		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Fitness Integrated with Teaching
			 Kids Act</short-title></quote> or the <quote><short-title>FIT Kids Act</short-title></quote>.</text>
		</section><title id="id313C07A41AB74CF8B2BAE6EBE446BF3B"><enum>I</enum><header>Healthy students
			 grants</header>
			<section id="IDd668fa314ad34f90bf4207d654641f8b"><enum>101.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
				<paragraph id="IDbd1fdce14ec14005926142add2cbd312"><enum>(1)</enum><header>Physical
			 education indicators measurement system</header>
					<subparagraph id="idEB76272359A54F3880B290D3E711B15A"><enum>(A)</enum><header>In
			 general</header><text>The term <term>physical education indicators measurement
			 system</term> means a State reporting and information system that measures
			 student physical health and well-being, nutrition, and fitness based on the
			 physical education indicators and is, to the extent possible, part of the
			 State’s statewide longitudinal data system and part of the State’s system for
			 reporting the data required under section 1111 of the Elementary and Secondary
			 Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311</external-xref>).</text>
					</subparagraph><subparagraph id="ID991165e42f574f30be219669eb021ae6"><enum>(B)</enum><header>Description of
			 system</header><text>Such system shall—</text>
						<clause id="IDe68746f0b4cb444abdf56ee3bbf5ab6f"><enum>(i)</enum><text>contain, at a
			 minimum, data from valid and reliable surveys of students and staff on the
			 physical education indicators that allow staff at the State, local educational
			 agencies, and schools to examine and improve school-level conditions regarding
			 physical activity, education, and fitness and nutrition;</text>
						</clause><clause id="ID9b1c16fc5493404ca6888934e02e7111"><enum>(ii)</enum><text>collect
			 school-level data on the physical education indicators, in the aggregate and
			 disaggregated by the categories of race, ethnicity, gender, disability status,
			 migrant status, English proficiency, and status as economically disadvantaged,
			 and cross-tabulated across all of such categories by gender and by
			 disability;</text>
						</clause><clause id="ID9789ba70bffd4dd4a10df27b9fee6d33"><enum>(iii)</enum><text>protect student
			 privacy, consistent with applicable data privacy laws and regulations,
			 including section 444 of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232g">20 U.S.C. 1232g</external-xref>,
			 commonly known as the <quote>Family Educational Rights and Privacy Act of
			 1974</quote>); and</text>
						</clause><clause id="IDc19f0f65aa904fa4b82ac391e1410c38"><enum>(iv)</enum><text>to
			 the extent possible, utilize a web-based reporting system.</text>
						</clause></subparagraph></paragraph><paragraph id="ID6b13918213534d4a8590c0c43c60963f"><enum>(2)</enum><header>Eligible local
			 applicant</header><text>The term <term>eligible local applicant</term> means a
			 local educational agency, a consortium of local educational agencies, or a
			 nonprofit organization that has a track record of success in implementing the
			 proposed activities and has signed a memorandum of understanding with a local
			 educational agency or consortium of local educational agencies to—</text>
					<subparagraph id="idA4FB9EF836C947D8938298B9F0DADF68"><enum>(A)</enum><text>implement
			 school-based activities; and</text>
					</subparagraph><subparagraph id="id8B0612284E9C43ECADDD39D66A8FA185"><enum>(B)</enum><text>conduct
			 school-level measurement of the physical education indicators that are
			 consistent with this title.</text>
					</subparagraph></paragraph><paragraph commented="no" id="ID145c97fd60c948329b6d7d49c18bb833"><enum>(3)</enum><header>Local
			 educational agency</header><text>The term <term>local educational agency</term>
			 has the meaning given the term in section 9101 of the Elementary and Secondary
			 Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text>
				</paragraph><paragraph id="IDe0c02109cc0b40bd904f292b1b521b88"><enum>(4)</enum><header>Physical
			 education indicators</header><text>The term <term>physical education
			 indicators</term> means a set of measures for instruction on physical activity,
			 health-related fitness, physical competence, and cognitive understanding about
			 physical activity. Such indicators shall include—</text>
					<subparagraph id="ID0a2594d56c4742c79471b35ae893c829"><enum>(A)</enum><text>for the State,
			 for each local educational agency in the State, and for each school in the
			 State, the average number of minutes per week (averaged over the school year)
			 that all students spend in required physical education, and the average number
			 of minutes per week (averaged over the school year) that all students engage in
			 moderate to vigorous physical activity, as measured against established
			 recommended guidelines of the Centers for Disease Control and Prevention and
			 the Department of Health and Human Services;</text>
					</subparagraph><subparagraph id="IDe4b9b2ab4847450cb150cac34993f16a"><enum>(B)</enum><text>for the State,
			 the percentage of local educational agencies that have a required,
			 age-appropriate physical education curriculum that adheres to Centers for
			 Disease Control and Prevention guidelines and State standards;</text>
					</subparagraph><subparagraph id="ID2074dc9fa60443ffb2f4e1e91949cc70"><enum>(C)</enum><text>for the State,
			 for each local educational agency in the State, and for each school in the
			 State, the percentage of elementary school and secondary school physical
			 education teachers who are licensed or certified by the State to teach physical
			 education;</text>
					</subparagraph><subparagraph id="IDca402c72b44b405faf0157f0838c57b8"><enum>(D)</enum><text>for the State,
			 and for each local educational agency in the State, the percentage of schools
			 that have a physical education teacher who is certified or licensed in the
			 State to teach physical education and adapted physical education;</text>
					</subparagraph><subparagraph id="IDa5d3bd58bf9b43b29197cdd934464385"><enum>(E)</enum><text>for each school
			 in the State, the number of indoor square feet and the number of outdoor square
			 feet used primarily for physical education; and</text>
					</subparagraph><subparagraph id="idcd33bfb1f4944f4aaaec82801617aea5"><enum>(F)</enum><text>for the State,
			 the percentage of local educational agencies that have a school wellness
			 council that—</text>
						<clause id="idCC35D3006BC5494C9DE42AFAE89A5A05"><enum>(i)</enum><text>includes members
			 appointed by the local educational agency superintendent;</text>
						</clause><clause id="id2D0CFB5CED5049D9BD5E60A43F58734D"><enum>(ii)</enum><text>may include
			 parents, students, representatives of the school food authority,
			 representatives of the school board, school administrators, school nurses, and
			 members of the public; and</text>
						</clause><clause id="id55E2F4FAF6B341838B84AB3EB6C67298"><enum>(iii)</enum><text>meets regularly
			 to promote a healthy school environment.</text>
						</clause></subparagraph></paragraph><paragraph id="ID2faadd509efd40388425750f8f568452"><enum>(5)</enum><header>Program to
			 promote physical activity, education, and fitness and
			 nutrition</header><text>The term <term>program to promote physical activity,
			 education, and fitness and nutrition</term> means a program that—</text>
					<subparagraph id="id84995366D8DB4407B283D01FF85C863A"><enum>(A)</enum><text>increases and
			 enables active student participation in physical well-being activities and
			 provides teacher and school leader professional development to encourage and
			 increase such participation;</text>
					</subparagraph><subparagraph id="id8C7933DD30B54ED6B8C076EE31693DC6"><enum>(B)</enum><text>is comprehensive
			 in nature;</text>
					</subparagraph><subparagraph id="id0D8A6244C4F649F288F6D4354F274620"><enum>(C)</enum><text>includes
			 opportunities for professional development for teachers of physical education
			 to stay abreast of the latest research, issues, and trends in the field of
			 physical education; and</text>
					</subparagraph><subparagraph id="idCE0A44D5FB8848B1B938A755852161C6"><enum>(D)</enum><text>includes 1 or
			 more of the following activities:</text>
						<clause id="ID0c072e215370405f85aef558ddd8edf9"><enum>(i)</enum><text>Fitness education
			 and assessment to help students understand, improve, or maintain their physical
			 well-being.</text>
						</clause><clause id="IDed1a00ced81f44bc81b6c3eec89ffbe4"><enum>(ii)</enum><text>Instruction in a
			 variety of motor skills and physical activities designed to enhance the
			 physical, mental, social, and emotional development of every student.</text>
						</clause><clause id="IDc0ae41e21d1344efbd6e4953d1d1796e"><enum>(iii)</enum><text>Development of,
			 and instruction in, cognitive concepts about motor skill and physical fitness
			 that support a lifelong healthy lifestyle.</text>
						</clause><clause id="ID6704f972dd0a47cda081d66823a2429e"><enum>(iv)</enum><text>Opportunities to
			 develop positive social and cooperative skills through physical
			 activity.</text>
						</clause><clause id="ID799c92b597af46fd87f6353f7d725edb"><enum>(v)</enum><text>Instruction in
			 healthy eating habits and good nutrition.</text>
						</clause></subparagraph></paragraph><paragraph id="id32B8F0428A074EDF9E33FB8AD1A68C6A"><enum>(6)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Education.</text>
				</paragraph><paragraph commented="no" id="id5C320AEED45F45189B3F0E80FA987DD0"><enum>(7)</enum><header>State</header><text>The
			 term <term>State</term> has the meaning given the term in section 9101 of the
			 Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text>
				</paragraph></section><section id="ID9eefca3322ed4cd3b464494ed3bc11bb"><enum>102.</enum><header>Distribution
			 of funds</header><text display-inline="no-display-inline">From amounts made
			 available under section 105, the Secretary shall use—</text>
				<paragraph id="ID81b18b0146374c169fb8e340e70319d3"><enum>(1)</enum><text>in each year for
			 which funding is made available under such section, not more than 2 percent of
			 such amounts for technical assistance and evaluation;</text>
				</paragraph><paragraph id="ID31463e2c90694c238f07fc40b62e69eb"><enum>(2)</enum><text>for the first 3
			 fiscal years for which funding is made available under such section—</text>
					<subparagraph id="id977B4A1DD4B249D1A866D3FB1C789607"><enum>(A)</enum><text>except as
			 provided in subparagraph (B)—</text>
						<clause id="idB7FB1FCC230E44BD80D82EBC0199FAFE"><enum>(i)</enum><text>not
			 more than 30 percent of such amounts or $30,000,000, whichever amount is more,
			 for State measurement system grants, distributed to every State (by an
			 application process consistent with section 103(c)) in an amount proportional
			 to each State’s share of funding under part A of title I of the Elementary and
			 Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311 et seq.</external-xref>), to be used—</text>
							<subclause id="id2AE68FB300D34A4FBEA13AACA249C08D"><enum>(I)</enum><text>to develop the
			 State’s physical education indicators measurement system;</text>
							</subclause><subclause id="id13AC1159AE7B48C282926E29E0314693"><enum>(II)</enum><text>to conduct a
			 needs analysis to meet the requirements of section 103(c)(2)(C); and</text>
							</subclause><subclause id="idBC22FC638B0642B18B3187306E4B3193"><enum>(III)</enum><text>if grant funds
			 remain after carrying out subclauses (I) and (II), for activities described in
			 section 103(f); and</text>
							</subclause></clause><clause id="idBC786073303E4A22B1A621853D20EA6D"><enum>(ii)</enum><text>not more than 68
			 percent of such amounts for grants under section 103; and</text>
						</clause></subparagraph><subparagraph id="id00DBF182A89941BF980080126E084678"><enum>(B)</enum><text>for any fiscal
			 year for which the amount remaining available after funds are reserved under
			 paragraph (1) is less than $30,000,000, all of such remainder for the State
			 measurement system grants described in subparagraph (A)(i); and</text>
					</subparagraph></paragraph><paragraph id="IDd83153ab99fe4141a44c2a31dc18f5f1"><enum>(3)</enum><text>for the fourth
			 fiscal year and each subsequent fiscal year for which funding is made available
			 under section 105, not less than 98 percent of such amounts for grants under
			 section 103.</text>
				</paragraph></section><section id="IDd666b138361d408ab2d2070556990b11"><enum>103.</enum><header>Healthy
			 students grants</header>
				<subsection id="ID506603efec90487e8a5d3ea420042db6"><enum>(a)</enum><header>Grant program
			 authorized</header>
					<paragraph id="ID3257bdeaa67a4ad589874406a36164fc"><enum>(1)</enum><header>In
			 general</header><text>From amounts made available under paragraph (2)(A)(ii) or
			 (3) of section 102 for a fiscal year, the Secretary shall award grants to
			 States to implement comprehensive programs to promote physical activity,
			 education, and fitness and nutrition and that are based on—</text>
						<subparagraph id="id08AFA154277B411F805CA9CD66E4712A"><enum>(A)</enum><text>scientifically
			 valid research; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4CF73A549CF64A6FB7D14411C21F556C"><enum>(B)</enum><text>an analysis of
			 need that considers, at a minimum, the physical education indicators.</text>
						</subparagraph></paragraph><paragraph id="ID402a86ebe04a4c2b9069c664cab9eed9"><enum>(2)</enum><header>Awards to
			 States</header>
						<subparagraph id="IDfe7be8da054b447e8fa6cb1a6fae2380"><enum>(A)</enum><header>Formula
			 grants</header><text>For any fiscal year for which the total amount available
			 under (2)(A)(ii) or (3) of section 102 for grants under this section is
			 $250,000,000 or more, the Secretary shall allot to each State with an approved
			 application an amount that bears the same relationship to such total amount as
			 the amount received under part A of title I of the Elementary and Secondary
			 Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311 et seq.</external-xref>) by such State for such fiscal
			 year bears to the amount received under such part for such fiscal year by all
			 States.</text>
						</subparagraph><subparagraph id="id78966E5C65D844BAABED7CD16A6F3BB2"><enum>(B)</enum><header>Competitive
			 grants</header>
							<clause id="id21CEFC22CB2047FC9555AF6CD732DF47"><enum>(i)</enum><header>In
			 general</header><text>For any fiscal year for which the total amount available
			 under paragraph (2)(A)(ii) or (3) of section 102 for grants under this section
			 is less than $250,000,000, the Secretary shall award such grants to States on a
			 competitive basis.</text>
							</clause><clause id="ID0e00ad9a454d4f1e99f4de52ca8a194d"><enum>(ii)</enum><header>Sufficient
			 size and scope</header><text>In awarding grants on a competitive basis pursuant
			 to clause (i), the Secretary shall ensure that grant awards are of sufficient
			 size and scope to carry out required and approved activities under this
			 section.</text>
							</clause></subparagraph></paragraph></subsection><subsection id="ID1af434cf0b084a8c8a831e67226b7c00"><enum>(b)</enum><header>Eligibility</header><text>To
			 be eligible to receive a grant under this section, a State shall demonstrate
			 that the State has established a statewide physical education requirement that
			 is consistent with widely recognized standards.</text>
				</subsection><subsection id="id88BA029EFEB14231BAC3D1917DD833FA"><enum>(c)</enum><header>Applications</header>
					<paragraph id="ID0776169d304d4e5a9221545f47758e9b"><enum>(1)</enum><header>In
			 general</header><text>A State that desires to receive a grant under this
			 section shall submit an application at such time, in such manner, and
			 containing such information as the Secretary may require.</text>
					</paragraph><paragraph id="IDc867ccdb8f3247fdbfe91c228f312de7"><enum>(2)</enum><header>Content of
			 application</header><text>At a minimum, the application shall include—</text>
						<subparagraph id="ID38c51ee3a6a9424d843c2f57055b38da"><enum>(A)</enum><text>documentation of
			 the State’s eligibility to receive a grant under this section, as described in
			 subsection (b);</text>
						</subparagraph><subparagraph commented="no" id="IDf90bbe24bffc4a7aae542d053c5eac22"><enum>(B)</enum><text>a plan for
			 improving physical activity, education, and fitness and nutrition in schools in
			 the State in a manner consistent with the requirements of the program that may
			 be a part of a broader statewide child and youth plan, if such a plan exists
			 and is consistent with the requirements of this title;</text>
						</subparagraph><subparagraph id="IDeed054747d324330995b636e7af4a7d7"><enum>(C)</enum><text>a needs analysis
			 of the schools in the State regarding physical activity, education, and fitness
			 and nutrition, which—</text>
							<clause id="id15FDCEAA4BEC47CEAE498EDCFC5269D9"><enum>(i)</enum><text>shall include a
			 description of, and data measuring, the State's performance on the physical
			 education indicators; and</text>
							</clause><clause id="id15152FE3DBB14F2C83B8DCA3AF21C9C6"><enum>(ii)</enum><text>may be a part of
			 a broader statewide child and youth needs analysis, if such an analysis exists
			 and is consistent with the requirements of this title;</text>
							</clause></subparagraph><subparagraph id="IDc615f1be5d7d41bcac6a35174e466fd9"><enum>(D)</enum><text>a description of
			 how the programs to promote physical activity, education, and fitness and
			 nutrition that the State proposes to implement with grant funds are responsive
			 to the results of the needs analysis described in subparagraph (C); and</text>
						</subparagraph><subparagraph id="ID1c7c83c9da32408fb16752086b992b41"><enum>(E)</enum><text>a description of
			 how the State will—</text>
							<clause id="IDc21adb849d764a1792cc8f853d3686ef"><enum>(i)</enum><text>develop, adapt,
			 improve, or adopt, and implement, the State's physical education indicators
			 measurement system, and how the State will ensure that all local educational
			 agencies and schools in the State participate in such system;</text>
							</clause><clause id="ID817559dd88f74deb9c32b97581f91d85"><enum>(ii)</enum><text>ensure the
			 quality of the State's data collection for the physical education indicators,
			 including the State's plan for survey administration and for ensuring the
			 reliability and validity of survey instruments;</text>
							</clause><clause commented="no" id="IDd85edb335ce04a8b875e21e16e3f2224"><enum>(iii)</enum><text>coordinate the
			 proposed activities with other Federal and State programs, which may include
			 programs to expand learning time and for before- and after-school programming
			 in order to provide sufficient time to carry out the activities described in
			 this title;</text>
							</clause><clause id="ID65aa715c09b844e0b822bfbe83aeb22d"><enum>(iv)</enum><text>assist local
			 educational agencies in aligning activities carried out with funds the agencies
			 receive under the grant with other funding sources in order to support a
			 coherent and non-duplicative program;</text>
							</clause><clause id="ID4d0fb4053fe24964b563448626b6edf8"><enum>(v)</enum><text>solicit and
			 approve subgrant applications, including how the State will—</text>
								<subclause id="ID002537a731e444d189af6bd16197c086"><enum>(I)</enum><text>allocate funds
			 for statewide activities and subgrants for each year of the grant; and</text>
								</subclause><subclause id="ID6645fd699f9f4cc5b2ae12867ac5d36d"><enum>(II)</enum><text>consider the
			 results of the needs analysis described in subparagraph (C) in the State’s
			 distribution of subgrants;</text>
								</subclause></clause><clause id="ID26720d68a8994dc685438abaa0ab699c"><enum>(vi)</enum><text>address the
			 needs of diverse geographic areas in the State, including rural and urban
			 communities; and</text>
							</clause><clause id="id9ee9b0b8cc4346a7a03df3228944b309"><enum>(vii)</enum><text>assist local
			 educational agencies and schools in their efforts to increase the provision of
			 physical activity and physical education opportunities during the school day
			 and implement programs to promote physical activity, education, and fitness,
			 and nutrition.</text>
							</clause></subparagraph></paragraph><paragraph id="ID948417b844724ad9938f6d73ae75dae6"><enum>(3)</enum><header>Peer-review
			 process</header><text>The Secretary shall establish a peer-review process that
			 includes individuals with applicable expertise in physical activity, education,
			 or fitness or nutrition to review applications submitted under this
			 subsection.</text>
					</paragraph></subsection><subsection id="ID23c29078432b46cea04730861d1ad180"><enum>(d)</enum><header>Duration</header>
					<paragraph id="id82B7DB8E13E248B49807BC94E2021297"><enum>(1)</enum><header>In
			 general</header><text>A State that receives a grant under this section may
			 receive funding for not more than 5 years in accordance with this
			 subsection.</text>
					</paragraph><paragraph id="ID210217462e1d403ca04313d2daab590d"><enum>(2)</enum><header>Initial
			 period</header><text>The Secretary shall award grants under this section for an
			 initial period of not more than 3 years.</text>
					</paragraph><paragraph id="ID8f948116fe6844d4aa2d5e7554a756c8"><enum>(3)</enum><header>Grant
			 extension</header><text>The Secretary may extend a grant awarded to a State
			 under this section for not more than an additional 2 years if the State shows
			 sufficient improvement, as determined by the Secretary, against baseline data
			 for the performance metrics established under subsection (h)(1).</text>
					</paragraph></subsection><subsection id="idA25C8C2CD9DF4618BAE6A8657DF68E51"><enum>(e)</enum><header>Reservation and
			 use of funds</header><text>A State that receives a grant under this section
			 shall—</text>
					<paragraph id="ID74e6ca6cfa9e4b14aab8b0308fe366d8"><enum>(1)</enum><text>reserve not more
			 than 10 percent of the grant funds for administration of the program, technical
			 assistance, and the development, adaptation, improvement, or adoption, and
			 implementation of the State’s physical education indicators measurement system,
			 as described in paragraphs (1) through (5) of subsection (f); and</text>
					</paragraph><paragraph id="ID5bc9b6d7c5bf4866a5003500cca7af90"><enum>(2)</enum><text>use the remainder
			 of grant funds after making the reservation under paragraph (1) to award
			 subgrants, on a competitive basis, to eligible local applicants.</text>
					</paragraph></subsection><subsection id="IDe89f7905f99c4ed9bcc10acb4a42b883"><enum>(f)</enum><header>Required State
			 activities</header><text>A State that receives a grant under this section
			 shall—</text>
					<paragraph id="ID831853981e3b41f7b1d74b7fac841b67"><enum>(1)</enum><text>not later than 1
			 year after receipt of the grant, develop, adapt, improve, or adopt and
			 implement a physical education indicators measurement system (unless the State
			 can demonstrate, to the satisfaction of the Secretary, that an appropriate
			 system has already been implemented) that annually measures the State’s
			 progress regarding physical activity, education, and fitness and nutrition for
			 every public school in the State;</text>
					</paragraph><paragraph id="IDae0654940a76434da67a87a6d11d39d6"><enum>(2)</enum><text>collect
			 information in each year of the grant on physical activity, education, and
			 fitness and nutrition at the school level through comprehensive needs
			 assessments of student, school staff, and family perceptions, experiences, and
			 behaviors;</text>
					</paragraph><paragraph id="ID07d115f7f4f64c238f9fdb2ef1ec38d1"><enum>(3)</enum><text>publicly report,
			 at the school level and district level, the data collected in the physical
			 education indicators measurement system each year in a timely and highly
			 accessible manner and in a manner that does not reveal personally identifiable
			 information;</text>
					</paragraph><paragraph id="ID45b1b09423f8436085347f48f31fecc4"><enum>(4)</enum><text>use, on a
			 continuous basis, the results of the physical education indicators measurement
			 system to—</text>
						<subparagraph id="IDd6af2ae0f6d44a0ba2eabb3de0f5a1f2"><enum>(A)</enum><text>identify and
			 address student physical activity, education, and fitness needs
			 statewide;</text>
						</subparagraph><subparagraph id="IDf4a894cf3ddb4001ae310fd771387762"><enum>(B)</enum><text>help subgrantees
			 identify and address school and student needs; and</text>
						</subparagraph><subparagraph id="ID6b716393095b4beaab14ef1e9b3486c5"><enum>(C)</enum><text>provide
			 individualized assistance to the lowest-performing schools (consistent with
			 section 1116 of the Elementary and Secondary Education Act of 1965 (20 U.S.C.
			 6316)) and schools with significant weaknesses with respect to physical
			 activity, education, and fitness and nutrition as identified through the
			 physical education indicators measurement system with implementation of
			 activities under this title;</text>
						</subparagraph></paragraph><paragraph id="id00bdea1c046c4291b89c7500432f2c3a"><enum>(5)</enum><text>encourage local
			 educational agencies to—</text>
						<subparagraph id="id69ed9328cb4848cb90c75fb890de7d35"><enum>(A)</enum><text>integrate
			 physical activity, education, and fitness into a range of subjects throughout
			 the school day and locations within schools;</text>
						</subparagraph><subparagraph id="idc95c62053a80421c815d2c0f3d7811d5"><enum>(B)</enum><text>encourage
			 consultation with a variety of stakeholders, including families, students,
			 school officials, and other organizations with wellness and physical activity,
			 education, and fitness expertise; and</text>
						</subparagraph><subparagraph id="id382e968a3561420d980232c26a983faa"><enum>(C)</enum><text>regularly monitor
			 schools’ efforts in improving wellness and physical activity, education, and
			 fitness understanding and habits among students; and</text>
						</subparagraph></paragraph><paragraph id="ID856914fa065d404cac07dcbe8a02922f"><enum>(6)</enum><text>award subgrants
			 under subsection (g) to eligible local applicants.</text>
					</paragraph></subsection><subsection id="id757EA5117AC6414E82829ACF3FE27179"><enum>(g)</enum><header>Subgrants</header>
					<paragraph id="idE3110E0365424FF08CF2FAFB884376AE"><enum>(1)</enum><header>In
			 general</header>
						<subparagraph id="id92199113AFB44E6CBA70ED525C5FA1BB"><enum>(A)</enum><header>Awarding of
			 subgrants</header><text>A State that receives a grant under this section shall
			 award subgrants, on a competitive basis, to eligible local applicants—</text>
							<clause id="ID43adf4ec37784931827b1157b51a2d0b"><enum>(i)</enum><text>based on need, as
			 identified by—</text>
								<subclause id="idD873CFA48F224A1F99AC802043B6AE60"><enum>(I)</enum><text>data from the
			 State physical education indicators measurement system and, if available,
			 similar local systems; or</text>
								</subclause><subclause id="id05921AE7EEAA40D39F9291AB81E73DCF"><enum>(II)</enum><text>in the case of a
			 State for which the State physical education indicators measurement system
			 required under subsection (f)(1) is not yet implemented, other data determined
			 appropriate by the State;</text>
								</subclause></clause><clause id="ID366a2bd44c8f46988ca4822283c455a5"><enum>(ii)</enum><text>that are of
			 sufficient size and scope to enable the eligible local applicants to carry out
			 approved activities; and</text>
							</clause><clause id="ID6350f638993845b791b3246aceb944f2"><enum>(iii)</enum><text>to implement
			 programs to promote physical activity, education, and fitness and nutrition
			 that—</text>
								<subclause id="ID03e6bb7380c34359a543776579973a57"><enum>(I)</enum><text>are comprehensive
			 in nature; and</text>
								</subclause><subclause id="ID7320d50b890a457fafd70d83d9798525"><enum>(II)</enum><text>are based on
			 scientifically valid research.</text>
								</subclause></clause></subparagraph><subparagraph id="idAD80631984124AF3823D106293F79821"><enum>(B)</enum><header>Assistance</header><text>A
			 State that receives a grant under this section shall provide assistance to
			 subgrant applicants and recipients in the selection of scientifically valid
			 programs to promote physical activity, education, and fitness and
			 nutrition.</text>
						</subparagraph><subparagraph commented="no" id="id4464573F56384CD1B5BC4547E6C175D6"><enum>(C)</enum><header>Partnerships
			 allowed</header><text>An eligible local applicant may apply for a subgrant
			 under this subsection in partnership with 1 or more community-based
			 organizations.</text>
						</subparagraph></paragraph><paragraph commented="no" id="idFDCA432EABDF42ADB1DE0C73253D3591"><enum>(2)</enum><header>Applications</header><text>An
			 eligible local applicant that desires to receive a subgrant under this
			 subsection shall submit to the State an application at such time, in such
			 manner, and containing such information as the State may require.</text>
					</paragraph><paragraph id="IDefd28045d5934184b6f05f1b73346147"><enum>(3)</enum><header>Priority</header><text>In
			 awarding subgrants under this subsection, a State shall give priority to
			 applications that—</text>
						<subparagraph id="id01A020A1C12045569359CD90A5C887DD"><enum>(A)</enum><text>demonstrate the
			 greatest need according to the results of the State’s needs analysis described
			 in subsection (c)(2)(C); and</text>
						</subparagraph><subparagraph id="idF23F1AE6FB1C484E87D7FFB397573C83"><enum>(B)</enum><text>propose to serve
			 schools with the highest concentrations of poverty, based on the percentage of
			 students receiving or eligible to receive a free or reduced price lunch under
			 the Richard B. Russell National School Lunch Act (42 U.S.C. 1751 et
			 seq.).</text>
						</subparagraph></paragraph><paragraph id="ID362a52c659d643e7908177fd15da5384"><enum>(4)</enum><header>Activities of
			 subgrant recipients</header><text>Each eligible local applicant receiving a
			 subgrant under this subsection shall, for the duration of the subgrant—</text>
						<subparagraph id="IDcf6d1736e9384969b6fb3e0b487772be"><enum>(A)</enum><text>carry out, as
			 part of a program to promote physical activity, education, and fitness and
			 nutrition, activities—</text>
							<clause id="id3589150862134161B2F28B7FE4CC2DEE"><enum>(i)</enum><text>the
			 need for which has been identified, at a minimum—</text>
								<subclause id="idF41474D640C24E4BA0AD624330FCEFF8"><enum>(I)</enum><text>through the
			 physical education indicators measurement system; or</text>
								</subclause><subclause id="id0E7A5AECEEB24B949F9F1B968A9D6740"><enum>(II)</enum><text>in the case of a
			 State that has not yet implemented the physical education indicators
			 measurement system as required under subsection (f)(1), the State's needs
			 analysis described in subsection (c)(2)(C); and</text>
								</subclause></clause><clause commented="no" id="id9E1ABB7B62384E1B822DDF62CFBBE5E1"><enum>(ii)</enum><text>that are part of
			 a comprehensive strategy or framework to address such need;</text>
							</clause></subparagraph><subparagraph id="IDb7bb17d57dfd4adc895148e7b515234f"><enum>(B)</enum><text>ensure that each
			 activity selected as part of such program be based on scientifically valid
			 research and be used for the purpose for which such activity was found to be
			 effective;</text>
						</subparagraph><subparagraph id="ID16377b58153245ddb441f477916b98b9"><enum>(C)</enum><text>use school-level
			 data from the statewide physical education indicators, and use the statewide
			 physical education indicators measurement system when implemented by the State
			 as required under subsection (f)(1), to inform the implementation and
			 continuous improvement of activities carried out under this title;</text>
						</subparagraph><subparagraph id="IDe8ca67f293fd4916abc0cec2493b1425"><enum>(D)</enum><text>collect and
			 report to the State educational agency, data for schools served by the eligible
			 local applicant, in a manner determined by the State and consistent with the
			 State’s physical education indicators measurement system, when
			 established;</text>
						</subparagraph><subparagraph id="IDfaa4cd9e4ef444738255754ddde24da6"><enum>(E)</enum><clause commented="no" display-inline="yes-display-inline" id="id9E20507FE0944F3EAC0BF6A64F3FC146"><enum>(i)</enum><text>establish policies to
			 expand access to quality physical activity opportunities (including school
			 wellness policies); and</text>
							</clause><clause id="idb6328f826da640dcb42604eae51b1048" indent="up1"><enum>(ii)</enum><text>if the local educational agency to
			 be served through the grant does not have an active school wellness council
			 consistent with the requirements of the Child Nutrition Act of 1966 (42 U.S.C.
			 1771 et seq.), establish such a school wellness council, which may be part of
			 an existing school council that has the capacity and willingness to address
			 school wellness;</text>
							</clause></subparagraph><subparagraph id="IDc38f55dac0704034b4d3d2f89a84e75a"><enum>(F)</enum><text>engage family
			 members and community-based organizations in the development of physical
			 education indicators surveys, and in the planning, implementation, and review
			 of the eligible local applicant’s efforts under this title; and</text>
						</subparagraph><subparagraph id="IDecdb95613dff4912b12287a9b2c113b6"><enum>(G)</enum><text>consider and
			 accommodate the unique needs of students with disabilities and English language
			 learners in implementing activities.</text>
						</subparagraph></paragraph></subsection><subsection id="IDcb36f147cafa4db7b8823d736202c160"><enum>(h)</enum><header>Accountability</header>
					<paragraph id="IDabff4f5f055246bfb3de4212d39ba4d4"><enum>(1)</enum><header>Establishment
			 of performance metrics</header><text>The Secretary, acting through the Director
			 of the Institute of Education Sciences, shall establish program performance
			 metrics to measure the effectiveness of the activities carried out under this
			 title.</text>
					</paragraph><paragraph id="IDcb47b7d8e71c41cdb02012c8cc84dfcb"><enum>(2)</enum><header>Annual
			 report</header><text>Each State that receives a grant under this title shall
			 prepare and submit to the Secretary an annual report that includes information
			 relevant to the physical education indicators, including progress towards
			 meeting outcomes for the metrics established under paragraph (1).</text>
					</paragraph></subsection></section><section id="ID2ed2fc3e75bc414192bb229615aebc04"><enum>104.</enum><header>Funds reserved
			 for Secretary</header><text display-inline="no-display-inline">From the amount
			 reserved under section 102(1), the Secretary shall—</text>
				<paragraph id="IDc93f9b8b767c4b759cb8a52233fe9b7e"><enum>(1)</enum><text>direct the
			 Institute of Education Sciences to conduct an evaluation of the impact of the
			 practices funded or disseminated under this title; and</text>
				</paragraph><paragraph id="IDe5c8c00d054b4a53aa646e55bad36328"><enum>(2)</enum><text>provide technical
			 assistance to applicants for and recipients of, grants and subgrants under this
			 title.</text>
				</paragraph></section><section id="IDa808072a1db34af3ae5e032a038f3fcd"><enum>105.</enum><header>Authorization
			 of appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated to carry out this title such sums as may be
			 necessary for fiscal year 2014 and each of the 5 succeeding fiscal
			 years.</text>
			</section></title><title id="id0EE23A716BCB4E76A6532C15C19856DD"><enum>II</enum><header>Parental
			 involvement for healthy students; equal physical activity opportunities for
			 students with disabilities</header>
			<section commented="no" id="idA00090B6B2AA4ADF9CDA7B20FCFD2B58"><enum>201.</enum><header>Parental
			 involvement</header><text display-inline="no-display-inline">Section 1118(d)(1)
			 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6318">20 U.S.C. 6318(d)(1)</external-xref>) is
			 amended—</text>
				<paragraph commented="no" id="idbb7b64ba7876479dac348baaeaaf6680"><enum>(1)</enum><text>by inserting
			 <quote>, healthy,</quote> after <quote>supportive</quote>;</text>
				</paragraph><paragraph commented="no" id="id1cfaf894868e433ba2ad66ec0a3db7f1"><enum>(2)</enum><text>by striking
			 <quote>; and participating</quote> and inserting <quote>;
			 participating</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida3e80fe460df4e90acca7c339738d0bf"><enum>(3)</enum><text>by inserting
			 after <quote>extracurricular time</quote> the following: <quote>; and
			 supporting their children in leading a healthy and active life, such as by
			 providing healthy meals and snacks, encouraging participation in physical
			 education, and sharing in physical activity outside the school day to support
			 successful academic achievement</quote>.</text>
				</paragraph></section><section id="idAF4F4209529E48FCA8F328815354C04D"><enum>202.</enum><header>Equal physical
			 activity opportunities for students with disabilities</header>
				<subsection id="id65AD3BA973094A6099450E0C4CDDAF28"><enum>(a)</enum><header>In
			 general</header><text>Title V of the Rehabilitation Act of 1973 (29 U.S.C. 791
			 et seq.) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idDC2EA120AC9341718F818EEEF3BC3913" style="OLC">
						<section id="id041D8889853441D5882489842159DC83"><enum>511.</enum><header>Equal physical
				activity opportunities for students with disabilities</header>
							<subsection id="ID3990f5d8fa4243e0a288ecb25297b437"><enum>(a)</enum><header>In
				general</header><text>The Secretary shall promote equal opportunities for
				students with disabilities to be included and to participate in physical
				education and extracurricular athletics implemented in, or in conjunction with,
				elementary schools, secondary schools, and institutions of higher education, by
				ensuring the provision of appropriate technical assistance and guidance for
				schools and institutions described in this subsection and their
				personnel.</text>
							</subsection><subsection id="idF1A13AEC47F445F98DFEA1E921EFE138"><enum>(b)</enum><header>Technical
				assistance and guidance</header><text>The provision of technical assistance and
				guidance described in subsection (a) shall include—</text>
								<paragraph id="IDfcc3a37f26ca4534b401e476cfd36e28"><enum>(1)</enum><text>providing
				technical assistance to elementary schools, secondary schools, local
				educational agencies, State educational agencies, and institutions of higher
				education, regarding—</text>
									<subparagraph id="ID10a261fa24cf4c25ad7b6f5debd28ed6"><enum>(A)</enum><text>inclusion and
				participation of students with disabilities, in a manner equal to that of the
				other students, in physical education opportunities (including classes) and
				extracurricular athletics opportunities, including technical assistance
				on—</text>
										<clause id="id9734D783E52D4E3F812587024FF15D61"><enum>(i)</enum><text>providing
				reasonable modifications to policies, practices, and procedures; and</text>
										</clause><clause id="idFDFEEAD3B7C14958A563CD328E80380F"><enum>(ii)</enum><text>providing
				supports to ensure such inclusion and participation;</text>
										</clause></subparagraph><subparagraph id="IDe73693d1a56d4335bdad35a599e27ae1"><enum>(B)</enum><text>provision of
				adaptive sports programs, in the physical education and extracurricular
				athletics opportunities, including programs with competitive sports leagues or
				competitions, for students with disabilities; and</text>
									</subparagraph><subparagraph id="ID1aab32111df44175a1ff79abae73378b"><enum>(C)</enum><text>responsibilities
				of the schools, institutions, and agencies involved under section 504, the
				Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>), and any
				other applicable Federal law to provide students with disabilities equal access
				to extracurricular athletics;</text>
									</subparagraph></paragraph><paragraph id="IDa03c317fe8c34b31af983c2d39c56990"><enum>(2)</enum><text>facilitating
				information sharing among the schools, institutions, and agencies, and students
				with disabilities, on ways to provide inclusive opportunities in physical
				education and extracurricular athletics for students with disabilities;
				and</text>
								</paragraph><paragraph id="ID6cd196287a4c4ad089cc6a39895852e7"><enum>(3)</enum><text>monitoring the
				extent to which physical education and extracurricular athletics opportunities
				for students with disabilities are implemented in, or in conjunction with,
				elementary schools, secondary schools, and institutions of higher
				education.</text>
								</paragraph></subsection><subsection id="idF0FEF019064D4E8EBDFAE9D0271C4C7D"><enum>(c)</enum><header>Definitions</header><text>In
				this section:</text>
								<paragraph id="idA05004A177D2419592BFD5CC63C642AD"><enum>(1)</enum><header>Agencies</header><text>The
				terms <term>local educational agency</term> and <term>State educational
				agency</term> have the meanings given the terms in section 9101 of the
				Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text>
								</paragraph><paragraph id="id0137CDD92EAF4EA483216794ADEB19AE"><enum>(2)</enum><header>Schools and
				institutions</header><text>The terms <term>elementary school</term>,
				<term>secondary school</term>, and <term>institution of higher education</term>
				mean an elementary school, secondary school, or institution of higher
				education, respectively (as defined in section 9101 of the Elementary and
				Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)), that receives, or has 1 or
				more students that receive, Federal financial assistance.</text>
								</paragraph><paragraph id="idD4226250B5D94D5C82121DBDE37D6C86"><enum>(3)</enum><header>Student with a
				disability</header>
									<subparagraph id="idFDBE96297C30481DB669FC9D74C27675"><enum>(A)</enum><header>In
				general</header><text>The term <term>student with a disability</term> means an
				individual who—</text>
										<clause id="idDAF7C00C62F94DFAB0695BCFA96E2B1A"><enum>(i)</enum><text>attends an
				elementary school, secondary school, or institution of higher education;
				and</text>
										</clause><clause id="idDFE34D14364544A9A166C712079C81DC"><enum>(ii)</enum><text>who—</text>
											<subclause id="id296AB22F4CAB4A879A402FEB3FBB472D"><enum>(I)</enum><text>is eligible for,
				and receiving, special education or related services under part B of the
				Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1411">20 U.S.C. 1411 et seq.</external-xref>); or</text>
											</subclause><subclause id="id376BF8BE0053404D98166E04D25C3C6D"><enum>(II)</enum><text>is an individual
				with a disability, for purposes of section 504 or the Americans with
				Disabilities Act of 1990.</text>
											</subclause></clause></subparagraph><subparagraph id="id6A884C81C7674C31AF358DBD5976D586"><enum>(B)</enum><header>Students with
				disabilities</header><text>The term <term>students with disabilities</term>
				means more than 1 student with a
				disability.</text>
									</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="id325131BC2FFF43EABA637FB05AF3FF41"><enum>(b)</enum><header>Table of
			 contents</header><text>The table of contents in section 1(b) of the
			 Rehabilitation Act of 1973 is amended by inserting after the item relating to
			 section 509 the following:</text>
