		  vehicle weight limitations applicable to the Interstate System, and for other

		<section id="HA260A2DF048247A78456AF67547B222C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Safe and Efficient Transportation Act
			 of 2013</short-title></quote>.</text>
		</section><section id="HD597C72CC7A84E1C820E067B8C825E0A"><enum>2.</enum><header>Modernized weight
			 limitations for certain vehicles</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/23/127">Section 127</external-xref> of title 23, United States Code,
			 is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H416AC7ECE54540AABA7A192A50E1D1DA" style="USC">
				<subsection id="H6197149AEE7445EAAA89DA3035147E7C"><enum>(j)</enum><header>Additional
				exception to weight requirements</header>
					<paragraph id="HA2FEB15F09F045B0832AF41206BBEBC5"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Notwithstanding
				subsection (a), a State may authorize a vehicle with a maximum gross weight,
				including all enforcement tolerances, that exceeds the maximum gross weight
				otherwise applicable under subsection (a) to operate on the Interstate System
				routes in the State, if—</text>
						<subparagraph id="H74444BB7F0FC4BEB99C3BA559A43E24A"><enum>(A)</enum><text>the vehicle is
				equipped with at least 6 axles;</text>
						</subparagraph><subparagraph id="H8D5BB13C4E8A46C593B836AA2F48783A"><enum>(B)</enum><text display-inline="yes-display-inline">the weight of any single axle on the
				vehicle does not exceed 20,000 pounds, including enforcement tolerances;</text>
						</subparagraph><subparagraph id="HC403B6D1FCF64715BA5DE381B3078A35"><enum>(C)</enum><text display-inline="yes-display-inline">the weight of any tandem axle on the
				vehicle does not exceed 34,000 pounds, including enforcement tolerances;</text>
						</subparagraph><subparagraph id="H57E3456045394ADE838729A941DE9283"><enum>(D)</enum><text display-inline="yes-display-inline">the weight of any group of 3 or more axles
				on the vehicle does not exceed 51,000 pounds, including enforcement tolerances;
				and</text>
						</subparagraph><subparagraph id="HCFEE71A2382E48F3894C8DC8669CBC0A"><enum>(E)</enum><text>the gross weight
				of the vehicle does not exceed 97,000 pounds, including enforcement
				tolerances.</text>
						</subparagraph></paragraph><paragraph id="H6544F37878504F03AB60E0B7F0EB157C"><enum>(2)</enum><header>Special
				Rules</header>
						<subparagraph id="H4F7E42CF4C17426888DD68A5710C80FE"><enum>(A)</enum><header>Other exceptions
				not affected</header><text display-inline="yes-display-inline">This subsection
				shall not restrict—</text>
							<clause id="H644FDD06E3AE44399B1DBA9339F52A6D"><enum>(i)</enum><text>a
				vehicle that may operate under any other provision of this section or another
				Federal law; or</text>
							</clause><clause id="H04D2E0E864F74C1C8DE290B90E13C339"><enum>(ii)</enum><text>a
				State’s authority with respect to a vehicle that may operate under any other
				provision of this section or another Federal law.</text>
							</clause></subparagraph><subparagraph id="HC2FB732EACFE4A988ECE96092A1CE4F1"><enum>(B)</enum><header>Increase in axle
				weight requirement</header><text display-inline="yes-display-inline">A State
				may authorize a vehicle to exceed the maximum axle weight requirements under
				any one axle grouping in subparagraph (B), (C), or (D) of paragraph (1) by not
				more than 2,000 pounds.</text>
						</subparagraph></paragraph><paragraph id="H51E71C92A5584D698517DB3577D2922E"><enum>(3)</enum><header>State
				authorization</header><text display-inline="yes-display-inline">A State seeking
				to authorize a vehicle to operate on the Interstate System routes within its
				boundaries under paragraph (1) or to increase the maximum axle weight
				requirements under paragraph (2) shall do so pursuant to authority provided
				under the laws of the State.</text>
					</paragraph><paragraph display-inline="no-display-inline" id="HC671C3385ADE4654A92AB2752EA9E5EF"><enum>(4)</enum><header>Reporting
				requirements</header>
						<subparagraph id="HCB67C8EE60B44B0DABD7FA2D4BDDA8D2"><enum>(A)</enum><header>Annual
				report</header><text display-inline="yes-display-inline">If a State authorizes
				vehicles described in paragraph (1) to operate on highway routes in the State
				in a fiscal year, the State shall submit to the Secretary for the fiscal year
				an annual report at such time, in such manner, and containing such information
				as the Secretary may require, including, at a minimum, the following:</text>
							<clause id="HA1D9B6C350D44B20BA7ACCECA126FD81"><enum>(i)</enum><text display-inline="yes-display-inline">An identification of highway routes in the
				State, including routes not on the Interstate System, on which the State
				authorizes vehicles described in paragraph (1) to operate.</text>
							</clause><clause id="H078B0D107A1B44B18B8150B149128E7E"><enum>(ii)</enum><text display-inline="yes-display-inline">A description of the operating requirements
				and gross vehicle weight limits applicable to the vehicles described in
				paragraph (1).</text>
							</clause><clause id="HDBCF9F4D7E644040BC6A71B750455F1C"><enum>(iii)</enum><text display-inline="yes-display-inline">Safety statistics, including estimated
				vehicle miles traveled data, concerning the vehicles described in paragraph
				(1).</text>
							</clause></subparagraph><subparagraph id="H7C4C1D52AB8445808B362354BC9B17F9"><enum>(B)</enum><header>Public
				availability</header><text>The Secretary shall make all information required
				under subparagraph (A) available to the public.</text>
						</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H6A075D6E5BB149F7B0627E578B333A99"><enum>(5)</enum><header>Termination</header><text>The
				Secretary may terminate the operation of vehicles authorized under this
				subsection on a specific Interstate System route segment if the Secretary
				determines that such operation poses an unreasonable safety risk based on an
				engineering analysis or an analysis of safety data or any other applicable data
				the Secretary may use.</text>
					</paragraph><paragraph id="HD9183F55F67B4556B2F903C9DA1A6729"><enum>(6)</enum><header>Waiver of
				highway funding reduction</header><text display-inline="yes-display-inline">Notwithstanding subsection (a), the total
				amount of funds apportioned to a State under section 104(b)(1) for any period
				may not be reduced under subsection (a) if the State authorizes a vehicle
				described in paragraph (1) to operate on the Interstate System in the State in
				accordance with this subsection or subsection (k).</text>
					</paragraph></subsection><subsection id="H028013ACCF7F4308AD6FC5A398B4EE0F"><enum>(k)</enum><header>Vehicles
				lawfully operating on December 31, 2012</header><text>In addition to authority
				otherwise provided to a State under this section, a State may permit a vehicle
				with a gross vehicle weight that could have been lawfully operated on the
				Interstate System in the State on December 31, 2012, to operate on the
				Interstate System in that State upon the date of enactment of this
				subsection.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HAA7943F64778475EA7790EC54089EC93"><enum>3.</enum><header>Safe and
			 efficient vehicle bridge infrastructure improvement program</header>
			<subsection id="HC21704F9472144C59175638FA4831142"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 1 of title
			 23, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HCB1C14BF2933413C88A714EC36C3F254" style="USC">
					<section id="H1AD896EA76564E69AB994EE7CB869A93"><enum>171.</enum><header>Safe and
				efficient vehicle bridge infrastructure improvement program</header>
						<subsection id="HAD8AD5DBEA5A4E32BC9915364F4204E0"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish a safe and
				efficient vehicle bridge infrastructure improvement program in accordance with
				this section.</text>
						</subsection><subsection id="HE64015327D9240E98E7C39BF1B90E55C"><enum>(b)</enum><header>Apportionment of
				funds to eligible States</header>
							<paragraph id="H2D3E766E52B64A26A0B2A5C205C054CA"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">On October 1 of each
				fiscal year, the Secretary shall apportion, in accordance with paragraph (2),
				the sums made available out of the Safe and Efficient Vehicle Trust Fund for
				that fiscal year to carry out this section.</text>
							</paragraph><paragraph id="H0EC6DFD2D78D434A8250617D604FFE00"><enum>(2)</enum><header>Ratio to
				eligible States</header><text display-inline="yes-display-inline">The sums made
				available out of the Safe and Efficient Vehicle Trust Fund shall be apportioned
				among eligible States in a ratio that—</text>
								<subparagraph id="H38409E41F2534A859C637A902D3D63F2"><enum>(A)</enum><text>the total vehicle
				miles traveled on Interstate System highways by vehicles authorized to travel
				on such highways pursuant to section 127(j) in each eligible State, as
				determined by the Secretary; bears to</text>
								</subparagraph><subparagraph id="H5BB5CFE16A22485D8EB48F118F38C3DF"><enum>(B)</enum><text display-inline="yes-display-inline">the total vehicle miles traveled on
				Interstate System highways by vehicles authorized to travel on such highways
				pursuant to section 127(j) in all eligible States, as determined by the
				Secretary.</text>
								</subparagraph></paragraph></subsection><subsection id="H5BFC0BB0FEF14B3FB0AA3C13FCA419EC"><enum>(c)</enum><header>Eligible
				Projects</header><text display-inline="yes-display-inline">An eligible State
				that receives an apportionment in a fiscal year under subsection (b) shall use
				the amounts of the apportionment for bridge projects eligible for assistance
				under this chapter that are located on the Interstate System.</text>
						</subsection><subsection id="HBDF29B1A9D5E451DBFD8E7E0C2535B37"><enum>(d)</enum><header>Contract
				Authority</header><text display-inline="yes-display-inline">Funds made
				available out of the Safe and Efficient Vehicle Trust Fund to carry out this
				section shall be available for obligation in the same manner as if the funds
				were made available from the Highway Trust Fund (other than the Mass Transit
				Account).</text>
						</subsection><subsection id="H1F27A4C833D943BD89DF962783A8186A"><enum>(e)</enum><header>Eligible State
				defined</header><text display-inline="yes-display-inline">In this section, the
				term <term>eligible State</term> means a State that authorizes a vehicle
				described in section 127(j) to operate on the Interstate System within its
				borders.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5ED7D60AB7224C88A2F83A4D7D71F7AB"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The analysis for such chapter is amended by adding at
			 the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HD498C59890E34F189A901FF1F95140F8" style="USC">
					<toc regeneration="no-regeneration">
						<toc-entry level="section">171. Safe and efficient vehicle bridge
				infrastructure improvement
				program.</toc-entry>
					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H5050170E326E46AC99273EEBD180D6AE"><enum>4.</enum><header>Safe and
			 efficient vehicle charges</header>
			<subsection id="HB31C7F4086AD4FEEA5992D05255F9AA2"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subsection (a) of
			 <external-xref legal-doc="usc" parsable-cite="usc/26/4481">section 4481</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H108B52AE35C845538ADA874C5A5BA766" style="OLC">
					<quoted-block-continuation-text quoted-block-continuation-text-level="subsection">In the
				case of the use of any highway motor vehicle described in section 127(j) of
				title 23, United States Code, if that vehicle is used on the Interstate System
				with a gross weight in excess of 80,000 pounds, in lieu of the rate in the
				table, the rate shall be equal to the lesser of—</quoted-block-continuation-text><paragraph id="H8E5DF5478681465C9C96DD11E5A103EA"><enum>(1)</enum><text>$100 per year,
				plus $22 for each 1,000 pounds (or fraction thereof) in excess of 55,000
				pounds, or</text>
					</paragraph><paragraph id="H3DAAC4A814804490B91ED630BE7D5156"><enum>(2)</enum><text>$800 per
				year.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HA6E12C9C00C44B128EE223701E4C61E0"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by this section shall apply to taxable
			 periods beginning after the date of the enactment of this Act.</text>
			</subsection></section><section id="H0F494CE86F2D445A9AF7AC68BD62A2D1"><enum>5.</enum><header>Safe and
			 Efficient Vehicle Trust Fund</header>
			<subsection id="HBF0F5A38392F4F68912F359758AE213F"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subchapter A of
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/98">chapter 98</external-xref> of the Internal Revenue Code of 1986 (relating to the trust fund
			 code) is amended by adding at the end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H74AB7BF8C064451C95E6934F794F161F" style="OLC">
					<section id="HA22E5D111B334C7B8DE1EDF036EAE950"><enum>9512.</enum><header>Safe and
				Efficient Vehicle Trust Fund</header>
						<subsection id="H317598264CC4422A9C207CC32A42351E"><enum>(a)</enum><header>Creation of
				fund</header><text display-inline="yes-display-inline">There is hereby
				established in the Treasury of the United States a fund to be known as the
				<quote>Safe and Efficient Vehicle Trust Fund</quote>, consisting of such
				amounts as may be—</text>
							<paragraph id="H09A956EC1B0E45569B30F6F701202BFA"><enum>(1)</enum><text>appropriated to
				the Safe and Efficient Vehicle Trust Fund as provided in this section,
				or</text>
							</paragraph><paragraph id="HF007373CB6484B7EAA3E508526490064"><enum>(2)</enum><text display-inline="yes-display-inline">credited to the Safe and Efficient Vehicle
				Trust Fund as provided in section 9602(b).</text>
							</paragraph></subsection><subsection id="HDEF323066F224D34ACCF6A87A706C1D6"><enum>(b)</enum><header>Transfer to Safe
				and Efficient Vehicle Trust Fund of amounts equivalent to certain
				taxes</header><text display-inline="yes-display-inline">There are hereby
				appropriated to the Safe and Efficient Vehicle Trust Fund amounts equivalent to
				the taxes received in the Treasury under section 4481(a) which are attributable
				to the use of any highway motor vehicle described in section 127(j) of title
				23, United States Code, if that vehicle is used on the Interstate System with a
				gross weight in excess of 80,000 pounds.</text>
						</subsection><subsection id="H87BED87FFD094AC5B9E3F05CF5E3F88B"><enum>(c)</enum><header>Expenditures
				from Safe and Efficient Vehicle Trust Fund</header><text display-inline="yes-display-inline">Amounts in the Safe and Efficient Vehicle
				Trust Fund shall be available, as provided by appropriations Acts, for fiscal
				years beginning 1 year after the date of the enactment of this section for
				projects eligible for assistance under <external-xref legal-doc="usc" parsable-cite="usc/23/171">section 171(c)</external-xref> of title 23, United
				States
				Code.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H4E4C4E08610544D487C1E2956A806262"><enum>(b)</enum><header>Conforming
			 amendments</header>
				<paragraph id="HF847B0B9D94E4112860E6391894FE23B"><enum>(1)</enum><text>Paragraph (1) of
			 section 9503(b) of such Code is amended by striking the period at the end and
			 inserting <quote>, and taxes received under section 4481 shall be determined
			 without regard to those received in the Treasury under section 4481(a) which
			 are attributable to the use of any highway motor vehicle described in section
			 127(j) of title 23, United States Code, if that vehicle is used on the
			 Interstate System with a gross weight in excess of 80,000
			 pounds.</quote>.</text>
				</paragraph><paragraph id="H7C59FC29B9354E2E9E88B294B67D7DCB"><enum>(2)</enum><text display-inline="yes-display-inline">The table of sections for subchapter A of
			 chapter 98 of such Code is amended by adding at the end the following:</text>

							<toc-entry level="section">Sec. 9512. Safe and Efficient Vehicle

				</paragraph></subsection><subsection id="H3497724DFBF64384B692E1FE9A7E906B"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on the
			 date of the enactment of this Act.</text>
