		<official-title>To amend the Helium Act to complete the privatization of
		  the Federal helium reserve in a competitive market fashion that ensures
		  stability in the helium markets while protecting the interests of American
		  taxpayers, and for other purposes.</official-title>

		<section id="H32AB5519F6C3402DB5E6EDD698B7E3E3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Responsible Helium Administration and
			 Stewardship Act</short-title></quote> .</text>
		</section><section id="H36FA0D6FD48344F289509647433972C3"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 2 of the Helium Act (<external-xref legal-doc="usc" parsable-cite="usc/50/167">50 U.S.C. 167</external-xref>)
			 is amended—</text>
			<paragraph id="H09DBC2A3FC5E411081BAB01F20A26631"><enum>(1)</enum><text>in paragraph (1),
			 by striking the semicolon at the end and inserting a period;</text>
			</paragraph><paragraph id="H4088A8CA6D7E4428BA642D8CB0B25ED3"><enum>(2)</enum><text>in paragraph (2),
			 by striking <quote>; and</quote> and inserting a period; and</text>
			</paragraph><paragraph id="HB44A2236C1E44A01B7A638C2D9E8F940"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block id="HD7AA5D96BA9840EA9CC4EBABAE6F18D3" style="OLC">
					<paragraph id="H256D63C3A8E740C683B9A3BDF0B49ADE"><enum>(4)</enum><header>Federal Helium
				Reserve</header>
						<subparagraph id="HF05CDB6D7F324FAAB6030191D28EA68F"><enum>(A)</enum><header>In
				general</header><text>The term <term>Federal Helium Reserve</term> means the
				Bureau of Land Management Cliffside Gas Field and supporting
				infrastructure.</text>
						</subparagraph><subparagraph id="HF09948F6036040969473656FB2E56F9B"><enum>(B)</enum><header>Inclusions</header><text>The
				term <term>Federal Helium Reserve</term> includes—</text>
							<clause id="HF2870527C1E345B085B282061DB63747"><enum>(i)</enum><text>the Cliffside Gas
				Field helium storage reservoir; and</text>
							</clause><clause id="H27BC117C03CE4D6ABBA6A2E0B10F589D"><enum>(ii)</enum><text>all associated
				infrastructure owned, leased, or managed under contract by the Secretary for
				storage, transportation, withdrawal, purification, or management of
				helium.</text>
							</clause></subparagraph></paragraph><paragraph id="HAB15F13DDFBF41C3B8239DB9DC7694CF"><enum>(5)</enum><header>Qualifying
				domestic helium transaction</header><text display-inline="yes-display-inline">The term <term>qualifying domestic helium
				transaction</term>—</text>
						<subparagraph id="H5B4DFFA318EA4462B4CC0516ADC1C3BE"><enum>(A)</enum><text>except as provided
				in subparagraph (B), means any new or newly negotiated agreement for the
				purchase or sale of at least 15,000,000 standard cubic feet of crude helium or
				bulk liquid helium delivered in the United States in the most recent
				2-fiscal-year period; and</text>
						</subparagraph><subparagraph id="H588E04BA2B00454EB34CE17A3ECE835E"><enum>(B)</enum><text>does not include
				any purchase of crude helium from the Secretary.</text>
						</subparagraph></paragraph><paragraph id="H8CF23BE3BC9F401381437430E0BCAC7D"><enum>(6)</enum><header>Tolling
				agreement</header><text>The term <term>tolling agreement</term> means an
				agreement between a helium refiner and another party under which the helium
				refiner agrees to process the other person’s helium at an agreed upon
				price.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HF2AFC0A32D904F7AB434501D8B60D994"><enum>3.</enum><header>Sale and auction
			 of crude helium</header>
			<subsection id="H967A83E76B054CEAB10C55B11C98A211"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">Section 6 of the
			 Helium Act (<external-xref legal-doc="usc" parsable-cite="usc/50/167d">50 U.S.C. 167d</external-xref>) is amended to read as follows:</text>
				<quoted-block id="H4612F47EC06F4B7F909579117C9B18DB" style="OLC">
					<section id="HDEF50E8FD5B0446790DFB6E136529B59"><enum>6.</enum><header>Sale of
				helium</header>
						<subsection id="HF753227CD7A946E092BF84F7A9BBCBAD"><enum>(a)</enum><header>Phase A:
				Finalizing Debt Payoff</header>
							<paragraph id="H477EA807A699480CA27EA9B55ACA37EE"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), the Secretary shall offer for
				sale crude helium for Federal, medical, scientific, and commercial uses in such
				quantities, at such times, and under such conditions as the Secretary
				determines necessary to carry out this subsection with minimum market
				disruption.</text>
							</paragraph><paragraph id="H1876EA7516B2472FA5C1B6BDF02520CE"><enum>(2)</enum><header>Minimum
				quantity</header><text>The Secretary shall offer for sale during each fiscal
				year under paragraph (1) a quantity of crude helium that is not less than the
				quantity of crude helium offered for sale by the Secretary during fiscal year
				2012.</text>
							</paragraph><paragraph id="HEAE7C76CF61B4AF99BD5B1068DE580FC"><enum>(3)</enum><header>Purchase by
				Federal agencies</header><text>Federal agencies, and holders of 1 or more
				Federal research grants, may purchase refined helium under this subsection for
				Federal, medical, and scientific uses from persons who have entered into
				enforceable contracts to purchase an equivalent quantity of crude helium from
				the Secretary.</text>
							</paragraph><paragraph id="H25C7C07C0E78441B826D64BDEA39ED50"><enum>(4)</enum><header>Prices and
				determinations</header><text>Sales of crude helium by the Secretary under this
				subsection shall be at prices established by the Secretary that shall not be
				less than the price in the last sale of crude helium from the Federal Helium
				Reserve before the date of enactment of the Responsible Helium Administration
				and Stewardship Act.</text>
							</paragraph><paragraph id="H8CB8E5752E154C4480BFF10D9F077BD3"><enum>(5)</enum><header>Duration</header><text>This
				subsection applies during the period—</text>
								<subparagraph id="HAB28259C499D46FDA481A1BFE0B082F1"><enum>(A)</enum><text>beginning on the
				date of enactment of the Responsible Helium Administration and Stewardship Act;
				and</text>
								</subparagraph><subparagraph id="H39884DBD931846A68C4567B8FA27402E"><enum>(B)</enum><text display-inline="yes-display-inline">ending on the expiration of the one-year
				period following such date of enactment.</text>
								</subparagraph></paragraph></subsection><subsection id="HF1574C35DBFF4751B2AC703D832FF454"><enum>(b)</enum><header>Phase B:
				Maximizing Total Recovery of Helium and Increasing Returns to the American
				Taxpayer</header>
							<paragraph id="HA31E5C5F996441509691F4B09286EDE9"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall offer for sale at auction, as
				described in subsection (d), crude helium for Federal, medical, scientific, and
				commercial uses in such quantities, at such times, and under such conditions as
				the Secretary determines necessary—</text>
								<subparagraph id="H3FBFEB39AA06419F8A5C50DD517E5D83"><enum>(A)</enum><text>to maximize total
				recovery and conservation of helium from the Federal Helium Reserve;</text>
								</subparagraph><subparagraph id="HF5A6F2A39F3749F7A430AB0F9FD12451"><enum>(B)</enum><text>to manage crude
				helium sales according to the ability of the Secretary to extract and produce
				helium from the Federal Helium Reserve;</text>
								</subparagraph><subparagraph id="H595E6080B4E848FDBC28600CFF48C74D"><enum>(C)</enum><text display-inline="yes-display-inline">to respond to helium market supply and
				demand and minimize market disruption; and</text>
								</subparagraph><subparagraph id="H8E63FD8EB9FD489A8365CC2E5A17B399"><enum>(D)</enum><text>to give priority
				to meeting the helium demand of Federal users in the event of any disruption to
				the Federal Helium Reserve.</text>
								</subparagraph></paragraph><paragraph id="HFC74860D79454DE89A4B47E7186F3D28"><enum>(2)</enum><header>Purchase by
				designated federal agencies and grantees</header><text>Any Federal agency, and
				any holder of 1 or more Federal research grants, may purchase refined helium
				for Federal, medical, research, and scientific uses from an eligible person, at
				the minimum auction price or other price designated by the Secretary. The
				Secretary shall then provide an equivalent volume of crude helium to the
				eligible person as if the eligible person was the successful bidder for the
				helium at auction.</text>
							</paragraph><paragraph id="HC73FA12FB09B44CAB52F6AA4E217D53A"><enum>(3)</enum><header>Eligible
				person</header><text display-inline="yes-display-inline">For purposes of this
				subsection, the term <term>eligible person</term> means a helium distributer
				who is registered as such with the Secretary.</text>
							</paragraph><paragraph id="HF3CE6A3C442F4A60B4BD781721672632"><enum>(4)</enum><header>Duration</header><text>This
				subsection applies during the period—</text>
								<subparagraph id="H661D401C151E46E3BCB71774B442F89D"><enum>(A)</enum><text>beginning on the
				expiration of the period described in subsection (a)(5)(B); and</text>
								</subparagraph><subparagraph id="H566A999C7CAF49EEB77BE4D10F2B5364"><enum>(B)</enum><text>ending on the date
				on which the volume of recoverable crude helium at the Federal Helium Reserve
				(other than privately owned quantities of crude helium stored temporarily at
				the Federal Helium Reserve under section 5 and this section) is 3,000,000,000
				standard cubic feet.</text>
								</subparagraph></paragraph></subsection><subsection id="H10076742FBD74B13954B6AB0628A1DB7"><enum>(c)</enum><header>Phase C: Access
				for Federal users</header>
							<paragraph id="HEAE02A7CE63043DC863AA1B693ED94D1"><enum>(1)</enum><header>In
				general</header><text>The Secretary may offer for sale crude helium for Federal
				uses (including medical and scientific uses) in such quantities, at such times,
				and under such conditions as the Secretary determines necessary to carry out
				this subsection.</text>
							</paragraph><paragraph id="HF9E9DE1DFA8D4DFEADAEACF15D9182A1"><enum>(2)</enum><header>Purchase by
				Federal agencies and grantees</header><text display-inline="yes-display-inline">Federal agencies, and holders of 1 or more
				Federal research grants related to helium or the use of helium, may purchase
				refined helium under this subsection for Federal uses (including medical and
				scientific uses) from persons who have entered into enforceable contracts to
				purchase an equivalent quantity of crude helium from the Secretary.</text>
							</paragraph><paragraph id="HA9074C8C6BEE434D9E4B40D26CF5762B"><enum>(3)</enum><header>Effective
				date</header><text>This subsection applies beginning on the day after the date
				described in subsection (b)(4)(B).</text>
							</paragraph></subsection><subsection id="H1461B997552C40C5AEE9AA5415289B64"><enum>(d)</enum><header>Auction and
				minimum prices determination</header>
							<paragraph id="H4D35E5D706A442409666D489A8ECC514"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Sales of crude helium
				by the Secretary under subsection (b) shall be conducted at auction under the
				conditions described in this section and at no less than the minimum price
				established by the Secretary.</text>
							</paragraph><paragraph id="HEA8E884DEDE44CEAB05C194E52B1326E"><enum>(2)</enum><header>Auction</header><text display-inline="yes-display-inline">The Secretary shall conduct auctions of
				crude helium in the Federal Helium Reserve as soon as practical but no later
				than beginning 180 days after the first day of the period described in
				subsection (b)(4), under the following conditions:</text>
								<subparagraph id="HB2820DEF243448618E2400D90D99766A"><enum>(A)</enum><text display-inline="yes-display-inline">60 percent of the volume of crude helium
				made available in each auction shall be made available to entities that can
				show the Secretary they have either adequate refining capacity or tolling
				agreements for refining in place, in accordance with the conditions set forth
				in paragraph (3).</text>
								</subparagraph><subparagraph id="HCC16F4CC1CE445B5BC586B22998CEAF7"><enum>(B)</enum><text display-inline="yes-display-inline">20 percent of the volume of crude helium
				made available in each auction shall be made available to any bidder, in
				accordance with the conditions set forth in paragraph (3).</text>
								</subparagraph><subparagraph id="H4F4F0EF5D64F48C5A78D9F1E817176D0"><enum>(C)</enum><text display-inline="yes-display-inline">In each auction after the first auction
				under this subsection after the date of the enactment of the Responsible Helium
				Administration and Stewardship Act, the Secretary shall make available an
				additional volume of crude helium, in an amount equivalent to the amount made
				available under subparagraph (B) that the Secretary certifies can be refined,
				through tolling agreements or otherwise. Of such additional volume, a person
				may not acquire in the auction a volume in excess of the volume they
				demonstrate to the Secretary they have the ability to refine through either
				refining capacity or tolling agreements.</text>
								</subparagraph><subparagraph id="H03678D9DCB9E497CA36C014F99BDABEF"><enum>(D)</enum><text>The Secretary
				shall conduct such auctions at such times as the Secretary determines necessary
				to ensure a reliable supply of helium and a fair return to taxpayers, but no
				less frequently than 2 times each fiscal year.</text>
								</subparagraph><subparagraph id="HBA42D15FC0FA416C87C214EA5DF67163"><enum>(E)</enum><text>For purposes of
				the first auction under this subsection after the date of the enactment of the
				Responsible Helium Administration and Stewardship Act, the Secretary may revise
				the percentage under subparagraph (A) so as to make available for auction 100
				percent of the volume of crude helium intended to be offered.</text>
								</subparagraph><subparagraph id="HA6072372BE674627AEDBA9E9C7ACF91F"><enum>(F)</enum><text>The Secretary may
				adjust the percentages and amount specified in subparagraphs (A) through (C),
				respectively, in any auction if the Secretary determines the adjustment is
				necessary to—</text>
									<clause id="HE87D401217614EADA05B6F63DE2C88DA"><enum>(i)</enum><text>respond to market
				supply and demand and minimize market disruption; or</text>
									</clause><clause id="H57FA4CEFC7BB4D519CDFC3A8B27A6C5F"><enum>(ii)</enum><text>increase
				participation in helium auctions.</text>
									</clause></subparagraph><subparagraph id="H2B579A5B1267420F8F171475E1BA191B"><enum>(G)</enum><text>Notwithstanding
				any other provision of this subsection, for each fiscal year, the Secretary may
				not offer a total volume of crude helium for sale under this subsection that
				exceeds the lesser of—</text>
									<clause id="H0688BEE93E9B42A7A6D3207DFACF03AC"><enum>(i)</enum><text>the projected
				maximum total production capacity of the Federal Helium Reserve during that
				fiscal year; and</text>
									</clause><clause id="HAA7BECD72F514B399DEAFB54DD17E81F"><enum>(ii)</enum><text>the maximum
				refining capacity of persons connected by pipeline to the Federal Helium
				Reserve during that fiscal year.</text>
									</clause></subparagraph></paragraph><paragraph id="HF9D80E353B9349F197D5C10568DA62B4"><enum>(3)</enum><header>Auction
				conditions</header>
								<subparagraph id="HECBB66E21F43455190467BDA7970DCB3"><enum>(A)</enum><header>Bidding
				method</header><text>The Secretary shall conduct each auction by sealed bid for
				predetermined volume lots, unless the Secretary determines that an alternative
				bidding method may result in more revenue to the Federal Government.</text>
								</subparagraph><subparagraph id="H1AE8F28389CA4E8FB564907BD40FA496"><enum>(B)</enum><header>Bidder
				qualifications and limits</header><text>In carrying out an auction under
				subsection (b), the Secretary—</text>
									<clause id="HE6648260DE9F4726BE45D1E0F7FE1534"><enum>(i)</enum><text>may accept bids
				only from persons the Secretary determines are seeking to purchase helium for
				their own use, for refining, or for delivery to users; and</text>
									</clause><clause id="H1176CD172E844F918DA239449810C74C"><enum>(ii)</enum><text>may not award to
				a person more than 30 percent of the total volume of crude helium offered in
				that auction, except that the Secretary may adjust such limitation based on the
				number of bidders in the auction.</text>
									</clause></subparagraph><subparagraph id="HF9A50B5E06694097894D8548501C64F6"><enum>(C)</enum><header>Storage
				fees</header><text>In each auction the Secretary—</text>
									<clause id="HDD1DD70700A947E2B0690E2CC12CA865"><enum>(i)</enum><text>shall begin
				charging each winning bidder a storage fee for crude helium purchased by the
				bidder that remains in the Federal Helium Reserve, beginning on the date the
				Secretary receives payment of the purchase price for the helium; and</text>
									</clause><clause id="HD837CB3E24164DBBA765D5422A728DAA"><enum>(ii)</enum><text>beginning 270
				days after the date of the auction, shall charge increasing storage fees that
				will encourage the withdrawal of the helium no later than 2 years after the
				date of the auction.</text>
									</clause></subparagraph></paragraph><paragraph id="H087A27797F2E41848F8F3BB8E9111331"><enum>(4)</enum><header>Determination of
				minimum sale price</header><text>The Secretary shall make a determination of
				the minimum sale price for sales described in paragraph (1) using—</text>
								<subparagraph id="H7F424649DDFE4527925F4BDEAF77D362"><enum>(A)</enum><text>a confidential
				survey of qualifying domestic helium transactions to which any holder of a
				contract with the Secretary for the acceptance, storage, and redelivery of
				crude helium in the Cliffside Gas Field helium storage reservoir is a
				party;</text>
								</subparagraph><subparagraph id="H16F1AAF68D32447E8A8A8446D74A1BCA"><enum>(B)</enum><text display-inline="yes-display-inline">current market crude helium prices as
				represented by the sale price at any auction held by the Secretary in the
				preceding 2 years;</text>
								</subparagraph><subparagraph id="H38CD98EDC1AD49D49C941AAC2C32DAAD"><enum>(C)</enum><text>the
				volume-weighted average cost among helium refiners, producers, and liquefiers,
				in dollars per thousand cubic feet, of converting gaseous crude helium into
				bulk liquid helium; and</text>
								</subparagraph><subparagraph id="H963FA99884804E318F267319FD834AF7"><enum>(D)</enum><text>the additional
				layer of cost and profit associated with the sale or resale of bulk liquid
				helium.</text>
								</subparagraph></paragraph><paragraph id="HB356B23B98E749C3824FC592BC20556D"><enum>(5)</enum><header>Authority of
				Secretary</header><text>The Secretary shall—</text>
								<subparagraph id="HCA921555547F4590823587B10E3DC901"><enum>(A)</enum><text>require all
				persons that are parties to a contract with the Secretary for the acceptance,
				storage, and redelivery of crude helium to disclose, on a strictly confidential
				basis in dollars per thousand cubic feet, the weighted average price of all
				crude helium and bulk liquid helium purchased, sold, or processed by the
				persons in all qualifying domestic helium transactions during the fiscal
				year;</text>
								</subparagraph><subparagraph id="H36995B2258814361820DF19DCDCC9D9F"><enum>(B)</enum><text>appoint a
				qualified independent third party to perform data collection and analysis for
				the purposes of the survey under paragraph (4)(A); and</text>
								</subparagraph><subparagraph id="H8A520347CBF74561AAE66FA1DA05E587"><enum>(C)</enum><text>adopt such
				administrative policies and procedures as the Secretary considers necessary and
				reasonable to ensure robust protection of the confidentiality of data submitted
				by private persons.</text>
								</subparagraph></paragraph><paragraph id="HDFF83A67A9544EF4AA9F1455A4FA13ED"><enum>(6)</enum><header>Changes in
				minimum price</header><text>If the Secretary believes that the minimum price as
				determined by the survey under paragraph (4)(A) may not be reflective of the
				current market value of helium, or if a higher minimum price may result in
				greater conservation of the Federal crude helium resource, the Secretary may
				change the minimum price charged for crude helium sold under this section by up
				to 10 percent of the price determined under paragraph (4). If at any sale in
				which the minimum price is increased under this paragraph all crude helium
				offered is sold at the increased price, the Secretary shall consider that
				increased price to be the minimum price determined under paragraph (4) for all
				future sales of crude helium under this section unless that price is further
				changed in accordance with this paragraph.</text>
							</paragraph><paragraph id="HE3CC847410174DD78A58B53373E6BF46"><enum>(7)</enum><header>Ensuring fair
				acts and practices</header><text>The Secretary may issue such rules and
				regulations with respect to bidding, transfer, and refining of helium produced
				from or held in the Federal Helium Reserve as may be necessary to prevent
				unfair acts and practices.</text>
							</paragraph><paragraph id="H88370BC7777C442BA13D1DD3875EA827"><enum>(8)</enum><header>Auction
				records</header>
								<subparagraph id="H83A0FC9E59B4420A95599A28AFA7117B"><enum>(A)</enum><header>Furnishing
				records</header><text>Every person participating in auctions of helium from the
				Federal Helium Reserve shall furnish to the Secretary on request such records
				of transactions in helium auctions as the Secretary may require to reconstruct
				bidding or trading in the course of a particular inquiry or investigation being
				conducted by the Secretary for enforcement or surveillance purposes. In
				requiring information pursuant to this paragraph, the Secretary shall specify
				the information required, the period for which it is required, and the time and
				date on which the information must be furnished.</text>
								</subparagraph><subparagraph id="H4AEBF45423D3494FA3646CC0AFEB2A96"><enum>(B)</enum><header>Reporting
				requirements</header><text display-inline="yes-display-inline">The Secretary
				may issue rules to require persons participating in helium auctions to file
				such reports as the Secretary determines to be necessary for purposes of this
				Act.</text>
								</subparagraph><subparagraph id="H18CCA1BAA8CB42DB83626D8C83BFAEE8"><enum>(C)</enum><header>Recordkeeping
				requirements</header><text>Rules under this subsection may require specified
				persons to make and keep for prescribed periods such records as the Secretary
				determines are necessary or appropriate to ensure that such persons can comply
				with reporting requirements under this subsection.</text>
								</subparagraph><subparagraph id="HA950BC1D10E5452BBF65D3786F58BC89"><enum>(D)</enum><header>Limitation on
				disclosure of information</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
				the Secretary shall not be compelled to disclose any proprietary information
				required to be kept or reported under this subsection. Nothing in this
				subsection authorizes the Secretary to withhold information from Congress,
				prevents the Secretary from complying with a request for information from any
				other Federal department or agency requesting information for purposes within
				the scope of its jurisdiction, or prevents the Secretary from complying with an
				order of a court of the United States in an action brought by the United States
				or by the Secretary.</text>
								</subparagraph></paragraph></subsection><subsection id="H36CBB98B5D4D4891BFD4983273AAC64A"><enum>(e)</enum><header>Helium
				Production Fund</header>
							<paragraph id="H4BA585409F4445B3A6C407E714A9110F"><enum>(1)</enum><header>In
				general</header><text>All amounts received under this Act shall be credited to
				the Helium Production Fund, which shall be available without fiscal year
				limitation for purposes considered necessary by the Secretary to carry out this
				subsection.</text>
							</paragraph><paragraph id="H0F0254609F58404F9CBF1017F8F2DD10"><enum>(2)</enum><header>Administrative
				expenses</header><text>Amounts in the Helium Production Fund may be used by the
				Secretary to conduct helium auctions and otherwise administer this Act.</text>
							</paragraph><paragraph id="HB3FD560427C24625967F4C30A9CB33C0"><enum>(3)</enum><header>Repayment
				amounts</header><text display-inline="yes-display-inline">During the period
				described in subsection (a)(4), amounts in the Helium Production Fund in excess
				of amounts the Secretary considers necessary to conduct helium auctions and
				otherwise administer this Act shall be paid to the general fund of the Treasury
				and credited against all amounts required to be repaid to the United States
				under this Act as of October 1, 1995.</text>
							</paragraph><paragraph id="HA2A476C909A041679DD47047DC23F544"><enum>(4)</enum><header>Capital
				investments and maintenance</header><text>Amounts in the Helium Production Fund
				in excess of amounts the Secretary considers necessary to carry out paragraphs
				(1) through (3) may be used to fund the following capital investments in
				upgrades and maintenance at the Federal Helium reserve:</text>
								<subparagraph id="H522A652396DA4962908914E8E4308E3F"><enum>(A)</enum><text>Wellhead
				maintenance at the Cliffside Gas Field helium storage reservoir.</text>
								</subparagraph><subparagraph id="HC3A4FA9837EE47279383B2595C2AD59B"><enum>(B)</enum><text>Capital
				investments in maintenance and upgrades of facilities that pressurize the
				Cliffside Gas Field helium storage reservoir.</text>
								</subparagraph><subparagraph id="HF4770C5365614EF68BCF99C99B4BF673"><enum>(C)</enum><text display-inline="yes-display-inline">Capital investments in maintenance and
				upgrades of equipment related to the storage, withdrawal, transportation,
				purification, and sale of crude helium at the Cliffside Gas Field helium
				storage reservoir.</text>
								</subparagraph><subparagraph id="HD7FDB488A4B64E209308E1A411BFA1FD"><enum>(D)</enum><text display-inline="yes-display-inline">Any other scheduled or unscheduled
				maintenance of the Cliffside Gas Field helium storage reservoir and helium
				pipeline.</text>
								</subparagraph></paragraph><paragraph id="H40F5F49F26EC4C63A2932FF397A2F75E"><enum>(5)</enum><header>Excess
				funds</header><text display-inline="yes-display-inline">Amounts in the Helium
				Production Fund in excess of amounts the Secretary considers necessary to carry
				out paragraphs (1) through (4) shall be paid to the general fund of the
				Treasury.</text>
							</paragraph></subsection><subsection commented="no" id="HF54FE715F80D441EBE76916903B4496D"><enum>(f)</enum><header>Extraction of
				helium from deposits on Federal land</header><text display-inline="yes-display-inline">All amounts received by the Secretary from
				the sale or disposition of crude helium on Federal land shall be paid to the
				general fund of the Treasury and credited against all amounts required to be
				repaid to the United States under this Act as of October 1,
				1995.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5DFBCFEEA89D490A87FB1CF464990689"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
			 enactment of this Act and annually thereafter, the Secretary of the Interior
			 shall submit to the Committee on Natural Resources of the House of
			 Representatives and the Committee on Energy and Natural Resources of the Senate
			 a report describing all expenditures by the Bureau of Land Management for
			 operation and maintenance of the Federal Helium Reserve (as that term is
			 defined in the amendment made by section 2(3)), investments made by the Bureau
			 for such reserve, and scheduled or unscheduled maintenance of such reserve or
			 its infrastructure to be conducted by the Bureau.</text>
			</subsection></section><section id="HC9C76BE596E143CD9B89EAD6C9D721DC"><enum>4.</enum><header>BLM transparency
			 requirements to facilitate market and supply chain information</header><text display-inline="no-display-inline">The Helium Act (<external-xref legal-doc="usc" parsable-cite="usc/50/167">50 U.S.C. 167 et seq.</external-xref>) is
			 further amended by redesignating sections 15 through 17 as sections 17 through
			 19, and by inserting after section 14 the following:</text>
			<quoted-block display-inline="no-display-inline" id="H6FB0052E933149CEBF122353E76E3436" style="OLC">
				<section id="HA442EFD8BF0E41F49A452BEE0B9D9EE6"><enum>15.</enum><header>Pipeline
				access</header>
					<subsection id="HA7ED30B1927B4275BCA5D467134536D5"><enum>(a)</enum><header>Annual
				report</header><text display-inline="yes-display-inline">The Secretary, acting
				through the Bureau of Land Management, shall make available on the Internet the
				current refining capacity on the Federal Helium Reserve pipeline,
				including—</text>
						<paragraph id="H4F19D6DE52D545B6B698AE5372079629"><enum>(1)</enum><text>refinery capacity
				and future capacity estimates;</text>
						</paragraph><paragraph id="HD62398CBE5F84A8291BA8AE349CA1C2E"><enum>(2)</enum><text display-inline="yes-display-inline">ownership of federally auctioned helium
				held in the Federal Helium Reserve;</text>
						</paragraph><paragraph id="H805B9618B7AB47C386609B63F4E0AEBD"><enum>(3)</enum><text>volume of helium
				delivered to individual buyers through such pipeline;</text>
						</paragraph><paragraph id="HE856401FB110431EA353A8AA9B253AA1"><enum>(4)</enum><text>pipeline pressure
				constraints; and</text>
						</paragraph><paragraph id="HCBC2A0F2BBBC4F4B9178A5896D2D00DE"><enum>(5)</enum><text>other factors that
				will increase transparency for persons interested in entering refining
				contracts with existing refiners.</text>
						</paragraph></subsection><subsection id="H10D8225C49B24CDDAB77B5EB89AAA242"><enum>(b)</enum><header>New refining
				capacity</header><text display-inline="yes-display-inline">The Secretary shall
				take any applications for new refining capacity on the Federal Helium Reserve
				pipeline. To create more competition, any new refining capacity added to the
				Federal Helium Reserve pipeline system shall be granted access to crude helium
				that is equal to the access provided to existing refining facilities.</text>
					</subsection><subsection id="H780B572D1E3D4B87B16E9CF1CF52C22D"><enum>(c)</enum><header>Access by
				purchasers of helium</header><text display-inline="yes-display-inline">The
				Secretary shall manage Federal Helium Reserve pipeline access in a competitive
				manner to ensure that all persons purchasing helium have equal access to timing
				and delivery of the helium, subject to the capacity of the system.</text>
					</subsection><subsection id="H51E359383CAE46449792906A101C24B2"><enum>(d)</enum><header>Scheduling
				deliveries</header><text display-inline="yes-display-inline">The Secretary
				shall, to the greatest extent practicable, make the scheduling of crude helium
				deliveries through the Federal Helium Reserve pipeline open and transparent to
				all purchasers of helium through the auction process, and to the public if the
				Secretary believes that it is in the national interest.</text>
					</subsection></section><section id="H699EE5F9FA0643F8B6EBF0289B988CA9"><enum>16.</enum><header>BLM reporting
				requirements to facilitate supply chain information</header>
					<subsection id="HFD9E390FAFDE487BBC17AE5888EDF976"><enum>(a)</enum><header>In
				general</header><text>In order to provide the market with appropriate and
				timely information affecting the helium resource, the Director of the Bureau of
				Land Management shall establish, no later than 90 days after the date of
				enactment of the <short-title>Responsible Helium
				Administration and Stewardship Act</short-title>, a real-time reporting
				process, including reporting over the Internet, to provide data that will
				affect the helium industry, including such effects for all persons in such
				industry from crude helium suppliers to end users.</text>
					</subsection><subsection id="H22E7A27C45114C1BA8ED91FE40B5B064"><enum>(b)</enum><header>Included
				information</header><text>Information provided under this section shall include
				the following:</text>
						<paragraph id="H4516B5581CFE4633991AEC2E208AA8E3"><enum>(1)</enum><text>Annual maintenance
				schedules and quarterly updates thereof, which shall be available on the
				Internet, to the extent practicable, and shall include the following:</text>
							<subparagraph id="H9EB207207ABC44219B9AEEEC290567E5"><enum>(A)</enum><text display-inline="yes-display-inline">The date and duration of planned shutdowns
				of the Federal Helium Reserve pipeline.</text>
							</subparagraph><subparagraph id="HFECBF3565BF34606B767CAFC2AA9CAC8"><enum>(B)</enum><text>The nature of work
				to be undertaken, whether routine, extended, or extraordinary.</text>
							</subparagraph><subparagraph id="HB8A3F3BD2EF8438183B5F8113450738C"><enum>(C)</enum><text>The anticipated
				impact on the helium supply.</text>
							</subparagraph><subparagraph id="HF1A0A637C23148C0A93936EDFF688E55"><enum>(D)</enum><text>The efforts to
				minimize any impact on the supply chain.</text>
							</subparagraph><subparagraph id="HEACA62523FA543B18CF6660E196CC6B9"><enum>(E)</enum><text display-inline="yes-display-inline">Any concerns regarding maintenance of the
				Federal Helium Reserve pipeline, pressure of such pipeline, or deviation from
				normal operation of such pipeline.</text>
							</subparagraph></paragraph><paragraph id="HF5DAAECACEBE4181A68F5F1F6ED65941"><enum>(2)</enum><text display-inline="yes-display-inline">For each unplanned outage, the
				following:</text>
							<subparagraph id="H5D248E021857464FB2A3C755B38BFCC8"><enum>(A)</enum><text>The beginning of
				the outage.</text>
							</subparagraph><subparagraph id="H91CE60AB78144A1E87420172F232F5E3"><enum>(B)</enum><text>The expected
				duration of outage.</text>
							</subparagraph><subparagraph id="H52C190E4A9C94A6DAE13E3A9A092954B"><enum>(C)</enum><text>A description of
				the problem.</text>
							</subparagraph><subparagraph id="H5496B5C980134DF487F311AF1C66EA7B"><enum>(D)</enum><text>The estimated
				impact on helium supply.</text>
							</subparagraph><subparagraph id="H9DE219F358534A06A83AD18732A9FC57"><enum>(E)</enum><text>A plan to correct
				problems, an estimate of the potential timeframe for correction, and the
				likelihood of plan success within the timeframe.</text>
							</subparagraph><subparagraph id="HE7B4CFE044324E1580A088A38E4A76A9"><enum>(F)</enum><text>Efforts to
				minimize negative impacts on the helium supply chain.</text>
							</subparagraph><subparagraph id="H1CD309F138BE4B4D8E3B6BE47C3CAED1"><enum>(G)</enum><text>Updates on repair
				status and the anticipated online date.</text>
							</subparagraph></paragraph><paragraph id="H65EE4D0D40E647FEB343431FF1F96CC1"><enum>(3)</enum><text>Minutes of
				meetings between the Bureau of Land Management and the Cliffside Refiners
				Limited Partnership, including—</text>
							<subparagraph id="H50A6FF233B5B45BA8FC2A7300AA1D4C9"><enum>(A)</enum><text display-inline="yes-display-inline">publication of the minutes of each meeting
				between the Bureau of Land Management and the Cliffside Refiners Limited
				Partnership, including attendees and their affiliations, on the Internet site
				of the Bureau within 1 week after the meeting; and</text>
							</subparagraph><subparagraph id="H1420FB1A6A17474C9FD55D4FB845D49D"><enum>(B)</enum><text display-inline="yes-display-inline">indication in the minutes of any action
				taken that could affect the supply or operating status related to the Federal
				helium program.</text>
							</subparagraph></paragraph><paragraph id="HA72F9A65E27E4C178946CBAB663C33FA"><enum>(4)</enum><text display-inline="yes-display-inline">Current predictions of the lifespan of the
				Federal Helium Reserve, including how much longer such crude helium supply will
				be available based on current and forecasted demand and the projected maximum
				production capacity of the Federal Helium Reserve for the following fiscal
				year.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H32DD4751B4BE492C895A2A8B1DB47187"><enum>5.</enum><header>Helium resource
			 assessment and helium–3 separation</header>
			<subsection id="HF2388C35DA0A4CE99F0203C81BA9B359"><enum>(a)</enum><header>Helium gas
			 resource assessment</header><text display-inline="yes-display-inline">Not later
			 than 2 years after the date of enactment of this Act, the Secretary of the
			 Interior shall—</text>
				<paragraph id="H4C2C59DBB4594A07BFE907F77A35B82A"><enum>(1)</enum><text>in coordination
			 with appropriate heads of State geological surveys—</text>
					<subparagraph id="HB631F4C14A5045C7B75040CD23CC6BDF"><enum>(A)</enum><text>complete a
			 national helium gas assessment that identifies and quantifies the quantity of
			 helium, including the isotope helium-3, in each reservoir, including
			 assessments of the constituent gases found in each helium resource, such as
			 carbon dioxide, nitrogen, and natural gas; and</text>
					</subparagraph><subparagraph id="H3533D3628CF243CAAEDB058D06A67DAC"><enum>(B)</enum><text>make available the
			 modern seismic and geophysical log data for characterization of the Bush Dome
			 Reservoir;</text>
					</subparagraph></paragraph><paragraph id="HB2EF3CB7B0F54E51A484D2A9F1127E9A"><enum>(2)</enum><text>in coordination
			 with appropriate international agencies and the global geology community,
			 complete a global helium gas assessment that identifies and quantifies the
			 quantity of the helium, including the isotope helium-3, in each
			 reservoir;</text>
				</paragraph><paragraph id="H35E7BDE840AB46ABBDEFA6A6B3FA5664"><enum>(3)</enum><text>in consultation
			 with the Secretary of Energy, acting through the Administrator of the Energy
			 Information Administration, complete—</text>
					<subparagraph id="HAEF8AD58ACA746F396312E364838392D"><enum>(A)</enum><text>an assessment of
			 trends in global demand for helium, including the isotope helium-3;</text>
					</subparagraph><subparagraph id="HB7028EF2AD1F41FF9B350B4EF12E3D33"><enum>(B)</enum><text>a 10-year forecast
			 of domestic demand for helium across all sectors, including scientific and
			 medical research, commercial, manufacturing, space technologies, cryogenics,
			 and national defense; and</text>
					</subparagraph><subparagraph id="HA9893CA85A5C495E86F999AA0C1EB5F9"><enum>(C)</enum><text>an inventory of
			 medical, scientific, industrial, commercial, and other uses of helium in the
			 United States, including Federal and commercial helium uses, that identifies
			 the nature of the helium use, the amounts required, the technical and
			 commercial viability of helium recapture and recycling in that use, and the
			 availability of material substitutes wherever possible; and</text>
					</subparagraph></paragraph><paragraph id="HB47CE33904C143A2BE5A12D61E2F64ED"><enum>(4)</enum><text>submit to the
			 Committee on Natural Resources of the House of Representatives and the
			 Committee on Energy and Natural Resources of the Senate a report describing the
			 results of the assessments required under this subsection.</text>
				</paragraph></subsection><subsection id="HA0F1F17F96724C109FB116E9979E7F33"><enum>(b)</enum><header>Helium-3
			 separation</header>
				<paragraph id="H7579DB91FF324910A4572B95CA7225F7"><enum>(1)</enum><header>Interagency
			 cooperation</header><text display-inline="yes-display-inline">The Secretary of
			 the Interior shall cooperate with the Secretary of Energy, or a designee of the
			 Secretary of Energy, on any assessment or research relating to the extraction
			 and refining of the isotope helium-3 from crude helium at the Federal Helium
			 Reserve (as that term is defined in the amendments made by section 2) or along
			 the Federal Helium Reserve pipeline system, including—</text>
					<subparagraph id="H5F71C8083C474A43AA65C291E8EA5D60"><enum>(A)</enum><text>gas
			 analysis;</text>
					</subparagraph><subparagraph id="H4A2FF29102384CF497F365CF324CA7F4"><enum>(B)</enum><text>infrastructure
			 studies; and</text>
					</subparagraph><subparagraph id="H0AAB35CB5C43429094032143EE6B8C5F"><enum>(C)</enum><text>cooperation with
			 private helium refiners.</text>
					</subparagraph></paragraph><paragraph id="H2E51146A1F4D454686F835B784D5C172"><enum>(2)</enum><header>Feasibility
			 study</header><text>The Secretary of the Interior shall assess the feasibility
			 of establishing a facility to separate the isotope helium-3 from crude helium
			 at—</text>
					<subparagraph id="H2C8DDC22B92047908FF10D3635FD87DC"><enum>(A)</enum><text>the Federal Helium
			 Reserve; or</text>
					</subparagraph><subparagraph id="H9C5A9C30DD284CB5AF23A41BEBFBE08E"><enum>(B)</enum><text display-inline="yes-display-inline">an existing helium separation or
			 purification facility connected to the Federal Helium Reserve pipeline
			 system.</text>
					</subparagraph></paragraph><paragraph id="H254B8CA64A754A2EA998DD2D4E48150F"><enum>(3)</enum><header>Report</header><text>Not
			 later than 1 year after the date of enactment of this Act, the Secretary of the
			 Interior shall submit to the Committee on Natural Resources of the House of
			 Representatives and the Committee on Energy and Natural Resources of the Senate
			 a report that contains a description of the results of the assessments
			 conducted under this subsection.</text>
				</paragraph></subsection></section></legis-body>
