		<official-title>To allow that certain Federal job training and career
		  education programs give priority to programs that lead to recognized
		  postsecondary credentials.</official-title>

		<section id="HE230F06A455444ED856D94B358D1C2E4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>America Works
			 Act</short-title></quote>.</text>
		</section><section id="H5DC5826AA8C74F419AA01F8C1341B112"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="HC08A1C163B9943DC90C9EC320AD498D2"><enum>(1)</enum><text>Recent data show
			 that United States manufacturing companies cannot fill as many as 600,000
			 skilled positions, even as unemployment numbers hover at historically high
			 levels.</text>
			</paragraph><paragraph id="HCDAB01DCD5E34222B927F7DEACF35C6E"><enum>(2)</enum><text>The unfilled
			 positions are mainly in the skilled production category, and in occupations
			 such as machinist, operator, craft worker, distributor, or technician.</text>
			</paragraph><paragraph id="HEB78A1C925554DEB967A16E6FBAC4189"><enum>(3)</enum><text>In less than 20
			 years, an overall loss of expertise and management skill is expected to result
			 from the gradual departure from the workplace of 77,200,000 workers.</text>
			</paragraph><paragraph id="HDC1AC3699653492D85180D9696A2E309"><enum>(4)</enum><text>Postsecondary
			 success and workforce readiness can be achieved through attainment of a
			 recognized postsecondary credential.</text>
			</paragraph><paragraph id="HADBDCB7DE8E74928B1DA1548C1A170FD"><enum>(5)</enum><text display-inline="yes-display-inline">The Bureau of Labor Statistics Occupational
			 Outlook estimates that 746,500 new jobs in computer-related occupations will be
			 generated from 2010 to 2020. This would equate to a 23 percent net growth in
			 computer-related occupations.</text>
			</paragraph><paragraph id="H3C6BA4FE92414671AB4AA11C8FF22940"><enum>(6)</enum><text>Computer-related
			 occupations with the highest projected growth rates include database
			 administrators, software developers, and network and computer systems
			 administrators.</text>
			</paragraph><paragraph id="H13F8DAFF57734AD29D856B0703FB759C"><enum>(7)</enum><text>As of June 2012,
			 there were approximately 301,214 job openings in the information technology
			 sector.</text>
			</paragraph><paragraph id="H18B2EE92FE684335BAFE85984BB9B3FC"><enum>(8)</enum><text>According to a
			 recent report, 64 percent of managers hiring for information technology jobs
			 rate certifications as having extremely high or high value in validating
			 information technology skills and expertise, and that value is rated highest by
			 senior managers, such as chief information officers, and by medium-size
			 firms.</text>
			</paragraph></section><section id="H6A89B294C8114D8DAA69D01571E6E314"><enum>3.</enum><header>Industry-recognized
			 and nationally portable credentials for job training programs</header>
			<subsection id="H957B55DF3C3942D98604747F78CBB66B"><enum>(a)</enum><header>Workforce
			 Investment Act of 1998</header>
				<paragraph id="HC2E6C9E8325947178BB9A00D1BD5CEA7"><enum>(1)</enum><header>Youth
			 activities</header><text display-inline="yes-display-inline">Section
			 129(c)(1)(C) of the Workforce Investment Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/2854">29 U.S.C. 2854(c)(1)(C)</external-xref>)
			 is amended—</text>
					<subparagraph id="H96FE8BD7F7374D0FB37D6D071EECECC5"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating clauses (ii) through (iv)
			 as clauses (iii) through (v), respectively; and</text>
					</subparagraph><subparagraph id="H493F29CFF74B4EBCA2679114433EDD3C"><enum>(B)</enum><text display-inline="yes-display-inline">inserting after clause (i) the
			 following:</text>
						<quoted-block display-inline="no-display-inline" id="H3B17FD45731648C6B9FF9F72BB4AF0BA" style="OLC">
							<clause id="HD57D63A54E784FCABA63E06F48D32BBF"><enum>(ii)</enum><text display-inline="yes-display-inline">training (which may include priority
				consideration for training programs that lead to recognized postsecondary
				credentials (as defined in section 4 of the America Works Act) that are aligned
				with in-demand occupations or industries in the local area involved, if the
				local board determines that the programs meet the quality criteria described in
				section
				123);</text>
							</clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H4E7BF4AD2483435FAA76BDFE8A032453"><enum>(2)</enum><header>General
			 employment and training activities</header><text>Section 134(d)(4)(F) of the
			 Workforce Investment Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/2864">29 U.S.C. 2864(d)(4)(F)</external-xref>) is amended by adding
			 at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HDA215A4BC3454F33A4A24A1EEBCD7CA0" style="OLC">
						<clause id="H8BA5D82EA5C14692A72EADF580E0C5E5"><enum>(iv)</enum><header>Programs that
				lead to an industry-recognized and nationally portable credential</header><text display-inline="yes-display-inline">In assisting individuals in selecting
				programs of training services under this section, a one-stop operator and
				employees of a one-stop center referred to in subsection (c) may give priority
				consideration to programs (approved in conjunction with eligibility decisions
				made under section 122) that lead to recognized postsecondary credentials (as
				defined in section 4 of the America Works Act) that are aligned with in-demand
				occupations or industries in the local area
				involved.</text>
						</clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HA17ED920B44B47F9A8A86F88B7D3C732"><enum>(3)</enum><header>Criteria</header>
					<subparagraph id="HE3D5FC4758C848A4B8663EFBD96267F3"><enum>(A)</enum><header>General
			 employment and training activities</header><text>Section 122(b)(2)(D) of the
			 Workforce Investment Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/2842">29 U.S.C. 2842(b)(2)(D)</external-xref>) is amended—</text>
						<clause id="HE0DC40EF5A3F4549BF327990E33BD327"><enum>(i)</enum><text>in
			 clause (ii), by striking <quote>and</quote> at the end;</text>
						</clause><clause id="H31FD7F95E8014069A69F1F466A91D57D"><enum>(ii)</enum><text>in
			 clause (iii), by striking the period and inserting <quote>; and</quote>;
			 and</text>
						</clause><clause id="H215ABEAB578B4AF49304E106F893E992"><enum>(iii)</enum><text>by
			 adding at the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="H142220789FA94F7D9027D7285B68AE8A" style="OLC">
								<clause id="HFD4C7B8E1411416E90F076B32BBEDB06"><enum>(iv)</enum><text display-inline="yes-display-inline">in the case of a provider of a program of
				training services that leads to a recognized postsecondary credential (as
				defined in section 4 of the America Works Act), that the program leading to the
				credential meets such quality criteria as the Governor shall
				establish.</text>
								</clause><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="HA60DDB4E9CF54FE5BAC2EC6AEF6D895A"><enum>(B)</enum><header>Youth
			 activities</header><text>Section 123 of the Workforce Investment Act of 1998
			 (<external-xref legal-doc="usc" parsable-cite="usc/29/2843">29 U.S.C. 2843</external-xref>) by inserting <quote>(including such quality criteria as the
			 Governor shall establish for a training program that leads to a recognized
			 postsecondary credential (as defined in section 4 of the America Works
			 Act))</quote> after <quote>plan</quote>.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" id="HC6728716E2B443BCB4B993E945FCE63E"><enum>(b)</enum><header>Career and
			 technical education</header>
				<paragraph commented="no" id="HFD58C044B8B24B66BAF2AAC32370EF81"><enum>(1)</enum><header>State
			 plan</header><text>Section 122(c)(1)(B) of the Carl D. Perkins Career and
			 Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2342">20 U.S.C. 2342(c)(1)(B)</external-xref>) is amended—</text>
					<subparagraph commented="no" id="H7EF829BAF13444499F824C3746615F8F"><enum>(A)</enum><text>by striking
			 <quote>(B) how</quote> and inserting <quote>(B)(i) how</quote>;</text>
					</subparagraph><subparagraph commented="no" id="H02F8D01DE5254A8F9061F31909C8A449"><enum>(B)</enum><text>by inserting
			 <quote>and</quote> after the semicolon; and</text>
					</subparagraph><subparagraph commented="no" id="H2099E3C35F5E4299B9C8519025194EDE"><enum>(C)</enum><text>by adding at the
			 end the following</text>
						<quoted-block display-inline="no-display-inline" id="HC3DFA45D597E4345A5F002AA278B1696" style="OLC">
							<clause commented="no" id="HE12609DFAB8143828995B3FABC9C0E6D" indent="up1"><enum>(ii)</enum><text>in the case of an eligible entity
				that, in developing and implementing programs of study leading to recognized
				postsecondary credentials, desires to give a priority to such programs that are
				aligned with in-demand occupations or industries in the area served (as
				determined by the eligible agency) and that may provide a basis for additional
				credentials, certificates, or degree, how the entity will do
				so;</text>
							</clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" id="HE2342EC307AB42D3A145B0F74F58F0C3"><enum>(2)</enum><header>Use of local
			 funds</header><text>Section 134(b) of the Carl D. Perkins Career and Technical
			 Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2354">20 U.S.C. 2354(b)</external-xref>) is amended—</text>
					<subparagraph commented="no" id="HC801A39C9C644A10A3CBE9E348799991"><enum>(A)</enum><text>in paragraph (11),
			 by striking <quote>; and</quote> and inserting a semicolon;</text>
					</subparagraph><subparagraph commented="no" id="H1716D776011E47298F318C9B6258E257"><enum>(B)</enum><text>in paragraph
			 (12)(B), by striking the period and inserting <quote>; and</quote>; and</text>
					</subparagraph><subparagraph commented="no" id="HA52E9DFCE8E24FC0930FD159869BD524"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H4D867FF05DA44DC6AC8601161F411190" style="OLC">
							<paragraph commented="no" id="HD190CFAAE9ED4C129D84F93EC5193621"><enum>(13)</enum><text display-inline="yes-display-inline">describe the career and technical education
				activities supporting the attainment of recognized postsecondary credentials
				(as defined in section 4 of the America Works Act), and, in the case of an
				eligible recipient that desires to provide priority consideration to certain
				programs of study in accordance with the State plan under section 122(c)(1)(B),
				how the eligible recipient will give priority consideration to such
				activities.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDB07750F648249ACA774376AA4A5211A"><enum>(3)</enum><header>Tech-prep
			 programs</header><text>Section 203(c)(2)(E) of the Carl D. Perkins Career and
			 Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2373">20 U.S.C. 2373(c)(2)(E)</external-xref>) is amended by
			 striking <quote>industry-recognized credential, a certificate,</quote> and
			 inserting <quote>recognized postsecondary credential (as defined in section 4
			 of the America Works Act and approved by the eligible agency),</quote>.</text>
				</paragraph></subsection><subsection commented="no" id="H5538F90E31014DFCB47D7BDEE0A66F7B"><enum>(c)</enum><header>Training
			 programs under TAA</header><text>Section 236(a) of the Trade Act of 1974 (19
			 U.S.C. 2296(a)) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HD70F392B9E05428E8D84A1827DA33CC6" style="OLC">
					<paragraph id="H337CCAC033904C649D2947D40EA83144" indent="up1"><enum>(12)</enum><text>In approving training programs for
				adversely affected workers and adversely affected incumbent workers under
				paragraph (1), the Secretary may give priority consideration to workers seeking
				training through programs that are approved in conjunction with eligibility
				decisions made under section 122 of the Workforce Investment Act of 1998 (29
				U.S.C. 2842), and that lead to recognized postsecondary credentials (as defined
				in section 4 of the America Works Act) that are aligned with in-demand
				occupations or industries in the local area (defined for purposes of title I of
				the Workforce Investment Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/2801">29 U.S.C. 2801 et seq.</external-xref>))
				involved.</text>
					</paragraph><after-quoted-block>.
				</after-quoted-block></quoted-block>
			</subsection></section><section id="HC5BA6D9E57F34D16B3DA9937199FC6D8"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H2B168D28EF054C96BA1DCA3DF5707C9E"><enum>(1)</enum><header>Industry-recognized</header><text>The
			 term <term>industry-recognized</term>, used with respect to a credential, means
			 a credential that—</text>
				<subparagraph id="H781CBE4D238540D891EF71A1C9F6D64A"><enum>(A)</enum><text>is sought or
			 accepted by employers within the industry sector involved as recognized,
			 preferred, or required for recruitment, screening, hiring, or
			 advancement;</text>
				</subparagraph><subparagraph id="HD26C2885193A4C5E9D27BBA9B2DD8DAD"><enum>(B)</enum><text>is endorsed by a
			 recognized trade or professional association or organization, representing a
			 significant part of the industry sector; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1EFF319848A0408CBC3AB1F5CA7A183E"><enum>(C)</enum><text>is a nationally
			 portable credential, meaning a credential that is sought or accepted, across
			 multiple States, as described in subparagraph (A).</text>
				</subparagraph></paragraph><paragraph id="HE4A072A01890488AA0045A75ED2B45C0"><enum>(2)</enum><header>Recognized
			 postsecondary credential</header><text>The term <term>recognized postsecondary
			 credential</term> means a credential consisting of an industry-recognized
			 credential for postsecondary training, a certificate that meets the
			 requirements of subparagraphs (A) and (C) of paragraph (1) for postsecondary
			 training, a certificate of completion of a postsecondary apprenticeship through
			 a program described in section 122(a)(2)(B) of the Workforce Investment Act of
			 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/2842">29 U.S.C. 2842(a)(2)(B)</external-xref>), or an associate degree or baccalaureate degree
			 awarded by an institution of higher education (as defined in section 102(a) of
			 the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002(a)</external-xref>)).</text>
			</paragraph></section><section id="H4F14E24DA526472996498DE23F5E7FA0"><enum>5.</enum><header>Rule of
			 construction</header><text display-inline="no-display-inline">Nothing in this
			 Act shall be construed to require an entity with responsibility for selecting
			 or approving an education, training, or workforce investment activities program
			 with regard to a covered provision, to select a program with a recognized
			 postsecondary credential or certificate as defined by this Act.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H78198ACD1E7347B6BBA0C9C2A1B5EAB8"><enum>6.</enum><header>Effective
			 Date</header><text display-inline="no-display-inline">This Act, and the
			 amendments made by this Act, take effect 120 days after the date of enactment
			 of this Act.</text>
