		<section id="HC1CAE49CDCD0493995F740F754ABC4C4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Organ Mountains National Monument
			 Establishment Act</short-title></quote>.</text>
		</section><section id="H655559DDE7A9474F87EF4DC5CA45115F"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">For the purposes of this Act:</text>
			<paragraph id="HA45976DBCB664917BD53CF79C85E9073"><enum>(1)</enum><header>City</header><text>The
			 term <term>City</term> means the city of Las Cruces, New Mexico.</text>
			</paragraph><paragraph id="HBC17DF6891EB41EEBE1290658E6A4869"><enum>(2)</enum><header>County</header><text>The
			 term <term>County</term> means Dona Ana County, New Mexico.</text>
			</paragraph><paragraph id="HA1BD49AADE5446BAB3BBCACE4D2CEE38"><enum>(3)</enum><header>Management
			 plan</header><text>The term <term>management plan</term> means the management
			 plan developed pursuant to this Act.</text>
			</paragraph><paragraph id="HE1117B7D6EE440A3BE9A01BAF4A73408"><enum>(4)</enum><header>Map</header><text display-inline="yes-display-inline">The term <term>map</term> means the map
			 titled <quote>Organ Mountains National Monument</quote> and dated February 6,
			 2013.</text>
			</paragraph><paragraph id="H78F6A97B4B2545A892830D9D8B145533"><enum>(5)</enum><header>Monument</header><text display-inline="yes-display-inline">The term <term>monument</term> means the
			 national monument established by this Act.</text>
			</paragraph><paragraph id="H88BFE6988C3E4655B77ACD192DB2FADE"><enum>(6)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior, acting through
			 the Director of the Bureau of Land Management.</text>
			</paragraph><paragraph id="HAF2E826EC81045CCB7D03E7C0D644FC2"><enum>(7)</enum><header>State
			 director</header><text>The term <term>State Director</term> means the New
			 Mexico State Director of the Bureau of Land Management.</text>
			</paragraph><paragraph id="H9A39AD68CAD94E76866B1B1ECA9AC86F"><enum>(8)</enum><header>State</header><text>The
			 term <term>State</term> means the State of New Mexico.</text>
			</paragraph></section><section id="H6F93EC76ACBB47429D8BAFD350A15505"><enum>3.</enum><header>Water
			 rights</header><text display-inline="no-display-inline">Nothing in this Act
			 shall—</text>
			<paragraph commented="no" id="H7D4A3E0529094BD79325E2225282E926"><enum>(1)</enum><text display-inline="yes-display-inline">constitute or be construed to constitute
			 either an express or implied reservation by the United States of any water or
			 water rights with respect to the lands within the monument; or</text>
			</paragraph><paragraph commented="no" id="HAABFDF56329C48A59E24951DDB4C4D75"><enum>(2)</enum><text>affect any water
			 rights existing on the date of the enactment of this Act, including any water
			 right held by the United States.</text>
			</paragraph></section><section id="H198E650BB9904D4FBC46FC20EC348D59"><enum>4.</enum><header>Establishment of
			 monument</header>
			<subsection id="H2691E4441A994E009A788E1C8BA4DD65"><enum>(a)</enum><header>In
			 general</header><text>There is established the Organ Mountains monument in the
			 State.</text>
			</subsection><subsection id="H2C0E982E8CFF4D7394140D4A24E0FC30"><enum>(b)</enum><header>Area
			 included</header><text display-inline="yes-display-inline">The monument shall
			 consist of approximately 54,800 acres of public land in Dona Ana County in the
			 State, as generally depicted on the map.</text>
			</subsection></section><section id="H7AF330C4A10040BFB6B66C07E5C176A8"><enum>5.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of the monument are to
			 conserve, protect, and enhance the cultural, traditional, archaeological,
			 natural, ecological, geological, historical, wildlife, livestock, watershed,
			 educational, recreational, and scenic resources of the monument for the benefit
			 and enjoyment of present and future generations.</text>
		</section><section id="H3D458BBA580943D4A6CCFDAD22D39F5B"><enum>6.</enum><header>Management of
			 monument</header>
			<subsection id="H076AA91EA3C64DBBA097946220EFFDFB"><enum>(a)</enum><header>In
			 general</header><text>The Secretary shall manage the monument—</text>
				<paragraph id="H10BA3E11B0A349D49B3B479114EA3B32"><enum>(1)</enum><text>in a manner that
			 conserves, protects, and enhances the resources of the monument; and</text>
				</paragraph><paragraph id="H6577789C1FD54DE4AC6F9B86E83F15A6"><enum>(2)</enum><text>in accordance
			 with—</text>
					<subparagraph id="H88C5C4590F504F71BFDA410E59102C85"><enum>(A)</enum><text>the Federal Land
			 Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>);</text>
					</subparagraph><subparagraph id="H5F016A5E36C844C9A623EBC9B7D7B736"><enum>(B)</enum><text>this Act;
			 and</text>
					</subparagraph><subparagraph id="H25B79392936A4C90BBA2628347E09605"><enum>(C)</enum><text>any other
			 applicable laws.</text>
					</subparagraph></paragraph></subsection><subsection id="HEE17BA3B1F0B41F6888FAB9EE58116E8"><enum>(b)</enum><header>Uses</header>
				<paragraph id="HDE236A50E08C46C19DF21EE68F4D63D0"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall allow only such uses of the monument
			 that the Secretary determines would further the purposes described in section
			 5.</text>
				</paragraph><paragraph id="HF858DEAF2F414E29A02ADFB93E232249"><enum>(2)</enum><header>Use of motorized
			 vehicles</header><text display-inline="yes-display-inline">Except as needed for
			 administrative purposes or to respond to an emergency, the use of motorized
			 vehicles in the monument shall be permitted only on roads designated for use by
			 motorized vehicles in the management plan. Nothing in this Act precludes the
			 use of motorized vehicles or mechanical equipment for the construction or
			 maintenance of range improvements or the performance of standard ranching
			 operations or for the construction, maintenance, operation, or management of
			 flood control or water conservation systems.</text>
				</paragraph><paragraph id="H5C23CE1DB0CC45F1AC13E00A96CB1191"><enum>(3)</enum><header>New
			 roads</header><text>No additional road shall be built within the monument after
			 the date of the enactment of this Act unless the Secretary determines that the
			 road is necessary for public safety or natural resource protection.</text>
				</paragraph></subsection><subsection id="HD52118497D42434AB6909FF3A434A9E5"><enum>(c)</enum><header>Grazing</header><text>The
			 Secretary shall issue any grazing leases or permits in the monument in
			 accordance with the same laws and executive orders that apply to issuance by
			 the Secretary of grazing leases and permits on other land under the
			 jurisdiction of the Bureau of Land Management.</text>
			</subsection><subsection id="HC1EDCCFCFFF342B594CDE54C68B7DAE8"><enum>(d)</enum><header>Utility
			 right-of-Ways</header><text>Nothing in this section precludes the Secretary
			 from authorizing, renewing or upgrading (including widening) a utility
			 right-of-way through the monument in a manner that minimizes harm to the
			 purposes of the monument in accordance with—</text>
				<paragraph id="HA8BE90BEF6D44A5BA85F182550E39DAA"><enum>(1)</enum><text>the National
			 Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>);</text>
				</paragraph><paragraph id="H7804F5190C53402580BD13C642CC1846"><enum>(2)</enum><text>any other
			 applicable law; and</text>
				</paragraph><paragraph id="H67D9AA12F4C748FBB003F38550C86A9C"><enum>(3)</enum><text>such terms and
			 conditions as the Secretary determines to be appropriate.</text>
				</paragraph></subsection></section><section id="H894D012BDC9A4B628346CBB28AA85AE2"><enum>7.</enum><header>Management
			 plan</header>
			<subsection id="H61D5F11715C249738D1EF251EC1EC587"><enum>(a)</enum><header>In
			 general</header><text>Not later than 3 years after the date of the enactment of
			 this Act, the Secretary shall develop a management plan for the
			 monument.</text>
			</subsection><subsection id="H9BE38709979C4F8EA72FDAB6D9E533CE"><enum>(b)</enum><header>Consultation</header><text>The
			 management plan shall be developed in consultation with—</text>
				<paragraph id="H6A721656789C4BA7834F9450BACB4785"><enum>(1)</enum><text>State, tribal, and
			 local governments;</text>
				</paragraph><paragraph id="H239A9B7BF58248528393C8EA73F595CF"><enum>(2)</enum><text>the public;
			 and</text>
				</paragraph><paragraph id="HBF4EF1E6E0CA485691C6239886136203"><enum>(3)</enum><text>interested Federal
			 agencies.</text>
				</paragraph></subsection></section><section id="HE73422BD60EC4152B48F3AE4548B2683"><enum>8.</enum><header>General
			 provisions</header>
			<subsection id="H74C158433649444B9617034BE93C2705"><enum>(a)</enum><header>Map and legal
			 description</header>
				<paragraph id="HA7DD275D4E604847A29ABC886E3B5D52"><enum>(1)</enum><header>In
			 general</header><text>As soon as practicable after the date of the enactment of
			 this Act, the Secretary shall file the map and legal description of the
			 monument.</text>
				</paragraph><paragraph id="H15741D923E11486B82074B8258B913E2"><enum>(2)</enum><header>Force and
			 effect</header><text>The map and legal description filed under paragraph (1)
			 shall have the same force and effect as if included in this Act, except that
			 the Secretary may correct errors in the map and legal description.</text>
				</paragraph><paragraph id="H35D0BDD726734BD6BBD8CF137EBE0F9C"><enum>(3)</enum><header>Public
			 availability</header><text>The map and legal description filed under paragraph
			 (1) shall be on file and available for public inspection in the appropriate
			 offices of—</text>
					<subparagraph id="H0E876EDFE3F64AAE94FABD5FE1C0CF69"><enum>(A)</enum><text>the Bureau of Land
			 Management; and</text>
					</subparagraph><subparagraph id="HB36AFF47EDE14330B119BB6BEC37E1DD"><enum>(B)</enum><text>the Office of the
			 County Clerk of Dona Ana County, New Mexico.</text>
					</subparagraph></paragraph><paragraph id="H878E22998913499794474EB4A01195E4"><enum>(4)</enum><header>Fish and
			 wildlife</header><text>Nothing in this Act affects the jurisdiction of the
			 State with respect to fish and wildlife located on public land in the
			 State.</text>
				</paragraph><paragraph id="H94CECCC361C448898EDD981A795BAED8"><enum>(5)</enum><header>No buffer
			 zones</header>
					<subparagraph id="HA01F9596D2D94E4781011CBC0B5DF650"><enum>(A)</enum><header>In
			 general</header><text>There shall be no buffer zone around a monument.</text>
					</subparagraph><subparagraph id="HE06D3BF9A7924C8D819C682CE17EEA5D"><enum>(B)</enum><header>Activities
			 outside the monument</header><text>The fact that an activity or use of land is
			 not permitted on land within a monument shall not preclude the activity or use
			 outside the boundary of the monument or on private or State land within the
			 monument, consistent with other applicable laws.</text>
					</subparagraph></paragraph><paragraph id="H95232F8A370E4A7EAE68B3333A2A2D7E"><enum>(6)</enum><header>Withdrawals</header><text>Subject
			 to valid existing rights (including lease rights), all Federal land within the
			 monument and any land and interests in land acquired for the monument by the
			 United States after the date of the enactment of this Act are withdrawn
			 from—</text>
					<subparagraph id="H87827874EF2141BFAFF156DC297B078A"><enum>(A)</enum><text>all forms of
			 entry, appropriation, or disposal under the public land laws;</text>
					</subparagraph><subparagraph id="H8E80B2E3313B4E45B3B0D4EA7829DB6F"><enum>(B)</enum><text>location, entry,
			 and patent under the mining laws; and</text>
					</subparagraph><subparagraph id="H1561794CD3C54EB695912C84B4D93A3B"><enum>(C)</enum><text>operation of the
			 mineral leasing, mineral materials, and geothermal leasing laws.</text>
					</subparagraph></paragraph></subsection></section><section id="H37ABF51B39524160BA04FFFC8C4F994A"><enum>9.</enum><header>Hunting and
			 trapping</header>
			<subsection id="H3F76CBE29AA14098AD0D0CFD74A5A22B"><enum>(a)</enum><header>In
			 general</header><text>The Secretary shall allow hunting and trapping in the
			 monument.</text>
			</subsection><subsection id="HDAAF8E103AC24262AD0D68694C9B6FDF"><enum>(b)</enum><header>Limitations</header>
				<paragraph id="H64968AB1AE9C40DCA2EC3B72D6F31D2B"><enum>(1)</enum><header>Regulations</header><text>The
			 Secretary may designate by regulation areas in the monument in which, and
			 establish periods during which no hunting or trapping will be allowed for
			 reasons of public safety, administration, or compliance with applicable
			 laws.</text>
				</paragraph><paragraph id="HFD67E63E867248C6956E00D822C4B209"><enum>(2)</enum><header>Consultation</header><text>The
			 Secretary shall obtain the concurrence of the appropriate State agency before
			 promulgating regulations under paragraph (1) that close a portion of the
			 monument to hunting or trapping.</text>
				</paragraph></subsection></section><section id="HCA01EB6096804030A4724293502DC270"><enum>10.</enum><header>Release of
			 wilderness study area</header><text display-inline="no-display-inline">For
			 purposes of section 603 of the Federal Land Policy and Management Act of 1976
			 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782</external-xref>), the Federal land in the following has been adequately studied
			 for wilderness designation and shall no longer be subject to section 603(c) of
			 the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>):</text>
			<paragraph id="HD8F0B02231904DA586B8A44FA062B7FD"><enum>(1)</enum><text display-inline="yes-display-inline">The Organ Mountains Wilderness Study
			 Area.</text>
			</paragraph><paragraph id="H615C374363F94C069E7E39D1E1892CF9"><enum>(2)</enum><text>The Organ Needles
			 Wilderness Study Area.</text>
			</paragraph><paragraph id="H2CA264A1D61A4BC3BEB2A0D93D162D33"><enum>(3)</enum><text>The Pena Blanca
			 Wilderness Study Area.</text>
			</paragraph></section><section id="HA7533F161B3644B7AAD32E336AB385EF"><enum>11.</enum><header>Law
			 enforcement</header><text display-inline="no-display-inline">Nothing in this
			 Act, or regulations issued in furtherance of this Act, shall prevent Federal,
			 State, or local law enforcement personnel from having unfettered access to the
			 entire monument, including the use of motorized vehicles and specialized
			 equipment.</text>
		</section><section id="HED9B2FD375F040A9B383DEFE59330A7B"><enum>12.</enum><header>National
			 landscape conservation system</header><text display-inline="no-display-inline">The monument designated by this Act shall be
			 administered as a component of the National Landscape Conservation
			 System.</text>
