			 to be subsequently determined by the Speaker, in each case for consideration of
			 such provisions as fall within the jurisdiction of the committee
			 concerned</action-desc>

		<official-title>To decriminalize marijuana at the Federal level, to leave
		  to the States a power to regulate marijuana that is similar to the power they
		  have to regulate alcohol, and for other purposes.</official-title>

		<section id="HEDC50C77F41A4C3D9A846F6DA5939AB6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Ending Federal Marijuana Prohibition
			 Act of 2013</short-title></quote>.</text>
		</section><title id="H2442D7BB8F8B4099846A05DE9F7418CA"><enum>I</enum><header>Amendments to
			 decriminalize marijuana at the Federal level</header>
			<section id="H3BB51C79527445B3806C50D882363F81"><enum>101.</enum><header>Decriminalization
			 of marijuana</header>
				<subsection id="H4D9EC76BC1784DF080F068720CB1880B"><enum>(a)</enum><header>Removal from
			 schedule of controlled substances</header><text display-inline="yes-display-inline">Notwithstanding any other provision of the
			 Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>), the Attorney General shall,
			 not later than 60 days after the date of the enactment of this Act, issue a
			 final order that removes marijuana in any form from all schedules under section
			 202(c) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/21/812">21 U.S.C. 812(c)</external-xref>).</text>
				</subsection><subsection display-inline="no-display-inline" id="HDC61321323974ED184FB650D64010465"><enum>(b)</enum><header>Conforming
			 amendment To remove legislative deadwood</header><text display-inline="yes-display-inline">Subsection (c) of section 202 of the
			 Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/812">21 U.S.C. 812</external-xref>) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H91C85718F4EA4BB48E66F3F607CB410D" style="OLC">
						<subsection id="H934C31E10DDC4017A216743B5E8AA71F"><enum>(c)</enum><header>Cross reference
				to schedules of Controlled Substances</header><text display-inline="yes-display-inline">Schedules I, II, III, IV, and V shall
				consist of the drugs and other substances (by whatever official name, common or
				usual name, chemical name, or brand name designated) that are set forth in the
				respective schedules in part 1308 of title 21, Code of Federal Regulations, as
				they may be amended from time to time, or in any successor
				regulation.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="H651DB1FEA9684E85B758D2BB8632DB78"><enum>102.</enum><header>Application of
			 the Controlled Substances Act and Controlled Substances Import and Export Act
			 to marijuana</header><text display-inline="no-display-inline">Part A of the
			 Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>) is amended by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H371B9106ECFF41ED816F5D825DC87C3A" style="OLC">
					<section id="HB273BCAD8CD840A6873F6D494BE97828"><enum>103.</enum><header>Application to
				marihuana</header>
						<subsection id="H5ABD7CA8D9CE49FD8B862626D07EAC1D"><enum>(a)</enum><header>General
				nonapplication</header><text display-inline="yes-display-inline">Except as
				provided in this section, this title and title III do not apply to
				marihuana.</text>
						</subsection><subsection id="H29A17BBD5BD64E3D9DA4AE66CFE37840"><enum>(b)</enum><header>Exception:
				prohibition on certain transportations and shipments</header><text display-inline="yes-display-inline">It shall be unlawful to ship or transport
				marihuana from any place outside a State, territory, or district of the United
				States, or other place noncontiguous to but subject to the jurisdiction of the
				United States, into that State, territory, or district of the United States, or
				place, when such marihuana is intended by any person interested therein to be
				received, possessed, sold, or in any manner used, in violation of any law of
				such State, territory, district, or place.</text>
						</subsection><subsection commented="no" id="H84A738E7713C4680968CE6795077919F"><enum>(c)</enum><header>Penalty</header><text display-inline="yes-display-inline">Whoever knowingly violates subsection (b)
				shall be fined under title 18, United States Code, or imprisoned not more than
				one year, or
				both.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H68068058F8544321A8E264F6F8BF4D9D"><enum>103.</enum><header>Conforming and
			 ancillary amendments</header>
				<subsection id="H70A1F6AB9E574E52AA651557502D5974"><enum>(a)</enum><header>Modification of
			 definition of <quote>felony drug offense</quote></header><text display-inline="yes-display-inline">Section 102(44) of the Controlled
			 Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802(44)</external-xref>) is amended by striking
			 <quote>marihuana,</quote>.</text>
				</subsection><subsection id="H7E18865FDA3543F09C2AAAEE48819018"><enum>(b)</enum><header>Elimination of
			 marijuana penalty provisions</header><text display-inline="yes-display-inline">Part D of the Controlled Substances Act (21
			 U.S.C. 841 et seq.) is amended—</text>

					</paragraph></subsection><subsection id="H0C5D02ABDC154038A5C77B00248CFBFD"><enum>(c)</enum><header>Removal of
			 prohibition on import and export</header><text display-inline="yes-display-inline">Section 1010 of the Controlled Substances
			 Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/960">21 U.S.C. 960</external-xref>) is amended—</text>
					<paragraph id="HDA0F1510A4584BABA6B3159AA41CC8CE"><enum>(1)</enum><text>by striking
			 subparagraph (G) of subsection (b)(1);</text>

			 application of the National Forest System Drug Control Act of 1986 to
			 controlled substances other than marijuana</header><text>The National Forest
			 System Drug Control Act of 1986 is amended—</text>
					<paragraph id="HA196DD5646294C218D4F9E40F4311C2A"><enum>(1)</enum><text>in section
			 15002(a) (<external-xref legal-doc="usc" parsable-cite="usc/16/559b">16 U.S.C. 559b(a)</external-xref>) by striking <quote>marijuana and
			 other</quote>;</text>
					</paragraph><paragraph id="H83B1E7543A1342A18A5ADF7FC22F49D2"><enum>(2)</enum><text>in section
			 15003(2) (<external-xref legal-doc="usc" parsable-cite="usc/16/559c">16 U.S.C. 559c(2)</external-xref>) by striking <quote>marijuana and other</quote>;
			 and</text>
					</paragraph><paragraph id="H27AF3167229F42C58282C48D98EBED92"><enum>(3)</enum><text>in section
			 15004(2) (<external-xref legal-doc="usc" parsable-cite="usc/16/559d">16 U.S.C. 559d(2)</external-xref>) by striking <quote>marijuana and
			 other</quote>.</text>
					</paragraph></subsection><subsection commented="no" id="H8D2E76C369904275970B7DDB480F5022"><enum>(e)</enum><header>Interception of
			 communications</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2516">Section 2516</external-xref> of title 18, United States Code, is
			 amended—</text>
					<paragraph id="H288A880B670B4A42B05114DD8F239A39"><enum>(1)</enum><text>in subsection
			 (1)(e), by striking “marihuana,”; and</text>
					</paragraph><paragraph id="H21DE889CE48142F19D960891D656EDF4"><enum>(2)</enum><text>in subsection (2)
			 by striking “marihuana,”.</text>
					</paragraph></subsection><subsection id="H1599A82DB8464E30BABD0A10D5E73A75"><enum>(f)</enum><header>National youth
			 anti-Drug media campaign</header><text display-inline="yes-display-inline">Section 709 of the Office of National Drug
			 Control Policy Reauthorization Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/21/1708">21 U.S.C. 1708</external-xref>) is amended by
			 striking subsection (j) (relating to prevention of marijuana use).</text>
				</subsection></section></title><title id="HD971E1B7020F4E8CAE665D5BA4DA8018"><enum>II</enum><header>Federal Marijuana
			 Licensing and Related Matters</header>
			<section id="HEC61315DC21D4131BDA97792E594A34B"><enum>201.</enum><header>Federal
			 marijuana administration</header><text display-inline="no-display-inline">The
			 Federal Alcohol Administration Act (<external-xref legal-doc="usc" parsable-cite="usc/27/201">27 U.S.C. 201 et seq.</external-xref>) is amended by adding
			 at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H4F6595B8F3674BD697495AA2D6F22014" style="OLC">
					<title id="HEB8D2A16ED0048C293D5C587E528ACC5"><enum>III</enum><header>Marijuana</header>
						<section id="HAEC6EBFB860D4DB89E7832000CD82DA4"><enum>301.</enum><header>Unlawful
				businesses without marijuana permit</header>
							<subsection commented="no" id="H04B8073D41B74C14962C73D43D548998"><enum>(a)</enum><header>Import</header><text display-inline="yes-display-inline">It shall be unlawful, except pursuant to a
				permit issued under this title by the Secretary of the Treasury (hereinafter in
				this title referred to as <quote>the Secretary</quote>)—</text>
								<paragraph commented="no" id="H61238C2F1F2949E1A5E624519E48B1B2"><enum>(1)</enum><text>to engage in the
				business of importing marijuana into the United States; or</text>
								</paragraph><paragraph commented="no" id="H4ECA6B229DEC4246855A34F9032DC384"><enum>(2)</enum><text>for any person so
				engaged to sell, offer or deliver for sale, contract to sell, or ship, in
				interstate or foreign commerce, directly or indirectly or through an affiliate,
				marijuana so imported.</text>
								</paragraph></subsection><subsection id="H0476143040474567AE65735D435C00E7"><enum>(b)</enum><header>Manufacture and
				sale</header><text>It shall be unlawful, except pursuant to a permit issued
				under this title by the Secretary—</text>
								<paragraph id="HF9F3394A058C499D9014D21440402692"><enum>(1)</enum><text>to engage in the
				business of cultivating, producing, manufacturing, packaging, or warehousing
				marijuana; or</text>
								</paragraph><paragraph id="H30A3C812FBCC435797BC63BE6C3F26BA"><enum>(2)</enum><text>for any person so
				engaged to sell, offer or deliver for sale, contract to sell, or ship, in
				interstate or foreign commerce, directly or indirectly or through an affiliate,
				marijuana so cultivated, produced, manufactured, packaged, or
				warehoused.</text>
								</paragraph></subsection><subsection id="H983580547D4347FE8FD26DCBB84896D0"><enum>(c)</enum><header>Resale</header><text>It
				shall be unlawful, except pursuant to a permit issued under this title by the
				Secretary—</text>
								<paragraph id="HF8A5D7793FE747EEBF92F651AB365103"><enum>(1)</enum><text>to engage in the
				business of purchasing marijuana for resale at wholesale; or</text>
								</paragraph><paragraph id="H4B308B8E04E443C79309CDF0C9C8B3B5"><enum>(2)</enum><text>for any person so
				engaged to receive or to sell, offer or deliver for sale, contract to sell, or
				ship, in interstate or foreign commerce, directly or indirectly or through an
				affiliate, marijuana so purchased.</text>
								</paragraph></subsection><subsection id="H1992C03571734E0087AC24D35FF5C21F"><enum>(d)</enum><header>Remedies for
				violations</header>
								<paragraph id="HE59DE35FBB3640FB9FE37C8AAB1B8630"><enum>(1)</enum><header>Criminal
				fine</header>
									<subparagraph id="HA64AD5DDB687450D8A1B78466DFB5DDA"><enum>(A)</enum><header>Generally</header><text>Whoever
				violates this section shall be fined not more than $1000.</text>
									</subparagraph><subparagraph id="H2AF99011BE1A4EA0999817FC8BDE36F7"><enum>(B)</enum><header>Settlement in
				compromise</header><text>The Secretary may decide not to refer a violation of
				this section to the Attorney General for prosecution but instead to collect a
				payment from the violator of no more than $500 for that violation.</text>
									</subparagraph></paragraph><paragraph id="HBC2F3A2728C3431FB447EA6D037630B0"><enum>(2)</enum><header>Civil Action for
				relief</header><text display-inline="yes-display-inline">The Attorney General
				may, in a civil action, obtain appropriate relief to prevent and restrain a
				violation of this title.</text>
								</paragraph></subsection></section><section id="HCB310EF5B9584855B6D443C7ABA35995"><enum>302.</enum><header>Procedure for
				issuance of marijuana permits</header>
							<subsection id="HA892E513CCD24042928F314EEC026DFC"><enum>(a)</enum><header>Who entitled to
				permit</header>
								<paragraph id="H251DF51F804B4372985C24821EB0BCBE"><enum>(1)</enum><header>Generally</header><text display-inline="yes-display-inline">The Secretary shall issue a permit for
				operations requiring a permit under section 301 unless the Secretary finds
				that—</text>
									<subparagraph id="HC6AE9E1B8A124AAF80438E9B81FD0721"><enum>(A)</enum><text display-inline="yes-display-inline">the applicant (or if the applicant is a
				corporation, any of its officers, directors, or principal stockholders) has
				been convicted of a disqualifying offense;</text>
									</subparagraph><subparagraph id="H537C882C404C42939F560B1865F18936"><enum>(B)</enum><text>the applicant is,
				by reason of business experience, financial standing, or trade connections, not
				likely to commence operations within a reasonable period or to maintain such
				operations in conformity with Federal law; or</text>
									</subparagraph><subparagraph id="HD045A0DF5223451AA3EB541960B328D4"><enum>(C)</enum><text>the operations
				proposed to be conducted by the applicant are in violation of the law of the
				State in which they are to be conducted.</text>
									</subparagraph></paragraph><paragraph id="HE5B550BF48974EACA22E7E379765E333"><enum>(2)</enum><header>Disqualifying
				offenses</header><text>For the purposes of paragraph (1):</text>
									<subparagraph id="H3C18EEE50AA94D68A0B66A4485139374"><enum>(A)</enum><header>Generally</header><text>Except
				as provided in subparagraph (B) a disqualifying offense is an offense related
				to the production, consumption, or sale of marijuana that is—</text>
										<clause id="HD8ED06C2F65D466BBE87FFC2046051F2"><enum>(i)</enum><text>a
				felony under Federal or State law, if the conviction occurred not later than 5
				years before the date of the application; or</text>
										</clause><clause id="HC85DAF5ED3314499AF4F3586A5EA8692"><enum>(ii)</enum><text display-inline="yes-display-inline">a misdemeanor under Federal law, if the
				conviction occurred not later than 3 years before the date of the
				application.</text>
										</clause></subparagraph><subparagraph id="HC38A6ED909104BB7A3E9A0997E149B17"><enum>(B)</enum><header>Excluded
				offenses</header><text>A disqualifying offense does not include a Federal or
				State offense based on conduct that—</text>
										<clause id="HE67F140D19864CF1B53B0C9362FDF5D8"><enum>(i)</enum><text>was legal under
				State law in the State when and where the conduct took place, or</text>
										</clause><clause id="HE9242F74EA7444529D80AA170992E30A"><enum>(ii)</enum><text>is, as of the
				date of the application, no longer an offense in that State.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="H0944C2464229468C9D7920CDB5D088E3"><enum>(b)</enum><header>Refusal of
				permit; hearing</header><text display-inline="yes-display-inline">If upon
				examination of any application for a permit the Secretary has reason to believe
				that the applicant is not entitled to such permit, the Secretary shall so
				notify the applicant and, upon request by the applicant, afford the applicant
				due notice and opportunity for hearing on the application. If the Secretary,
				after affording such notice and opportunity for hearing, still finds that the
				applicant is not entitled to a permit hereunder, the Secretary shall by order
				deny the application stating the findings which are the basis for the
				order.</text>
							</subsection><subsection id="HB66257578CD6410496C0669D7DC8C80D"><enum>(c)</enum><header>Form of
				application</header>
								<paragraph id="H838B8D1FF6854A4995815469D1FAB13C"><enum>(1)</enum><header>Generally</header><text>The
				Secretary shall—</text>
									<subparagraph id="HF9228ABE3B50478899D764F1E2D20DDB"><enum>(A)</enum><text>prescribe the
				manner and form of applications for permits under this title (including the
				facts to be set forth in the application);</text>
									</subparagraph><subparagraph id="H58260C89EE8F482E9D13FE9A788621D7"><enum>(B)</enum><text>prescribe the form
				of such permits;</text>
									</subparagraph><subparagraph id="H77DC7911BC184F20A12D56EBE10ED68C"><enum>(C)</enum><text>specify in any
				permit the authority conferred by the permit and the conditions of that permit
				in accordance with this title.</text>
									</subparagraph></paragraph><paragraph id="HFD02DF7E9DF4482CA5352EE743F7E79D"><enum>(2)</enum><header>Separate types
				of applications and permits</header><text>To the extent deemed necessary by the
				Secretary for the efficient administration of this title, the Secretary may
				require separate applications and permits with respect to the various classes
				of marijuana, and with respect to the various classes of persons entitled to
				permits under this title.</text>
								</paragraph><paragraph id="H51FCC4BAB0B34366852BC2196E652CBF"><enum>(3)</enum><header>Disclaimer</header><text>The
				issuance of a permit under this title does not deprive the United States of any
				remedy for a violation of law.</text>
								</paragraph></subsection><subsection id="H9A2F8303B8054A0EBCE4B0C7A6FC2696"><enum>(d)</enum><header>Conditions</header><text display-inline="yes-display-inline">A permit under this title shall be
				conditioned upon—</text>
								<paragraph id="H9C9AD973F27F41DEABBC937885D4095A"><enum>(1)</enum><text>compliance with
				all other Federal laws relating to production, sale and consumption of
				marijuana, as well as compliance with all State laws relating to said
				activities in the State in which the permit applicant resides and does
				business; and</text>
								</paragraph><paragraph id="HD5138FDD3FB84967B4A2C46DFD5AFCA0"><enum>(2)</enum><text>payment to the
				Secretary of a reasonable permit fee in an amount determined by the Secretary
				to be sufficient over time to offset the cost of implementing and overseeing
				all aspects of marijuana regulation by the Federal Government.</text>
								</paragraph></subsection><subsection id="H2ECA5530C61948708DEA5787C9A48B93"><enum>(e)</enum><header>Revocation,
				suspension, and annulment</header>
								<paragraph id="H9CE9F9CEF6BE43C79C78851F75CD7C17"><enum>(1)</enum><header>Generally</header><text display-inline="yes-display-inline">After due notice and opportunity for
				hearing, the Secretary may order a permit under this title—</text>
									<subparagraph id="H323D46FE1BC54F69BC0DBF875677BFA8"><enum>(A)</enum><text>revoked or
				suspended for such period as the Secretary deems appropriate, if the Secretary
				finds that the permittee has willfully violated any of the conditions of the
				permit, but for a first violation of the conditions the permit shall be subject
				to suspension only;</text>
									</subparagraph><subparagraph id="H1D24FC83DA91423787EB8FFBAA40151A"><enum>(B)</enum><text>revoked if the
				Secretary finds that the permittee has not engaged in the operations authorized
				by the permit for a period of more than two years; or</text>
									</subparagraph><subparagraph id="HF78EDB12FEA74A59AC802A26F97F952F"><enum>(C)</enum><text>annulled if the
				Secretary finds that the permit was procured through fraud, or
				misrepresentation, or concealment of material fact.</text>
									</subparagraph></paragraph><paragraph id="HD8C8A0A6CD2E4750AE2E3C7E4FAC85D0"><enum>(2)</enum><header>Order to state
				basis for order</header><text>The order shall state the findings which are the
				basis for the order.</text>
								</paragraph></subsection><subsection id="H7CD28EC7873940B3B36F0E2BE29DD836"><enum>(f)</enum><header>Service of
				orders</header><text display-inline="yes-display-inline">Each order of the
				Secretary with respect to any denial of application, suspension, revocation,
				annulment, or other proceedings, shall be served—</text>
								<paragraph id="H70C82E2C0EFD46F1A39DC66FC69B89B1"><enum>(1)</enum><text>in person by any
				officer or employee of the Secretary designated by him or any internal revenue
				or customs officer authorized by the Secretary for the purpose; or</text>
								</paragraph><paragraph id="H24F326A3DF0243BEAE1DB68F6FA4ADAF"><enum>(2)</enum><text>by mailing the
				order by registered mail, addressed to the applicant or respondent at his last
				known address in the records of the Secretary.</text>
								</paragraph></subsection><subsection id="H3D17B91502594FD6A8CF335202613982"><enum>(g)</enum><header>Duration</header>
								<paragraph id="H6902880DB0934308B0F7352E7C0D9039"><enum>(1)</enum><header>General
				rule</header><text display-inline="yes-display-inline">Except as otherwise
				provided in this subsection, a permit issued under this title shall continue in
				effect until suspended, revoked, or annulled as provided in this title, or
				voluntarily surrendered.</text>
								</paragraph><paragraph id="H1F91F06203A5475C9A99F133BF1181B7"><enum>(2)</enum><header>Effect of
				transfer</header><text display-inline="yes-display-inline">If operations under
				a permit issued under this title are transferred, the permit automatically
				terminates 30 days after the date of that transfer, unless an application is
				made by the transferee before the end of that period for a permit under this
				title for those operations. If such an application is made, the outstanding
				permit shall continue in effect until such application is finally acted on by
				the Secretary.</text>
								</paragraph><paragraph id="H490CC67A5D0645C09FEC959B66029FBA"><enum>(3)</enum><header>Definition of
				transfer</header><text display-inline="yes-display-inline">For the purposes of
				this section, the term <quote>transfer</quote> means any change of ownership or
				control, whether voluntary or by operation of law.</text>
								</paragraph></subsection><subsection id="H65892FCDAC8E41B79D8945ED01E277B1"><enum>(h)</enum><header>Judicial
				review</header><text display-inline="yes-display-inline">A permittee or
				applicant for a permit under this title may obtain judicial review under
				<external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/7">chapter 7</external-xref> of title 5 chapter, United States Code, of the denial of the
				application of that applicant or, in the case of a permittee, the denial of an
				application by the transferee of that permittee.</text>
							</subsection><subsection id="H2C2FBECF926049C2BB2B47D7809FDB1E"><enum>(i)</enum><header>Statute of
				limitations</header><text display-inline="yes-display-inline">No proceeding for
				the suspension or revocation of a permit for violation of any condition thereof
				relating to compliance with Federal law shall be instituted by the Secretary
				more than 18 months after conviction of the violation of Federal law, or, if no
				conviction has been had, more than 3 years after the violation occurred; and no
				permit shall be suspended or revoked for a violation of any such condition
				thereof if the alleged violation of Federal law has been compromised by any
				officer of the Government authorized to compromise such violation.</text>
							</subsection></section><section id="HB86C0BC427CD4AE3A26D916F98441936"><enum>303.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title—</text>
							<paragraph id="HC76CDDD7D0F548CDB33DFC7AC9CA9821"><enum>(1)</enum><text>the term
				<term>marijuana</term> has the meaning given the term <quote>marihuana</quote>
				in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>); and</text>
							</paragraph><paragraph id="H2F4E31AA148940DF9E4983E3F7B96F4B"><enum>(2)</enum><text>the term
				<quote>State</quote> includes the District of Columbia, Puerto Rico, and any
				territory or possession of the United
				States.</text>
							</paragraph></section></title><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HC6D6267E7687400D8316E01609427475"><enum>202.</enum><header>Addition of
			 marijuana to certain legal authorities relating to intoxicating
			 liquors</header>
				<subsection id="HEF3E9926E8E1429C8651ED0412989B9C"><enum>(a)</enum><header>Wilson
			 Act</header><text display-inline="yes-display-inline">The Act of August 8, 1890
			 (commonly known as the Wilson Act or the Original Packages Act; <external-xref legal-doc="usc" parsable-cite="usc/27/121">27 U.S.C. 121</external-xref>)
			 is amended by inserting <quote>or marijuana</quote> after <quote>intoxicating
			 liquors or liquids</quote>.</text>
				</subsection><subsection id="HA96F1DDE7BE44E489682B9C57D84D9E0"><enum>(b)</enum><header>Webb-Kenyon
			 Act</header><text display-inline="yes-display-inline">The Act of March 1, 1913
			 (commonly known as the Webb-Kenyon Act; <external-xref legal-doc="usc" parsable-cite="usc/27/122">27 U.S.C. 122</external-xref>) is amended by inserting
			 <quote>, or marijuana</quote> after <quote>intoxicating liquor</quote> both
			 places it appears.</text>
				</subsection><subsection id="H60F7FDFBB595470FAB437F71EB6FD14E"><enum>(c)</enum><header>Victims of
			 Trafficking and Violence Protection Act of 2000</header><text display-inline="yes-display-inline">Section 2 of the Victims of Trafficking and
			 Violence Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/27/122a">27 U.S.C. 122a</external-xref>) is amended—</text>
					<paragraph id="H5559461DB17444169F6B6E7ACA8EF6F0"><enum>(1)</enum><text>in subsection
			 (a)—</text>
						<subparagraph id="H8209E4619DEF46229A476137C2DCF5F9"><enum>(A)</enum><text>by redesignating
			 paragraphs (3) and (4) as paragraphs (4) and (5), respectively; and</text>
						</subparagraph><subparagraph id="HF1999299AE774797AAFB0512AECC24A9"><enum>(B)</enum><text>by inserting after
			 paragraph (2) the following new paragraph:</text>

						</subparagraph></paragraph><paragraph id="HBDAC7D16D0914E09B015402CF56A6E98"><enum>(2)</enum><text>in subsections (b)
			 and (c), by inserting <quote>or marijuana</quote> after <quote>intoxicating
			 liquor</quote> each place it appears.</text>
					</paragraph></subsection><subsection id="H8E28D95A36E54E0E89C0505D7385B4D7"><enum>(d)</enum><header>Federal Alcohol
			 Administration Act</header><text display-inline="yes-display-inline">Section 3
			 of the Federal Alcohol Administration Act (<external-xref legal-doc="usc" parsable-cite="usc/27/203">27 U.S.C. 203</external-xref>) is amended—</text>
					<paragraph id="H4D6E8163663A4F7E9174577B5F0F622A"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>marijuana,</quote>
			 before <quote>distilled spirits</quote> each place it appears (except in
			 subsection (b)(1)); and</text>
					</paragraph><paragraph id="H9374D97E381A4FF6AD08D5F86287DA2F"><enum>(2)</enum><text>in paragraph
			 (b)(1) by inserting <quote>manufacturing and distribution of marijuana,</quote>
			 after <quote>the business of,</quote>.</text>
					</paragraph></subsection></section></title><title id="HE86C1D391F9A48ACB5799A1127E92674"><enum>III</enum><header>Other Amendments
			 Relating to Federal Authority Regarding Marijuana</header>
			<section id="HE8C84E304A4149FEA9AA406ED4F17992"><enum>301.</enum><header>Food and Drug
			 Administration</header><text display-inline="no-display-inline">The Food and
			 Drug Administration shall have the same authorities with respect to marijuana
			 as the Administration has with respect to alcohol.</text>
			</section><section commented="no" id="H335B2F280D1C47E2A9E468636D435AC9"><enum>302.</enum><header>Transferring
			 agency functions with regard to marijuana</header>
				<subsection commented="no" id="H3FF537A2F02F43AFA8C2BC37B283B6EF"><enum>(a)</enum><header>Transfer of
			 jurisdiction from Drug Enforcement Administration to Bureau of Alcohol,
			 Tobacco, Firearms and Explosives</header><text display-inline="yes-display-inline">The functions of the Attorney General,
			 acting through the Administrator of the Drug Enforcement Administration
			 relating to marijuana enforcement, shall hereafter be administered by the
			 Attorney General, acting through the Director of the Bureau of Alcohol,
			 Tobacco, Firearms and Explosives.</text>
				</subsection><subsection commented="no" id="H631CEC1951A34295A43AB394C5843FC5"><enum>(b)</enum><header>Redesignation of
			 Bureau of Alcohol, Tobacco, Firearms and Explosives as Bureau of Alcohol,
			 Tobacco, Marijuana, Firearms and Explosives</header>
					<paragraph commented="no" id="H91A7B85B04E748BC85FB011CC89A6021"><enum>(1)</enum><header>Redesignation</header><text>The
			 Bureau of Alcohol, Tobacco, Firearms and Explosives is hereby renamed the
			 <quote>Bureau of Alcohol, Tobacco, Marijuana, Firearms and
			 Explosives</quote>.</text>
					</paragraph><paragraph commented="no" id="H658025FAA4464DEDB3466FB44F6475BE"><enum>(2)</enum><header>References</header><text display-inline="yes-display-inline">Any reference to the Bureau of Alcohol,
			 Tobacco, Firearms and Explosives in any law, regulation, map, document, record,
			 or other paper of the United States shall be deemed to be a reference to the
			 Bureau of Alcohol, Tobacco, Marijuana, Firearms and Explosives.</text>
					</paragraph></subsection><subsection commented="no" id="HBEFE3BED629F45009002B1A990940D0E"><enum>(c)</enum><header>Redesignation of
			 Alcohol and Tobacco Tax and Trade Bureau as Alcohol, Tobacco, and Marijuana Tax
			 and Trade Bureau</header>
					<paragraph commented="no" id="H4EEA7C6DBB69432A87F833EE072D2D7C"><enum>(1)</enum><header>Redesignation</header><text>The
			 Alcohol and Tobacco Tax and Trade Bureau is hereby renamed the <quote>Alcohol,
			 Tobacco, and Marijuana Tax and Trade Bureau</quote>.</text>
					</paragraph><paragraph commented="no" id="HE78376D4C5F745CF84B0A4D1F1D25D45"><enum>(2)</enum><header>References</header><text>Any
			 reference to the Alcohol and Tobacco Tax and Trade Bureau in any law,
			 regulation, map, document, record, or other paper of the United States shall be
			 deemed to be a reference to the Alcohol, Tobacco, and Marijuana Tax and Trade
			 Bureau.</text>
					</paragraph></subsection></section><section id="H8537C672DA1D4B4C83318147B867261A"><enum>303.</enum><header>Comptroller
			 General Review of laws and regulations</header><text display-inline="no-display-inline">The Comptroller General shall conduct a
			 review of Federal laws, regulations, and policies to determine if any changes
			 in them are desirable in the light of the purposes and provisions of this Act.
			 Not later than 2 years after the date of the enactment of this Act the
			 Comptroller General shall make to Congress and the relevant agencies such
			 recommendations relating to the results of that review as the Comptroller
			 General deems appropriate.</text>
			</section><section id="H097EA19B149D4F45920F2D9B5F43C74C"><enum>304.</enum><header>Construction</header><text display-inline="no-display-inline">Neither this Act nor any amendment made by
			 this Act shall be construed to affect Federal drug testing policies.</text>
