<official-title>To establish the Harriet Tubman National Historical Park in Auburn, New York, and the Harriet Tubman Underground Railroad National Historical Park in Caroline, Dorchester, and Talbot Counties, Maryland, and for other purposes.</official-title>

<section id="H63C000D5CC7840F5B1531935C0F6C708" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Harriet Tubman National Historical Parks Act</short-title></quote>.</text></section>
<section id="H2896F23AACCB4B4A86F585CDB8524102"><enum>2.</enum><header>Harriet Tubman Underground Railroad National Historical Park, Maryland</header>
<subsection id="H60E2F5A6071C47B89864B53617C12A58"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
<paragraph id="H65E331ADB19247969B71CD0650C4EAC3"><enum>(1)</enum><header>Historical park</header><text>The term <term>historical park</term> means the Harriet Tubman Underground Railroad National Historical Park established by subsection (b)(1)(A).</text></paragraph>
<paragraph id="H98C25C249EC04F9EAABB56195442027B"><enum>(2)</enum><header>Map</header><text>The term <term>map</term> means the map entitled <quote>Authorized Acquisition Area for the Proposed Harriet Tubman Underground Railroad National Historical Park</quote>, numbered T20/80,001, and dated July 2010.</text></paragraph>
<paragraph id="HCA571B294A074D04A7E457F77C0293FF"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph>
<paragraph id="H59462D0A08A14314A6E049C1A29BC95D"><enum>(4)</enum><header>State</header><text>The term <quote>State</quote> means the State of Maryland.</text></paragraph></subsection>
<subsection id="HBD79F192624A43ED8B0713A6D531A4B3"><enum>(b)</enum><header>Harriet tubman underground railroad national historical park</header>
<paragraph id="H7DA81C3779F846DBB7BD3B15A8C884F2"><enum>(1)</enum><header>Establishment</header>
<subparagraph id="H70799B6148FE4DC0AC1E92176C2CD9A9"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), there is established the Harriet Tubman Underground Railroad National Historical Park in Caroline, Dorchester, and Talbot Counties, Maryland, as a unit of the National Park System.</text></subparagraph>
<subparagraph id="HF85EA6569AEE4408BED66E4B701AE088"><enum>(B)</enum><header>Determination by secretary</header><text>The historical park shall not be established until the date on which the Secretary determines that a sufficient quantity of land, or interests in land, has been acquired to constitute a manageable park unit.</text></subparagraph>
<subparagraph id="HC6D0276D97374339AF2BF46E0AB6F96A"><enum>(C)</enum><header>Notice</header><text>Not later than 30 days after the date on which the Secretary makes a determination under subparagraph (B), the Secretary shall publish in the Federal Register notice of the establishment of the historical park, including an official boundary map for the historical park.</text></subparagraph>
<subparagraph id="HA38ED7866AC044AD9257D8B201BDF0A3"><enum>(D)</enum><header>Availability of map</header><text>The official boundary map published under subparagraph (C) shall be on file and available for public inspection in appropriate offices of the National Park Service.</text></subparagraph></paragraph>
<paragraph id="H74182D70A6DA40BFB1DD1A8707AE9706"><enum>(2)</enum><header>Purpose</header><text>The purpose of the historical park is to preserve and interpret for the benefit of present and future generations the historical, cultural, and natural resources associated with the life of Harriet Tubman and the Underground Railroad.</text></paragraph>
<paragraph id="HBBBD2A907B27473F91D68220B44AE9E7"><enum>(3)</enum><header>Land acquisition</header>
<subparagraph id="H543473E831D24C2B88B43C6237E57BD9"><enum>(A)</enum><header>In general</header><text>The Secretary may acquire land and interests in land within the areas depicted on the map as <quote>Authorized Acquisition Areas</quote> by purchase from willing sellers, donation, or exchange.</text></subparagraph>
<subparagraph id="H12C64ABAF8BC40E4BA005F0971A13789"><enum>(B)</enum><header>Boundary adjustment</header><text>On acquisition of land or an interest in land under subparagraph (A), the boundary of the historical park shall be adjusted to reflect the acquisition.</text></subparagraph></paragraph></subsection>
<subsection id="H8BDC33B8A1CE48A29623F8003895E5A2"><enum>(c)</enum><header>Administration</header>
<paragraph id="HA1DCCEF118E24BAF98CBCB805707E1EA"><enum>(1)</enum><header>In general</header><text>The Secretary shall administer the historical park in accordance with this section and the laws generally applicable to units of the National Park System, including—</text>
<subparagraph id="H0987CA274CDB4DC7A9EB05F8D3E6B33F"><enum>(A)</enum><text>the National Park System Organic Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1">16 U.S.C. 1 et seq.</external-xref>); and</text></subparagraph>
<subparagraph id="H09A6521DB8EC489283D0AF0D6484BC0F"><enum>(B)</enum><text>the Act of August 21, 1935 (<external-xref legal-doc="usc" parsable-cite="usc/16/461">16 U.S.C. 461 et seq.</external-xref>).</text></subparagraph></paragraph>
<paragraph id="H5DEE632CF3754D82B3423A6FB4C0C950"><enum>(2)</enum><header>Interagency agreement</header><text>Not later than 1 year after the date on which the historical park is established, the Director of the National Park Service and the Director of the United States Fish and Wildlife Service shall enter into an agreement to allow the National Park Service to provide for public interpretation of historic resources located within the boundary of the Blackwater National Wildlife Refuge that are associated with the life of Harriet Tubman, consistent with the management requirements of the Refuge.</text></paragraph>
<paragraph id="HE95ED516BC3F4D49836C2F71B5066A12"><enum>(3)</enum><header>Interpretive tours</header><text>The Secretary may provide interpretive tours to sites and resources located outside the boundary of the historical park in Caroline, Dorchester, and Talbot Counties, Maryland, relating to the life of Harriet Tubman and the Underground Railroad.</text></paragraph>
<paragraph id="H30820A443C554BAD94FC4DF2B6DD43EB"><enum>(4)</enum><header>Cooperative agreements</header>
<subparagraph id="H2110B549D267468FA7F1262AB402C801"><enum>(A)</enum><header>In general</header><text>The Secretary may enter into a cooperative agreement with the State, political subdivisions of the State, colleges and universities, non-profit organizations, and individuals—</text>
<clause id="H0BD342E74A1446BF9A99E9986316597F"><enum>(i)</enum><text>to mark, interpret, and restore nationally significant historic or cultural resources relating to the life of Harriet Tubman or the Underground Railroad within the boundaries of the historical park, if the agreement provides for reasonable public access; or</text></clause>
<clause id="HF7B593BF6B974A22821445D075857764"><enum>(ii)</enum><text>to conduct research relating to the life of Harriet Tubman and the Underground Railroad.</text></clause></subparagraph>
<subparagraph id="H99AE6A03B381487EA8BAC2F1427F93B0"><enum>(B)</enum><header>Visitor center</header><text>The Secretary may enter into a cooperative agreement with the State to design, construct, operate, and maintain a joint visitor center on land owned by the State—</text>
<clause id="H5C702FD0153747388896D75039D9945D"><enum>(i)</enum><text>to provide for National Park Service visitor and interpretive facilities for the historical park; and</text></clause>
<clause id="H82C8059EF57044969FC10697AACA216D"><enum>(ii)</enum><text>to provide to the Secretary, at no additional cost, sufficient office space to administer the historical park.</text></clause></subparagraph>
<subparagraph id="H90BBF54AD8EA4E0A9E157D95A379F857"><enum>(C)</enum><header>Cost-sharing requirement</header>
<clause id="H4994ADA5840A4D3EA54CA89A835B5D81"><enum>(i)</enum><header>Federal share</header><text>The Federal share of the total cost of any activity carried out under this paragraph shall not exceed 50 percent.</text></clause>
<clause id="H86D104EFF84542129177694B02D81AE7"><enum>(ii)</enum><header>Form of non-federal share</header><text>The non-Federal share of the cost of carrying out an activity under this paragraph may be in the form of in-kind contributions or goods or services fairly valued.</text></clause></subparagraph></paragraph></subsection>
<subsection id="HFEEE8338552B47208319DB12128EA2BA"><enum>(d)</enum><header>General management plan</header>
<paragraph id="H34272B2FD3CB4718830F5D243309EADD"><enum>(1)</enum><header>In general</header><text>Not later than 3 years after the date on which funds are made available to carry out this section, the Secretary shall prepare a general management plan for the historical park in accordance with section 12(b) of the National Park Service General Authorities Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1a">16 U.S.C. 1a–7(b)</external-xref>).</text></paragraph>
<paragraph id="H13239145F18B4858AB9164B98B7AE240"><enum>(2)</enum><header>Consultation</header><text>The general management plan shall be prepared in consultation with the State (including political subdivisions of the State).</text></paragraph>
<paragraph id="H06FBBEA90FC448C3A4F24F142A0C9F8E"><enum>(3)</enum><header>Coordination</header><text>The Secretary shall coordinate the preparation and implementation of the management plan with—</text>
<subparagraph id="H752341F47CB849B29E268916B1739ABE"><enum>(A)</enum><text>the Blackwater National Wildlife Refuge;</text></subparagraph>
<subparagraph id="H5F89988EBF4343ACB758D7E4DC096E38"><enum>(B)</enum><text>the Harriet Tubman National Historical Park established by section 3(b)(1)(A); and</text></subparagraph>
<subparagraph id="H54007D275527422BB2C53362AC146AEE"><enum>(C)</enum><text>the National Underground Railroad Network to Freedom.</text></subparagraph></paragraph></subsection>
<subsection id="HE38A5AB1D39E4D9B9AE2B62A1662FD8F"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as are necessary to carry out this section.</text></subsection></section>
<section id="HDE9FD2B4B2C640DD8DC77F6C7CECB87C"><enum>3.</enum><header>Harriet tubman national historical park, auburn, New York</header>
<subsection id="HE8017C6041074B1EB9FFEB072F87ED5F"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="H74A0D5488F314998939552DFB17220AA"><enum>(1)</enum><header>Historical park</header><text>The term <term>historical park</term> means the Harriet Tubman National Historical Park established by subsection (b)(1)(A).</text></paragraph>
<paragraph id="H90E16EA4BE1449A0948EDDA3DE3DC58A"><enum>(2)</enum><header>Home</header><text>The term <term>Home</term> means The Harriet Tubman Home, Inc., located in Auburn, New York.</text></paragraph>
<paragraph id="H52CD03A528C14A5DBA7D56A04900BEEE"><enum>(3)</enum><header>Map</header><text>The term <term>map</term> means the map entitled <quote>Harriet Tubman National Historical Park</quote>, numbered T18/80,000, and dated March 2009.</text></paragraph>
<paragraph id="HDF04D820936548AE8AE9DF0FFD86F74E"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph>
<paragraph id="HFE38DAB4ADDB4D0EB57D2CD8E6718442"><enum>(5)</enum><header>State</header><text>The term <quote>State</quote> means the State of New York.</text></paragraph></subsection>
<subsection id="H08AB78891B3549F8982EBFA31FC6F1B1"><enum>(b)</enum><header>Harriet tubman national historical park</header>
<paragraph id="H138B92E51BCC406BA4489471CE291C2E"><enum>(1)</enum><header>Establishment</header>
<subparagraph id="H8D2F12E2021C4FD0AB19E49A2E0A2A03"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), there is established the Harriet Tubman National Historical Park in Auburn, New York, as a unit of the National Park System.</text></subparagraph>
<subparagraph id="H02259BD5C9E34998A41375AB606AE223"><enum>(B)</enum><header>Determination by secretary</header><text>The historical park shall not be established until the date on which the Secretary determines that a sufficient quantity of land, or interests in land, has been acquired to constitute a manageable park unit.</text></subparagraph>
<subparagraph id="HC264275DC6EB494B8F79EBA4E477A929"><enum>(C)</enum><header>Notice</header><text>Not later than 30 days after the date on which the Secretary makes a determination under subparagraph (B), the Secretary shall publish in the Federal Register notice of the establishment of the historical park.</text></subparagraph>
<subparagraph id="HD28719FD0CCA49DCAB9C1C591A053099"><enum>(D)</enum><header>Map</header><text>The map shall be on file and available for public inspection in appropriate offices of the National Park Service.</text></subparagraph></paragraph>
<paragraph id="H148C698CA8FA4EA1B1E72C64914EF32A"><enum>(2)</enum><header>Boundary</header><text>The historical park shall include the Harriet Tubman Home, the Tubman Home for the Aged, the Thompson Memorial AME Zion Church and Rectory, and associated land, as identified in the area entitled <quote>National Historical Park Proposed Boundary</quote> on the map.</text></paragraph>
<paragraph id="HFEFA2E25EC9F484295185C5ECE5D045C"><enum>(3)</enum><header>Purpose</header><text>The purpose of the historical park is to preserve and interpret for the benefit of present and future generations the historical, cultural, and natural resources associated with the life of Harriet Tubman.</text></paragraph>
<paragraph id="HF5CFCC905CE6420C87933497ADBFF269"><enum>(4)</enum><header>Land acquisition</header><text>The Secretary may acquire land and interests in land within the areas depicted on the map by purchase from a willing seller, donation, or exchange.</text></paragraph></subsection>
<subsection id="HFFBD8B9C657F49B0BD203FDA2E02DA2F"><enum>(c)</enum><header>Administration</header>
<paragraph id="H040EF94DB1664D6CA140F026205DAC1F"><enum>(1)</enum><header>In general</header><text>The Secretary shall administer the historical park in accordance with this section and the laws generally applicable to units of the National Park System, including—</text>
<subparagraph id="H3C2B097FD6184AA59CCCC4D1E26D6426"><enum>(A)</enum><text>the National Park System Organic Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1">16 U.S.C. 1 et seq.</external-xref>); and</text></subparagraph>
<subparagraph id="H056FF21ED1D14C569B7AA2D9DA88D7C5"><enum>(B)</enum><text>the Act of August 21, 1935 (<external-xref legal-doc="usc" parsable-cite="usc/16/461">16 U.S.C. 461 et seq.</external-xref>).</text></subparagraph></paragraph>
<paragraph id="HF885128F945D474EB56EFA6189627E9A"><enum>(2)</enum><header>Interpretive tours</header><text>The Secretary may provide interpretive tours to sites and resources located outside the boundary of the historical park in Auburn, New York, relating to the life of Harriet Tubman.</text></paragraph>
<paragraph id="HD74CFF9522E4430BBD47BF4078D1D936"><enum>(3)</enum><header>Cooperative agreements</header>
<subparagraph id="H023E0AA1CB024FEA9CD2B4E56C62F9E1"><enum>(A)</enum><header>In general</header><text>The Secretary may enter into a cooperative agreement with the owner of any land within the historical park to mark, interpret, or restore nationally significant historic or cultural resources relating to the life of Harriet Tubman, if the agreement provides that—</text>
<clause id="H7E7804ADB40245C39C8B996792526548"><enum>(i)</enum><text>the Secretary shall have the right of access to any public portions of the land covered by the agreement to allow for—</text>
<subclause id="H26011255D882481883CC2D4C1D0B85C7"><enum>(I)</enum><text>access at reasonable times by historical park visitors to the land; and</text></subclause>
<subclause id="H9E91252E452249F9B01C41C50DCD8ED9"><enum>(II)</enum><text>interpretation of the land for the public; and</text></subclause></clause>
<clause id="H34268B1432D8496F99333489F1EFCE8A"><enum>(ii)</enum><text>no changes or alterations shall be made to the land except by mutual agreement of the Secretary and the owner of the land.</text></clause></subparagraph>
<subparagraph id="H4AB5C82E4FD9401A914EF6C756143804"><enum>(B)</enum><header>Research</header><text>The Secretary may enter into a cooperative agreement with the State, political subdivisions of the State, institutions of higher education, the Home and other nonprofit organizations, and individuals to conduct research relating to the life of Harriet Tubman.</text></subparagraph>
<subparagraph id="H3366483459ED460B9A44225D11520185"><enum>(C)</enum><header>Cost-sharing requirement</header>
<clause id="H546345A0766146ADBC8111C82D8B1546"><enum>(i)</enum><header>Federal share</header><text>The Federal share of the total cost of any activity carried out under this paragraph shall not exceed 50 percent.</text></clause>
<clause id="H13D24BC02FB8412DAEE8022CDC36D19D"><enum>(ii)</enum><header>Form of non-Federal share</header><text>The non-Federal share may be in the form of in-kind contributions or goods or services fairly valued.</text></clause></subparagraph>
<subparagraph id="HD30E04108D764F90962639146F8F33C1"><enum>(D)</enum><header>Attorney general</header>
<clause id="H65E48224692D490693E13757D456E634"><enum>(i)</enum><header>In general</header><text>The Secretary shall submit to the Attorney General for review any cooperative agreement under this paragraph involving religious property or property owned by a religious institution.</text></clause>
<clause id="H0B890B1738584BDF91F3ADDF8F45EF9C"><enum>(ii)</enum><header>Finding</header><text>No cooperative agreement subject to review under this subparagraph shall take effect until the date on which the Attorney General issues a finding that the proposed agreement does not violate the Establishment Clause of the first amendment to the Constitution.</text></clause></subparagraph></paragraph></subsection>
<subsection id="HB5B30F2EA6F742A5B8F1BCDA42748FEC"><enum>(d)</enum><header>General management plan</header>
<paragraph id="H923F79B38FC145279CC3E2548C704511"><enum>(1)</enum><header>In general</header><text>Not later than 3 years after the date on which funds are made available to carry out this section, the Secretary shall prepare a general management plan for the historical park in accordance with section 12(b) of the National Park Service General Authorities Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1a">16 U.S.C. 1a–7(b)</external-xref>).</text></paragraph>
<paragraph id="H3A67541FAAC84EAC8949CFCD6E07D440"><enum>(2)</enum><header>Coordination</header><text>The Secretary shall coordinate the preparation and implementation of the management plan with—</text>
<subparagraph id="HCA02E2C6E75C4D1DB7D5E35EAB3891CC"><enum>(A)</enum><text>the Harriet Tubman Underground Railroad National Historical Park established by section 2(b)(1); and</text></subparagraph>
<subparagraph id="H29D71AB2B4CF42A9BC595967504BD00A"><enum>(B)</enum><text>the National Underground Railroad Network to Freedom.</text></subparagraph></paragraph></subsection>
<subsection id="H82FA4830116D4D7494A3811FC69BA919"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as are necessary to carry out this Act, except that not more than $7,500,000 shall be available to provide financial assistance under subsection (c)(3).</text></subsection></section>
