		</section><section id="H1CDFE1823A3B4A43BCE48F63D141CFA6"><enum>3.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="HABCA467D434B498D904EE08CEB88E9B9"><enum>(1)</enum><text display-inline="yes-display-inline">There is growing opportunity provided by
			 technology in classrooms, for every grade, in every subject, and for all types
			 of learners, to—</text>
				<subparagraph id="H9E12FDB718314738A8CD15526378DD1A"><enum>(A)</enum><text>ensure that
			 students are college-and-career ready; and</text>
				</subparagraph><subparagraph id="HE2D2AA085533470995E94BA10F8E2623"><enum>(B)</enum><text>access the
			 accelerating roll-out of online assessments.</text>
				</subparagraph></paragraph><paragraph id="H43126C1F2DE8400DABAFB818C70DE0B5"><enum>(2)</enum><text display-inline="yes-display-inline">Comprehensive education technology programs
			 have shown great success in improving student achievement, reducing secondary
			 school dropout rates, and improving graduation and college enrollment
			 rates.</text>
			</paragraph><paragraph id="H94331C27D7064FF28175B4761AE5781D"><enum>(3)</enum><text display-inline="yes-display-inline">Mooresville Graded School District in the
			 State of North Carolina has implemented an integrated education technology
			 initiative, which has led to its ranking as the third highest achieving
			 district in the State, with 21 percent composite achievement rate increases and
			 25 percent graduation rate increases over 5 years.</text>
			</paragraph><paragraph id="HF12366DEDC534FD68226A27A40F766D3"><enum>(4)</enum><text display-inline="yes-display-inline">At Manor New Tech High School in the State
			 of Texas, where 65 percent of students receive free or reduced price lunch
			 under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>)
			 and 75 percent are students of color, a project-based learning focus on
			 science, technology, engineering and mathematics, has led to 62 percent of
			 students being the first generation in their families to enroll in an
			 institution of higher education and a near zero secondary school dropout
			 rate.</text>
			</paragraph><paragraph id="H38732AA53C914721BA6F7A61FFFC7941"><enum>(5)</enum><text display-inline="yes-display-inline">At the City Arts and Technology High School
			 Envisions in San Francisco, California, which emphasizes personalized learning
			 environments, integration of arts and technology in project-based learning, and
			 development of deeper learning skills, 98 percent of the graduates enrolled at
			 an institution of higher education, 91 percent remained enrolled at such an
			 institution, and 100 percent met the course requirements for entrance to the
			 University of California.</text>
			</paragraph><paragraph id="HC4C9721650DE4735AB20BDEEECEC8B9A"><enum>(6)</enum><text display-inline="yes-display-inline">The Federal Government placed a strong
			 emphasis on technology professional development in the past decade, but no
			 longer provides any funding support for such activities. Annual appropriations
			 for grants awarded under the Enhancing Education through Technology Act of 2001
			 under subpart D of title II of the Elementary and Secondary Education Act of
			 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6751">20 U.S.C. 6751 et seq.</external-xref>) ended in 2010 and all funds appropriated by the
			 American Recovery and Reinvestment Act of 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/111/5">Public Law 111–5</external-xref>) for such
			 grants were to have been spent by September 2011.</text>
			</paragraph><paragraph id="H51F85E084B064700BB086D29965F20DD"><enum>(7)</enum><text>Online
			 professional development courses offer excellent opportunities for educators to
			 receive the training that they need 24 hours each day, 7 days each week.
			 However, a recent survey indicates that only 25 percent of teachers make use of
			 online professional development courses.</text>
			</paragraph><paragraph id="H6381B63262EA49BBBB6FF4512A431419"><enum>(8)</enum><text>For technology to
			 be fully integrated into classrooms and to ensure that students are
			 college-and-career ready, it is critical that school administrators are
			 confident in their abilities to use technology and thereby lead change in their
			 schools and local educational agencies. The Federal Government must invest in
			 building leadership skills and capacity for technology to truly take hold in
			 our Nation’s schools.</text>
			</paragraph></section><section id="H8D72E63BB8754A5E859BB39E7753DA38"><enum>4.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are to—</text>
			<paragraph id="H019C5C98C79E44F5AA9BAEFF24D3D273"><enum>(1)</enum><text display-inline="yes-display-inline">improve the achievement, academic growth,
			 and college-and-career readiness of students who have developed the ability to
			 think critically, apply knowledge to solve complex problems, work
			 collaboratively, communicate effectively, be self-directed, and be responsible
			 digital citizens;</text>
			</paragraph><paragraph id="HB928DAF40BD448638D578D070ADB7DC1"><enum>(2)</enum><text>ensure all
			 students have access to individualized, rigorous, and engaging digital learning
			 experiences;</text>
			</paragraph><paragraph id="H2C8B9F81B1104F5CB27CF56E5DE4CF12"><enum>(3)</enum><text>ensure that
			 educators have the knowledge and skills to develop and implement digital
			 learning curriculum, use technology effectively in order to personalize and
			 strengthen instruction, and effectively deliver and utilize assessments to
			 measure student outcomes and support student success;</text>
			</paragraph><paragraph id="HAF476CB83FAE455E99B92726CCE693A6"><enum>(4)</enum><text>ensure that
			 administrators have the leadership, management, knowledge, and skills to
			 design, develop, and implement a school or local educational agency-wide
			 digital age learning environment;</text>
			</paragraph><paragraph id="HE24A9BD74A834547A913FD5C2492FAA3"><enum>(5)</enum><text>improve the
			 efficiency and productivity of education through technology;</text>
			</paragraph><paragraph commented="no" id="H36532516CB8D40C2990FDF7FB7EBEBF8"><enum>(6)</enum><text display-inline="yes-display-inline">address the connectivity needs of local
			 educational agencies and educational service agencies that are eligible for
			 support under the E-rate program without duplicating the support available
			 under such program; and</text>
			</paragraph><paragraph id="H60B2EC48ADC24B3580F4D7993D374FB5"><enum>(7)</enum><text>ensure that State
			 educational agencies, local educational agencies, and elementary schools and
			 secondary schools have the technological capacity and infrastructure to meet
			 purposes described in paragraphs (1) through (6).</text>
			</paragraph></section><section commented="no" id="HDE330511E64A400F9925A2004523B7DD"><enum>5.</enum><header>E-rate
			 restriction</header><text display-inline="no-display-inline">Funds awarded
			 under this Act may be used to address the networking needs of a recipient of
			 such funds for which the recipient is eligible to receive support under the
			 E-rate program, except that such funds may not be duplicative of support
			 received by the recipient under the E-rate program.</text>
		</section><section id="H5CFAADCF289E4D11B8145E08834107CA"><enum>6.</enum><header>Rule of
			 construction regarding purchasing</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to
			 permit a recipient of funds under this Act to purchase goods or services using
			 such funds without ensuring that the purchase is free of any conflict of
			 interest between such recipient, or any partner of such recipient, and the
			 person or entity receiving such funds.</text>
		</section><section id="H2B261B17A8864136BFE65ABB42136C19"><enum>7.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H0C1018F16CAF4B07A2D709EA08888B80"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Except as otherwise
			 provided in this Act, any term that is defined in section 9101 of the
			 Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>) has the meaning
			 given the term in such section.</text>
			</paragraph><paragraph id="HFDB239AA13DD45ED82A787FADBE92D7A"><enum>(2)</enum><header>Digital
			 learning</header><text>The term <quote>digital learning</quote> means any
			 instructional practice that effectively uses technology to strengthen a
			 student’s learning experience and encompasses a wide spectrum of tools and
			 practices, including—</text>
				<subparagraph id="H002D4B3956E14EB88F066DFF1AB50C69"><enum>(A)</enum><text>interactive
			 learning resources that engage students in academic content;</text>
				</subparagraph><subparagraph id="HDDE3743414DB4FA2B31ECF24999D7F94"><enum>(B)</enum><text>access to online
			 databases and other primary source documents;</text>
				</subparagraph><subparagraph id="HCEDDD53BCD6346FBA5DB3C933BA2C4F6"><enum>(C)</enum><text>the use of data to
			 personalize learning and provide targeted supplementary instruction;</text>
				</subparagraph><subparagraph id="H005C05A634C140B8B9FF9628BC79D41B"><enum>(D)</enum><text>student
			 collaboration with content experts and peers;</text>
				</subparagraph><subparagraph id="H8A0FF20ADE3D4E13A26E7A7D3554DD9D"><enum>(E)</enum><text>online and
			 computer-based assessments;</text>
				</subparagraph><subparagraph id="HF16C12210C7E436B8FFEDC62B2E2565B"><enum>(F)</enum><text>digital content,
			 adaptive, and simulation software or courseware,</text>
				</subparagraph><subparagraph id="HAB785B6E0CE04E80B43D35E3D4736B7D"><enum>(G)</enum><text>online courses,
			 online instruction, or digital learning platforms;</text>
				</subparagraph><subparagraph id="H658AC5CF706F48F6BEB3BA3B12D128D1"><enum>(H)</enum><text>mobile and
			 wireless technologies for learning in school and at home;</text>
				</subparagraph><subparagraph id="H76A928594C1A474A8D314C051D5DE106"><enum>(I)</enum><text>learning
			 environments that allow for rich collaboration and communication;</text>
				</subparagraph><subparagraph id="H56EC09FC9B254599958E01D6C512F1E3"><enum>(J)</enum><text>authentic
			 audiences for learning in a relevant, real world experience;</text>
				</subparagraph><subparagraph id="H54A97D891E03455EBB90B62F10323783"><enum>(K)</enum><text>teacher
			 participation in virtual professional communities of practice; and</text>
				</subparagraph><subparagraph id="HFBBAA5D4C18E4B50A2BD8499C9FC8991"><enum>(L)</enum><text>hybrid or blended
			 learning, which occurs under direct instructor supervision at a school or other
			 location away from home and, at least in part, through online delivery of
			 instruction with some element of student control over time, place, path, or
			 pace.</text>
				</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H195FE76B55A64CBC913E38D3DA90D21B"><enum>(3)</enum><header>Eligible
			 partnership</header><text>The term <quote>eligible partnership</quote> means a
			 partnership that includes—</text>
				<subparagraph id="H080D339FF4994A4D8FC5DC2CC88E311C"><enum>(A)</enum><text>not less than
			 1—</text>
					<clause id="H52B0391DC849421BAC53C4D549723B42"><enum>(i)</enum><text>State educational
			 agency; or</text>
					</clause><clause id="H79639F02344E45D68FEF2EA6B3ED483A"><enum>(ii)</enum><text>local educational
			 agency or consortium of local educational agencies; and</text>
					</clause></subparagraph><subparagraph id="HB8F2B8112A014DCC9ACC29118159338D"><enum>(B)</enum><text>not less than
			 1—</text>
					<clause id="H8C0DF1EE7A9C4DAB849773A4F5025826"><enum>(i)</enum><text display-inline="yes-display-inline">local educational agency, educational
			 service agency, consortium of local educational agencies, or consortium of
			 educational service agencies;</text>
					</clause><clause id="H8C45673762984A7197D09BC85BB7336B"><enum>(ii)</enum><text>institution of
			 higher education;</text>
					</clause><clause id="HF0D823E4F5D2424592A69A38D86AFC34"><enum>(iii)</enum><text>nonprofit or
			 community-based organization; or</text>
					</clause><clause id="HF726E4F7255144439801E2596ACF58C2"><enum>(iv)</enum><text>business or
			 for-profit organization.</text>
					</clause></subparagraph></paragraph><paragraph id="HF047C118AEE145A2BB1B640271AC5A81"><enum>(4)</enum><header>Eligible
			 technology</header><text>The term <quote>eligible technology</quote> means
			 modern information, computer, and communication technology hardware, software,
			 services, or tools, including computer or mobile hardware devices and other
			 computer and communications hardware, software applications, systems and
			 platforms, and digital and online content, courseware, and online instruction
			 and other online services and supports.</text>
			</paragraph><paragraph id="H20408CAF07F540D49C811A5D83ADDDC0"><enum>(5)</enum><header>E-rate
			 program</header><text display-inline="yes-display-inline">The term
			 <quote>E-rate program</quote> means the Schools and Libraries Universal Service
			 Support Mechanism.</text>
			</paragraph><paragraph display-inline="no-display-inline" id="H0FBE0443DCE440758C96DFFCEEFB10C2"><enum>(6)</enum><header>Professional
			 development</header><text>The term <quote>professional development</quote> is a
			 process of continuous improvement for teachers and school leaders that improves
			 educator knowledge, skills, and practice toward the goal of increased student
			 achievement and—</text>
				<subparagraph id="H217EF7040F2D44729D6275EA69D7944C"><enum>(A)</enum><text>is intensive,
			 ongoing, connected to practice, and on-site where allowable;</text>
				</subparagraph><subparagraph id="H96B8659A86034EFCB07C197641C89294"><enum>(B)</enum><text>is focused on
			 student learning and addresses the teaching of specific curriculum
			 content;</text>
				</subparagraph><subparagraph id="HC86DFC8C108A4F76A72CCD70A3C9D5A1"><enum>(C)</enum><text>is aligned with
			 school improvement priorities and goals of the school and local educational
			 agency; and</text>
				</subparagraph><subparagraph id="H0DBA234764C6420EB272883C0FFA60D0"><enum>(D)</enum><text>builds strong
			 working relationships among teachers and school leaders that—</text>
					<clause id="H9B23D4E812384585BD0D19F5680A3F6D"><enum>(i)</enum><text>may
			 be built around active professional learning communities; and</text>
					</clause><clause id="HBFDC5979AA884F7487931524FD492E2E"><enum>(ii)</enum><text>may
			 contain on-demand components, such as instructional videos, training documents,
			 or learning modules.</text>
					</clause></subparagraph></paragraph><paragraph id="HE76A4F0743564A769793EF899182E0F1"><enum>(7)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of Education.</text>
			</paragraph><paragraph id="H85E794FC2E5047A09887E86824FE2F7C"><enum>(8)</enum><header>Student
			 technology literacy</header><text display-inline="yes-display-inline">The term
			 <quote>student technology literacy</quote> means student knowledge and skills
			 in using contemporary information, communication, and learning technologies in
			 a manner necessary for successful employment, lifelong learning, and
			 citizenship in the knowledge-based, digital, and global 21st century,
			 including, at a minimum, the ability to—</text>
				<subparagraph id="HBC59E4B1FD3C4857A418F90A02C7C500"><enum>(A)</enum><text>effectively
			 communicate and collaborate;</text>
				</subparagraph><subparagraph id="HB4D5BCF30EE64372B0A1EE138C3FA412"><enum>(B)</enum><text>analyze and solve
			 problems;</text>
				</subparagraph><subparagraph id="H5EE395652808466C9ACC37F1FD250BEA"><enum>(C)</enum><text>access, evaluate,
			 manage, and create information and otherwise gain information literacy;</text>
				</subparagraph><subparagraph id="H5BFF6099DB4C4E09BF42B6285E64B186"><enum>(D)</enum><text>demonstrate
			 creative thinking, construct knowledge, and develop innovative products and
			 processes; and</text>
				</subparagraph><subparagraph id="HF544D35FE4D34D269BA86DEA5BBF7CAC"><enum>(E)</enum><text>carry out the
			 activities described in subparagraphs (A) through (D) in a safe and ethical
			 manner.</text>
				</subparagraph></paragraph><paragraph id="HA4D2CA57334847C6ADF511B283DB23F5"><enum>(9)</enum><header>Technology
			 readiness survey</header><text display-inline="yes-display-inline">The term
			 <quote>technology readiness survey</quote> means a survey completed by a local
			 educational agency that provides standardized information comparable to the
			 information collected through the technology readiness survey administered
			 under the Race to the Top Assessment program under section 14006 of division A
			 of the American Recovery and Reinvestment Act of 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/111/5">Public Law 111–5</external-xref>) on the
			 quantity and types of technology infrastructure and access available to the
			 students served by the local educational agency, including computer devices,
			 Internet connectivity, operating systems, related network infrastructure, data
			 systems, and—</text>
				<subparagraph id="HB1C846C6CFC74B108B79839F8AFD5409"><enum>(A)</enum><text>requiring—</text>
					<clause id="HC922ABA2971A40BBBBF8C3E56CE328A3"><enum>(i)</enum><text>an
			 internal review of the degree to which instruction, additional student support,
			 and professional development is delivered in digital formats, media, and
			 platforms and is available to students and educators at any time;</text>
					</clause><clause id="H328C69681394459AB76FD5A90E62E026"><enum>(ii)</enum><text>an
			 internal review of the ability of educators to use assessments and other
			 student data to personalize and strengthen instruction and identify
			 professional development needs and priorities; and</text>
					</clause><clause id="H69EF70A9615D4B91BD87C1B67F100DF3"><enum>(iii)</enum><text>any other
			 information required by the State educational agency serving the local
			 educational agency; and</text>
					</clause></subparagraph><subparagraph commented="no" id="H32FE3CADD02F400D86984A269A696E7B"><enum>(B)</enum><text display-inline="yes-display-inline">may include an assessment of local
			 community needs to ensure students have adequate on-line access and access to
			 devices for school-related work during out-of-school time.</text>
				</subparagraph></paragraph><paragraph commented="no" id="HF9041ADAE4CF4689B2B5A1A487DAC11A"><enum>(10)</enum><header>Universal
			 design for learning</header><text display-inline="yes-display-inline">The term
			 <quote>universal design for learning</quote> has the meaning given the term in
			 section 103 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1003">20 U.S.C. 1003</external-xref>).</text>
			</paragraph></section><title id="H882AD7EF7CB049C0987EF43BE1A6C5AA"><enum>I</enum><header>Technology
			 Readiness and Access</header>
			<section id="H80F55E9AF16E49C0AA87F36CCEBBB943"><enum>101.</enum><header>Technology
			 grants program authorized</header>
				<subsection id="H5F78DB6F3FD34FBE9A5F4C5A4A439ED5"><enum>(a)</enum><header>In
			 general</header><text>From the amounts appropriated under
			 <internal-xref idref="HCFD8A10AEBC34B80B4BD6CCCBF169515" legis-path="106.">section 106</internal-xref>, the Secretary shall award State
			 Grants for Technology Readiness and Access (in this title referred to as
			 <quote>grants</quote>) to State educational agencies to strengthen State and
			 local technological infrastructure and professional development that supports
			 digital learning through State activities under
			 <internal-xref idref="H7BB49FF211CB4D9E9880CE4A313F90E7" legis-path="103.(c)">section 103(c)</internal-xref> and local activities under
			 <internal-xref idref="H84ABBFB17FA44F3AA0DC785B2DBEECF3" legis-path="104.">section 104(c)</internal-xref>.</text>
				</subsection><subsection id="H4E38D48CA2424D8A96B7EB51CDC307CC"><enum>(b)</enum><header>Grants to State
			 educational agencies</header>
					<paragraph id="HD06E4CED9F84462B81DA42C19D96CE76"><enum>(1)</enum><header>Reservations</header><text>From
			 the amounts appropriated under
			 <internal-xref idref="HCFD8A10AEBC34B80B4BD6CCCBF169515" legis-path="106.">section 106</internal-xref> for any fiscal year, the
			 Secretary shall reserve—</text>
						<subparagraph id="HA9C84AC8980645AD9BF5D669B05AD83B"><enum>(A)</enum><text>three-fourths of 1
			 percent for the Secretary of Interior to provide assistance under this title
			 for schools operated or funded by the Bureau of Indian Education; and</text>
						</subparagraph><subparagraph id="H5587D8C291BB4F3490EBAA28C283F1D9"><enum>(B)</enum><text>1 percent to
			 provide assistance under this title to the outlying areas; and</text>
						</subparagraph></paragraph><paragraph id="H70477C1124F444568CFC954E5CBBFDAB"><enum>(2)</enum><header>Grants</header><text display-inline="yes-display-inline">From the amounts appropriated under
			 <internal-xref idref="HCFD8A10AEBC34B80B4BD6CCCBF169515" legis-path="106.">section 106</internal-xref> for any fiscal year and remaining
			 after the Secretary makes reservations under
			 <internal-xref idref="HD06E4CED9F84462B81DA42C19D96CE76" legis-path="101.(b)(1)">paragraph (1)</internal-xref>, the Secretary shall make
			 a grant for the fiscal year to each State educational agency with an approved
			 application under
			 <internal-xref idref="H0C224D78C676472E935BA90D58396A94" legis-path="102.">section 102</internal-xref> in an amount that bears the same
			 relationship to such remainder as the amount the State educational agency
			 received under part A of title I of the Elementary and Secondary Education Act
			 of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311 et seq.</external-xref>) for such year bears to the amount all State
			 educational agencies with an approved application under
			 <internal-xref idref="H0C224D78C676472E935BA90D58396A94" legis-path="102.">section 102</internal-xref> received under such part (20
			 U.S.C. 6311 et seq.) for such year.</text>
					</paragraph></subsection><subsection id="HC77160EA9E114147ACF77FE1F7654070"><enum>(c)</enum><header>Minimum</header><text>The
			 amount of a grant to a State educational agency under
			 <internal-xref idref="H70477C1124F444568CFC954E5CBBFDAB" legis-path="102.(b)(2)">subsection (b)(2)</internal-xref> for a fiscal year may
			 not be less than one-half of 1 percent of the total amount made available for
			 grants to all State educational agencies under such subsection for such
			 year.</text>
				</subsection><subsection id="H59F2F138098E47238826FEF580542BFE"><enum>(d)</enum><header>Reallotment of
			 unused funds</header><text>If any State educational agency does not apply for a
			 grant under
			 <internal-xref idref="H70477C1124F444568CFC954E5CBBFDAB" legis-path="102.(b)(2)">subsection (b)(2)</internal-xref> for a fiscal year, or
			 does not use its entire grant under
			 <internal-xref idref="H70477C1124F444568CFC954E5CBBFDAB" legis-path="102.(b)(2)">subsection (b)(2)</internal-xref> for such year, the
			 Secretary shall reallot the amount of the State educational agency’s grant, or
			 the unused portion of the grant, to the remaining State educational agencies
			 that use their entire grant amounts under subsection (b)(2) for such
			 year.</text>
				</subsection><subsection id="H96526BE97F10417DAABF8F9AA3B70D2B"><enum>(e)</enum><header>Matching
			 funds</header>
					<paragraph id="HDBFCF9798330438CAE9CA1EB0EAF2F5C"><enum>(1)</enum><header>In
			 general</header><text>A State educational agency that receives a grant under
			 <internal-xref idref="H70477C1124F444568CFC954E5CBBFDAB" legis-path="102.(b)(2)">subsection (b)(2)</internal-xref> shall provide
			 matching funds, from non-Federal sources, in an amount equal to 20 percent of
			 the amount of grant funds provided to the State educational agency to carry out
			 the activities supported by the grant. Such matching funds may be provided in
			 cash or in-kind, except that any such in-kind contributions shall be provided
			 for the purpose of supporting the State educational agency’s activities under
			 <internal-xref idref="H67AE16D358234753A4028380881B3AFD" legis-path="104.(c)">section 104(c)</internal-xref>.</text>
					</paragraph><paragraph id="H2353D74A69194B34A3257701F2A87294"><enum>(2)</enum><header>Waiver</header><text>The
			 Secretary may waive the matching requirement under
			 <internal-xref idref="HDBFCF9798330438CAE9CA1EB0EAF2F5C" legis-path="101.(e)(1)">paragraph (1)</internal-xref> for a State educational
			 agency that demonstrates that such requirement imposes an undue financial
			 hardship on the State educational agency.</text>
					</paragraph></subsection></section><section id="H0C224D78C676472E935BA90D58396A94"><enum>102.</enum><header>State
			 applications</header>
				<subsection id="H05E35720EAEE4C4FB930E821AE7170FE"><enum>(a)</enum><header>Application</header><text>To
			 receive a grant under
			 <internal-xref idref="H70477C1124F444568CFC954E5CBBFDAB" legis-path="101.(b)(2)">section 101(b)(2)</internal-xref>, a State educational
			 agency shall submit to the Secretary an application at such time and in such
			 manner as the Secretary may require and containing the information described in
			 <internal-xref idref="HF2E17FA6F68A4D24B7FDFA444F0BC23B" legis-path="102.(b)">subsection (b)</internal-xref>.</text>
				</subsection><subsection id="HF2E17FA6F68A4D24B7FDFA444F0BC23B"><enum>(b)</enum><header>Contents</header><text>Each
			 application submitted under
			 <internal-xref idref="H05E35720EAEE4C4FB930E821AE7170FE" legis-path="102.(a)">subsection (a)</internal-xref> shall include the
			 following:</text>
					<paragraph id="HFA14DE73F2694EDCA55E7134575AE5B7"><enum>(1)</enum><text>A
			 description of how the State educational agency will meet the following
			 goals:</text>
						<subparagraph id="H3526C1E9A46A4BE3A12C068453318243"><enum>(A)</enum><text>Use technology to
			 ensure all students achieve college-and-career readiness and technology
			 literacy, including by providing high-quality education opportunities to
			 economically or geographically isolated student populations.</text>
						</subparagraph><subparagraph id="H82A0991347A04AC6A4CB89E4D51E9084"><enum>(B)</enum><text>Provide educators
			 with the tools, devices, content, and resources to—</text>
							<clause id="H32D75975C93440FB871BEA07399CFD05"><enum>(i)</enum><text>significantly
			 improve teaching and learning, including support to increase personalization
			 for and engagement of students in pursuit of college-and-career readiness and
			 technology literacy; and</text>
							</clause><clause id="HBE2ACBBC99554CA18ACD65C4807C83EB"><enum>(ii)</enum><text>develop and use
			 assessments to improve instruction consistent with the principles of universal
			 design for learning, including for students with disabilities and
			 English-language learners.</text>
							</clause></subparagraph><subparagraph id="H78A00B1E850F469E8D83CB88578E2B78"><enum>(C)</enum><text>Ensure
			 administrators and school leaders have the flexibility and capacity to develop
			 and manage systems to carry out activities described in subparagraphs (A) and
			 (B), and support administrators and school leaders in utilizing technology to
			 promote equity and increase efficiency and productivity.</text>
						</subparagraph><subparagraph id="H52B04E1B25FB4352B6C34A6883B5CAB9"><enum>(D)</enum><text display-inline="yes-display-inline">Enable local educational agencies to build
			 the technological capacity and infrastructure (including through local
			 purchasing of eligible technology), necessary for the full implementation of
			 on-line assessments for all students, (including students with disabilities and
			 English-language learners) and to—</text>
							<clause id="HF4332A3B6AE24D679F21BC8C779B9685"><enum>(i)</enum><text>ensure the
			 interoperability of data systems and eligible technology; and</text>
							</clause><clause id="HDC855B84313F4A2BAC58C7AE16C0A485"><enum>(ii)</enum><text>carry out
			 subparagraphs (A) through (C).</text>
							</clause></subparagraph></paragraph><paragraph id="H26B967F8187640F4B26CC925ACBEDBCD"><enum>(2)</enum><text>A
			 description of the results of the technology readiness in the State as
			 determined by local educational agency responses to the technology readiness
			 survey, including—</text>
						<subparagraph id="H51B64608706B42C4BB6DBC23532343E2"><enum>(A)</enum><text display-inline="yes-display-inline">the status of the ability of each local
			 educational agency served by the State educational agency to meet the goals
			 described in
			 <internal-xref idref="H22E8BA4BCF364536B918715B3D0965FF" legis-path="104.(b)(1)">section 104(b)(1)</internal-xref>;</text>
						</subparagraph><subparagraph id="HBF818CE5256E4A7FB6E4DB93AEA7B6F4"><enum>(B)</enum><text>an assurance that
			 not less 90 percent of the local educational agencies served by the State
			 educational agency have completed and submitted the technology readiness survey
			 to the State educational agency; and</text>
						</subparagraph><subparagraph id="H8920395390514C21A3A2171F978491B7"><enum>(C)</enum><text>an assurance that
			 the results of the technology readiness survey for each such local educational
			 agency are made available to the Secretary and the public through the Website
			 of the local educational agency.</text>
						</subparagraph></paragraph><paragraph commented="no" id="H28B6302165E146A9819921863B444307"><enum>(3)</enum><text>A description of
			 the plan for the State educational agency to support each local educational
			 agency served by the State educational agency in meeting the goals described in
			 <internal-xref idref="H22E8BA4BCF364536B918715B3D0965FF" legis-path="104.(b)(1)">section 104(b)(1)</internal-xref> not later than 3
			 years after the local educational agency completes the technology readiness
			 survey by addressing the readiness gaps identified in such survey.</text>
					</paragraph><paragraph id="HB711FEF976514B8A858D6517C0905010"><enum>(4)</enum><text>A
			 description of the State’s process for the adoption, acquisition, distribution,
			 and use of content, how the State will ensure integrity of such processes, and
			 how such processes support the goals under
			 <internal-xref idref="HFA14DE73F2694EDCA55E7134575AE5B7" legis-path="102.(b)(1)">paragraph (1)</internal-xref> or how a State will
			 change such processes to support such goals, and how the State will ensure
			 content quality.</text>
					</paragraph><paragraph id="H9B313CA727884AFB95AAD724C082FCD5"><enum>(5)</enum><text display-inline="yes-display-inline">A description of how the State educational
			 agency will ensure its data systems and eligible technology are
			 interoperable.</text>
					</paragraph><paragraph id="H222894159BCA4B1EA9D64A6805A1D4BA"><enum>(6)</enum><text display-inline="yes-display-inline">An assurance that the State educational
			 will consider making content widely available through open educational
			 resources when making purchasing decisions with funds received under this
			 title.</text>
					</paragraph><paragraph id="HFE73DC1437544B52B4341D141F9D6362"><enum>(7)</enum><text display-inline="yes-display-inline">A description of the State’s student
			 technology literacy standards and the technology standards for teachers and
			 administrators, and an assurance that the State’s student technology literacy
			 standards meet the requirements of section 7(8).</text>
					</paragraph><paragraph id="H03F0936F478C421BB1E8A64F1DA28BA0"><enum>(8)</enum><text>An assurance that
			 subgrant awards under
			 <internal-xref idref="H84ABBFB17FA44F3AA0DC785B2DBEECF3" legis-path="104.">section 104</internal-xref> will be carried out by the State
			 educational agency staff with responsibility for leadership, coordination, and
			 implementation of instructional and other classroom technologies.</text>
					</paragraph><paragraph id="HAEB47B2EF85D49AF8FBF89ADF4BF1DDD"><enum>(9)</enum><text>A
			 description of how the State educational agency will award subgrants to local
			 educational agencies under
			 <internal-xref idref="H84ABBFB17FA44F3AA0DC785B2DBEECF3" legis-path="104.">section 104</internal-xref>.</text>
					</paragraph><paragraph id="H32B68332A6344DF787FA025ECA37F2BF"><enum>(10)</enum><text>A description of
			 the process, activities, and performance measures, that the State educational
			 agency will use to evaluate the impact and effectiveness of the grant and
			 subgrants funds awarded under this title across the State and in each local
			 educational agency.</text>
					</paragraph><paragraph id="H605C67BF6B904556BE911A469EE82EBF"><enum>(11)</enum><text>A description of
			 how the State educational agency will, in providing technical and other
			 assistance to local educational agencies, give priority to the local
			 educational agencies proposing to target services to—</text>
						<subparagraph id="H71536B0868094247BFBC53E253941AB0"><enum>(A)</enum><text>students in
			 schools in need of improvement and persistently low-achieving schools;
			 and</text>
						</subparagraph><subparagraph id="HCDDC80014B2D4AF4AE5C935E12E0732F"><enum>(B)</enum><text>schools with a
			 high percentage of students that are eligible for free or reduced price lunch
			 under the Richard B. Russell National School Lunch Act (42 U.S.C. 1751 et
			 seq.).</text>
						</subparagraph></paragraph><paragraph id="H0B74E4BA10B246D1ADB997D073F45570"><enum>(12)</enum><text>A description of
			 how the State educational agency consulted with local educational agencies in
			 the development of the State educational agency’s application under this
			 subsection.</text>
					</paragraph><paragraph commented="no" id="H377BFB2CBD8741C5AF4E3D443B4B70A4"><enum>(13)</enum><text>An assurance that
			 the State educational agency will provide matching funds as required under
			 <internal-xref idref="H96526BE97F10417DAABF8F9AA3B70D2B" legis-path="101.(e)">section 101(e)</internal-xref>.</text>
					</paragraph><paragraph id="HEBFA264DE8A8430FAC668F178AFE8D2E"><enum>(14)</enum><text display-inline="yes-display-inline">A description of how the State educational
			 agency will ensure that funds received under this title is not duplicative of
			 support received under the E-rate program.</text>
					</paragraph><paragraph id="HFC0F2F20D2FB4C4E9597CA64397B77B9"><enum>(15)</enum><text display-inline="yes-display-inline">An assurance that the State educational
			 agency will protect the privacy and safety of students and teachers, consistent
			 with requirements of section 444 of the General Education Provisions Act (20
			 U.S.C. 1232g) (commonly known as the <quote>Family Educational Rights and
			 Privacy Act of 1974</quote>) and section 2441(a) of the Elementary and
			 Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6777">20 U.S.C. 6777(a)</external-xref>).</text>
					</paragraph></subsection></section><section id="HF94F72B103D34141972386900C2F4695"><enum>103.</enum><header>State use of
			 grant funds</header>
				<subsection id="HBFE1B2756637412DBD9DEA1E14839B17"><enum>(a)</enum><header>Reservation for
			 subgrants To support technology infrastructure</header><text>Each State
			 educational agency that receives a grant under
			 <internal-xref idref="H70477C1124F444568CFC954E5CBBFDAB" legis-path="101.(b)(2)">section 101(b)(2)</internal-xref> shall expend not less
			 90 percent of the grant amount for each fiscal year to award subgrants to local
			 educational agencies in accordance with
			 <internal-xref idref="H84ABBFB17FA44F3AA0DC785B2DBEECF3" legis-path="104.">section 104</internal-xref>.</text>
				</subsection><subsection id="H2B7E149806D0459BA0F9CA1E8FBFC39D"><enum>(b)</enum><header>Reservation for
			 State activities</header>
					<paragraph id="H33E145425A274B72B6AC9077118673FC"><enum>(1)</enum><header>In
			 general</header><text>A State educational agency shall reserve not more than 10
			 percent of the grant received under
			 <internal-xref idref="H70477C1124F444568CFC954E5CBBFDAB" legis-path="101.(b)(2)">section 101(b)(2)</internal-xref> for the State
			 activities described in
			 <internal-xref idref="H7BB49FF211CB4D9E9880CE4A313F90E7" legis-path="103.(c)">subsection (c).</internal-xref></text>
					</paragraph><paragraph id="HC1FC4F7606B340D89A03C3720849EF77"><enum>(2)</enum><header>Grant
			 administration</header><text>Of the amount reserved by a State educational
			 agency under
			 <internal-xref idref="H33E145425A274B72B6AC9077118673FC" legis-path="103.(b)(1)">paragraph (1)</internal-xref>, the State educational
			 agency may reserve not more than 1 percent or 3 percent, in the case of a State
			 educational agency awarding subgrants under
			 <internal-xref idref="H8DDA1E0BC29444B3AD3E48182642B64F" legis-path="104.(a)(2)">section 104(a)(2)</internal-xref>, for the
			 administration of the grant under this title, except that a State educational
			 agency that forms a State purchasing consortium under
			 <internal-xref idref="H7C5EE5FFFE6C445F8705BEEC185C6CFB" legis-path="103.(d)">subsection (d)</internal-xref>—</text>
						<subparagraph id="HF6FC070214D648B984D74F853707C8BB"><enum>(A)</enum><text>may reserve an
			 additional 1 percent to carry out the activities described in
			 <internal-xref idref="H2D313058629246C1A0ADCA6E2734D63F" legis-path="103.(d)(1)">subsection (d)(1)</internal-xref>; and</text>
						</subparagraph><subparagraph id="H1214F5C49C7340F38B447A20C525699A"><enum>(B)</enum><text>shall receive
			 direct approval from the local educational agencies receiving subgrants under
			 <internal-xref idref="H3085A10984864437B18C86B3C8F4F250" legis-path="104.(a)">section 104(a)</internal-xref> from the State educational
			 agency prior to reserving more than the additional percentage authorized under
			 subparagraph (A) to carry out the activities described in
			 <internal-xref idref="H2D313058629246C1A0ADCA6E2734D63F" legis-path="103.(d)(1)">subsection (d)(1)</internal-xref>.</text>
						</subparagraph></paragraph></subsection><subsection id="H7BB49FF211CB4D9E9880CE4A313F90E7"><enum>(c)</enum><header>State
			 activities</header><text>A State educational agency shall use funds described
			 in
			 <internal-xref idref="H2B7E149806D0459BA0F9CA1E8FBFC39D" legis-path="103.(b)">subsection (b)</internal-xref> to carry out each of the
			 following:</text>
					<paragraph id="HE067C7B259FA4403A96A071501979F45"><enum>(1)</enum><text>Except for the
			 awarding of subgrants in accordance with
			 <internal-xref idref="H84ABBFB17FA44F3AA0DC785B2DBEECF3" legis-path="104.">section 104</internal-xref>, activities described in the
			 State educational agency’s application under
			 <internal-xref idref="HF2E17FA6F68A4D24B7FDFA444F0BC23B" legis-path="102.(b)">section 102(b)</internal-xref>.</text>
					</paragraph><paragraph id="H3ACBA3160D1E4501AD4CDAA4585978A1"><enum>(2)</enum><text>Providing
			 technical assistance to local educational agencies to—</text>
						<subparagraph id="H82841D0B3CE448D19B442DDFF171BB5D"><enum>(A)</enum><text>identify and
			 address technology readiness needs;</text>
						</subparagraph><subparagraph id="HCF30D55FD9044A00961EFC34A7A8F89E"><enum>(B)</enum><text>redesign
			 curriculum and instruction, improve educational productivity, and deliver
			 computer-based and online assessment;</text>
						</subparagraph><subparagraph id="H84CB5F68C1824524A9429C09FDA320BE"><enum>(C)</enum><text>use technology,
			 consistent with the principles of universal design for learning, to support the
			 learning needs of all students including students with disabilities and
			 English-language learners;</text>
						</subparagraph><subparagraph id="HE5CB86FDCA694EEFA116808092E0CAA8"><enum>(D)</enum><text>support principals
			 to have the expertise to evaluate teachers’ proficiency in implementing digital
			 tools for teaching and learning; and</text>
						</subparagraph><subparagraph id="HEB9262367A31492FA9A17A6EBC84CD78"><enum>(E)</enum><text>build capacity for
			 individual school and local educational agency leaders.</text>
						</subparagraph></paragraph><paragraph id="H0D0C330691534CAE9FA4058139CA7270"><enum>(3)</enum><text>Developing or
			 utilizing research-based or innovative strategies for the delivery of
			 specialized or rigorous academic courses and curricula through the use of
			 technology, including digital learning technologies and assistive
			 technology.</text>
					</paragraph><paragraph id="H111F963A629E40159F65FAB4B6C189FA"><enum>(4)</enum><text>Integrating and
			 coordinating activities under this title with other educational resources and
			 programs across the State.</text>
					</paragraph><paragraph id="H3D3B507DFDC94D1FBA4B35AA23F8D376"><enum>(5)</enum><text>Disseminating
			 information, including making publicly available on the Websites of the State
			 educational agency promising practices to improve technology instruction, and
			 acquiring and implementing technology tools and applications.</text>
					</paragraph><paragraph id="H6CE82EB59CF249B9BC25C075C6EA48CE"><enum>(6)</enum><text>Ensuring that
			 teachers, paraprofessionals, library and media personnel, specialized
			 instructional support personnel, and administrators possess the knowledge and
			 skills to use technology—</text>
						<subparagraph id="H167F6BD52DFA469699CC23671A0459F2"><enum>(A)</enum><text>for curriculum
			 redesign to change teaching and learning and improve student
			 achievement;</text>
						</subparagraph><subparagraph id="H2DD6C943EC0A4210A1B830DD803AC5DB"><enum>(B)</enum><text>for formative and
			 summative assessment administration, data analysis, and to personalize
			 learning;</text>
						</subparagraph><subparagraph id="HDE3142B9EBA64BA7852DDB70B6B4447C"><enum>(C)</enum><text>to improve student
			 technology literacy;</text>
						</subparagraph><subparagraph id="H09398BB865184C1C9472C41A505127F2"><enum>(D)</enum><text>to expand the
			 range of supports and accommodations available to English-language learners and
			 students with disabilities; and</text>
						</subparagraph><subparagraph id="H81E36BAC2B544C65955B4ECBBBBDEF0A"><enum>(E)</enum><text>for their own
			 ongoing professional development and for access to teaching resources and
			 tools.</text>
						</subparagraph></paragraph><paragraph id="HB746422F99B343448A67E6C9ECC308DF"><enum>(7)</enum><text>Coordinating with
			 teacher and school leader preparation programs to—</text>
						<subparagraph id="H74F23C9D9AB043A9AC9DEBB6474A5049"><enum>(A)</enum><text>align digital
			 learning teaching standards; and</text>
						</subparagraph><subparagraph id="HC7B651764DCC4520845B28A3695A0C95"><enum>(B)</enum><text>provide ongoing
			 professional development for teachers and school leaders that is aligned to
			 State student technology standards and activities promoting college-and-career
			 readiness.</text>
						</subparagraph></paragraph></subsection><subsection id="H090A2F8836244DF2900AB6E95024A9C6"><enum>(d)</enum><header>Purchasing
			 consortia</header>
					<paragraph id="H2D313058629246C1A0ADCA6E2734D63F"><enum>(1)</enum><header>In
			 general</header><text>A State educational agency receiving a grant under
			 <internal-xref idref="H70477C1124F444568CFC954E5CBBFDAB" legis-path="101.(b)(2)">section 101(b)(2)</internal-xref> may—</text>
						<subparagraph id="HC0311B55E93E46C4BC7F38EEEF558834"><enum>(A)</enum><text>form a State
			 purchasing consortium with 1 or more State educational agencies receiving such
			 a grant to carry out the State activities described in subsection (c),
			 including purchasing eligible technology;</text>
						</subparagraph><subparagraph id="H92ABFDA129734017BEC4AE28393D61FA"><enum>(B)</enum><text>encourage local
			 educational agencies to form local purchasing consortia under
			 <internal-xref idref="H465B8766276D4F62A472BD7F71F6CFB5" legis-path="104.(c)(4)">section 104(c)(4)</internal-xref>; and</text>
						</subparagraph><subparagraph id="H81500C36F0EA44CCBCDF301A7C4C1C02"><enum>(C)</enum><text display-inline="yes-display-inline">promote pricing opportunities to local
			 educational agencies for the purchase of eligible technology that are—</text>
							<clause id="HD2848870BCA24C919B17D54739F6DEDB"><enum>(i)</enum><text>negotiated by the
			 State educational agency or the State purchasing consortium of the State
			 educational agency; and</text>
							</clause><clause id="H50A7B5E4424D438E85889DF54B14ABAB"><enum>(ii)</enum><text>available to such
			 local educational agencies.</text>
							</clause></subparagraph></paragraph><paragraph id="H31FC085E2E534BFEA138EA330EE3889A"><enum>(2)</enum><header>Restrictions</header><text display-inline="yes-display-inline">A State educational agency receiving a
			 grant under
			 <internal-xref idref="H70477C1124F444568CFC954E5CBBFDAB" legis-path="101.(b)(2)">section 101(b)(2)</internal-xref> may not—</text>
						<subparagraph id="HB51804EBAF914CB1B7989DAEE22427BF"><enum>(A)</enum><text>except for
			 promoting the pricing opportunities described in
			 <internal-xref idref="H81500C36F0EA44CCBCDF301A7C4C1C02" legis-path="103.(d)(1)(C)">paragraph (1)(C)</internal-xref>, make
			 recommendations to local educational agencies for or require use of any
			 specific commercial products and services by local educational agencies;</text>
						</subparagraph><subparagraph id="H43F15DFFFF6044CCA007642EB8EF375E"><enum>(B)</enum><text>require local
			 educational agencies to participate in a State purchasing consortia or local
			 purchasing consortia; or</text>
						</subparagraph><subparagraph id="H6E675BB02C314FE9AF2DA078498105B7"><enum>(C)</enum><text>use more than the
			 reservation amount authorized for the administration of the grant under
			 <internal-xref idref="H2B7E149806D0459BA0F9CA1E8FBFC39D" legis-path="103.(b)">subsection (b)</internal-xref> to carry out the activities
			 described in
			 <internal-xref idref="H2D313058629246C1A0ADCA6E2734D63F" legis-path="103.(d)(1)">paragraph (1)</internal-xref>, unless the State
			 educational agency receives approval in accordance with
			 <internal-xref idref="H1214F5C49C7340F38B447A20C525699A" legis-path="103.(b)(2)(B)">subsection (b)(2)(B)</internal-xref>.</text>
						</subparagraph></paragraph></subsection></section><section id="H84ABBFB17FA44F3AA0DC785B2DBEECF3"><enum>104.</enum><header>Local
			 subgrants</header>
				<subsection id="H3085A10984864437B18C86B3C8F4F250"><enum>(a)</enum><header>Subgrants</header>
					<paragraph id="HCF570B76E8E247A7B84EC1394545E530"><enum>(1)</enum><header>Grants to local
			 educational agencies</header><text display-inline="yes-display-inline">From the
			 grant funds provided under
			 <internal-xref idref="H70477C1124F444568CFC954E5CBBFDAB" legis-path="101.(b)(2)">section 101(b)(2)</internal-xref> to a State
			 educational agency that are remaining after the State educational agency makes
			 reservations under
			 <internal-xref idref="H2B7E149806D0459BA0F9CA1E8FBFC39D" legis-path="104.(b)">section 104(b)</internal-xref> for any fiscal year and
			 subject to paragraph (2), the State educational agency shall award subgrants
			 for the fiscal year to local educational agencies served by the State
			 educational agency and with an approved application under subsection (b) by
			 allotting to each such local educational agency an amount that bears the same
			 relationship to the remainder as the amount received by the local educational
			 agency under part A of title I of the Elementary and Secondary Education Act of
			 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6301">20 U.S.C. 6301 et seq.</external-xref>) for such year bears to the amount received by all
			 such local educational agencies under such part for such year, except that no
			 local educational agency may receive less than $5,000.</text>
					</paragraph><paragraph id="H8DDA1E0BC29444B3AD3E48182642B64F"><enum>(2)</enum><header>Competitive
			 grants to local educational agencies</header><text>If the amount of funds
			 appropriated under
			 <internal-xref idref="HCFD8A10AEBC34B80B4BD6CCCBF169515" legis-path="106.">section 106</internal-xref> is less than $500,000,000 for any
			 fiscal year, a State educational agency—</text>
						<subparagraph id="HB530A14273D14E09990EFEB07A28A3B7"><enum>(A)</enum><text>shall not award
			 subgrants under
			 <internal-xref idref="HCF570B76E8E247A7B84EC1394545E530" legis-path="104.(a)(1)">paragraph (1)</internal-xref>; and</text>
						</subparagraph><subparagraph id="HB15B5A3AB8594D1399470F130C7CDF1C"><enum>(B)</enum><text>shall—</text>
							<clause id="HD6B577604C0045238FD852D5DDCF23CC"><enum>(i)</enum><text>award subgrants,
			 on a competitive basis, to local educational agencies based on the quality of
			 applications submitted under (b), including—</text>
								<subclause id="H164A95E2FB0542D7809E4B6A849C9BFE"><enum>(I)</enum><text display-inline="yes-display-inline">the level of technology readiness as
			 determined by the technology readiness surveys completed by local educational
			 agencies submitting such applications; and</text>
								</subclause><subclause commented="no" id="H097AFC79168042FF809D5119D95CFB00"><enum>(II)</enum><text display-inline="yes-display-inline">the technology plans described in
			 subsection (b)(3) and how the local educational agencies with such plans will
			 carry out the alignment and coordination described in such subsection;
			 and</text>
								</subclause></clause><clause id="H3FF7221E9E2A4BCD8797C688B7686D46"><enum>(ii)</enum><text>ensure that such
			 subgrants are of sufficient size and scope to carry out the local activities
			 described in
			 <internal-xref idref="H67AE16D358234753A4028380881B3AFD" legis-path="104.(c)">subsection (c)</internal-xref>.</text>
							</clause></subparagraph></paragraph><paragraph id="HF4477546B3DF4D2B9D43B1F0B441A544"><enum>(3)</enum><header>Definition of
			 local educational agency for certain fiscal years</header><text display-inline="yes-display-inline">For purposes of awarding subgrants under
			 <internal-xref idref="H8DDA1E0BC29444B3AD3E48182642B64F" legis-path="104.(a)(2)">paragraph (2)</internal-xref>, the term <quote>local
			 educational agency</quote> means—</text>
						<subparagraph id="H1DAFE69614E240AE866A83C03C4BA7FE"><enum>(A)</enum><text>a local
			 educational agency;</text>
						</subparagraph><subparagraph id="HA93488DC9A1047C586E91CB5D0718DE0"><enum>(B)</enum><text>an educational
			 service agency; or</text>
						</subparagraph><subparagraph id="HDA825517425D467CBDB0CA30B765CEC8"><enum>(C)</enum><text>a local
			 educational agency and an educational service agency.</text>
						</subparagraph></paragraph></subsection><subsection id="H90145F817AC341D2A2B79468FA30D69D"><enum>(b)</enum><header>Application</header><text>A
			 local educational agency that desires to receive a subgrant under
			 <internal-xref idref="H3085A10984864437B18C86B3C8F4F250" legis-path="104.(a)">subsection (a)</internal-xref> shall submit an application
			 to the State at such time, in such manner, and accompanied by such information
			 as the State educational agency may require, including—</text>
					<paragraph id="H22E8BA4BCF364536B918715B3D0965FF"><enum>(1)</enum><text>a
			 description of how the local educational agency will—</text>
						<subparagraph id="H1148CCE85F884CC0B0E812FA02111809"><enum>(A)</enum><text>carry out the
			 goals described in subparagraphs (A) through (C) of
			 <internal-xref idref="HD06E4CED9F84462B81DA42C19D96CE76" legis-path="101.(b)(1)">section 101(b)(1)</internal-xref>; and</text>
						</subparagraph><subparagraph id="H586D5C48974749DDAD7B3C1D526635B6"><enum>(B)</enum><text>enable schools
			 served by the agency to build the technological capacity and infrastructure
			 (including through local purchasing of eligible technology), necessary for the
			 full implementation of on-line assessments for all students (including students
			 with disabilities and English-language learners) and to—</text>
							<clause id="HB70B3025A36B45869935B5902D25104A"><enum>(i)</enum><text>ensure the
			 interoperability of data systems and eligible technology; and</text>
							</clause><clause id="HB8A2FE664237485D9C8303366A63AB64"><enum>(ii)</enum><text>carry out the
			 goals described in subparagraphs (A) through (C) of
			 <internal-xref idref="HD06E4CED9F84462B81DA42C19D96CE76" legis-path="101.(b)(1)">section 101(b)(1)</internal-xref>;</text>
							</clause></subparagraph></paragraph><paragraph id="H521C66205BFC4A3CA2CE78280CAC437C"><enum>(2)</enum><text display-inline="yes-display-inline">a description of the results of the
			 technology readiness survey completed by the local educational agency and a
			 description of the plan for the local educational agency to meet the goals
			 described in
			 <internal-xref idref="H22E8BA4BCF364536B918715B3D0965FF" legis-path="104.(b)(1)">paragraph (1)</internal-xref> within 3 years of
			 completing the survey;</text>
					</paragraph><paragraph id="H39E208C283344A0B8CFA7F4C5175020A"><enum>(3)</enum><text display-inline="yes-display-inline">a description of the local educational
			 agency’s student technology literacy standards, and its goals for the
			 technology skills for teachers and administrators, and an assurance that the
			 student technology literacy standards meet the requirements of section
			 7(8);</text>
					</paragraph><paragraph id="HADD712A7B88F4846902B1E03FCEEF61E"><enum>(4)</enum><text display-inline="yes-display-inline">a description of the local educational
			 agency’s technology plan to carry out paragraphs (1) and (3) and how the agency
			 will align and coordinate the activities under this section with other
			 activities across the local educational agency;</text>
					</paragraph><paragraph id="H26DF892623324E6FA12939AE37E4C765"><enum>(5)</enum><text>a
			 description of the team of educators that will coordinate and carry out the
			 activities under this section, including individuals with responsibility and
			 expertise in instructional technology, teachers that specialize in supporting
			 students with disabilities and English-language learners, school leaders,
			 technology officers, and staff responsible for assessments and data
			 analysis;</text>
					</paragraph><paragraph id="HA8188837108E42E69AC1A35EE20F33B6"><enum>(6)</enum><text>a
			 description of how the local educational agency will evaluate teachers’
			 proficiency and progress in implementing technology for teaching and
			 learning;</text>
					</paragraph><paragraph id="HF35F25C2C46E470D8198C671F7E9FD67"><enum>(7)</enum><text>a
			 description of how the local educational agency will ensure that principals
			 have the expertise to evaluate teachers’ proficiency and progress in
			 implementing technology for teaching and learning and the interoperability of
			 data systems and eligible technology;</text>
					</paragraph><paragraph id="H1908BA21938A4A80B3732FC551C704DB"><enum>(8)</enum><text>a
			 description of the local educational agency’s procurement process and process
			 for the creation, acquisition, distribution, and use of content, how the local
			 educational agency will ensure integrity of such processes, and how such
			 processes support the goals described in
			 <internal-xref idref="H22E8BA4BCF364536B918715B3D0965FF" legis-path="104.(b)(1)">paragraph (1)</internal-xref> or how a local
			 educational agency will change such processes to support such goals, and how
			 the local educational agency will ensure content quality;</text>
					</paragraph><paragraph id="H27987D69D7DE490A8D32ADA0004839B5"><enum>(9)</enum><text>a
			 description of how the local educational agency will carry out activities under
			 <internal-xref idref="H67AE16D358234753A4028380881B3AFD" legis-path="104.(c)">subsection (c)</internal-xref>;</text>
					</paragraph><paragraph id="H933082EF8B3C4D07A6565CCD596A45D6"><enum>(10)</enum><text>a description of
			 how the subgrant funds received under
			 <internal-xref idref="H3085A10984864437B18C86B3C8F4F250" legis-path="104.(a)">subsection (a)</internal-xref> will be coordinated with
			 and supported by other Federal, State, and local funds to support activities
			 under this title;</text>
					</paragraph><paragraph commented="no" id="H6600D7EC02E840E88E51675E82C3F732"><enum>(11)</enum><text display-inline="yes-display-inline">a description of how the local educational
			 agency will ensure that the subgrant received under subsection (a) is not
			 duplicative of support received under the E-rate program; and</text>
					</paragraph><paragraph id="HD3916156422D4AC791CCBAA8F06AB187"><enum>(12)</enum><text display-inline="yes-display-inline">an assurance that the local educational
			 agency will protect the privacy and safety of students and teachers, consistent
			 with requirements section 444 of the General Education Provisions Act (20
			 U.S.C. 1232g) (commonly known as the <quote>Family Educational Rights and
			 Privacy Act of 1974</quote>) and section 2441(a) of the Elementary and
			 Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6777">20 U.S.C. 6777(a)</external-xref>).</text>
					</paragraph></subsection><subsection id="H67AE16D358234753A4028380881B3AFD"><enum>(c)</enum><header>Use of
			 funds</header>
					<paragraph id="HAC9F76B791604CE68C0838A6EDBAB770"><enum>(1)</enum><header>Technology
			 infrastructure</header><text display-inline="yes-display-inline">Subject to
			 <internal-xref idref="HF2A91FC3CD7948198FC6A8D5818D59FA" legis-path="104.(c)(3)">paragraph (3)</internal-xref>, a local educational
			 agency receiving a subgrant under
			 <internal-xref idref="H3085A10984864437B18C86B3C8F4F250" legis-path="104.(a)">subsection (a)</internal-xref> shall use not less than 40
			 percent of such funds to support activities for the acquisition of eligible
			 technology needed to—</text>
						<subparagraph id="HD41EB29CE3B34663A088C4E30613F3CC"><enum>(A)</enum><text>except for the
			 activities described in paragraph (2), carry out activities described in the
			 application submitted under subsection (b), including purchasing devices,
			 equipment, and software applications, and improving connectivity to and within
			 schools; and</text>
						</subparagraph><subparagraph id="H9610BA7EEDE84BC09B2E85C92569D5AF"><enum>(B)</enum><text>address readiness
			 shortfalls identified under the technology readiness survey completed by the
			 local educational agency.</text>
						</subparagraph></paragraph><paragraph id="H2C13FCAAAF034B8297015BCA906DDB1B"><enum>(2)</enum><header>Professional
			 development for digital learning</header><text display-inline="yes-display-inline">Subject to
			 <internal-xref idref="HF2A91FC3CD7948198FC6A8D5818D59FA" legis-path="104.(c)(3)">paragraph (3)</internal-xref>, a local educational
			 agency receiving a subgrant under
			 <internal-xref idref="H3085A10984864437B18C86B3C8F4F250" legis-path="104.(a)">subsection (a)</internal-xref>—</text>
						<subparagraph id="H9DAA4D7168954080BA7EDA619ED71724"><enum>(A)</enum><text>shall use not less
			 than 35 percent of such funds to carry out—</text>
							<clause id="H260907DEF5184B86AEE1ACE17AB95516"><enum>(i)</enum><text>digital age
			 professional development opportunities for teachers, paraprofessionals, library
			 and media personnel, specialized instructional support personnel, technology
			 coordinators, and administrators in the effective use of modern information and
			 communication technology tools and digital resources to deliver instruction,
			 curriculum and school classroom management, including for classroom teachers to
			 assess, support, and provide engaging student learning opportunities, including
			 professional development that—</text>
								<subclause id="H981461B2390D407AB4C15AA778AFEDD4"><enum>(I)</enum><text>is ongoing,
			 sustainable, and scalable;</text>
								</subclause><subclause id="H7604A6F8E1364473938D56AA3C4C0284"><enum>(II)</enum><text>is
			 participatory;</text>
								</subclause><subclause id="HAF0697A283714C4085D80F3AE29A9596"><enum>(III)</enum><text>includes
			 communication and regular interactions with instructors, facilitators, and
			 peers and is directly related to up-to-date teaching methods in content
			 areas;</text>
								</subclause><subclause id="HA6389B000F904237BF400C76D263C47C"><enum>(IV)</enum><text display-inline="yes-display-inline">includes strategies and tools for improving
			 communication with parents and family engagement;</text>
								</subclause><subclause id="H5300CB264A204C54AA19A4C10656F975"><enum>(V)</enum><text display-inline="yes-display-inline">may be built around active professional
			 learning communities or online communities of practice or other tools that
			 increase collaboration among teachers across schools, local educational
			 agencies, or States; and</text>
								</subclause><subclause id="HFAA00F33DEE54EB8986A6B06906BD921"><enum>(VI)</enum><text>may contain
			 on-demand components, such as instructional videos, training documents, or
			 learning modules;</text>
								</subclause></clause><clause id="H1C412381698B4978A006613559677C54"><enum>(ii)</enum><text>ongoing
			 professional development in strategies and pedagogy in the core academic
			 subjects that involve the use of technology and curriculum redesign as key
			 components of supporting effective, innovative teaching and learning, and
			 improving student achievement;</text>
							</clause><clause id="H407FAE136CE9493C8294CC0D1CE95EC3"><enum>(iii)</enum><text>ongoing
			 professional development in the use of educational technologies to ensure every
			 educator achieves and maintains technology literacy, including possessing and
			 maintaining the knowledge and skills to use technology—</text>
								<subclause id="H7BB81F8240E94E20BC04E7E7681B444E"><enum>(I)</enum><text>across the
			 curriculum for student learning;</text>
								</subclause><subclause id="H85A2BC8B1E9945CE86F4903E00689B7E"><enum>(II)</enum><text>for real-time
			 data analysis and online or digital assessment to enable individualized
			 instruction; and</text>
								</subclause><subclause id="HB6B272ED9F25437995DC16DE27D4AC47"><enum>(III)</enum><text>to develop and
			 maintain student technology literacy;</text>
								</subclause></clause><clause id="HF19ACF43AE1E438189F37AD32642EEB1"><enum>(iv)</enum><text>ongoing
			 professional development for school leaders to provide and promote leadership
			 in the use of—</text>
								<subclause id="HEEB07EB7955D4989BB8176E9750451F2"><enum>(I)</enum><text>educational
			 technology to ensure a digital-age learning environment, including the capacity
			 to lead the reform or redesign of curriculum, instruction, assessment;
			 and</text>
								</subclause><subclause id="H273328B66BE64E3B92E6D2690654DCBD"><enum>(II)</enum><text>data through the
			 use of technology in order to increase student learning opportunity, student
			 technology literacy, student access to technology, and student engagement in
			 learning; and</text>
								</subclause></clause><clause id="H7D7E522FCB3B43FA923C51A6E6125FF8"><enum>(v)</enum><text>a
			 review of the effectiveness of the professional development and regular
			 intervals of learner feedback and data; and</text>
							</clause></subparagraph><subparagraph id="HC9FB2E9E93594FAB8F76A15565B634A0"><enum>(B)</enum><text>may use such funds
			 for—</text>
							<clause id="HDC3B052E1565441E8C9864974AF8688E"><enum>(i)</enum><text>the
			 use of technology coaches to work directly with teachers, including through the
			 preparation of teachers as technology leaders or master teachers—</text>
								<subclause id="H86FC5A9280224A878EE0F2518FE42234"><enum>(I)</enum><text>who are provided with the means to serve as experts and to create professional
			 development opportunities for other teachers in the effective use of
			 technology; and</text>
								</subclause><subclause id="HC82D2C074FF8410FB25077993F102C9A"><enum>(II)</enum><text>who may leverage
			 technologies, such as distance learning and online virtual educator-to-educator
			 peer communities, as a means to support ongoing, participatory professional
			 growth around the integration of effective educational technologies;</text>
								</subclause></clause><clause id="H05E27D3407274949BE408B10CF155C42"><enum>(ii)</enum><text>innovative
			 approaches to ongoing professional development such as non-standard achievement
			 recognition strategies, including digital badging, gamification elements, use
			 of learner-created learning objects, integration of social and professional
			 networking tools, rating and commenting on learning artifacts, and
			 personalization of professional development; and</text>
							</clause><clause id="HF6CC7A461A2C491AB7645A58CF256488"><enum>(iii)</enum><text>any other
			 activities required to carry out the local educational agency’s technology plan
			 described in
			 <internal-xref idref="HADD712A7B88F4846902B1E03FCEEF61E" legis-path="104.(b)(4)">subsection (b)(4)</internal-xref>.</text>
							</clause></subparagraph></paragraph><paragraph id="HF2A91FC3CD7948198FC6A8D5818D59FA"><enum>(3)</enum><header>Modification of
			 funding allocations</header><text>A State educational agency may authorize a
			 local educational agency to modify the percentage of the local educational
			 agency’s subgrant funds required to carry out the activities described in
			 paragraphs (1) or (2) if the local educational agency demonstrates that such
			 modification will assist the local educational agency in more effectively
			 carrying out such activities.</text>
					</paragraph><paragraph commented="no" id="H465B8766276D4F62A472BD7F71F6CFB5"><enum>(4)</enum><header>Purchasing
			 consortia</header><text>Local educational agencies receiving subgrants under
			 subsection (a) may—</text>
						<subparagraph commented="no" id="H10832CCF006643FCA80CFD94AF50FFD8"><enum>(A)</enum><text>form a local
			 purchasing consortia with other such local educational agencies to carry out
			 the activities described in this subsection, including purchasing eligible
			 technology; and</text>
						</subparagraph><subparagraph commented="no" id="H8BA04E1D34C84441BF9DBCE3BAC117D4"><enum>(B)</enum><text>use such funds for
			 purchasing eligible technology through a State purchasing consortia under
			 <internal-xref idref="H090A2F8836244DF2900AB6E95024A9C6" legis-path="103.(d)">section 103(d)</internal-xref>.</text>
						</subparagraph></paragraph></subsection></section><section commented="no" id="HBE0F94E95712439C978E6CEAC421038A"><enum>105.</enum><header>Reporting</header>
				<subsection commented="no" id="H91E05D37B46346C395E0C7AD61ECDA9B"><enum>(a)</enum><header>Local
			 educational agencies</header><text display-inline="yes-display-inline">Each
			 local educational agency receiving a subgrant under
			 <internal-xref idref="H84ABBFB17FA44F3AA0DC785B2DBEECF3" legis-path="104.">section 104</internal-xref> shall submit to the State
			 educational agency that awarded such subgrant an annual report the meets the
			 requirements of
			 <internal-xref idref="HDE149BFEEC284F9B88F8C82E33F98C75" legis-path="105.(c)">subsection (c)</internal-xref>.</text>
				</subsection><subsection commented="no" id="H1BCCC15F64944188A4537608C2EBF436"><enum>(b)</enum><header>State
			 educational agencies</header><text>Each State educational agency receiving a
			 grant under
			 <internal-xref idref="H70477C1124F444568CFC954E5CBBFDAB" legis-path="101.(b)(2)">section 101(b)(2)</internal-xref> shall submit to the
			 Secretary an annual report that meets the requirements of
			 <internal-xref idref="HDE149BFEEC284F9B88F8C82E33F98C75" legis-path="105.(c)">subsection (c)</internal-xref>.</text>
				</subsection><subsection commented="no" id="HDE149BFEEC284F9B88F8C82E33F98C75"><enum>(c)</enum><header>Report
			 requirements</header><text>A report submitted under subsection (a) or (b) shall
			 include, at a minimum, a description of—</text>
					<paragraph commented="no" id="HBADDEECD82ED430192D6F978459BB393"><enum>(1)</enum><text display-inline="yes-display-inline">the status of the State education agency’s
			 plan described in
			 <internal-xref idref="H28B6302165E146A9819921863B444307" legis-path="102.(b)(3)">section 102(b)(3)</internal-xref> or local education
			 agency’s technology plan under
			 <internal-xref idref="HADD712A7B88F4846902B1E03FCEEF61E" legis-path="104.(b)(4)">section 104(b)(4)</internal-xref>, as
			 applicable;</text>
					</paragraph><paragraph commented="no" id="HA7D046FB88124F9DA5E21C65429F5376"><enum>(2)</enum><text display-inline="yes-display-inline">the categories eligible technology acquired
			 with funds under this title and how such technology is being used;</text>
					</paragraph><paragraph commented="no" id="H82C657F0F5B34A59AE70FE4A2D770FA7"><enum>(3)</enum><text>the professional
			 development activities funded under this title, including types of activities
			 and entities involved in providing such professional development to classroom
			 teachers and other staff, such as school librarians;</text>

			 carry out this Act $500,000,000 for fiscal year 2014 and such sums as may be
			 necessary for each of the 4 succeeding fiscal years.</text>
			</section></title><title id="H949C0BE2651F4F66988DF6AEE7874E16"><enum>II</enum><header>Technology for
			 Tomorrow Fund</header>
			<section commented="no" id="H0364ECE25EC84D2CA1A869F553918B84"><enum>201.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote>Technology for Tomorrow Fund</quote>.</text>
			</section><section id="H958C2EFBBFAA403DB11F83A8B62E0D11"><enum>202.</enum><header>Technology for
			 tomorrow fund</header>
				<subsection id="H1AB83F543B1C41349E89FDA8AE412BFB"><enum>(a)</enum><header>Grants to
			 eligible partnerships</header><text>From the amounts appropriated under
			 <internal-xref idref="HE6F727CF0CAE4120959A7E71697F9C47" legis-path="207.">section 207</internal-xref> and not reserved under
			 <internal-xref idref="H1BD39CB361DB471EB5D49E86EE6DFD02" legis-path="202.(b)">subsection (b)</internal-xref>, the Secretary shall award
			 grants, on a competitive basis, to eligible partnerships to enable the eligible
			 partnerships to carry out activities described in
			 <internal-xref idref="H4CA7ED22FE964216B2902FD9B17C02D7" legis-path="204.">section 204</internal-xref> to improve student achievement,
			 academic growth, and college-and-career readiness through the use of technology
			 and digital learning.</text>
				</subsection><subsection id="H1BD39CB361DB471EB5D49E86EE6DFD02"><enum>(b)</enum><header>Reservation of
			 funds</header><text>The Secretary may reserve up to 5 percent of the amounts
			 appropriated under
			 <internal-xref idref="HE6F727CF0CAE4120959A7E71697F9C47" legis-path="207.">section 207</internal-xref> for a fiscal year for—</text>
					<paragraph id="H8514A2853D244193B6E32E99352AFE3D"><enum>(1)</enum><text>the administration
			 of this title; and</text>
					</paragraph><paragraph id="HCCBC29F5A5B54A779E31A40A66783D52"><enum>(2)</enum><text>the evaluation and
			 dissemination activities described in
			 <internal-xref idref="H7C5EE5FFFE6C445F8705BEEC185C6CFB" legis-path="204.(b)">section 204(b)</internal-xref>.</text>
					</paragraph></subsection><subsection id="HB502F47C1397483B826AFD9A14171202"><enum>(c)</enum><header>Duration of
			 grant period</header><text>A grant under
			 <internal-xref idref="H1AB83F543B1C41349E89FDA8AE412BFB" legis-path="202.(a)">subsection (a)</internal-xref> shall be awarded to an
			 eligible partnership for at least a 2-year period and not longer than a 3-year
			 period, except that the Secretary may award the eligible partnership an
			 additional 2-year grant if the eligible partnership demonstrates satisfactory
			 progress on the performance measures described in
			 <internal-xref idref="H25F69269AD3146E1B98B567D7F62DFA3" legis-path="206.(a)">section 206(a)</internal-xref>.</text>
				</subsection></section><section id="H45D22B216BEC4A23B2E94AB7FA0E72EE"><enum>203.</enum><header>Application</header>
				<subsection id="HF6DEEDAC61D74C2DBDCD24FE127F4C06"><enum>(a)</enum><header>In
			 general</header><text>To receive a grant under
			 <internal-xref idref="H958C2EFBBFAA403DB11F83A8B62E0D11" legis-path="202.">section 202</internal-xref>, an eligible partnership shall
			 submit an application at such time and in such manner as the Secretary may
			 require, and containing the information described in
			 <internal-xref idref="H4ECE30EA30CD46EF9A19F3BA905B2B8B" legis-path="203.(b)">subsection (b)</internal-xref>.</text>
				</subsection><subsection id="H4ECE30EA30CD46EF9A19F3BA905B2B8B"><enum>(b)</enum><header>Contents</header><text>An
			 application submitted under
			 <internal-xref idref="HF6DEEDAC61D74C2DBDCD24FE127F4C06" legis-path="203.(a)">subsection (a)</internal-xref> shall include—</text>
					<paragraph id="H0CDC64A302684417AF6814ECCC6F1BA4"><enum>(1)</enum><text>a
			 description of the eligible partnership, the partners forming the eligible
			 partnership, and the roles and responsibilities of each partner;</text>
					</paragraph><paragraph id="HDA8B8EEA9BE546228F20976939D46220"><enum>(2)</enum><text>a
			 demonstration of each partner’s capacity and commitment to fulfill its role and
			 responsibilities to ensure the successful completion of activities described in
			 <internal-xref idref="H4CA7ED22FE964216B2902FD9B17C02D7" legis-path="204.">section 204</internal-xref>;</text>
					</paragraph><paragraph id="H5EB97415A53149949E395F6D5996BF17"><enum>(3)</enum><text>a
			 description of how the grant funds will be used to improve the achievement,
			 academic growth, and college-and-career readiness of students, particularly
			 at-risk, low-income, and low-performing students;</text>
					</paragraph><paragraph id="HBBF933C7802B4972A85C391D2840C4F6"><enum>(4)</enum><text>a
			 description of how the activities funded by the grant will be innovative,
			 systemic, or evidence-based by ensuring such activities—</text>
						<subparagraph id="H4837F0E5FA0E468CA3C60999546B197B"><enum>(A)</enum><text>are based on
			 strong or promising evidence or a review of the best available research
			 evidence; and</text>
						</subparagraph><subparagraph id="HEDBE39E5281042F38C20EBCBA1A9B1F5"><enum>(B)</enum><text>may contribute to
			 the development and use of new models;</text>
						</subparagraph></paragraph><paragraph id="HCBFE6B48FDDC49D99458C57C0312622B"><enum>(5)</enum><text>a
			 description of how such activities will utilize technology and digital learning
			 to—</text>
						<subparagraph id="HDB36AF0C8EC3496DAB83DE33C6DA3D1B"><enum>(A)</enum><text>promote
			 personalized, individualized instruction that improves student achievement,
			 academic growth, and college-and-career readiness;</text>
						</subparagraph><subparagraph id="H59A2ACF706E34A4FA7D3A257A63E88AA"><enum>(B)</enum><text>improve teacher
			 and school leader preparation, training, knowledge, skills, practice, and
			 professional capacity;</text>
						</subparagraph><subparagraph id="H953EF051275D488DAF805D135693B19A"><enum>(C)</enum><text>ensure all
			 students, particularly at-risk and historically disadvantaged students,
			 including students with disabilities and English-language learners, have
			 equitable access to high-quality curriculum, instruction, assessments,
			 technology, and digital learning; or</text>
						</subparagraph><subparagraph id="H0EB71C00F09640528F96636F0A921272"><enum>(D)</enum><text>improve the
			 efficiency and productivity of education;</text>
						</subparagraph></paragraph><paragraph commented="no" id="H2D93CF5E10064E05B4F6932DF8B32D3A"><enum>(6)</enum><text>a description of
			 how the eligible partnership will measure and report data on the effectiveness
			 of such activities under
			 <internal-xref idref="H313412A926C942E59E55771B7A0EFC5E" legis-path="205.(a)">section 205(a)</internal-xref>;</text>
					</paragraph><paragraph id="H9705C074EF3340F4988398FE971A6AE5"><enum>(7)</enum><text>an assurance that
			 the grant funds will not solely be used—</text>
						<subparagraph id="H728C8CE642184D85827D559706D20039"><enum>(A)</enum><text>to purchase
			 materials, hardware, or technology-based tools; or</text>
						</subparagraph><subparagraph id="H89EE8BCE0A02443582D1BE206DD7719F"><enum>(B)</enum><text>to implement
			 online learning to the exclusion of other activities;</text>
						</subparagraph></paragraph><paragraph id="HF1A53056DDC14D3CB6C90BDF1BBC2503"><enum>(8)</enum><text display-inline="yes-display-inline">a description of how the eligible
			 partnership will ensure that a grant received under this title is not
			 duplicative of support received under the E-rate program; and</text>
					</paragraph><paragraph id="H773CCC67DDAD409A9C93B0B301D72BDF"><enum>(9)</enum><text>such other
			 information as the Secretary may require.</text>
					</paragraph></subsection><subsection id="HD39A862792024725BA63D21729C72E54"><enum>(c)</enum><header>Application
			 review and award</header>
					<paragraph id="HCC13341B57B24E0CA0008A161E62B2DC"><enum>(1)</enum><header>Application
			 review and approval</header><text>The Secretary shall—</text>
						<subparagraph id="HC9C597D74EBA42068C1602AADB946019"><enum>(A)</enum><text>establish a peer
			 review process to assist in the review of the grant applications and approval
			 of the grants under this section;</text>
						</subparagraph><subparagraph id="H9E41CE01EC9844E29C0C33BA42391D32"><enum>(B)</enum><text>appoint to the
			 peer review process individuals who are educators and experts in—</text>
							<clause id="HC55CC1B018CA40DEB38E3CC0A098B778"><enum>(i)</enum><text>technology and
			 digital learning;</text>
							</clause><clause id="H85FE5DD4332A45D7A1292A45B59ABAAD"><enum>(ii)</enum><text>classroom
			 instruction and teaching practice;</text>
							</clause><clause id="HAFAB4556E0E3495E91B7CC2FCAD2912D"><enum>(iii)</enum><text>school
			 improvement, redesign, or turnaround;</text>
							</clause><clause id="H45370AB55CC144838A2D9160B6D6EFFE"><enum>(iv)</enum><text>teacher and
			 school leader training or professional development; and</text>
							</clause><clause id="H08EC33DCEED24AEA94B66FD036DBBE1B"><enum>(v)</enum><text>education
			 efficiency and productivity; and</text>
							</clause></subparagraph><subparagraph id="HE363576768F4499D981717C2F1FF2039"><enum>(C)</enum><text>ensure that each
			 grant is of sufficient size and scope to carry out the activities described in
			 the grant application under
			 <internal-xref idref="H4ECE30EA30CD46EF9A19F3BA905B2B8B" legis-path="203.(b)">subsection (b)</internal-xref>, including the activities
			 described in section 204 and measuring and reporting data under
			 <internal-xref idref="H313412A926C942E59E55771B7A0EFC5E" legis-path="205.(a)">section 205(a)</internal-xref>.</text>
						</subparagraph></paragraph><paragraph id="H712C151B446B4BCAB053D8744C1EBEED"><enum>(2)</enum><header>Grant
			 award</header><text>In awarding grants under this title, the Secretary shall,
			 to the extent practicable, ensure—</text>
						<subparagraph id="H6BD3785459FC4154B893128EF37DA92B"><enum>(A)</enum><text>diversity in the
			 type of activities funded under the grants, including statewide and local
			 initiatives;</text>
						</subparagraph><subparagraph id="HB564630286C048808499BED22C1396C2"><enum>(B)</enum><text>equitable
			 geographic distribution of the grants, including urban and rural areas and
			 small and large local educational agencies; and</text>
						</subparagraph><subparagraph commented="no" id="HF50FA1F7E5FC4C79A0B53574BFCFAB35"><enum>(C)</enum><text>that eligible
			 partnerships receiving such grants—</text>
							<clause id="H1DFCEEA7FB904F8189B670FBDEF6A544"><enum>(i)</enum><text>demonstrate that
			 activities funded by the grant will be carried out based on strong or promising
			 evidence; and</text>
							</clause><clause commented="no" id="H52678859A81143D98793FE81CA828533"><enum>(ii)</enum><text display-inline="yes-display-inline">are committed to and capable of
			 successfully carrying out the activities described in the grant application
			 submitted under
			 <internal-xref idref="H4ECE30EA30CD46EF9A19F3BA905B2B8B" legis-path="203.(b)">subsection (b)</internal-xref>, including the activities
			 described in section 204 and measuring and reporting data under
			 <internal-xref idref="H313412A926C942E59E55771B7A0EFC5E" legis-path="205.(a)">section 205(a)</internal-xref>.</text>
							</clause></subparagraph></paragraph></subsection></section><section id="H4CA7ED22FE964216B2902FD9B17C02D7"><enum>204.</enum><header>Use of
			 funds</header>
				<subsection id="H34CD63B9DA7B42F4AD12BC58959C6D84"><enum>(a)</enum><header>Requirements</header><text display-inline="yes-display-inline">An eligible partnership receiving a grant
			 under this title shall use grant funds to carry out 1 or more of the following
			 activities that utilize technology and digital learning to promote:</text>
					<paragraph id="H7D120F2D68864C9A827D58D9E1B5334F"><enum>(1)</enum><text>Personalized,
			 individualized instruction that improves student achievement, academic growth,
			 and college-and-career readiness, such as—</text>
						<subparagraph id="HC2FC8BD4B8624DA19D86C5302CC53FC5"><enum>(A)</enum><text>hybrid, blended,
			 or other digital-learning opportunities that combine online and teacher-based
			 instruction to improve student outcomes;</text>
						</subparagraph><subparagraph id="HDF3DF31A70D642BD845451A6DB12C09F"><enum>(B)</enum><text>gaming or other
			 personalized digital or technology-based tools that individualize instruction
			 and promote self-directed learning and higher order thinking skills, including
			 giving students control over the place, pace, or time of learning;</text>
						</subparagraph><subparagraph id="HFDB1297534424231868EFA80BEF2E25E"><enum>(C)</enum><text>online platforms
			 or opportunities that provide students opportunities for credit recovery or
			 advanced credit accumulation; and</text>
						</subparagraph><subparagraph id="H60F7F5882CD145268C162E59BECC3AEE"><enum>(D)</enum><text>expanding the
			 accommodations available to students with disabilities and English-language
			 learners.</text>
						</subparagraph></paragraph><paragraph id="HD9965E93046349509E5AB8669D47C9C2"><enum>(2)</enum><text>Improving teacher
			 and school leader preparation, professional development, knowledge, skills,
			 practice, and professional capacity, such as—</text>
						<subparagraph id="H02EE87F5DC5543E3B5345CA75A25E9C9"><enum>(A)</enum><text>tools or programs
			 that equip teachers to differentiate instruction, conduct ongoing formative
			 assessments, and use real-time data or data systems to identify individual
			 student learning needs and guide personalized instruction, learning, and
			 appropriate interventions that address those individualized student learning
			 needs;</text>
						</subparagraph><subparagraph id="HD6A89E586E8D4F929C002A3B5128E729"><enum>(B)</enum><text>on-demand
			 professional development, online communities of practice, or other
			 technology-based tools that improve teaching and leadership;</text>
						</subparagraph><subparagraph id="HE0551F30B2044934B4493807F09B98CC"><enum>(C)</enum><text>pre-service
			 training in the use of technology and digital learning to improve student
			 outcomes; and</text>
						</subparagraph><subparagraph id="H727E1B71B7C1425C92879E572AF07C11"><enum>(D)</enum><text>technology-based
			 tools to improve the administration and implementation of teacher evaluation
			 systems or other human capital systems.</text>
						</subparagraph></paragraph><paragraph id="H69E84FD1C5E049AB9957841004A65AF6"><enum>(3)</enum><text>Ensuring all
			 students, particularly at-risk and low-performing students, have equitable
			 access to high-quality curriculum, instruction, assessments, technology, and
			 digital learning by effectively implementing technology tools consistent with
			 principals of universal design for learning, such as—</text>
						<subparagraph id="H2C5FEF338E284485B76111CFFA7E8B56"><enum>(A)</enum><text>using tools or
			 programs to teach students higher order thinking skills;</text>
						</subparagraph><subparagraph id="HA0F81C32134C48EB9886CE52834F1252"><enum>(B)</enum><text>improving the
			 education of students with disabilities through assessment accommodations,
			 including assistive technology;</text>
						</subparagraph><subparagraph id="HEC9258DF9E514BB79A6EED1513E115A8"><enum>(C)</enum><text>improving the
			 education of English-language learners, including language proficiency and
			 academic content, through intuitive games and interfaces, web-based
			 interventions, or technology-based assessments and assessment
			 accommodations;</text>
						</subparagraph><subparagraph id="H649C67115CBF4746BEAE0E898C8923BC"><enum>(D)</enum><text>technology-based
			 tools or digital learning opportunities that enhance high-quality early
			 learning or early childhood education programs;</text>
						</subparagraph><subparagraph id="HAAC4E5529CCA4D468B82FD5C13E29FAE"><enum>(E)</enum><text display-inline="yes-display-inline">expanding learning opportunities,
			 particularly for students who are low-performing or live in rural areas, that
			 increase access to high-quality curriculum and instruction, advanced placement
			 or international baccalaureate courses, science, technology, engineering, and
			 mathematics education, or enrichment activities; and</text>
						</subparagraph><subparagraph id="H297897AFCF3646788FCA1C287E0E5C91"><enum>(F)</enum><text>enhancing the
			 quality, depth, or administration of student assessments, including summative,
			 formative, and classroom-based assessments.</text>
						</subparagraph></paragraph><paragraph id="H6836631DF4284EBCA150F9C0C8AFC3F4"><enum>(4)</enum><text>Improving the
			 efficiency and productivity of education, such as—</text>
						<subparagraph id="H5A09897AA3BE4E14A14F0FCEC21FB3FF"><enum>(A)</enum><text>extending the
			 reach of high-quality materials, tools, curriculum, instruction, or teachers
			 through such means as open educational resources or blended learning;</text>
						</subparagraph><subparagraph id="HD8A9B09C3C404EF683F4A2468F214CB2"><enum>(B)</enum><text>making student
			 learning or school improvement more effective and cost-efficient through online
			 or digital platforms; and</text>
						</subparagraph><subparagraph id="HEA16CAE4F082487ABC4963BCED3F6520"><enum>(C)</enum><text>use of laptops,
			 personal devices, or technology-infused instruction to reduce cost and improve
			 delivery of instruction.</text>
						</subparagraph></paragraph></subsection><subsection id="H66F6070A267248CA9A88FDE9FD4AC83F"><enum>(b)</enum><header>Limitations on
			 uses of funds</header><text>An eligible partnership may not use the total
			 amount of a grant received under this title for a fiscal year—</text>
					<paragraph id="H5E9789E826934E93B5805378098321B8"><enum>(1)</enum><text>on materials,
			 hardware, or technology-based tools; or</text>
					</paragraph><paragraph id="H9C055E0DA78D4126BE37EE02D72D5105"><enum>(2)</enum><text>to implement
			 online learning to the exclusion of other activities.</text>
					</paragraph></subsection></section><section id="H6C9E4794C7D5475FBB1A732324975530"><enum>205.</enum><header>Data collection
			 and reporting</header>
				<subsection id="H313412A926C942E59E55771B7A0EFC5E"><enum>(a)</enum><header>Reporting</header><text>Each
			 eligible partnership receiving a grant under this title shall collect and
			 report to the Secretary, on at least an annual basis, such information on the
			 progress, outcomes, and best practices learned from activities under the grant
			 as the Secretary may require, which—</text>
					<paragraph id="HC4E5CCD6EBFD478E97C18CA5B2E0DAD0"><enum>(1)</enum><text>shall include
			 information on the impact of the grant on student outcomes, such as—</text>
						<subparagraph id="H7C9A1FCC56874631AB6F64097287C31F"><enum>(A)</enum><text>the number of and
			 demographic information about students who are served by the eligible
			 partnership under this title;</text>
						</subparagraph><subparagraph id="HAC1CD32B4F0E45E6A9E9BC5F2B593F17"><enum>(B)</enum><text>student
			 achievement, student growth, and graduation rates of such students;</text>
						</subparagraph><subparagraph id="HB660A41DAB69439AB725BD025C997F35"><enum>(C)</enum><text>college-and-career
			 readiness data about students of such students, such as rates of credit
			 accumulation, course taking and completion, and college enrollment and
			 persistence;</text>
						</subparagraph><subparagraph id="H3D7C4BE948C04596B46246298DEC8E10"><enum>(D)</enum><text>student attendance
			 and participation rates; and</text>
						</subparagraph><subparagraph id="H3F7E87150D4D4836998C03C00606C8A5"><enum>(E)</enum><text>such other
			 information the Secretary may require or other information the eligible
			 partnership proposes to include and approved by the Secretary; and</text>
						</subparagraph></paragraph><paragraph id="H52373AC61ED547BC9E2AD7EDA8F9F875"><enum>(2)</enum><text>may include data
			 on—</text>
						<subparagraph id="H98DC2D9DDEE4456495EEBF6D3936DEE2"><enum>(A)</enum><text>student engagement
			 and discipline;</text>
						</subparagraph><subparagraph id="H34D7E5F8143A4C20B703BFFCF7F4C091"><enum>(B)</enum><text>school climate and
			 teacher working conditions; and</text>
						</subparagraph><subparagraph id="HECFCCA04EAB04EAE862AE3500EAC5ABB"><enum>(C)</enum><text display-inline="yes-display-inline">increases in inclusion of students with
			 disabilities and English-language learners.</text>
						</subparagraph></paragraph></subsection><subsection id="H8B50BBECF9044FD38BB321F89E600DFD"><enum>(b)</enum><header>Disaggregation</header><text>Each
			 eligible partnership receiving a grant under this title shall disaggregate the
			 information required under
			 <internal-xref idref="H313412A926C942E59E55771B7A0EFC5E" legis-path="205.(a)">subsection (a)</internal-xref> in the same manner as
			 information is disaggregated under section 1111(h)(1)(C)(i) of the Elementary
			 and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(h)(1)(C)(i)</external-xref>).</text>
				</subsection></section><section id="HA6104BBB983A438BAEDDC41122A2858B"><enum>206.</enum><header>Performance
			 measurement and evaluation and dissemination</header>
				<subsection id="H25F69269AD3146E1B98B567D7F62DFA3"><enum>(a)</enum><header>Performance
			 measures</header><text display-inline="yes-display-inline">Prior to the
			 reviewing and awarding of grants under this title, the Secretary shall
			 establish performance measures used to evaluate the progress and performance of
			 each eligible partnership that—</text>
					<paragraph id="H5A8FCCC5E9BD4CDF81546C52BCE58791"><enum>(1)</enum><text>shall include, at
			 a minimum, information on the impact of the grants on student outcomes as
			 reported under
			 <internal-xref idref="H313412A926C942E59E55771B7A0EFC5E" legis-path="205.(a)">section 205(a)</internal-xref>; and</text>
					</paragraph><paragraph id="H2409ECEB609149C4985E87E0F6EF4A03"><enum>(2)</enum><text>may include such
			 other information as the Secretary may reasonably require.</text>
					</paragraph></subsection><subsection id="HF82F4DCF2884488C849B26A6DFD9A0B3"><enum>(b)</enum><header>Evaluation and
			 dissemination</header><text>From amounts reserved under
			 <internal-xref idref="H1BD39CB361DB471EB5D49E86EE6DFD02" legis-path="202.(b)">section 202(b)</internal-xref>, the Secretary
			 shall—</text>
					<paragraph id="HA516FD9404ED4AEEB796C7185B9D9363"><enum>(1)</enum><text>conduct or enter
			 into a contract with an outside evaluator to conduct—</text>
						<subparagraph id="HC20C977EED6A465595A1DE6C63394A37"><enum>(A)</enum><text>a comprehensive
			 evaluation after the third year that the grant program is carried under this
			 title on the effectiveness of all grants awarded under this title; and</text>
						</subparagraph><subparagraph id="H50B44979A97448A08D34B80BCC8E8606"><enum>(B)</enum><text>a final evaluation
			 following the final year of the grant program under this title—</text>
							<clause id="HFFFD17B980F44CE79FD00BB018485F9C"><enum>(i)</enum><text>that
			 focuses on the improvement in student outcomes reported under paragraphs (1)
			 through (3) of
			 <internal-xref idref="H313412A926C942E59E55771B7A0EFC5E" legis-path="205.(a)">section 205(a)</internal-xref>;</text>
							</clause><clause id="H7D20B1C4C356416197177047A761C192"><enum>(ii)</enum><text display-inline="yes-display-inline">that compares the relative effectiveness of
			 different types of programs carried under this title and compares the relative
			 effectiveness of variations in implementation within such programs; and</text>
							</clause><clause id="HCC4FB35815A84C5086CB138328B4F3C6"><enum>(iii)</enum><text>identifies the
			 conditions and practices needed for the effective use of technology and digital
			 learning, including issues related to teacher professional development,
			 educational leadership, classroom and school practices and implementation and
			 support;</text>
							</clause></subparagraph></paragraph><paragraph commented="no" id="H58CA07E9F4B7487292F5974AF4011766"><enum>(2)</enum><text>disseminate and
			 provide technical assistance to local educational agencies and State
			 educational agencies on best practices in utilizing technology and digital
			 learning to improve student achievement, academic growth, and
			 college-and-career readiness; and</text>
					</paragraph><paragraph commented="no" id="H73665FE5883A4F21865FEBDCBBB728EB"><enum>(3)</enum><text>ensure that the
			 Department of Education applies the best practices described in
			 <internal-xref idref="H58CA07E9F4B7487292F5974AF4011766" legis-path="206.(b)(2)">paragraph (2)</internal-xref> in carrying out other
			 innovation funds.</text>
					</paragraph></subsection></section><section id="HE6F727CF0CAE4120959A7E71697F9C47"><enum>207.</enum><header>Authorization
			 of appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated to carry out this title $250,000,000 for fiscal
			 year 2014 and such sums as may be necessary for each of the 4 succeeding fiscal
			 years.</text>
