		<section commented="no" display-inline="no-display-inline" id="H4363985189474F76AE0F6DADBD74F6B7" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Women Veterans and Other Health Care
			 Improvements Act of 2013</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="HE480E1B31465487FB248D74C2AC42DC5" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Clarification that fertility counseling and
			 treatment are medical services which the Secretary may furnish to veterans like
			 other medical services</header><text display-inline="no-display-inline">Section
			 1701(6) of title 38, United States Code, is amended by adding at the end the
			 following new subparagraph:</text>
			<quoted-block display-inline="no-display-inline" id="HFA9D92459D08486AA529A1A0C62C404E" style="OLC">
				<subparagraph commented="no" display-inline="no-display-inline" id="HD86A39ECF6EB46039D1AB8474952C59A" indent="up1"><enum>(H)</enum><text display-inline="yes-display-inline">Fertility counseling and treatment,
				including treatment using assisted reproductive technology such as in vitro
				fertilization and other fertility treatments in which both eggs and sperm are
				handled when clinically
				appropriate.</text>
				</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="H9C9593603C58466C99B85A57339FB514" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Reproductive treatment and care for spouses
			 and surrogates of veterans</header>
			<subsection commented="no" display-inline="no-display-inline" id="H8373284C74DA4664B9E26DFFAE7B0239"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subchapter VIII of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">chapter 17</external-xref> of title 38,
			 United States Code, is amended by adding at the end the following new
			 section:</text>
				<quoted-block display-inline="no-display-inline" id="HF631148A70164CD9A3C31D2C167349AD" style="USC">
					<section commented="no" display-inline="no-display-inline" id="HD6F1731CC46245CD9E77082F6B104D6A" section-type="subsequent-section"><enum>1788.</enum><header display-inline="yes-display-inline">Reproductive treatment and care for spouses
				and surrogates of veterans</header>
						<subsection commented="no" display-inline="no-display-inline" id="H956496C9925E4F63AD7BCC8D8B34580C"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall furnish fertility
				counseling and treatment, including through the use of assisted reproductive
				technology, to a spouse or surrogate of a severely wounded, ill, or injured
				veteran who has an infertility condition incurred or aggravated in line of duty
				in the active military, naval, or air service and who is enrolled in the system
				of annual patient enrollment established under section 1705(a) of this title if
				the spouse or surrogate and the veteran apply jointly for such counseling and
				treatment through a process prescribed by the Secretary.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="H01B2CEE08A7C4FA19368E39925484091"><enum>(b)</enum><header display-inline="yes-display-inline">Coordination of care for other spouses and
				surrogates</header><text display-inline="yes-display-inline">In the case of a
				spouse or surrogate of a veteran not described in subsection (a) who is seeking
				fertility counseling and treatment, the Secretary may coordinate fertility
				counseling and treatment for such spouse or surrogate.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="H42BF9877F7DF453C8622306292518C04"><enum>(c)</enum><header display-inline="yes-display-inline">Construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed
				to require the Secretary—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="H84B82633606E4BD6A37B84FFAAA9A96C"><enum>(1)</enum><text display-inline="yes-display-inline">to find or certify a surrogate for a
				veteran or to connect a surrogate with a veteran; or</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H18A108E4C4CD4E25BDCCB3FE95111E43"><enum>(2)</enum><text>to furnish
				maternity care to a spouse or surrogate of a veteran.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H1CF067EBA0BC4EFF86C2EA6DD12DCAB6"><enum>(d)</enum><header>Assisted
				reproductive technology defined</header><text display-inline="yes-display-inline">In this section, the term <term>assisted
				reproductive technology</term> includes in vitro fertilization and other
				fertility treatments in which both eggs and sperm are handled when clinically
				appropriate.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HB7558C43CB6D427EBB29020891E4E2A8"><enum>(b)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of
			 chapter 17 of such title is amended by inserting after the item relating to
			 section 1787 the following new item:</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="HE1B89FECFD9A4582A77709C12F5EB189" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Adoption assistance for severely wounded
			 veterans</header>
			<subsection commented="no" display-inline="no-display-inline" id="H90FE411744234570AEC1B9D0937A269A"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subchapter VIII of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">chapter 17</external-xref> of title 38,
			 United States Code, as amended by section 3, is further amended by adding at
			 the end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H704E7868B59B43749715E0F10A281BA7" style="USC">
					<section commented="no" display-inline="no-display-inline" id="H10B1D86B1D294F9AB0F417049ED7E0E2" section-type="subsequent-section"><enum>1789.</enum><header display-inline="yes-display-inline">Adoption assistance</header>
						<subsection commented="no" display-inline="no-display-inline" id="H2952784B99A044008497336E025C99BF"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary may pay an amount, not to
				exceed the limitation amount, to assist a covered veteran in the adoption of
				one or more children.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="HDDC33B3C05F84D79B6E040E542886CE7"><enum>(b)</enum><header display-inline="yes-display-inline">Covered veteran</header><text display-inline="yes-display-inline">For purposes of this section, a covered
				veteran is any severely wounded, ill, or injured veteran who—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="HFAD01CC16880486496423E8DA8640777"><enum>(1)</enum><text display-inline="yes-display-inline">has an infertility condition incurred or
				aggravated in line of duty in the active military, naval, or air service;
				and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF7CE928C3608404A9F25503F89AC57B6"><enum>(2)</enum><text display-inline="yes-display-inline">is enrolled in the system of annual patient
				enrollment established under section 1705(a) of this title.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H4774CBC78A2F401094926011D19B2795"><enum>(c)</enum><header display-inline="yes-display-inline">Limitation amount</header><text display-inline="yes-display-inline">For purposes of this section, the
				limitation amount is the amount equal to the lesser of—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="H90EA0C4EC54441278B4AE6D33567A4F8"><enum>(1)</enum><text display-inline="yes-display-inline">the cost the Department would incur if the
				Secretary were to provide a covered veteran with one cycle of in vitro
				fertilization, as determined by the Secretary; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3FE469E33C3E446B9F47313E927664DA"><enum>(2)</enum><text display-inline="yes-display-inline">the cost the Department would incur by
				paying the expenses of three adoptions by covered veterans, as determined by
				the
				Secretary.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HCAE48DCA9C544CD1BAFCB8B0FE41BBBD"><enum>(b)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of
			 chapter 17 of such title, as amended by section 3, is further amended by
			 inserting after the item relating to section 1788 the following new
			 item:</text>

				assistance.</toc-entry>
					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H2134CAFC88A64D8B83AF1303021C4E7F" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Annual report on provision of fertility
			 counseling and treatment furnished by Department of Veterans Affairs</header>
			<subsection commented="no" display-inline="no-display-inline" id="HC9FCC9A2C9B74143A0F516E8CF7559A9"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than one year after the date of
			 the enactment of this Act and not less frequently than once each year
			 thereafter, the Secretary of Veterans Affairs shall submit to the Committee on
			 Veterans' Affairs of the Senate and the Committee on Veterans' Affairs of the
			 House of Representatives a report on the fertility counseling and treatment
			 furnished by the Department of Veterans Affairs during the year preceding the
			 submittal of the report.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H043BF162BE31481DAF279A3C4159B1F0"><enum>(b)</enum><header display-inline="yes-display-inline">Elements</header><text display-inline="yes-display-inline">Each report submitted under subsection (a)
			 shall include, for the period covered by the report, the following:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H49512E935FD34EC3AA658CC41797B4F0"><enum>(1)</enum><text display-inline="yes-display-inline">The number of veterans who received
			 fertility counseling or treatment furnished by the Department of Veterans
			 Affairs, disaggregated by era of military service of such veterans.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC9176E92E86644EE8D4DEEFA8A31F833"><enum>(2)</enum><text display-inline="yes-display-inline">The number of spouses and surrogates of
			 veterans who received fertility counseling or treatment furnished by the
			 Department.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6CD971EEF21D464CB6063AB124A86082"><enum>(3)</enum><text display-inline="yes-display-inline">The cost to the Department of furnishing
			 fertility counseling and treatment, disaggregated by cost of services and
			 administration.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H762D4746F79643499E0CF707C4209E31"><enum>(4)</enum><text display-inline="yes-display-inline">The average cost to the Department per
			 recipient of such counseling and treatment.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H799E47DDEBFB436D912B173C24EA1133"><enum>(5)</enum><text display-inline="yes-display-inline">In cases in which the Department furnished
			 fertility treatment through the use of assisted reproductive technology, the
			 average number of cycles per person furnished.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCC8313DA63014DB08D99DAA0ACD8D872"><enum>(6)</enum><text display-inline="yes-display-inline">A description of how fertility counseling
			 and treatment services of the Department are coordinated with similar services
			 of the Department of Defense.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H8329C33B365D4AA9BA3F4B58231775CD" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Regulations on furnishing of fertility
			 counseling and treatment and adoption assistance by Department of Veterans
			 Affairs</header>
			<subsection commented="no" display-inline="no-display-inline" id="HB3FBFE058FC84916837DE3A8BD922D82"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 540 days after the date of
			 the enactment of this Act, the Secretary of Veterans Affairs shall prescribe
			 regulations—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H9083385982AA4313AA64AAEF31AB3FC0"><enum>(1)</enum><text display-inline="yes-display-inline">on the furnishing of fertility treatment to
			 veterans using assisted reproductive technology;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0ABF2A3015EF4A108B17C036E55430F4"><enum>(2)</enum><text display-inline="yes-display-inline">to carry out <external-xref legal-doc="usc" parsable-cite="usc/38/1788">section 1788</external-xref> of title 38,
			 United States Code, as added by section 3; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8644711F470F47D3A9FC588048744851"><enum>(3)</enum><text display-inline="yes-display-inline">to carry out section 1789 of such title, as
			 added by section 4.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HEF618D6CB782461FB96A43104A28621F"><enum>(b)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 during the period beginning on the date of the enactment of this Act and ending
			 on the date on which the Secretary prescribes regulations under subsection (a),
			 the Secretary may not furnish—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H7FFD4FDBBAC04515B8FE2AD8C72C5D64"><enum>(1)</enum><text display-inline="yes-display-inline">to a veteran any fertility treatment that
			 uses an assisted reproductive technology that the Secretary has not used in the
			 provision of a fertility treatment to a veteran before the date of the
			 enactment of this Act;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCF70E16B68D34D3DBA30777710AE98D0"><enum>(2)</enum><text display-inline="yes-display-inline">any fertility counseling or treatment under
			 <external-xref legal-doc="usc" parsable-cite="usc/38/1788">section 1788</external-xref> of title 38, United States Code, as added by section 3; or</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD87EDDF637394C6A8A2822422D93DDAF"><enum>(3)</enum><text display-inline="yes-display-inline">any assistance under section 1789 of such
			 title, as added by section 4.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HE86F19FC716D4A5C98990D310BEB37A3"><enum>(c)</enum><header display-inline="yes-display-inline">Assisted reproductive technology
			 defined</header><text display-inline="yes-display-inline">In this section, the
			 term <term>assisted reproductive technology</term> has the meaning given the
			 term in section 1788 of such title, as added by section 3.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H2D5ADB3DA17C42B8941E81E06CA13B75" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Coordination between Department of Veterans
			 Affairs and Department of Defense on furnishing of fertility counseling and
			 treatment</header><text display-inline="no-display-inline">The Secretary of
			 Veterans Affairs and the Secretary of Defense shall share best practices and
			 facilitate referrals, as they consider appropriate, on the furnishing of
			 fertility counseling and treatment.</text>
		</section><section id="HCF093959FFEF45DE95958850943657A4"><enum>8.</enum><header>Facilitation of
			 reproduction and infertility research</header>
			<subsection id="H632C6AEDACF648D782E453F20B68B924"><enum>(a)</enum><header>In
			 general</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/73">chapter 73</external-xref> of title 38, United States
			 Code, is amended by adding at the end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H1D189006156641CDB120676FBC98177C" style="USC">
					<section id="H1C6DAA16E48D414C95BF47F09F1702E8"><enum>7330B.</enum><header>Facilitation
				of reproduction and infertility research</header>
						<subsection id="H3080D42F36A0483A9FFE8EB92375C189"><enum>(a)</enum><header>Facilitation of
				research required</header><text>The Secretary shall facilitate research
				conducted collaboratively by the Secretary of Defense and the Secretary of
				Health and Human Services to improve the ability of the Department of Veterans
				Affairs to meet the long-term reproductive health care needs of veterans who
				have a genitourinary service-connected disability or a condition that was
				incurred or aggravated in line of duty in the active military, naval, or air
				service, such as spinal cord injury, that affects the veterans' ability to
				reproduce.</text>
						</subsection><subsection id="H4B6DFF41A1E64083AB06EA9F9EA101B0"><enum>(b)</enum><header>Dissemination of
				information</header><text>The Secretary shall ensure that information produced
				by the research facilitated under this section that may be useful for other
				activities of the Veterans Health Administration is disseminated throughout the
				Veterans Health
				Administration.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HBBED0BB272194861949E5B48656B298B"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of chapter 73 of
			 such title is amended by inserting after the item relating to section 7330A the
			 following new item:</text>

						<toc-entry bold="off" level="section">7330B. Facilitation of
				reproduction and infertility
				research.</toc-entry>
					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H578BCDE837C64471B7994997A3CB3EAD"><enum>(c)</enum><header>Report</header><text>Not
			 later than three years after the date of the enactment of this Act, the
			 Secretary of Veterans Affairs shall submit to Congress a report on the research
			 activities conducted by the Secretary under <external-xref legal-doc="usc" parsable-cite="usc/38/7330B">section 7330B</external-xref> of title 38, United
			 States Code, as added by subsection (a).</text>
			</subsection></section><section id="HDD201EE2D8724ADF92D8621C78952FAA"><enum>9.</enum><header>Requirement to
			 improve Department of Veterans Affairs women veterans contact
			 center</header><text display-inline="no-display-inline">The Secretary of
			 Veterans Affairs shall enhance the capabilities of the Department of Veterans
			 Affairs women veterans contact center—</text>
			<paragraph id="HBFE32BADF53D45AC828AF364415634CE"><enum>(1)</enum><text display-inline="yes-display-inline">to respond to requests by women veterans
			 for assistance with accessing health care and benefits furnished under laws
			 administered by the Secretary; and</text>
			</paragraph><paragraph id="H7CF5CD2FAA5A4831B4E084F4705184A0"><enum>(2)</enum><text display-inline="yes-display-inline">for referral of such veterans to community
			 resources to obtain assistance with services not furnished by the
			 Department.</text>
			</paragraph></section><section id="H01473002BB0B491D91B6181D5A905407"><enum>10.</enum><header>Modification of
			 pilot program on counseling in retreat settings for women veterans newly
			 separated from service in the Armed Forces</header>
			<subsection id="HEE644CC46BEB45658DEC85F5A23BCA5D"><enum>(a)</enum><header>Increase in
			 number of locations</header><text>Subsection (c) of section 203 of the
			 Caregivers and Veterans Omnibus Health Services Act of 2010 (Public Law
			 111–163; <external-xref legal-doc="usc" parsable-cite="usc/38/1712A">38 U.S.C. 1712A</external-xref> note) is amended by striking <quote>three
			 locations</quote> and inserting <quote>14 locations</quote>.</text>

			<subsection id="H4785EC37D9B343FC8609D317005AE536"><enum>(a)</enum><header>Assistance for
			 child care for certain veterans receiving health care</header>
				<paragraph id="H8E2781CB846D43E2A9ABE690CBBD48D6"><enum>(1)</enum><header>In
			 general</header><text>Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">chapter 17</external-xref> of title 38, United States
			 Code, is amended by adding at the end the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="H65E87752E89A48B493C469E8F6C95E87" style="USC">
						<section id="H4A82A32EBA6549F0B68BAAF082CA16BF"><enum>1709B.</enum><header>Assistance
				for child care for certain veterans receiving health care</header>
							<subsection id="H56546F0C243A49378F0ED386D8C17E3B"><enum>(a)</enum><header>Program
				required</header><text>The Secretary shall carry out a program to provide,
				subject to subsection (b), assistance to qualified veterans described in
				subsection (c) to obtain child care so that such veterans can receive health
				care services described in subsection (c).</text>
							</subsection><subsection id="H1C6605A286ED470A8A533A7759B04706"><enum>(b)</enum><header>Limitation on
				period of payments</header><text>Assistance may only be provided to a qualified
				veteran under this section for receipt of child care during the period that the
				qualified veteran—</text>
								<paragraph id="HC3A9640A5F86403B826BC580A47E3117"><enum>(1)</enum><text>receives the types
				of health care services described in subsection (c) at a facility of the
				Department; and</text>
								</paragraph><paragraph id="H02778F6E99E94C64A4F705D3D9574349"><enum>(2)</enum><text>requires travel to
				and return from such facility for the receipt of such health care
				services.</text>
								</paragraph></subsection><subsection id="H3DCFC9C2B1F94E5693A0512ADB661B0A"><enum>(c)</enum><header>Qualified
				veterans</header><text>For purposes of this section, a qualified veteran is a
				veteran who is—</text>
								<paragraph id="H6873EA4154384707AD6131CDC6F2786D"><enum>(1)</enum><text>the primary
				caretaker of a child or children; and</text>
								</paragraph><paragraph id="HF1A8598588CD44DCBEE5ECA0B4F2B48B"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H7D3CD164B2D945C785DAC306B1DD3F2D"><enum>(A)</enum><text>receiving from the
				Department—</text>
										<clause id="H7C7770C6377B4E19A8036188246524B6" indent="up1"><enum>(i)</enum><text>regular mental health care
				services;</text>
										</clause><clause id="H8AB127B616C3454F9EA710A20F67B9F7" indent="up1"><enum>(ii)</enum><text>intensive mental health care
				services; or</text>
										</clause><clause id="HD4A86D1ECB694D48857711E938AC5B12" indent="up1"><enum>(iii)</enum><text>such other intensive health care
				services that the Secretary determines that provision of assistance to the
				veteran to obtain child care would improve access to such health care services
				by the veteran; or</text>
										</clause></subparagraph><subparagraph id="H3CB111F594074B97B207ECA0567D6B07" indent="up1"><enum>(B)</enum><text>in need of regular or intensive mental
				health care services from the Department, and but for lack of child care
				services, would receive such health care services from the Department.</text>
									</subparagraph></paragraph></subsection><subsection id="HE858B288A925424BBEA4DF7E8276A824"><enum>(d)</enum><header>Locations</header><text>The
				Secretary shall carry out the program in no fewer than three Veterans
				Integrated Service Networks selected by the Secretary for purposes of the
				program.</text>
							</subsection><subsection id="H266E4A2D49EB42F08A73319D7DA1A01D"><enum>(e)</enum><header>Forms of child
				care assistance</header><paragraph commented="no" display-inline="yes-display-inline" id="H45F4DDCD29F345608F9B4BFF2CE0343A"><enum>(1)</enum><text>Child care assistance
				under this section may include the following:</text>
									<subparagraph id="HE80BBE71CB3E4E4B9221673DC446A1BA" indent="up1"><enum>(A)</enum><text>Stipends for the payment of child care
				offered by licensed child care centers (either directly or through a voucher
				program) which shall be, to the extent practicable, modeled after the
				Department of Veterans Affairs Child Care Subsidy Program established pursuant
				to section 630 of the Treasury and General Government Appropriations Act, 2002
				(<external-xref legal-doc="public-law" parsable-cite="pl/107/67">Public Law 107–67</external-xref>; 115 Stat. 552).</text>
									</subparagraph><subparagraph id="H489DF63D647B4C6AA926405C987BC30E" indent="up1"><enum>(B)</enum><text>Direct provision of child care at an
				on-site facility of the Department of Veterans Affairs.</text>
									</subparagraph><subparagraph id="H78399E2D02674F6F95636F2772B99483" indent="up1"><enum>(C)</enum><text>Payments to private child care
				agencies.</text>
									</subparagraph><subparagraph id="H9A96383087524A2CA620A7051ECC666D" indent="up1"><enum>(D)</enum><text>Collaboration with facilities or
				programs of other Federal departments or agencies.</text>
									</subparagraph><subparagraph id="H11BFE8D456EE4D26AF61B1542B2C2733" indent="up1"><enum>(E)</enum><text>Such other forms of assistance as the
				Secretary considers appropriate.</text>
									</subparagraph></paragraph><paragraph id="H8B291F4AE9D94818A13C897B4E7FE687" indent="up1"><enum>(2)</enum><text>In the case that child care
				assistance under this section is provided as a stipend under paragraph (1)(A),
				such stipend shall cover the full cost of such child

			 Health Services Act of 2010 (<external-xref legal-doc="public-law" parsable-cite="pl/111/163">Public Law 111–163</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/1710">38 U.S.C. 1710</external-xref> note) is
			 amended by inserting <quote>but not after the date of the enactment of the
			 <short-title>Women Veterans and Other Health Care
			 Improvements Act of 2013</short-title></quote> before the period at the

				required</header><text>The Secretary shall carry out a program to provide,
				subject to subsection (b), assistance to qualified veterans described in
				subsection (c) to obtain child care so that such veterans can receive
				readjustment counseling and related mental health services.</text>
							</subsection><subsection id="H633D4EF08E4545EAA697900D8B7B1995"><enum>(b)</enum><header>Limitation on
				period of payments</header><text>Assistance may only be provided to a qualified
				veteran under this section for receipt of child care during the period that the
				qualified veteran receives readjustment counseling and related health care
				services at a Vet Center.</text>
							</subsection><subsection id="H6BE981D1917F410D9C0158A9A048BC0C"><enum>(c)</enum><header>Qualified
				veterans</header><text>For purposes of this section, a qualified veteran is a
				veteran who is—</text>
								<paragraph id="H2AFA27824EA741C6A2F67D9DC46A815F"><enum>(1)</enum><text>the primary
				caretaker of a child; and</text>
								</paragraph><paragraph id="H8AC9087AC8B14E798A83782EC7784E0F"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HBCA8527014FD4505AD01A8DE482A9F05"><enum>(A)</enum><text>receiving from the
				Department regular readjustment counseling and related mental health services;
				or</text>
									</subparagraph><subparagraph id="HB60A906E2BAA4AE180E615E3027A3BED" indent="up1"><enum>(B)</enum><text>in need of readjustment counseling and
				related mental health services from the Department, and but for lack of child
				care services, would receive such counseling and services from the
				Department.</text>
									</subparagraph></paragraph></subsection><subsection id="H9B606F5330A24B62B84DC375A0D4EFE9"><enum>(d)</enum><header>Locations</header><text>The
				Secretary shall carry out the program under this section in no fewer than three
				Readjustment Counseling Service Regions selected by the Secretary for purposes
				of the program.</text>
							</subsection><subsection id="H522B55562F8D49E2A6C2E3CE47E75BD5"><enum>(e)</enum><header>Forms of child
				care assistance</header><paragraph commented="no" display-inline="yes-display-inline" id="H32890C8CEB8A4CD3BD87B40212240496"><enum>(1)</enum><text>Child care assistance
				under this section may include the following:</text>

				assistance under this subsection is provided as a stipend under paragraph
				(1)(A), such stipend shall cover the full cost of such child care.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H490AE884EAD343A3B54202EA3F20050A"><enum>(f)</enum><header>Vet Center
				defined</header><text>In this section, the term <term>Vet Center</term> means a
				center for readjustment counseling and related mental health services for
				veterans under section 1712A of this
				title.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HF1E0EA1CF9A74C15947956584FC1F279"><enum>(2)</enum><header>Clerical

			 fees</header>
			<subsection id="H888DA7C456404D05A0A4D9550DE70AA1"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 3 of title
			 38, United States Code, is amended by adding at the end the following new
			 section:</text>

					<section id="H97663C9C379C4E5895B8E228C7980F78"><enum>323.</enum><header>Contractor user
				fees</header>
						<subsection id="H4A393CBDB6F3453885506FC6E4DBAD0A"><enum>(a)</enum><header>Fee
				requirement</header><text display-inline="yes-display-inline">Except as
				provided in subsection (c) and subject to subsection (d), the Secretary shall
				impose a fee upon each person with whom the Secretary engages in a contract for
				a good or service as a condition of the contract.</text>
						</subsection><subsection id="H89A866DF08384638A90E3E3E2C784662"><enum>(b)</enum><header>Fee
				amount</header><paragraph commented="no" display-inline="yes-display-inline" id="HD86E617FF82844E49264B52EECE5490A"><enum>(1)</enum><text>The
				amount of a fee imposed upon a person under subsection (a) with respect to a
				contract shall be equal to the lesser of—</text>
								<subparagraph id="HCEADDE2F1C6C465B87ADBEA53FA148AD" indent="up1"><enum>(A)</enum><text>the amount which is equal to seven
				percent of the total value of the contract; and</text>
								</subparagraph><subparagraph id="HB9C3A434086F423BBF68D36D8F59B9A8" indent="up1"><enum>(B)</enum><text>the amount which is equal to the total
				value of the contract multiplied by the applicable percentage for such fiscal
				year.</text>
								</subparagraph></paragraph><paragraph id="HFECF66D6601D4DE48E0B2FF4374E2FC2" indent="up1"><enum>(2)</enum><text>The applicable percentage for a
				fiscal year shall be equal to the percentage by which—</text>
								<subparagraph id="H0F89D38E109A44B9A8A8EA21663C93B8"><enum>(A)</enum><text>the annual estimate of the total value
				of contracts for such fiscal year, exceeds</text>
								</subparagraph><subparagraph id="HC86FB4793F2543508A6874BDB7C560FD"><enum>(B)</enum><text>the annual estimate of the total cost
				of fertility counseling and treatment for such fiscal year.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H101AC80FB04244F3A4866108AFF6D2A5" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Before each fiscal year, the Secretary
				shall establish, for purposes of this section, the annual estimate of the total
				value of contracts for the next fiscal year, which shall be the Secretary's
				estimate of what the aggregate value will be of all contracts in which the
				Secretary will engage in the next fiscal year.</text>
							</paragraph><paragraph id="H0AAF6BA28D1F49A89338082AB461FE4A" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">Before each fiscal year, the Secretary
				shall establish, for purposes of this section, the annual estimate of the total
				cost of fertility counseling and treatment for the next fiscal year, which
				shall be the Secretary's estimate of what the total cost to the Department will
				be in the next fiscal year of—</text>
								<subparagraph id="HBA01F37A45304A1DB18111F920E88886"><enum>(A)</enum><text display-inline="yes-display-inline">furnishing fertility counseling and
				treatment, including through the use of assisted reproductive technology, to
				individuals under laws administered by the Secretary in the next fiscal year;
				and</text>
								</subparagraph><subparagraph id="H4359DA68FCCF45518BC76F3B70A75FE3"><enum>(B)</enum><text display-inline="yes-display-inline">making payments under section 1789 of this
				title in the next fiscal year.</text>
								</subparagraph></paragraph></subsection><subsection id="H11BC8A949155444FB25A02AA6826B286"><enum>(c)</enum><header>Waiver</header><text display-inline="yes-display-inline">The Secretary may waive the fee required by
				subsection (a) for a person as the Secretary considers appropriate if the
				person is an individual or a small business concern.</text>
						</subsection><subsection id="H9E206ADC28DC4AD792A9EA3E61EDE9B1"><enum>(d)</enum><header>Limitation on
				collection</header><text display-inline="yes-display-inline">No fee may be
				collected under subsection (a) except to the extent that the expenditure of the
				fee to pay the costs of activities and services for which the fee is imposed is
				provided for in advance in an appropriations Act.</text>
						</subsection><subsection id="H6FCCF5957ACA451EAB294797733EF00F"><enum>(e)</enum><header>Department of
				Veterans Affairs Fertility Counseling and Treatment Fund</header><paragraph commented="no" display-inline="yes-display-inline" id="HEFD434AEFD244DE4BB510D5F1B6E2CB5"><enum>(1)</enum><text>There is in the Treasury
				a fund to be known as the Department of Veterans Affairs Fertility Counseling
				and Treatment Fund.</text>
							</paragraph><paragraph id="H02EA8103C11B47DAAA0A159E49CF0A53" indent="up1"><enum>(2)</enum><text>All amounts received by the Secretary
				under subsection (a) shall be deposited in the fund.</text>
							</paragraph><paragraph id="H8DC8C32C283C4021A48F1F060AF55D4F" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H52D6ECF1BED74C759D402E8051D214B6"><enum>(A)</enum><text>Subject to the
				provisions of appropriations Acts, amounts in the fund shall be available,
				without fiscal year limitation, to the Secretary for the following
				purposes:</text>
									<clause id="H2A8AA71F94E74DF7ADE42F675E07B230" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">To
				furnish fertility counseling and treatment, including through the use of
				assisted reproductive technology, to individuals under laws administered by the
				Secretary.</text>
									</clause><clause id="H8DB34B60B71F4A3A846D6633B19551D5" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">To make payments under section 1789 of this
				title.</text>
									</clause></subparagraph><subparagraph id="H9A198BD770D540E191500D40DCCDEDF0" indent="up1"><enum>(B)</enum><text>Amounts available under subparagraph
				(A) may not be used for any purposes other than a purpose set forth in clause
				(i) or (ii) of that subparagraph.</text>
								</subparagraph></paragraph><paragraph id="H0A4F089CB3F44E86B84DD7991F931335" indent="up1"><enum>(4)</enum><text>Amounts received by the Secretary
				under subsection (a) shall be treated for the purposes of sections 251 and 252
				of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/901">2 U.S.C. 901</external-xref>,
				902) as offsets to discretionary appropriations (rather than as offsets to
				direct spending) to the extent that such amounts are made available for
				expenditure in appropriations Acts for the purposes specified in paragraph (3)
				of this subsection.</text>
							</paragraph></subsection><subsection id="H52422C0F52444340867E72A522577ECB"><enum>(f)</enum><header>Small business
				concern defined</header><text>In this section, the term <term>small business
				concern</term> has the meaning given such term under section 3 of the Small
				Business Act (15 U.S.C.
				632).</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H70D7CAF4E9474B8A8DCEA0370AC14D67"><enum>(b)</enum><header>Clerical
