		<official-title>To suspend the sale, lease, transfer, retransfer, or
		  delivery of F–16 aircraft, M1 tanks, and certain other defense articles or
		  defense services to the Government of Egypt.</official-title>

	<legis-body id="H8719AF70457445D5876ABA4C0BB2149C" style="OLC">
		<section id="HF71A7F2A4F1948F9B794B5124B653B46" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Support
			 Democracy in Egypt Act</quote>.</text>
		</section><section id="H5FB5F6B0ABC64581A4914E5F49FD268D" section-type="subsequent-section"><enum>2.</enum><header>Suspension of sales,
			 leases, transfers, retransfers, or delivery of covered defense articles and
			 defense services to Egypt</header>
			<subsection id="HD9BB22D469FC4BA293CA16666444D955"><enum>(a)</enum><header>Suspension</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 the United States Government shall not license, approve, facilitate, or
			 otherwise allow the sale, lease, transfer, retransfer, or delivery of any
			 covered defense article or defense service to the Government of Egypt unless
			 the President submits to Congress a certification described in subsection (b)
			 and a notification described in subsection (c).</text>
			</subsection><subsection id="H01D9E2B3C21040B3BCA2F5326D509346"><enum>(b)</enum><header>Certification</header><text>A
			 certification referred to in subsection (a) is a certification that contains a
			 determination of the President that each of the following conditions has been
			 met:</text>
				<paragraph id="H872E24B22BE04E8E80538D7F150B5FD5"><enum>(1)</enum><text display-inline="yes-display-inline">The Government of Egypt is working to
			 curtail support for terrorist activities conducted by foreign terrorist
			 organizations.</text>
				</paragraph><paragraph id="HB944F929879A411FBDEC15CBE667BE75"><enum>(2)</enum><text display-inline="yes-display-inline">The Government of Egypt has adopted
			 policies that promote religious and political freedoms for the people of
			 Egypt.</text>
				</paragraph><paragraph id="H0E870771A7B940B686436456079B7CF7"><enum>(3)</enum><text>The Government of
			 Egypt is carrying out concerted efforts to enforce access along the Sinai
			 Peninsula, including to stop illegal weapons smuggling between Egypt and
			 Gaza.</text>
				</paragraph><paragraph id="H4908C8111A294D1FA69A3A855731AF40"><enum>(4)</enum><text>The Government of
			 Egypt is fully implementing all aspects of the 1979 Peace Treaty between Egypt
			 and Israel.</text>
				</paragraph></subsection><subsection id="H21E30B7444B5449BB39EC0FE8EE3F3C3"><enum>(c)</enum><header>Notification</header><text>A
			 notification referred to in subsection (a) is a notification of the President
			 that is submitted to Congress not less than 30 days prior to the proposed sale,
			 lease, transfer, retransfer, or delivery of any covered defense article or
			 defense service, as the case may be, in accordance with procedures applicable
			 to reprogramming notifications under section 634A(a) of the Foreign Assistance
			 Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2394-1">22 U.S.C. 2394–1(a)</external-xref>).</text>
			</subsection><subsection commented="no" id="H23F1BDAAA182434593FF92C17399BE01"><enum>(d)</enum><header>Waiver</header><text>The
			 President may waive the application of subsection (a) if the President
			 determines and certifies to Congress that it is in the national security
			 interests of the United States to do so.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H8739B04D7FD54C06A496E93B1CD903AC"><enum>(e)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="H40D48376E31A4A7AA42FAE4ABC9918EE"><enum>(1)</enum><header>Covered defense
			 article or defense service</header><text display-inline="yes-display-inline">The term <term>covered defense article or
			 defense service</term> means any F–16 aircraft, M1 tank, or other defense
			 article or defense service listed in Category VI, VII, or VIII of the United
			 States Munitions List.</text>
				</paragraph><paragraph id="H569C1B9D54A34905963C32DB70EBE6A5"><enum>(2)</enum><header>Foreign
			 terrorist organization</header><text>The term <term>foreign terrorist
			 organization</term> means an organization designated as a foreign terrorist
			 organization by the Secretary of State in accordance with section 219(a) of the
			 Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189(a)</external-xref>).</text>
				</paragraph><paragraph id="H51DC46500C3440C8945DC777EA4FE910"><enum>(3)</enum><header>United States
			 Munitions List</header><text>The term <term>United States Munitions List</term>
			 means the list referred to in section 38(a)(1) of the Arms Export Control Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/22/2778">22 U.S.C. 2778(a)(1)</external-xref>).</text>
