		<official-title display="yes">To amend title 38, United States Code, to
		  provide for annual cost-of-living adjustments to be made automatically by law
		  each year in the rates of disability compensation for veterans with
		  service-connected disabilities and the rates of dependency and indemnity
		  compensation for survivors of certain service-connected disabled veterans, and
		  for other purposes.</official-title>

		<section id="H77079901764D4B469851D1629D10AFDC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>American Heroes COLA
			 Act</short-title></quote> .</text>
		</section><section id="HE70964128E894F44851D9FE67D2A8E69"><enum>2.</enum><header>Automatic annual
			 increase in rates of disability compensation and dependency and indemnity
			 compensation</header>
			<subsection id="H3ED26F1EA71D4EF08755B42C71CBED0D"><enum>(a)</enum><header>Indexing to
			 social security increases</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/5312">Section 5312</external-xref> of title 38, United
			 States Code, is amended by adding at the end the following new
			 subsection:</text>
				<quoted-block id="H1ECECFF0C0EF484FB8C7D5D08D1EE146" style="OLC">
					<subsection id="H4C88A49C6E0D45218E1991E560BC9D08"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HA5B6AA016EFC428AA06C6270838A8E04"><enum>(1)</enum><text display-inline="yes-display-inline">Whenever there is an increase in benefit
				amounts payable under title II of the Social Security Act (42 U.S.C. 401 et
				seq.) as a result of a determination made under section 215(i)
				of such Act (42
				U.S.C. 415(i)), the Secretary shall, effective on the date of
				such increase in benefit amounts, increase the dollar amounts in effect for the
				payment of disability compensation and dependency and indemnity compensation by
				the Secretary, as specified in paragraph (2), as such amounts were in effect
				immediately before the date of such increase in benefit amounts payable under
				title II of the Social Security Act, by the same percentage as the percentage
				by which such benefit amounts are increased, but only if such percentage
				increase is calculated using the Bureau of Labor Statistics Consumer Price
				Index for Urban Wage Earners and Clerical Workers.</text>
						</paragraph><paragraph display-inline="no-display-inline" id="H99F29B31D5B74AA9AAF8E68ACD845ADA" indent="up1"><enum>(2)</enum><text>The dollar amounts to be increased
				pursuant to paragraph (1) are the following:</text>
							<subparagraph id="H32DEDC172FC84E26B7F2418584233063"><enum>(A)</enum><header>Wartime disability
				compensation</header><text>Each of the dollar amounts in effect under
				section
				1114 of this title.</text>
							</subparagraph><subparagraph id="H512CA5CCEE3040258BA3B606E1E937D8"><enum>(B)</enum><header>Additional compensation for
				dependents</header><text>Each of the dollar amounts in effect under
				section
				1115(1) of this title.</text>
							</subparagraph><subparagraph id="H185965F16C9142B4832AAB60B922C1B3"><enum>(C)</enum><header>Clothing allowance</header><text>The
				dollar amount in effect under
				section
				1162 of this title.</text>
							</subparagraph><subparagraph id="H69D667E9F82044658BA90DEC2948F34E"><enum>(D)</enum><header>Dependency and indemnity
				compensation to surviving spouse</header><text>Each of the dollar amounts in
				effect under subsections (a) through (d) of
				section
				1311 of such title.</text>
							</subparagraph><subparagraph id="HF23A265E7AC54B7FB76A7D984E24A3BC"><enum>(E)</enum><header>Dependency and indemnity
				compensation to children</header><text>Each of the dollar amounts in effect
				under sections
				1313(a) and
				1314
				of such title.</text>
							</subparagraph></paragraph><paragraph id="H2FE86EE0E80A4B879B0319A5F9F0DE79" indent="up1"><enum>(3)</enum><text>Whenever there is an increase under
				paragraph (1) in amounts in effect for the payment of disability compensation
				and dependency and indemnity compensation, the Secretary shall publish such
				amounts, as increased pursuant to such paragraph, in the Federal Register at
				the same time as the material required by section 215(i)(2)(D) of the Social
				Security Act (42
				U.S.C. 415(i)(2)(D)) is published by reason of a determination
				under section 215(i) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/415">42 U.S.C. 415(i)</external-xref>).</text>
						</paragraph><paragraph commented="no" id="H6D4CDE284A10499AB884B1D5D9CD5231" indent="up1"><enum>(4)</enum><text>During the period beginning on the
				date of the enactment of this subsection and ending on September 30, 2018, each
				dollar amount increased under paragraph (1), if not a whole dollar amount,
				shall be rounded to the next lower whole dollar amount.</text>
						</paragraph><paragraph commented="no" id="H8AB13653B0EA4D2295F9905351501EC3" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">The Secretary of Veterans Affairs may
				adjust administratively, consistent with the increases made under subsection
				(a), the rates of disability compensation payable to persons under section 10
				of Public Law
				85–857 (72 Stat. 1263) who have not received compensation under
				chapter 11 of this
				title.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HCEEC3EB3B49D41729B1A8F81C1B2153C"><enum>(b)</enum><header>Effective
			 date</header><text>Subsection (d) of
			 section
			 5312 of title 38, United States Code, as added by subsection
			 (a) of this section, shall take effect on December 1, 2014.</text>
			</subsection></section><section id="H5C267017F3A248E7966E7D11BDDA6352"><enum>3.</enum><header>Increase in rate
			 of special monthly compensation for severely injured veterans</header>
			<subsection id="H24FFEE75220A4107923A50E8B76B5E1F"><enum>(a)</enum><header>Increase</header>
				<paragraph id="H912E616618F5480F8105B33E9BD9B7F2"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1114(r) of
			 title 38, United States Code, is amended—</text>
					<subparagraph id="HD3369F7F372B41B195904FAD09886335"><enum>(A)</enum><text>in paragraph (1),
			 by striking <quote>$2,002</quote> and inserting <quote>$3,163</quote>;
			 and</text>
					</subparagraph><subparagraph id="H9F05D9F6B2404F30B26E6E12B706BCE9"><enum>(B)</enum><text>in paragraph (2),
			 by striking <quote>$2,983</quote> and inserting <quote>$4,713</quote>.</text>
					</subparagraph></paragraph><paragraph id="H7FE94889855F43568B411DC11B9649F4"><enum>(2)</enum><header>Effective
			 date</header><text>The amendments made by paragraph (1) shall take effect on
			 December 1, 2014.</text>
				</paragraph></subsection><subsection id="HB331F640A3804799B775E32BB451EC43"><enum>(b)</enum><header>Temporary
			 rates</header><text display-inline="yes-display-inline">During the period
			 beginning on December 1, 2014, and ending on September 30, 2018,
			 section
			 1114(r) of title 38, United States Code, as amended by
			 subsection (a), shall be applied—</text>
				<paragraph id="H132132C2CFB0492982489AE91927D161"><enum>(1)</enum><text>in paragraph (1),
			 by substituting <quote>$2,742</quote> for <quote>$3,163</quote>; and</text>
				</paragraph><paragraph id="HD5E3C95D0BE546749C12D94CC7AB9F81"><enum>(2)</enum><text>in paragraph (2),
			 by substituting <quote>$4085</quote> for <quote>$4,713</quote>.</text>
				</paragraph></subsection></section></legis-body>
