			 this Act, wherever in this Act an amendment or repeal is expressed in terms of
			 an amendment to, or repeal of, a section or other provision, the amendment or
			 repeal shall be considered to be made to a section or other provision of the
			 Social Security Act.</text>
		</section><section id="HDB1CC7A2D4724C758D388350D572857B"><enum>4.</enum><header>State plans
			 required to address whether and how States will provide assistance to neediest
			 geographic areas</header><text display-inline="no-display-inline">Section
			 402(a)(1)(A)(i) (<external-xref legal-doc="usc" parsable-cite="usc/42/602">42 U.S.C. 602(a)(1)(A)(i)</external-xref>) is amended by inserting <quote>,
			 including whether and how the State will give priority to providing benefits
			 and services in areas of the State with the greatest need (such as areas with
			 the greatest unemployment rates, the greatest poverty rates, and the least job
			 opportunity to population ratios)</quote> before the period.</text>
		</section><section id="H04C7733CC5724956AD853D3532993E10"><enum>5.</enum><header>Funding of the
			 TANF program</header>
			<subsection id="H2D3DCE37AC2A4652BE7DB88EE80ED9F0"><enum>(a)</enum><header>State family
			 assistance grant</header>
				<paragraph id="H806CD5C178104705A40EF5E7DA463148"><enum>(1)</enum><header>In
			 general</header><text>Section 403(a)(1) (<external-xref legal-doc="usc" parsable-cite="usc/42/603">42 U.S.C. 603(a)(1)</external-xref>) is
			 amended—</text>
					<subparagraph id="H85D25E3F1EBB46E2BE075305063C2CAA"><enum>(A)</enum><text>in subparagraph
			 (A), by striking <quote>fiscal years 1996,</quote> and all that follows through
			 <quote>2003,</quote> and inserting <quote>fiscal year 2013 and each succeeding
			 fiscal year</quote>; and</text>
					</subparagraph><subparagraph id="HBA61E46F5DB24E3D91DB6B4520FA60B3"><enum>(B)</enum><text>by striking
			 subparagraphs (B) and (C) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="H4E117F376F5549998AD8AA4A205D2BFA" style="OLC">
							<subparagraph id="H5796F6E460694729A8FD734412D04673"><enum>(B)</enum><header>State family
				assistance grant</header>
								<clause id="H24B179DAF7DD4E98BC653725DC0FD108"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">The State family
				assistance grant payable to a State for a fiscal year shall be the greater
				of—</text>
									<subclause id="HA1991EDEA30E4A8DA15230FB0335CF48"><enum>(I)</enum><text>the adjusted basic
				block grant, plus the amount required to be paid to the State under paragraph
				(3) (as in effect on September 30, 2010) for fiscal year 2010; or</text>
									</subclause><subclause id="H55AD1F9ACC56477E93DF8DB4631DB78A"><enum>(II)</enum><text display-inline="yes-display-inline">the amount required to be paid to the State
				under this paragraph for the preceding fiscal year.</text>
									</subclause></clause><clause id="H588D6B9419194018ADB1B9E89A9A0C12"><enum>(ii)</enum><header>Adjusted basic
				block grant</header><text>In clause (i), the term <term>adjusted block
				grant</term> means, with respect to a State, the product of—</text>
									<subclause id="H10A0C15F46544A2DB765E3D18FAA2472"><enum>(I)</enum><text display-inline="yes-display-inline">the amount required to be paid to the State
				under this paragraph for fiscal year 2010 (determined without regard to any
				reduction pursuant to section 409 or 412(a)(1));</text>
									</subclause><subclause id="H3BACB8CC04404DDDA812052B9E2EA159"><enum>(II)</enum><text display-inline="yes-display-inline">1.00, plus the percentage (if any) by which
				the average of the CPI for the 12-month period ending with June of the
				preceding fiscal year exceeds the average of the CPI for the 12-month period
				ending with June 1996, expressed as a decimal; and</text>
									</subclause><subclause id="H7E5E189E213D498D9C0FEA98E85020B5"><enum>(III)</enum><text display-inline="yes-display-inline">1.00, plus the percentage (if any) by which
				the most recent estimate by the Bureau of the Census of the population of the
				State that has not attained 18 years of age exceeds the most recent estimate by
				the Bureau of the Census of that population as of July 1, 1996, expressed as a
				decimal.</text>
									</subclause></clause><clause id="HE7F84929A27D4E908E143DD3529BA33F"><enum>(iii)</enum><header>CPI
				defined</header><text>In clause (ii), the term <term>CPI</term> means the last
				Consumer Price Index for All Urban Consumers published by the Department of
				Labor for the period involved.</text>
								</clause></subparagraph><subparagraph id="H1AA5584F6CC94E00A180C79B7B9C38A5"><enum>(C)</enum><header>Appropriation</header><text display-inline="yes-display-inline">Out of any money in the Treasury of the
				United States not otherwise appropriated, there are appropriated such sums as
				are necessary for grants under this paragraph for each fiscal
				year.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H5BBF985BF55D4A80849BAD2FCC8A46F1"><enum>(2)</enum><header>Conforming
			 amendment to eliminate supplemental grants for population increases in certain
			 States</header><text>Section 403(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/603">42 U.S.C. 603(a)</external-xref>) is amended by striking
			 paragraph (3).</text>
				</paragraph></subsection><subsection id="H433BD64A942E42C3B32BE8545A79F8EC"><enum>(b)</enum><header>Penalty for
			 failure To maintain effort adjusted for inflation</header><text display-inline="yes-display-inline">Section 409(a)(7) (<external-xref legal-doc="usc" parsable-cite="usc/42/609">42 U.S.C. 609(a)(7)</external-xref>) is
			 amended—</text>
				<paragraph id="HDF5A25E647FC408D82BDBEA6741D4681"><enum>(1)</enum><text>in subparagraph
			 (A), by inserting <quote>the inflation-adjusted</quote> before <quote>historic
			 State expenditures</quote>; and</text>
				</paragraph><paragraph id="H326BF066666A47FB94B442BD5E110DCC"><enum>(2)</enum><text>in subparagraph
			 (B), by redesignating clauses (iii) through (v) as clauses (iv) through (vi),
			 respectively, and inserting after clause (ii) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H2E803817102D45738C04AC6FEB27902C" style="OLC">
						<clause id="HBA15956B2BBD4B66912ADA13CFBF6A86"><enum>(iii)</enum><header>Inflation-adjusted
				historic State expenditures</header><text display-inline="yes-display-inline">The term <term>inflation-adjusted historic
				State expenditures</term> means, with respect to a fiscal year—</text>
							<subclause id="H6C9F0BE0ED4441E08EC3912A9BDD560E"><enum>(I)</enum><text>historic State
				expenditures; multiplied by</text>
							</subclause><subclause id="H45B4D00AE8484827ABE55AF87618938C"><enum>(II)</enum><text display-inline="yes-display-inline">1.00, plus (in the case of fiscal year 2014
				or any succeeding fiscal year) the percentage (if any) by which the average of
				the CPI (as defined in section 403(a)(1)(B)(iii)) for the 12-month period
				ending with June of the preceding fiscal year exceeds the average of the CPI
				(as so defined) for the 12-month period ending with June 2012, expressed as a
				decimal.</text>
							</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HE34C0F1C168F4489ADB3875E2B49C306"><enum>(c)</enum><header>Modification of
			 contingency fund</header>
				<paragraph id="H65F54C4FA80C4CCEB55A9FEC034D20BE"><enum>(1)</enum><header>In
			 general</header><text>Section 403(b) (<external-xref legal-doc="usc" parsable-cite="usc/42/603">42 U.S.C. 603(b)</external-xref>) is amended by striking
			 all that follows paragraph (1) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="HEC3F20A25F4346E09228BC32809C0A0F" style="OLC">
						<paragraph id="H0815EE381AEC4DE8A2CDF7895BC43CCD"><enum>(2)</enum><header>Grants</header>
							<subparagraph id="HB32BC281C07F40899D555194F82DD5E2"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall make a grant to each eligible State
				and each Indian tribe that is an economically needy entity for a calendar
				quarter, in an amount equal to 80 percent of the amount (if any) by which the
				total amount of relevant expenditures of the entity for the quarter exceeds the
				total amount of the relevant expenditures of the entity for the corresponding
				quarter in the base year of the entity, subject to paragraph (2).</text>
							</subparagraph><subparagraph id="HA28DD6CA289A4848A1AF0DABA60DAC14"><enum>(B)</enum><header>Limitation</header><text>The
				total amount payable to an entity under this subsection for a fiscal year shall
				not exceed an amount equal to 25 percent of the amount payable to the
				entity—</text>
								<clause id="H1490C73AA62C4955B791E2E2ACF43478"><enum>(i)</enum><text>if
				the entity is a State, under section 403(a)(1) for the fiscal year; or</text>
								</clause><clause id="HA64F81194FF142BB89FAF0B6BDD48FED"><enum>(ii)</enum><text>if the entity is
				an Indian tribe, under section 412(a)(1) for the fiscal year.</text>
								</clause></subparagraph></paragraph><paragraph id="H78986342165F4157BB9BE7495EFE1FC5"><enum>(3)</enum><header>Definitions</header><text display-inline="yes-display-inline">In paragraph (2):</text>
							<subparagraph id="H58D8696D45674140B8FA659D3ACB5180"><enum>(A)</enum><header>Economically
				needy entity</header><text display-inline="yes-display-inline">The term
				<term>economically needy entity</term> means an entity with respect to a
				calendar quarter—</text>
								<clause id="H3880D7B179694E008A996A4177E18659"><enum>(i)</enum><text>if
				the seasonally adjusted average unemployment rate with respect to entity for
				the quarter or any of the preceding 4 calendar quarters exceeds 6.5 percent;
				or</text>
								</clause><clause id="HFEFFDF52A0C74D66AF036C1C3471F519"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case that the unemployment rate
				information described in clause (i) is not available with respect to the
				entity, if the entity meets such qualifications as the Secretary, in
				consultation with the Secretary of Labor, shall, by regulation,
				prescribe.</text>
								</clause></subparagraph><subparagraph id="H5B5A44DE688241279865622F278ADBC9"><enum>(B)</enum><header>Base
				year</header><text>The term <term>base year</term> means, with respect to an
				entity, and a calendar quarter in a fiscal year—</text>
								<clause id="HA5FE4CADFAA448FB8C789795BB549620"><enum>(i)</enum><text>except as provided
				in clause (ii), whichever of the 2 fiscal years most recently preceding the 1st
				fiscal year of the most recent contingency fund eligibility period for the
				entity, is the fiscal year in which the relevant expenditures of the entity
				were the lesser; or</text>
								</clause><clause id="H1800DCAD38E546D69A641C90C303B3D5"><enum>(ii)</enum><text>if the 1st year
				of the period referred to in clause (i) is fiscal year 2013, whichever of
				fiscal year 2007 or 2008 is the fiscal year in which the relevant expenditures
				of the entity were the lesser.</text>
								</clause></subparagraph><subparagraph id="H40F2CA26F69B4C418B6A6047BBE70132"><enum>(C)</enum><header>Contingency fund
				eligibility period</header><text display-inline="yes-display-inline">The term
				<term>contingency fund eligibility period</term> means, with respect to an
				entity, a period of 1 or more consecutive calendar quarters for which the
				entity is an economically needy entity.</text>
							</subparagraph><subparagraph id="HAA8A2411D92641B0882AD0663F621352"><enum>(D)</enum><header>Relevant
				expenditures</header>
								<clause id="HCE9DEDAE9C2F4874BABF613A289E7874"><enum>(i)</enum><header>In
				general</header><text>The term <term>relevant expenditures</term> means
				expenditures—</text>
									<subclause id="HCBD95DD24AE44A6C99DA5BB39BA2DFFF"><enum>(I)</enum><text display-inline="yes-display-inline">for assistance under the program funded
				under this part of the entity (including, in the case of a State, any qualified
				State expenditures (as defined in section 409(a)(7)(B)(i)) and any expenditures
				under any other State program funded by such expenditures);</text>
									</subclause><subclause id="HDAF7524B49E34155ADF7EA8E6C89A2AB"><enum>(II)</enum><text>for child
				care;</text>
									</subclause><subclause id="H1271E9E90BFD4619A1E7A432DEAC83FE"><enum>(III)</enum><text display-inline="yes-display-inline">for subsidized employment under the program
				funded under this part of the entity (including, in the case of a State, such
				expenditures under any other State program funded by qualified State
				expenditures (as defined in section 409(a)(7)(B)(i))), other than expenditures
				made using Federal funds or with respect to which the entity received a grant
				made under paragraph (3) of this subsection; and</text>
									</subclause><subclause id="H375BC9AB2F8146168111D2544A34CFF3"><enum>(IV)</enum><text>for
				administrative costs associated with making the expenditures referred to in the
				preceding subclauses of this clause.</text>
									</subclause></clause><clause id="H778A264E7B214029ACA62E076320B771"><enum>(ii)</enum><header>Child care
				expenditures</header><text display-inline="yes-display-inline">For purposes of
				clause (i), expenditures for child care consist of the following:</text>
									<subclause id="H18830FD156434606B92CFA73836B4618"><enum>(I)</enum><text>Amounts
				transferred under section 404(d)(1)(B).</text>
									</subclause><subclause id="H1174EA87919545F2A85171A2816E7B34"><enum>(II)</enum><text>Expenditures for
				child care assistance from Federal funds provided under this part.</text>
									</subclause><subclause id="H3463EDD5A0BA438C999B8A5CD89B11AA"><enum>(III)</enum><text>In the case of
				an entity that is a State, expenditures for child care assistance that are
				qualified State expenditures (as defined in section 409(a)(7)(B)(i)), but only
				to the extent exceeding the total expenditures of the State (other than from
				Federal funds) for child care in fiscal year 1994 or 1995 (whichever is the
				greater).</text>
									</subclause></clause><clause id="HA40AC1669CFE498390E7A2C871F2A1AB"><enum>(iii)</enum><header>Authority to
				collect and adjust data</header><text display-inline="yes-display-inline">In
				determining the amount of the expenditures of a State for basic assistance,
				child care, and subsidized employment, during any period for which the State
				requests funds under this subsection, and during the base year of the State,
				the Secretary may make appropriate adjustments to the data, on a State-by-State
				basis, to ensure that the data are comparable with respect to the groups of
				families served and the types of aid provided. The Secretary may develop a
				mechanism for collecting expenditure data, including procedures which allow
				States to make reasonable estimates, and may set deadlines for making revisions
				to the data.</text>
								</clause></subparagraph></paragraph><paragraph id="HB87665CBD4CC46FE867F9558D28A9D71"><enum>(4)</enum><header>Use of
				grant</header><text display-inline="yes-display-inline">Each State to which a
				grant is made under this subsection shall use the grant to serve areas of the
				State with the greatest need (as referred to in section 402(a)(1)(A)).</text>
						</paragraph><paragraph id="H6C2EC3AD9B4044B68EF1423E997A3C99"><enum>(5)</enum><header>Appropriation</header>
							<subparagraph id="H8E9C3318469A45C3B98A834FF26E1E86"><enum>(A)</enum><header>In
				general</header><text>Out of any funds in the Treasury of the United States not
				otherwise appropriated, there are appropriated for payment to the Fund—</text>
								<clause id="HDCCA2225C1A549CC90E00F5F01A5BE5D"><enum>(i)</enum><text>$2,500,000,000 for
				fiscal year 2013; and</text>
								</clause><clause id="HCEF07EC2B2A74D42B80438A0C2EBE802"><enum>(ii)</enum><text>for each
				succeeding fiscal year, the amount appropriated under this paragraph for the
				then preceding fiscal year, increased by the percentage (if any) by which the
				amount appropriated under section 403(a)(1) for the fiscal year involved
				exceeds the amount appropriated under such section for the then preceding
				fiscal year.</text>
								</clause></subparagraph><subparagraph id="HD8E4E203ABA542069D6B864E16E6CBCE"><enum>(B)</enum><header>Availability</header><text>Amounts
				made available under this paragraph for a fiscal year shall remain available
				until expended.</text>
							</subparagraph></paragraph><paragraph id="H5DE717696EA441B8808E2BCA8A37273A"><enum>(6)</enum><header>Actions to be
				taken in anticipation of exhaustion of fund</header><text>The Secretary shall
				monitor the amount in, and the rate at which amounts are paid from, the Fund,
				and if the Secretary determines that the Fund will be exhausted within 6
				months, the Secretary shall—</text>
							<subparagraph id="H5AE63732F78E4001B5EB3CB6C57FFC3C"><enum>(A)</enum><text>notify the
				Congress of the determination; and</text>
							</subparagraph><subparagraph id="H71621E011A8C42BB9A0E5DABE0257A35"><enum>(B)</enum><text display-inline="yes-display-inline">develop and communicate to each State and
				Indian tribe that is an economically needy entity as of the date of the
				determination, the procedure for allocating amounts in the Fund among such
				entities.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H428D29931F554B378E4F5BB37E1B0207"><enum>(2)</enum><header>Elimination of
			 penalty for failure of state receiving amounts from contingency fund to
			 maintain 100 percent of historic effort</header>

				each eligible State that is 1 of the 50 States or the District of Columbia, for
				each fiscal year for which the State is an MOE State; and</text>
								</clause><clause id="HD0EA1F75BDA9428CBEA1E94FD9842FC4"><enum>(ii)</enum><text>to each State
				that is not 1 of the 50 States or the District of Columbia, and to each Indian
				tribe, for each fiscal year for which the State or tribe, as the case may be,
				meets such terms and conditions as the Secretary shall, by regulation,
				establish, which shall be comparable to the terms and conditions under which
				grants are made under clause (i).</text>
								</clause></subparagraph><subparagraph id="HF902B91FD1964291A5F7109C7BC4D221"><enum>(B)</enum><header>MOE
				State</header><text>In subparagraph (A), the term <term>MOE State</term> means
				a State if the qualified expenditures of the State (as defined in section
				409(a)(7)(B)(i)) for the fiscal year exceeds the applicable percentage (as
				defined in clause (ii) of such section) of inflation-adjusted historic State
				expenditures (as defined in clause (iii) of such section) of the State with
				respect to the fiscal year.</text>
							</subparagraph><subparagraph id="HFE4B48F51A83469A95686EE37532DCA2"><enum>(C)</enum><header>Amount of
				grant</header>
								<clause id="HE2F6174DDC1E47A1A9098C92C09374BA"><enum>(i)</enum><header>States</header>
									<subclause id="HAA6E837120744A259F65BFCDCCEE3C0B"><enum>(I)</enum><header>In
				general</header><text>The grant to be made to a State under subparagraph (A)(i)
				for a fiscal year shall be in an amount equal to 50 percent of the excess
				expenditures of the State for subsidized employment during the fiscal
				year.</text>
									</subclause><subclause id="HCFBA6D4AB1B44661BB060C5C51304CD3"><enum>(II)</enum><header>Excess
				expenditures of the State for subsidized employment</header><text>The term
				<term>excess expenditures of the State for subsidized employment</term> means,
				with respect to a fiscal year, the lesser of—</text>
										<item id="H114CDA995A6D40FA99492D8B650B50B4"><enum>(aa)</enum><text>the
				excess described in subparagraph (B) with respect to the State for the fiscal
				year; or</text>
										</item><item id="H8179BEE4D12146AFB496F2F46F3A5A5A"><enum>(bb)</enum><text display-inline="yes-display-inline">an amount equal to the total expenditures
				of the State for subsidized employment funded under this part or under any
				other State program funded by qualified State expenditures (as defined in
				section 409(a)(7)(B)(i)), excluding those with respect to which a grant is made
				to the State under subsection (b) of this section, during the fiscal
				year.</text>
										</item></subclause></clause><clause id="H3293529170DB4CE4A7A9F417B1DDBDF5"><enum>(ii)</enum><header>Indian
				tribes</header><text>The grant to be made to an Indian tribe under this
				paragraph shall be in such amount as the Secretary deems appropriate.</text>
								</clause></subparagraph><subparagraph id="H33A4C6798DC94925817AC1E13781BCC6"><enum>(D)</enum><header>Use of
				grant</header><text display-inline="yes-display-inline">Notwithstanding section
				404, a State or Indian tribe to which a grant is made under this paragraph
				shall use the grant solely to finance subsidized employment activities, and to
				serve areas of the State with the greatest need (as referred to in section
				402(a)(1)(A)).</text>
							</subparagraph><subparagraph id="H88BE4D391E8B4E7BB8CD5D970DD4F0F2"><enum>(E)</enum><header>Appropriation</header><text>Out
				of any funds in the Treasury of the United States not otherwise appropriated,
				there are appropriated such sums as are necessary for grants under this
				paragraph for each fiscal
				year.</text>

				expenditures (other than child care expenditures) by the State under parts A
				and F (as so in effect) for fiscal year 1994 for Indian families residing in
				the service areas identified by the tribe pursuant to subsection (b)(1)(C) of
				this section that are in the State, increased by the percentage (if any) by
				which the amount of the grant payable under section 403(a)(1) for the fiscal
				year to the State exceeds the amount of the grant so payable to the State for
				fiscal year
				2010.</text>
							</clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H557946CE4DC74FC0B6EE5544D5821701"><enum>(f)</enum><header>Census bureau
			 study</header><text>Section 414 (<external-xref legal-doc="usc" parsable-cite="usc/42/614">42 U.S.C. 614</external-xref>) is amended—</text>
				<paragraph id="HACEF3BB17B4F459883AF29F0BFDF46BC"><enum>(1)</enum><text>by striking
			 subsection (a) and inserting the following:</text>

				and programs related to low-income families, including policies and programs
				under State programs funded under this part or funded with qualified State
				expenditures (as defined in section 409(a)(7)(B)(i)), including changes and
				policies in such programs made pursuant to the Rewriting to Improve and Secure
				an Exit Out of Poverty Act. The Director shall design the study in consultation
				with the Secretary. Every 5 years, the Director shall, in consultation with the
				Secretary, revise the content and nature of the study to reflect emerging
				policy issues related to low-income
				families.</text>
						</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HF75797FBFA0B4F93B042AC0895398D99"><enum>(2)</enum><text>in subsection (b),
			 by striking <quote>fiscal year 2012</quote> and inserting <quote>each fiscal

						</paragraph><paragraph id="H060CBAAB90724E2EBAF3A20A698BA6A7"><enum>(2)</enum><header>Work-eligible
				individual defined</header>
							<subparagraph id="HEC7509F5E156445B9EE7DA172A445A7F"><enum>(A)</enum><header>In
				general</header><text>In subsection (a), the term <term>work-eligible
				individual</term>, subject to subparagraphs (B) and (C), means—</text>
								<clause id="H437F310AE55C4530A6272DD89A56EF1B"><enum>(i)</enum><text display-inline="yes-display-inline">an adult recipient of assistance under the
				State program funded under this part or under any other State program funded by
				qualified State expenditures (as defined in section 409(a)(7)(B)(i));</text>
								</clause><clause id="H910E421C20BD4ACFB9F710DD33706505"><enum>(ii)</enum><text display-inline="yes-display-inline">a former recipient of such assistance who
				is—</text>
									<subclause id="H664A849043F54FCDB1755896E8AABEA7"><enum>(I)</enum><text>a parent of a
				dependent child who is such a recipient; and</text>
									</subclause><subclause id="H71A41C4A077642BAAFDFDC3F94969013"><enum>(II)</enum><text>no longer
				eligible for assistance under the State program funded under this part by
				reason of section 408(a)(7); and</text>
									</subclause></clause><clause id="HBB552FC52AF34C4EACC89BECF1C84D45"><enum>(iii)</enum><text display-inline="yes-display-inline">a participant in a subsidized employment
				program funded under this part or under any other State program funded by
				qualified State expenditures (as defined in section 409(a)(7)(B)(i)).</text>
								</clause></subparagraph><subparagraph id="H0161B101EBA4435AB5083520C7D8C127"><enum>(B)</enum><header>Exclusion of
				individuals sanctioned or undergoing pre-sanction review</header><text>The term
				<term>work-eligible individual</term> does not include any individual with
				respect to whom—</text>
								<clause id="H0942460C12644A8AB66ECFC620318E13"><enum>(i)</enum><text>there is in effect
				a penalty imposed by the State under subsection (e) of this section; or</text>
								</clause><clause id="H5CFB15ED5F134519BC1439CC2349131C"><enum>(ii)</enum><text>the State has
				initiated (but not completed) the pre-sanction review process pursuant to
				section 408(a)(14)(A).</text>
								</clause></subparagraph><subparagraph id="H3A2055C643D24700891A10CD3E550599"><enum>(C)</enum><header>State option to
				exclude certain individuals</header><text display-inline="yes-display-inline">A
				State may exclude from the term <term>work-eligible individual</term> any
				resident of the State who is—</text>
								<clause id="H6ADB76E7287D4C53A21CEBEC7173B00B"><enum>(i)</enum><text>a
				single parent caring for a child who has not attained 1 year of age;</text>
								</clause><clause id="HA3A21336162F49A69549A69402BBB46A"><enum>(ii)</enum><text>a
				recipient of supplemental security income benefits under title XVI, disability
				insurance benefits under title II, or other Federal or State benefits based on
				disability;</text>
								</clause><clause id="HDCF2DBAE5B804391AD9507D9F2B6F2A2"><enum>(iii)</enum><text display-inline="yes-display-inline">an applicant for supplemental security
				income benefits under title XVI;</text>
								</clause><clause id="HFB9F1CF7D31C4216925C0C6969701D83"><enum>(iv)</enum><text>an individual who
				is needed in the home of the individual to care for a disabled member of the
				family of the individual; or</text>
								</clause><clause id="HD2EC93F07CA6470CA5676C9EC8E44E66"><enum>(v)</enum><text display-inline="yes-display-inline">an individual who (but for the exercise of
				the State option under this clause) would be a work-eligible individual under a
				tribal family assistance plan approved under section 412 or under a tribal work
				program to which funds are provided under this part.</text>
								</clause></subparagraph></paragraph></subsection><subsection id="HF894462F0429428D8E35D69194D588C0"><enum>(b)</enum><header>Calculation of
				participation rates</header>
						<paragraph id="HBB6E437A5EAE4605849FACD79AC7A397"><enum>(1)</enum><header>Average monthly
				rate</header><text>For purposes of subsection (a), the participation rate of a
				State for a fiscal year is the average of the participation rates of the State
				for each month in the fiscal year.</text>
						</paragraph><paragraph id="H25239E97B58E4A4F91B70AD0172B3ED3"><enum>(2)</enum><header>Monthly
				participation rate</header><text>For purposes of paragraph (1), the
				participation rate of a State for a month, expressed as a percentage,
				is—</text>
							<subparagraph id="H01D004515DF943E58043A98AEDB2FDBC"><enum>(A)</enum><text display-inline="yes-display-inline">the number of families residing in the
				State that include a work-eligible individual who is engaged in work for the
				month; divided by</text>

				State that include a work-eligible
				individual.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H1A672AD9188748CFAD92001079BD5C86"><enum>(b)</enum><header>Participation
			 requirements</header><text>Section 407(c) (<external-xref legal-doc="usc" parsable-cite="usc/42/607">42 U.S.C. 607(c)</external-xref>) is amended to read
			 as follows:</text>

				rule</header><text display-inline="yes-display-inline">An individual is engaged
				in work for a month in a fiscal year if the recipient is participating in work
				activities for an average of at least 20 hours per week during the
				month.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H801F63A7B08346CD9BE90908EBEBA6AF"><enum>(2)</enum><header display-inline="yes-display-inline">Individuals complying with a modified
				employability plan deemed to be engaged in work</header><text display-inline="yes-display-inline">An individual is deemed to be engaged in
				work for a month if the State determines that the individual is in substantial
				compliance with the activities and hourly participation requirements of a
				modified employability plan developed for the individual in accordance with
				section 408(h).</text>
						</paragraph><paragraph id="H7C944A194D724985AE8C312EF3E4DFE3"><enum>(3)</enum><header>Single teen head
				of household or married teen who maintains satisfactory school attendance
				deemed to be engaged in work</header><text>An individual who is married or a
				head of household and has not attained 20 years of age is deemed to be engaged
				in work for a month if the recipient maintains satisfactory attendance at
				secondary school or the equivalent during the
				month.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H45C4E8D75B7A461CAE95B19579F7FDC5"><enum>(c)</enum><header>Elimination of
			 12-Month limit on counting vocational educational training as a work
			 activity</header><text display-inline="yes-display-inline">Section 407(d)(8)
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/607">42 U.S.C. 607(d)(8)</external-xref>) is amended by striking <quote>(not to exceed 12 months

				employability plan for a recipient of assistance under the State program funded
				under this part—</text>
							<subparagraph id="HD3004838CFE24592A4B6BE0FE1CDD721"><enum>(A)</enum><text>who—</text>
								<clause id="HB773AAFA8B304837B0B081C7DE954541"><enum>(i)</enum><text>is
				a work-eligible individual (as defined in section 407(a)(2)); and</text>
								</clause><clause id="HB287BA6253D344188E643A43946DAB78"><enum>(ii)</enum><text>has been
				determined by a qualified medical, mental health, addiction, or social services
				professional (as determined by the State) to have a disability; or</text>
								</clause></subparagraph><subparagraph id="H39046A1D7B424F8487FDDB1F523157AD"><enum>(B)</enum><text>who is caring for
				a family member with a disability (as so determined).</text>
							</subparagraph></paragraph><paragraph id="H3B53E6D9C2BC4A2297B18E19246BC07B"><enum>(2)</enum><header>Contents of
				plan</header><text>The modified employability plan shall—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="HEDDEE6B893B3402D81A23BCCE3D4BCBA"><enum>(A)</enum><text display-inline="yes-display-inline">include a determination that, because of
				the disability of the recipient or the individual for whom the recipient is
				caring, reasonable modification of work activities, hourly participation
				requirements, or both, is needed in order for the recipient to participate in
				the activities;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD5359B526F6949A7899A5F01B43BB1FB"><enum>(B)</enum><text display-inline="yes-display-inline">describe the modified work activities in
				which the recipient is required to participate;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H27840EDDA2024282AEACB1D622720A1A"><enum>(C)</enum><text display-inline="yes-display-inline">specify the number of hours per week for
				which the recipient is required to participate in the modified work activities,
				based on an evaluation by the State of the circumstances of the family;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4361DE7C90D8471FA317CCAF40A38E76"><enum>(D)</enum><text display-inline="yes-display-inline">describe the services, supports, and
				modifications that the State will provide to the recipient or the family of the
				recipient;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3518C1816EB441E19DC657C094661E27"><enum>(E)</enum><text display-inline="yes-display-inline">be developed in cooperation with the
				recipient; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3E78602201D24671B4CA806B762865A3"><enum>(F)</enum><text display-inline="yes-display-inline">be reviewed not less often than every 6
				months.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H00A25F3E075942998348EBE23BECBAAF"><enum>(3)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this subsection:</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="H8EE46AAC092E49D3AB25D4EDF071E1A0"><enum>(A)</enum><header display-inline="yes-display-inline">Disability</header><text display-inline="yes-display-inline">The term <term>disability</term> means a
				mental or physical impairment, including substance abuse or addiction,
				that—</text>
								<clause commented="no" display-inline="no-display-inline" id="HB6C28EC3BFC94656BF2F2A7AA57F505B"><enum>(i)</enum><text display-inline="yes-display-inline">constitutes or results in a substantial
				impediment to employment; or</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="HF12A13DCFB5D43DD9A1C057F9A1BA8E4"><enum>(ii)</enum><text display-inline="yes-display-inline">substantially limits 1 or more major life
				activities.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4F637779D6B8497792BB05126A5A81C7"><enum>(B)</enum><header display-inline="yes-display-inline">Modified work activities</header><text display-inline="yes-display-inline">The term <term>modified work
				activities</term> means activities which the State has determined will help the
				recipient become
				employable.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H46098F62071E4E42A7DF14AA996CDC82"><enum>(d)</enum><header>Sanctions</header>
				<paragraph id="H6E2EB8B753784F06AD1214A83AFFEFE0"><enum>(1)</enum><header>General sanction
			 provisions</header>
					<subparagraph id="HFACCC1FB55CD4CE983B78D0991C70126"><enum>(A)</enum><header>Prohibition on
			 imposing lifetime or full family sanction</header>

			 protections</header>
						<clause id="HDF1D1DFF3AEF4994A171CB9EDFAE42CC"><enum>(i)</enum><header>In
			 general</header><text>Section 408(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/608">42 U.S.C. 608(a)</external-xref>), as amended by
			 subparagraph (A)(i) of this paragraph, is amended by adding at the end the
			 following:</text>

								<paragraph id="HAC15EC14507E459BB0B90E4F882674F4"><enum>(14)</enum><header>Sanction
				procedures</header>
									<subparagraph id="H4AA0DF87B9084B249EA814C37E256DA6"><enum>(A)</enum><header>Pre-sanction
				review process</header><text>Before imposing a sanction against an individual
				or family receiving assistance under the State program funded under this part
				or under a program funded with qualified State expenditures (as defined in
				section 409(a)(7)(B)(i)) for failure to comply with program requirements, the
				State shall take the following steps:</text>
										<clause id="H0FCF181D3A2F431CBF411D3D381D9DE0"><enum>(i)</enum><text>Provide or send
				notice to the individual or family, and, if the recipient’s native language is
				not English, through a culturally competent written or verbal translation, of
				the following information:</text>
											<subclause id="H08B53B8D9E5240B1A4A31A74DE34568A"><enum>(I)</enum><text>The specific
				reason for the proposed sanction.</text>
											</subclause><subclause id="H863BFEE9022445E6BAA271F9E8A29A41"><enum>(II)</enum><text>The amount of the
				proposed sanction.</text>
											</subclause><subclause id="H6E5CF9F75F054E77966C01C491C66687"><enum>(III)</enum><text>The length of
				time during which the proposed sanction would be in effect.</text>
											</subclause><subclause id="H9E16D8B891824F808CCBCCB21C782EA8"><enum>(IV)</enum><text>The steps
				required to come into compliance or to show good cause for
				noncompliance.</text>
											</subclause><subclause id="HDA1FF94FC77C4B8A9EEE7B3B6D98635B"><enum>(V)</enum><text>That the agency
				will provide assistance to help the individual demonstrate good cause for
				noncompliance, or come into compliance with program requirements.</text>
											</subclause><subclause id="HA65DDAC0F83445DF8216C772833D58FF"><enum>(VI)</enum><text>That the
				individual may appeal the determination to impose a sanction, and the steps
				that the individual must take to pursue such an appeal.</text>
											</subclause></clause><clause id="HC362F486755B4C1C8A7BC3BA8B800776"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H195548EBBC4A4FE0860404A7EF953479"><enum>(I)</enum><text>Ensure that, subject to
				clause (iii)—</text>
												<item id="H7D01437EC9C340E38EDA79B681A98BAC" indent="up1"><enum>(aa)</enum><text>an individual, other than the
				individual who determined that a sanction be imposed, will review the
				determination and have the authority to take the actions described in subclause
				(II); and</text>
												</item><item id="HA08BC45DC12541809610E42E1A3FBC5B" indent="up1"><enum>(bb)</enum><text>the individual or family against whom
				the sanction is to be imposed shall be afforded the opportunity to meet with
				the individual who is reviewing the determination to impose the
				sanction.</text>
												</item></subclause><subclause id="H2031AFB44879493182281D6A9CCAEBB6" indent="up1"><enum>(II)</enum><text>The action described in this subclause
				are the following:</text>
												<item id="H6B2A096ED6B94CCDA52588FAB38C902F"><enum>(aa)</enum><text>Modify the determination to impose a
				sanction.</text>
												</item><item id="H7A85189FCD2448529BF31DA1C030B18F"><enum>(bb)</enum><text>Determine that there was good cause
				for the failure to comply.</text>
												</item><item id="HF8B059C796464DDDA11AAA92CE4ED6FC"><enum>(cc)</enum><text>Recommend modifications to the
				individual responsibility or employment plan of an individual.</text>
												</item><item id="HDED97C1DB0AE4D07859783953B2879CF"><enum>(dd)</enum><text>Make such other determinations and
				take such other actions as may be appropriate.</text>
												</item></subclause></clause><clause id="H35DB839E612345D9A0B1D030F483F486"><enum>(iii)</enum><text>The review
				required under clause (ii) shall include consideration of the following:</text>
											<subclause id="HF497493DF2274B249E606C7A803EE861"><enum>(I)</enum><text>To the extent
				applicable, whether barriers to compliance exist, such as a physical or mental
				impairment (including mental illness, substance abuse, mental retardation, or a
				learning disability), domestic or sexual violence, limited proficiency in
				English, limited literacy, homelessness, or the need to care for a child with a
				disability or health condition, that contributed to the noncompliance.</text>
											</subclause><subclause id="HDF4FF6FAF7E94A769282633CBFF78029"><enum>(II)</enum><text>Whether the
				noncompliance resulted from failure to receive or have access to services
				identified as necessary in an individual responsibility or employment
				plan.</text>
											</subclause><subclause id="HAAB50DF12EB54694961017AD65D5EFBF"><enum>(III)</enum><text>Whether changes
				to the individual responsibility or employment plan of an individual should be
				made in order for the individual to come into compliance.</text>
											</subclause><subclause id="HE72A06AE8AE04DF4B463743994843908"><enum>(IV)</enum><text>Whether there is
				good cause for any noncompliance.</text>
											</subclause><subclause id="H08094DDD205B486EAEC6245E95E46F80"><enum>(V)</enum><text>Whether the
				sanction policies of the State have been applied properly.</text>
											</subclause></clause></subparagraph><subparagraph id="H96F8482FE8C14EB18A47A3F7ADD412CE"><enum>(B)</enum><header>Sanction
				follow-up requirements</header><text>If a State imposes a sanction on a family
				or individual for failing to comply with program requirements, the State
				shall—</text>
										<clause id="HD6944E98554D4AC785447D0D9E700A43"><enum>(i)</enum><text>provide or send
				notice to the individual or family, in language calculated to be understood by
				the individual or family, and, if the individual’s or family’s native language
				is not English, through a culturally competent translation, of the reason for
				the sanction and the steps the individual or family must take to end the
				sanction;</text>
										</clause><clause id="H667EF8E587544EA1A0CCCA7A351338DE"><enum>(ii)</enum><text>resume full
				assistance, services, or benefits to the individual or family under the program
				(if the individual or family is otherwise eligible for the assistance,
				services, or benefits) once the individual who was not in compliance with
				program requirements that led to the sanction complies with the requirements
				for a reasonable period of time, as determined by the State and subject to
				State discretion to reduce the period; and</text>
										</clause><clause id="H03228A979E684E28AEDC8A1A78D141C1"><enum>(iii)</enum><text>if the State has
				not resumed providing the assistance, services, or benefits as of the end of
				the 120-day period that begins on the date that is 60 days after the date on
				which the sanction was imposed, provide notice to the individual or family, in
				language calculated to be understood by the individual or family, of the steps
				the individual or family must take to end the sanction, and of the availability
				of assistance to come into compliance or demonstrate good cause for
				noncompliance.</text>
										</clause></subparagraph><subparagraph id="H2ECC482D75B84A8EB70AE7A6F1E63E30"><enum>(C)</enum><header>Notice to
				evicted persons</header><text display-inline="yes-display-inline">The State
				shall make a reasonable effort to provide to an individual or family that has
				been evicted from a residence for failure to pay rent or as a result of another
				problem related to poverty, any notice required by this paragraph to be
				provided to the individual or
				family.</text>
									</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause><clause id="H0FDE6F59FBC9495882A74E86BA9A4DC9"><enum>(ii)</enum><header>Penalty</header><text display-inline="yes-display-inline">Section 409(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/609">42 U.S.C. 609(a)</external-xref>), as
			 amended by section 5(c)(2)(A) of this Act, subsection (b)(3) of this section,
			 and subparagraph (A)(ii) of this paragraph, is amended by adding at the end the
			 following:</text>

				amount equal to not more than 5 percent of the State family assistance
				grant.</text>
									</subparagraph><subparagraph id="H585EFC5756394C9D88A24E6038F3F50E"><enum>(B)</enum><header>Penalty based on
				severity of failure</header><text>The Secretary shall impose reductions under
				subparagraph (A) with respect to a fiscal year based on the degree of
				noncompliance.</text>
									</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause><clause id="H627AF6D39A7A4CE08661DEC8813045FD"><enum>(iii)</enum><header>State plan
			 requirement to describe how states will notify applicants and recipients of
			 their rights under the program and of potential benefits and services available
			 under the program</header><text>Section 402(a)(1)(B)(iii) (42 U.S.C.
			 602(a)(1)(B)(iii)) is amended by inserting <quote>, and will notify applicants
			 and recipients of assistance under the program of the rights of individuals
			 under all laws applicable to program activities and of all potential benefits
			 and services available under the program</quote> before the period.</text>
						</clause></subparagraph></paragraph><paragraph id="HCD2A26AB6B9640448915159007F99316"><enum>(2)</enum><header>Modifications to
			 work sanction</header>
					<subparagraph id="H4FE1A632E6B44894A35084318FB80FDE"><enum>(A)</enum><header>Elimination of
			 full family sanction; State required to establish certain good cause
			 exceptions</header><text>Section 407(e)(1) (<external-xref legal-doc="usc" parsable-cite="usc/42/607">42 U.S.C. 607(e)(1)</external-xref>) is
			 amended—</text>
						<clause id="H050C9B49EA984656AF2276B088AC2EC4"><enum>(i)</enum><text>by
			 striking <quote>shall—</quote> and all that follows through subparagraph (B)
			 and inserting <quote>shall reduce the amount of assistance otherwise payable to
			 the family pro rata with respect to any period during a month in which the
			 individual so refuses,</quote>; and</text>
						</clause><clause id="HE8E1E87F26B048B1B9D275BD80562E34"><enum>(ii)</enum><text>by
			 striking <quote>may establish</quote> and inserting the following <quote>shall
			 establish, which shall include the decline of an offer of employment at a wage
			 less than the greater of the applicable Federal or State minimum wage, or 80
			 percent of the wage that would have governed had the minimum hourly rate under
			 the Fair Labor Standards Act been applicable to the offer of employment, at a
			 site subject to a strike or lockout at the time of refusal, or for medical
			 reasons or a lack of sufficient physical strength or stamina</quote>.</text>
						</clause></subparagraph><subparagraph display-inline="no-display-inline" id="H6B6AB1ECD98C43389377A691EEC9118D"><enum>(B)</enum><header>Prohibition on
			 sanctioning individual for failure to engage in work if individual has a child
			 under age 6 months or if failure results from inability to secure child care or
			 after-school arrangements for a child under age 13</header><text>Section
			 407(e)(2) (<external-xref legal-doc="usc" parsable-cite="usc/42/607">42 U.S.C. 607(e)(2)</external-xref>) is amended by striking <quote>refusal</quote>
			 and all that follows and inserting</text>
						<quoted-block display-inline="yes-display-inline" id="H555D1A5232CE4740BB6449E5AC82E626" style="OLC">
							<text>failure of
			 an individual to engage in work required in accordance with this section

				caring for a child who has not attained 6 months of age; or</text>

				the single custodial parent caring for a child who has not attained 13 years of
				age, and the failure resulted from the inability of the individual to secure
				child care or after-school arrangements for the
				child</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H414053039D3343EBB629E17ECC98D885"><enum>(3)</enum><header>Modifications to
			 child support sanction</header><text>Section 408(a)(2) (<external-xref legal-doc="usc" parsable-cite="usc/42/608">42 U.S.C. 608(a)(2)</external-xref>) is
			 amended by striking <quote>State—</quote> and all that follows and inserting
			 <quote>State shall deduct from the assistance that would otherwise be provided
			 to the family of the individual under the State program funded under this part
			 an amount equal to 25 percent of the amount of the assistance.</quote>.</text>
				</paragraph></subsection><subsection id="H44CB1034A49B4D20A5B68A57B8239F8F"><enum>(e)</enum><header>Related state
			 plan requirement</header><text>Section 402(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/602">42 U.S.C. 602(a)</external-xref>) is amended by

			 of durational limit on assistance</header><text display-inline="yes-display-inline">Section 408(a)(7) (<external-xref legal-doc="usc" parsable-cite="usc/42/608">42 U.S.C. 608(a)(7)</external-xref>), as
			 amended by section 8(a)(1)(C) of this Act, is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HC8089E0910AA4F77BDDEDD6B17376FCE" style="OLC">

				which an adult has received assistance under a State or tribal program funded
				under this part or any other State program funded by qualified State
				expenditures (as defined in section 409(a)(7)(B)(i)), the State or tribe shall
				disregard any month which is in a high unemployment period with respect to the
				State.</text>
					</subparagraph><subparagraph id="HEA4605A4ECD54F08B8BB9DA9C0D2805E"><enum>(K)</enum><header>6-month grace
				period required after recession</header><text display-inline="yes-display-inline">Subparagraph (A) shall not apply to a
				recipient of assistance under the State program funded under this part or any
				other State program funded by qualified State expenditures (as defined in
				section 409(a)(7)(B)(i)) during the 6-month period that begins with the month
				immediately following a high unemployment period with respect to the State if
				the recipient received the assistance for the last month of the
				period.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

			 requirement</header><text>Section 402(a)(1)(B) (<external-xref legal-doc="usc" parsable-cite="usc/42/602">42 U.S.C. 602(a)(1)(B)</external-xref>), as
			 amended by sections 8(c) and 9(d) of this Act, is amended by adding at the end
			 the following:</text>

			 requirement</header><text display-inline="yes-display-inline">Section 408(a)
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/608">42 U.S.C. 608(a)</external-xref>), as amended by sections 7(d)(1), 8(b)(1), 9(b)(1), 10(a),
			 and 11(a) of this Act, is amended by adding at the end the following:</text>

				tracking of work outcomes</header><text display-inline="yes-display-inline">Track work-related outcomes for recipients
				of assistance under the program, such as employment entries, wages, and job
				retention, including establishing numerical goals for work-related outcomes for
				recipients.</text>
						</clause><clause id="HEA210EA39FFD44AFBBA0EC7A2A00A704"><enum>(xi)</enum><header>Provide
				preventative services to families at-risk of abuse or neglect</header><text display-inline="yes-display-inline">Provide benefits and services to families
				at-risk of having their children removed from the home because of abuse and
				neglect, using Federal funds provided under this part and State funds.</text>

				available to the public, including by posting on a public website of the State
				or another appropriate website—</text>
								<subparagraph id="HAD3163EF6DEB4151BA769D7200B9C8FE"><enum>(A)</enum><text>each draft of any
				plan or plan amendment to be submitted by the State under this section, for at
				least 45 days before the submission; and</text>
								</subparagraph><subparagraph id="HEE0A830BFF894A26B66A620FF571D57F"><enum>(B)</enum><text display-inline="yes-display-inline">any such plan or amendment certified by the
				Secretary to be complete.</text>
								</subparagraph></paragraph><paragraph id="H971E278C7AAA46FAA3588ED6E77C6676"><enum>(2)</enum><header>Procedures</header><text display-inline="yes-display-inline">The State shall establish procedures to
				receive and respond to comments from the public, private sector organizations,
				and local governments on any draft referred to in paragraph
				(1).</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H38A1BA2BFB9B469CA32EF3ED49FDABCC"><enum>(c)</enum><header>Annual
			 performance report</header><text>Section 411 (<external-xref legal-doc="usc" parsable-cite="usc/42/611">42 U.S.C. 611</external-xref>) is amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HE0D39F92450E4F75BE7B90EABD3C6F13" style="OLC">
					<subsection id="HAEE793677FA0479F9AAAF4BFD719CBDB"><enum>(e)</enum><header>Annual
				performance report by States</header><text display-inline="yes-display-inline">Not later than December 31 of each year,
				each eligible State shall submit to the Secretary (in accordance with such form
				and content rules as the Secretary, in consultation with the National
				Governor’s Association, National Association of State Legislatures, and the
				American Public Human Services Association, develops) a report on the following
				aspects of the State program funded under this part in the preceding fiscal
				year:</text>
						<paragraph id="HFCC1B650DA974C6CADC9C31D91D95FA8"><enum>(1)</enum><text display-inline="yes-display-inline">Whether the State met the child poverty
				reduction goals set forth in the State plan. This part of the report shall
				include a discussion of the factors, including benefits, services, and
				activities funded with Federal funds provided under this part or State funds,
				which contributed to the meeting of, or the failure to meet, the goals.</text>
						</paragraph><paragraph id="H3089DD71382F4ABDA7459FEAF0155A27"><enum>(2)</enum><text display-inline="yes-display-inline">Whether the work programs of the State were
				effective in meeting the objectives and numerical goals of the State plan. This
				part of the report shall include a discussion of data derived from the tracking
				of recipients, including—</text>
							<subparagraph id="HAA75AD1982A2478B8BF0E49FEB15BE4F"><enum>(A)</enum><text>the number of
				families that left the State program funded under this part;</text>
							</subparagraph><subparagraph id="HD2B3BC537A9B421ABBF83674EB37B37D"><enum>(B)</enum><text>the employment
				rate for those who left the program in each calendar quarter;</text>
							</subparagraph><subparagraph id="H071D8773531346719CF4D104DC147DFE"><enum>(C)</enum><text>the wage rates of
				those who left the program, including the percentage of leavers who, in each
				calendar quarter, earned an amount equal to at least 50 percent of the average
				wage then paid in the State; and</text>
							</subparagraph><subparagraph id="H99C522CA6C6746BC835D48A3CE48A94A"><enum>(D)</enum><text display-inline="yes-display-inline">the employment outcomes of those who left
				the program because of a durational limit on assistance, reported at 6 months,
				12 months, 24 months, and 36 months after leaving the program.</text>
							</subparagraph><continuation-text continuation-text-level="paragraph">The
				Secretary shall provide States with technical assistance in preparing this part
				of the report, including by providing States with data from the National
				Directory of New Hires.</continuation-text></paragraph><paragraph id="HE525046CC002415EB5027F8D57807D3D"><enum>(3)</enum><text display-inline="yes-display-inline">Whether the State has been effective in
				providing benefits and services under the program to persons with disabilities.
				This part of the report shall include a report on recipients of assistance
				under the State program funded under this part who participated in work
				activities (as defined in section 407(d)) pursuant to a modified employability
				plan due to disability, including the following:</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="HBA1FA19BE31142559270C87249EABFF5"><enum>(A)</enum><text display-inline="yes-display-inline">The aggregate number of recipients with
				modified employability plans due to a disability.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD83B52B830C14FAEB846B87F4A75F071"><enum>(B)</enum><text display-inline="yes-display-inline">The percentage of all recipients with
				modified employability plans who substantially complied with activities set
				forth in the plans each month of the fiscal year.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H49675A5778B540F4980CFC905AD81BB8"><enum>(C)</enum><text display-inline="yes-display-inline">Information regarding the most prevalent
				types of physical and mental impairments that provided the basis for the
				disability determinations.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC3C8CF1BC56E44558B56EF9D9C63FC20"><enum>(D)</enum><text display-inline="yes-display-inline">The percentage of cases with a modified
				employability plan in which the recipient had a disability, was caring for a
				child with a disability, or was caring for another family member with a
				disability.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDB25E4D161544BA188751D13CC895895"><enum>(E)</enum><text display-inline="yes-display-inline">A description of the most prevalent types
				of modification in work activities or hours of participation that were included
				in the modified employability plans.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA7044154D29A4CDB8630E205A05AE4C1"><enum>(F)</enum><text display-inline="yes-display-inline">A description of the qualifications of the
				staff who determined whether individuals had a disability, of the staff who
				determined that individuals needed modifications to their work requirements,
				and of the staff who developed the modified employability plans.</text>
							</subparagraph></paragraph><paragraph id="HB2C91C6683DD46DCBE6A98E32876A96D"><enum>(4)</enum><text>The effectiveness
				of the benefits and services provided under the State program in reducing the
				number of children removed from their homes because of abuse and neglect. This
				part of the report shall include an analysis which includes the
				following:</text>
							<subparagraph id="H79A2FE467086431D972556AB046B772B"><enum>(A)</enum><text>The number of
				families provided the benefits or services that were at risk of having their
				children removed from the home.</text>
							</subparagraph><subparagraph id="HA83D073527B14BF0A1335319382DDDBB"><enum>(B)</enum><text>The number of
				families served by the program that had 1 or more children removed from the
				home because of abuse or neglect.</text>
							</subparagraph></paragraph><paragraph id="H331F3BA2FBCF48A7A43C0D233E2ECFC5"><enum>(5)</enum><text>An analysis of the
				extent to which the benefits and services under the State program were provided
				to noncustodial parents.</text>
						</paragraph><paragraph id="HA16FE748C1864A24B610E2BB58587751"><enum>(6)</enum><text display-inline="yes-display-inline">How funds provided to the State under this
				part, with a separate accounting for funds provided under section 403(a)(3) and
				funds provided under section 403(b), were used to serve areas of the State with
				the greatest need (as referred to in section 402(a)(1)(A)(i)). This part of the
				report shall include supporting
				data.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H3C54F6D3DE43460C805FD1C0B93E288E"><enum>(d)</enum><header>Annual report to
			 Congress on the efforts of State programs To promote and support employment for
			 individuals with disabilities</header><text>Section 411 (<external-xref legal-doc="usc" parsable-cite="usc/42/611">42 U.S.C. 611</external-xref>), as
			 amended by subsection (c) of this section, is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HD1F86B03E3934A9F9F6C4D9AE8DB4F1F" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="H7BC2694A919940FAAD23B198FDF20693"><enum>(f)</enum><header display-inline="yes-display-inline">Report by Secretary</header><text display-inline="yes-display-inline">Not later than July 31 of each fiscal year,
				the Secretary shall submit to the Congress a report, entitled <quote>Efforts in
				State TANF Programs to Promote and Support Employment for Individuals with
				Disabilities</quote>, that includes information on State efforts to engage
				individuals with disabilities in work activities during the preceding fiscal
				year. The report shall include the following information:</text>
						<paragraph commented="no" display-inline="no-display-inline" id="H22555DD1194F4C009C73DB189157BCD0"><enum>(1)</enum><text display-inline="yes-display-inline">For each State, the number of individuals
				for whom the State has developed a modified employability plan.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1204B38A3B91404EB783F4F828365F00"><enum>(2)</enum><text display-inline="yes-display-inline">The types of physical and mental
				impairments that provided the basis for the disability determination, and
				whether the individual with the disability was an adult recipient or minor
				child head of household, a child, or a non-recipient family member.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE7A8A9B062834A0E8816C8D58F4FC294"><enum>(3)</enum><text display-inline="yes-display-inline">The types of modifications that States have
				included in modified employability plans.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H58A0A5FCBDE94BBB8ECD858AA91FCF5B"><enum>(4)</enum><text display-inline="yes-display-inline">The extent to which individuals with a
				modified employability plan are participating in work activities.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDABAAE0692DD4E62A3D0C8591279DBE3"><enum>(5)</enum><text display-inline="yes-display-inline">For each State, an analysis of the extent
				to which the option to establish modified employability plans was a factor in
				the State achieving or not achieving the minimum participation rate required by
				section
				407(a).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H134ADF11D4C24C73B43B905EDDFB25AD"><enum>(e)</enum><header>Report to
			 Congress on legislative options To reward States with high employment rates and
			 high rates of employment at good wages</header><text display-inline="yes-display-inline">Within 4 years after the effective date of
			 this section, the Secretary of Health and Human Services shall submit to the
			 Congress a report that sets forth options for the enactment of legislation to
			 provide financial or other rewards to States that have high rates of employment
			 and high rates of employment at good wages.</text>
			</subsection></section><section display-inline="no-display-inline" id="H444AF196DE16487BB663E0B7EF860F7B" section-type="subsequent-section"><enum>14.</enum><header>Requirement that
			 States adopt standards and procedures to address domestic and sexual violence
			 among TANF recipients</header>
			<subsection id="H2A4C06A038F34CFF94196C8878F410D5"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 402(a)(7) (42
			 U.S.C. 602(a)(7)) is amended—</text>
				<paragraph id="H8DF580D0AC0A489AA550EE0A4CF4B1B5"><enum>(1)</enum><text>by striking the
			 paragraph heading and inserting <quote><header-in-text level="paragraph" style="OLC">Certification of standards and procedures regarding domestic and
			 sexual violence</header-in-text></quote>;</text>
				</paragraph><paragraph id="H91E2B82B23B84ABFB470620C05329FF4"><enum>(2)</enum><text>by striking
			 subparagraph (A) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H7BDFDECD6FC24FAC82AC4BB72BBFC2BE" style="OLC">
						<subparagraph id="HA80D5D4CA7994F5E89DF5D2BB09FC3B3"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">A certification by
				the chief executive officer of the State that the State has established and is
				enforcing standards and procedures to ensure the right and entitlement of
				victims of domestic or sexual violence (notwithstanding section 401(b)) seeking
				or receiving assistance under the State program funded under this part or any
				other State program funded by qualified State expenditures (as defined in
				section 409(a)(7)(B)(i))—</text>
							<clause id="H6516508EC7AF47E3880CBDA794DA6204"><enum>(i)</enum><text>to
				be screened and identified while maintaining the confidentiality of the
				victims;</text>
							</clause><clause id="H457FF7D0E61C46BE85BE6DA8DD4E6273"><enum>(ii)</enum><text>to be referred to
				counseling and supportive services;</text>
							</clause><clause id="H7F01FACDBE70476380A78E417633565E"><enum>(iii)</enum><text display-inline="yes-display-inline">to be granted a waiver, pursuant to a
				determination of good cause, of program requirements such as time limits (for
				so long as necessary), residency requirements, child support cooperation
				requirements, and family cap provisions, in cases where compliance with the
				requirements would make it more difficult for the victims to escape domestic or
				sexual violence or unfairly penalize the victims or other individuals who are
				at risk of further domestic or sexual violence;</text>
							</clause><clause id="H158FC2ABAC994918B72250270A4E7BE5"><enum>(iv)</enum><text display-inline="yes-display-inline">to apply to participate in the program on
				the same day the victim appears in person in a program office during office
				hours;</text>
							</clause><clause id="H45B4683EC04C416FBFDFC8F4C08FFCDE"><enum>(v)</enum><text>to
				have an application that contains the name, address, and signature of the
				victim considered to be filed on the date the application is submitted;</text>
							</clause><clause id="H3464E4C8A4E24D90814EB37EA38ADDC9"><enum>(vi)</enum><text>to receive at the
				time of application a clear, written statement explaining what the victim must
				do to cooperate in obtaining verification and otherwise completing the
				application process; and</text>
							</clause><clause id="H19DF4ACF1E4D4638B2D2DAD69D439706"><enum>(vii)</enum><text>if the victim
				has completed the application process, to have the eligibility of the victim
				for assistance determined promptly, and to be provided assistance retroactive
				to the application date if determined eligible within 30 days after the
				application date.</text>
							</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H0F5C8D0F266B4015AEBE6A9A5A7D0752"><enum>(3)</enum><text>in subparagraph
			 (B)—</text>
					<subparagraph id="HFCE11F94FEBC4A0C97CFA16A4A2FCF5E"><enum>(A)</enum><text>in the
			 subparagraph heading, by inserting <quote><header-in-text level="subparagraph" style="OLC">or sexual</header-in-text></quote> after <quote><header-in-text level="subparagraph" style="OLC">Domestic</header-in-text></quote>; and</text>
					</subparagraph><subparagraph id="HA32540C8F1424FE7A7219382C75AEA67"><enum>(B)</enum><text>in the text, by
			 inserting <quote>or sexual</quote> after <quote>domestic</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H4F2A193CDAF94FC39A9B085CC6F7F616"><enum>(b)</enum><header>Report to the
			 Congress on best practices of States</header><text>Section 413 (<external-xref legal-doc="usc" parsable-cite="usc/42/613">42 U.S.C. 613</external-xref>)
			 is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HC22B056430734B98969BC7EA67AA29B4" style="OLC">
					<subsection id="H522EA6C21883453AAEB7BD6C0A16DE72"><enum>(k)</enum><header>Report to
				Congress on best practices of States in addressing domestic and sexual violence
				suffered by TANF recipients</header><text display-inline="yes-display-inline">Every 4 years, the Secretary shall prepare
				and submit to the Congress a report which examines the practices of States in
				implementing section 402(a)(7), and identifies the best practices used to do
				so.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H215718FB03384E948C9B28C22D4583A9"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on
			 October 1, 2013.</text>
			</subsection></section><section id="HC98B4E823A954C4F818B08C0A0C0D5F4"><enum>15.</enum><header>Child care
			 entitlement</header>
			<subsection id="H38CFBAF7D9C34E0885CA89664497EEE2"><enum>(a)</enum><header>Replacement of
			 requirement that portion of funds be used for certain populations with child
			 care guarantee</header><text display-inline="yes-display-inline">Section
			 418(b)(2) (<external-xref legal-doc="usc" parsable-cite="usc/42/618">42 U.S.C. 618(b)(2)</external-xref>) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H97C3FFD4D3A64F348686FAA9811452BE" style="OLC">
					<paragraph id="H0E73E7E547CE4A2CBCE6F2F63A20C57F"><enum>(2)</enum><header>Child care to be
				guaranteed for certain populations</header><text display-inline="yes-display-inline">As a condition of receiving funds under
				this section, a State shall guarantee the provision of child care services
				to—</text>
						<subparagraph id="H824BCEAA502C4A0C9B0376EE5A827083"><enum>(A)</enum><text>each recipient of
				assistance under the State program funded under this part or under a State
				program funded with qualified State expenditures (as defined in section
				409(a)(7)(B)(i)) of this Act, and to each work-eligible individual (as defined
				in section 407(a)(2) of this Act), for any period in which the recipient or
				individual is—</text>
							<clause id="HB3785C3F3E774873BD193D51EE0876A9"><enum>(i)</enum><text>participating in a
				work activity (as defined in section 407(d) of this Act);</text>
							</clause><clause id="H5B682B7FBDB84A2CB1E7CCA76853B3B3"><enum>(ii)</enum><text>employed, and in
				a family the total income of which does not exceed 250 percent of the poverty
				line (within the meaning of section 673(2) of the Omnibus Budget Reconciliation
				Act of 1981, including any revision required by such section applicable to a
				family of the size involved); or</text>
							</clause><clause id="HEFBCE2A1BCF544B39961FB6DFAB6636A"><enum>(iii)</enum><text>engaged in
				employment subsidized by the State; or</text>
							</clause></subparagraph><subparagraph id="H474E9732ED8D4B06B3CF8476CF45B585"><enum>(B)</enum><text display-inline="yes-display-inline">each individual who is a former recipient
				of assistance under such a program or a former work-eligible individual, for
				any portion of the 24-month period, beginning with the date the individual left
				the program involved, in which the individual is employed and in a family that
				meets the income requirement of subparagraph
				(A)(ii).</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H4C67F948164D4061BBB51713778A7C78"><enum>(b)</enum><header>Elimination of
			 State caps</header><text>Section 418(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/618">42 U.S.C. 618(a)</external-xref>) is amended—</text>
				<paragraph id="H69F83A352F4D4DCE8E9034382CE744A5"><enum>(1)</enum><text>in paragraph
			 (2)—</text>
					<subparagraph id="HF4E1BEC961AC4305AD30F44B88AE82CC"><enum>(A)</enum><text>by striking
			 subparagraphs (B) and (D) and redesignating subparagraph (C) as subparagraph
			 (B); and</text>
					</subparagraph><subparagraph id="H3649BB0F8C45435EB60B2D9818664B82"><enum>(B)</enum><text>in subparagraph
			 (B) (as so redesignated), by striking <quote>the lesser of the State's

				training, school attendance, or postsecondary school attendance of a minor
				child in determining that the eligibility of the family of the child for, or
				the amount of assistance to be provided to the family, under the State program
				funded under this part or any other State program funded by qualified State
				expenditures (as defined in section 409(a)(7)(B)(i)); or</text>
							</subparagraph><subparagraph id="H98D6CFD92747408CAD74EFFFBF3989DB"><enum>(B)</enum><text>impose additional
				requirements on a family solely because the family includes a minor child who
				is enrolled in a training program, school, or post-secondary educational
				institution.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph display-inline="no-display-inline" id="H3BD4D285319E47FF99FC45E1DB6239A2"><enum>(2)</enum><header>Penalty</header><text>Section
			 409(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/609">42 U.S.C. 609</external-xref>), as amended by sections 5(c)(2)(A), 7(d)(1), 8(b)(2),

			 and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/21/862a">21 U.S.C. 862a</external-xref>) is
			 amended—</text>

			 date</header>
			<subsection id="H78611A49F8144CEBB7CF3A50865946BE"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Except as otherwise
			 provided in this Act, this Act and the amendments made by this Act shall take
			 effect on October 1, 2013, and shall apply to payments under title IV of the
			 Social Security Act for calendar quarters beginning on or after such date,
			 without regard to whether regulations to implement the amendments are
			 promulgated by such date.</text>
			</subsection><subsection id="HCCCCEF346C084440AC14032DEEF9ABBD"><enum>(b)</enum><header>Delay permitted
			 if state legislation required</header><text>If the Secretary of Health and
			 Human Services determines that State legislation (other than legislation
			 appropriating funds) is required in order for a State plan under part A or E of
			 title IV of the Social Security Act to meet the additional requirements imposed
			 by the amendments made by this Act, the plan shall not be regarded as failing
			 to meet any of the additional requirements before the 1st day of the 1st
			 calendar quarter beginning after the close of the first regular session of the
			 State legislature that begins after the date of the enactment of this Act. If
			 the State has a 2-year legislative session, each year of the session is deemed
			 to be a separate regular session of the State legislature.</text>
