		<section id="H98A2E92295D64F08BC67AFA66C8A7EE0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Grazing Improvement
			 Act</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="HFE4573CD6C4644C0ABBEA381178BD2CD"><enum>2.</enum><header>Terms of grazing permits
			 and leases</header><text display-inline="no-display-inline">Section 402 of the
			 Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1752">43 U.S.C. 1752</external-xref>) is
			 amended—</text>
			<paragraph id="H7B094DF187CC4E718ADB675200399BF8"><enum>(1)</enum><text>by striking <quote>ten
			 years</quote> each place it appears and inserting <quote>20
			 years</quote>;</text>
			</paragraph><paragraph id="HE7343287D40C4F44BE6CE9037C2331A2"><enum>(2)</enum><text>in subsection (b)—</text>
				<subparagraph id="H0F04355489AD4664BAA916246D6CE76D"><enum>(A)</enum><text>by striking
			 <quote>or</quote> at the end of each of paragraphs (1) and (2);</text>
				</subparagraph><subparagraph id="H7A31189BD02B45C48693E5F587C0BA25"><enum>(B)</enum><text>in paragraph (3), by
			 striking the period at the end and inserting <quote>; or</quote>; and</text>
				</subparagraph><subparagraph id="H7DEE06DB90A948C895FAD975B1E598FB"><enum>(C)</enum><text>by adding at the end the
			 following:</text>
					<quoted-block changed="added" committee-id="HII00" display-inline="no-display-inline" id="H6127444996054F63BE5BA5261924AEBE" reported-display-style="italic" style="OLC">
						<paragraph id="H5A1983796DE841D0A7843804C1D453B8"><enum>(4)</enum><text display-inline="yes-display-inline">the initial environmental analysis under
				National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) regarding a
				grazing allotment, permit, or lease has not been
				completed.</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="HC85DE4B15E7A4DFA9645F0EFC41E731E"><enum>(3)</enum><text>after subsection (h),
			 insert the following new subsection:</text>
				<quoted-block changed="added" committee-id="HII00" display-inline="no-display-inline" id="HC0FD16BCB0CD4CEF84A823D731C6A9E8" reported-display-style="italic" style="OLC">
					<subsection id="HCE25C06B0CAD466DA7FBE001EB8C343C"><enum>(i)</enum><text display-inline="yes-display-inline">Only applicants, permittees and lessees
				whose interest in grazing livestock is directly affected by a final grazing
				decision may appeal the decision to an administrative law
				judge.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H65B96278D61A4D858A4F87DEB13BBC8D"><enum>3.</enum><header>Renewal, transfer, and
			 reissuance of grazing permits and leases</header>
			<subsection id="H96200F3580AC448DBAD5F64209E1B865"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline">Title IV of the Federal Land Policy and
			 Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1751">43 U.S.C. 1751 et seq.</external-xref>) is amended by adding at the end
			 the following:</text>
				<quoted-block changed="added" committee-id="HII00" display-inline="no-display-inline" id="H14DBB7F8CADC42EBBE62EFB7B65BEABC" reported-display-style="italic" style="OLC">
					<section id="HB9EA4E9C0C11404380C07F49F8A8370D"><enum>405.</enum><header>Renewal, transfer, and
				reissuance of grazing permits and leases</header>
						<subsection id="HF04381B107E645F493CCD4126F57F22E"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="H27638E89E5464107B7B9CD442EDFF4D9"><enum>(1)</enum><header>Current grazing
				management</header><text display-inline="yes-display-inline">The term
				<term>current grazing management</term> means grazing in accordance with the
				terms and conditions of an existing permit or lease and includes any
				modifications that are consistent with an applicable Department of Interior
				resource management plan or Department of Agriculture land use plan.</text>
							</paragraph><paragraph id="H9DF579407EA04F2BAD3C595DE32BADED"><enum>(2)</enum><header>Secretary
				concerned</header><text>The term <term>Secretary concerned</term> means—</text>
								<subparagraph id="H2CE05BD216804F3691BCF7E83EC17332"><enum>(A)</enum><text>the Secretary of
				Agriculture, with respect to National Forest System land; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE0E837E294B54EBCAFF28D575659A062"><enum>(B)</enum><text>the Secretary of the
				Interior, with respect to land under the jurisdiction of the Department of the
				Interior.</text>
								</subparagraph></paragraph></subsection><subsection id="H384FC4336BA5443CAE7BD5AA2F2CAC65"><enum>(b)</enum><header>Renewal, Transfer,
				reissuance, and pending processing</header><text>A grazing permit or lease
				issued by the Secretary of the Interior, or a grazing permit issued by the
				Secretary of Agriculture regarding National Forest System land, that expires,
				is transferred, or is waived shall be renewed or reissued under, as
				appropriate—</text>
							<paragraph id="HBB5228424D6548918A67F3D79162800E"><enum>(1)</enum><text>section 402;</text>
							</paragraph><paragraph id="HB90D769BA66B486A95747569E49348CB"><enum>(2)</enum><text>section 19 of the Act of
				April 24, 1950 (commonly known as the <quote><act-name>Granger-Thye
				Act</act-name></quote>; <external-xref legal-doc="usc" parsable-cite="usc/16/580l">16 U.S.C. 580l</external-xref>);</text>
							</paragraph><paragraph id="HD166B55FA8CB4196B0BA51E4B7908AA4"><enum>(3)</enum><text>title III of the
				Bankhead-Jones Farm Tenant Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1010">7 U.S.C. 1010 et seq.</external-xref>); or</text>
							</paragraph><paragraph id="HD36DBA7BC29B4190BD83CA3E7E915EC3"><enum>(4)</enum><text>section 510 the
				California Desert Protection Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/16/410aaa-50">16 U.S.C. 410aaa–50</external-xref>).</text>
							</paragraph></subsection><subsection id="HA5F56ED77A45447093D0C1175C59CADE"><enum>(c)</enum><header>Terms;
				conditions</header><text display-inline="yes-display-inline">The terms and
				conditions (except the termination date) contained in an expired, transferred,
				or waived permit or lease described in subsection (b) shall continue in effect
				under a renewed or reissued permit or lease until the date on which the
				Secretary concerned completes the processing of the renewed or reissued permit
				or lease that is the subject of the expired, transferred, or waived permit or
				lease, in compliance with each applicable law.</text>
						</subsection><subsection id="HCD881B2328334D4F81ADF3F501184E31"><enum>(d)</enum><header>Cancellation;
				suspension; modification</header><text display-inline="yes-display-inline">Notwithstanding subsection (c), a permit or
				lease described in subsection (b) may be cancelled, suspended, or modified in
				accordance with applicable law.</text>
						</subsection><subsection id="H3C4DA21D2BCC4FD9898ECCEF918A22E0"><enum>(e)</enum><header>Renewal transfer
				reissuance after processing</header><text>When the Secretary concerned has
				completed the processing of the renewed or reissued permit or lease that is the
				subject of the expired, transferred, or waived permit or lease, the Secretary
				concerned shall renew or reissue the permit or lease for a term of 20 years
				after completion of processing.</text>
						</subsection><subsection id="H04F36C8DF12640AA945E7DF3B43E60C5"><enum>(f)</enum><header>Compliance with
				National Environmental Policy Act of 1969</header><text display-inline="yes-display-inline">The renewal, reissuance, or transfer of a
				grazing permit or lease by the Secretary concerned shall be categorically
				excluded from the requirement to prepare an environmental assessment or an
				environmental impact statement if—</text>
							<paragraph id="HD1F5B39107A843F6928AE522DC461FDB"><enum>(1)</enum><text display-inline="yes-display-inline">the decision continues to renew, reissue,
				or transfer the current grazing management of the allotment;</text>
							</paragraph><paragraph id="HAD75E21E64C94E91B8677D74171B2857"><enum>(2)</enum><text>monitoring of the
				allotment has indicated that the current grazing management has met, or has
				satisfactorily progressed towards meeting, objectives contained in the land use
				and resource management plan of the allotment, as determined by the Secretary
				concerned; or</text>
							</paragraph><paragraph id="H7F356116F908448086F14A46CA7D7DC1"><enum>(3)</enum><text display-inline="yes-display-inline">the decision is consistent with the policy
				of the Department of the Interior or the Department of Agriculture, as
				appropriate, regarding extraordinary circumstances.</text>
							</paragraph></subsection><subsection id="H80AD1BB8F8E24C3DB25ED20A7078B11F"><enum>(g)</enum><header>Priority and timing for
				completing environmental analyses</header><text display-inline="yes-display-inline">The Secretary concerned, in the sole
				discretion of the Secretary concerned, shall determine the priority and timing
				for completing each required environmental analysis regarding any grazing
				allotment, permit, or lease based on the environmental significance of the
				allotment, permit, or lease and available funding for that purpose.</text>
						</subsection><subsection id="H8A033181AD324A94913FCFAFF76D9D34"><enum>(h)</enum><header>NEPA
				exemptions</header><text>The National Environmental Policy Act of 1969 (42
				U.S.C. 4321 et seq.) shall not apply to the following:</text>
							<paragraph id="H10C9A7746BB341D2BF4E2123AB74E14C"><enum>(1)</enum><text>Crossing and trailing
				authorizations of domestic livestock.</text>
							</paragraph><paragraph id="HFDF7150CA80D4B98AC9AB9DFF09892DB"><enum>(2)</enum><text>Transfer of grazing
				preference.</text>
							</paragraph><paragraph id="H9B5A266278C44133873E97110EAC6322"><enum>(3)</enum><text>Range improvements as
				defined under 43 U.S.C. 315c and 16 U.S.C.
				580h.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5ABABF2F52C34652AA3ECA9AA211E7B4"><enum>(b)</enum><header>Table of
			 contents</header><text display-inline="yes-display-inline">The table of
			 contents for the Federal Land Policy and Management Act of 1976 is amended by
			 adding after the item for section 404, the following:</text>
