		<official-title>To amend the Federal Water Pollution Control Act to
		  provide assistance for nutrient removal technologies to States in the Great
		  Lakes System.</official-title>

		<section id="HEE626CBB0F214B55A3ACC84FC3D61114" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Great Lakes Nutrient Removal
			 Assistance Act</short-title></quote>.</text>
		</section><section id="HFF5E49398C3246B5BA099282ACAABAE1"><enum>2.</enum><header>Findings and
			 purposes</header>
			<subsection id="H1C14572C958A40D18E0B749089EDAF5E"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds that—</text>
				<paragraph id="H9F4D2F947F854F4AB8A0566B528453B6"><enum>(1)</enum><text>ineffective
			 wastewater treatment is one of the most common sources of water
			 pollution;</text>
				</paragraph><paragraph id="HFD414FD66FE74875BFECC4DBEA227604"><enum>(2)</enum><text>nutrient
			 pollution, particularly phosphorus loading, continues to be one of the most
			 significant water quality issues facing the Great Lakes System;</text>
				</paragraph><paragraph id="HAB83FA1C50EF4C8A851EDE492064CABF"><enum>(3)</enum><text display-inline="yes-display-inline">limiting phosphorus loads is key to
			 controlling excessive algal growth, and a coordinated Great Lakes System-wide
			 strategy to change how nutrients are discharged is urgent; and</text>
				</paragraph><paragraph id="H5E1902A1E3CF45A096AE099472EFCA57"><enum>(4)</enum><text>nutrient removal
			 technology is one of the most reliable, cost effective, and direct methods for
			 reducing the flow of phosphorus and other harmful nutrients from point sources
			 in the Great Lakes System.</text>
				</paragraph></subsection><subsection id="HB84351FDFC4C435087F57AAEDA523149"><enum>(b)</enum><header>Purposes</header><text>The
			 purposes of this Act are—</text>
				<paragraph id="H2B48EED260644D34A328A329CAD92F4F"><enum>(1)</enum><text>to authorize the
			 Administrator of the Environmental Protection Agency to provide financial
			 assistance to Great Lakes States and municipalities for use in upgrading
			 publically owned wastewater treatment plants in the Great Lakes System with
			 nutrient removal technologies; and</text>
				</paragraph><paragraph id="HBCE7E0F3C7B749A79B3267C31B4578F5"><enum>(2)</enum><text>to further the
			 goal of restoring the water of the Great Lakes System to conditions that are
			 protective of human health and aquatic life.</text>
				</paragraph></subsection></section><section id="H1A5F587495804ABFA5DC6D3B3EF124A5"><enum>3.</enum><header>Sewage control
			 technology grant program</header><text display-inline="no-display-inline">The
			 Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) is amended by
			 adding at the end the following:</text>

				<title id="HD5CE7426E1F14D08ACC2F2297E7C1577"><enum>VII</enum><header>MISCELLANEOUS</header>
					<section id="H8681146B6853434D890B765A822B538E"><enum>701.</enum><header>Sewage control
				technology grant program</header>
						<subsection id="HDEE8CE9B4AF84211AC623355EBEDE327"><enum>(a)</enum><header>Grant
				program</header>
							<paragraph id="H85E76816DEEE4CA4A54040012590F64D"><enum>(1)</enum><header>Establishment</header><text>Not
				later than 1 year after the date of enactment of this section, the
				Administrator shall establish a program within the Environmental Protection
				Agency to provide grants to Great Lakes States, and municipalities thereof, to
				upgrade eligible facilities with nutrient removal technologies.</text>
							</paragraph><paragraph id="HC44B17A79AF24618B44B50F3D951844B"><enum>(2)</enum><header>Priority</header><text>In
				providing a grant under paragraph (1), the Administrator shall—</text>
								<subparagraph id="HD2D803B38B1945179667EAFC3A6F9787"><enum>(A)</enum><text display-inline="yes-display-inline">consult with the Program Office; and</text>
								</subparagraph><subparagraph id="H1BC73E532A1F417F927594A98A931721"><enum>(B)</enum><text>give priority to
				eligible facilities at which nutrient removal technology upgrades would—</text>
									<clause id="H02965E79850248AEA9D5596668620811"><enum>(i)</enum><text>produce the
				greatest nutrient load reductions at points of discharge;</text>
									</clause><clause id="HCF3C05D122EA4BC5A5307ABE79F5052C"><enum>(ii)</enum><text display-inline="yes-display-inline">result in the greatest environmental
				benefits to the Great Lakes System; and</text>
									</clause><clause commented="no" id="H5AA452721E454D9EA232FADF46FD193F"><enum>(iii)</enum><text display-inline="yes-display-inline">help meet the objectives related to
				nutrients outlined in Annex 4 of the 2012 Great Lakes Water Quality
				Agreement.</text>
									</clause></subparagraph></paragraph><paragraph id="H78066366FD0F49E1AE5282216939FDB0"><enum>(3)</enum><header>Application</header>
								<subparagraph id="H842654E0AA6D43EBBCF02AD082D5DFA2"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">On receipt of an
				application from a State or municipality for a grant under this section, if the
				Administrator approves the request, the Administrator shall transfer to the
				State or municipality the amount of assistance determined necessary by the
				Administrator, in consultation with the Program Office, to carry out the
				facility upgrades that are the subject of the application.</text>
								</subparagraph><subparagraph id="HB8A4AA840B6B4AE7A53521C339E111AB"><enum>(B)</enum><header>Form</header><text>An
				application submitted by a State or municipality under subparagraph (A) shall
				be in such form and shall include such information as the Administrator may
				prescribe.</text>
								</subparagraph></paragraph><paragraph id="HE5AB53950FDC4D4783F9ADD3AF5094DA"><enum>(4)</enum><header>Use of
				funds</header><text>A State or municipality that receives a grant under this
				section shall use the grant to upgrade eligible facilities with nutrient
				removal technologies that are designed to reduce total nutrients in discharged
				wastewater.</text>
							</paragraph><paragraph id="H60D40B042E3A47F1A6C5794B35C8DBCB"><enum>(5)</enum><header>Cost
				sharing</header>
								<subparagraph id="H2C135C5301F04DC19D91632C5205F9BE"><enum>(A)</enum><header>Federal
				share</header><text>The Federal share of the cost of upgrading any eligible
				facility as described in paragraph (1) using funds provided under this section
				shall not exceed 55 percent.</text>
								</subparagraph><subparagraph id="H1E3B97A5994C4CD08B87DE0E87B331F0"><enum>(B)</enum><header>Non-Federal
				share</header><text display-inline="yes-display-inline">The non-Federal share
				of the costs of upgrading any eligible facility as described in paragraph (1)
				using funds provided under this section may be provided in the form of funds
				made available to a State or municipality under—</text>
									<clause id="HA30A214EDE094BD0AE35CF294625A0CC"><enum>(i)</enum><text display-inline="yes-display-inline">any provision of this Act other than this
				section (including funds made available from a State water pollution control
				revolving fund established under title VI); or</text>
									</clause><clause id="HA601B57DDD99472B899ACA10C9C4B6A1"><enum>(ii)</enum><text>any other Federal
				or State law.</text>
									</clause></subparagraph></paragraph></subsection><subsection id="H2BC37415CD7B4EF895C63A8E05D5DDE9"><enum>(b)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="HAA72F31D40594BF682E9397D57D6A5AA"><enum>(1)</enum><header>2012 Great Lakes
				Water Quality Agreement</header><text display-inline="yes-display-inline">The
				term <term>2012 Great Lakes Water Quality Agreement</term> means the Great
				Lakes Water Quality Protocol of 2012, signed at Washington on September 7, 2012
				(further amending the Agreement between the United States of America and Canada
				on Great Lakes Water Quality, 1978, signed at Ottawa on November 22, 1978).</text>
							</paragraph><paragraph id="H61C9E0277F6045B18FF5559C36A4F051"><enum>(2)</enum><header>Eligible
				facility</header><text>The term <term>eligible facility</term> means a
				municipal wastewater treatment plant that—</text>
								<subparagraph id="H0FE374EB2FB3489D8A3E3284C28D26D6"><enum>(A)</enum><text>as of the date of
				enactment of this section, has a permitted design capacity to treat an annual
				average of at least 500,000 gallons of wastewater per day; and</text>
								</subparagraph><subparagraph id="H5111007510CD4A18AD0D8769D7C19483"><enum>(B)</enum><text>is located within
				the Great Lakes System in any of the Great Lakes States.</text>
								</subparagraph></paragraph><paragraph id="HEA0512790C4F4974A1759E79C1573751"><enum>(3)</enum><header>Great Lakes
				States; Great Lakes System</header><text>The terms <term>Great Lakes
				States</term> and <term>Great Lakes System</term> have the meanings given those
				terms in section 118.</text>
							</paragraph><paragraph id="H55244575ED8E452D9EB265D7CD4E6640"><enum>(4)</enum><header>Program
				Office</header><text display-inline="yes-display-inline">The term <term>Program
				Office</term> means the Great Lakes National Program Office established by
				section 118(b).</text>
							</paragraph></subsection><subsection id="H239519FB1F6C4B42BF09BA33794EEDB6"><enum>(c)</enum><header>Authorization of
				appropriations</header>
							<paragraph id="HC2B001BE4F234BD5AC07F7ADD4BF15DF"><enum>(1)</enum><header>In
				general</header><text>There is authorized to be appropriated to carry out this
				section $100,000,000 for each of fiscal years 2013 through 2017. Such sums
				shall remain available until expended.</text>
							</paragraph><paragraph id="H8EE51794596F486CBBE7A9DF18C63925"><enum>(2)</enum><header>Administrative
				costs</header><text>The Administrator may use not to exceed 4 percent of any
				amount made available under paragraph (1) to pay administrative costs incurred
				in carrying out this
				section.</text>
