		<official-title>To reduce Medicare waste, fraud, and abuse by providing
		  for enhanced penalties to combat Medicare and Medicaid fraud, for a Medicare
		  data-mining system, for a study on applying biometric technology, and for other

		<section id="HDA193550FA6540638E3CFF6C70030FB7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Medicare Fraud Enforcement and
			 Prevention Act of 2013</short-title></quote>.</text>
		</section><section id="HBDA14E88EBA34E67ABA6A678A6E9B50B"><enum>2.</enum><header>Enhanced criminal
			 penalties to combat Medicare and Medicaid fraud</header>
			<subsection id="HE8EBA8BA447C46EABFFAC98783DA0AD9"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1128B of the
			 Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320a-7b">42 U.S.C. 1320a–7b</external-xref>) is amended—</text>
				<paragraph id="HD2F67DD0006348199A43986354E91539"><enum>(1)</enum><text>in subsection (a),
			 by striking <quote>$10,000 or imprisoned for not more than one year</quote> and
			 inserting <quote>$20,000 or imprisoned for not more than two years</quote>;
			 and</text>
				</paragraph><paragraph id="HC0A9F831C5BA408EBE9D0AD0D5A18E91"><enum>(2)</enum><text>in each of
			 subsections (a), (b)(1), (b)(2), (c), and (d), by striking <quote>$25,000 or
			 imprisoned for not more than five years</quote> and inserting <quote>$50,000 or
			 imprisoned for not more than 10 years</quote>.</text>
				</paragraph></subsection><subsection id="H5FF64EBD8F1049B48D47740B3BD4F405"><enum>(b)</enum><header>Illegal
			 distribution of Medicare or Medicaid beneficiary identification or billing
			 privileges</header><text>Section 1128B of the Social Security Act (42 U.S.C.
			 1320a–7b) is amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H1E636FB73843471FAC5FBE129D51CB54" style="OLC">
					<subsection id="HAAFC578E55634D8BBEEA78E0C981A579"><enum>(h)</enum><text display-inline="yes-display-inline">Whoever knowingly purchases, sells, or
				unlawfully distributes, or arranges for the purchase, sale, or unlawful
				distribution of two or more Medicare or Medicaid beneficiary identification
				numbers or billing privileges under title XVIII or title XIX shall be
				imprisoned for not more than 10 years or fined under title 18, United States
				Code (or, if greater, an amount equal to the monetary loss to the Federal and
				any State government as a result of such acts), or
				both.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HE36830E0FB75423489FE8005CA73FA5D"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to acts
			 committed on or after the date of the enactment of this Act.</text>
			</subsection></section><section id="H236A688BEAB14F4993C618A9677B8D8F"><enum>3.</enum><header>Enhanced civil
			 authorities to combat Medicare and Medicaid fraud</header>
			<subsection id="HCCD535791567437A8B9A7FD4C38B5F1A"><enum>(a)</enum><header>Civil monetary
			 penalties law alignment and other changes</header>
				<paragraph id="H22645E2A058144FB8A1AA38411CE6798"><enum>(1)</enum><text display-inline="yes-display-inline">Section 1128A(a) of the Social Security Act
			 (42 U.S.C. 1320a–7a(a)) is amended—</text>
					<subparagraph id="HD404B0A3BDCC49F78902F1558B953A57"><enum>(A)</enum><text>in paragraph (1),
			 by striking <quote>to an officer, employee, or agent of the United States, or
			 of any department or agency thereof, or of any State agency (as defined in
			 subsection (i)(1)),</quote>;</text>
					</subparagraph><subparagraph id="H48C9900325AD4775A4285A026022DBDA"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting after paragraph (10), as added
			 by section 6402(d)(2) of the Patient Protection and Affordable Care Act (Public
			 Law 111–148) the following new paragraphs:</text>
						<quoted-block display-inline="no-display-inline" id="H209FA24C5C0D44AE8C2F0E34F1D05AE0" style="OLC">
							<paragraph id="H64F19282B8C046AFB177C920AD46B624"><enum>(11)</enum><text display-inline="yes-display-inline">conspires to commit a violation of this
				section; or</text>
							</paragraph><paragraph id="H689BC62940A94D0BAEAB4531494163D6"><enum>(12)</enum><text display-inline="yes-display-inline">knowingly makes, uses, or causes to be made
				or used, a false record or statement material to an obligation to pay or
				transmit money or property to a Federal health care program, or knowingly
				conceals or knowingly and improperly avoids or decreases an obligation to pay
				or transmit money or property to a Federal health care
				program;</text>
							</paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H051205A8804945C6A771DAED9DF23D9A"><enum>(C)</enum><text display-inline="yes-display-inline">in the first sentence—</text>
						<clause id="H6707090A82474C0F9E98CDDFEEDF3E4C"><enum>(i)</enum><text>by
			 striking <quote>or in cases under paragraph (9)</quote> and inserting <quote>in
			 cases under paragraph (9)</quote>; and</text>
						</clause><clause id="H794D8346FE294A2B94AFBE12C052CE94"><enum>(ii)</enum><text>by
			 striking <quote>fact)</quote> and inserting <quote>fact), in cases under
			 paragraph (11), $50,000 for any violation described in this section committed
			 in furtherance of the conspiracy involved, and in cases under paragraph (12),
			 $50,000 for each false record or statement, or concealment, avoidance, or
			 decrease</quote>; and</text>
						</clause></subparagraph><subparagraph id="H01455BDA6F34445D82901F3E5A9A30D9"><enum>(D)</enum><text>in the second
			 sentence, by striking <quote>material fact).</quote> and inserting
			 <quote>material fact); or in cases under paragraph (11), an assessment of not
			 more than 3 times the total amount that would otherwise apply for any violation
			 described in this section committed in furtherance of the conspiracy involved;
			 or in cases under paragraph (12), an assessment of not more than 3 times the
			 total amount of the obligation to which the false record or statement was
			 material or that was avoided or decreased.</quote>.</text>
					</subparagraph></paragraph><paragraph id="HDF8E88C6904D491988699A523AD8115A"><enum>(2)</enum><text>Section
			 1128A(c)(1) of the Social Security Act (42 U.S.C. 1320a–7a(c)(1)) is amended by
			 striking <quote>six years</quote> and inserting <quote>10 years</quote>.</text>
				</paragraph><paragraph id="HD8921369F1214E6180B49DEFCF8D82B3"><enum>(3)</enum><text>Section 1128A(i)
			 of the Social Security Act (42 U.S.C. 1320a–7a(i)) is amended—</text>
					<subparagraph id="H2D440C9AD4934602856E6154217D8B2B"><enum>(A)</enum><text>by amending
			 paragraph (2) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="H4E64468D1B7D4E3790DEF5C5D007A608" style="OLC">
							<paragraph id="H252EBC977E3E4ACA8BFF2B64C06E8F40"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>claim</term> means any
				application, request, or demand, whether under contract, or otherwise, for
				money or property for items and services under a Federal health care program
				(as defined in section 1128B(f)), whether or not the United States or a State
				agency has title to the money or property, that—</text>
								<subparagraph id="H517C4858DEB7424D99FCC03C1AC618BE"><enum>(A)</enum><text>is presented or
				caused to be presented to an officer, employee, or agent of the United States,
				or of any department or agency thereof, or of any State agency (as defined in
				subsection (i)(1)); or</text>
								</subparagraph><subparagraph id="HCCF47B7C72BB41619876EE6D5EA70AEE"><enum>(B)</enum><text display-inline="yes-display-inline">is made to a contractor, grantee, or other
				recipient if the money or property is to be spent or used on the Federal health
				care program’s behalf or to advance a Federal health care program interest, and
				if the Federal health care program—</text>
									<clause id="HF819D2E446844C96981A974AAA4443AC"><enum>(i)</enum><text>provides or has
				provided any portion of the money or property requested or demanded; or</text>
									</clause><clause id="HC957E8FB4CB14D9BB2A5E1D4866C5DCD"><enum>(ii)</enum><text>will reimburse
				such contractor, grantee, or other recipient for any portion of the money or
				property which is requested or
				demanded.</text>
									</clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H13D972BEB82B4C41956DC071BFE84A37"><enum>(B)</enum><text>by amending
			 paragraph (3) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="HF3655EF0D51C4CE7A33E0FA08B1346E1" style="OLC">
							<paragraph id="H3C33D24E4FE249308C1756DEEB65CBC2"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>item or service</term>
				means, without limitation, any medical, social, management, administrative, or
				other item or service used in connection with or directly or indirectly related
				to a Federal health care
				program.</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H9FDDFA22EAE442A9B2795665A8B28F9F"><enum>(C)</enum><text>in paragraph
			 (7)—</text>
						<clause id="H1AFEFDC29EC14D559DAA570D19972F67"><enum>(i)</enum><text>by
			 striking <quote>term <term>should know</term> means</quote> and inserting
			 <quote>terms <term>knowing</term>, <term>knowingly</term>, and <term>should
			 know</term> mean</quote>;</text>
						</clause><clause id="H7EEA5B46BABB4A0BAC390F3E6FF7854B"><enum>(ii)</enum><text>by
			 redesignating subparagraphs (A) and (B) as subparagraphs (B) and (C),
			 respectively;</text>
						</clause><clause id="H19EAD5392FA44F7C8369514EE21618DF"><enum>(iii)</enum><text>by
			 inserting before subparagraph (B), as redesignated by clause (ii), the
			 following new subparagraph:</text>
							<quoted-block display-inline="no-display-inline" id="HE961BEFB20DF4DB095A26338D34F504F" style="OLC">
								<subparagraph id="H8BBA8DE1784B41DF9F31250BE2E21C98"><enum>(A)</enum><text display-inline="yes-display-inline">has actual knowledge of the
				information;</text>
								</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</clause><clause id="HB7BE58CDE0114389A50CC9CBC7DBC275"><enum>(iv)</enum><text>in
			 the matter following subparagraph (C), as redesignated by clause (ii)—</text>
							<subclause id="HDB9E8FA239AF4EF4B57BBFFD66F8F3B6"><enum>(I)</enum><text>by inserting
			 <quote>require</quote> after <quote>and</quote>; and</text>
							</subclause><subclause id="H03BAB07225504C51AD46D0D4751C409B"><enum>(II)</enum><text>by striking
			 <quote>is required</quote>; and</text>
							</subclause></clause></subparagraph><subparagraph id="HE37C74C84D0446159119E9D34F33B7AE"><enum>(D)</enum><text>by adding at the
			 end the following new paragraphs:</text>
						<quoted-block display-inline="no-display-inline" id="HB9B09D5174E644FB9170886D0211DCE6" style="OLC">
							<paragraph id="H28850AB842914336808E1CFBACC3FD2D"><enum>(8)</enum><text display-inline="yes-display-inline">The term <term>obligation</term> means an
				established duty, whether or not fixed, arising from an express or implied
				contractual, grantor-grantee, or licensor licensee relationship, from a
				fee-based or similar relationship, from statute or regulation, or from the
				retention of any overpayment.</text>
							</paragraph><paragraph id="HE50E1B66EC0046A5BF872A68E01AE0F4"><enum>(9)</enum><text>The term
				<term>material</term> means having a natural tendency to influence, or be
				capable of influencing, the payment or receipt of money or
				property.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H7526B26437194F29B4F0CCA7622C4D2A"><enum>(b)</enum><header>Exclusion of
			 responsible corporate officials</header><text display-inline="yes-display-inline">Section 1128(b) of the Social Security Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/1320a-7">42 U.S.C. 1320a–7(b)</external-xref>) is amended by striking clauses (i) and (ii) of paragraph
			 (15)(A) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H6AE11EF1247941D581C3DD2609EF18FB" style="OLC">
					<clause id="H36613090E490434996AEA399C970C11B"><enum>(i)</enum><text display-inline="yes-display-inline">who has or had a direct or indirect
				ownership or control interest in a sanctioned entity at the time of and who
				knew or should have known (as defined in section 1128(i)(7)) of any of the
				conduct that formed a basis for the conviction or exclusion described in
				subparagraph (B); or</text>
					</clause><clause id="H76559A4374E4486B8585E90D0445F50D"><enum>(ii)</enum><text>who is or was an
				officer or managing employee (as defined in section 1126(b)) of such an entity
				at the time of any of the conduct that formed a basis for the conviction or
				exclusion so
				described.</text>
					</clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HBEF9E1F3266946D49542FEC8E8CB793B"><enum>(c)</enum><header>Payment
			 suspensions</header><text>Subsection (o)(1) of section 1862 of the Social
			 Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y</external-xref>) is amended by striking <quote>may</quote> and
			 inserting <quote>shall</quote>.</text>
			</subsection><subsection id="H19FFA59435E84A939DC47F19B7326B41"><enum>(d)</enum><header>Civil monetary
			 penalties for false statements or delaying inspections</header><text>Paragraph
			 (9) of section 1128A(a) of the Social Security Act (42 U.S.C. 1320a–7a(a)) is
			 amended by inserting <quote>or to timely provide information in response to a
			 request authorized by section 1128J(b),</quote> after
			 <quote>regulations),</quote>.</text>
			</subsection></section><section id="H42E95E48545C4BBE830449A8FC7419DC"><enum>4.</enum><header>Enhanced
			 screening, Medicare data-mining system; biometric technology study</header>
			<subsection id="HFD754B2D62204B7FB8772D1A7F5CEC0E"><enum>(a)</enum><header>Enhanced
			 screening</header><text display-inline="yes-display-inline">Section
			 1866(j)(2)(B)(ii) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395cc">42 U.S.C. 1395cc(j)(2)(B)(ii)</external-xref>) is
			 amended by striking <quote>may</quote> and inserting
			 <quote>shall</quote>.</text>
			</subsection><subsection id="HB8FE3E4701E24C99B738D56CEB8874CC"><enum>(b)</enum><header>Access to Real
			 Time Claims and Payment Data</header><text display-inline="yes-display-inline">Section 1128J(a)(2) of the Social Security
			 Act is amended—</text>
				<paragraph id="H63A7FF4D623D486B85FEA54747319912"><enum>(1)</enum><text>by inserting
			 <quote>including real time claims and payment data,</quote> after <quote>access
			 to claims and payment data</quote>; and</text>
				</paragraph><paragraph id="H7EB1247701ED46B8B369527A1539338B"><enum>(2)</enum><text>by adding at the
			 end the following sentence: <quote>In carrying out this section, the Inspector
			 General of the Department of Health and Human Services, in consultation with
			 the Attorney General, shall implement mechanisms for the sharing of information
			 about suspected fraud relating to the Federal health care programs under titles
			 XVIII, XIX, and XXI with other appropriate law enforcement
			 officials.</quote>.</text>
				</paragraph></subsection><subsection id="H18F22118DE2D4E49B9C3056A51E30B99"><enum>(c)</enum><header>Study on use of
			 biometric technology</header>
				<paragraph id="H1ADF2981562443168520D641BAB49B3C"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Health and Human Services shall provide
			 for a study that analyzes the feasibility and benefits in reducing waste,
			 fraud, and abuse of carrying out a program (in this subsection referred to as a
			 <term>biometric technology program</term>) that implements biometric technology
			 to ensure that individuals entitled to benefits under part A of title XVIII of
			 the Social Security Act or enrolled under part B of such title are physically
			 present at the time and place of receipt of certain items and services
			 (specified by the Secretary) for which payment may be made under such title.
			 Such a program may provide for financial incentives to encourage voluntary
			 participation of providers of services (as defined in section 1861(u) of such
			 Act) and suppliers (as defined in section 1861(d) of such Act).</text>
				</paragraph><paragraph id="H9AC9C976E04A411791354894D42A1052"><enum>(2)</enum><header>Report</header><text>Not
			 later than 6 months after the date of the enactment of this Act, the Secretary
			 shall submit to the Congress a report on the study conducted under paragraph
			 (1). Such report shall include an analysis of the likely effectiveness of a
			 biometric technology program on reducing waste, fraud, and abuse under the
			 Medicare program and may include recommendations with regard to whether such a
			 program, on a pilot or other basis, should be implemented.</text>
				</paragraph></subsection></section></legis-body>
