		<official-title>To promote innovative practices for the education of
		  English learners and to help States and local educational agencies with English
		  learner populations build capacity to ensure that English learners receive
		  high-quality instruction that enables them to become proficient in English,
		  access the academic content knowledge needed to meet State challenging academic
		  content standards, and be prepared for postsecondary education and
		  careers.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>English Learning and Innovation
			 Act</short-title></quote>.</text>
		</section><section id="id2C9F2E8CAD7A47E4A1AB7AF813E42506"><enum>2.</enum><header>English Learner
			 Competitive Grants</header>
			<subsection id="idE9AF3A18106A46ED9BC5564E529CA1B0"><enum>(a)</enum><header>In
			 General</header><text>Title III of the Elementary and Secondary Education Act
			 of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6801">20 U.S.C. 6801 et seq.</external-xref>) is amended—</text>
				<paragraph id="id060C95EC36FB4A9A945D0C92E779B757"><enum>(1)</enum><text>in section
			 3001(a)—</text>
					<subparagraph id="id3D20EF4F9BF84B8A99B1B3537626B598"><enum>(A)</enum><text>in paragraph (1),
			 by inserting “and part C” after “part B”; and</text>
					</subparagraph><subparagraph id="idD13E5388577C4DA58F7BA43DE6540A60"><enum>(B)</enum><text>by adding at the
			 end of the following:</text>
						<quoted-block display-inline="no-display-inline" id="idD011B9E0763E4B7A9E49B6D70FEBE94E" style="OLC">
							<paragraph id="idFB27B7FE4C8D4547AEC841AAA830A7C7"><enum>(3)</enum><header>English Learner
				Competitive Grants</header><text>There are authorized to be appropriated to
				carry out part C, $100,000,000 for fiscal year 2014 and each of the 5
				succeeding fiscal years.</text>
							</paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="idF40C1632FBEF44EB870C62AA0F10D468"><enum>(2)</enum><text>by redesignating
			 part C as part D;</text>
				</paragraph><paragraph id="id9C47FD6628F546BC9BEF7B0D4E988369"><enum>(3)</enum><text>by redesignating
			 sections 3301 through 3304 as sections 3401 through 3404, respectively;</text>
				</paragraph><paragraph id="idFCC2D9B5CEB44914A292477A83E6DFB4"><enum>(4)</enum><text>in section
			 3111(c)(1)(C), by striking <quote>3303</quote> each place the term appears and
			 inserting <quote>3403</quote>; and</text>
				</paragraph><paragraph id="id49C326891896463A9FCA5E6956851EF3"><enum>(5)</enum><text>in section
			 3116(d)(1), by striking <quote>3302</quote> and inserting
			 <quote>3402</quote>;</text>
				</paragraph><paragraph id="idE22C49DE215F43868D690A9B9290F0F1"><enum>(6)</enum><text display-inline="yes-display-inline">by inserting after part B the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="id52DCF7E8A85E46E39DAF6FAD252AD16F" style="OLC">
						<part id="id2E643844D44A4C69B30969FD3649AF29"><enum>C</enum><header>English Learner
				Competitive Grants.</header>
							<section id="idE832DF4B6F2543BBB2628867EE014192"><enum>3301.</enum><header>Purpose</header><text display-inline="no-display-inline">The purposes of this part are—</text>
								<paragraph id="idCE7CDA8EA496448591CCC79915983F2F"><enum>(1)</enum><text display-inline="yes-display-inline">to support eligible entities and eligible
				agencies in developing and strengthening innovative systems that support
				high-quality instruction for a diverse group of English learners, including
				English learners who have entered a school in the United States after
				elementary school or English learners who have been in schools in the United
				States for more than 5 years without achieving English language proficiency (as
				determined through the assessment described in section 1111(b)(7)), or both;
				and</text>
								</paragraph><paragraph id="id3D8E7CEF9F75464998781088BC0DA8FD"><enum>(2)</enum><text display-inline="yes-display-inline">to encourage successful strategies in
				providing coordinated literacy and parent engagement service models for
				low-literate limited English proficient parents of English learners.</text>
								</paragraph></section><section id="id90CF904805824FAC88F1D7C5BA0C584C"><enum>3302.</enum><header>Innovation
				grants</header>
								<subsection id="IDf97fa7f9cdc14904afdb70935e8315ea"><enum>(a)</enum><header>Program
				authorized</header><text>From amounts appropriated under section 3001(a)(3),
				the Secretary may award grants, on a competitive basis, to eligible entities
				that have demonstrated progress in establishing and committing to provide
				high-quality instruction that results in the ability of English learners to
				achieve English language proficiency and to demonstrate content mastery in core
				academic subjects to enable such eligible entities to carry out the activities
				described in subsection (f).</text>
								</subsection><subsection id="id75BFAA997094429A850DECD7888D4882"><enum>(b)</enum><header>Duration</header>
									<paragraph id="id62D1DF0E84E14EB28EB3013CD5FC8A5F"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Grants awarded under
				this section shall be for a period of not more than 4 years.</text>
									</paragraph><paragraph id="id172FA4597C824DC99864BFD083528F00"><enum>(2)</enum><header>Renewal</header><text display-inline="yes-display-inline">The Secretary may renew a grant under this
				section for an additional 2-year period, if the eligible entity demonstrates
				success in—</text>
										<subparagraph id="ID648ca47bdcca48c385a427f47c3dac8e"><enum>(A)</enum><text>improving the
				English language proficiency of students served by the grant program, as
				measured by the assessment described in section 1111(b)(7);</text>
										</subparagraph><subparagraph id="ID58019c64ddab410d8604e9f9f746a239"><enum>(B)</enum><text>increasing the
				percentage of English learners who achieve proficiency on the State academic
				assessment in mathematics, reading or language arts, and science, as described
				in section 1111(b)(3);</text>
										</subparagraph><subparagraph id="ID3b03d45a60c448c78dd2dca6969a9995"><enum>(C)</enum><text>increasing the
				percentage of secondary school students who achieve proficiency in core
				academic subjects;</text>
										</subparagraph><subparagraph id="id1b16fde431f242a6addc28e068ad0bd3"><enum>(D)</enum><text>increasing the
				awareness and knowledge of the education system for parents of English
				learners;</text>
										</subparagraph><subparagraph id="id060b371d9c024342ab505930d43c45e6"><enum>(E)</enum><text>improving the
				English language proficiency and literacy skills of parents served by the grant
				program; and</text>
										</subparagraph><subparagraph id="ID03ef5c9f1bfa418daa3ac45929c0186b"><enum>(F)</enum><text>increasing the
				graduation rate, as defined in section 1111(b)(2)(C)(vi) and clarified in
				<external-xref legal-doc="regulation" parsable-cite="cfr/34/200.19">section 200.19(b)(1)</external-xref> of title 34, Code of Federal Regulations, for English
				learners.</text>
										</subparagraph></paragraph></subsection><subsection id="id8B1ABE33D7DD49D797EB14E5B028F827"><enum>(c)</enum><header>Eligible
				entity</header><text>The term <term>eligible entity</term> means—</text>
									<paragraph id="id160C5E28B20F44BEAA99E6858B2274DD"><enum>(1)</enum><text>a State
				educational agency;</text>
									</paragraph><paragraph id="id66B1A1F340654DA6B4BF0F76A3C725AA"><enum>(2)</enum><text>a local
				educational agency; or</text>
									</paragraph><paragraph id="id7745E02AF82247DEABE408A76C8893CA"><enum>(3)</enum><text>a public charter
				school or a charter school management organization.</text>
									</paragraph></subsection><subsection id="id8D135EE02C54409C9F5B52F3EF4406BD"><enum>(d)</enum><header>Applications</header>
									<paragraph id="id428E6A0B58EE430DB20748BC14EC70BD"><enum>(1)</enum><header>In
				General</header><text>An eligible entity desiring a grant under this section
				shall submit an application to the Secretary at such time, in such manner, and
				containing such information as the Secretary may require.</text>
									</paragraph><paragraph id="id59F68893DC2D4D0A85E84D5106F41262"><enum>(2)</enum><header>Contents</header><text>At
				a minimum, the application described in paragraph (1) shall include the
				following:</text>
										<subparagraph id="id1336A6D87E514FD3845E0C64E182E2C0"><enum>(A)</enum><text>A description of
				how the eligible entity will use grant funds to implement English language
				proficiency standards, and the academic content standards and student academic
				achievement standards required under section 1111(b)(1), to assist English
				learners in—</text>
											<clause id="idC2E67771594A465BADEB12BF7D1380DD"><enum>(i)</enum><text>improving English
				language proficiency, academic achievement, and achievement in core academic
				subject areas; and</text>
											</clause><clause id="id836F45851A7F4EEFAE3CD9CD086627C6"><enum>(ii)</enum><text>improving
				preparation for postsecondary education and careers.</text>
											</clause></subparagraph><subparagraph id="ID8a9802dab8ef43e0b7bcff3c20628e1d"><enum>(B)</enum><text>A description of
				the benchmarks, consistent with section 3304(b)(1), that the eligible entity
				will establish to demonstrate improvements in outcomes for students who are
				English learners.</text>
										</subparagraph><subparagraph id="IDe6256983b78c423983bb00914a208aea"><enum>(C)</enum><text>A description of
				how the eligible entity has used the metrics described in subparagraphs (A)
				through (D) of subsection (b)(2) and the benchmarks described in subparagraph
				(B) to create a data-driven needs assessment that the eligible entity will use
				to determine how grant funds will be used.</text>
										</subparagraph><subparagraph id="ID9413dca428cd4865a9b319f49013e3ba"><enum>(D)</enum><text>A description of
				how the eligible entity will use Federal funds received under this section only
				to supplement the funds that would, in the absence of such Federal funds, be
				made available from non-Federal sources for the education of students
				participating in programs assisted under this section, and not to supplant such
				funds.</text>
										</subparagraph></paragraph></subsection><subsection id="id4D3ED2F3679D4E79B2388BBDAF19A5B2"><enum>(e)</enum><header>Priority</header><text>In
				awarding grants under this section, the Secretary shall give priority to
				eligible entities that—</text>
									<paragraph id="id64BA3487C28C44EBB80C310A262BC377"><enum>(1)</enum><text>use funds, or
				propose to use grant funds under this section, to—</text>
										<subparagraph id="IDe9d1148c67f34645ba84dd9bcd2a7614"><enum>(A)</enum><text>implement
				evidence-based strategies, as determined by the Secretary, for activities
				described in subsection (f);</text>
										</subparagraph><subparagraph id="IDbfea315a4e0f4ba9b42a32cb59292dc8"><enum>(B)</enum><text>provide
				educational opportunities for English learners who have entered a school in the
				United States after elementary school or English learners who have been in
				schools in the United States for more than 5 years without achieving English
				language proficiency (as determined through the assessment described in section
				1111(b)(7)), or both;</text>
										</subparagraph><subparagraph commented="no" id="idd543446fa17c4597818dcee9cab4478f"><enum>(C)</enum><text>provide a
				continuum of literacy, parenting, and parent engagement services for
				low-literate limited English proficient parents of young English learners;
				or</text>
										</subparagraph><subparagraph id="IDe3472692e07343bba1e2b5a03952e86e"><enum>(D)</enum><text>serve populations
				of rural students and students who are migratory children, as defined in
				section 1309(2);</text>
										</subparagraph></paragraph><paragraph id="idCA81B7AF676D487E8A92443E29E8FF41"><enum>(2)</enum><text>form partnerships
				with entities to carry out activities under the grant; or</text>
									</paragraph><paragraph id="ID46b2be0064ee4f7bac6bc09eb4979e77"><enum>(3)</enum><text>work with an
				educational research entity that is, at the time of the application,
				implementing research-based programs or interventions in schools that serve a
				significant percentage of English learners.</text>
									</paragraph></subsection><subsection id="ID8d1c91a263b7463e932a5fdb10a70a42"><enum>(f)</enum><header>Use of
				funds</header><text>Each eligible entity that receives a grant under this
				section shall use the grant funds to carry out activities that lead to English
				learners becoming proficient in English in order to access the academic content
				knowledge that English learners need to meet the State challenging academic
				content standards under section 1111(b)(1) and to be ready for postsecondary
				education and careers, which may include—</text>
									<paragraph id="id737E49F4648D4E6CBCF75C3987C041E3"><enum>(1)</enum><text>improving
				instructional programs by—</text>
										<subparagraph id="id9A1912B67F504554B2C281E514C71AB4"><enum>(A)</enum><text>implementing
				evidence-based language instruction programs, including—</text>
											<clause id="idAC20302F8737400A9ACB339562AB5DA8"><enum>(i)</enum><text>technology-based
				programs; and</text>
											</clause><clause id="id932C190224E64F1387E1CA39592AAD41"><enum>(ii)</enum><text>early childhood
				education programs, if applicable;</text>
											</clause></subparagraph><subparagraph id="id4F5C4982CF3D409591B1E1D799590505"><enum>(B)</enum><text>consistent with
				State law, implementing a program that uses instruction in the native language
				as a basis for English language acquisition, such as—</text>
											<clause id="idAC4F5A85A4804EAC90E5FD7D0E8F98B7"><enum>(i)</enum><text>a
				dual-language program; or</text>
											</clause><clause id="id4D20373E700644B384D37AD21FB1C07D"><enum>(ii)</enum><text>a bilingual
				education program; or</text>
											</clause></subparagraph><subparagraph id="idB57111950B584943A483FCBEF8626CE6"><enum>(C)</enum><text>obtaining
				technical assistance from an expert to develop or implement materials for
				English learner instruction;</text>
										</subparagraph></paragraph><paragraph id="ID30657bc2769747b6a81f6b3bc6c32bcf"><enum>(2)</enum><text>ensuring that
				English learners are taught by effective teachers and attend schools that are
				administered by effective principals, by—</text>
										<subparagraph id="id72CB2D6772BA426A90FC2ECA20CB164C"><enum>(A)</enum><text>developing or
				implementing a strategy to recruit effective teachers and principals;</text>
										</subparagraph><subparagraph id="id007ECCE9932F426D8083AFFCAF3D383C"><enum>(B)</enum><text>developing or
				implementing a strategy to retain effective teachers and principals; or</text>
										</subparagraph><subparagraph id="id6312E981714440C8B772D11B4ED70F68"><enum>(C)</enum><text>developing or
				implementing a strategy to improve the effectiveness of teachers and
				principals;</text>
										</subparagraph></paragraph><paragraph id="ID247c743e6f0a487d83109b4fa2c5147d"><enum>(3)</enum><text>increasing the
				ability of families of English learners to be engaged in their child’s
				education and development;</text>
									</paragraph><paragraph id="ID7c75fe08040049859ec4eb9699aedbbc"><enum>(4)</enum><text>expanding best
				practices to other schools or local educational agencies that are served by the
				eligible entity; or</text>
									</paragraph><paragraph id="id645A0EEF83A643C2BC0476325384E69B"><enum>(5)</enum><text>carrying out
				other activities consistent with the purpose of this part.</text>
									</paragraph></subsection></section><section id="idB5E89704170A4D1A8951B42BED589083"><enum>3303.</enum><header>Capacity
				building grants</header>
								<subsection id="id204EAD6C366E4511A1C88BD8DF440252"><enum>(a)</enum><header>Capacity
				Building Grants</header>
									<paragraph id="id31109FDBE5E14522B1908CDD0505A359"><enum>(1)</enum><header>In
				General</header><text display-inline="yes-display-inline">From amounts
				appropriated under section 3001(a)(3), the Secretary may award
				capacity-building grants, on a competitive basis, to eligible agencies that
				demonstrate a commitment to establishing and maintaining a system of
				high-quality instruction for English learners to enable such eligible agencies
				to carry out the activities described in subsection (g).</text>
									</paragraph><paragraph id="id717DCC4E780A4EB2B961EE3C2644FDE4"><enum>(2)</enum><header>Limitations</header><text>The
				Secretary shall not award a grant under this section to an eligible agency that
				has received a grant under section 3302.</text>
									</paragraph></subsection><subsection id="idE55BED027B12453BBCB7B9931EB26016"><enum>(b)</enum><header>Duration</header>
									<paragraph id="idCB61E56B79C647F191F8616622E994F2"><enum>(1)</enum><header>In
				General</header><text display-inline="yes-display-inline">Grants awarded under
				this section shall be for a period of not more than 4 years.</text>
									</paragraph><paragraph id="id11B0B8E0AFF74F11B8D63BF25EB6E64C"><enum>(2)</enum><header>Renewal</header><text display-inline="yes-display-inline">The Secretary shall not renew a grant under
				this section.</text>
									</paragraph></subsection><subsection id="ID70e92bfbfe9042c387c1743c4a8d2610"><enum>(c)</enum><header>Eligible
				agency</header><text>The term <term>eligible agency</term> means a State
				educational agency or local educational agency that has experienced a
				significant increase, as determined by the Secretary, in the number of English
				learners that the State educational agency or local educational agency,
				respectively, serves.</text>
								</subsection><subsection id="ID95364560fa4646ecb271fea87f78292c"><enum>(d)</enum><header>Funding
				requirement</header><text>Continued funding after the second year of the grant
				period for a grant awarded under this section shall be contingent on the
				eligible agency’s progress in—</text>
									<paragraph id="IDdb7b238f33504ddb885bbbfa1deff02a"><enum>(1)</enum><text>meeting the
				benchmarks described in subsection (e)(2)(B);</text>
									</paragraph><paragraph id="idD882B25A494746CD91686115D89D219B"><enum>(2)</enum><text>improving the
				English language proficiency of students served by the grant program, as
				measured by the assessment described in section 1111(b)(7);</text>
									</paragraph><paragraph id="ID1ca1690a5fa04481bd54e1b28799a921"><enum>(3)</enum><text>increasing the
				percentage of English learners who achieve proficiency on State academic
				assessments in mathematics, reading or language arts, and science, as described
				in section 1111(b)(3);</text>
									</paragraph><paragraph id="IDcdc8e636453c49d2891bc7c88f3a2c77"><enum>(4)</enum><text>increasing the
				percentage of secondary school students who achieve proficiency in core
				academic subjects;</text>
									</paragraph><paragraph commented="no" id="IDddd92907bb6f4aa9938d7fd37ef01b9c"><enum>(5)</enum><text>increasing the
				graduation rate, as defined in section 1111(b)(2)(C)(vi) and clarified in
				<external-xref legal-doc="regulation" parsable-cite="cfr/34/200.19">section 200.19(b)(1)</external-xref> of title 34, Code of Federal Regulations, for English
				learners;</text>
									</paragraph><paragraph id="id02d06d6078b549b880c8564613130eb2"><enum>(6)</enum><text>increasing the
				awareness and knowledge of the education system for parents of English
				learners; and</text>
									</paragraph><paragraph id="idf8f18f7087e14ac19ee1328701c88d65"><enum>(7)</enum><text>improving the
				English language proficiency and literacy skills of parents of English
				learners.</text>
									</paragraph></subsection><subsection id="idC3E783C9202642348436B8615EF0101C"><enum>(e)</enum><header>Applications</header>
									<paragraph id="idCDE943C77FFA40308F136E61C94E886D"><enum>(1)</enum><header>In
				General</header><text>An eligible agency desiring a grant under this section
				shall submit an application to the Secretary at such time, in such manner, and
				containing such information as the Secretary may require.</text>
									</paragraph><paragraph id="id6EC5FDD9FFAB43CEB563F371876FD188"><enum>(2)</enum><header>Contents</header><text>At
				a minimum, the application described in paragraph (1) shall include the
				following:</text>
										<subparagraph id="IDf51f199b5b404de4b165e7b15c3a01ff"><enum>(A)</enum><text>A description of
				how the eligible entity will use grant funds to implement English language
				proficiency standards and challenging student academic achievement standards
				and academic content standards under section 1111(b)(1) to assist English
				learners in—</text>
											<clause id="id5324FF6D949F4A1EB1360F3590054334"><enum>(i)</enum><text>improving English
				language proficiency;</text>
											</clause><clause id="id4520F74DA48D45A295EE0BCD5BC20059"><enum>(ii)</enum><text>improving
				preparation for postsecondary education and careers;</text>
											</clause><clause id="idd6d3a7e3ef96490b90c010f2a8feb977"><enum>(iii)</enum><text>improving the
				English language proficiency and literacy skills of their parents; and</text>
											</clause><clause id="iddde0e558f9c04050892bb470e7415e38"><enum>(iv)</enum><text>improving the
				knowledge and ability of their parents to navigate the education system.</text>
											</clause></subparagraph><subparagraph id="id1678970D7BBE492EA191491C8D7226B6"><enum>(B)</enum><text>A description of
				the benchmarks, consistent with section 3304(b), that the eligible agency will
				establish to demonstrate improvements in outcomes for students who are English
				learners.</text>
										</subparagraph><subparagraph commented="no" id="id0EC0B2BD3D514526971FE1FC8CE6F30E"><enum>(C)</enum><text>A description of
				how the eligible agency will efficiently use funds to build upon previous
				efforts to educate English learners and their parents.</text>
										</subparagraph><subparagraph commented="no" id="id29CBD6694D294266AF740517A81833CF"><enum>(D)</enum><text>A description of
				how the eligible entity will use Federal funds received under this section only
				to supplement the funds that would, in the absence of such Federal funds, be
				made available from non-Federal sources for the education of students
				participating in programs assisted under this section, and not to supplant such
				funds.</text>
										</subparagraph></paragraph></subsection><subsection id="id59670DE607A84769A2ADAD7C7351DB0B"><enum>(f)</enum><header>Priority</header><text>In
				awarding grants under this section, the Secretary shall give priority to
				eligible agencies that propose to use grant funds to implement evidence-based
				strategies, as determined by the Secretary, in order to become competitive in
				the application process for a grant described in section 3302.</text>
								</subsection><subsection id="id4B1D014EB71D4D8293EE458CDFB5144D"><enum>(g)</enum><header>Use of
				Funds</header>
									<paragraph id="idB0899D7E07FF489F9E1466D31FBBD861"><enum>(1)</enum><header>Required Use of
				Funds</header><text>An eligible agency that receives a grant under this section
				shall use the grant funds to carry out activities that—</text>
										<subparagraph id="idEFF4942BFE334B95AB3B4236A56901E2"><enum>(A)</enum><text>build the
				eligible agency's capacity to provide quality instruction to English learners
				and their parents; and</text>
										</subparagraph><subparagraph id="id14135850DF074AB9B4FFB1A6D9DB9613"><enum>(B)</enum><text>will allow the
				eligible agency to become competitive in the application process for a grant
				described in section 3302.</text>
										</subparagraph></paragraph><paragraph id="id84BEE63749204E49A6F7D575E25865FB"><enum>(2)</enum><header>Permissible Use
				of Funds</header><text>An eligible agency that receives a grant under this
				section may use the grant funds to ensure that English learners are taught by
				effective teachers and attend schools that are administered by effective
				principals, by—</text>
										<subparagraph id="ID337c19e210df4a60841a3e38521911d5"><enum>(A)</enum><text>developing or
				implementing a strategy to recruit effective teachers and principals;</text>
										</subparagraph><subparagraph id="ID6980f0be05f34d1789ce0d39224d3a1f"><enum>(B)</enum><text>developing or
				implementing a strategy to retain effective teachers and principals; or</text>
										</subparagraph><subparagraph id="ID08c31910942b4b0685addf84f233e9c4"><enum>(C)</enum><text>developing or
				implementing a strategy to improve the effectiveness of teachers and
				principals.</text>
										</subparagraph></paragraph></subsection></section><section id="idF00F36905D8D4DCF9E7E103EC0FDD158"><enum>3304.</enum><header>Indicators,
				evaluation, technical assistance, and research</header>
								<subsection id="idE1FE6DE5D78A4795AB14279032613CF5"><enum>(a)</enum><header>Indicators</header>
									<paragraph id="id81F64C6E31294BC3AFBECEF00E637C75"><enum>(1)</enum><header>In
				General</header><text display-inline="yes-display-inline">The Secretary, in
				consultation with the Director of the Institute of Education Sciences, shall
				establish indicators to measure the success of grant programs under this
				part.</text>
									</paragraph><paragraph id="ID1f3b959274964c7d97a2388857b7e8dd"><enum>(2)</enum><header>Primary
				indicator</header><text>The primary indicator described in paragraph (1) shall
				be the percentage of students who—</text>
										<subparagraph id="id8DA2A63D8CCC4E87850E35142381313C"><enum>(A)</enum><text>are English
				learners;</text>
										</subparagraph><subparagraph id="id48DA1C1B3D4C47BFBE7E3295EF48E549"><enum>(B)</enum><text>become English
				language proficient;</text>
										</subparagraph><subparagraph id="id778A783A930B4121BFBA1A730DE19CAA"><enum>(C)</enum><text>are on track for
				postsecondary education and a career;</text>
										</subparagraph><subparagraph id="id316a983bf44f40afb473c870f18177e9"><enum>(D)</enum><text>have parents who
				demonstrate improved English language or basic literacy skills;</text>
										</subparagraph><subparagraph id="idcdbf839d53ab4751a7c56557d64700d3"><enum>(E)</enum><text>have parents who
				increase their knowledge of the education system; and</text>
										</subparagraph><subparagraph id="id8ee87072f78d4d73a91d28657138d697"><enum>(F)</enum><text>have parents who
				increase their participation in their children’s education.</text>
										</subparagraph></paragraph></subsection><subsection id="id95424BE5477143E196C24EE05AF8F1EA"><enum>(b)</enum><header>Evaluation and
				Reports by the Eligible Entity</header><text display-inline="yes-display-inline">Each eligible entity and eligible agency
				receiving a grant under this part shall—</text>
									<paragraph id="ID05ee907a321748e595cd8aa97714d612"><enum>(1)</enum><text>develop
				quantifiable benchmarks to evaluate the activities that the eligible entity or
				eligible agency carries out under this part, based on the applicable indicators
				described in subsection (a), which may include—</text>
										<subparagraph id="id29E9AC609CCE450D8F770FFBC118C9B6"><enum>(A)</enum><text>the percentage of
				students who are English learners who obtain English proficiency;</text>
										</subparagraph><subparagraph commented="no" id="id43BA73F6B52D4756A257F730975B4275"><enum>(B)</enum><text>the rate of
				participation of students who are English learners in the State academic
				assessments under section 1111(b);</text>
										</subparagraph><subparagraph id="id410C701F526F417DB1DE5A78AA4D17C4"><enum>(C)</enum><text>the reduction in
				the percentage of students who are English learners and who are in the lowest
				level of achievement on such State assessments in English, reading or language
				arts, and mathematics;</text>
										</subparagraph><subparagraph id="id1426EC4134094660B7703576E01EDE05"><enum>(D)</enum><text>the percentage of
				students who are English learners and who are taking advanced
				coursework;</text>
										</subparagraph><subparagraph id="ida318e4f734874f16a7e48e2ea42d56d2"><enum>(E)</enum><text>the percentage of
				parents of English learners who advance at least one educational functioning
				level in English language proficiency, based on the Department's National
				Reporting System of Adult Education, after a year of participating in a program
				supported under this part;</text>
										</subparagraph><subparagraph id="id486957FB2AA140D499902C96F6A9CF52"><enum>(F)</enum><text>the percentage of
				parents of English learners who enter postsecondary education or job training
				after a year of participating in such program;</text>
										</subparagraph><subparagraph id="id9bc7b4dc24cf497a93ac96979bc947fc"><enum>(G)</enum><text>improvement,
				based on pre- and post- surveys, of the knowledge of the parents of English
				learners regarding the education system; or</text>
										</subparagraph><subparagraph id="idc8302ca364594e1ea30202422f84b9b2"><enum>(H)</enum><text>improvement,
				based on instructor observation, of child and parent interactions and reports
				of parent engagement;</text>
										</subparagraph></paragraph><paragraph id="id592AB388DB814200B837E8CCBE503180"><enum>(2)</enum><text display-inline="yes-display-inline">submit the benchmarks described in
				paragraph (1) to the Secretary for approval; and</text>
									</paragraph><paragraph id="idC921B2390BA744899EA59ED37730DBC0"><enum>(3)</enum><text display-inline="yes-display-inline">prepare and submit an annual report to the
				Secretary on the progress that the eligible entity or eligible agency is making
				toward meeting such benchmarks.</text>
									</paragraph></subsection><subsection id="id2CCBDB88FD4E40EEBE12BF099FF473A4"><enum>(c)</enum><header>Technical
				Assistance</header><text display-inline="yes-display-inline">The Secretary
				shall reserve not more than 1 percent from amounts appropriated in section
				3001(a)(3) to directly, or through grant or contract, provide technical
				assistance to eligible entities and eligible agencies to prepare the entities
				and agencies to qualify, apply for, and maintain grants under this part.</text>
								</subsection><subsection id="IDedf68aaf4b344913b7d8b94938ae0370"><enum>(d)</enum><header>Research and
				evaluation</header><text>The Secretary shall reserve not more than 0.5 percent
				from amounts appropriated in section 3001(a)(3) to evaluate grants or provide
				technical assistance for activities funded under this part.</text>
								</subsection></section><section id="idD8D743B99B9A487F8917DE193FC116FC"><enum>3305.</enum><header>Definitions</header><text display-inline="no-display-inline">In this part:</text>
								<paragraph id="id27AD41EDEAF74A29B0B6C967ED7AB7BA"><enum>(1)</enum><header>Dual language
				program</header><text>The term <term>dual language program</term> means an
				instructional strategy for English learners—</text>
									<subparagraph id="idDAD6BD7FE5B8460085B376AD80287511"><enum>(A)</enum><text>in which students
				are taught literacy and content in English and another language and use the
				other language for at least half of the instructional day; and</text>
									</subparagraph><subparagraph id="idFF63207C823F4DEC88BDC59D0EC1B419"><enum>(B)</enum><text>that fosters
				bilingualism, biliteracy, enhanced awareness of linguistic and cultural
				diversity, and high levels of academic achievement through instruction in 2
				languages.</text>
									</subparagraph></paragraph><paragraph id="idA44C4DF0D2434047A486EBFF096488AF"><enum>(2)</enum><header>English
				learner</header><text>The term <term>English learner</term> means an individual
				who is limited English proficient, as defined in section
				9101.</text>
