		<official-title>To amend the National Energy Conservation Policy Act and
		  the Energy Independence and Security Act of 2007 to promote energy efficiency
		  via information and computing technologies, and for other
		  purposes.</official-title>

		<section id="H09A3E461CD5E49EA931F6DD11C1C1435" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Energy Efficient Government Technology
			 Act</short-title></quote>.</text>
		</section><section id="HB41A3F92FB544F639465E10EB5EFA41B" section-type="subsequent-section"><enum>2.</enum><header>Energy-efficient and
			 energy-saving information and communications technologies</header><text display-inline="no-display-inline">Section 543 of the National Energy
			 Conservation Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8253">42 U.S.C. 8253</external-xref>) is amended—</text>
			<paragraph id="H6B30E2C17C914D509A51E74C47E6D3E1"><enum>(1)</enum><text>by redesignating
			 the second subsection (f) (relating to large capital energy investments) as
			 subsection (g); and</text>
			</paragraph><paragraph id="H0970C542EDAB42FA94003B5EA6BF06A2"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H2AE77878B55E47DAB58CFBFACAB47999" style="OLC">
					<subsection id="H6F9D83D12C694145A985231EBB951462"><enum>(h)</enum><header>Federal
				Implementation Strategy for Energy-Efficient and Energy-Saving Information and
				Communications Technologies</header>
						<paragraph id="HFC3270BD98404BCCB8590B8ADA7792E5"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not later than 1 year
				after the date of enactment of this subsection, each Federal agency shall
				collaborate with the Director of the Office of Management and Budget (referred
				to in this subsection as the <term>Director</term>) to develop an
				implementation strategy (including best-practices and measurement and
				verification techniques) for the maintenance, purchase, and use by the Federal
				agency of energy-efficient and energy-saving information and communications
				technologies and practices. Each implementation strategy shall be flexible,
				cost-effective, and based on the specific operating requirements and statutory
				mission of the agency.</text>
						</paragraph><paragraph id="HA0C713B46F2540FBA32B3787BC307135"><enum>(2)</enum><header>Administration</header><text>In
				developing an implementation strategy, each Federal agency shall—</text>
							<subparagraph id="H760F45A983B1409B89E0662CC7AA72B5"><enum>(A)</enum><text display-inline="yes-display-inline">consider information and communications
				technologies (ICT) and related infrastructure and practices, such as—</text>
								<clause id="HF60A3489E55C4580BE38FA0C40A1D388"><enum>(i)</enum><text>advanced metering
				infrastructure;</text>
								</clause><clause id="HCE5FE5269CB640D7A972CBB7BA31B59E"><enum>(ii)</enum><text>ICT services and
				products;</text>
								</clause><clause id="HED3EB773074340B2B6C104B54CC8BFC4"><enum>(iii)</enum><text display-inline="yes-display-inline">efficient data center strategies and
				methods of increasing ICT asset and related infrastructure utilization;</text>
								</clause><clause id="H77356C64816A4BF6B1B0E589E5A1D538"><enum>(iv)</enum><text display-inline="yes-display-inline">ICT and related infrastructure power
				management;</text>
								</clause><clause id="H849AF64C3AA24354B82E7C4F0A89F5C8"><enum>(v)</enum><text display-inline="yes-display-inline">building information modeling, including
				building energy management; and</text>
								</clause><clause id="H4555BE2AA5A54B2A8FFDC46F2A3AAFEB"><enum>(vi)</enum><text display-inline="yes-display-inline">secure telework and travel substitution
				tools; and</text>
								</clause></subparagraph><subparagraph commented="no" id="H997E576503F84AF89857C7C4DD883C78"><enum>(B)</enum><text>ensure that the
				agency realizes the savings and rewards brought about through increased
				efficiency and utilization.</text>
							</subparagraph></paragraph><paragraph id="HC722BFD504FD48A38E5B7CA178FA2296"><enum>(3)</enum><header>Performance
				goals</header>
							<subparagraph id="H9F574BC71A2A466395B31E3D722F3E68"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not later than 180
				days after the date of enactment of this subsection, the Director, in
				consultation with the Secretary, shall establish performance goals for
				evaluating the efforts of Federal agencies in improving the maintenance,
				purchase, and use of energy-efficient and energy-saving information and
				communications technology systems and practices.</text>
							</subparagraph><subparagraph id="H68D8199BE34A4E8AB2A78B9A2C547E7D"><enum>(B)</enum><header>Energy efficient
				data centers</header><text display-inline="yes-display-inline">The Director
				shall include within the performance goals established under this
				paragraph—</text>
								<clause id="HE6D67AE2B8264233A6FB5EB5C36EDC5A"><enum>(i)</enum><text display-inline="yes-display-inline">specifications and benchmarks that will
				enable Federal data center operators to make more informed decisions about the
				energy efficiency and cost savings of data centers, including an overall
				Federal target for increased energy efficiency, with initial reliance on the
				Power Usage Effectiveness metric;</text>
								</clause><clause id="HCFB55AAA102E4CD386B545A200342FA4"><enum>(ii)</enum><text display-inline="yes-display-inline">overall ICT asset utilization and related
				infrastructure utilization; and</text>
								</clause><clause id="H84417E78D8444132B2711C92FB3F38C3"><enum>(iii)</enum><text display-inline="yes-display-inline">recommendations and best practices for how
				the benchmarks will be attained, with such recommendations to include a
				requirement for agencies to evaluate the use of energy savings performance
				contracting as a preferred acquisition method for data center
				efficiency.</text>
								</clause></subparagraph><subparagraph id="HBD30135E644443658333740B15860132"><enum>(C)</enum><header>Administration</header><text>The
				performance goals established under this paragraph shall—</text>
								<clause id="H532D8C58D0144BFF8A0E480D4E8B3870"><enum>(i)</enum><text>measure
				information technology costs over a specific time period of 3 to 5
				years;</text>
								</clause><clause id="H9D3BCCCD8A87465CB922BE98CCF4A7A3"><enum>(ii)</enum><text>measure cost
				savings attained via the use of energy-efficient and energy-saving information
				and communications solutions during the same time period; and</text>
								</clause><clause id="H57930D6C807B40F29F246DC6FF432055"><enum>(iii)</enum><text>provide, to the
				maximum extent practicable, a complete picture of all costs and savings,
				including energy costs and savings.</text>
								</clause></subparagraph></paragraph><paragraph id="HD0E0F37BB33845258007731EBBDD15D7"><enum>(4)</enum><header>Federal data
				centers task force</header><text display-inline="yes-display-inline">The
				Director shall maintain a Government-wide Data Center Task Force comprised of
				Federal data center program managers, facilities managers, and sustainability
				officers. The members of such task force shall be responsible for working
				together to share progress toward individual agency goals and the overall
				Federal target for increased energy efficiency, and shall regularly exchange
				best practices and other strategic information related to energy efficiency
				with the private sector.</text>
						</paragraph><paragraph id="H7F82F7F72A6A47CAA0B7E7CC094D20C4"><enum>(5)</enum><header>Reports</header>
							<subparagraph id="HD6DDBADB60B04FBFB4F774D4172B11AD"><enum>(A)</enum><header>Agency
				reports</header><text>Each Federal agency subject to the requirements of this
				subsection shall include in the report of the agency under section 527 of the
				Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17143">42 U.S.C. 17143</external-xref>) a description of
				the efforts and results of the agency under this subsection.</text>
							</subparagraph><subparagraph id="H37A0CBF176CC4CE98EE39DBD5A4F415C"><enum>(B)</enum><header>OMB Government
				efficiency reports and scorecards</header><text>Effective beginning not later
				than October 1, 2013, the Director shall include in the annual report and
				scorecard of the Director required under section 528 of the Energy Independence
				and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17144">42 U.S.C. 17144</external-xref>) a description of the efforts and
				results of Federal agencies under this
				subsection.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HC29CF19AB53C454AA6959A60CB8BC6B1"><enum>3.</enum><header>Energy efficient
			 data centers</header><text display-inline="no-display-inline">Section 453 of
			 the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17112">42 U.S.C. 17112</external-xref>) is
			 amended—</text>
			<paragraph id="HE187C267AA6C455B9540528F5E76349D"><enum>(1)</enum><text display-inline="yes-display-inline">by amending subsection (c)(1) to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="H977B808A49384D8D86DAD0502217C13F" style="OLC">
					<paragraph id="HD4EA55B7AE284F8C86F7A5276083C972"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not later than 30
				days after the date of enactment of the <short-title>Energy Efficient Government Technology Act</short-title>,
				the Secretary and the Administrator shall designate an established information
				technology industry organization to coordinate the program described in
				subsection (b), and shall make such designation public, including on an
				appropriate website.</text>
					</paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H9153598BDCC74037896E026FC148DE15"><enum>(2)</enum><text>by amending
			 subsections (e) and (f) to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HD8580A784C99481CB9B13BBEB621288C" style="OLC">
					<subsection id="HA64EAF2870714B7B89BFC966902F2DB0"><enum>(e)</enum><header>Study</header><text display-inline="yes-display-inline">The Secretary, with assistance from the
				Administrator, shall—</text>
						<paragraph id="HA05031CD2E9645998ED14FDF62B98083"><enum>(1)</enum><text display-inline="yes-display-inline">not later than December 31, 2013, make
				available to the public an update to the Report to Congress on Server and Data
				Center Energy Efficiency published on August 2, 2007, under <external-xref legal-doc="public-law" parsable-cite="pl/109/431">Public Law 109–431</external-xref>,
				providing—</text>
							<subparagraph id="HC975F359DD6848448022B015F125CAF8"><enum>(A)</enum><text>a comparison and
				gap analysis of the estimates and projections contained in the original report
				with new data regarding the period from 2007 though 2012;</text>
							</subparagraph><subparagraph id="HDD412C9084F3442F9BC1DDAC3C0D7E7C"><enum>(B)</enum><text display-inline="yes-display-inline">an analysis considering the impact of ICT
				asset and related infrastructure utilization solutions, to include
				virtualization and cloud computing-based solutions, in the public and private
				sectors; and</text>
							</subparagraph><subparagraph id="H7B42D74A94D2479DA80FB08CF5BDEFDE"><enum>(C)</enum><text>updated
				projections and recommendations for best practices; and</text>
							</subparagraph></paragraph><paragraph id="H95375272A5CA41CEB4E7A778DEA6A88F"><enum>(2)</enum><text>collaborate with
				the organization designated under subsection (c) in preparing such
				report.</text>
						</paragraph></subsection><subsection id="H432A32B652824E6782A6991B8F19893C"><enum>(f)</enum><header>Data center
				energy practitioner program</header><text display-inline="yes-display-inline">The Secretary, in collaboration with the
				organization designated under subsection (c) and the United States Chief
				Information Officer in the Office of Management and Budget, shall maintain a
				data center energy practitioner program that leads to the certification of
				energy practitioners qualified to evaluate the energy usage and efficiency
				opportunities in data centers. Each Federal agency shall have its data centers
				evaluated annually by energy practitioners certified pursuant to such program,
				whenever practicable using certified practitioners employed by that
				agency.</text>
					</subsection><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HB764FAEE4D604E7690DC8811BE649076"><enum>(3)</enum><text>by redesignating
			 subsection (g) as subsection (j); and</text>
			</paragraph><paragraph id="H6815179DA21945D2AC93D713214D3E52"><enum>(4)</enum><text>by inserting after
			 subsection (f) the following new subsections:</text>
				<quoted-block display-inline="no-display-inline" id="HB00AA742D1634AD68B7ADC1236F613D9" style="OLC">
					<subsection id="HB12A010DB3B7499386FDB39C5A876577"><enum>(g)</enum><header>Open data
				initiative</header><text display-inline="yes-display-inline">The Secretary, in
				collaboration with the organization designated under subsection (c) and the
				United States Chief Information Officer in the Office of Management and Budget,
				shall establish an open data initiative for Federal data center energy usage
				data, with the purpose of making such data available and accessible in a manner
				that empowers further data center innovation while protecting United States
				national security interests. In establishing this initiative, the Secretary
				shall consider use of the online Data Center Maturity Model.</text>
					</subsection><subsection id="HE34A6201D15C481688B939ED4629C8F9"><enum>(h)</enum><header>International
				specifications and metrics</header><text>The Secretary, in collaboration with
				the organization designated under subsection (c), shall actively participate in
				efforts to harmonize global specifications and metrics for data center energy
				efficiency.</text>
					</subsection><subsection id="HC9F31C93AD8D4F43B848A9E815BEDF94"><enum>(i)</enum><header>ICT asset
				utilization metric</header><text display-inline="yes-display-inline">The
				Secretary, in collaboration with the organization designated under subsection
				(c), shall assist in the development of an efficiency metric that measures the
				energy efficiency of the overall data center, including information technology
				systems and related
				infrastructure.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section></legis-body>
