		<official-title>To amend the Americans with Disabilities Act of 1990 to
		  impose notice and a compliance opportunity to be provided before commencement
		  of a private civil action.</official-title>

		<section id="HF6A7BB1D029141DD8F9D5E2494A6EBBD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>ACCESS (ADA Compliance for Customer Entry to Stores and
			 Services) Act of 2013</short-title></quote>.</text>
		</section><section id="HCA9EDF5F1B7245098029B5BE809EF8BB"><enum>2.</enum><header>Amendments</header><text display-inline="no-display-inline">Section 308(a)(1) of the Americans with
			 Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12188">42 U.S.C. 12188(a)(1)</external-xref>) is amended—</text>
			<paragraph id="H18F3DA31C75C432E8C47B1562B7DEC2B"><enum>(1)</enum><text>by striking
			 <quote><header-in-text level="paragraph" style="OLC">procedures.—</header-in-text></quote> and all that follows through
			 <quote>The</quote>, and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H236C601BED88492AAE3424F8212573A9" style="OLC">
					<quoted-block-continuation-text quoted-block-continuation-text-level="paragraph"><header-in-text level="paragraph" style="OLC">procedures.—</header-in-text>
					</quoted-block-continuation-text><subparagraph id="H9E6F564193124D28B730B1BA4222FFE0"><enum>(A)</enum><header>In
				general</header><text>Subject to subparagraph (B),
				the</text>
					</subparagraph><after-quoted-block>,
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HDBBEBEF7F8C64E108B931CCD1526C36F"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HB45864A77A774D2E818518729298E092" style="OLC">
					<subparagraph id="H5E8B819FE9F444FC95066EEB55A1375D"><enum>(B)</enum><header>Structural
				barriers to entry into existing public accommodations</header><text display-inline="yes-display-inline">A civil action for discrimination under
				section 302(b)(2) based on the failure to remove a structural barrier to entry
				into an existing public accommodation may not be commenced by a person
				aggrieved by such discrimination unless—</text>
						<clause id="H7BDCA6CFA577438CBF26FBCDCFAC4A0B"><enum>(i)</enum><text display-inline="yes-display-inline">such person has provided to the owner or
				operator of such accommodation a written notice specific enough to allow such
				owner or operator to identify such barrier; and</text>
						</clause><clause id="H65E4F0CBFEFE459B9B93D5F98DBD8232"><enum>(ii)</enum><text display-inline="yes-display-inline">beginning on the date such notice was
				received and—</text>
							<subclause display-inline="no-display-inline" id="HBC7A0DEDBA1048B9A1BCEAEF049E0536"><enum>(I)</enum><text display-inline="yes-display-inline">before the expiration of 60 days after such
				date, such owner or operator failed to provide to such person a written
				description outlining improvements that will be made to remove such barrier;
				or</text>
							</subclause><subclause id="H4A3B76ED85D14966B32E034799A95982"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="H4FB2F792E12B4BAD9F0677F27D15DA59"><enum>(aa)</enum><text display-inline="yes-display-inline">before the expiration of 60 days after such
				date, such owner or operator provided such description to such person;
				and</text>
								</item><item display-inline="no-display-inline" id="HB727290D00774807BC1C0CF682E33864" indent="up1"><enum>(bb)</enum><text>before the expiration of 120 days
				after such description is provided, such owner or operator failed to remove
				such
				barrier.</text>
								</item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HB55D71B4AF9140EC93DFC8FD76D567B5"><enum>3.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This Act and the
			 amendments made by this Act shall take effect on the 1st day of the 1st month
			 beginning more than 30 days after the date of the enactment of this Act.</text>
