			</subsection></section><section id="HC0F441892C5446B089E0186471E02B71"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following
			 findings:</text>
			<paragraph id="H7320EE2D88EB4DC28C4D8817BDB41DCC"><enum>(1)</enum><text>The political and
			 economic benefits of the Internet are important to advancing democracy and
			 freedom throughout the world, but the potential benefits of this transformative
			 technology are under attack by authoritarian governments.</text>
			</paragraph><paragraph id="H2624083566194BD1A1FF1BA77A74EA9D"><enum>(2)</enum><text>A
			 number of repressive foreign governments block, restrict, otherwise control,
			 and monitor the Internet, effectively transforming the Internet into a tool of
			 censorship and surveillance.</text>
			</paragraph><paragraph id="HDC583D6DBC0941AD97EA9A30425ACBCA"><enum>(3)</enum><text display-inline="yes-display-inline">A number of United States businesses have
			 enabled repressive regimes to compromise the security of Internet users engaged
			 in peaceful discussion of political, social, and religious issues and severely
			 limit their access to information and communication channels by selling these
			 governments or their agents technology or training.</text>
			</paragraph><paragraph id="H10D0B646A6394865B8EA33A59C907499"><enum>(4)</enum><text>A
			 number of United States businesses have provided repressive governments with
			 information about Internet users who were the company’s clients or were using
			 the companies’ products, that has led to the arrest and imprisonment of the
			 Internet users.</text>
			</paragraph><paragraph id="H409F00AD8DA142429D61B0103FE98002"><enum>(5)</enum><text>The actions of a
			 number of United States businesses in cooperating with the efforts of
			 repressive governments to transform the Internet into a tool of censorship and
			 surveillance have caused Internet users in the United States and in foreign
			 countries to lose confidence in the integrity of United States
			 businesses.</text>
			</paragraph><paragraph id="H3F30710DF8F944029170199831BE428A"><enum>(6)</enum><text>Information and
			 communication technology companies are to be commended for cooperating with
			 civil society organizations, academics, and investors in founding the Global
			 Network Initiative, in order to provide direction and guidance to the
			 information and communication technology companies and others in protecting the
			 free expression and privacy of Internet users. Human rights due diligence by
			 companies makes a difference.</text>
			</paragraph><paragraph id="H78AFBA0FAE8447DEBA08C52DE2D7E518"><enum>(7)</enum><text>The United States
			 Government has a responsibility to protect freedom of expression on the
			 Internet, to prevent United States businesses from directly and materially
			 cooperating in human rights abuses perpetrated by repressive foreign
			 governments, and to restore public confidence in the integrity of United States
			 business.</text>
			</paragraph></section><section id="HD2A247B9B3C14576A8A9F5A5BEC7A278"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H1A0BB809B64649E3ABD3BC17866CE4F8"><enum>(1)</enum><header>Appropriate
			 congressional committees</header><text>The term <term>appropriate congressional
			 committees</term> means—</text>
				<subparagraph id="HF6B4A0121CA94043AAEC6C907EA11416"><enum>(A)</enum><text>the Committee on
			 Foreign Affairs and the Committee on Financial Services of the House of
			 Representatives; and</text>
				</subparagraph><subparagraph id="H455A6CBB97214F929B9B8C4BEBF938F1"><enum>(B)</enum><text>the Committee on
			 Foreign Relations and the Committee on Finance of the Senate.</text>
				</subparagraph></paragraph><paragraph id="HB2158C736ADB4DA09719333DA886137C"><enum>(2)</enum><header>Foreign
			 official</header><text display-inline="yes-display-inline">The term
			 <term>foreign official</term> means—</text>
				<subparagraph id="H41E500572A0B41A895EB19E00FA272F0"><enum>(A)</enum><text>any officer or
			 employee of a foreign government or of any department; and</text>
				</subparagraph><subparagraph id="HFF4A00CDF1294BFC8606D4E65D516A21"><enum>(B)</enum><text>any person acting
			 in an official capacity for or on behalf of, or acting under color of law with
			 the knowledge of, any such government or such department, agency, state-owned
			 enterprise, or instrumentality.</text>
				</subparagraph></paragraph><paragraph id="H4D5A7328FA434129BF754DDBB0EA2C13"><enum>(3)</enum><header>Internet</header><text>The
			 term <term>Internet</term> has the meaning given the term in section 231(e)(3)
			 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/231">47 U.S.C. 231(e)(3)</external-xref>).</text>
			</paragraph><paragraph id="H9E8732ED5C5F466A9D2D645CADDFAE5E"><enum>(4)</enum><header>Internet-restricting
			 country</header><text>The term <term>Internet-restricting country</term> means
			 a country designated by the Secretary of State pursuant to section 104(a) of
			 this Act.</text>
			</paragraph><paragraph id="HAE669795CC064FE2ABD4797FB6FE3A91"><enum>(5)</enum><header>Legitimate
			 foreign law enforcement purpose</header>
				<subparagraph id="HF6D27B8F9F0545ADBEF142FB979137F5"><enum>(A)</enum><header>In
			 general</header><text>The term <term>legitimate foreign law enforcement
			 purpose</term> means for the purpose of enforcement, investigation, or
			 prosecution by a foreign official based on a publicly promulgated law of
			 reasonable specificity that proximately relates to the protection or promotion
			 of the health, safety, or morals of the citizens of the jurisdiction of such
			 official.</text>
				</subparagraph><subparagraph id="HB6D6E08156B54A31BAF2F9CB9D18ED43"><enum>(B)</enum><header>Rule of
			 construction</header><text>For purposes of this Act, the control, suppression,
			 or punishment of peaceful expression of political, religious, or ideological
			 opinion or belief shall not be construed to constitute a legitimate foreign law
			 enforcement purpose. Among expression that should be construed to be protected
			 against control, suppression, or punishment when evaluating a foreign
			 government’s claim of a legitimate foreign law enforcement purpose is
			 expression protected by article 19 of the International Covenant on Civil and
			 Political Rights.</text>
				</subparagraph><subparagraph id="HD58689184BAD4968B298FF6C5D5B4670"><enum>(C)</enum><header>Rule of
			 construction</header><text display-inline="yes-display-inline">No provision
			 under this Act shall be construed to affect a country’s ability to adopt
			 measures designed to combat infringement of intellectual property.</text>
				</subparagraph></paragraph><paragraph id="H752BE0132DCA44EE85B5852551CF3DC3"><enum>(6)</enum><header>Substantial
			 restrictions on internet freedom</header><text>The term <term>substantial
			 restrictions on Internet freedom</term> means actions that restrict or punish
			 the free availability of information via the Internet for reasons other than
			 legitimate foreign law enforcement purposes, including—</text>
				<subparagraph id="H204F5997C36744E59871F6A9FDE4EE48"><enum>(A)</enum><text>deliberately
			 blocking, filtering, or censoring information available via the Internet based
			 on the expression of political, religious, or ideological opinion or belief,
			 including by electronic mail; or</text>
				</subparagraph><subparagraph id="H5D6F79F2A42842DAA82C82712A0F1165"><enum>(B)</enum><text>persecuting,
			 prosecuting, or otherwise punishing an individual or group for posting or
			 transmitting peaceful political, religious, or ideological opinion or belief
			 via the Internet, including by electronic mail.</text>
				</subparagraph></paragraph><paragraph id="HBCE025A7BBB94AAD95E46A969D835B57"><enum>(7)</enum><header>United states
			 business</header><text>The term <term>United States business</term>
			 means—</text>
				<subparagraph id="H28D72906417047A5AA2EBC2A50B0EA76"><enum>(A)</enum><text>any corporation,
			 partnership, association, joint-stock company, business trust, unincorporated
			 organization, or sole proprietorship that—</text>
					<clause id="H1F01270385B74D00BE0013681EE8A1AC"><enum>(i)</enum><text>has
			 its principal place of business in the United States; or</text>
					</clause><clause id="H7A5F3DE7735E4F63885EDD71BAC2922B"><enum>(ii)</enum><text>is
			 organized under the laws of a State of the United States or a territory,
			 possession, or commonwealth of the United States; and</text>
					</clause></subparagraph><subparagraph id="HD0D8C915E2D04296840AA7F44C9903B3"><enum>(B)</enum><text>any issuer of a
			 security registered pursuant to section 12 of the Securities Exchange Act of
			 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78l">15 U.S.C. 78l</external-xref>).</text>
				</subparagraph></paragraph></section><section id="H56E30987B0F348B3BD70B2911893001A"><enum>4.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, or the
			 application of such provision to any person or circumstance, is held invalid,
			 the remainder of this Act, and the application of such provision to other
			 persons not similarly situated or to other circumstances, shall not be affected
			 by such invalidation.</text>
		</section><title commented="no" id="H81C6FC6EAD0F4CE2BAD971B563FD342B"><enum>I</enum><header>Promotion of
			 global Internet freedom</header>
			<section commented="no" id="HD21554567BFE470B8F616CC85B11C219"><enum>101.</enum><header>Statement of
			 policy</header><text display-inline="no-display-inline">It shall be the policy
			 of the United States—</text>
				<paragraph commented="no" id="H744A81ADC7804ABD9E61C047DCD8DD23"><enum>(1)</enum><text>to promote as a
			 fundamental component of United States foreign policy the right of every
			 individual to freedom of opinion and expression, including the right to hold
			 opinions, and to seek, receive, and impart information and ideas through any
			 media and regardless of frontiers, without interference;</text>
				</paragraph><paragraph commented="no" id="HEBEE72D2CF704982B8B3580510A14661"><enum>(2)</enum><text>to use all
			 appropriate instruments of United States influence, including diplomacy, trade
			 policy, and export controls, to support, promote, and strengthen principles,
			 practices, and values that promote the free flow of information without
			 interference or discrimination, including through the Internet and other
			 electronic media; and</text>
				</paragraph><paragraph commented="no" id="H2201846407A143E6ADACD063CB012004"><enum>(3)</enum><text>to deter any
			 United States business from cooperating with officials of Internet-restricting
			 countries in effecting the political censorship of online content.</text>
				</paragraph></section><section id="H5854C5A0F7FB4303A052D51BB19EFBC9"><enum>102.</enum><header>Sense of
			 Congress</header><text display-inline="no-display-inline">It is the sense of
			 the Congress that—</text>
				<paragraph id="HAC2CC1A3F3BF47D9B869A6128FDA3B8B"><enum>(1)</enum><text>the President
			 should, through bilateral, and where appropriate, multilateral activities, seek
			 to obtain the agreement of other countries to promote the goals and objectives
			 of this Act and to protect Internet freedom; and</text>
				</paragraph><paragraph id="HCBDB6C3FDE5D43FFBC6A2A9F9085CA2B"><enum>(2)</enum><text>to the extent
			 possible in every country in which they operate, United States businesses
			 should work to—</text>
					<subparagraph id="HC4BC028A15124AD0A6108C23E29D7753"><enum>(A)</enum><text>ensure access to
			 the Web sites of the Voice of America, Radio Free Europe/Radio Liberty, Radio
			 Free Asia, Al-Hurra, Radio Sawa, Radio Farda, Radio Marti, TV Marti, or other
			 United States-supported Web sites and online access to United States Government
			 reports such as the annual Country Reports on Human Rights Practices, the
			 annual Reports on International Religious Freedom, and the annual Trafficking
			 in Human Persons Reports; and</text>
					</subparagraph><subparagraph id="H758469211EAA4C8AB257E7B6308C63AF"><enum>(B)</enum><text>promote the
			 security of Internet users and expand their access to information and
			 communication channels by limiting censorship of protected political and
			 religious speech and information.</text>
					</subparagraph></paragraph></section><section commented="no" id="H9DEB104F793149AF9BCA4ED2E689F339"><enum>103.</enum><header>Annual Country
			 Reports on Human Rights Practices</header>
				<subsection commented="no" id="H281279EBBEBB4927B1B4299DBDD51235"><enum>(a)</enum><header>Report relating
			 to economic assistance</header><text>Section 116 of the Foreign Assistance Act
			 of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151n">22 U.S.C. 2151n</external-xref>) is amended by adding at the end the following new
			 subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H9B7D9BEF8162412581B1F4ADC74D054A" style="OLC">
						<subsection commented="no" id="H589AEF9A42DF485192DDB5CA2D195495"><enum>(g)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HF3588327C77740DF8FB6B0250CA378E6"><enum>(1)</enum><text display-inline="yes-display-inline">The report required by subsection (d) shall
				include an assessment of freedom of expression with respect to electronic
				information in each foreign country. Such assessment shall consist of the
				following:</text>
								<subparagraph commented="no" id="H3844803172934CF492AA4C3D70549DAC" indent="up1"><enum>(A)</enum><text>An assessment of the general extent to
				which Internet access is available to and used by citizens in that
				country.</text>
								</subparagraph><subparagraph commented="no" id="H9DB4EEE2E8CA466BA4E687CD2A6C96F9" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">An
				assessment of the extent to which government authorities in that country
				attempt to filter, censor, or otherwise block or remove nonviolent expression
				of political or religious opinion or belief via the Internet, including
				electronic mail, as well as a description of the means by which such
				authorities attempt to block or remove protected speech.</text>
								</subparagraph><subparagraph commented="no" id="HEDB39EE729A9415B9CE0309CAEC03D02" indent="up1"><enum>(C)</enum><text>An assessment of the extent to which
				government authorities in that country have persecuted, prosecuted, or
				otherwise punished an individual or group for the nonviolent expression of
				political, religious, or ideological opinion or belief via the Internet,
				including electronic mail.</text>
								</subparagraph><subparagraph commented="no" id="HD0FE08DD8F17403CADF62C4F27AE4DBC" indent="up1"><enum>(D)</enum><text>An assessment of the extent to which
				government authorities in that country have sought to collect, request, obtain,
				or disclose the personally identifiable information of a person in connection
				with that person’s nonviolent expression of political, religious, or
				ideological opinion or belief, including without limitation communication that
				would be protected by the International Covenant on Civil and Political
				Rights.</text>
								</subparagraph><subparagraph commented="no" id="H1C5D784D54CC43B59A4A1D214A5A7AA9" indent="up1"><enum>(E)</enum><text display-inline="yes-display-inline">An
				assessment of the extent to which wire communications and electronic
				communications are illicitly monitored in that country.</text>
								</subparagraph></paragraph><paragraph commented="no" id="H4CF262FD25E944E6924AB1A21B8D11F3" indent="up1"><enum>(2)</enum><text>In compiling data and making
				assessments for the purposes of paragraph (1), United States diplomatic mission
				personnel shall consult with human rights organizations, technology and
				Internet companies, and other appropriate nongovernmental organizations.</text>
							</paragraph><paragraph id="HC40FFF64F24D4642A754E2830E39C645" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">In this subsection—</text>
								<subparagraph id="H00A63A538D7C4192936335EEDD5AB43B"><enum>(A)</enum><text>the term <quote>electronic
				communication</quote> has the meaning given the term in section 2510 of title
				18, United States Code;</text>
								</subparagraph><subparagraph id="HE421E3D958C44252B3EDB2D99757780A"><enum>(B)</enum><text>the term <term>Internet</term> has the
				meaning given the term in section 231(e)(3) of the Communications Act of 1934
				(<external-xref legal-doc="usc" parsable-cite="usc/47/231">47 U.S.C. 231(e)(3)</external-xref>);</text>
								</subparagraph><subparagraph id="HD3ADF21EFB5C4889A090BB735826226F"><enum>(C)</enum><text display-inline="yes-display-inline">the term <term>personally identifiable
				information</term> means data in a form that identifies a particular person;
				and</text>
								</subparagraph><subparagraph id="H38082201767342F0989D2C0BAD167EE5"><enum>(D)</enum><text display-inline="yes-display-inline">the term <quote>wire communication</quote>
				has the meaning given the term in <external-xref legal-doc="usc" parsable-cite="usc/18/2510">section 2510</external-xref> of title 18, United States
				Code.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" id="HFDEA26F5BADF4745A4AC2724F67949BF"><enum>(b)</enum><header>Report relating
			 to security assistance</header><text>Section 502B of the Foreign Assistance Act
			 of 1961 (22 <external-xref legal-doc="usc" parsable-cite="usc/15/2304">15 U.S.C. 2304</external-xref>) is amended by adding at the end the following new
			 subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H3A967E1BB020410A8317CEE08691CCFC" style="OLC">
						<subsection commented="no" id="H14536F457EE14BCCAB96BA0944B469EA"><enum>(j)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H0A29119C4E804010AA13149C0BAB6C17"><enum>(1)</enum><text display-inline="yes-display-inline">The report required by subsection (b) shall
				include an assessment of freedom of expression with respect to electronic
				information in each foreign country. Such assessment shall consist of the
				following:</text>
								<subparagraph commented="no" id="H82D8637DB02145089FA7E2B67AC8E493" indent="up1"><enum>(A)</enum><text>An assessment of the general extent to
				which Internet access is available to and used by citizens in that
				country.</text>
								</subparagraph><subparagraph commented="no" id="H5F349D407C5A4FB19AD3ECF975B6AB4D" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">An
				assessment of the extent to which government authorities in that country
				attempt to filter, censor, or otherwise block or remove nonviolent expression
				of political or religious opinion or belief via the Internet, including
				electronic mail, as well as a description of the means by which such
				authorities attempt to block or remove protected speech.</text>
								</subparagraph><subparagraph commented="no" id="HF07EFB9204184470886684CC0FF9AF22" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">An
				assessment of the extent to which government authorities in that country have
				persecuted, prosecuted, or otherwise punished an individual or group for the
				peaceful expression of political, religious, or ideological opinion or belief
				via the Internet, including electronic mail.</text>
								</subparagraph><subparagraph commented="no" id="H389A744D5AB64419B69976E096057D12" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">An
				assessment of the extent to which government authorities in that country have
				sought to collect, request, obtain, or disclose the personally identifiable
				information of a person in connection with that person’s communication of
				ideas, facts, or views where such communication would be protected by the
				International Covenant on Civil and Political Rights.</text>
								</subparagraph><subparagraph commented="no" id="H52587EDA8FA2454D86E6AF03426037BC" indent="up1"><enum>(E)</enum><text>An assessment of the extent to which
				wire communications and electronic communications are illicitly monitored in
				that country.</text>
								</subparagraph></paragraph><paragraph commented="no" id="HD55246C8EDD1400C8D00318FE9DAD228" indent="up1"><enum>(2)</enum><text>In compiling data and making
				assessments for the purposes of paragraph (1), United States diplomatic mission
				personnel shall consult with human rights organizations, technology and
				Internet companies, and other appropriate nongovernmental organizations.</text>
							</paragraph><paragraph commented="no" id="HC9A69C36E74A4E01B4032543E6091A06" indent="up1"><enum>(3)</enum><text>In this subsection—</text>
								<subparagraph id="HF8084AF9D32F443C8578D36EB23D39DE"><enum>(A)</enum><text display-inline="yes-display-inline">the term <quote>electronic
				communication</quote> has the meaning given the term in section 2510 of title
				18, United States Code;</text>
								</subparagraph><subparagraph id="H03E7DE48A3E248CD9CABD460448EE5B4"><enum>(B)</enum><text>the term <term>Internet</term> has the
				meaning given the term in section 231(e)(3) of the Communications Act of 1934
				(<external-xref legal-doc="usc" parsable-cite="usc/47/231">47 U.S.C. 231(e)(3)</external-xref>);</text>
								</subparagraph><subparagraph id="H65FC3ED6492D4A28B7A863507786A8FC"><enum>(C)</enum><text display-inline="yes-display-inline">the term <term>personally identifiable
				information</term> means data in a form that identifies a particular person;
				and</text>
								</subparagraph><subparagraph id="H9E525C02DA36485D980C48666BEA75B5"><enum>(D)</enum><text display-inline="yes-display-inline">the term <quote>wire communication</quote>
				has the meaning given the term in <external-xref legal-doc="usc" parsable-cite="usc/18/2510">section 2510</external-xref> of title 18, United States
				Code.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section commented="no" id="HAC94A9F5AE4E409987A5E27875D86080"><enum>104.</enum><header>Annual
			 designation of Internet-restricting countries; report</header>
				<subsection commented="no" id="H41EE3F8DC83543DD822FCCD7975598D4"><enum>(a)</enum><header>Designation</header>
					<paragraph commented="no" id="H11DBDD26569E4CE4BFE57D0C9321406B"><enum>(1)</enum><header>In
			 general</header><text>Not later than 180 days after the date of the enactment
			 of this Act, and annually thereafter, the Secretary of State shall designate
			 Internet-restricting countries for purposes of this Act.</text>
					</paragraph><paragraph commented="no" id="HB5496162A43541309BA22828AA4AFE85"><enum>(2)</enum><header>Standard</header><text>A
			 foreign country shall be designated as an Internet-restricting country if the
			 Secretary of State, after consultation with the Secretary of Commerce,
			 determines, based on the review of the evidence that the government of the
			 country is directly or indirectly responsible for a systematic pattern of
			 substantial restrictions on Internet freedom during any part of the preceding
			 1-year period.</text>
					</paragraph></subsection><subsection commented="no" id="H9F4EDBCA637B4AF0870205C656F74F0B"><enum>(b)</enum><header>Report</header>
					<paragraph commented="no" id="HF0EB6D0A22D34087BF79EF6C1ACC3B65"><enum>(1)</enum><header>In
			 general</header><text>Not later than 180 days after the date of the enactment
			 of this Act, and annually thereafter, the Secretary of State shall transmit to
			 the appropriate congressional committees a report that contains the
			 following:</text>
						<subparagraph commented="no" id="HA76C6C958BD04DECB9AB508C6642C1C5"><enum>(A)</enum><text>The name of each
			 foreign country that at the time of the transmission of the report is
			 designated as an Internet-restricting country under subsection (a).</text>
						</subparagraph><subparagraph commented="no" id="H69276E60A05A438DACD8053FD51D7351"><enum>(B)</enum><text>An identification
			 of each government agency and quasi-government organization responsible for the
			 substantial restrictions on Internet freedom in each foreign country designated
			 as an Internet-restricting country under subsection (a).</text>
						</subparagraph><subparagraph commented="no" id="HFA2131B1C0DF4FDBB097851375C59DBD"><enum>(C)</enum><text display-inline="yes-display-inline">A description of efforts by the United
			 States to counter the substantial restrictions on Internet freedom referred to
			 in subparagraph (B), including a description and details of programs funded
			 under any other provision of law with the purpose of promoting Internet
			 freedom.</text>
						</subparagraph><subparagraph commented="no" id="H607F6245284B4E45BC86C4598AF74EE0"><enum>(D)</enum><text>A description of
			 the evidence used by the Secretary of State to make the determinations under
			 subsection (a)(2).</text>
						</subparagraph></paragraph><paragraph commented="no" id="H3EE5D95704D84E92B1736014AB224F17"><enum>(2)</enum><header>Form</header><text>The
			 information required by paragraph (1)(C) may be provided in a classified form
			 if necessary.</text>
					</paragraph><paragraph commented="no" id="H994D0EF5499F4F48B69731DE41B0BB95"><enum>(3)</enum><header>Public
			 availability</header><text>All unclassified portions of the report shall be
			 made publicly available on the Internet Web site of the Department of
			 State.</text>
					</paragraph></subsection></section><section commented="no" id="H007E5B8C6D4C4F71A0788596F28BCB2E"><enum>105.</enum><header>Report on
			 trade-related issues or disputes due to government censorship or disruption of
			 the Internet</header>
				<subsection commented="no" id="HCE2F2156EA5442C8AA5CAD6A8BD7E2CC"><enum>(a)</enum><header>Report</header><text>Not
			 later than 90 days after the date of the enactment of this Act, the United
			 States Trade Representative, in consultation with the Secretary of State and
			 the Secretary of Commerce, shall transmit to the appropriate congressional
			 committees a report on—</text>
					<paragraph commented="no" id="H4A3406CE30A34E538CA7FFE30C9C0802"><enum>(1)</enum><text>any trade-related
			 issues or disputes that arise due to government censorship or disruption of the
			 Internet among United States trade partners; and</text>
					</paragraph><paragraph commented="no" id="H1D20FF66D3FF4ACDA8EB7E585BB53778"><enum>(2)</enum><text>efforts by the
			 United States Government to address the issues or disputes described in
			 paragraph (1) either bilaterally or multilaterally.</text>
					</paragraph></subsection><subsection commented="no" id="HA0FAE4BD3B574961BC2219DBBE296560"><enum>(b)</enum><header>Sense of
			 Congress</header><text>It is the sense of Congress that the United States
			 should pursue trade policies that expand the information economy by—</text>
					<paragraph id="HD4B0D2B3AFCA4C8BB74FE55582C0F482"><enum>(1)</enum><text>ensuring the free
			 flow of information across the entire global network;</text>
					</paragraph><paragraph id="HC88A94754DF741FC878F526E37F9BF93"><enum>(2)</enum><text>promoting stronger
			 international transparency rules; and</text>
					</paragraph><paragraph id="H526F0C311A0B476A90850E34AEF85D1B"><enum>(3)</enum><text>ensuring fair and
			 equal treatment of online services regardless of country of origin.</text>
					</paragraph></subsection></section></title><title id="HC63A940DBB024DE1AF2CDB905D5FE1E8"><enum>II</enum><header>Corporate
			 transparency and accountability to protect online freedom</header>
			<section id="HE7B4B3082F904F29B88EC7E0E084DF4A"><enum>201.</enum><header>Disclosure of
			 human rights due diligence</header>
				<subsection id="H921880F51A6340C5B8FFAF34421DA049"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 13 of the
			 Securities Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78m">15 U.S.C. 78m</external-xref>) is amended by adding at the end
			 the following:</text>
					<quoted-block display-inline="no-display-inline" id="H4A05CF8F7E6C45F1BC9DE32D84220B8F" style="OLC">
						<subsection id="HFD390DAE789E4813A6D0FBC3F4F67AB3"><enum>(s)</enum><header>Disclosure of
				human rights due diligence</header>
							<paragraph id="HBA80D8D267A14EC3982FA9A65269F198"><enum>(1)</enum><header>Disclosure</header><text display-inline="yes-display-inline">Except as provided in paragraph (3), each
				Internet communications service company that operates in an
				Internet-restricting country shall include in the annual report of the company
				information relating to the company, any subsidiary of the company, and any
				entity under the control of either of such companies, relating to the
				following:</text>
								<subparagraph id="H9907E4D6203E4E93A10B145CD99123FA"><enum>(A)</enum><header>Human rights due
				diligence</header><text>Company policies applicable to the company’s internal
				operations that address human rights due diligence through a statement of
				policy that is consistent with applicable provisions of the Guidelines for
				Multinational Enterprises issued by the Organization for Economic Co-operation
				and Development, and whether such policy—</text>
									<clause id="H6540E175A1104940BDADA7C99B8544F3"><enum>(i)</enum><text>is
				approved at the most senior level of the company;</text>
									</clause><clause id="HC936A461C84B4CEA82520CF18AC5F9D3"><enum>(ii)</enum><text>explicitly states
				the company’s expectations of personnel, business partners, and other parties
				under the control of the company, products, or services;</text>
									</clause><clause id="HCBAEDE514211478A99193BD0A4A5C38F"><enum>(iii)</enum><text>is publicly
				available and communicated internally and externally to all personnel, business
				partners, other relevant partners, customers, and users;</text>
									</clause><clause id="H25585E1B24D4491C82C1492248EAEB95"><enum>(iv)</enum><text>is reflected in
				operational policies and procedures necessary to embed it throughout the
				company; and</text>
									</clause><clause commented="no" id="HF154ADB01F4040E8B283A01140E04710"><enum>(v)</enum><text>is independently
				assessed by a third party to demonstrate compliance in practice, which should
				include—</text>
										<subclause commented="no" id="H64B1B9DB96EF44E9ACB6530D9792D97B"><enum>(I)</enum><text>whether the
				assessment was conducted under the supervision of any third party organization
				or multi-stakeholder initiative;</text>
										</subclause><subclause commented="no" id="HECE7D805E2564FDCBA1ADE981E25A08C"><enum>(II)</enum><text>a description of
				the assessment process;</text>
										</subclause><subclause commented="no" id="H438F96CEAAB648A69168E324A6B14A46"><enum>(III)</enum><text>a description of
				measures taken to ensure the assessor’s independence; and</text>
										</subclause><subclause commented="no" id="H96BF94C993CE482595682369CC1B4787"><enum>(IV)</enum><text>inclusion of the
				assessor’s public report.</text>
										</subclause></clause></subparagraph><subparagraph id="H1181F7B4CB66496C8E3346D9DBAB8A6C"><enum>(B)</enum><header>Non-compliance</header><text>If
				the company’s policy does not comply with any of the requirements of clauses
				(i) through (iv) of subparagraph (A), an explanation of why the company’s
				policy does not meet each such requirement.</text>
								</subparagraph><subparagraph id="H6E9B982B90E54EDEB7D119452D513F89"><enum>(C)</enum><header>Policies
				pertaining to disclosure of personally identifiable information</header><text display-inline="yes-display-inline">If the company collects or obtains
				personally identifiable information, the contents of wire communications or
				electronic communications in electronic storage, or the contents of wire
				communications or electronic communications in a remote computing service on
				the Internet, a summary of any internal policies or procedures of the company
				that set out how the company will assess and respond to requests by the
				governments of Internet-restricting countries for disclosure of such personally
				identifiable information or communications.</text>
								</subparagraph><subparagraph id="HCB7CF4D608524C85A2C018FB21CD276C"><enum>(D)</enum><header>Restrictions on
				Internet search engines and Internet content hosting services</header><text>If
				the company creates, provides, or hosts an Internet search engine or an
				Internet content hosting service, all steps taken to provide users and
				customers with clear, prominent, and timely notice when access to specific
				content has been removed or blocked at the request of an Internet-restricting
				country.</text>
								</subparagraph></paragraph><paragraph id="H8473FB21C4D24108977185E481B240EF"><enum>(2)</enum><header>Availability of
				information</header><text>The Commission shall make all information reported by
				an issuer pursuant to this subsection available online to the public.</text>
							</paragraph><paragraph commented="no" id="H2B7D6D0D7764470B80ED9FBA050E2A3F"><enum>(3)</enum><header>Safe
				harbor</header>
								<subparagraph id="HC9C4B166A6434E97877A324B24CE55AE"><enum>(A)</enum><header>In
				general</header><text>An Internet communications service company that operates
				in an Internet-restricting country shall not be required to include in the
				annual report of the company information described in paragraph (1) if the
				company includes in the annual report of the company a certification of the
				Global Network Initiative or a multi-stakeholder initiative described in
				subparagraph (B) that the company participates in good standing in the Global
				Network Initiative or the multi-stakeholder initiative (as the case may be).</text>
								</subparagraph><subparagraph commented="no" id="H92B93AF569F3484396921E20298EC0DD"><enum>(B)</enum><header>Multi-stakeholder
				initiative</header><text>A multi-stakeholder initiative referred to in
				subparagraph (A) is an initiative that—</text>
									<clause commented="no" id="H5D5660E236ED492A94119D7669FE0768"><enum>(i)</enum><text>is composed of
				civil society organizations, including human rights organizations and Internet
				communications service companies;</text>
									</clause><clause commented="no" id="H842B0E2A151341EFBCBE0E97EE1F7469"><enum>(ii)</enum><text>promotes the rule
				of law and the adoption of laws, policies, and practices that protect, respect,
				and fulfill freedom of expression and privacy; and</text>
									</clause><clause commented="no" id="H183B47AFFDDB4F12B26CD4F01CF516B5"><enum>(iii)</enum><text>requires each
				company participating in the initiative to undergo assessments by an
				independent third party described in subparagraph (C) of the company’s
				compliance with the standards described in clause (ii).</text>
									</clause></subparagraph><subparagraph commented="no" id="H77217350818D4D42A70A6F5C2E10001E"><enum>(C)</enum><header>Independent
				third party</header><text>An independent third party referred to in
				subparagraph (B)(iii) is an entity accredited by the multi-stakeholder
				initiative to conduct assessments based on criteria that include—</text>
									<clause commented="no" id="H2C6A12D931E14366A4E59F3FC965944F"><enum>(i)</enum><text>general expertise
				in legal and human rights standards; and</text>
									</clause><clause commented="no" id="HEF284CC0206D42C58E79AF3034A01582"><enum>(ii)</enum><text>specific
				expertise in global business processes relating to information and
				communication technology, including operations, product development cycles,
				market segments and industry relationships, information technology privacy,
				safety, and security standards, data retention systems, and database forensics.</text>
									</clause></subparagraph></paragraph><paragraph id="HCE3407CFF55C4117AFBAC7363BF1BB78"><enum>(4)</enum><header>Definitions</header><text>In
				this subsection:</text>
								<subparagraph id="H144E840AB4AE4033A1752E36B51598BF"><enum>(A)</enum><header>Electronic
				communication and other title 18 definitions</header><text display-inline="yes-display-inline">The terms <term>electronic
				communication</term>, <quote>electronic communication service</quote>,
				<term>electronic storage</term>, <quote>wire communication</quote>, and
				<term>contents</term> have the meanings given such terms in section 2510 of
				title 18, United States Code.</text>
								</subparagraph><subparagraph commented="no" id="H2623719CFE13497DA8B67BF41CCFCB4D"><enum>(B)</enum><header>Internet</header><text display-inline="yes-display-inline">The term <term>Internet</term> has the
				meaning given the term in section 231(e)(3) of the Communications Act of 1934
				(<external-xref legal-doc="usc" parsable-cite="usc/47/231">47 U.S.C. 231(e)(3)</external-xref>).</text>
								</subparagraph><subparagraph id="H881253701B5D498E940493B6CBD1C91D"><enum>(C)</enum><header>Internet
				communications service company</header><text>The term <term>Internet
				communications service company</term> means an issuer that—</text>
									<clause id="H65EAC2554F004D799B7DEE42DF626ED0"><enum>(i)</enum><text display-inline="yes-display-inline">is required to file an annual report with
				the Commission; and</text>
									</clause><clause id="HA4742A6790FF4F428293EF4D25765A05"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H03FBB7DBD2934F5A8126BE2C86B8741D"><enum>(I)</enum><text>provides electronic
				communication services or remote computing services, but does not
				include—</text>
											<item id="HD868E5A94EB248DC9B31D67EAA12D452" indent="up1"><enum>(aa)</enum><text>businesses that provide such services
				as an ancillary service to the provision of lodging, transportation, or food
				services; or</text>
											</item><item commented="no" id="H8622E42B48D74DF6B97E7F1AF2AFD219" indent="up1"><enum>(bb)</enum><text display-inline="yes-display-inline">activities conducted by a financial
				institution (as such term is defined in <external-xref legal-doc="usc" parsable-cite="usc/31/5312">section 5312</external-xref> of title 31, United States
				Code) that are financial in nature, even if such activities are conducted using
				the Internet; or</text>
											</item></subclause><subclause id="H50C49936DFF54D63BD5489AED4293046" indent="up1"><enum>(II)</enum><text>is a domain name registrar, domain name
				registry, or other domain name registration authority.</text>
										</subclause></clause></subparagraph><subparagraph id="HF008217575A6452CA79757AB92B1D0E3"><enum>(D)</enum><header>Internet content
				hosting service</header><text>The term <term>Internet content hosting
				service</term> means a service that—</text>
									<clause id="HBE9AAE7D51F843E39304D6B19DD0C35F"><enum>(i)</enum><text>stores, through
				electromagnetic or other means, electronic data, such as the content of Web
				pages, electronic mail, documents, images, audio and video files, online
				discussion boards, or Web logs; and</text>
									</clause><clause id="H3E31FCC7283C42D7AF89D9B3346A0D6A"><enum>(ii)</enum><text>makes such data
				available via the Internet.</text>
									</clause></subparagraph><subparagraph id="H7132A391556D43C18A7FD3F914B39C62"><enum>(E)</enum><header>Internet-restricting
				country</header><text display-inline="yes-display-inline">The term
				<term>Internet-restricting country</term> has the meaning given such term under
				section 3 of the <short-title>Global Online Freedom Act of
				2013</short-title>.</text>
								</subparagraph><subparagraph id="HBF30002897344FE1A6514DD71A3D18EA"><enum>(F)</enum><header>Internet search
				engine</header><text>The term <term>Internet search engine</term> means a
				service made available via the Internet that, on the basis of a query
				consisting of terms, concepts, questions, or other data input by a user,
				searches information available on the Internet and returns to the user a link
				to or other means of locating, viewing, or downloading information or data
				available on the Internet relating to such query.</text>
								</subparagraph><subparagraph id="HDD9FAEA970A74AE88EE36D4D52A3F7E6"><enum>(G)</enum><header>Personally
				identifiable information</header><text display-inline="yes-display-inline">The
				term <term>personally identifiable information</term> means data in a form that
				identifies a particular person.</text>
								</subparagraph><subparagraph id="HDCCC75A3D9694E95AE752ED15D21BA97"><enum>(H)</enum><header>Remote computing
				service</header><text>The term <quote>remote computing service</quote> has the
				meaning given such term under <external-xref legal-doc="usc" parsable-cite="usc/18/2711">section 2711(2)</external-xref> of title 18, United States
				Code.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HCCE3E5138E03408CA71B1120B7C3892E"><enum>(b)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">Not later than the end of the 270-day
			 period beginning on the date of the enactment of this Act, the Securities and
			 Exchange Commission shall issue final rules to carry out section 13(s) of the
			 Securities and Exchange Act of 1934, as added by subsection (a).</text>
				</subsection></section></title><title commented="no" id="H27216425BBCC47519273B806388E05C9"><enum>III</enum><header>Export controls
			 on certain telecommunications equipment</header>
			<section id="H92B137C4968D466EA42DF1463A956A92"><enum>301.</enum><header>Export controls
			 on certain telecommunications equipment</header>
				<subsection id="H4A31063ABB71436595C13BF08A6BDD29"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 6 of the
			 Export Administration Act of 1979 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/2405">50 U.S.C. App. 2405</external-xref>), as continued in effect
			 under the International Emergency Economic Powers Act, is amended by adding at
			 the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H0BFA4600AAD84BC18171CAFCBD3F2203" style="OLC">
						<subsection id="HCF03790BF1364D0A8C2A0111481FECE6"><enum>(t)</enum><header>Certain
				telecommunications equipment</header>
							<paragraph commented="no" id="HF371966BCA03493B882BFF5A8CF5C7F0"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary, in
				consultation with the Secretary of State, the Secretary of Defense, and the
				heads of other appropriate Federal departments and agencies, shall establish
				and maintain, as part of the list maintained under this section, a list of
				goods and technology that would serve the primary purpose of assisting, or be
				specifically configured to assist, a foreign government in acquiring the
				capability to carry out censorship, surveillance, or any other similar or
				related activity through means of telecommunications, including the Internet,
				the prohibition or licensing of which would be effective in barring acquisition
				or enhancement of such capability.</text>
							</paragraph><paragraph id="HCC1D05F996894D46870470F97A237C4B"><enum>(2)</enum><header>Internet-restricting
				countries</header><text display-inline="yes-display-inline">Notwithstanding any
				other provision of law, the Secretary shall prohibit the export of goods or
				technology on the list established under paragraph (1) to a government end user
				in any Internet-restricting country.</text>
							</paragraph><paragraph id="H7E1E3CC1580242D98465016F084A2EA3"><enum>(3)</enum><header>Waiver</header><text display-inline="yes-display-inline">The President may waive the application of
				paragraph (2) with respect to export of goods or technology on the list
				established under paragraph (1) on a case-by-case basis if the President
				determines and certifies to Congress that it is in the national interests of
				the United States to do so.</text>
							</paragraph><paragraph id="H6ABBED6C38EB4FEFBF7CCE227846EFB9"><enum>(4)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection—</text>
								<subparagraph id="H88AE658CC85349E7A72A3B2D0FE25A22"><enum>(A)</enum><text>the term
				<term>Internet</term> has the meaning given the term in section 231(e)(3) of
				the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/231">47 U.S.C. 231(e)(3)</external-xref>);</text>
								</subparagraph><subparagraph id="H6091E6F09C03429E87D490285657DE35"><enum>(B)</enum><text>the term
				<term>Internet-restricting country</term> means a country designated by the
				Secretary of State pursuant to section 104(a) of the
				<short-title>Global Online Freedom Act of
				2013</short-title>;</text>
								</subparagraph><subparagraph id="H925B376BC6F44748BD9F41A190A7671E"><enum>(C)</enum><text>a
				<quote>government end user</quote> in a country—</text>
									<clause id="H40867953245D4C2394166DAD58049E75"><enum>(i)</enum><text>is
				an end user that is a government of that country, or of a political subdivision
				of that country, or is an agency or instrumentality of such a government;
				and</text>
									</clause><clause id="HDD4B169CFB49406082D12924C206FE2C"><enum>(ii)</enum><text>includes a
				telecommunications or Internet service provider that is wholly or partially
				owned by a government of that country; and</text>
									</clause></subparagraph><subparagraph id="H239CFFC59AE0499F86524A664BD8D98D"><enum>(D)</enum><text>an <quote>agency
				or instrumentality</quote> of a government is an <quote>agency or
				instrumentality of a foreign state</quote>, as defined in section 1603 of title
				28, United States
				Code.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H3EB6E8EEB49849F3BCCC4D78D7720FF4"><enum>(b)</enum><header>Regulations</header>
					<paragraph id="H5809A1DF01A44EF697E74EE52F40775C"><enum>(1)</enum><header>In
			 general</header><text>Not later than 1 year after the date of the enactment of
			 this Act, the President shall revise the Export Administration Regulations and
			 any other regulations necessary to carry out the amendment made by subsection
			 (a).</text>
					</paragraph><paragraph id="HFD719F79C6244D2780F57A1ED5606FB1"><enum>(2)</enum><header>Export
			 administration regulations</header><text display-inline="yes-display-inline">In
			 this subsection, the term <term>Export Administration Regulations</term> means
			 the Export Administration Regulations as maintained and amended under the
			 authority of the International Emergency Economic Powers Act and codified, as
			 of the date of the enactment of this Act, in subchapter C of chapter VII of
			 title 15, Code of Federal Regulations.</text>
					</paragraph></subsection><subsection id="H5524943567394F69BD3D6C9C6CC5D584"><enum>(c)</enum><header>Effective
			 date</header><text>Section 6(t) of the Export Administration Act of 1979, as
			 added by subsection (a), shall take effect on the date of the enactment of this
			 Act and shall apply with respect to the export of goods or technology on the
			 list established under paragraph (1) of such section on or after 1 year after
			 the date of the enactment of this Act.</text>
