		  Assistance to make grants to States, units of local government, and gun dealers
		  to conduct gun buyback programs.</official-title>

		<section id="H1CC1DAC6D88349679FBDD7540E079B55" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Safer Neighborhoods Gun Buyback Act of
			 2013</short-title></quote>.</text>
		</section><section id="HB5EFBA4E675D43B9B8A9DFD652D1A7E3"><enum>2.</enum><header>Program
			 Authorized</header>
			<subsection id="H4E649E4D19FD44CFB68499161DA1660C"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Director of the
			 Bureau of Justice Assistance (referred to in this Act as the
			 <quote>Director</quote>) may make grants to eligible entities to conduct gun
			 buyback programs.</text>
			</subsection><subsection id="H6FD90F037D684FC594957FEF43D40743"><enum>(b)</enum><header>Eligible entity
			 defined</header><text>In this Act, the term <term>eligible entity</term>
			 means—</text>
				<paragraph id="HAE91350040B24E51A9A7BDFB9FF9C582"><enum>(1)</enum><text>a
			 State;</text>
				</paragraph><paragraph id="H630455DA70274405ADCB9967E12FE2E9"><enum>(2)</enum><text>a
			 unit of local government; or</text>
				</paragraph><paragraph id="H1D1AFB8924BE443380A23AB354601FAA"><enum>(3)</enum><text>a
			 gun dealer if neither the unit of local government nor the State where such
			 dealer is located receives a grant under this Act.</text>
				</paragraph></subsection></section><section id="HE65CA26D0004485D8BD22ACE83C6CB8E"><enum>3.</enum><header>Applications</header>
			<subsection id="HF3EC7811006E4DF195C9D61754F7BC24"><enum>(a)</enum><header>Grants</header><text display-inline="yes-display-inline">The chief executive of an eligible entity
			 seeking a grant under this Act shall submit an application to the Director at
			 such time and containing such information as the Director may reasonably
			 require.</text>
			</subsection><subsection id="H4DA96E881456443ABE0E748F11A66DE8"><enum>(b)</enum><header>Subgrants</header><text display-inline="yes-display-inline">A gun dealer located in a unit of local
			 government or State that does receive a grant under this Act seeking a subgrant
			 shall submit an application to the chief executive of such unit of local
			 government or State at such time and containing such information as the chief
			 executive may reasonably require, including proof of such dealer’s license
			 under <external-xref legal-doc="usc" parsable-cite="usc/18/923">section 923</external-xref> of title 18, United States Code.</text>
			</subsection></section><section id="H3B2AD77805874752B14347A9084C954C"><enum>4.</enum><header>Term of
			 grant</header>
			<subsection id="HE49C6B91E1AE4389B1999FC5AF2A181E"><enum>(a)</enum><header>Term</header><text display-inline="yes-display-inline">The term of a grant awarded under this Act
			 shall be two years.</text>
			</subsection><subsection id="HEE0188D50EA74296B96728A898D82527"><enum>(b)</enum><header>Availability of
			 grant funds</header>
				<paragraph commented="no" id="HF684FED511F74B66B81EA4EA611506C2"><enum>(1)</enum><header>Gun
			 dealers</header><text display-inline="yes-display-inline">A gun dealer that
			 receives a grant or subgrant under this Act shall return to the Director any
			 remaining smart prepaid cards and any unused portion of such grant or subgrant
			 that was allocated to be used to buy back guns—</text>
					<subparagraph commented="no" id="H7FAE6F6CCBCE4C13818FA693A3005A4E"><enum>(A)</enum><text>in the case of a
			 gun dealer receiving a grant, at the end of the two-year period beginning on
			 the date that the grant was awarded; or</text>
					</subparagraph><subparagraph commented="no" id="HBB215B2A65E745DDBB3A00FB2EFF39E4"><enum>(B)</enum><text>in the case of a
			 gun dealer receiving a subgrant, at the end of the two-year period beginning on
			 the date that the grant was awarded to the State or unit of local government
			 from which the gun dealer received a subgrant.</text>
					</subparagraph></paragraph><paragraph id="HD35DCC3EFDB14105A8C1C3DFBA28D8A0"><enum>(2)</enum><header>States or units
			 of local government</header><text>A State of unit of local government that
			 receives a grant under this Act shall return to the Director any unused portion
			 of such grant at the end of the two-year and 270-day period beginning on the
			 date that the grant was awarded.</text>
				</paragraph></subsection><subsection id="H931202D3FE84402CBB6B2145B4B38BBD"><enum>(c)</enum><header>Amounts
			 returned</header><text>The Director shall return to the general fund of the
			 Treasury any amounts returned under subsection (b).</text>
			</subsection></section><section id="HB392349308AE42C7AD986C012E7DDB6D"><enum>5.</enum><header>Smart prepaid
			 cards</header>
			<subsection id="H1D352F509BF44935AF4A458E155B30A5"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">In conducting the
			 grant program authorized under section 2, the Director may reserve such funds
			 as may be necessary to acquire and distribute smart prepaid cards to eligible
			 entities that receive grants under this Act. The Director shall distribute the
			 smart prepaid cards without any funds loaded onto the cards.</text>
			</subsection><subsection id="H2F1498E9154D4199922381732D1A74A0"><enum>(b)</enum><header>Market value of
			 guns</header><text display-inline="yes-display-inline">The Director shall
			 determine the market value of each gun listed in section 7(2) and make such
			 information publicly available.</text>
			</subsection><subsection id="H45C74CF333604FB38011049FD75C8F1A"><enum>(c)</enum><header>Prohibition on
			 use of cards To buy guns</header>
				<paragraph id="H2747B551873A470E9D2AB8066A1B3BF2"><enum>(1)</enum><header>In
			 general</header><text>A person may not use a smart prepaid card to buy a gun or
			 ammunition, and a merchant may not accept a smart prepaid card to sell a gun or
			 ammunition.</text>
				</paragraph><paragraph id="HEC45FA2F083E4BC3B84F9960E84EA588"><enum>(2)</enum><header>Penalty</header><text>A
			 merchant that violates paragraph (1) shall pay to the Director an amount that
			 is equal to the value of the prohibited sale.</text>
				</paragraph></subsection></section><section id="H0E6AF93DC0DD4BE1B327403EECEF9CB4"><enum>6.</enum><header>Uses of
			 funds</header>
			<subsection id="H80CB0570CF47486A90AE7BBB0A6315E1"><enum>(a)</enum><header>States and units
			 of local government</header><text display-inline="yes-display-inline">A State
			 or unit of local government receiving a grant under this Act shall use such
			 funds to do the following:</text>
				<paragraph id="HC6090AC620E14271B78C2BEB18FAC4CA"><enum>(1)</enum><header>Subgrants to gun
			 dealers</header><text display-inline="yes-display-inline">Distribute not less
			 than 80 percent of such funds in the form of subgrants to gun dealers in such
			 State or unit of local government to conduct gun buyback programs.</text>
				</paragraph><paragraph id="HDC820D57FCEB450196CC150B4F67D8D2"><enum>(2)</enum><header>Distribute smart
			 prepaid cards</header><text>Distribute the smart prepaid cards such State or
			 unit of local government receives to gun dealers receiving subgrants.</text>
				</paragraph><paragraph id="HCFF91CE34F6A4D48BB6144E819237CBC"><enum>(3)</enum><header>Gun recycling
			 program</header><text display-inline="yes-display-inline">Use 10 percent of
			 such funds to recycle the guns that such State or unit of local government
			 receives from gun dealers to make street signs, energy efficient washing
			 machines, car parts, energy efficient refrigerators, or other steel parts such
			 as railroad or metro tracks.</text>
				</paragraph><paragraph id="HFEBC3B33B99640459207FBDA538F9E7C"><enum>(4)</enum><header>Administrative
			 costs</header><text>Use not more than 10 percent of such funds for the
			 administrative costs of carrying out the grant program under this Act.</text>
				</paragraph></subsection><subsection id="H4D69B9C29F104712A466467EAFE380A7"><enum>(b)</enum><header>Gun
			 dealers</header>
				<paragraph id="H0B4F4EF2A5E14120B7A9E03225B42EA0"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">A gun dealer
			 receiving a grant or subgrant under this Act shall use such funds to conduct a
			 gun buyback program.</text>
				</paragraph><paragraph id="H725C53DAE9244233BD75DC046BC72BE2"><enum>(2)</enum><header>Smart prepaid
			 card amounts</header>
					<subparagraph id="H3EA54B9FD1FA4D9A843197C7CD578EEF"><enum>(A)</enum><text display-inline="yes-display-inline">In order to purchase a gun through a gun
			 buyback program, a gun dealer shall load onto a smart prepaid card 125 percent
			 of the market value of the gun that the individual wishes to dispose of (as
			 determined by the Director under section 5(b)).</text>
					</subparagraph><subparagraph id="H6D72FB88D9E84AA3A4404FEE8F321F1C"><enum>(B)</enum><text>A gun dealer may
			 increase the purchase price of a gun and load an amount onto a smart prepaid
			 card that is greater than 125 percent of the market value of the gun if the gun
			 dealer determines that the gun has been altered in a way that would increase
			 the market value of the gun (such as an altered grip, or the addition of a
			 scope).</text>
					</subparagraph></paragraph><paragraph id="H130C677BAC73481590BEBCDFCA774039"><enum>(3)</enum><header>Guns
			 received</header>
					<subparagraph id="HDC6145FC79E44C73835AD5AF5E1D6CB5"><enum>(A)</enum><text display-inline="yes-display-inline">In the case of a gun dealer receiving a
			 grant under this Act, the gun dealer shall deliver a gun the dealer receives
			 under the gun buyback program to the closest office of the Bureau of Alcohol,
			 Tobacco, Firearms and Explosives not later than 60 days after receiving such
			 gun.</text>
					</subparagraph><subparagraph id="H25C7A3D96B404F4492CC9EABEC85BE5D"><enum>(B)</enum><text>In the case of a
			 gun dealer receiving a subgrant under this Act, the gun dealer shall deliver a
			 gun the dealer receives under the gun buyback program to the State or unit of
			 local government from which it receives the subgrant not later than 60 days
			 after receiving such gun.</text>
					</subparagraph></paragraph></subsection><subsection id="HD870E7EF04F941E49A06F62A1A640AD8"><enum>(c)</enum><header>Incentives for
			 gun dealer participation</header><text>To the extent that the Director
			 determines necessary to facilitate participation of gun dealers in the gun
			 buyback program, grant funds may be used to provide monetary or other
			 incentives to gun dealers to participate in such program. For purposes of
			 subsection (a), any such incentives shall be treated as part of the subgrant to
			 the gun dealer described in paragraph (1) thereof.</text>
			</subsection></section><section id="H6E72C4CFB17644AAA5C3D64D76A4B5C6"><enum>7.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H0230EB783D1D4164AEF60F90C669EE74"><enum>(1)</enum><header>Gun</header><text display-inline="yes-display-inline">The term <term>gun</term> means
			 <quote>firearm</quote> as defined in <external-xref legal-doc="usc" parsable-cite="usc/18/921">section 921(a)(3)</external-xref> of title 18, United
			 States Code.</text>
			</paragraph><paragraph id="HD5D4DF1F4221483DA7E1AA3165475F9F"><enum>(2)</enum><header>Gun buyback
			 program</header><text display-inline="yes-display-inline">The term <term>gun
			 buyback program</term> means a program under which a gun dealer, using smart
			 prepaid cards as described in section 6(b)(2), purchases back from individuals
			 wishing to dispose of them, the following guns:</text>
				<subparagraph id="H082E4D3C28614D85AD4AA003E6A661A9"><enum>(A)</enum><text>Smith and Wesson
			 .38 revolver.</text>
				</subparagraph><subparagraph id="HD97699D9CD9A4740875CA51046B737CF"><enum>(B)</enum><text>Smith and Wesson
			 .40 semiautomatic pistol.</text>
				</subparagraph><subparagraph id="H6DCCD6AC6E844AADB104EDA1D6A28A7D"><enum>(C)</enum><text>Haskell Hi-Point
			 JHP 45 semiautomatic pistol.</text>
				</subparagraph><subparagraph id="H5BB15A91ECDC4AC6988BD47A1BE8E168"><enum>(D)</enum><text>Iberia Firearm
			 JCP40 pistol.</text>
				</subparagraph><subparagraph id="HC0105DEC60894DBB8AB1ABEE5F259B8A"><enum>(E)</enum><text>Ruger 9 mm
			 semiautomatic pistol.</text>

				</subparagraph></paragraph><paragraph id="H32111B45A4054C55AF40DCCC437847F7"><enum>(3)</enum><header>Gun
			 dealer</header><text display-inline="yes-display-inline">The term <term>gun
			 dealer</term> means a dealer of firearms licensed under section 923 of title
			 18, United States Code.</text>
			</paragraph><paragraph id="H1CB3D1BA148744629C1A624AFBFC0B19"><enum>(4)</enum><header>Smart prepaid
			 card</header><text>The term <term>smart prepaid card</term> means a card issued
			 by the Director that—</text>
				<subparagraph id="H3B44E3E02E074E248F0B64FE62594367"><enum>(A)</enum><text>is redeemable at
			 multiple, unaffiliated merchants or service providers;</text>
				</subparagraph><subparagraph display-inline="no-display-inline" id="HE8694C447B2E470EBA57D30D8F96EE44"><enum>(B)</enum><text display-inline="yes-display-inline">contains a mechanism, for the purpose of
			 preventing the card-holder from using it to purchase a gun or ammunition, that
			 recognizes the merchant category code of a merchant and prohibits the use of
			 such card at gun stores and pawn shops;</text>
				</subparagraph><subparagraph id="HA9A698C798DE46DEB42BB0AFEBDEA580"><enum>(C)</enum><text>is honored, upon
			 presentation, by merchants for goods or services, except for merchants
			 described in subparagraph (B);</text>
				</subparagraph><subparagraph id="H9B5ED6FBAA4846B8AD97C6B21AAE51A9"><enum>(D)</enum><text>is loaded on a
			 prepaid basis by a gun dealer for use in a gun buyback program; and</text>
				</subparagraph><subparagraph id="HB31762A12A8347A88A51906D0CB19EEA"><enum>(E)</enum><text display-inline="yes-display-inline">clearly and conspicuously bears the words
			 <quote>THIS CARD MAY NOT BE USED TO PURCHASE A GUN OR AMMUNITION</quote> in
			 capital and raised letters on the card.</text>
				</subparagraph></paragraph><paragraph id="HAEBD4A8784F04852B1EB1F3E90DAEB30"><enum>(5)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each of
			 the 50 States and the District of Columbia.</text>
			</paragraph></section><section id="H35E2D1F2576C4BE08A0C6EC789A71776"><enum>8.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There is
			 authorized to be appropriated $360,000,000 for each of fiscal years 2014
			 through 2016 to carry out this Act.</text>
