		<official-title>To provide protection for certain Federal employees with
		  respect to implementation of the June 15, 2012, memorandum from Janet
		  Napolitano, Secretary of Homeland Security, regarding the exercise of
		  prosecutorial discretion with respect to individuals who came to the United
		  States as children.</official-title>

		<section id="HCE0B22D725D14380B94BA58B8C8AAC30" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Protecting Department of Homeland
			 Security Personnel Act of 2013</short-title></quote>.</text>
		</section><section id="HDDC3DD1A3D6A4D60AFAE614AD504C9EA"><enum>2.</enum><header>Protection for
			 individuals who refuse to carry out unlawful provisions of the
			 memorandum</header>
			<subsection id="H331143A15AFD4EE8A7B6C13CE8290E2D"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Notwithstanding any
			 other provision of law, no adverse personnel action, including employee
			 termination, may be taken against a protected individual which is based, in
			 whole or in part, on the refusal of such individual to carry out a provision of
			 the memorandum described in subsection (b) that has been determined by the
			 Congress to be in violation of the Immigration and Nationality Act (8 U.S.C.
			 1101 et seq.).</text>
			</subsection><subsection id="H4826D039656B4E64B543337C85360706"><enum>(b)</enum><header>Memorandum
			 described</header><text>This Act applies with respect to the June 15, 2012,
			 memorandum from Janet Napolitano, Secretary of Homeland Security, regarding the
			 exercise of prosecutorial discretion with respect to individuals who came to
			 the United States as children.</text>
			</subsection><subsection id="H98D3D9C112ED411984BDD762BA0C1CA6"><enum>(c)</enum><header>Protected
			 individuals</header><text>For purposes of this Act, the term <quote>protected
			 individual</quote> means an individual employed in or under any of the
			 following:</text>
				<paragraph id="H75390714471049D28734FEFE950871DD"><enum>(1)</enum><text>U.S. Immigration
			 and Customs Enforcement.</text>
				</paragraph><paragraph id="HC8F951EC74034833A7D89333EDDC113B"><enum>(2)</enum><text>U.S. Customs and
			 Border Protection.</text>
				</paragraph><paragraph id="H7686BA43C13149B988ED5509D237402C"><enum>(3)</enum><text>U.S. Citizenship
			 and Immigration Services.</text>
				</paragraph></subsection><subsection id="H7A3B3C1BDBF14ECCA3850A53130BE7B5"><enum>(d)</enum><header>Adverse actions
			 include denial of benefits</header><text>The personnel actions prohibited by
			 this Act include the withholding or denial of a promotion, an increase in pay,
			 or other similar benefit.</text>
