerce in violation of this
			 subsection;</text>
				</paragraph><paragraph id="HDEA8D3573342475FB5B9AACC29EB0F65"><enum>(3)</enum><text>to violate any
			 term or condition of a permit issued to a qualified institution under section
			 12 for a taxon designated as Injurious I under clause (i) of section 5(a)(1)(A)
			 or under section 6;</text>
				</paragraph><paragraph id="H8ED48FF74A1441B88A684D446129F321"><enum>(4)</enum><text>to release into
			 the wild any nonnative wildlife taxon described in paragraph (1);</text>
				</paragraph><paragraph id="HF4E555E2048A41EB898D0019DE314004"><enum>(5)</enum><text>to violate any
			 additional regulation promulgated by the Secretary as necessary to prevent the
			 importation of, and interstate commerce in, wildlife pathogens and harmful
			 parasites under this Act; or</text>
				</paragraph><paragraph id="HA1444761214E436DBF064F06B45C0D80"><enum>(6)</enum><text>to attempt any of
			 the prohibited actions described in paragraphs (1) through (5).</text>
				</paragraph></subsection><subsection id="HC991B6AD2DCF4C57BC2F1FAA571C8B68"><enum>(b)</enum><header>Exemption for
			 interstate transportation of animals of later-Regulated taxa</header>
				<paragraph id="H96B31F11AEDF4257B8F9F4A4B03E0B6F"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), an individual animal
			 that was lawfully owned prior to the taxa to which the animal belongs being
			 regulated by the Director under this Act as Injurious II may be transported
			 interstate without a permit by any person for noncommercial purposes
			 only.</text>
				</paragraph><paragraph id="H5D7D4DF8DA184EADB73F09C3DF88FFEA"><enum>(2)</enum><header>Exception</header><text>The
			 exemption under paragraph (1) does not apply to an animal of any taxa
			 designated by the Director as Injurious I.</text>
				</paragraph></subsection><subsection id="HA60AA7D2DD274A4B920909D5C85788CC"><enum>(c)</enum><header>Limitation on
			 Application</header>
				<paragraph id="H4BF61DAA7B554BA58EC29259EE626C23"><enum>(1)</enum><header>In
			 general</header><text>The prohibitions in this section shall not apply
			 to—</text>
					<subparagraph id="HD318178B5FAB415DB45EECF2256717B9"><enum>(A)</enum><text>any action by
			 Federal, State, tribal, or local law enforcement personnel to enforce this
			 section; and</text>
					</subparagraph><subparagraph id="H0A6BE6D5811D4A6899B71E19AEED7A60"><enum>(B)</enum><text>any action by
			 Federal, State, tribal, or local officials to prevent the introduction or
			 establishment of nonnative wildlife, or wildlife pathogens or parasites,
			 including actions to transport, hold, and shelter animals of taxa regulated
			 under this Act.</text>
					</subparagraph></paragraph><paragraph id="HDB840DC06D704588B552D753CBEE8E53"><enum>(2)</enum><header>Importation and
			 transportation by Federal agencies</header><text>Nothing in this Act shall
			 restrict the importation or transportation between any States of nonnative
			 wildlife by a Federal agency for the use of the Federal agency if the nonnative
			 wildlife remains in the possession of a Federal agency.</text>
				</paragraph></subsection><subsection id="H6A8ACD48680B494B974A9612816901DF"><enum>(d)</enum><header>Effective
			 date</header><text>This section takes effect on the date that is 30 days after
			 the date of promulgation of the final regulations under section 5(a).</text>
			</subsection></section><section id="H8AEC8C5030264D70892A212C9F15D862"><enum>12.</enum><header>Permits and
			 exemptions for qualified institutions and live animal transporters</header>
			<subsection id="H1505F6022DAE4C1A96250AF3A2494F9A"><enum>(a)</enum><header>Permits</header><text>The
			 Director may issue to a qualified institution a permit under this Act
			 authorizing any of the actions otherwise prohibited under section 11 for any
			 wildlife taxon designated under clause (i) or (ii) of section 5(a)(1)(A) or
			 under section 6.</text>
			</subsection><subsection id="H853FD44C4F01450EB4E1FC8BC469C19D"><enum>(b)</enum><header>Terms and
			 conditions</header><text>The Director may include in a permit under subsection
			 (a) terms and conditions to minimize the risk of introduction or establishment
			 of nonnative wildlife, pathogens, and parasites in the United States.</text>
			</subsection><subsection id="H20126D25574744CE9064E97AD608DC4A"><enum>(c)</enum><header>Exemption and
			 reporting</header>
				<paragraph id="H1E03F9A5670D4C2D8910E634702180CF"><enum>(1)</enum><header>In
			 general</header><text>No permit under this Act shall be required for any
			 qualified institution or any live animal transportation company or other live
			 animal transporter that is in temporary possession of an animal delivering it
			 to, or transporting it from, a qualified institution, to import or transport
			 (on an interstate or intrastate basis), or possess or breed, any taxon that the
			 Director has designated as an Injurious II taxon under section
			 5(a)(1)(A)(ii).</text>
				</paragraph><paragraph id="id687EC7DE59664CEA83ADD69DC0013E0B"><enum>(2)</enum><header>Display
			 exemption</header><text>No permit under this Act shall be required for the
			 import, interstate or intrastate transportation, possession, or breeding of an
			 Injurious I taxon by a qualified zoo or aquarium institution.</text>
				</paragraph><paragraph id="HF86687796B23494CB397B2EC1D3D6891"><enum>(3)</enum><header>Exclusions</header><text>The
			 exemptions described in paragraphs (1) and (2) do not include the transfer of
			 ownership of an Injurious I taxon or the transfer of ownership of an Injurious
			 II taxon to any person or entity other than to another qualified
			 institution.</text>
				</paragraph><paragraph id="H319CEB4D592042DD8DB19E3358F742BE"><enum>(4)</enum><header>Record</header><text>Each
			 qualified institution or live animal transporter that imports, transports (on
			 an interstate or intrastate basis), possesses, or breeds any taxa designated as
			 Injurious I or II shall maintain records, subject to annual inspection by the
			 Director, at the discretion of the Director, that summarize the transactions of
			 the qualified institution or live animal transporter for the covered
			 taxa.</text>
				</paragraph></subsection><subsection id="H8FEB2AA111CC4488A129783573AFD463"><enum>(d)</enum><header>Regulations;
			 list of qualified institutions</header><text>The Secretary shall—</text>
				<paragraph id="H91366271148144829BB784FE892C094A"><enum>(1)</enum><text>promulgate
			 regulations to implement this section; and</text>
				</paragraph><paragraph id="H3A5528E120584610B2CF40989CDEF6A6"><enum>(2)</enum><text>maintain a current
			 roster of designated qualified institutions on a publicly available Federal
			 Internet site and through other appropriate means.</text>
				</paragraph></subsection><subsection id="idC512059E1505422CBFF181B9C8CD26F3"><enum>(e)</enum><header>Report</header><text>Not
			 later than March 1 of each year, a qualified zoo or aquarium shall submit to
			 the Director a report on the imports, interstate or intrastate transportation,
			 possession, or breeding of any Injurious I taxon by the qualified zoo or
			 aquarium for the preceding calendar year.</text>
			</subsection></section><section id="HE81247FE408048FB82B1C8CDBFB9B830"><enum>13.</enum><header>User
			 fees</header>
			<subsection id="H019A55323DBF461E89CE02E70A2632E0"><enum>(a)</enum><header>Definition of
			 live wildlife shipments</header><text>In this section, the term <term>live
			 wildlife shipment</term> does not include shipments made by qualified
			 institutions for scientific, veterinary, or medical research, medical research,
			 education, conservation outreach, or display purposes.</text>
			</subsection><subsection id="idF870F2A50AF64C56866AB4CFA12C770D"><enum>(b)</enum><header>Reasonable
			 fee</header><text>Not later than 2 years after the date of enactment of this
			 Act, the Secretary shall propose, and subsequently adopt, by regulation, a
			 reasonable fee to be charged on imported live wildlife shipments for use in
			 recovering a portion of the costs of—</text>
				<paragraph id="H14446CA602204FCB950488F1013A9236"><enum>(1)</enum><text>improving the
			 information available on the importation and interstate commerce trade of
			 wildlife;</text>
				</paragraph><paragraph id="H6E4249DD6E664D53A9CBA965FD6F1BBC"><enum>(2)</enum><text>monitoring that
			 information under section 7;</text>
				</paragraph><paragraph id="H8909F43B79584AE0978C3A936E0F8405"><enum>(3)</enum><text>conducting risk
			 assessments and risk analyses for nonnative wildlife taxa in that trade under
			 sections 4 and 5;</text>
				</paragraph><paragraph id="H8D6B8682142941F29C4258F4915C0AD6"><enum>(4)</enum><text>making emergency
			 designations under section 6; and</text>
				</paragraph><paragraph id="H5BF8FD74D3164650950E2E722D8D5CBD"><enum>(5)</enum><text>preventing
			 wildlife pathogens and parasites under section 10.</text>
				</paragraph></subsection><subsection id="H0B51485E68514EA59567410E9033FC00"><enum>(c)</enum><header>Cost recovery
			 purpose</header><text>The purpose of the user fees in this section shall be to
			 recover approximately 75 percent of the costs to the Director for the services
			 listed in subsection (b), after such date as the user fee regulation under
			 subsection (b) is fully implemented and the amounts of the fees received have
			 been appropriated to the Injurious Wildlife Prevention Fund pursuant to section
			 16(b)(2)(A) for at least one full fiscal year.</text>
			</subsection><subsection id="HD1FF8880BD7B47F29BFD99325771F705"><enum>(d)</enum><header>Fee
			 limit</header>
				<paragraph id="id012D24AEE9F0462FAAE1C79B27B8385E"><enum>(1)</enum><header>In
			 general</header><text>The amount of the additional fee to be charged on any
			 live wildlife shipment under this section shall be set by the Secretary only
			 after fully considering public comments on the proposed fee regulation and it
			 shall be charged broadly and fairly across the live wildlife import industry
			 and at the lowest level feasible to achieve the cost recovery purpose in
			 subsection (c).</text>
				</paragraph><paragraph id="id8DD48B8AFFA341409E367574F61D37DB"><enum>(2)</enum><header>Annual total
			 fee revenue</header><text>The fees shall be set so that the annual total fee
			 revenue shall not exceed the amount of the annual total fee revenue of the fee
			 charged by the Director under the inspection program of the Director to oversee
			 the importation of live wildlife carried out pursuant to—</text>
					<subparagraph id="H349DDF9F78144872B46E7B92EEC32A5B"><enum>(A)</enum><text>section 11(f) of
			 the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1540">16 U.S.C. 1540(f)</external-xref>);</text>
					</subparagraph><subparagraph id="H2E8CD4440E3C413FAFA096C3821A3B1C"><enum>(B)</enum><text>subpart I of part
			 14 of title 50, Code of Federal Regulations (or successor regulations);
			 and</text>
					</subparagraph><subparagraph id="HA54D36452AB140D5A0A16E1C100C1CDC"><enum>(C)</enum><text>other applicable
			 authority.</text>
					</subparagraph></paragraph></subsection></section><section id="H112DF96CAF7D4C94AAB51D13F1F32843"><enum>14.</enum><header>Relationship to
			 State law</header>
			<subsection id="H85FC10BC6F4D4056A8B3551018D2E2A7"><enum>(a)</enum><header>Possession of
			 lawfully obtained injurious wildlife taxa</header><text>For purposes of this
			 Act, possession of lawfully obtained injurious wildlife taxa within a State
			 shall—</text>
				<paragraph id="id4A90E0973DD84F9391B8AA7BFDBD76DA"><enum>(1)</enum><text>be a matter of
			 State law; and</text>
				</paragraph><paragraph id="id5BD425C871AF49D8818930DF24F3DE01"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id5720E42BA0D6489DB369F39C140A36F2"><enum>(A)</enum><text>not be federally
			 regulated; or</text>
					</subparagraph><subparagraph id="id2C6E9DDB4476466581CA9B28CAA79C7E" indent="up1"><enum>(B)</enum><text>not require a Federal permit under
			 this Act.</text>
					</subparagraph></paragraph></subsection><subsection id="HA784CC2534C64C5DA613407DEB30FA5A"><enum>(b)</enum><header>Regulations and
			 determinations</header><text>Except as provided in subsection (c), nothing in
			 this Act, or in the regulations and determinations to be promulgated or issued
			 by the Secretary or the Director under this Act, preempts or otherwise affects
			 the application of any State law that establishes more stringent requirements
			 for—</text>
				<paragraph id="H46A0C1B74318404095A4196A4846334B"><enum>(1)</enum><text>the importation,
			 transportation, possession, sale, purchase, release, breeding of, or bartering
			 for, or any other transaction involving, any nonnative wildlife taxon;
			 or</text>
				</paragraph><paragraph id="HFB40D8E47E2648C0A35007F07130A50C"><enum>(2)</enum><text>the prevention of
			 wildlife pathogens and harmful parasites.</text>
				</paragraph></subsection><subsection id="H88A90A28414B40D99638F74977A7E550"><enum>(c)</enum><header>Limitation on
			 Application of prohibitions To prevent release</header><text>The Director may
			 limit the application of this Act to facilitate implementation of any State,
			 local, or tribal program that results in voluntary surrender of regulated
			 nonnative wildlife, if the Director determines that the limitation will prevent
			 the release of that wildlife.</text>
			</subsection></section><section id="H63D349E9DDD0442E819663A8CF35171B"><enum>15.</enum><header>Penalties and
			 sanctions</header>
			<subsection id="HCEC0DD2A62AC49A480096D22A93FA61C"><enum>(a)</enum><header>Civil
			 penalties</header>
				<paragraph id="H6CF6541781864D0FB946B8E39D0D4C2A"><enum>(1)</enum><header>Civil
			 administrative penalties</header>
					<subparagraph id="H8F60E2B9D8FD42669A98F71B16367994"><enum>(A)</enum><header>In
			 general</header><text>Any person who is found by the Secretary, after notice
			 and opportunity for a hearing conducted in accordance with section 554 of title
			 5, United States Code, to have committed any act prohibited by section 11 shall
			 be liable to the United States for a civil penalty in an amount not to exceed
			 $10,000 for each violation.</text>
					</subparagraph><subparagraph id="H050C2CC3141F4CAC99A1C839F0CB99E2"><enum>(B)</enum><header>Subpoena
			 power</header><text>For the purposes of conducting any investigation or hearing
			 under this Act, the Secretary may—</text>
						<clause id="HEB1B5F6B4B934A27A8D290301B2572D2"><enum>(i)</enum><text>issue subpoenas
			 for the attendance and testimony of witnesses and the production of relevant
			 papers, books, and documents; and</text>
						</clause><clause id="HC22910D652DC4932A63053EF24CE1217"><enum>(ii)</enum><text>administer
			 oaths.</text>
						</clause></subparagraph></paragraph><paragraph id="HFCC660DAF24B4ECAA6ED7A86EBD8FE78"><enum>(2)</enum><header>Civil judicial
			 penalties</header><text>Any person who violates any provision of this Act, or
			 any regulation promulgated or permit issued under this Act, shall be subject to
			 a civil penalty in an amount not to exceed $500 for each such violation.</text>
				</paragraph></subsection><subsection id="H3855401E40CC4A448D5DA74C74031EE9"><enum>(b)</enum><header>Criminal
			 offenses</header><text>Any person who knowingly violates any provision of this
			 Act, or any regulation promulgated or permit issued under this Act, shall, upon
			 conviction, be guilty of a class A misdemeanor.</text>
			</subsection><subsection id="HAF311FCF4C58498A8028AE9E35560313"><enum>(c)</enum><header>Natural resource
			 damages</header><text>All costs relating to the mitigation of injury caused by
			 a violation of this Act shall be borne by the person that violated this
			 Act.</text>
			</subsection><subsection id="H51C443A8DEC54480BA0ECE0B56C56266"><enum>(d)</enum><header>Enforcement</header>
				<paragraph id="H76E02B8908E54D37B6DE9A307FD37956"><enum>(1)</enum><header>Other powers and
			 authorities</header><text>Any person authorized by the Secretary to enforce
			 this Act shall have the same authorities as are described in section 6 of the
			 Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3375">16 U.S.C. 3375</external-xref>).</text>
				</paragraph><paragraph id="H7E1B7FC3435249D2B4480A74F19BEC63"><enum>(2)</enum><header>Forfeiture</header>
					<subparagraph id="H9E6814C6667A4F8F8BA0EB9E5A16C21F"><enum>(A)</enum><header>In
			 general</header><text>A person who is determined to have violated any provision
			 of this Act shall forfeit to the United States—</text>
						<clause id="H0C2F23B7DDE74C6CBB8C82951846DA09"><enum>(i)</enum><text>any
			 property, real or personal, taken or retained in connection with or as a result
			 of the offense; and</text>
						</clause><clause id="H71CE0A9A37774A3EBD12417BA7A7592D"><enum>(ii)</enum><text>any
			 property, real or personal, used or intended to be used to commit or to
			 facilitate the commission of the offense.</text>
						</clause></subparagraph><subparagraph id="H0B7FA8C062C044A3A2AD915747D1D6DE"><enum>(B)</enum><header>Disposal of
			 property</header><text>Upon the forfeiture to the United States of any property
			 or item described in clause (i) or (ii) of subparagraph (A), or upon the
			 abandonment or waiver of any claim to any such property or item, the property
			 or item shall be disposed of by the Secretary in a manner consistent with the
			 purpose of this Act.</text>
					</subparagraph></paragraph></subsection><subsection id="H4A1F04C8111643AFB53ABC6D27E10138"><enum>(e)</enum><header>Application of
			 customs laws</header><text>All powers, rights, and duties conferred or imposed
			 by the customs laws upon any officer or employee of the Customs Service may,
			 for the purpose of this Act, be exercised or performed by the Secretary, or by
			 such officers or employees of the United States as the Secretary may
			 designate.</text>
			</subsection></section><section id="HEC5B770B87BB46C295210D13F088F217"><enum>16.</enum><header>Injurious
			 wildlife prevention fund</header>
			<subsection id="HA72CA0D3781F4C3DB2FD066F051D8640"><enum>(a)</enum><header>Establishment</header><text>There
			 is established in the Treasury of the United States a Fund, to be known as the
			 <quote>Injurious Wildlife Prevention Fund</quote>, to be administered by the
			 Secretary, and to be available without fiscal year limitation and subject to
			 appropriation, for use in accordance with subsection (c).</text>
			</subsection><subsection id="H397A9E5832BE4732A69F57BD819CF3B6"><enum>(b)</enum><header>Transfers to
			 fund</header>
				<paragraph id="HBD6D1D6DA03244C89DE8FD1778B5A4F4"><enum>(1)</enum><header>In
			 general</header><text>The Fund shall consist of such amounts as are
			 appropriated to the Fund under paragraph (2).</text>
				</paragraph><paragraph id="H0C2EFA7CBE864634AB67395F852A02F9"><enum>(2)</enum><header>Fees and
			 penalties</header><text>There are appropriated to the Fund, out of funds of the
			 Treasury not otherwise appropriated, amounts equivalent to amounts
			 collected—</text>
					<subparagraph id="H6BD7E47D7B9444258044393B92623816"><enum>(A)</enum><text>as user fees and
			 received in the Treasury under section 13(a);</text>
					</subparagraph><subparagraph id="HA739D29603CA48AEA617CB7C0B8DBAA8"><enum>(B)</enum><text>as civil
			 administrative or judicial penalties under section 15; and</text>
					</subparagraph><subparagraph id="H306144F2509248DA8EF7467FA3EA7EDE"><enum>(C)</enum><text>as a civil penalty
			 for any violation of <external-xref legal-doc="usc" parsable-cite="usc/18/42">section 42</external-xref> of title 18, United States Code (including a
			 regulation promulgated under that section).</text>
					</subparagraph></paragraph></subsection><subsection id="H170F44F6320145F2ABADFBB76109ABB8"><enum>(c)</enum><header>Use of
			 funds</header>
				<paragraph id="HF22C2C0F9B06467BA0D75BD9CB4217FD"><enum>(1)</enum><header>In
			 general</header><text>Of the amounts deposited in the Fund for a fiscal
			 year—</text>
					<subparagraph id="H08067256342445F58ED8BFEBDB785440"><enum>(A)</enum><text>75 percent shall
			 be available to the Secretary for use in carrying out this Act (other than
			 paragraph (2)); and</text>
					</subparagraph><subparagraph id="H06E392224AFA48F1920D720853016995"><enum>(B)</enum><text>25 percent shall
			 be used by the Secretary to carry out paragraph (2).</text>
					</subparagraph></paragraph><paragraph id="H8E81C22F916D41FB84B35C0B9421C956"><enum>(2)</enum><header>Aid for state
			 wildlife risk assessments</header>
					<subparagraph id="HC019E910DDA74A66901646FAAFC73A8C"><enum>(A)</enum><header>In
			 general</header><text>The Secretary shall establish a program to provide
			 natural resource assistance grants to States for use in supporting best
			 practices and capacity-building by States, consistent with the purpose of this
			 Act, for—</text>
						<clause id="H748031034F6B481D8C9B359FEB290E33"><enum>(i)</enum><text>inspecting and
			 monitoring wildlife imports and interstate commerce; and</text>
						</clause><clause id="HA4889F0D480D4671A85E92E234EC5839"><enum>(ii)</enum><text>conducting
			 assessments of risk associated with the intentional importation of nonnative
			 wildlife taxa.</text>
						</clause></subparagraph><subparagraph id="HC62255265F444503A4C03721E0D62980"><enum>(B)</enum><header>Administration</header><text>The
			 program under this paragraph shall be administered by the Director under the
			 Federal Aid to States program of the Director.</text>
					</subparagraph></paragraph></subsection><subsection id="HB813C7FDBF0C449D9BFF14AE508D6FAF"><enum>(d)</enum><header>Prohibition</header><text>Amounts
			 in the Fund may not be made available for any purpose other than a purpose
			 described in subsection (c).</text>
			</subsection><subsection id="HAC459A7BD70749E0A92172551DADD572"><enum>(e)</enum><header>Annual
			 reports</header>
				<paragraph id="H08F65CFC0B1B4DEAA3A10D935056C4A9"><enum>(1)</enum><header>In
			 general</header><text>Not later than 60 days after the end of each fiscal year
			 beginning with fiscal year 2014, the Secretary shall submit to the Committee on
			 Appropriations of the House of Representatives, the Committee on Appropriations
			 of the Senate, the Committee on Environment and Public Works of the Senate, and
			 the Committee on Natural Resources of the House of Representatives a report on
			 the operation of the Fund during the fiscal year.</text>
				</paragraph><paragraph id="H60862111BAB448D1A6AC67B75B7A9F02"><enum>(2)</enum><header>Contents</header><text>Each
			 report shall include, for the fiscal year covered by the report, the
			 following:</text>
					<subparagraph id="HE905296F22B5420797E65949A0B70E83"><enum>(A)</enum><text>A statement of the
			 amounts deposited in the Fund.</text>
					</subparagraph><subparagraph id="H5F5554B2DE0F47539759D70D8E43D98B"><enum>(B)</enum><text>A description of
			 the expenditures made from the Fund for the fiscal year, including the purpose
			 of the expenditures.</text>
					</subparagraph><subparagraph id="HAA97D4D5387F4B15B4111E0449A93B9B"><enum>(C)</enum><text>Recommendations
			 for additional authorities to fulfill the purpose of the Fund.</text>
					</subparagraph><subparagraph id="H94B30B4074454146B2DF300F129ABD64"><enum>(D)</enum><text>A statement of the
			 balance remaining in the Fund at the end of the fiscal year.</text>
					</subparagraph></paragraph></subsection><subsection id="H35E35A6DECC24A82B23668C21C9736AA"><enum>(f)</enum><header>Separate
			 Appropriations account</header><text><external-xref legal-doc="usc" parsable-cite="usc/31/1105">Section 1105(a)</external-xref> of title 31, United States
			 Code, is amended—</text>
				<paragraph id="H77CBBBB0DB43406596E951F29481DD78"><enum>(1)</enum><text>by redesignating
			 paragraphs (35) and (36) as paragraphs (36) and (37), respectively;</text>
				</paragraph><paragraph id="H98E93E6412DF485593BF8C147136FDCF"><enum>(2)</enum><text>by redesignating
			 the second paragraph (33) (relating to obligational authority and outlays
			 requested for homeland security) as paragraph (35); and</text>
				</paragraph><paragraph id="HDA7CDFF50B31478DB3F95FE19BE7CE56"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="H2C1E6685D9D44DD8A840509396F9765E" style="OLC">
						<paragraph id="HAB03E61FA33642B39E362397078C54B3"><enum>(38)</enum><text>a separate
				statement for the Injurious Wildlife Prevention Fund established by section
				16(a) of the Invasive Wildlife Prevention Act of 2012, which shall include the
				estimated amount of deposits in the Fund, obligations, and outlays from the
				Fund.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="H73E634CBD7EE4158A7A33F2F65833654"><enum>17.</enum><header>Relationship to
			 other Federal laws</header><text display-inline="no-display-inline">Nothing in
			 this Act—</text>
			<paragraph id="HF41DD34591E84C90A7AFF4CC181E3783"><enum>(1)</enum><text>repeals,
			 supersedes, or modifies any provision of—</text>
				<subparagraph id="HA70A92581E6C4266B752FB424FAA951B"><enum>(A)</enum><text>the Public Health
			 Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/201">42 U.S.C. 201 et seq.</external-xref>);</text>
				</subparagraph><subparagraph id="H7AD3F3BFE2754A2088E1481A229B00E6"><enum>(B)</enum><text>the Federal Food,
			 Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/301">21 U.S.C. 301 et seq.</external-xref>);</text>
				</subparagraph><subparagraph id="HBBB5F547B84A438B90D94000DF12F9E0"><enum>(C)</enum><text>the Plant
			 Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/7/7701">7 U.S.C. 7701 et seq.</external-xref>);</text>
				</subparagraph><subparagraph id="HF6972D51CC1B4C2DB6AB91AB40F917FF"><enum>(D)</enum><text>the Animal Health
			 Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/7/8301">7 U.S.C. 8301 et seq.</external-xref>);</text>
				</subparagraph><subparagraph id="id739AD07F4BC44AB0A30D1A66323B674F"><enum>(E)</enum><text>the Animal
			 Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2131">7 U.S.C. 2131 et seq.</external-xref>); or</text>
				</subparagraph><subparagraph id="idF5A31135A0784EF2B2BE0ABF1FE8994F"><enum>(F)</enum><text>the
			 <act-name parsable-cite="ESA">Endangered Species Act of 1973</act-name> (16
			 U.S.C. 1531 et seq.); or</text>
				</subparagraph></paragraph><paragraph id="HAA401F37C1A74FB8820FF9ADF8FAA8AE"><enum>(2)</enum><text>authorizes any
			 action with respect to the importation of any plant pest, including a
			 biological control agent, under the Federal Plant Pest Act (7 U.S.C. 150aa et
			 seq.), to the extent that the importation is subject to regulation under that
			 Act.</text>
			</paragraph></section><section id="H406FAC63810543D783865685650CA854"><enum>18.</enum><header>Requirement to
			 promulgate regulations</header><text display-inline="no-display-inline">In
			 addition to regulations required under section 5 and other provisions of this
			 Act, the Secretary shall promulgate such regulations as are necessary to carry
			 out this Act.</text>
