		  Environmental Enforcement to promote the artificial reefs, and for other
		  purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Artificial Reef Promotion Act of
			 2013</short-title></quote>.</text>
		</section><section id="id96FCD2EB12FA45ADBAB3277143D8448B" section-type="subsequent-section"><enum>2.</enum><header>Permits for
			 construction and management of artificial reefs</header><text display-inline="no-display-inline">Section 205 of the National Fishing
			 Enhancement Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/33/2104">33 U.S.C. 2104</external-xref>) is amended—</text>
			<paragraph id="id5A31350A485F471D96B328DC6164EFCB"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (b) through
			 (e) as subsections (d) through (g), respectively; and</text>
			</paragraph><paragraph id="id30F1040ED4864AD58CF55A6D69B79BF7"><enum>(2)</enum><text>by striking
			 subsection (a) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="idCF67417D9BBD4EC6906078A7567B0101" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="id8A669DCC6A43447F9081CB22EE47C4A2"><enum>(a)</enum><header>Action on
				permits</header>
						<paragraph commented="no" display-inline="no-display-inline" id="id1AC483C4A1824356A36670DA0103B5DC"><enum>(1)</enum><header>In
				general</header><text>In issuing a permit for an artificial reef under section
				10 of the Act entitled <quote>An Act making appropriations for the
				construction, repair, and preservation of certain public works on rivers and
				harbors, and for other purposes</quote>, approved March 3, 1899 (commonly known
				as the <quote>Rivers and Harbors Appropriation Act of 1899</quote>) (33 U.S.C.
				403), section 404 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C. 1344</external-xref>),
				or section 4(e) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1333">43 U.S.C. 1333(e)</external-xref>),
				the Secretary shall—</text>
							<subparagraph id="id7da7522866cc4765a35cc44e055accfc"><enum>(A)</enum><text>consult with and
				consider the views of appropriate Federal agencies, States, local governments,
				and other interested parties;</text>
							</subparagraph><subparagraph id="id0932c978995b4db6b7a3feee72081035"><enum>(B)</enum><text>ensure that the
				provisions for siting, constructing, monitoring, and managing the artificial
				reef are consistent with the criteria and standards established under this
				Act;</text>
							</subparagraph><subparagraph id="id9f2eab0f5a0940d2af12760909bb4c77"><enum>(C)</enum><text>ensure that the
				title to the artificial reef construction material is unambiguous, and that
				responsibility for maintenance and the financial ability to assume liability
				for future damages are clearly established;</text>
							</subparagraph><subparagraph id="id8F2D8A7CB48E47C2AA9B0652AD7EA185"><enum>(D)</enum><text>ensure that a
				State assuming liability under subparagraph (C) has established an artificial
				reef maintenance fund; and</text>
							</subparagraph><subparagraph id="id7d172768f6594070bfd15628f72599b2"><enum>(E)</enum><text>consider the plan
				developed under section 204 and notify the Secretary of Commerce of any need to
				deviate from that plan.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA32704C4FD2D4887AA8E26F258152AF4"><enum>(2)</enum><header>Regulations</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="id8E44A78EC60D43E7B8471A4B7C66EB18"><enum>(A)</enum><header>In
				general</header><text>Not later than 180 days after the date of enactment of
				this paragraph, the Directors shall promulgate regulations that expedite the
				review of a final application such that a decision is rendered not later than
				150 days after the date on which the application is submitted.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id10BB12D56C5148648371DAC5397319ED"><enum>(B)</enum><header>Regulations
				promulgated by the Commanding General</header><text>Not later than 180 days
				after the date of enactment of the <short-title>Artificial
				Reef Promotion Act of 2013</short-title>, the Commanding General shall
				promulgate regulations that expedite the review of a final application by the
				Secretary such that a decision is rendered not later than 120 days after the
				date on which the application is submitted.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1D0B06F0E7AA48269A6AC2A86ACFAD3C"><enum>(b)</enum><header>Siting</header>
						<paragraph commented="no" display-inline="no-display-inline" id="id8C2815D38C7D4B55BDB00AE2FF4BEF35"><enum>(1)</enum><header>Number</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="id20A5E9EB78B24A8CB3CCD88CE8FF8EC7"><enum>(A)</enum><header>In
				general</header><text>Not later than 1 year after the date of enactment of the
				<short-title>Artificial Reef Promotion Act of
				2013</short-title>, the Commanding General shall, in consultation with the
				Directors and appropriate State agencies, designate not fewer than 20
				artificial reef planning areas.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9900ED613ACC4B4299DDA222AF3A29B9"><enum>(B)</enum><header>Gulf
				States</header><text>Of the artificial reef planning areas described in
				subparagraph (A)—</text>
								<clause commented="no" display-inline="no-display-inline" id="id1AAF5639D8894F7E98F3834448904BED"><enum>(i)</enum><text>6 shall be
				located outside the seaward boundary of the State of Texas;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id55EC77F62DC24ADCBEE15D7634C7BD08"><enum>(ii)</enum><text>6 shall be
				located outside the seaward boundary of the State of Louisiana;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id6C53FBBC3F1C4B88948CA3071E1A9E67"><enum>(iii)</enum><text>3 shall be
				located outside the seaward boundaries of the State of Alabama and State of
				Mississippi; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id6793305F521B41A28C28CE4B2E80B692"><enum>(iv)</enum><text>5 shall be
				located outside the seaward boundary of the State of Florida.</text>
								</clause></subparagraph><subparagraph id="id5b648a0baac246aa96c4b0dd56665509"><enum>(C)</enum><header>Inclusions</header><text>The
				sites described in subparagraph (A) include any artificial reef planning area
				existing on the day before the date of enactment of the Artificial Reef
				Promotion Act of 2013 if the boundaries and area of the site are modified to
				meet the requirements of this Act.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id792BF3B987B641F3A8602F702F8B21C0"><enum>(2)</enum><header>Boundaries and
				proximity to shoreline</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="id4C941191991B4602BA12EEBFB5B3DD60"><enum>(A)</enum><header>In
				general</header><text>The Directors shall, in consultation with the Commanding
				General and appropriate State agencies—</text>
								<clause commented="no" display-inline="no-display-inline" id="id0729FC7C013D4069AE62AAD822F3A928"><enum>(i)</enum><text>ensure that each
				artificial reef planning area described in paragraph (1)(A)—</text>
									<subclause commented="no" display-inline="no-display-inline" id="id8DFC258CF1704352BE779DA23A94FD39"><enum>(I)</enum><text>is sited a
				reasonable proximity to the shoreline, as determined by the Directors;
				and</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="idE9486EA63C7E410485DD68BAB5C3A468"><enum>(II)</enum><text>includes as many
				platforms as practical, as determined by the Directors; and</text>
									</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id87D603D103DA4305880F0866768F9747"><enum>(ii)</enum><text>determine the
				appropriate size and boundaries for each site.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAE2A3722558F4139865722A9886F1D48"><enum>(B)</enum><header>Minimum
				area</header>
								<clause commented="no" display-inline="no-display-inline" id="id1C6FD2800FB348F4AAE1650D54EE0272"><enum>(i)</enum><header>In
				general</header><text>Each artificial reef planning area described in paragraph
				(1)(A) shall be not smaller than 12 contiguous lease blocks.</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idFFB8443DA5BA4FFEB6A7E26915BE027A"><enum>(ii)</enum><header>Application</header><text>Clause
				(i) shall apply to any artificial reef planning area existing before, on, or
				after the date of enactment of the <short-title>Artificial
				Reef Promotion Act of 2013</short-title>.</text>
								</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id05F61C667E724B86A4E0943A1367BC62"><enum>(3)</enum><header>Distance
				between sites</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="id8355C4C1CEE4475DA57E582304D6643A"><enum>(A)</enum><header>In
				general</header><text>Not later than 180 days after the date of enactment of
				the <short-title>Artificial Reef Promotion Act of
				2013</short-title>, the Director of the Bureau of Safety and Environmental
				Enforcement shall promulgate a regulation that regulates the distance between
				platforms used as artificial reefs.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8E51F33126FC4713B12ED68F5476879E"><enum>(B)</enum><header>Maximum</header><text>The
				distance contained in the regulation described in subparagraph (A) shall be not
				greater than 2 miles.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEEF6EABE739244DABD69D2B4CF7ED137"><enum>(4)</enum><header>Depth</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="id6E783DDA4B544276BC9D4EEAB77C4816"><enum>(A)</enum><header>In
				general</header><text>Of the artificial reef planning areas described in
				paragraph (1)(A)—</text>
								<clause commented="no" display-inline="no-display-inline" id="idA73F92ACD66C4FC3A59E558EDA7D27B0"><enum>(i)</enum><text>not fewer than 10
				shall be located at a water depth of—</text>
									<subclause commented="no" display-inline="no-display-inline" id="id70056169689D423F9B594E407E49A097"><enum>(I)</enum><text>not less than 100
				feet; and</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="id30A3C9F79C8C48AA875C13808D20E5C9"><enum>(II)</enum><text>not greater than
				200 feet; and</text>
									</subclause></clause><clause commented="no" display-inline="no-display-inline" id="idABA9EC690276444B9399DF0D8223140C"><enum>(ii)</enum><text>not fewer than
				10 shall be located at a water depth of greater than 200 feet.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id954071B01F054570B4CD7AABBE8D8328"><enum>(B)</enum><header>Sites in water
				depth of not greater than 100 feet</header><text>The Commanding General shall,
				in consultation with the Directors and appropriate State agencies, designate
				artificial reef planning areas, where practicable, at a water depth of not
				greater than 100 feet.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id70A4E605446B4E7E944B144DA35EF946"><enum>(5)</enum><header>Requirements
				for permittees</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="idF6D4B71DB88C4D98B97AE477A186A283"><enum>(A)</enum><header>In
				general</header><text>A person to whom a permit is issued under subsection
				(a)(1) shall—</text>
								<clause commented="no" display-inline="no-display-inline" id="idCF6BB2A3F0444E729ABF76CB35CA1980"><enum>(i)</enum><text>construct the
				artificial reef in an artificial reef site located in an artificial reef
				planning area described in paragraph (1)(A);</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idB25C64B70516400785FFFFEBBC523118"><enum>(ii)</enum><text>comply
				with—</text>
									<subclause commented="no" display-inline="no-display-inline" id="idEEE881E00169421CAEED1CB5774CDBE9"><enum>(I)</enum><text>any regulation
				promulgated by the Director of the Bureau of Safety and Environmental
				Enforcement relating to reef planning;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="id7C7DCFEA314E413E923444C2658ACE8B"><enum>(II)</enum><text>the plan
				developed under section 204; and</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="idD61D55C32CDD4AA490A352224F5649A3"><enum>(III)</enum><text>any applicable
				plan developed by a State; and</text>
									</subclause></clause><clause commented="no" display-inline="no-display-inline" id="idD68C5F64F25B4634B546CB6CC4532945"><enum>(iii)</enum><text>if the person
				owns platforms, not later than 180 days after the date on which the Commanding
				General designates the artificial reef planning areas under paragraph (1),
				submit to the Director of the Bureau of Safety and Environmental Enforcement
				and appropriate State agencies notice that identifies 20 percent of the
				platforms to be used as artificial reefs.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8D7215059BC849D8AD03A0DA59C90FCA"><enum>(B)</enum><header>Donated
				platforms</header>
								<clause commented="no" display-inline="no-display-inline" id="id67506FF23DDD4E66A6114C4D92EBA2D4"><enum>(i)</enum><header>In
				general</header><text>A person described in subparagraph (A)(iii) shall include
				in a final application the artificial reef planning area and the artificial
				reef site in which the platforms described in subparagraph (A)(iii) will be
				located.</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idFEFE8664B24042DA8D8BED5BF9E5C045"><enum>(ii)</enum><header>Depth</header><text>The
				area and site described in clause (i) shall be consistent with the depth
				requirements in paragraph (4).</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idF16D7EA278594104924B4E61B7D3D886"><enum>(iii)</enum><header>Area or site
				filled to capacity</header><text>If the Director of the Bureau of Safety and
				Environmental Enforcement or appropriate State agency determines that the area
				or site chosen by the person under clause (i) is filled to capacity, the person
				shall choose a different area or site.</text>
								</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEFAB536F4FBA48C29BB02F80F71A287E"><enum>(6)</enum><header>Regulations</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="id43790EEDB2EF4F23828E1930573DBDD6"><enum>(A)</enum><header>Capacity of
				reef sites</header><text>No regulation shall require that an artificial reef
				planning area described in paragraph (1)(A) be filled to capacity with
				platforms before another artificial reef planning area is established.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7FAB02B52FBD41AA870D502335CE75F2"><enum>(B)</enum><header>Minimum water
				depth</header>
								<clause commented="no" display-inline="no-display-inline" id="id8DC932A3B5DB4C4F90FC2C92437A6CF4"><enum>(i)</enum><header>In
				general</header><text>The Secretary shall, in consultation with the Secretary
				of the department in which the Coast Guard is operating, promulgate regulations
				for the minimum water depth required to cover an artificial reef.</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id717114E6382140CF86AAC5739DF5A02A"><enum>(ii)</enum><header>Depth not
				greater than 85 feet</header><text>If the minimum water depth described in
				clause (i) is not greater than 85 feet, the Secretary of the department in
				which the Coast Guard is operating shall—</text>
									<subclause commented="no" display-inline="no-display-inline" id="idE056BC9F3BEA486999AF142B67B8FB3F"><enum>(I)</enum><text>evaluate each
				artificial reef site to ensure that the site is properly marked to reduce any
				navigational hazard;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="idA19B999934E949ACAB75D1E65D1FB187"><enum>(II)</enum><text>not later than
				30 days on which a final application is submitted, review the application to
				ensure that the artificial reef site will contain the markings described in
				subclause (I);</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="idD9CEB225FCE24D22A8BCE13A2D3C2450"><enum>(III)</enum><text>indicate on
				appropriate nautical charts the location of each artificial reef planning area
				and artificial reef site; and</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="idC146AD7E57CD4BF4B76AA0A02FF5C72C"><enum>(IV)</enum><text>provide mariners
				with notice of the location of each artificial reef site in a manner that the
				Secretary of the department in which the Coast Guard is operating determines is
				appropriate.</text>
									</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id39F429EE341A41829B93C3D0F28EEB70"><enum>(7)</enum><header>Review</header><text>Not
				later than 3 years after the date of enactment of the
				<short-title>Artificial Reef Promotion Act of
				2013</short-title>, the Director of the Bureau of Safety and Environmental
				Enforcement, shall review the artificial reef planning areas described in
				paragraph (1)(A) to determine the effectiveness of using decommissioned
				platforms as artificial reefs.</text>
						</paragraph></subsection><subsection id="idDA0F5A39F7CF405D9E2383A717BE2681"><enum>(c)</enum><header>Preference
				given to applications seeking To use decommissioned platforms as artificial
				reefs</header><text>The Regional Supervisor shall give preference to a final
				application.</text>
					</subsection><subsection id="idD4588D308EE14CDDB16BE95401BB2AD0"><enum>(d)</enum><header>Regulations
				governing decommissioned platforms</header><text>Any regulation in effect on
				the date of enactment of the <short-title>Artificial Reef
				Promotion Act of 2013</short-title> that governs the decommissioning or removal
				of a platform that is not being decommissioned for use as an artificial reef
				shall continue to govern the decommissioning or removal of the
				platform.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id19BF8C9305FE4079AA3ABC1E99A9AB1B" section-type="subsequent-section"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 206 of the National Fishing
			 Enhancement Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/33/2105">33 U.S.C. 2105</external-xref>) is amended—</text>
			<paragraph id="id103BCD2C3C0C4DD69B071D2EBA29617A"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (2) and (3) as
			 paragraphs (11) and (12), respectively; and</text>
			</paragraph><paragraph id="idD11F7A3D150342758C9F590F6CF8E1FB"><enum>(2)</enum><text>by inserting
			 after paragraph (1) the following:</text>
				<quoted-block display-inline="no-display-inline" id="id87A2A39E4160480CA84E5ADA8AA653E3" style="OLC">
					<paragraph id="id98DD37923B2842ABADDBD63AF032345B"><enum>(2)</enum><header>Artificial
				reef</header><text>The term <term>artificial reef</term> means a structure that
				is constructed or placed in the Gulf of Mexico for the purpose of enhancing
				fishery resources and commercial and recreational fishing opportunities.</text>
					</paragraph><paragraph id="id6A4B8EEC4BC14CC388BB1892B488B1DB"><enum>(3)</enum><header>Artificial reef
				planning area</header><text>The term <term>artificial reef planning area</term>
				means a designated area within which artificial reef sites may be located
				when—</text>
						<subparagraph id="id783A7C25BEF24C5BACB29167B0969773"><enum>(A)</enum><text>a person obtains
				all appropriate permits; and</text>
						</subparagraph><subparagraph id="idAAC24F06549E46B39CC66CAC38E2DFC3"><enum>(B)</enum><text>each platform
				located in the artificial reef site is appropriately prepared.</text>
						</subparagraph></paragraph><paragraph id="id77AFEDB8EAB349E2BAB3A3E2A79E3CB3"><enum>(4)</enum><header>Artificial reef
				site</header><text>The term <term>artificial reef site</term> means an area
				within an artificial reef planning area that has been cleared to have
				decommissioned platforms placed in the boundaries of the artificial reef
				planning area to be used as an artificial reef.</text>
					</paragraph><paragraph id="id4D5A7571FD764B08BCC2AF949AA77426"><enum>(5)</enum><header>Commanding
				General</header><text>The term <term>Commanding General</term> means the
				Commanding General of the Corps of Engineers.</text>
					</paragraph><paragraph id="id6640451958FE4B6A82C4326FD8CA317B"><enum>(6)</enum><header>Decommissioning</header><text>The
				term <term>decommission</term> includes removing and moving a platform to an
				artificial reef site.</text>
					</paragraph><paragraph id="id6DFFC148650E48449AB7225264DCED09"><enum>(7)</enum><header>Directors</header><text>The
				term <term>Directors</term> means—</text>
						<subparagraph id="id425EF5B83CBD45E9947943CE7568E345"><enum>(A)</enum><text>the Director of
				the Bureau of Safety and Environmental Enforcement; and</text>
						</subparagraph><subparagraph id="idD484AF76D38846CE89EE7243D4776989"><enum>(B)</enum><text>the Director of
				the Bureau of Ocean Energy Management.</text>
						</subparagraph></paragraph><paragraph id="idD560289236B34069A9B2AEB4FAC1DC12"><enum>(8)</enum><header>Final
				application</header><text>The term <term>final application</term> means a final
				application submitted to dispose of or remove a platform for use as an
				artificial reef under <external-xref legal-doc="usc" parsable-cite="usc/30/250">section 250.1727(g)</external-xref> of title 30, Code of Federal
				Regulations (or successor regulations).</text>
					</paragraph><paragraph id="idBDE2F5A71D1D4F2E9B5B352DA88ABC44"><enum>(9)</enum><header>Platform</header><text>The
				term <term>platform</term> means an offshore oil and gas platform in the Gulf
				of Mexico.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE0997C81B3FF483FBC3C73C36E2A09EB"><enum>(10)</enum><header>Secretary</header><text>The
				term <term>Secretary</term> means the Secretary of the
				Interior.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="idA6D11306EE804347BEB06D560F2824C8" section-type="subsequent-section"><enum>4.</enum><header>Savings
			 clauses</header><text display-inline="no-display-inline">Section 208 of the
			 National Fishing Enhancement Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/33/2106">33 U.S.C. 2106</external-xref>) is amended by adding
			 after subsection (b) the following:</text>
			<quoted-block display-inline="no-display-inline" id="id2ADEA4306CF04A1B963DC9D37BCA6DB7" style="OLC">
				<subsection id="id913226932AC543DE898FB04AD2F1DB09"><enum>(c)</enum><header>Miscellaneous</header><text display-inline="yes-display-inline">Nothing in this Act shall—</text>
					<paragraph id="id500908792D7F41B6AEA3D5844F0EFF5C"><enum>(1)</enum><text display-inline="yes-display-inline">hinder or invalidate—</text>
						<subparagraph id="idB75A7D0CC61B4334849456C7AB4A6122"><enum>(A)</enum><text display-inline="yes-display-inline">the transfer of liability to the person to
				whom title of a platform is transferred when the platform is donated or becomes
				an artificial reef; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8A5ED47067CB48E7B6FE33CE9322D191"><enum>(B)</enum><text>any term or
				condition of any existing lease; and</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC82AEF49F8CA4E46A5B68B6BE84A6E17"><enum>(2)</enum><text>require
				that—</text>
						<subparagraph id="id41da0649204b4ae8850fb616175ebc83"><enum>(A)</enum><text>a platform be
				left standing above the surface of the water; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf56248fe1f6e4364a9996e0076e23012"><enum>(B)</enum><text>an owner of a
				platform notify any party, other than the Directors and the appropriate State
				agencies that coordinate with the Commanding General, of any plan to
				decommission a platform before abandonment operations
				commence.</text>
