		<section id="H025F0995D6194E0D83F021F03ADD49DF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Racial Profiling Prevention
			 Act</short-title></quote>.</text>
		</section><section id="HA9D821190F484CE3AD2374891AB08E55" section-type="subsequent-section"><enum>2.</enum><header>Grant program to
			 prohibit racial profiling</header>
			<subsection id="H40CDAD2A4C1B4D78B1AB6D3D40317E16"><enum>(a)</enum><header>Grants</header><text display-inline="yes-display-inline">Subject to the requirements of this
			 section, the Secretary shall make grants to a State that—</text>
				<paragraph id="H19511E37FAC14E48BCADD2C46024D254"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H1C57715977CC49A49F1B482A4C509675"><enum>(A)</enum><text display-inline="yes-display-inline">has enacted and is enforcing a law that
			 prohibits the use of racial profiling in the enforcement of State laws
			 regulating the use of Federal-aid highways; and</text>
					</subparagraph><subparagraph id="HC493972386B64ACD9F9B12603F276324" indent="up1"><enum>(B)</enum><text>is maintaining and allows public
			 inspection of statistical information for each motor vehicle stop made by a law
			 enforcement officer on a Federal-aid highway in the State regarding the race
			 and ethnicity of the driver and any passengers; or</text>
					</subparagraph></paragraph><paragraph id="H6569ED8F40CE42A5BC99C0E3E5C89F5A"><enum>(2)</enum><text>provides
			 assurances satisfactory to the Secretary that the State is undertaking
			 activities to comply with the requirements of paragraph (1).</text>
				</paragraph></subsection><subsection id="HD3B2D4719333492AA9FACEAFA35DBC63"><enum>(b)</enum><header>Eligible
			 activities</header><text display-inline="yes-display-inline">A grant received
			 by a State under subsection (a) shall be used by the State—</text>
				<paragraph id="H9A53DF054009496F899231F170D6933F"><enum>(1)</enum><text display-inline="yes-display-inline">in the case of a State eligible under
			 subsection (a)(1), for costs of—</text>
					<subparagraph id="H9706CAEF121B4F2C8E68F6CB85747378"><enum>(A)</enum><text display-inline="yes-display-inline">collecting and maintaining of data on
			 traffic stops;</text>
					</subparagraph><subparagraph id="HF32AF7B4594647C7930D66B0A21473C4"><enum>(B)</enum><text>evaluating the
			 results of the data; and</text>
					</subparagraph><subparagraph id="H239C2E34D4A64ACC961A3A3C023AC401"><enum>(C)</enum><text>developing and
			 implementing programs to reduce the occurrence of racial profiling, including
			 programs to train law enforcement officers; and</text>
					</subparagraph></paragraph><paragraph id="HDE09F19F2A1C4490A14CB3EF9ECAAB15"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of a State eligible under
			 subsection (a)(2), for costs of—</text>
					<subparagraph id="H729CC8E84B67410D9D50EC9C37844EC6"><enum>(A)</enum><text display-inline="yes-display-inline">activities to comply with the requirements
			 of subsection (a)(1); and</text>
					</subparagraph><subparagraph id="HE1295297AB1642B1AA1BFE5DED485E8D"><enum>(B)</enum><text>any eligible
			 activity under paragraph (1).</text>
					</subparagraph></paragraph></subsection><subsection id="HF4EFDB01EF06494DB46A613D014B8C30"><enum>(c)</enum><header>Racial
			 profiling</header>
				<paragraph id="H155F0EBAFBD1467B8D57E88115FADF54"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">To meet the
			 requirement of subsection (a)(1), a State law shall prohibit, in the
			 enforcement of State laws regulating the use of Federal-aid highways, a State
			 or local law enforcement officer from using the race or ethnicity of the driver
			 or passengers to any degree in making routine or spontaneous law enforcement
			 decisions, such as ordinary traffic stops on Federal-aid highways.</text>
				</paragraph><paragraph id="H35855F7165E8412A898DC076B7095C45"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">Nothing in this subsection shall alter the
			 manner in which a State or local law enforcement officer considers race or
			 ethnicity whenever there is trustworthy information, relevant to the locality
			 or time frame, that links persons of a particular race or ethnicity to an
			 identified criminal incident, scheme, or organization.</text>
				</paragraph></subsection><subsection id="HC177E6150EAD4E5F905D7EC5072D9127"><enum>(d)</enum><header>Limitations</header>
				<paragraph id="HC41870FA802E4730ADA962C7F2022938"><enum>(1)</enum><header>Maximum amount
			 of grants</header><text display-inline="yes-display-inline">The total amount of
			 grants made to a State under this section in a fiscal year may not exceed 5
			 percent of the amount made available to carry out this section in the fiscal
			 year.</text>
				</paragraph><paragraph id="H820E8BAFF7CC4A76B9428A5934901BAA"><enum>(2)</enum><header>Eligibility</header><text display-inline="yes-display-inline">A State may not receive a grant under
			 subsection (a)(2) in more than 2 fiscal years.</text>
				</paragraph></subsection><subsection id="H4E92D6BBCA6B461A96C95A3CF4A8D470"><enum>(e)</enum><header>Authorization of
			 appropriations</header>
				<paragraph id="H7DAD30627FB1456194D7596D5FE7B745"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">There is authorized
			 to be appropriated from the Highway Trust Fund (other than the Mass Transit
			 Account) to carry out this section $7,500,000 for each of fiscal years 2013
			 through 2017.</text>
				</paragraph><paragraph id="H44D2F7CBE64943A5B522984422780137"><enum>(2)</enum><header>Contract
			 authority</header><text display-inline="yes-display-inline">Funds authorized by
			 this subsection shall be available for obligation in the same manner as if the
			 funds were apportioned under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, except
			 the Federal share of the cost of activities carried out using such funds shall
			 be 80 percent, and such funds shall remain available until expended and shall
			 not be transferable.</text>
				</paragraph></subsection></section></legis-body>
