		<section id="H6356331833A44F058A68E268011E3C41" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Part-Time Worker Bill of Rights Act of
			 2013</short-title></quote>.</text>
		</section><section id="H8854A83A92014DB5B90FF87436CAC629"><enum>2.</enum><header>Extension of
			 employer health insurance coverage mandate to part-time employees</header>
			<subsection id="H72CEDA21F0D6432AA6EE3E528EAC7BF5"><enum>(a)</enum><header>Large employers
			 not offering health coverage</header>
				<paragraph id="H8AA5B75DD65942C6A6BD927D6549EBCD"><enum>(1)</enum><header>In
			 general</header><text>Subsection (a) of section 4980H of the Internal Revenue
			 Code of 1986 is amended—</text>
					<subparagraph id="HC8B9BD46EFF243489ABA341063D7A7C6"><enum>(A)</enum><text>by striking
			 <quote>full-time employees</quote> in paragraph (1) and inserting
			 <quote>employees</quote>,</text>
					</subparagraph><subparagraph id="H9ACD3A746C4442A0A3F0CD8E063B2425"><enum>(B)</enum><text>by striking
			 <quote>full-time employee</quote> in paragraph (2) and inserting
			 <quote>employee</quote>, and</text>
					</subparagraph><subparagraph id="HA771AD0D77E94EA5A04D11DF8A0A1F7B"><enum>(C)</enum><text>by striking
			 <quote>hereby imposed on the employer</quote> and all that follows and
			 inserting <quote>hereby imposed on the employer, with respect to each employee
			 employed by the employer during such month, an assessable payment equal to the
			 applicable payment amount with respect to such employee.</quote>.</text>
					</subparagraph></paragraph><paragraph id="H72884090EC6844E0987E816CBF5D717A"><enum>(2)</enum><header>Proration of
			 applicable payment amount for part-time employees</header><text>Paragraph (1)
			 of section 4980H(c) of such Code is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H870DFFE450FE45C4A6B69FF3D054B615" style="OLC">
						<paragraph id="H01CB5D129700428E9BD83A5641D88783"><enum>(1)</enum><header>Applicable
				payment amount</header><text display-inline="yes-display-inline">The term
				<quote>applicable payment amount</quote> means, with respect to any employee
				for any month—</text>
							<subparagraph id="HFCB85EC2F97B406A94B416404F4E0928"><enum>(A)</enum><text>in the case of a
				full-time employee, <fraction>1/12</fraction> of $2,000, and</text>
							</subparagraph><subparagraph id="HD5DE19590E5544078DFCA9C76834EE69"><enum>(B)</enum><text>in the case of any
				other employee, the amount which bears the same ratio to the amount determined
				under subparagraph (A) as—</text>
								<clause id="HB0BEFB29C6E94491B715217B3075FCD2"><enum>(i)</enum><text>the average hours
				of service per week of such employee for such month, bears to</text>
								</clause><clause id="HF7CC465D2AE54433846E19A3D8238496"><enum>(ii)</enum><text>30.</text>
								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HF4444968C23F4F57A292B870A8F194DE"><enum>(b)</enum><header>Large employers
			 offering coverage with employees who qualify for premium tax credits or
			 cost-Sharing reductions</header>
				<paragraph id="H810A334287754A76B1C9D82FFC59B5CC"><enum>(1)</enum><header>In
			 general</header><text>Paragraph (1) of section 4980H(b) of such Code is
			 amended—</text>
					<subparagraph id="H2C73B6867F964EF2B76306A1AAB879B3"><enum>(A)</enum><text>by striking
			 <quote>full-time employees</quote> each place it appears in subparagraphs (A)
			 and (B) and inserting <quote>employees</quote>, and</text>
					</subparagraph><subparagraph id="H9580EA92BC504680BBB8A12A703349A7"><enum>(B)</enum><text>by striking
			 <quote>hereby imposed on the employer</quote> and all that follows and
			 inserting <quote>hereby imposed on the employer, with respect to each employee
			 described in subparagraph (B) for such month, an assessable payment equal to
			 <fraction>1/12</fraction> of $3,000.</quote>.</text>
					</subparagraph></paragraph><paragraph id="H3FC7C36D5591411B9FCE6298EE69FFCB"><enum>(2)</enum><header>Proration for
			 part-time employees</header><text>Subsection (b) of section 4980H of such Code
			 is amended by adding at the end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H295546F67AC1493BA9C7ACEECE3A5A75" style="OLC">
						<paragraph id="HE071EF014CDF4B20A93DF8168900BA60"><enum>(3)</enum><header>Proration for
				part-time employees</header><text display-inline="yes-display-inline">In the
				case of any employee other than a full-time employee, paragraph (1) shall be
				applied by substituting for <quote>$3,000</quote> the dollar amount which bears
				the same ratio to $3,000 as—</text>
							<subparagraph id="HF7EE8F61F71248D99568803498F621AB"><enum>(A)</enum><text display-inline="yes-display-inline">the average hours of service per week of
				such employee for the month with respect to which such paragraph applies, bears
				to</text>
							</subparagraph><subparagraph id="H5C62AD5E32FD46D8BB5E1A389B099789"><enum>(B)</enum><text>30.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H5F3C0DE7A8B14217940382AD541404C3"><enum>(3)</enum><header>Application of
			 overall limitation</header><text>Paragraph (2) of section 4980H(b) of such Code
			 is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H51C1784710474EF4865A3FCD07E02903" style="OLC">
						<paragraph id="H7CA29DA1FBCF4B2BBBCF2906FA52EABA"><enum>(2)</enum><header>Overall
				limitation</header><text display-inline="yes-display-inline">The aggregate
				amount of tax determined under paragraph (1) with respect to any applicable
				large employer for any month shall not exceed the aggregate amount of tax which
				would have been determined under subsection (a) with respect to such employer
				for such month if such employer were described in subsection
				(a)(1).</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H0E03D42A80B249FCA521464B34849DD9"><enum>(c)</enum><header>Application of
			 hours of service rules</header><text>Subparagraph (B) of section 4980H(c)(4) of
			 such Code is amended by striking <quote>for the application of this paragraph
			 to</quote> and inserting <quote>with respect to</quote>.</text>
			</subsection><subsection id="H57F3F83A29724BCDADADF138D15A91A6"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to months
			 beginning after December 31, 2013.</text>
			</subsection></section><section id="H7286B987DF5F4F9C994D08224194D2E8"><enum>3.</enum><header>Elimination of
			 hours of service requirement for FMLA leave</header>
			<subsection id="H504059DED8E44A579B9F2D33FA776154"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline">Section 101(2)(A) of the Family and Medical
			 Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2611">29 U.S.C. 2611(2)(A)</external-xref>) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HF6254F62B4A343FCAFC1B462C3F3E416" style="OLC">
					<subparagraph id="H83CE6D7C3E5D41A7A8C33DAE2A81ABD3"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The term
				<quote>eligible employee</quote> means an employee who has been employed,
				either as a full-time or part-time employee, for at least 12 months by the
				employer with respect to whom leave is requested under section
				102.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H23F3F5851BA642A3A4511344FE8DC902"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 subsection (a) shall take effect beginning on the date that is one year after
			 the date of enactment of this Act.</text>
			</subsection></section><section commented="no" id="HE2A8D806AEC742AF83D648DB20512CE9"><enum>4.</enum><header>Treatment of
			 employees working at less than full-time under participation, vesting, and
			 accrual rules governing pension plans</header>
			<subsection commented="no" id="H07369973E03F47F4B95C97B497088F07"><enum>(a)</enum><header>Participation
			 rules</header>
				<paragraph commented="no" id="H7714DB3A921A474FAED81A91B68842A3"><enum>(1)</enum><header>In
			 general</header><text>Section 202(a)(3) of the <act-name parsable-cite="ERISA">Employee Retirement Income Security Act of
			 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/29/1052">29 U.S.C. 1052(a)(3)</external-xref>) is amended by adding at the end the
			 following new subparagraph:</text>
					<quoted-block act-name="Employee" id="HECA5E14E1A3B486EAEC0D074ECCDA464">
						<subparagraph commented="no" id="HDC62ED42EBB3498E927AA783FCF47A95" indent="up2"><enum>(E)</enum><clause commented="no" display-inline="yes-display-inline" id="H4F003810D42749B2AEDC36C7009271AA"><enum>(i)</enum><text display-inline="yes-display-inline">For purposes of this paragraph, in the case
				of any employee who, as of the beginning of the 12-month period referred to in
				subparagraph (A)—</text>
								<subclause commented="no" id="H57B2A8C0B6E641D5BAE05AC2C19F6064" indent="up1"><enum>(I)</enum><text>has customarily completed 500 or more
				hours of service per year but less than 1,000 hours of service per year,
				or</text>
								</subclause><subclause commented="no" id="HC2F1AB9C261847D795BA3F627C8BDCDB" indent="up1"><enum>(II)</enum><text>is employed in a type of position in
				which employment customarily constitutes 500 or more hours of service per year
				but less than 1,000 hours of service per year,</text>
								</subclause><continuation-text commented="no" continuation-text-level="clause" indent="subsection">completion of 500 hours of service within such period
				shall be treated as completion of 1,000 hours of service.</continuation-text></clause><clause commented="no" id="HA5D8D02B0D164C54AB480F8023AED371" indent="up1"><enum>(ii)</enum><text>For purposes of this subparagraph,
				the extent to which employment in any type of position customarily constitutes
				less than 1,000 hours of service per year shall be determined with respect to
				each pension plan in accordance with such regulations as the Secretary may
				prescribe providing for consideration of facts and circumstances peculiar to
				the work-force constituting the participants in such
				plan.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" id="HE20EEA1EB49443429F9C738982E0BA98"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Section 204(b)(1)(E) of such Act (29 U.S.C.
			 1054(b)(1)(E)) is amended by striking <quote>section 202(a)(3)(A)</quote> and
			 inserting <quote>subparagraphs (A) and (E) of section 202(a)(3)</quote>.</text>
				</paragraph></subsection><subsection commented="no" id="H18A7D56A89624782906D5784C127EB47"><enum>(b)</enum><header>Vesting
			 rules</header>
				<paragraph commented="no" id="HBF069041687D45B38DC91089CBC27354"><enum>(1)</enum><header>In
			 general</header><text>Section 203(b)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/1053">29 U.S.C. 1053(b)(2)</external-xref>) is
			 amended by adding at the end the following new subparagraph:</text>
					<quoted-block id="H6D847ABCF7C6428AAD8DCFAA85A7A54A">
						<subparagraph commented="no" id="H5E0B000F2E92466E8AB76A18A142E06A" indent="up2"><enum>(E)</enum><clause commented="no" display-inline="yes-display-inline" id="H87F9CF2A33974C78B9CB37274F29DC9F"><enum>(i)</enum><text display-inline="yes-display-inline">For purposes of this paragraph, in the case
				of any employee who, as of the beginning of the period designated by the plan
				pursuant to subparagraph (A)—</text>
								<subclause commented="no" id="HEAEF15E7AB974BDCA93D438DF9ECA32B" indent="up1"><enum>(I)</enum><text>has customarily completed 500 or more
				hours of service per year but less than 1,000 hours of service per year,
				or</text>
								</subclause><subclause commented="no" id="HB6E6EB2A7312470295A85C23C6BAA30A" indent="up1"><enum>(II)</enum><text>is employed in a type of position in
				which employment customarily constitutes 500 or more hours of service per year
				but less than 1,000 hours of service per year,</text>
								</subclause><continuation-text commented="no" continuation-text-level="clause" indent="subsection">completion of 500 hours of service within such period
				shall be treated as completion of 1,000 hours of service.</continuation-text></clause><clause commented="no" id="H4E6DA7CA4176401B993834804B1B3E96" indent="up1"><enum>(ii)</enum><text>For purposes of this subparagraph,
				the extent to which employment in any type of position customarily constitutes
				less than 1,000 hours of service per year shall be determined with respect to
				each pension plan in accordance with such regulations as the Secretary may
				prescribe providing for consideration of facts and circumstances peculiar to
				the work-force constituting the participants in such
				plan.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" id="HBA0DACDC02F94C558F4228715DE04936"><enum>(2)</enum><header>1-year breaks in
			 service</header><text>Section 203(b)(3) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/1053">29 U.S.C. 1053(b)(3)</external-xref>) is
			 amended by adding at the end the following new subparagraph:</text>
					<quoted-block id="H928CAB6D067C4107844B35A822587044">
						<subparagraph commented="no" id="H6610AF33EF194A1592123F613137EC24" indent="up2"><enum>(F)</enum><clause commented="no" display-inline="yes-display-inline" id="HAB5E57F12412474E8299AF1438719A9D"><enum>(i)</enum><text display-inline="yes-display-inline">For purposes of this paragraph, in the case
				of any employee who, as of the beginning of the period designated by the plan
				pursuant to subparagraph (A)—</text>
								<subclause commented="no" id="H9CB5988B422B4820A027B4386061F4C7" indent="up1"><enum>(I)</enum><text>has customarily completed 500 or more
				hours of service per year but less than 1,000 hours of service per year,
				or</text>
								</subclause><subclause commented="no" id="HC7703F4AA63B41DA820CF8BCD792B4BA" indent="up1"><enum>(II)</enum><text>is employed in a type of position in
				which employment customarily constitutes 500 or more hours of service per year
				but less than 1,000 hours of service per year,</text>
								</subclause><continuation-text commented="no" continuation-text-level="clause" indent="subsection">completion of 250 hours of service within such period
				shall be treated as completion of 500 hours of service.</continuation-text></clause><clause commented="no" id="HC128DE46EDFE4D8FACCC0C9C548F36DA" indent="up1"><enum>(ii)</enum><text>For purposes of this subparagraph,
				the extent to which employment in any type of position customarily constitutes
				less than 1,000 hours of service per year shall be determined with respect to
				each pension plan in accordance with such regulations as the Secretary may
				prescribe providing for consideration of facts and circumstances peculiar to
				the work-force constituting the participants in such
				plan.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" id="H7F25A3BE8D9348088C0F82233A2B172D"><enum>(c)</enum><header>Accrual
			 rules</header><text>Section 204(b)(4)(C) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/1054">29 U.S.C. 1054(b)(4)(C)</external-xref>)
			 is amended—</text>
				<paragraph commented="no" id="HCC90A5FB0880473DB6DA2A8814B34BF3"><enum>(1)</enum><text>by inserting
			 <quote>(i)</quote> after <quote>(C)</quote>; and</text>
				</paragraph><paragraph commented="no" id="H235DA6D6B5574ED2A76A7E43839F9E2D"><enum>(2)</enum><text>by adding at the
			 end the following new clauses:</text>
					<quoted-block id="H22A1F36061BB4A44ACD26F3A766F1DCF">
						<clause commented="no" id="H03259B8001E747B1B47FE33D91EA03E1" indent="up3"><enum>(ii)</enum><text>For purposes of this subparagraph,
				in the case of any employee who, as of the beginning of the period designated
				by the plan pursuant to clause (i)—</text>
							<subclause commented="no" id="H491918E40B4847ECB0640EC976DAA489"><enum>(I)</enum><text>has customarily completed 500 or more
				hours of service per year but less than 1,000 hours of service per year,
				or</text>
							</subclause><subclause commented="no" id="HA6D6E98E863C4A3C8B54370A9F62837C"><enum>(II)</enum><text>is employed in a type of position in
				which employment customarily constitutes 500 or more hours of service per year
				but less than 1,000 hours of service per year,</text>
							</subclause><continuation-text commented="no" continuation-text-level="clause">completion of 500 hours of service
				within such period shall be treated as completion of 1,000 hours of
				service.</continuation-text></clause><clause commented="no" id="HB3093108EB914F82A5B3A9A0A95AA741" indent="up3"><enum>(iii)</enum><text>For purposes of clause (ii), the
				extent to which employment in any type of position customarily constitutes less
				than 1,000 hours of service per year shall be determined with respect to each
				pension plan in accordance with such regulations as the Secretary may prescribe
				providing for consideration of facts and circumstances peculiar to the
				work-force constituting the participants in such
				plan.</text>
						</clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" id="H4944D3A966DF4991A344B09138537E24"><enum>(d)</enum><header>Effective
			 dates</header>
				<paragraph commented="no" id="H129A84B3B7734B95B6BA80D92D6AC983"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in subsection (b), the amendments made
			 by this section shall apply with respect to plan years beginning on or after
			 the date that is one year after the date of the enactment of this Act.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAD6ADA1BCD0448D486FD0B0748511F67"><enum>(2)</enum><header>Special rule for
			 collectively bargained plans</header><text display-inline="yes-display-inline">In the case of a plan maintained pursuant
			 to 1 or more collective bargaining agreements between employee representatives
			 and 1 or more employers ratified on or before the date of the enactment of this
			 Act, the amendments made by this section shall not apply to plan years
			 beginning before the later of—</text>
					<subparagraph commented="no" id="HB04944FBE3434DA6B2E3A0148E07FB5E"><enum>(A)</enum><text>the earlier
			 of—</text>
						<clause display-inline="no-display-inline" id="HF9033A7ADE0442C19FD0D39D8F696825"><enum>(i)</enum><text>the date on which
			 the last of the collective bargaining agreements relating to the plan
			 terminates (determined without regard to any extension thereof agreed to after
			 the date of the enactment of this Act); or</text>
						</clause><clause id="H18899DA3F3B740E49F82463FE4D2663D"><enum>(ii)</enum><text>the
			 date that is 3 years after the date of the enactment of this Act; or</text>
						</clause></subparagraph><subparagraph commented="no" id="HC6517C7F056747D0ABAF26BB7092ADCE"><enum>(B)</enum><text>the date that is 1
			 year after the date of the enactment of this Act.</text>
					</subparagraph><continuation-text commented="no" continuation-text-level="paragraph">For purposes of subparagraph (A), any
			 plan amendment made pursuant to a collective bargaining agreement relating to
			 the plan which amends the plan solely to conform to any requirement added by
			 this section shall not be treated as a termination of such collective
			 bargaining agreement.</continuation-text></paragraph></subsection></section></legis-body>
