<section id="HF341BA8AC58443C9BFD663A95F42DAA4"><enum>2.</enum><header>Findings and purpose</header> 
<subsection id="HD66FCC7EA21447C8A4FD158600090E9B"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text> 
<paragraph id="HEA446EC3CF1B4D27845030F52CCF361D"><enum>(1)</enum><text>the land exchange furthers public objectives referenced in section 206 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1716">43 U.S.C. 1716</external-xref>) including—</text> 
<subparagraph id="H015B1D09DF1A4DD481F71D18E041E8CB"><enum>(A)</enum><text>promoting significant job and other economic opportunities in a part of the State of Arizona that has a long history of mining, but is currently experiencing high unemployment rates and economic difficulties;</text></subparagraph> 
<subparagraph id="HBE43CF201573461CBA6E4BE4B7D3C0A6"><enum>(B)</enum><text>facilitating the development of a world-class domestic copper deposit capable of meeting a significant portion of the annual United States demand for this strategic and important mineral, in an area which has already been subject to mining operations;</text></subparagraph> 
<subparagraph id="HCC246770C6F848E8A43B5764F2A4B5B6"><enum>(C)</enum><text>significantly enhancing Federal, State, and local revenue collections in a time of severe governmental budget shortfalls;</text></subparagraph> 
<subparagraph id="H804A7F5E84A44BE4947B7B921871E746"><enum>(D)</enum><text>securing Federal ownership and protection of land with significant fish and wildlife, recreational, scenic, water, riparian, cultural, and other public values;</text></subparagraph> 
<subparagraph id="H536D73DA8308426E89261BEE4AB02FD2"><enum>(E)</enum><text>assisting more efficient Federal land management via Federal acquisition of land for addition to the Las Cienegas and San Pedro National Conservation Areas, and to the Tonto and Coconino National Forests;</text></subparagraph> 
<subparagraph id="H040BBB24D5E94E138FD8FE8D97BEE213"><enum>(F)</enum><text>providing opportunity for community expansion and economic diversification adjacent to the towns of Superior, Miami, and Globe, Arizona; and</text></subparagraph> 
<subparagraph id="H68EBE1FBDBEB4826A0C8C7EB9C0E30F6"><enum>(G)</enum><text>protecting the cultural resources and other values of the Apache Leap escarpment located near Superior, Arizona; and</text></subparagraph></paragraph> 
<paragraph id="H8F29BEA3598348E8A9CF5BC0251F2C32"><enum>(2)</enum><text>the land exchange is, therefore, in the public interest.</text></paragraph></subsection> 
<subsection id="H29ABA4E466E94A5A82DF4E8E6405C468"><enum>(b)</enum><header>Purpose</header><text>It is the purpose of this Act to authorize, direct, facilitate, and expedite the exchange of land between Resolution Copper and the United States.</text></subsection></section> 
<section id="HC328142F7E7B43DABC541E625E06624F"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph display-inline="no-display-inline" id="HEBE8FD27A35B4B209623A61C6E0E7C39"><enum>(1)</enum><header>Apache leap</header><text display-inline="yes-display-inline">The term <quote>Apache Leap</quote> means the approximately 807 acres of land depicted on the map entitled <quote>Southeast Arizona Land Exchange and Conservation Act of 2011–Apache Leap</quote> and dated March 2011.</text></paragraph> 
<paragraph id="H8CD761C3149B4B61AFA7C9144C31821F"><enum>(2)</enum><header>Federal land</header><text>The term <term>Federal land</term> means the approximately 2,422 acres of land located in Pinal County, Arizona, depicted on the map entitled <quote>Southeast Arizona Land Exchange and Conservation Act of 2011–Federal Parcel–Oak Flat</quote> and dated March 2011.</text></paragraph> 
<paragraph id="HC182449228954F51BE75AF557C211CC7"><enum>(3)</enum><header>Indian tribe</header><text>The term <term>Indian tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>).</text></paragraph> 
<paragraph id="HF7B4426222784730BC713DA4AEB54F71"><enum>(4)</enum><header>Non-Federal land</header><text display-inline="yes-display-inline">The term <term>non-Federal land</term> means the parcels of land owned by Resolution Copper that are described in section 5(a) and, if necessary to equalize the land exchange under section 4, section 4(e)(2)(A)(i).</text></paragraph> 
<paragraph display-inline="no-display-inline" id="HD50B7935C55C4FE187418F0686663963"><enum>(5)</enum><header>Oak flat campground</header><text display-inline="yes-display-inline">The term <quote>Oak Flat Campground</quote> means the approximately 50 acres of land comprising approximately 16 developed campsites depicted on the map entitled <quote>Southeast Arizona Land Exchange and Conservation Act of 2011–Oak Flat Campground</quote> and dated March 2011.</text></paragraph> 
<paragraph display-inline="no-display-inline" id="H08BB9FFA19404E049837AFA9AE308F71"><enum>(6)</enum><header>Oak flat withdrawal area</header><text display-inline="yes-display-inline">The term <quote>Oak Flat Withdrawal Area</quote> means the approximately 760 acres of land depicted on the map entitled <quote>Southeast Arizona Land Exchange and Conservation Act of 2011–Oak Flat Withdrawal Area</quote> and dated March 2011.</text></paragraph> 
<paragraph id="H2C55A2DCD7604874ADC20B396568F028"><enum>(7)</enum><header>Resolution copper</header><text>The term <term>Resolution Copper</term> means Resolution Copper Mining, LLC, a Delaware limited liability company, including any successor, assign, affiliate, member, or joint venturer of Resolution Copper Mining, LLC.</text></paragraph> 
<paragraph id="H24C03EB50149440F8880A2068C79B0F7"><enum>(8)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph> 
<paragraph id="H93DC0849203D4BEE8004E8A1621DDA31"><enum>(9)</enum><header>State</header><text>The term <term>State</term> means the State of Arizona.</text></paragraph> 
<paragraph id="H8368BA33644F45A69C63F444E749809D"><enum>(10)</enum><header>Town</header><text>The term <term>Town</term> means the incorporated town of Superior, Arizona.</text></paragraph></section> 
<section id="H1D39A9A044BE451D81495DD93CCF3D41"><enum>4.</enum><header>Land exchange</header> 
<subsection id="H6C0A70B3459D47CD8A69C3353D40EE70"><enum>(a)</enum><header>In general</header><text>Subject to the provisions of this Act, if Resolution Copper offers to convey to the United States all right, title, and interest of Resolution Copper in and to the non-Federal land, the Secretary is authorized and directed to convey to Resolution Copper, all right, title, and interest of the United States in and to the Federal land.</text></subsection> 
<subsection id="H7F171C8F187D4D78BF1104011925F238"><enum>(b)</enum><header>Conditions on acceptance</header><text>Title to any non-Federal land conveyed by Resolution Copper to the United States under this Act shall be in a form that—</text> 
<paragraph id="H5C9C1428B8BF40AFA2D39A658635039F"><enum>(1)</enum><text>is acceptable to the Secretary, for land to be administered by the Forest Service and the Secretary of the Interior, for land to be administered by the Bureau of Land Management; and</text></paragraph> 
<paragraph id="HDD27B41342FC4C7DAB2F4F250B7D7873"><enum>(2)</enum><text>conforms to the title approval standards of the Attorney General of the United States applicable to land acquisitions by the Federal Government.</text></paragraph></subsection> 
<subsection id="H7069418C856548D48A679E29494FAA5C"><enum>(c)</enum><header>Consultation with indian tribes</header><text>If not undertaken prior to enactment of this Act, within 30 days of the date of enactment of this Act, the Secretary shall engage in government-to-government consultation with affected Indian tribes concerning issues related to the land exchange, in accordance with applicable laws (including regulations).</text></subsection> 
<subsection id="HC34A1E4BE553496D9961E3D772115DE7"><enum>(d)</enum><header>Appraisals</header> 
<paragraph id="HAF7945CE84814BA7946203DBF787536B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">As soon as practicable after the date of enactment of this Act, the Secretary and Resolution Copper shall select an appraiser to conduct appraisals of the Federal land and non-Federal land in compliance with the requirements of <external-xref legal-doc="regulation" parsable-cite="cfr/36/254.9">section 254.9</external-xref> of title 36, Code of Federal Regulations.</text></paragraph> 
<paragraph id="H15DCB156223A4E23927FF6E1705020AA"><enum>(2)</enum><header>Requirements</header> 
<subparagraph id="H2301A3759EE24D20AA1D64710326A158"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), an appraisal prepared under this subsection shall be conducted in accordance with nationally recognized appraisal standards, including—</text> 
<clause id="HC0ECD6B3B362426199889F5C99F83A87"><enum>(i)</enum><text>the Uniform Appraisal Standards for Federal Land Acquisitions; and</text></clause> 
<clause id="H8D76AAD27FED495D9A3D3E88706D54AB"><enum>(ii)</enum><text>the Uniform Standards of Professional Appraisal Practice.</text></clause></subparagraph> 
<subparagraph id="H2510337E96494A0DA39EF970B0316041"><enum>(B)</enum><header>Final appraised value</header><text>After the final appraised values of the Federal land and non-Federal land are determined and approved by the Secretary, the Secretary shall not be required to reappraise or update the final appraised value—</text> 
<clause id="H9F9C2C0A819845CD8C9661E50EB445E2"><enum>(i)</enum><text>for a period of 3 years beginning on the date of the approval by the Secretary of the final appraised value; or</text></clause> 
<clause id="HEFEDF5BE9ACE457383B1C6DA2C5C6CD4"><enum>(ii)</enum><text>at all, in accordance with <external-xref legal-doc="regulation" parsable-cite="cfr/36/254.14">section 254.14</external-xref> of title 36, Code of Federal Regulations (or a successor regulation), after an exchange agreement is entered into by Resolution Copper and the Secretary.</text></clause></subparagraph> 
<subparagraph id="H5C9C101C0DDA49AAAD75F08551BADD6A"><enum>(C)</enum><header>Improvements</header><text>Any improvements made by Resolution Copper prior to entering into an exchange agreement shall not be included in the appraised value of the Federal land.</text></subparagraph> 
<subparagraph id="H20B38B415F954FBE8D78916E4C5DB307"><enum>(D)</enum><header>Public review</header><text>Before consummating the land exchange under this Act, the Secretary shall make the appraisals of the land to be exchanged (or a summary thereof) available for public review.</text></subparagraph></paragraph> 
<paragraph id="HE2BD7CA4B85E49C59346B215BB11F682"><enum>(3)</enum><header>Appraisal information</header><text>The appraisal prepared under this subsection shall include a detailed income capitalization approach analysis of the market value of the Federal land which may be utilized, as appropriate, to determine the value of the Federal land, and shall be the basis for calculation of any payment under section 6.</text></paragraph></subsection> 
<subsection id="H8195550771A54673B7A9E0D64C9DE13C"><enum>(e)</enum><header>Equal value land exchange</header> 
<paragraph id="H38B324D742E24C0CA0753E9654C861BD"><enum>(1)</enum><header>In general</header><text>The value of the Federal land and non-Federal land to be exchanged under this Act shall be equal or shall be equalized in accordance with this subsection.</text></paragraph> 
<paragraph id="H6819583D6FAB483D9E407DDFC079546B"><enum>(2)</enum><header>Surplus of Federal land value</header> 
<subparagraph id="H0E45AB2ECAA748CB9E5F578C5D5F713F"><enum>(A)</enum><header>In general</header><text>If the final appraised value of the Federal land exceeds the value of the non-Federal land, Resolution Copper shall—</text> 
<clause id="H14E7BCA1FF5D4B36813477BA83BBC8C6"><enum>(i)</enum><text>convey additional non-Federal land in the State to the Secretary or the Secretary of the Interior, consistent with the requirements of this Act and subject to the approval of the applicable Secretary;</text></clause> 
<clause id="H64B0027F77D44F6EB6C926E36B8CC542"><enum>(ii)</enum><text>make a cash payment to the United States; or</text></clause> 
<clause id="HD92D9D40D6784C29A2FB16B952ECE2F8"><enum>(iii)</enum><text>use a combination of the methods described in clauses (i) and (ii), as agreed to by Resolution Copper, the Secretary, and the Secretary of the Interior.</text></clause></subparagraph> 
<subparagraph id="H2B0BED036C094D9FA8188E88E39860EC"><enum>(B)</enum><header>Amount of payment</header><text>The Secretary may accept a payment in excess of 25 percent of the total value of the land or interests conveyed, notwithstanding section 206(b) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1716">43 U.S.C. 1716(b)</external-xref>).</text></subparagraph> 
<subparagraph id="H4D1192D7B9634BB2AEB0C4033334CAE5"><enum>(C)</enum><header>Disposition and use of proceeds</header><text display-inline="yes-display-inline">Any amounts received by the United States under this subparagraph shall be deposited in the fund established under <external-xref legal-doc="public-law" parsable-cite="pl/90/171">Public Law 90–171</external-xref> (commonly known as the <quote>Sisk Act</quote>; <external-xref legal-doc="usc" parsable-cite="usc/16/484a">16 U.S.C. 484a</external-xref>) and shall be made available, in such amounts as are provided in advance in appropriation Acts, to the Secretary for the acquisition of land for addition to the National Forest System.</text></subparagraph></paragraph> 
<paragraph id="HA2BF2C6B7CEE4B2AA839A08B6D94A7AD"><enum>(3)</enum><header>Surplus of non-Federal land</header><text>If the final appraised value of the non-Federal land exceeds the value of the Federal land—</text> 
<subparagraph id="H4950960387B24B3187F3B6118243EC30"><enum>(A)</enum><text>the United States shall not make a payment to Resolution Copper to equalize the value; and</text></subparagraph> 
<subparagraph id="H3CF22BF71A634B3C92E1D3BAAD593B2C"><enum>(B)</enum><text>except as provided in section 9(b)(2)(B), the surplus value of the non-Federal land shall be considered to be a donation by Resolution Copper to the United States.</text></subparagraph></paragraph></subsection> 
<subsection id="HDFF48275321C4CC1A90E662E57B46036"><enum>(f)</enum><header>Oak flat withdrawal area</header> 
<paragraph id="H0DC0F8C4695F45B482FA4F902DB682D7"><enum>(1)</enum><header>Permits</header><text>Subject to the provisions of this subsection and notwithstanding any withdrawal of the Oak Flat Withdrawal Area from the mining, mineral leasing, or public land laws, the Secretary, upon enactment of this Act, shall issue to Resolution Copper—</text> 
<subparagraph id="H5F178CEB12FC4864B94BFD00A6DE74C9"><enum>(A)</enum><text>if so requested by Resolution Copper, within 30 days of such request, a special use permit to carry out mineral exploration activities under the Oak Flat Withdrawal Area from existing drill pads located outside the Area, if the activities would not disturb the surface of the Area; and</text></subparagraph> 
<subparagraph id="H91A2F62B3DF644CD9B1083112F84AB06"><enum>(B)</enum><text>if so requested by Resolution Copper, within 90 days of such request, a special use permit to carry out mineral exploration activities within the Oak Flat Withdrawal Area (but not within the Oak Flat Campground), if the activities are conducted from a single exploratory drill pad which is located to reasonably minimize visual and noise impacts on the Campground.</text></subparagraph></paragraph> 
<paragraph id="H674A3C8854D54DABB3669AF4FDE8C08F"><enum>(2)</enum><header>Conditions</header><text>Any activities undertaken in accordance with this subsection shall be subject to such reasonable terms and conditions as the Secretary may require.</text></paragraph> 
<paragraph id="H4B7E52C727FD42B5864DAFEDA1EFB5FF"><enum>(3)</enum><header>Termination</header><text>The authorization for Resolution Copper to undertake mineral exploration activities under this subsection shall remain in effect until the Oak Flat Withdrawal Area land is conveyed to Resolution Copper in accordance with this Act.</text></paragraph></subsection> 
<subsection id="H98710BB54E394BB382EDC902B2B9C902"><enum>(g)</enum><header>Costs</header><text>As a condition of the land exchange under this Act, Resolution Copper shall agree to pay, without compensation, all costs that are—</text> 
<paragraph id="H0868ECB60692400582145188AC6D545B"><enum>(1)</enum><text display-inline="yes-display-inline">associated with the land exchange and any environmental review document under subsection (j); and</text></paragraph> 
<paragraph id="H3C65ECC479F9405DB2735E9B04B456BE"><enum>(2)</enum><text>agreed to by the Secretary.</text></paragraph></subsection> 
<subsection id="HA20D59F493C448F8883E56F8F33FD4F6"><enum>(h)</enum><header>Use of Federal land</header><text>The Federal land to be conveyed to Resolution Copper under this Act shall be available to Resolution Copper for mining and related activities subject to and in accordance with applicable Federal, State, and local laws pertaining to mining and related activities on land in private ownership.</text></subsection> 
<subsection id="H06FE8B411B584D8EB9520F8DBAD9A667"><enum>(i)</enum><header>Intent of Congress</header><text>It is the intent of Congress that the land exchange directed by this Act shall be consummated not later than one year after the date of enactment of this Act.</text></subsection> 
<subsection id="H1A46007C031A4E20B6653B639771EFB2"><enum>(j)</enum><header>Environmental compliance</header><text display-inline="yes-display-inline">Compliance with the requirements of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) under this Act shall be as follows:</text> 
<paragraph id="H997AE643926B40ABAB2A70B5A3A486DB"><enum>(1)</enum><text>Prior to commencing production in commercial quantities of any valuable mineral from the Federal land conveyed to Resolution Copper under this Act (except for any production from exploration and mine development shafts, adits, and tunnels needed to determine feasibility and pilot plant testing of commercial production or to access the ore body and tailing deposition areas), Resolution Copper shall submit to the Secretary a proposed mine plan of operations.</text></paragraph> 
<paragraph id="H9ABC4FACA8F647A7ABA7EDFE8FD3DD6C"><enum>(2)</enum><text>The Secretary shall, within 3 years of such submission, complete preparation of an environmental review document in accordance with section 102(2) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4322">42 U.S.C. 4322(2)</external-xref>) which shall be used as the basis for all decisions under applicable Federal laws, rules and regulations regarding any Federal actions or authorizations related to the proposed mine and mine plan of operations of Resolution Copper, including the construction of associated power, water, transportation, processing, tailings, waste dump, and other ancillary facilities.</text></paragraph></subsection></section> 
<section id="H245ABECBE18A47958FA4F9342076015C"><enum>5.</enum><header>Conveyance and management of non-Federal land</header> 
<subsection id="H648F57ACC9A34F71B2E1B18FBAE126DC"><enum>(a)</enum><header>Conveyance</header><text>On receipt of title to the Federal land, Resolution Copper shall simultaneously convey—</text> 
<paragraph id="HD60AFD6EF04C4EC8890BC3284DE49CA0"><enum>(1)</enum><text>to the Secretary, all right, title, and interest that the Secretary determines to be acceptable in and to—</text> 
<subparagraph id="H734BD6B3D7C5494FB19721B8C9D62AA0"><enum>(A)</enum><text>the approximately 147 acres of land located in Gila County, Arizona, depicted on the map entitled <quote>Southeast Arizona Land Exchange and Conservation Act of 2011–Non-Federal Parcel–Turkey Creek</quote> and dated March 2011;</text></subparagraph> 
<subparagraph id="HAA6C2B07CAC74D189F09A8D031C8A76D"><enum>(B)</enum><text>the approximately 148 acres of land located in Yavapai County, Arizona, depicted on the map entitled <quote>Southeast Arizona Land Exchange and Conservation Act of 2011–Non-Federal Parcel–Tangle Creek</quote> and dated March 2011;</text></subparagraph> 
<subparagraph id="H00BAB787EBE143DB9755F201D8B767F2"><enum>(C)</enum><text>the approximately 149 acres of land located in Maricopa County, Arizona, depicted on the map entitled <quote>Southeast Arizona Land Exchange and Conservation Act of 2011–Non-Federal Parcel–Cave Creek</quote> and dated March 2011;</text></subparagraph> 
<subparagraph id="HCE1AE22C7A7645AE9C54041E7D961A94"><enum>(D)</enum><text>the approximately 640 acres of land located in Coconino County, Arizona, depicted on the map entitled <quote>Southeast Arizona Land Exchange and Conservation Act of 2011–Non-Federal Parcel–East Clear Creek</quote> and dated March 2011; and</text></subparagraph> 
<subparagraph id="H41658044D4964FFCB4ED8A97EF5CA113"><enum>(E)</enum><text>the approximately 110 acres of land located in Pinal County, Arizona, depicted on the map entitled <quote>Southeast Arizona Land Exchange and Conservation Act of 2011–Non-Federal Parcel–Apache Leap South End</quote> and dated March 2011; and</text></subparagraph></paragraph> 
<paragraph id="HD54FFF98CC3241DDA6C47EB683401D00"><enum>(2)</enum><text>to the Secretary of the Interior, all right, title, and interest that the Secretary of the Interior determines to be acceptable in and to—</text> 
<subparagraph id="HD11C4A6DB84943AAAD5706EABC31FAF4"><enum>(A)</enum><text display-inline="yes-display-inline">the approximately 3,050 acres of land located in Pinal County, Arizona, identified as <quote>Lands to DOI</quote> as generally depicted on the map entitled <quote>Southeast Arizona Land Exchange and Conservation Act of 2011–Non-Federal Parcel–Lower San Pedro River</quote> and dated July 6, 2011;</text></subparagraph> 
<subparagraph id="H865585A8EBFE40EC8639496944D10420"><enum>(B)</enum><text display-inline="yes-display-inline">the approximately 160 acres of land located in Gila and Pinal Counties, Arizona, identified as <quote>Lands to DOI</quote> as generally depicted on the map entitled <quote>Southeast Arizona Land Exchange and Conservation Act of 2011–Non-Federal Parcel–Dripping Springs</quote> and dated July 6, 2011; and</text></subparagraph> 
<subparagraph id="H71872F78C48C4D50838E3113CC90C6C9"><enum>(C)</enum><text display-inline="yes-display-inline">the approximately 940 acres of land located in Santa Cruz County, Arizona, identified as <quote>Lands to DOI</quote> as generally depicted on the map entitled <quote>Southeast Arizona Land Exchange and Conservation Act of 2011–Non-Federal Parcel–Appleton Ranch</quote> and dated July 6, 2011.</text></subparagraph></paragraph></subsection> 
<subsection id="H18E45CAC02BF446D9E69F29D76644D39"><enum>(b)</enum><header>Management of acquired land</header> 
<paragraph id="H07795785E5104756B6702AD221568A3F"><enum>(1)</enum><header>Land acquired by the Secretary</header> 
<subparagraph id="HA2F9E7FD0612494188BCE496D68EC465"><enum>(A)</enum><header>In general</header><text>Land acquired by the Secretary under this Act shall—</text> 
<clause id="HDAB2C9B2E571431A8DA8A094E37FDC5E"><enum>(i)</enum><text>become part of the national forest in which the land is located; and</text></clause> 
<clause id="HF668AE4700624FB885C6BBC171601901"><enum>(ii)</enum><text>be administered in accordance with the laws applicable to the National Forest System.</text></clause></subparagraph> 
<subparagraph id="HEDAD50B403804551BF4DD3B3E45B3E50"><enum>(B)</enum><header>Boundary revision</header><text>On the acquisition of land by the Secretary under this Act, the boundaries of the national forest shall be modified to reflect the inclusion of the acquired land.</text></subparagraph> 
<subparagraph id="HD90436C2004F4DEF8EE6CD38BB63881C"><enum>(C)</enum><header>Land and water conservation fund</header><text>For purposes of section 7 of the Land and Water Conservation Fund Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/16/4601-9">16 U.S.C. 4601–9</external-xref>), the boundaries of a national forest in which land acquired by the Secretary is located shall be deemed to be the boundaries of that forest as in existence on January 1, 1965.</text></subparagraph></paragraph> 
<paragraph id="H05ECEB1A734F4700AD3091CA6F553C2D"><enum>(2)</enum><header>Land acquired by the Secretary of the interior</header> 
<subparagraph id="HAD0912A50B46485FA90F1450D16D1932"><enum>(A)</enum><header>San pedro national conservation area</header> 
<clause id="H291BA1224E454E278E8C71F6954D18A2"><enum>(i)</enum><header>In general</header><text>The land acquired by the Secretary of the Interior under subsection (a)(2)(A) shall be added to, and administered as part of, the San Pedro National Conservation Area in accordance with the laws (including regulations) applicable to the Conservation Area.</text></clause> 
<clause id="HCBDA98ED4B774593A1133B85559AD678"><enum>(ii)</enum><header>Management plan</header><text>Not later than 2 years after the date on which the land is acquired, the Secretary of the Interior shall update the management plan for the San Pedro National Conservation Area to reflect the management requirements of the acquired land.</text></clause></subparagraph> 
<subparagraph id="HD520FF399A624ABEAABC2DEF7EEFE931"><enum>(B)</enum><header>Dripping springs</header><text>Land acquired by the Secretary of the Interior under subsection (a)(2)(B) shall be managed in accordance with the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>) and applicable land use plans.</text></subparagraph> 
<subparagraph id="HB8F2002A23504366AAFDACC9F5E0F75B"><enum>(C)</enum><header>Las cienegas national conservation area</header><text>Land acquired by the Secretary of the Interior under subsection (a)(2)(C) shall be added to, and administered as part of, the Las Cienegas National Conservation Area in accordance with the laws (including regulations) applicable to the Conservation Area.</text></subparagraph></paragraph></subsection> 
<subsection id="H129F7CDF753F4C878C01BA6BA3246BCD"><enum>(c)</enum><header>Surrender of rights</header><text>In addition to the conveyance of the non-Federal land to the United States under this Act, and as a condition of the land exchange, Resolution Copper shall surrender to the United States, without compensation, the rights held by Resolution Copper under the mining laws and other laws of the United States to commercially extract minerals under Apache Leap.</text></subsection></section> 
<section id="HAE8C69215510418C94A2EC062926F6A9"><enum>6.</enum><header>Value adjustment payment to United States</header> 
<subsection id="HA29F3EE73FB74E60AE0BAA6E6CE04B83"><enum>(a)</enum><header>Annual production reporting</header> 
<paragraph id="HD126C1867E8D480EA423F184702A686F"><enum>(1)</enum><header>Report required</header><text display-inline="yes-display-inline">As a condition of the land exchange under this Act, Resolution Copper shall submit to the Secretary of the Interior an annual report indicating the quantity of locatable minerals produced during the preceding calendar year in commercial quantities from the Federal land conveyed to Resolution Copper under section 4. The first report is required to be submitted not later than February 15 of the first calendar year beginning after the date of commencement of production of valuable locatable minerals in commercial quantities from such Federal land. The reports shall be submitted February 15 of each calendar year thereafter.</text></paragraph> 
<paragraph id="H6F23CC15D50E43719649003D6909404E"><enum>(2)</enum><header>Sharing reports with state</header><text>The Secretary shall make each report received under paragraph (1) available to the State.</text></paragraph> 
<paragraph id="H4DFEC3003FF1421F87A85CB6444EB340"><enum>(3)</enum><header>Report contents</header><text>The reports under paragraph (1) shall comply with any recordkeeping and reporting requirements prescribed by the Secretary or required by applicable Federal laws in effect at the time of production.</text></paragraph></subsection> 
<subsection id="H594485923B714F23AE0BF3B8A66ACEF8"><enum>(b)</enum><header>Payment on production</header><text>If the cumulative production of valuable locatable minerals produced in commercial quantities from the Federal land conveyed to Resolution Copper under section 4 exceeds the quantity of production of locatable minerals from the Federal land used in the income capitalization approach analysis prepared under section 4(d)(3), Resolution Copper shall pay to the United States, by not later than March 15 of each applicable calendar year, a value adjustment payment for the quantity of excess production at the same rate assumed for the income capitalization approach analysis prepared under section 4(d)(3).</text></subsection> 
<subsection id="H286B39C5581348E6896E2B9C3CE3824D"><enum>(c)</enum><header>State law unaffected</header><text>Nothing in this section modifies, expands, diminishes, amends, or otherwise affects any State law relating to the imposition, application, timing, or collection of a State excise or severance tax.</text></subsection> 
<subsection id="HB606ABC5F01D4C75A2D9CBFE5B3EAC54"><enum>(d)</enum><header>Use of funds</header> 
<paragraph id="H329D2A4EB14C4387B66F5A82BC26D3F7"><enum>(1)</enum><header>Separate fund</header><text display-inline="yes-display-inline">All funds paid to the United States under this section shall be deposited in a special fund established in the Treasury and shall be available, in such amounts as are provided in advance in appropriation Acts, to the Secretary and the Secretary of the Interior only for the purposes authorized by paragraph (2).</text></paragraph> 
<paragraph id="H2BAB785416684AB09BD48F6C8ADF009E"><enum>(2)</enum><header>Authorized use</header><text display-inline="yes-display-inline">Amounts in the special fund established pursuant to paragraph (1) shall be used for maintenance, repair, and rehabilitation projects for Forest Service and Bureau of Land Management assets.</text></paragraph></subsection></section> 
<section id="H66EFEFC791BC44C3AAC7AA49BBC27EDE"><enum>7.</enum><header>Withdrawal</header><text display-inline="no-display-inline">Subject to valid existing rights, Apache Leap and any land acquired by the United States under this Act are withdrawn from all forms of—</text> 
<paragraph id="H782940E3B0DA4F0B87F1913A226886F3"><enum>(1)</enum><text>entry, appropriation, or disposal under the public land laws;</text></paragraph> 
<paragraph id="H58A908ABE4A14F9CA6FF8565403AA95A"><enum>(2)</enum><text>location, entry, and patent under the mining laws; and</text></paragraph> 
<paragraph id="H7D041D1C639443808E93EE25D86A5811"><enum>(3)</enum><text>disposition under the mineral leasing, mineral materials, and geothermal leasing laws.</text></paragraph></section> 
<section id="HC67DB9FFB0CC42E2AD84132461D8D459"><enum>8.</enum><header>Apache leap</header> 
<subsection id="H45C8C9A85DDD4FBCA8C31F05C72AE3EC"><enum>(a)</enum><header>Management</header> 
<paragraph id="HE28A984D1F8940CCA7C6F3D4F077CD80"><enum>(1)</enum><header>In general</header><text>The Secretary shall manage Apache Leap to preserve the natural character of Apache Leap and to protect archeological and cultural resources located on Apache Leap.</text></paragraph> 
<paragraph id="H7D274B2895F142A6AC97B2A98A22B254"><enum>(2)</enum><header>Special use permits</header><text>The Secretary may issue to Resolution Copper special use permits allowing Resolution Copper to carry out underground activities (other than the commercial extraction of minerals) under the surface of Apache Leap that the Secretary determines would not disturb the surface of the land, subject to any terms and conditions that the Secretary may require.</text></paragraph> 
<paragraph id="H51EF6AEB76524E659F2B5E907F24390B"><enum>(3)</enum><header>Fences; signage</header><text>The Secretary may allow use of the surface of Apache Leap for installation of fences, signs, monitoring devices, or other measures necessary to protect the health and safety of the public, protect resources located on Apache Leap, or to ensure that activities conducted under paragraph (2) do not affect the surface of Apache Leap.</text></paragraph></subsection> 
<subsection id="HAEDC943DAD6A4A72B73C944F2B64963B"><enum>(b)</enum><header>Plan</header> 
<paragraph id="H1B4580E7752B4B6EB851835D24AAC1E8"><enum>(1)</enum><header>In general</header><text>Not later than 3 years after the date of enactment of this Act, the Secretary, in consultation with affected Indian tribes, the Town, Resolution Copper, and other interested members of the public, shall prepare a management plan for Apache Leap.</text></paragraph> 
<paragraph id="H61820A971FDC4AD982C779EBEA8A9E20"><enum>(2)</enum><header>Considerations</header><text>In preparing the plan under paragraph (1), the Secretary shall consider whether additional measures are necessary to—</text> 
<subparagraph id="HEFFD07AC9F444CF68607211B86FECB0A"><enum>(A)</enum><text>protect the cultural, archaeological, or historical resources of Apache Leap, including permanent or seasonal closures of all or a portion of Apache Leap; and</text></subparagraph> 
<subparagraph id="H0C2B6750671047BFA22EF58F97C8C633"><enum>(B)</enum><text>provide access for recreation.</text></subparagraph></paragraph></subsection> 
<subsection id="H8674802132AF4695BF42929CA9EA1A19"><enum>(c)</enum><header>Mining activities</header><text>The provisions of this section shall not impose additional restrictions on mining activities carried out by Resolution Copper adjacent to, or outside of, the Apache Leap area beyond those otherwise applicable to mining activities on privately owned land under Federal, State, and local laws, rules and regulations.</text></subsection></section> 
<section id="HBA866FE885C84016B24372A754362BDB"><enum>9.</enum><header>Conveyances to town of Superior, Arizona</header> 
<subsection id="H91DDBD88923B44F08F7D61D071979D80"><enum>(a)</enum><header>Conveyances</header><text>On request from the Town and subject to the provisions of this section, the Secretary shall convey to the Town the following:</text> 
<paragraph id="H3B127EA07DA04BA3BD638115209277A0"><enum>(1)</enum><text>Approximately 30 acres of land as depicted on the map entitled <quote>Southeast Arizona Land Exchange and Conservation Act of 2011–Federal Parcel–Fairview Cemetery</quote> and dated March 2011.</text></paragraph> 
<paragraph id="HE9C1566A29C242BCB4DEA37A41BBA8BB"><enum>(2)</enum><text>The reversionary interest and any reserved mineral interest of the United States in the approximately 265 acres of land located in Pinal County, Arizona, as depicted on the map entitled <quote>Southeast Arizona Land Exchange and Conservation Act of 2011–Federal Reversionary Interest–Superior Airport</quote> and dated March 2011.</text></paragraph> 
<paragraph id="H09305D38DE93438F9BFCB7C4358085F0"><enum>(3)</enum><text>The approximately 250 acres of land located in Pinal County, Arizona, as depicted on the map entitled <quote>Southeast Arizona Land Exchange and Conservation Act of 2011–Federal Parcel–Superior Airport Contiguous Parcels</quote> and dated March 2011.</text></paragraph></subsection> 
<subsection display-inline="no-display-inline" id="HD1A8D420D23F41B5B489885CDE47DE0F"><enum>(b)</enum><header>Payment</header><text display-inline="yes-display-inline">The Town shall pay to the Secretary the market value for each parcel of land or interest in land acquired under this section, as determined by appraisals conducted in accordance with section 4(d).</text></subsection> 
<subsection id="HC65172B2B6564AADA161BC35F05D9C19"><enum>(c)</enum><header>Sisk Act</header><text display-inline="yes-display-inline">Any payment received by the Secretary from the Town under this section shall be deposited in the fund established under <external-xref legal-doc="public-law" parsable-cite="pl/90/171">Public Law 90–171</external-xref> (commonly known as the <quote>Sisk Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/16/484a">16 U.S.C. 484a</external-xref>) and shall be made available, in such amounts as are provided in advance in appropriation Acts, to the Secretary for the acquisition of land for addition to the National Forest System.</text></subsection> 
<subsection id="H8E91E63E79764831BEFAE826EA5CE4FB"><enum>(d)</enum><header>Terms and conditions</header><text>The conveyances under this section shall be subject to such terms and conditions as the Secretary may require.</text></subsection></section> 
<section id="H03741E26424348FBADF0F458C68F826F"><enum>10.</enum><header>Miscellaneous provisions</header> 
<subsection id="H0EE51B947BEB46409B7BD79D0B0A5A6E"><enum>(a)</enum><header>Revocation of orders; withdrawal</header> 
<paragraph id="H5007BCBA901141498BBB644650BE27E9"><enum>(1)</enum><header>Revocation of orders</header><text>Any public land order that withdraws the Federal land from appropriation or disposal under a public land law shall be revoked to the extent necessary to permit disposal of the land.</text></paragraph> 
<paragraph id="H65E1AFE6EA304B16A71D3D0100DEEDEA"><enum>(2)</enum><header>Withdrawal</header><text>On the date of enactment of this Act, if the Federal land or any Federal interest in the non-Federal land to be exchanged under section 4 is not withdrawn or segregated from entry and appropriation under a public land law (including mining and mineral leasing laws and the Geothermal Steam Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/30/1001">30 U.S.C. 1001 et seq.</external-xref>)), the land or interest shall be withdrawn, without further action required by the Secretary concerned, from entry and appropriation. The withdrawal shall be terminated—</text> 
<subparagraph id="H123B751556834D28B69AF73C160D7466"><enum>(A)</enum><text>on the date of consummation of the land exchange; or</text></subparagraph> 
<subparagraph id="HBE2DF4883D9F4D96A1DCBDAA506A22A0"><enum>(B)</enum><text>if Resolution Copper notifies the Secretary in writing that it has elected to withdraw from the land exchange pursuant to section 206(d) of the Federal Land Policy and Management Act of 1976, as amended (<external-xref legal-doc="usc" parsable-cite="usc/43/1716">43 U.S.C. 1716(d)</external-xref>).</text></subparagraph></paragraph> 
<paragraph id="H74096BC5E0064791A7195B28EB53BBA4"><enum>(3)</enum><header>Rights of resolution copper</header><text>Nothing in this Act shall interfere with, limit, or otherwise impair, the unpatented mining claims or rights currently held by Resolution Copper on the Federal land, nor in any way change, diminish, qualify, or otherwise impact Resolution Copper’s rights and ability to conduct activities on the Federal land under such unpatented mining claims and the general mining laws of the United States, including the permitting or authorization of such activities.</text></paragraph></subsection> 
<subsection id="HAEBA0B42F70E46248FBFAFCFB55AD0AB"><enum>(b)</enum><header>Maps, estimates, and descriptions</header> 
<paragraph id="HAA6DBCC2C0474ECFBDBBE265EE8F0C74"><enum>(1)</enum><header>Minor errors</header><text>The Secretary concerned and Resolution Copper may correct, by mutual agreement, any minor errors in any map, acreage estimate, or description of any land conveyed or exchanged under this Act.</text></paragraph> 
<paragraph id="H5F94D78F629549648782318D0CDA8356"><enum>(2)</enum><header>Conflict</header><text>If there is a conflict between a map, an acreage estimate, or a description of land in this Act, the map shall control unless the Secretary concerned and Resolution Copper mutually agree otherwise.</text></paragraph> 
<paragraph id="HC6806EE0D894473FAF4314CCA2B3596A"><enum>(3)</enum><header>Availability</header><text>On the date of enactment of this Act, the Secretary shall file and make available for public inspection in the Office of the Supervisor, Tonto National Forest, each map referred to in this Act.</text></paragraph></subsection></section>
