		<legis-type>A BILL</legis-type>
		<official-title>To amend the Federal Food, Drug, and Cosmetic Act to
		  clarify the Food and Drug Administration’s jurisdiction over certain tobacco
		  products, and to protect jobs and small businesses involved in the sale,
		  manufacturing and distribution of traditional and premium
		  cigars.</official-title>

		<section id="H3FAEB1086EC44B63A50C130C07B518E2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Traditional Cigar Manufacturing and
			 Small Business Jobs Preservation Act of 2013</short-title></quote>.</text>
		</section><section id="H64CC048D08B642E6B8C62260E1EAE26C"><enum>2.</enum><header>Limitation of
			 authority with respect to premium cigars</header>
			<subsection id="H3EF844E568D747D5A94C53071C007E9E"><enum>(a)</enum><header>Exception for
			 traditional large and premium cigars</header><text display-inline="yes-display-inline">Section 901(c) of the Federal Food, Drug,
			 and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/387a">21 U.S.C. 387a(c)</external-xref>) is amended—</text>
				<paragraph id="H376BFE50746A434491B8E5B49F4AF011"><enum>(1)</enum><text>in paragraph (2),
			 in the heading, by inserting <quote><header-in-text level="paragraph" style="OLC">for certain tobacco leaf</header-in-text></quote> after
			 <quote><header-in-text level="paragraph" style="OLC">authority</header-in-text></quote>; and</text>
				</paragraph><paragraph id="H5494CC3ADFDE46DBB4B6C1E7E0CC90FA"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H7261B621EFB242AFB0F7568A137A50E7" style="OLC">
						<paragraph id="H8D591BAF4D8A4BD98C36E5614B680A3A"><enum>(3)</enum><header>Limitation of
				authority for certain cigars</header>
							<subparagraph id="H75B8AB70DD3B4C97B29D64AF68A505AC"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The provisions of
				this chapter (except for section 907(d)(3)) shall not apply to traditional
				large and premium cigars.</text>
							</subparagraph><subparagraph id="HBACC9A1188564EAB931C011CDBA0E758"><enum>(B)</enum><header>Rule of
				construction</header><text display-inline="yes-display-inline">Nothing in this
				chapter shall be construed to grant the Secretary authority to promulgate
				regulations on any matter that involves traditional large and premium
				cigars.</text>
							</subparagraph><subparagraph id="HF729983FEC904323B83029E3389C3330"><enum>(C)</enum><header>Traditional
				large and premium cigar defined</header><text display-inline="yes-display-inline">For purposes of this paragraph, the term
				<term>traditional large and premium cigar</term>—</text>
								<clause id="H5D34A76991FE4A3882FF6216B4B1AE01"><enum>(i)</enum><text display-inline="yes-display-inline">means any roll of tobacco that is wrapped
				in 100 percent leaf tobacco, bunched with 100 percent tobacco filler, contains
				no filter, tip or non-tobacco mouthpiece, weighs at least 6 pounds per 1,000
				count, and—</text>
									<subclause id="H94EE3BD2CDA044908021BEBAEB5F57DC"><enum>(I)</enum><text>has a 100 percent
				leaf tobacco binder and is hand rolled;</text>
									</subclause><subclause id="HC6A5AE90BC9242EE8013FED779EFB664"><enum>(II)</enum><text display-inline="yes-display-inline">has a 100 percent leaf tobacco binder and
				is made using human hands to lay the leaf tobacco wrapper or binder onto only
				one machine that bunches, wraps, and caps each individual cigar; or</text>
									</subclause><subclause id="H5FE023768B7C4E15A27B8959184FC0A0"><enum>(III)</enum><text>has a
				homogenized tobacco leaf binder and is made in the United States using human
				hands to lay the 100 percent leaf tobacco wrapper onto only one machine that
				bunches, wraps, and caps each individual cigar; and</text>
									</subclause></clause><clause id="H29F0BEAC86624E0EA04FDEF10CD73AD2"><enum>(ii)</enum><text>does not include
				a cigarette (as such term is defined by section 900(3)) or a little cigar (as
				such term is defined by section
				900(11)).</text>
								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H96C811EFA56440B7B080BA34A4E641A1"><enum>(b)</enum><header>Conforming
			 amendments</header><text display-inline="yes-display-inline">Section 919(b) of
			 the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/387s">21 U.S.C. 387s(b)</external-xref>) is amended—</text>
				<paragraph id="H3E400360827E40DB892FB890A1ECC6F8"><enum>(1)</enum><text>in paragraph
			 (2)(B)(II), by inserting <quote>, but excluding traditional large and premium
			 cigars (as such term is defined under section 901(c)(3)</quote> before the
			 period; and</text>
				</paragraph><paragraph id="H46BB960EA3E5465EA825D8C7BDA42CF0"><enum>(2)</enum><text>in paragraph (5)
			 by inserting <quote>subject to section 901(c)(3),</quote> before <quote>if a
			 user fee</quote>.</text>
