		<section id="H1040C0E5F64248159C71CCA124E54E16" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Rio Grande del Norte National
			 Conservation Area Establishment Act</short-title></quote>.</text>
		</section><section id="HAB64CB2C185F4D0386B82BEC0CE316F8"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H7A8A764B8BE94DFB9BEB2BF8229FC379"><enum>(1)</enum><header>Conservation
			 area</header><text>The term <term>Conservation Area</term> means the Rio Grande
			 del Norte National Conservation Area established by section 3(a)(1).</text>
			</paragraph><paragraph id="H37E652D59EC34DD994F11FCA8A34DDAC"><enum>(2)</enum><header>Land grant
			 community</header><text>The term <term>land grant community</term> means a
			 member of the Board of Trustees of confirmed or nonconfirmed community land
			 grants within the Conservation Area.</text>
			</paragraph><paragraph id="HBB530CE66DF6432BA0EAEBF945BBC269"><enum>(3)</enum><header>Management
			 plan</header><text>The term <term>management plan</term> means the management
			 plan for the Conservation Area developed under section 3(d).</text>
			</paragraph><paragraph id="H68D003C3FE4A47C38CBC1735AAD026D1"><enum>(4)</enum><header>Map</header><text>The
			 term <term>map</term> means the map entitled <quote>Rio Grande del Norte
			 National Conservation Area</quote> and dated November 4, 2009.</text>
			</paragraph><paragraph id="HB422BAEC567E4212A75F7BF7761F4780"><enum>(5)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="H2CB174FEB91042FEBE5B6C96B02C4C3D"><enum>(6)</enum><header>State</header><text>The
			 term <term>State</term> means the State of New Mexico.</text>
			</paragraph></section><section id="H6FD5F7101E3B41DF8A631305DE26B6CF"><enum>3.</enum><header>Establishment of
			 national conservation area</header>
			<subsection id="H21FA92F9DE27487C9EC2AE527F796F56"><enum>(a)</enum><header>Establishment</header>
				<paragraph id="H2E647787F1CD43F9AA2F1827F0405E48"><enum>(1)</enum><header>In
			 general</header><text>There is established the Rio Grande del Norte National
			 Conservation Area in the State.</text>
				</paragraph><paragraph id="HD680420CC92D49FEA0419AAA4AD9B8F7"><enum>(2)</enum><header>Area
			 included</header><text>The Conservation Area shall consist of approximately
			 235,980 acres of public land in Taos and Rio Arriba counties in the State, as
			 generally depicted on the map.</text>
				</paragraph></subsection><subsection id="H598FBA890AE348D3A7D2AE8D36DC814F"><enum>(b)</enum><header>Purposes</header><text>The
			 purposes of the Conservation Area are to conserve, protect, and enhance for the
			 benefit and enjoyment of present and future generations the cultural,
			 traditional, archaeological, natural, ecological, geological, historical,
			 wildlife, educational, recreational, and scenic resources of the Conservation
			 Area.</text>
			</subsection><subsection id="HABE49BB82B724A4583E7DC297EB79D36"><enum>(c)</enum><header>Management</header>
				<paragraph id="HD9692C07598041F0A42CE5201A8F57E2"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall manage the Conservation Area—</text>
					<subparagraph id="H5E2D39A5E27E4A1FBBF1D50E69B74983"><enum>(A)</enum><text>in a manner that
			 conserves, protects, and enhances the resources of the Conservation Area;
			 and</text>
					</subparagraph><subparagraph id="HAD754511D7204983868FB132397A2363"><enum>(B)</enum><text>in accordance
			 with—</text>
						<clause id="HA04619A2441C4B07AADCF4EEB8C23409"><enum>(i)</enum><text>the
			 Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>);</text>
						</clause><clause id="HA0B8C2E6932346B0AF11B0300A94AB45"><enum>(ii)</enum><text>this Act;
			 and</text>
						</clause><clause id="H4020ACF5498E4318A3801B7621978F8E"><enum>(iii)</enum><text>any other
			 applicable laws.</text>
						</clause></subparagraph></paragraph><paragraph id="H5DA90A3A0CC749F4B50972516F54A6A1"><enum>(2)</enum><header>Uses</header>
					<subparagraph id="H74F97C22F540468FBF32FD49CE4424CC"><enum>(A)</enum><header>In
			 general</header><text>The Secretary shall allow only such uses of the
			 Conservation Area that the Secretary determines would further the purposes
			 described in subsection (b).</text>
					</subparagraph><subparagraph id="H0FF77861EC84407CA7CD8A8B3510F95D"><enum>(B)</enum><header>Use of motorized
			 vehicles</header>
						<clause id="H585F7913C60D4BFFBAD9F3574B10A5D9"><enum>(i)</enum><header>In
			 general</header><text>Except as needed for administrative purposes or to
			 respond to an emergency, the use of motorized vehicles in the Conservation Area
			 shall be permitted only on roads designated for use by motorized vehicles in
			 the management plan.</text>
						</clause><clause id="HE0CF283AE1254EC0B1B179E5FF32D4ED"><enum>(ii)</enum><header>New
			 roads</header><text>No additional road shall be built within the Conservation
			 Area after the date of enactment of this Act unless the road is needed for
			 public safety or natural resource protection.</text>
						</clause></subparagraph><subparagraph id="H54D5488E8BCB49DAAEE6AD359DDDC669"><enum>(C)</enum><header>Grazing</header><text>The
			 Secretary shall permit grazing within the Conservation Area, where established
			 before the date of enactment of this Act—</text>
						<clause id="H2CADC4AF5A624C2FB41B0700243F010F"><enum>(i)</enum><text>subject to all
			 applicable laws (including regulations) and Executive orders; and</text>
						</clause><clause id="HE3BC39CBE774436FA3CB3FCCA0939459"><enum>(ii)</enum><text>consistent with
			 the purposes described in subsection (b).</text>
						</clause></subparagraph><subparagraph id="H89D9F73648694C3FB060C9AD74EF6C03"><enum>(D)</enum><header>Collection of
			 piÑon nuts, firewood, medicinal plants and herbs</header><text>Nothing in this
			 section precludes the traditional collection of firewood, medicinal plants and
			 herbs, and piñon nuts in the Conservation Area for noncommercial personal
			 use—</text>
						<clause id="H29ED7CDB8EDB402189ED8D62CAE0DCBA"><enum>(i)</enum><text>in
			 accordance with any applicable laws; and</text>
						</clause><clause id="HAA7E900AF19A4F7A8F89BF08322766DD"><enum>(ii)</enum><text>subject to such
			 terms and conditions as the Secretary determines to be appropriate.</text>
						</clause></subparagraph><subparagraph id="H92F83FCB6CE24212AC60983FD048EF3F"><enum>(E)</enum><header>Utility
			 right-of-way upgrades</header><text>Nothing in this section precludes the
			 Secretary from renewing or authorizing the upgrading (including widening) of an
			 existing utility right-of-way through the Conservation Area in a manner that
			 minimizes harm to the purposes of the Conservation Area described in subsection
			 (b)—</text>
						<clause id="H93DB6705670846C994DF1B4F21713E4C"><enum>(i)</enum><text>in
			 accordance with—</text>
							<subclause id="HC97C9F39303245ADA17312FFBE5215E5"><enum>(I)</enum><text>the National
			 Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>); and</text>
							</subclause><subclause id="HDE38FB610D204F06A04AB3F62457C321"><enum>(II)</enum><text>any other
			 applicable law; and</text>
							</subclause></clause><clause id="HB38622B6898E4A92A0CF34FD2836A7CD"><enum>(ii)</enum><text>subject to such
			 terms and conditions as the Secretary determines to be appropriate.</text>
						</clause></subparagraph><subparagraph id="H5D287FC9529E4F8DAECB514A2FA6B0A2"><enum>(F)</enum><header>Tribal cultural
			 uses</header>
						<clause id="H1E207B572EFF4EA880CCEC58D18E3A25"><enum>(i)</enum><header>Access</header><text>The
			 Secretary shall, in consultation with Indian tribes or pueblos—</text>
							<subclause id="HEFF923A5B6FE4FC8A9AA0F03DB482A89"><enum>(I)</enum><text>ensure the
			 protection of religious and cultural sites in the Conservation Area; and</text>
							</subclause><subclause id="H1DEE835CEFB945ED8C471DB438076419"><enum>(II)</enum><text>provide access to
			 the sites by members of Indian tribes or pueblos for traditional cultural and
			 customary uses, consistent with <external-xref legal-doc="public-law" parsable-cite="pl/95/341">Public Law 95–341</external-xref> (commonly known as the
			 <quote>American Indian Religious Freedom Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/42/1996">42 U.S.C. 1996</external-xref>).</text>
							</subclause></clause><clause id="H7C952FDFFBDB4CD2865C9B1EF90F755C"><enum>(ii)</enum><header>Temporary
			 closures</header><text>In accordance with <external-xref legal-doc="public-law" parsable-cite="pl/95/341">Public Law 95–341</external-xref> (commonly known as
			 the <quote>American Indian Religious Freedom Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/42/1996">42 U.S.C. 1996</external-xref>), the
			 Secretary, on request of an Indian tribe or pueblo, may temporarily close to
			 general public use one or more specific areas of the Conservation Area in order
			 to protect traditional cultural and customary uses in those areas by members of
			 the Indian tribe or the pueblo.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H9EA0AB1F6A6A40C3960EEF0DE5B536B3"><enum>(d)</enum><header>Management
			 plan</header>
				<paragraph id="H17A537DB38634A2696C7CB8D04C3B10B"><enum>(1)</enum><header>In
			 general</header><text>Not later than 3 years after the date of enactment of
			 this Act, the Secretary shall develop a management plan for the Conservation
			 Area.</text>
				</paragraph><paragraph id="H1B93119B7C484D4F933C4D8B5C3B025E"><enum>(2)</enum><header>Other
			 plans</header><text>To the extent consistent with this Act, the plan may
			 incorporate in the management plan the Rio Grande Corridor Management Plan in
			 effect on the date of enactment of this Act.</text>
				</paragraph><paragraph id="HA336466D1F674B4F95F0572120401110"><enum>(3)</enum><header>Consultation</header><text>The
			 management plan shall be developed in consultation with—</text>
					<subparagraph id="HB1D275B3C8F449BAB3C1A6052523AE49"><enum>(A)</enum><text>State and local
			 governments;</text>
					</subparagraph><subparagraph id="H51EF2C6F29044DC79BE202F68F4D6CCB"><enum>(B)</enum><text>tribal
			 governmental entities;</text>
					</subparagraph><subparagraph id="H2B6CFDA0125842308EC6EDE08201DA81"><enum>(C)</enum><text>land grant
			 communities; and</text>
					</subparagraph><subparagraph id="H64DD86E499804A93931595123837CA26"><enum>(D)</enum><text>the public.</text>
					</subparagraph></paragraph><paragraph id="H97A9EB07450D403A987390F3610ED907"><enum>(4)</enum><header>Considerations</header><text>In
			 preparing and implementing the management plan, the Secretary shall consider
			 the recommendations of Indian tribes and pueblos on methods for—</text>
					<subparagraph id="H815766B33EB94B949EBBD2007CF66D0F"><enum>(A)</enum><text>ensuring access to
			 religious and cultural sites;</text>
					</subparagraph><subparagraph id="H8D007D1AC94D4A8EBD9B6AE192D23F9C"><enum>(B)</enum><text>enhancing the
			 privacy and continuity of traditional cultural and religious activities in the
			 Conservation Area; and</text>
					</subparagraph><subparagraph id="HDA39D2FEC3294550950D9D03AD818919"><enum>(C)</enum><text>protecting
			 traditional cultural and religious sites in the Conservation Area.</text>
					</subparagraph></paragraph></subsection><subsection id="H7769E8D1C87E425783782E1EE31A601F"><enum>(e)</enum><header>Incorporation of
			 acquired land and interests in land</header><text>Any land that is within the
			 boundary of the Conservation Area that is acquired by the United States
			 shall—</text>
				<paragraph id="H85D41C28261B4752AC7814B8C1F7B791"><enum>(1)</enum><text>become part of the
			 Conservation Area; and</text>
				</paragraph><paragraph id="H58BFEAD874E4496A8F35330E1B4AFDF7"><enum>(2)</enum><text>be managed in
			 accordance with—</text>
					<subparagraph id="HEDA48B64F8DC478B90D2F1FED7FD3648"><enum>(A)</enum><text>this Act;
			 and</text>
					</subparagraph><subparagraph id="H964833EC7D0842828D824D8F38F1856B"><enum>(B)</enum><text>any other
			 applicable laws.</text>
					</subparagraph></paragraph></subsection><subsection id="H85869A6E5AB147C89B7F7681E25EF0CF"><enum>(f)</enum><header>Special
			 management areas</header>
				<paragraph id="H0AA7672FA06A4F79B5540E6C80E7AA2B"><enum>(1)</enum><header>In
			 general</header><text>The establishment of the Conservation Area shall not
			 change the management status of any area within the boundary of the
			 Conservation Area that is—</text>
					<subparagraph id="HD6BE41B92DA546E19C013DA56B6B86DC"><enum>(A)</enum><text>designated as a
			 component of the National Wild and Scenic Rivers System under the Wild and
			 Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1271">16 U.S.C. 1271 et seq.</external-xref>); or</text>
					</subparagraph><subparagraph id="H1284F9EDF83140A7ACB4AF141742EC31"><enum>(B)</enum><text>managed as an area
			 of critical environmental concern.</text>
					</subparagraph></paragraph><paragraph id="H209F2C46E8814511884060818EC8A486"><enum>(2)</enum><header>Conflict of
			 laws</header><text>If there is a conflict between the laws applicable to the
			 areas described in paragraph (1) and this Act, the more restrictive provision
			 shall control.</text>
				</paragraph></subsection></section><section id="HACD0F4591AB44F71BB8072AA51C6DAB3"><enum>4.</enum><header>Designation of
			 wilderness areas</header>
			<subsection id="H546531CBADF9456DACC524078A945D4E"><enum>(a)</enum><header>In
			 general</header><text>In accordance with the Wilderness Act (16 U.S.C. 1131 et
			 seq.), the following areas in the Conservation Area are designated as
			 wilderness and as components of the National Wilderness Preservation
			 System:</text>
				<paragraph id="H6AE67F31899C4596811A8F9835AC8D70"><enum>(1)</enum><header>Cerro del yuta
			 wilderness</header><text>Certain land administered by the Bureau of Land
			 Management in Taos County, New Mexico, comprising approximately 13,420 acres as
			 generally depicted on the map, which shall be known as the <quote>Cerro del
			 Yuta Wilderness</quote>.</text>
				</paragraph><paragraph id="H6D399AE2BCD0457D82F56E775F9277DB"><enum>(2)</enum><header>Rio San Antonio
			 Wilderness</header><text>Certain land administered by the Bureau of Land
			 Management in Rio Arriba County, New Mexico, comprising approximately 8,000
			 acres, as generally depicted on the map, which shall be known as the <quote>Rio
			 San Antonio Wilderness</quote>.</text>
				</paragraph></subsection><subsection id="H2BA2DD2BA4394CAA8C332C1C9772E948"><enum>(b)</enum><header>Management of
			 wilderness areas</header><text>Subject to valid existing rights, the wilderness
			 areas designated by subsection (a) shall be administered in accordance with the
			 Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>) and this Act, except that with respect
			 to the wilderness areas designated by this Act—</text>
				<paragraph id="HDA072B3EC4234387A040B828F947E02A"><enum>(1)</enum><text>any reference to
			 the effective date of the Wilderness Act shall be considered to be a reference
			 to the date of enactment of this Act; and</text>
				</paragraph><paragraph id="H4DC9A1B7E8BE438EB4DF07E24D3F793F"><enum>(2)</enum><text>any reference in
			 the Wilderness Act to the Secretary of Agriculture shall be considered to be a
			 reference to the Secretary.</text>
				</paragraph></subsection><subsection id="HC0B36CC1F30F4F45B553C19094B363B9"><enum>(c)</enum><header>Incorporation of
			 acquired land and interests in land</header><text>Any land or interest in land
			 within the boundary of the wilderness areas designated by subsection (a) that
			 is acquired by the United States shall—</text>
				<paragraph id="H44FEC74EAB02454FACFCF2B59525909F"><enum>(1)</enum><text>become part of the
			 wilderness area in which the land is located; and</text>
				</paragraph><paragraph id="HC022110CFBED414D9E0B5C85433A9DF5"><enum>(2)</enum><text>be managed in
			 accordance with—</text>
					<subparagraph id="HE53DA9946A844691953C1D408517A039"><enum>(A)</enum><text>the Wilderness Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>);</text>
					</subparagraph><subparagraph id="HDF35908686194C8BA5B8B1F685CF3D64"><enum>(B)</enum><text>this Act;
			 and</text>
					</subparagraph><subparagraph id="HA2CA348AEEFE423A8B853229F4C1C812"><enum>(C)</enum><text>any other
			 applicable laws.</text>
					</subparagraph></paragraph></subsection><subsection id="H4876559F2B164464B95E010112938666"><enum>(d)</enum><header>Grazing</header><text>Grazing
			 of livestock in the wilderness areas designated by subsection (a), where
			 established before the date of enactment of this Act, shall be administered in
			 accordance with—</text>
				<paragraph id="HC38609799B174D21BFFA10ABF473161D"><enum>(1)</enum><text>section 4(d)(4) of
			 the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(4)</external-xref>); and</text>
				</paragraph><paragraph id="H3735723B63B049198C96298ED22A4BD9"><enum>(2)</enum><text>the guidelines set
			 forth in appendix A of the Report of the Committee on Interior and Insular
			 Affairs to accompany H.R. 2570 of the 101st Congress (H. Rept. 101–405).</text>
				</paragraph></subsection><subsection id="HEDA9BA439B88409B889AB99EE2FF6C70"><enum>(e)</enum><header>Buffer
			 zones</header>
				<paragraph id="H9DF5061CCBF246A8AA78594DAD36A45F"><enum>(1)</enum><header>In
			 general</header><text>Nothing in this section creates a protective perimeter or
			 buffer zone around any wilderness area designated by subsection (a).</text>
				</paragraph><paragraph id="H182E3E0D6589461FA472684E4322329B"><enum>(2)</enum><header>Activities
			 outside wilderness areas</header><text>The fact that an activity or use on land
			 outside any wilderness area designated by subsection (a) can be seen or heard
			 within the wilderness area shall not preclude the activity or use outside the
			 boundary of the wilderness area.</text>
				</paragraph></subsection><subsection id="HF82B857BA6B542E990E148ACC875AF39"><enum>(f)</enum><header>Release of
			 wilderness study areas</header><text>Congress finds that, for purposes of
			 section 603(c) of the Federal Land Policy and Management Act of 1976 (43 U.S.C.
			 1782(c)), the public land within the San Antonio Wilderness Study Area not
			 designated as wilderness by this section—</text>
				<paragraph id="H357D9C657EB9452D8F4DE56276DA0F8B"><enum>(1)</enum><text>has been
			 adequately studied for wilderness designation;</text>
				</paragraph><paragraph id="H03743ABB8C31481DB05CB5F9A20CCF58"><enum>(2)</enum><text>is no longer
			 subject to section 603(c) of the Federal Land Policy and Management Act of 1976
			 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>); and</text>
				</paragraph><paragraph id="H6A5F3396F8854C9196E6F386350250FC"><enum>(3)</enum><text>shall be managed
			 in accordance with this Act.</text>
				</paragraph></subsection></section><section id="HED0E4D6ADB4443D29E0501CD88CE09B1"><enum>5.</enum><header>General
			 provisions</header>
			<subsection id="HDD096FAE93E341B6A38109EDC35B7A3D"><enum>(a)</enum><header>Maps and legal
			 descriptions</header>
				<paragraph id="H814145DF3F9549379367807D7B9F00F0"><enum>(1)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, the Secretary shall file the map and legal descriptions of the
			 Conservation Area and the wilderness areas designated by section 4(a)
			 with—</text>
					<subparagraph id="H28E8C187F9CB4C6792011819649EDE94"><enum>(A)</enum><text>the Committee on
			 Energy and Natural Resources of the Senate; and</text>
					</subparagraph><subparagraph id="H943EA4E7DA784274AC7F3AB507719FF7"><enum>(B)</enum><text>the Committee on
			 Natural Resources of the House of Representatives.</text>
					</subparagraph></paragraph><paragraph id="H5C8DBAF639BC4F4DA475C1C4A76916BE"><enum>(2)</enum><header>Force of
			 law</header><text>The map and legal descriptions filed under paragraph (1)
			 shall have the same force and effect as if included in this Act, except that
			 the Secretary may correct errors in the legal description and map.</text>
				</paragraph><paragraph id="HC706077D30C94575ADE76AFCC924D1A9"><enum>(3)</enum><header>Public
			 availability</header><text>The map and legal descriptions filed under paragraph
			 (1) shall be on file and available for public inspection in the appropriate
			 offices of the Bureau of Land Management.</text>
				</paragraph></subsection><subsection id="H7105737A36A2462DB13D17285F1A5CBA"><enum>(b)</enum><header>National
			 landscape conservation system</header><text>The Conservation Area and the
			 wilderness areas designated by section 4(a) shall be administered as components
			 of the National Landscape Conservation System.</text>
			</subsection><subsection id="H4F5719E378D44EA19642FA4DECF92A9D"><enum>(c)</enum><header>Fish and
			 wildlife</header><text>Nothing in this Act affects the jurisdiction of the
			 State with respect to fish and wildlife located on public land in the State,
			 except that the Secretary, after consultation with the New Mexico Department of
			 Game and Fish, may designate zones where, and establishing periods when,
			 hunting shall not be allowed for reasons of public safety, administration, or
			 public use and enjoyment.</text>
			</subsection><subsection id="HC11F724E93BC4F4CAFE460E4FC1CD5C5"><enum>(d)</enum><header>Withdrawals</header><text>Subject
			 to valid existing rights, any Federal land within the Conservation Area and the
			 wilderness areas designated by section 4(a), including any land or interest in
			 land that is acquired by the United States after the date of enactment of this
			 Act, is withdrawn from—</text>
				<paragraph id="HEEBAA0915CF146ABBA8C2211CA903136"><enum>(1)</enum><text>entry,
			 appropriation, or disposal under the public land laws;</text>
				</paragraph><paragraph id="H5A186C68889F49C9BB3E37DC601EA2D2"><enum>(2)</enum><text>location, entry,
			 and patent under the mining laws; and</text>
				</paragraph><paragraph id="H907C67CD9A1547048C8C57E6F08DB83B"><enum>(3)</enum><text>operation of the
			 mineral leasing, mineral materials, and geothermal leasing laws.</text>
				</paragraph></subsection><subsection id="HF6887E1A45744648B4149561957C7AF9"><enum>(e)</enum><header>Treaty
			 rights</header><text>Nothing in this Act enlarges, diminishes, or otherwise
			 modifies any treaty rights.</text>
