		<section id="HFF44C834EDD845F28864369A30E133DE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Preserving Access to Cape Hatteras
			 National Seashore Recreational Area Act</short-title></quote>.</text>
		</section><section id="H180FE079D6E94027BC9CD1A4F662551D"><enum>2.</enum><header>Reinstatement of
			 Interim Management Strategy</header>
			<subsection id="H8DCF2D86EC7D4354BF3985DFB6D1E121"><enum>(a)</enum><header>Management</header><text display-inline="yes-display-inline">After the date of the enactment of this
			 Act, Cape Hatteras National Seashore Recreational Area shall be managed in
			 accordance with the Interim Protected Species Management Strategy/Environmental
			 Assessment issued by the National Park Service on June 13, 2007, for the Cape
			 Hatteras National Seashore Recreational Area, North Carolina, unless the
			 Secretary of the Interior (hereafter in this Act referred to as the
			 <quote>Secretary</quote>) issues a new final rule that meets the requirements
			 set forth in section 3.</text>
			</subsection><subsection id="H66B21D45948F4C6FAFAD4560A8846974"><enum>(b)</enum><header>Restrictions</header><text display-inline="yes-display-inline">The Secretary shall not impose any
			 additional restrictions on pedestrian or motorized vehicular access to any
			 portion of Cape Hatteras National Seashore Recreational Area for species
			 protection beyond those in the Interim Management Strategy, other than as
			 specifically authorized pursuant to section 3 of this Act.</text>
			</subsection></section><section display-inline="no-display-inline" id="H992F61EF8EEA4C638D735664C4F80144" section-type="subsequent-section"><enum>3.</enum><header>Additional
			 restrictions on access to Cape Hatteras National Seashore Recreational Area for
			 species protection</header>
			<subsection id="H72533875240B4C26822307E041D3009E"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">If, based on
			 peer-reviewed science and after public comment, the Secretary determines that
			 additional restrictions on access to a portion of the Cape Hatteras National
			 Seashore Recreational Area are necessary to protect species listed as
			 endangered under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>),
			 the Secretary may only restrict, by limitation, closure, buffer, or otherwise,
			 pedestrian and motorized vehicular access for recreational activities for the
			 shortest possible time and on the smallest possible portions of the Cape
			 Hatteras National Seashore Recreational Area.</text>
			</subsection><subsection id="H0AFC74C4911D4123B98138F9B088DB0D"><enum>(b)</enum><header>Limitation on
			 restrictions</header><text display-inline="yes-display-inline">Restrictions
			 imposed under this section for protection of species listed as endangered under
			 the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>) shall not be
			 greater than the restrictions in effect for that species at any other National
			 Seashore.</text>
			</subsection><subsection id="HE47E4319B9814EF59587C11569D6EB7C"><enum>(c)</enum><header>Corridors around
			 closures</header><text display-inline="yes-display-inline">To the maximum
			 extent possible, the Secretary shall designate pedestrian and vehicular
			 corridors of minimal distance on the beach or interdunal area around closures
			 implemented under this section to allow access to areas not closed.</text>
			</subsection></section><section commented="no" id="H60E788DB1A064B139A8B4CA1C0A8CD32"><enum>4.</enum><header>Inapplicability
			 of final rule and consent degree</header>
			<subsection id="H7A2433FC524D4D3FB3DEF7C2B271ECC2"><enum>(a)</enum><header>Final
			 rule</header><text display-inline="yes-display-inline">The final rule titled
			 <quote>Special Regulations, Areas of the National Park System, Cape Hatteras
			 National Seashore—Off-Road Vehicle Management</quote> (77 Fed. Reg. 3123–3144)
			 shall have no force or effect after the date of the enactment of this
			 Act.</text>
			</subsection><subsection id="H1C5BD8CEE4FD4C3FB957FE17A2F7A721"><enum>(b)</enum><header>Consent
			 decree</header><text>The April 30, 2008, consent decree filed in the United
			 States District Court for the Eastern District of North Carolina regarding
			 off-road vehicle use at Cape Hatteras National Seashore in North Carolina shall
			 not apply after the date of the enactment of this Act.</text>
			</subsection></section></legis-body>
