			 TRUST RESPONSIBILITY</header>
			<section id="H00C423C6972045A8ABAB15093C4414F6"><enum>101.</enum><header>Congressional
			 statement of findings</header><text display-inline="no-display-inline">The
			 Congress, after careful review of the Federal Government’s historical and
			 special legal relationship with, and resulting responsibilities to, American
			 Indian people, finds that—</text>
				<paragraph id="HE80BF9E3AC5943A3BBC80E2DF0A144FF"><enum>(1)</enum><text>the relationship
			 of Indian tribes to the United States is founded in part on the settled
			 doctrine of the law of nations that when a stronger sovereign assumes authority
			 over a weaker sovereign, the stronger one assumes a duty of protection for the
			 weaker one, which does not surrender its right to self-government;</text>
				</paragraph><paragraph id="HD0F0DADC8BEA4F389F645C4DDDB2A151"><enum>(2)</enum><text>the United States
			 fiduciary responsibilities to Indians also constitutes a foundational basis
			 for, not merely a function of, congressional legislation regarding Indians
			 because it constitutes an inherent presupposition of our constitutional
			 structure, which provides an inherent limit on the exercise and application of
			 the Indian Commerce Clause and the Treaty Clause of the Constitution;</text>
				</paragraph><paragraph id="H253DF3AF94094FA28992D8616C64CAAE"><enum>(3)</enum><text>the United States
			 fiduciary responsibilities to Indians also are founded in part on specific
			 commitments made through written treaties and agreements securing peace, in
			 exchange for which Indians have surrendered claims to vast tracts of land,
			 which provided legal consideration for permanent, ongoing performance of
			 Federal trust duties; and</text>
				</paragraph><paragraph id="H417BB617F86E4BCBA47F675DA3BB3C04"><enum>(4)</enum><text>the foregoing
			 historic Federal-tribal relations and understandings have benefitted the people
			 of the United States as a whole for centuries and established enduring and
			 enforceable Federal obligations to which the national honor has been
			 committed.</text>
				</paragraph></section><section id="H8FDE5C55C3A843678FF490109ABCD3BC"><enum>102.</enum><header>Congressional
			 reaffirmation of policy</header><text display-inline="no-display-inline">Pursuant to its constitutionally vested
			 authority over Indian affairs, the Congress hereby reaffirms the following
			 regarding the proper discharge of the United States fiduciary responsibilities
			 to Indians—</text>
				<paragraph id="H8E2D85BF36824C4494E36EE77421B008"><enum>(1)</enum><text>enforceable
			 fiduciary duties necessarily arise when the United States assumes control or
			 supervision over tribal trust assets even though nothing is said expressly in
			 the governing statutes or regulations, unless Congress has expressly specified
			 otherwise;</text>
				</paragraph><paragraph id="H286C919EE8C94F0DBC762C583622783E"><enum>(2)</enum><text>in general, the
			 most exacting common-law fiduciary standards which govern private trustees also
			 govern the United States when it manages Indian trust assets, and enforceable
			 Federal trust duties for Indian trust asset management are not limited to the
			 express terms of statutes and regulations;</text>
				</paragraph><paragraph id="HFC0E8096A515444897F3E14986E3D1B3"><enum>(3)</enum><text>the fact that the
			 United States simultaneously performs another task for another interest that
			 Congress has obligated it by statute to do does not compromise or limit the
			 United States enforceable fiduciary obligations to Indians; and</text>
				</paragraph><paragraph id="H908323D2542845C98E679B2BAF9B15C3"><enum>(4)</enum><text>the United States
			 fiduciary responsibilities to Indian tribes include and are not limited by a
			 duty to promote tribal self-determination regarding governmental authority and
			 economic development.</text>
				</paragraph></section></title><title id="H43F81B5E34014F668558B78E554A7352"><enum>II</enum><header>INDIAN TRUST
			 ASSET MANAGEMENT DEMONSTRATION PROJECT ACT</header>
			<section id="H49E8791D861E42ACA729A2D5C9ECE2FA"><enum>201.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote><short-title>Indian Trust Asset Management
			 Demonstration Project Act of 2013</short-title></quote>.</text>
			</section><section id="H1B5A858C55DA464AA5F82AFECF7B2960"><enum>202.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
				<paragraph id="H4752D48330414671A8C2E2F1FEBDC4C1"><enum>(1)</enum><header>Project</header><text>The
			 term <term>Project</term> means the Indian trust asset management demonstration
			 project established under section 103(a).</text>
				</paragraph><paragraph id="HD6FAFFF956A74865A13A22A22B1C93A7"><enum>(2)</enum><header>Indian
			 tribe</header><text>The term <term>Indian tribe</term> means an Indian tribe
			 that—</text>
					<subparagraph id="H7480B3DB73364CE080EABB717FE669DE"><enum>(A)</enum><text>is federally
			 recognized; and</text>
					</subparagraph><subparagraph id="H053BC1B5DFF6472DB0B189D1E1F90043"><enum>(B)</enum><text>submits an
			 application under section 203(c).</text>
					</subparagraph></paragraph><paragraph id="H20F74A015BC749EBA3845FFA38988F88"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
				</paragraph></section><section id="H97CA31AB1DE04BC796F81C1B89188A4A"><enum>203.</enum><header>Establishment
			 of demonstration project; selection of participating Indian tribes</header>
				<subsection id="H014AAD8AA03B43B4AD8243FC0964AD03"><enum>(a)</enum><header>In
			 general</header><text>The Secretary shall establish and carry out an Indian
			 trust asset management demonstration project, in accordance with this
			 title.</text>
				</subsection><subsection id="HAB2924048E94491EAC8C677B20311241"><enum>(b)</enum><header>Selection of
			 participating Indian tribes</header>
					<paragraph id="H448B4D1588A34C609880F3FC7042F5CD"><enum>(1)</enum><header>Indian
			 tribes</header>
						<subparagraph id="HBBB3DB7EBDCB4136AB72C985CC7942B8"><enum>(A)</enum><header>In
			 general</header><text>Any Indian tribe shall be eligible to participate in the
			 Project if—</text>
							<clause id="H3ACA212CB27E4B26BDA785B3B9C7D474"><enum>(i)</enum><text>the
			 Indian tribe submits to the Secretary an application under subsection (c);
			 and</text>
							</clause><clause id="HE922065B955648F0892E8B4933B3D9F6"><enum>(ii)</enum><text>the
			 Secretary approves the application of the Indian tribe.</text>
							</clause></subparagraph></paragraph><paragraph id="H51B6563240854565A7011EC02C145CF1"><enum>(2)</enum><header>Notice</header>
						<subparagraph id="HE0F123FA6FE8420CA2FC079DF02CBD9E"><enum>(A)</enum><header>In
			 general</header><text>The Secretary shall provide a written notice to each
			 Indian tribe approved to participate in the Project.</text>
						</subparagraph><subparagraph id="HFA6AFE2AD611450686DF05431F15396C"><enum>(B)</enum><header>Contents</header><text>A
			 notice under subparagraph (A) shall include—</text>
							<clause id="H6768058E1B384823AB4526BDD1BB71D1"><enum>(i)</enum><text>a
			 statement that the application of the Indian tribe has been approved by the
			 Secretary; and</text>
							</clause><clause id="H546B5590124D456495E8D044FDC159C7"><enum>(ii)</enum><text>a
			 requirement that the Indian tribe shall submit to the Secretary a proposed
			 Indian trust asset management plan in accordance with section 104.</text>
							</clause></subparagraph></paragraph></subsection><subsection id="HD20E2CDA419042CE8556926B8FCD0626"><enum>(c)</enum><header>Application</header>
					<paragraph id="HA7EDBEB59F6B4114B0E5CEEA649B0FF9"><enum>(1)</enum><header>In
			 general</header><text>To be eligible to participate in the Project, an Indian
			 tribe shall submit to the Secretary a written application in accordance with
			 paragraph (2).</text>
					</paragraph><paragraph id="HF23600DA77F34AA0BDE17835082A4612"><enum>(2)</enum><header>Requirements</header><text>The
			 Secretary shall take into consideration an application under this subsection
			 only if the application—</text>
						<subparagraph id="H395B8BE091F646C3978B7957C66CA432"><enum>(A)</enum><text>includes a copy of
			 a resolution or other appropriate action by the governing body of the Indian
			 tribe, as determined by the Secretary, in support of or authorizing the
			 application;</text>
						</subparagraph><subparagraph id="H0D372C3789134F25A9F07A9AAA0381B5"><enum>(B)</enum><text>is received by the
			 Secretary after the date of enactment of this Act; and</text>
						</subparagraph><subparagraph id="H268E74ED00144E249561946A5F8A9833"><enum>(C)</enum><text>states that the
			 Indian tribe is requesting to participate in the Project.</text>
						</subparagraph></paragraph></subsection><subsection id="H98C0C9623C12472ABD040FF6EEA4771C"><enum>(d)</enum><header>Duration</header><text>The
			 Project shall remain in effect for a period of 8 years after the date of
			 enactment of this Act.</text>
				</subsection></section><section id="H13093019982D4B97A84805A2B1028BDA"><enum>204.</enum><header>Indian trust
			 asset management plan</header>
				<subsection id="HEF7D8C6590314B30A61DE294D0DA45E3"><enum>(a)</enum><header>Proposed
			 plan</header>
					<paragraph id="HABBFF54C1E914E998B54F69AE44133BB"><enum>(1)</enum><header>Submission</header><text display-inline="yes-display-inline">After the date on which an Indian tribe
			 receives a notice from the Secretary under section 203(b)(2), the Indian tribe
			 shall submit to the Secretary a proposed Indian trust asset management plan in
			 accordance with paragraph (2).</text>
					</paragraph><paragraph id="H41CAD2AA22C0431B8DEDA0AEA4936637"><enum>(2)</enum><header>Contents</header><text>A
			 proposed Indian trust asset management plan shall include provisions
			 that—</text>
						<subparagraph id="H3EB01CD2F8D145008B72A04E3124EF1E"><enum>(A)</enum><text>identify the trust
			 assets that will be subject to the plan, including financial and nonfinancial
			 trust assets;</text>
						</subparagraph><subparagraph id="H8F328706CD9E4DC285A6508AC0E54F59"><enum>(B)</enum><text>establish trust
			 asset management objectives and priorities for Indian trust assets that are
			 located within the reservation, or otherwise subject to the jurisdiction, of
			 the Indian tribe;</text>
						</subparagraph><subparagraph id="H935088DB768C4C2E9CB232511C1C3DB5"><enum>(C)</enum><text>allocate trust
			 asset management funding that is available for the Indian trust assets subject
			 to the plan in order to meet the trust asset management objectives and
			 priorities;</text>
						</subparagraph><subparagraph id="H3B1BE870AAE046A38F02404CF8519D2C"><enum>(D)</enum><text>if the Indian
			 tribe has contracted or compacted functions or activities under the Indian
			 Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450">25 U.S.C. 450 et seq.</external-xref>)
			 relating to the management of trust assets—</text>
							<clause id="H56B0A6FC0F2742D6ABA82B5FF1355220"><enum>(i)</enum><text>identify the
			 functions or activities that are being performed by the Indian tribe under the
			 contracts or compacts; and</text>
							</clause><clause id="HBE96D0BD85AE418EBFFE888EE9549741"><enum>(ii)</enum><text>describe the
			 proposed management systems, practices, and procedures that the Indian tribe
			 will follow;</text>
							</clause></subparagraph><subparagraph id="H9651810FEC31405991AE88B6EEC1CE92"><enum>(E)</enum><text>establish
			 procedures for nonbinding mediation or resolution of any dispute between the
			 Indian tribe and the United States relating to the trust asset management
			 plan;</text>
						</subparagraph><subparagraph id="H9CE4467D00D84485AF88E91C16B4086D"><enum>(F)</enum><text>include a process
			 for the Indian tribe and the Federal agencies affected by the trust asset
			 management plan to conduct annual evaluations to ensure that trust assets are
			 being managed in accordance with the plan; and</text>
						</subparagraph><subparagraph id="H578F5A748F8F41A091FACCA7F3D9CDD9"><enum>(G)</enum><text>identify any
			 Federal regulations that will be superseded by the plan.</text>
						</subparagraph></paragraph><paragraph id="HEE20631994BC49B4AC1E306D6483A19A"><enum>(3)</enum><header>Authority of
			 Indian tribes to develop systems, practices, and procedures</header><text>For
			 purposes of preparing and carrying out a management plan under this section, an
			 Indian tribe that has compacted or contracted activities or functions under the
			 Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450">25 U.S.C. 450 et seq.</external-xref>),
			 for purposes of carrying out the activities or functions, may develop and carry
			 out trust asset management systems, practices, and procedures that differ from
			 any such systems, practices, and procedures used by the Secretary in managing
			 the trust assets if the systems, practices, and procedures of the Indian tribe
			 meet the requirements of the laws, standards, and responsibilities described in
			 subsection (c).</text>
					</paragraph><paragraph id="H56AC5EEE7970454DBC053E632613E464"><enum>(4)</enum><header>Technical
			 assistance and information</header><text>The Secretary shall provide to an
			 Indian tribe any technical assistance and information, including budgetary
			 information, that the Indian tribe determines to be necessary for preparation
			 of a proposed plan on receipt of a written request from the Indian
			 tribe.</text>
					</paragraph></subsection><subsection id="HE8DB8156CC804A38AB8D1D124419A2A5"><enum>(b)</enum><header>Approval and
			 disapproval of proposed plans</header>
					<paragraph id="HDA345A33F4434A51A1C52F1C3FCC499D"><enum>(1)</enum><header>Approval</header>
						<subparagraph id="H948A4E36A097422E89FB5887C540127A"><enum>(A)</enum><header>In
			 general</header><text>Not later than 120 days after the date on which an Indian
			 tribe submits a proposed Indian trust asset management plan under subsection
			 (a), the Secretary shall approve or disapprove the proposed plan.</text>
						</subparagraph><subparagraph id="H6CAA3DAFBFC64FB9923D844B96906F98"><enum>(B)</enum><header>Requirements for
			 disapproval</header><text>The Secretary shall approve a proposed plan unless
			 the Secretary determines that—</text>
							<clause id="HED463DCBCD49423B86B21554C550CA57"><enum>(i)</enum><text>the
			 proposed plan fails to address a requirement under subsection (a)(2);</text>
							</clause><clause id="H5F58737EEB144A5189895625A7B94D12"><enum>(ii)</enum><text>the
			 proposed plan includes one or more provisions that are inconsistent with
			 subsection (c); or</text>
							</clause><clause id="HD6F35BAC77E74545B4529164470D0131"><enum>(iii)</enum><text>the cost of
			 implementing the proposed plan exceeds the amount of funding available for the
			 management of trust assets that would be subject to the proposed plan.</text>
							</clause></subparagraph></paragraph><paragraph id="H76243F8C5FAA45ACBFFC0F85312F50A9"><enum>(2)</enum><header>Action on
			 disapproval</header>
						<subparagraph id="H290596BFA367439795CF3572A07391DC"><enum>(A)</enum><header>Notice</header><text>If
			 the Secretary disapproves a proposed plan under paragraph (1)(B), the Secretary
			 shall provide to the Indian tribe a written notice of the disapproval,
			 including any reason why the proposed plan was disapproved.</text>
						</subparagraph><subparagraph id="HE5EE25A1AF9947578386A8844CB2BBDA"><enum>(B)</enum><header>Action by
			 tribes</header><text>If a proposed plan is disapproved under paragraph (1)(B),
			 the Indian tribe may resubmit an amended proposed plan not later than 90 days
			 after the date on which the Indian tribe receives the notice under subparagraph
			 (A).</text>
						</subparagraph></paragraph><paragraph id="H8A842557002E4C89A8B104E2572E3CEB"><enum>(3)</enum><header>Failure to
			 approve or disapprove</header><text>If the Secretary fails to approve or
			 disapprove a proposed plan in accordance with paragraph (1), the plan shall be
			 considered to be approved.</text>
					</paragraph><paragraph id="H3430494804124FC1BA192056136DA3E4"><enum>(4)</enum><header>Judicial
			 review</header><text>An Indian tribe may seek judicial review of the
			 determination of the Secretary in accordance with subchapter II of chapter 5,
			 and chapter 7, of title 5, United States Code (commonly known as the
			 <term>Administrative Procedure Act</term>) if—</text>
						<subparagraph id="H307614166B5D48E180201F3DDE34CD98"><enum>(A)</enum><text>the Secretary
			 disapproves the proposed plan of the Indian tribe under paragraph (1) or (3);
			 and</text>
						</subparagraph><subparagraph id="HAB14267E4C2E44EB9F7A3DA2B3300F3A"><enum>(B)</enum><text>the Indian tribe
			 has exhausted any other administrative remedy available to the Indian
			 tribe.</text>
						</subparagraph></paragraph></subsection><subsection id="H37E42000E874458EB3CD8ADA6202A320"><enum>(c)</enum><header>Applicable laws;
			 standards; trust responsibility</header>
					<paragraph id="H864B420F837143F386218F8203220E7D"><enum>(1)</enum><header>Applicable
			 laws</header><text>An Indian trust asset management plan, and any activity
			 carried out under the plan, shall not be approved unless the proposed plan is
			 consistent with—</text>
						<subparagraph id="H5D7AF326679E4ABE81EEAD9E98460A61"><enum>(A)</enum><text>all Federal
			 treaties, statutes, Executive orders, and court decisions that are applicable
			 to the trust assets, or the management of the trust assets, identified in the
			 plan; and</text>
						</subparagraph><subparagraph id="H5906B30AA1274AE29DC6CB8D74F703B9"><enum>(B)</enum><text>all tribal laws
			 that are applicable to the trust assets, or the management of trust assets,
			 identified in the plan, except to the extent that the laws are inconsistent
			 with the treaties, statutes, Executive orders, and court decisions referred to
			 in subparagraph (A).</text>
						</subparagraph></paragraph><paragraph id="H54E5B82931EE49E18FECAA3EA9D310B9"><enum>(2)</enum><header>Standards</header><text>Subject
			 to the laws referred to in paragraph (1)(A), an Indian trust asset management
			 plan shall not be approved unless the Secretary determines that the plan
			 will—</text>
						<subparagraph id="HF32632B58BF349B489BBE695938E2D5E"><enum>(A)</enum><text>protect trust
			 assets from loss, waste, and unlawful alienation;</text>
						</subparagraph><subparagraph id="H96A3038154DD47B9945DCA1B7DA0DA30"><enum>(B)</enum><text>promote the
			 interests of the beneficial owner of the trust asset;</text>
						</subparagraph><subparagraph id="H1E599BA93C5046488CCFC282DFC2CC5A"><enum>(C)</enum><text>conform, to the
			 maximum extent practicable, to the preferred use of the trust asset by the
			 beneficial owner, unless the use is inconsistent with a treaty, statute,
			 regulation, Executive order, or court decision referred to in paragraph
			 (1)(A);</text>
						</subparagraph><subparagraph id="H41B5E9B5EE86476486C2675852F31E46"><enum>(D)</enum><text>protect any
			 applicable treaty-based fishing, hunting and gathering, and similar rights
			 relating to the use, access, or enjoyment of a trust asset; and</text>
						</subparagraph><subparagraph id="H4141714AFF2C4026B03A24103E317DC2"><enum>(E)</enum><text>require that any
			 activity carried out under the plan be carried out in good faith and with
			 loyalty to the beneficial owner of the trust asset.</text>
						</subparagraph></paragraph><paragraph id="HC5B5D647382843699035BF20325BB1D7"><enum>(3)</enum><header>Trust
			 responsibility</header><text>An Indian trust asset management plan shall not be
			 approved unless the Secretary determines that the plan is consistent with the
			 trust responsibility of the United States to the Indian tribe and individual
			 Indians.</text>
					</paragraph></subsection><subsection id="H790277051E054FACB477DEEA4C414480"><enum>(d)</enum><header>Termination of
			 plan</header>
					<paragraph id="HFA9C6636494F49EE84DB5EAD7447DBA1"><enum>(1)</enum><header>In
			 general</header><text>An Indian tribe may terminate an Indian trust asset
			 management plan on any date after the date on which a proposed Indian trust
			 asset management plan is approved by providing to the Secretary—</text>
						<subparagraph id="HCF9C4AF87E334A0B941843BBEE89AFB4"><enum>(A)</enum><text>a notice of the
			 intent of the Indian tribe to terminate the plan; and</text>
						</subparagraph><subparagraph id="H077586DDD83A49DEBC04D768D3BB8C65"><enum>(B)</enum><text>a resolution of
			 the governing body of the Indian tribe authorizing the termination of the
			 plan.</text>
						</subparagraph></paragraph><paragraph id="H6EB8F8704E404453B407C09A9B76B35E"><enum>(2)</enum><header>Effective
			 date</header><text>A termination of an Indian trust asset management plan under
			 paragraph (1) takes effect on October 1 of the first fiscal year following the
			 date on which a notice is provided to the Secretary under paragraph
			 (1)(A).</text>
					</paragraph></subsection></section><section id="H0CA2F59302A4491D9CEA924D9A6F181F"><enum>205.</enum><header>Effect of
			 title</header>
				<subsection id="H0750952F168347269CE36CEAA59E1AA3"><enum>(a)</enum><header>Liability</header><text>Nothing
			 in this title, or a trust asset management plan approved under section 204,
			 shall independently diminish, increase, create, or otherwise affect the
			 liability of the United States or an Indian tribe participating in the Project
			 for any loss resulting from the management of an Indian trust asset under an
			 Indian trust asset management plan.</text>
				</subsection><subsection id="H009A1D82041A474192F9CA7975AA1847"><enum>(b)</enum><header>Effect on other
			 laws</header><text>Except for any regulation superseded by a trust asset
			 management plan approved under section 204, nothing in this title amends or
			 otherwise affects the application of any treaty, statute, regulation, Executive
			 order, or court decision that is applicable to Indian trust assets or the
			 management or administration of Indian trust assets.</text>
				</subsection><subsection id="H106B0E4B226043E3B110104BA211BB1E"><enum>(c)</enum><header>Trust
			 responsibility</header><text>Nothing in this title diminishes or otherwise
			 affects the trust responsibility of the United States to Indian tribes and
			 individual Indians.</text>
				</subsection></section></title><title id="H4BDDB224031D4EAB9559B7314584B4DC"><enum>III</enum><header>RESTRUCTURING
			 BUREAU OF INDIAN AFFAIRS AND OFFICE OF SPECIAL TRUSTEE</header>
			<section id="H0F9DDC57556646EE90668D777F891963"><enum>301.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this title is to ensure a
			 more effective and accountable administration of duties of the Secretary of the
			 Interior with respect to providing services and programs to Indians and Indian
			 tribes, including the management of Indian trust resources.</text>
			</section><section id="H45584FF0278D433C8381A21C89CD4F64"><enum>302.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
				<paragraph id="H21A642EEE93C41CCA07B79EEF0090E7F"><enum>(1)</enum><header>Bureau</header><text>The
			 term <term>Bureau</term> means the Bureau of Indian Affairs.</text>
				</paragraph><paragraph id="H01A7753F3AE444A7A0C7EF751815A781"><enum>(2)</enum><header>Office</header><text>The
			 term <term>Office</term> means the Office of Trust Reform Implementation and
			 Oversight referred to in section 303(c).</text>
				</paragraph><paragraph id="HA05C3736A30F4F3CA98BEEB73F0B3F69"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
				</paragraph><paragraph id="H21E6F66651E84B0B95A6AF62ACBF1265"><enum>(4)</enum><header>Under
			 secretary</header><text>The term <term>Under Secretary</term> means the
			 individual appointed to the position of Under Secretary for Indian Affairs,
			 established by section 303(a).</text>
				</paragraph></section><section id="H5760A58EFA774C698776D3E6740F0FC1"><enum>303.</enum><header>Under Secretary
			 for Indian Affairs</header>
				<subsection id="H7D80E434562441B28A3E9B1999775424"><enum>(a)</enum><header>Establishment of
			 position</header><text>There is established in the Department of the Interior
			 the position of Under Secretary for Indian Affairs, who shall report directly
			 to the Secretary.</text>
				</subsection><subsection id="H23F34007E3614D0CB0F6E50B62D364BE"><enum>(b)</enum><header>Appointment</header>
					<paragraph id="HF83A460BEBA64A76A279CC692142C34D"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), the Under Secretary
			 shall be appointed by the President, by and with the advice and consent of the
			 Senate.</text>
					</paragraph><paragraph id="HE17BA7238C4943CCB563F6A6EF1067D1"><enum>(2)</enum><header>Exception</header><text>The
			 officer serving as the Assistant Secretary for Indian Affairs on the date of
			 enactment of this Act may assume the position of Under Secretary without
			 appointment under paragraph (1) if—</text>
						<subparagraph id="H8FB8CAB8C09546FA878209491BFD0266"><enum>(A)</enum><text>the officer was
			 appointed as Assistant Secretary for Indian Affairs by the President by and
			 with the advice and consent of the Senate; and</text>
						</subparagraph><subparagraph id="HE43DA2953D944B2C90F9AF76B055A7FC"><enum>(B)</enum><text>not later than 180
			 days after the date of enactment of this Act, the Secretary approves the
			 assumption.</text>
						</subparagraph></paragraph></subsection><subsection id="HB5B8D73EEB094C689F36D0695EC6CAC2"><enum>(c)</enum><header>Duties</header><text>In
			 addition to the duties transferred to the Under Secretary under sections 304
			 and 305, the Under Secretary, acting through an Office of Trust Reform
			 Implementation and Oversight, shall—</text>
					<paragraph id="HA885755762654AFEA47CA7C98D7C86DB"><enum>(1)</enum><text>carry out any
			 activity relating to trust fund accounts and trust resource management of the
			 Bureau (except any activity carried out under the Office of the Special Trustee
			 for American Indians before the date on which the Office of the Special Trustee
			 is abolished), in accordance with the American Indian Trust Fund Management
			 Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001 et seq.</external-xref>);</text>
					</paragraph><paragraph id="HBD5EFB76E1694C8EBF073A8DA4DB6B6F"><enum>(2)</enum><text>develop and
			 maintain an inventory of Indian trust assets and resources;</text>
					</paragraph><paragraph id="H8DFBD7BC54444185BD0A92A5945325CE"><enum>(3)</enum><text>coordinate with
			 the Special Trustee for American Indians to ensure an orderly transition of the
			 functions of the Special Trustee under section 305;</text>
					</paragraph><paragraph id="H833B1B4E47914F798ADD9592827E0548"><enum>(4)</enum><text>supervise any
			 activity carried out by the Department of the Interior, including but not
			 limited to—</text>
						<subparagraph id="H25EFFFDB1DF446429DEEB059A217217F"><enum>(A)</enum><text>to the extent that
			 the activities relate to Indian affairs, activities carried out by—</text>
							<clause id="HE4D99C8BF7F94700AFC9D1316F13442A"><enum>(i)</enum><text>the
			 Commissioner of Reclamation;</text>
							</clause><clause id="HF2D3AE28F9004079980B3E67B67574C1"><enum>(ii)</enum><text>the
			 Director of the Bureau of Land Management;</text>
							</clause><clause id="H4B694A678FC54E8497F8F145FAF093E0"><enum>(iii)</enum><text>the Director of
			 the Office of Natural Resources Revenue;</text>
							</clause><clause id="H868CFE4A682F42FB9AAAB0B7C9C50381"><enum>(iv)</enum><text>the
			 Director of the National Park Service; and</text>
							</clause><clause id="H7A14BA67673143FAA17540BA46BAC32B"><enum>(v)</enum><text>the
			 Director of the U.S. Fish and Wildlife Service; and</text>
							</clause></subparagraph><subparagraph id="HC1D84E4A41804C6BBA149D1AF4219A66"><enum>(B)</enum><text>intergovernmental
			 relations between the Bureau and Indian tribal governments;</text>
						</subparagraph></paragraph><paragraph id="H04F43BB7512844FAB42268AD1C9DDAA8"><enum>(5)</enum><text>to the maximum
			 extent practicable, coordinate activities and policies of the Bureau with
			 activities and policies of—</text>
						<subparagraph id="H8D2736CD3A034CAF8AB397930E0D62B0"><enum>(A)</enum><text>the Bureau of
			 Reclamation;</text>
						</subparagraph><subparagraph id="H496D35A873DD407A84D53FE8145312C7"><enum>(B)</enum><text>the Bureau of Land
			 Management;</text>
						</subparagraph><subparagraph id="H3D71EED7B8D449149D6032A4C527B2E8"><enum>(C)</enum><text>the Office of
			 Natural Resources Revenue;</text>
						</subparagraph><subparagraph id="H281C78722D1D4B9CBF3D482883F0BD7B"><enum>(D)</enum><text>the National Park
			 Service; and</text>
						</subparagraph><subparagraph id="HEC0CDE63ABF64BFAB10D03D371CDE698"><enum>(E)</enum><text>the U.S. Fish and
			 Wildlife Service;</text>
						</subparagraph></paragraph><paragraph id="H6FE5E3B2710A4E16803D508480452CEC"><enum>(6)</enum><text>provide for
			 regular consultation with Indians and Indian tribes that own interests in trust
			 resources and trust fund accounts;</text>
					</paragraph><paragraph id="H38E468E37F4042BFB702532BE0D88F45"><enum>(7)</enum><text>manage and
			 administer Indian trust resources in accordance with any applicable Federal
			 law;</text>
					</paragraph><paragraph id="H4B6A524577A94910AE5592B829B2F55C"><enum>(8)</enum><text>take steps to
			 protect the security of data relating to individual Indian and Indian tribal
			 trust accounts; and</text>
					</paragraph><paragraph id="H44FB97BF1100469B98D323A15289AE82"><enum>(9)</enum><text>take any other
			 measure the Under Secretary determines to be necessary with respect to Indian
			 affairs.</text>
					</paragraph></subsection></section><section id="H5ADB18A185314DE3880D88C8985D14E5"><enum>304.</enum><header>Transfer of
			 functions of Assistant Secretary for Indian Affairs</header>
				<subsection id="H882F748B0334467E96F00FE04386A247"><enum>(a)</enum><header>Transfer of
			 functions</header><text>There is transferred to the Under Secretary any
			 function of the Assistant Secretary for Indian Affairs that has not been
			 carried out by the Assistant Secretary as of the date of enactment of this
			 Act.</text>
				</subsection><subsection id="HE1A8F80FCED0492BAAB21DAE8D486BF5"><enum>(b)</enum><header>Determinations
			 of certain functions by the office of management and budget</header><text>If
			 necessary, the Office of Management and Budget shall make any determination
			 relating to the functions transferred under subsection (a).</text>
				</subsection><subsection id="H6D61E6DAEF294816850880549C3F5D69"><enum>(c)</enum><header>Personnel
			 provisions</header>
					<paragraph id="HE04BC01F856F4BD3AD9C86F2B3351D6B"><enum>(1)</enum><header>Appointments</header><text>The
			 Under Secretary may appoint and fix the compensation of such officers and
			 employees as the Under Secretary determines to be necessary to carry out any
			 function transferred under this section.</text>
					</paragraph><paragraph id="H3D7F66F09F534DF1B9944944E4BA97A1"><enum>(2)</enum><header>Requirements</header><text>Except
			 as otherwise provided by law—</text>
						<subparagraph id="HA47E2579D8C548E69FE23E1BD06123A9"><enum>(A)</enum><text>an officer or
			 employee described in paragraph (1) shall be appointed in accordance with the
			 civil service laws; and</text>
						</subparagraph><subparagraph id="HE3578ACB5A3D4C00B44874BFCEFB3E55"><enum>(B)</enum><text>the compensation
			 of the officer or employee shall be fixed in accordance with title 5, United
			 States Code.</text>
						</subparagraph></paragraph></subsection><subsection id="H986DC90BC4BD4DD3A81CE69D683018D0"><enum>(d)</enum><header>Delegation and
			 assignment</header>
					<paragraph id="HC811A29E3A3F4470B8F47C56FED33596"><enum>(1)</enum><header>In
			 general</header><text>Except as otherwise expressly prohibited by law or
			 otherwise provided by this section, the Under Secretary may—</text>
						<subparagraph id="HD10C0F9B7C5744B094E3CDD0F9EFAAA2"><enum>(A)</enum><text>delegate any of
			 the functions transferred to the Under Secretary by this section and any
			 function transferred or granted to the Under Secretary after the date of
			 enactment of this Act to such officers and employees of the Office as the Under
			 Secretary may designate; and</text>
						</subparagraph><subparagraph id="HFCD35C843D324669B28AB9EBB65C6D11"><enum>(B)</enum><text>authorize
			 successive redelegations of such functions as the Under Secretary determines to
			 be necessary or appropriate.</text>
						</subparagraph></paragraph><paragraph id="H25E9E3A48DC74CA2BB7AB114C2C373D4"><enum>(2)</enum><header>Delegation</header><text>No
			 delegation of functions by the Under Secretary under this section shall relieve
			 the Under Secretary of responsibility for the administration of the
			 functions.</text>
					</paragraph></subsection><subsection id="H6DBA004B8B9D454A86BE8072EE4FB388"><enum>(e)</enum><header>Reorganization</header><text>The
			 Under Secretary may allocate or reallocate any function transferred under this
			 section among the officers of the Office, and establish, consolidate, alter, or
			 discontinue such organizational entities in the Office, as the Under Secretary
			 determines to be necessary or appropriate.</text>
				</subsection><subsection id="H78E38E07BE764FBE893785CECFADD421"><enum>(f)</enum><header>Rules</header><text>The
			 Under Secretary may prescribe, in accordance with the provisions of chapters 5
			 and 6 of title 5, United States Code, such rules and regulations as the Under
			 Secretary determines to be necessary or appropriate to administer and manage
			 the functions of the Office.</text>
				</subsection><subsection id="HFFF003BFC8F24D4EA94DD6D61CB1428E"><enum>(g)</enum><header>Transfer and
			 allocations of appropriations and personnel</header>
					<paragraph id="H2D754391BBF649418803D7C8A0369B8D"><enum>(1)</enum><header>In
			 general</header><text>Except as otherwise provided in this section, the
			 personnel employed in connection with, and the assets, liabilities, contracts,
			 property, records, and unexpended balances of appropriations, authorizations,
			 allocations, and other funds employed, used, held, arising from, available to,
			 or to be made available in connection with, the functions transferred by this
			 section, subject to <external-xref legal-doc="usc" parsable-cite="usc/31/1531">section 1531</external-xref> of title 31, United States Code, shall be
			 transferred to the Office.</text>
					</paragraph><paragraph id="H2577C7CA99794484A205C13B30167C50"><enum>(2)</enum><header>Unexpended
			 funds</header><text>Unexpended funds transferred pursuant to this subsection
			 shall be used only for the purposes for which the funds were originally
			 authorized and appropriated.</text>
					</paragraph></subsection><subsection id="HA4E8A45F81614E18833BAFE398957B02"><enum>(h)</enum><header>Incidental
			 transfers</header>
					<paragraph id="H8F88A9C409B24B4E850ECA9F591C268A"><enum>(1)</enum><header>In
			 general</header><text>The Director of the Office of Management and Budget, at
			 any time the Director may provide, may make such determinations as are
			 necessary with regard to the functions transferred by this section, and make
			 such additional incidental dispositions of personnel, assets, liabilities,
			 grants, contracts, property, records, and unexpended balances of
			 appropriations, authorizations, allocations, and other funds held, used,
			 arising from, available to, or to be made available in connection with such
			 functions, as are necessary, to carry out this section.</text>
					</paragraph><paragraph id="HC4A6825B45FB4CE6B21954DA1FCE567A"><enum>(2)</enum><header>Termination of
			 affairs</header><text>The Director of the Office of Management and Budget shall
			 provide for the termination of the affairs of all entities terminated by this
			 section and for any further measures and dispositions as are necessary to
			 effectuate the purposes of this section.</text>
					</paragraph></subsection><subsection id="HD427E8AAD8F644318B12A690ED82AFE2"><enum>(i)</enum><header>Effect on
			 personnel</header>
					<paragraph id="H39AA3676B48A456C83D34183EBED580E"><enum>(1)</enum><header>In
			 general</header><text>Except as otherwise provided by this section, the
			 transfer pursuant to this section of full-time personnel (except special
			 Government employees) and part-time personnel holding permanent positions shall
			 not cause any such employee to be separated or reduced in grade or compensation
			 for a period of at least 1 year after the date of transfer of the employee
			 under this section.</text>
					</paragraph><paragraph id="H2E3AFCE7D6334C1194BBAEE40230A3E8"><enum>(2)</enum><header>Executive
			 schedule positions</header><text>Except as otherwise provided in this section,
			 any person who, on the day preceding the date of enactment of this Act, held a
			 position compensated in accordance with the Executive Schedule prescribed in
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United States Code, and who, without a break in service,
			 is appointed to a position in the Office having duties comparable to the duties
			 performed immediately preceding such appointment shall continue to be
			 compensated in the new position at not less than the rate provided for the
			 previous position, for the duration of the service of the person in the new
			 position.</text>
					</paragraph><paragraph id="HCA1296D795804077B179BE18DEE9DFBF"><enum>(3)</enum><header>Termination of
			 certain positions</header><text>Positions whose incumbents are appointed by the
			 President, by and with the advice and consent of the Senate, the functions of
			 which are transferred by this title, shall terminate on the date of enactment
			 of this Act.</text>
					</paragraph></subsection><subsection id="HE2BE21A193FD4174910B0F7579ABF2A7"><enum>(j)</enum><header>Separability</header><text>If
			 a provision of this section or the application of this section to any person or
			 circumstance is held invalid, neither the remainder of this section nor the
			 application of the provision to other persons or circumstances shall be
			 affected.</text>
				</subsection><subsection id="H541DF70623E24E49BB940E42C6920DA7"><enum>(k)</enum><header>Transition</header><text>The
			 Under Secretary may use—</text>
					<paragraph id="HA19C8219871E45F49E20721A5923705A"><enum>(1)</enum><text>the services of
			 the officers, employees, and other personnel of the Assistant Secretary for
			 Indian Affairs relating to functions transferred to the Office by this section;
			 and</text>
					</paragraph><paragraph id="HDE3C3E09111A4BCF822158CD1D9F8B34"><enum>(2)</enum><text>funds appropriated
			 to the functions for such period of time as may reasonably be needed to
			 facilitate the orderly implementation of this section.</text>
					</paragraph></subsection><subsection id="HA4F4141EB9794A7CA73993E462F6CCC5"><enum>(l)</enum><header>References</header><text>Any
			 reference in a Federal law, Executive order, rule, regulation, delegation of
			 authority, or document relating to the Assistant Secretary for Indian Affairs,
			 with respect to functions transferred under this section, shall be deemed to be
			 a reference to the Under Secretary.</text>
				</subsection><subsection id="H5C00139B1F3B45768DBFE7A91F9DFE13"><enum>(m)</enum><header>Recommended
			 legislation</header><text>Not later than 180 days after the effective date of
			 this title, the Under Secretary, in consultation with the appropriate
			 committees of Congress and the Director of the Office of Management and Budget,
			 shall submit to Congress any recommendations relating to additional technical
			 and conforming amendments to Federal law to reflect the changes made by this
			 section.</text>
				</subsection><subsection id="H18526A1D63C9465DB943DEAE12D36F17"><enum>(n)</enum><header>Effect of
			 section</header>
					<paragraph id="H211AF9B2E04D46D798230C3E9A76EB04"><enum>(1)</enum><header>Continuing
			 effect of legal documents</header><text>Any legal document relating to a
			 function transferred by this section that is in effect on the date of enactment
			 of this Act shall continue in effect in accordance with the terms of the
			 document until the document is modified or terminated by—</text>
						<subparagraph id="HB2F826019CDE4DE199E00621F96CCF0A"><enum>(A)</enum><text>the
			 President;</text>
						</subparagraph><subparagraph id="H4E62718E999A4568ACCCCF1CECE623AB"><enum>(B)</enum><text>the Under
			 Secretary;</text>
						</subparagraph><subparagraph id="H38A22C8487E540429EC6B8ADED8E1087"><enum>(C)</enum><text>a court of
			 competent jurisdiction; or</text>
						</subparagraph><subparagraph id="H3280B43EBFAE4535B5E04D726BDD4A8C"><enum>(D)</enum><text>operation of
			 Federal or State law.</text>
						</subparagraph></paragraph><paragraph id="H0E5EBAB2587544E994B0DE0DE17AECED"><enum>(2)</enum><header>Proceedings not
			 affected</header><text>This section shall not affect any proceeding (including
			 a notice of proposed rulemaking, an administrative proceeding, and an
			 application for a license, permit, certificate, or financial assistance)
			 relating to a function transferred under this section that is pending before
			 the Assistant Secretary on the date of enactment of this Act.</text>
					</paragraph></subsection></section><section id="HFCC688D057BD4CE4925376D0A9366313"><enum>305.</enum><header>Office of
			 Special Trustee for American Indians</header>
				<subsection id="HA8E96F7166D74F6D94D6D7099AB64EBE"><enum>(a)</enum><header>Termination</header><text>Notwithstanding
			 sections 302 and 303 of the American Indian Trust Fund Management Reform Act of
			 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4042">25 U.S.C. 4042</external-xref>; 4043), the Office of Special Trustee for American Indians
			 shall terminate on the effective date of this section.</text>
				</subsection><subsection id="H5212756F8AB4472A9DB34248950109FF"><enum>(b)</enum><header>Transfer of
			 functions</header><text>There is transferred to the Under Secretary any
			 function of the Special Trustee for American Indians that has not been carried
			 out by the Special Trustee as of the effective date of this section.</text>
				</subsection><subsection id="H2A98F6EE8F2A436EA512140EF8DAAC2C"><enum>(c)</enum><header>Determinations
			 of certain functions by the office of management and budget</header><text>If
			 necessary, the Office of Management and Budget shall make any determination
			 relating to the functions transferred under subsection (b).</text>
				</subsection><subsection id="H5DB4B99F521A4F91B55C0CB8B3746C76"><enum>(d)</enum><header>Personnel
			 provisions</header>
					<paragraph id="H97C2533479AC439392BA5286DB3B63D9"><enum>(1)</enum><header>Appointments</header><text>The
			 Under Secretary may appoint and fix the compensation of such officers and
			 employees as the Under Secretary determines to be necessary to carry out any
			 function transferred under this section.</text>
					</paragraph><paragraph id="HF2AD0BA6910E4272B184534D638AE413"><enum>(2)</enum><header>Requirements</header><text>Except
			 as otherwise provided by law—</text>
						<subparagraph id="H21DC4DBE510841569E6B72B3287AC444"><enum>(A)</enum><text>any officer or
			 employee described in paragraph (1) shall be appointed in accordance with the
			 civil service laws; and</text>
						</subparagraph><subparagraph id="H5FD8F22E3C7C45CABA2B21F4038087F8"><enum>(B)</enum><text>the compensation
			 of such an officer or employee shall be fixed in accordance with title 5,
			 United States Code.</text>
						</subparagraph></paragraph></subsection><subsection id="H8BEAFA734B7A488CBAFD2C178EDB7C21"><enum>(e)</enum><header>Delegation and
			 assignment</header>
					<paragraph id="H573F311E05DE479E94784890017B8D82"><enum>(1)</enum><header>In
			 general</header><text>Except as otherwise expressly prohibited by law or
			 otherwise provided by this section, the Under Secretary may—</text>
						<subparagraph id="HC1C8F6F1C8A6468DB5B97D0E1D1FC277"><enum>(A)</enum><text>delegate any of
			 the functions transferred to the Under Secretary under this section and any
			 function transferred or granted to the Under Secretary after the effective date
			 of this section to such officers and employees of the Office as the Under
			 Secretary may designate; and</text>
						</subparagraph><subparagraph id="HD02A71B82C5341AAA477042584A6F930"><enum>(B)</enum><text>authorize
			 successive redelegations of the functions as are necessary or
			 appropriate.</text>
						</subparagraph></paragraph><paragraph id="HCB1CFF6B418B43A3A3024E4F47B1CEDB"><enum>(2)</enum><header>Delegation</header><text>No
			 delegation of functions by the Under Secretary under this section shall relieve
			 the Under Secretary of responsibility for the administration of the
			 functions.</text>
					</paragraph></subsection><subsection id="H3CFA021A261B44549AB6AE5B74CEF478"><enum>(f)</enum><header>Reorganization</header><text>The
			 Under Secretary may allocate or reallocate any function transferred under
			 subsection (b) among the officers of the Office, and establish, consolidate,
			 alter, or discontinue such organizational entities in the Office as the Under
			 Secretary determines to be necessary or appropriate.</text>
				</subsection><subsection id="H04920F9ACE3946F9AD4B482A1FF02BC7"><enum>(g)</enum><header>Rules</header><text>The
			 Under Secretary may prescribe, in accordance with the provisions of chapters 5
			 and 6 of title 5, United States Code, such rules and regulations as the Under
			 Secretary determines to be necessary or appropriate to administer and manage
			 the functions of the Office.</text>
				</subsection><subsection id="H3F4988A75C7A422EB3738FC2D158B3E2"><enum>(h)</enum><header>Transfer and
			 Allocations of Appropriations and Personnel</header><text>Except as otherwise
			 provided in this section, the personnel employed in connection with, and the
			 assets, liabilities, contracts, property, records, and unexpended balances of
			 appropriations, authorizations, allocations, and other funds employed, used,
			 held, arising from, available to, or to be made available in connection with
			 the functions transferred by this section, subject to <external-xref legal-doc="usc" parsable-cite="usc/31/1531">section 1531</external-xref> of title 31,
			 United States Code, shall be transferred to the Office.</text>
				</subsection><subsection id="HC157D0F419D8465E9AA24F4D245E3DF3"><enum>(i)</enum><header>Incidental
			 transfers</header>
					<paragraph id="HB05C474F418E4721B337DA3917B00758"><enum>(1)</enum><header>In
			 general</header><text>The Director of the Office of Management and Budget, at
			 any time the Director may provide, may make such determinations as are
			 necessary with regard to the functions transferred by this section, and make
			 such additional incidental dispositions of personnel, assets, liabilities,
			 grants, contracts, property, records, and unexpended balances of
			 appropriations, authorizations, allocations, and other funds held, used,
			 arising from, available to, or to be made available in connection with such
			 functions, as are necessary, to carry out this section.</text>
					</paragraph><paragraph id="HF20C4BE385E94E32A0212505BD4676A4"><enum>(2)</enum><header>Termination of
			 affairs</header><text>The Director of the Office of Management and Budget shall
			 provide for the termination of the affairs of all entities terminated by this
			 section and for any further measures and dispositions as are necessary to
			 effectuate the purposes of this section.</text>
					</paragraph></subsection><subsection id="HCD8A79DAB8744CFFADEFC0D101A260F9"><enum>(j)</enum><header>Effect on
			 personnel</header>
					<paragraph id="H9754A11A9ADF4DE0AB228723E5BDA5E7"><enum>(1)</enum><header>In
			 general</header><text>Except as otherwise provided by this section, the
			 transfer pursuant to this section of full-time personnel (except special
			 Government employees) and part-time personnel holding permanent positions shall
			 not cause any such employee to be separated or reduced in grade or compensation
			 for a period of at least 1 year after the date of transfer of the employee
			 under this section.</text>
					</paragraph><paragraph id="H6B8A2DE6AE0C4033BDBE5D89B0816C7F"><enum>(2)</enum><header>Executive
			 schedule positions</header><text>Except as otherwise provided in this section,
			 any person who, on the day preceding the effective date of this section, held a
			 position compensated in accordance with the Executive Schedule prescribed in
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United States Code, and who, without a break in service,
			 is appointed to a position in the Office having duties comparable to the duties
			 performed immediately preceding such appointment, shall continue to be
			 compensated in the new position at not less than the rate provided for the
			 previous position, for the duration of the service of the person in the new
			 position.</text>
					</paragraph><paragraph id="HE59F06602A02481A80BA805323B8C855"><enum>(3)</enum><header>Termination of
			 certain positions</header><text>Positions the incumbents of which are appointed
			 by the President, by and with the advice and consent of the Senate, and the
			 functions of which are transferred by this title, shall terminate on the
			 effective date of this section.</text>
					</paragraph></subsection><subsection id="H551E97B7DF12438080A3E9116F5E7860"><enum>(k)</enum><header>Separability</header><text>If
			 a provision of this section or the application of this section to any person or
			 circumstance is held invalid, neither the remainder of this section nor the
			 application of the provision to other persons or circumstances shall be
			 affected.</text>
				</subsection><subsection id="HF37BF1A6E6E74DF7A45EA598D73990BC"><enum>(l)</enum><header>Transition</header><text>The
			 Under Secretary may use—</text>
					<paragraph id="H8DF4378117CF4610A5A3549618E8FB9C"><enum>(1)</enum><text>the services of
			 the officers, employees, and other personnel of the Special Trustee relating to
			 functions transferred to the Office by this section; and</text>
					</paragraph><paragraph id="H12AD066721BF48AAAD9950F65F4CFA93"><enum>(2)</enum><text>funds appropriated
			 to those functions for such period of time as may reasonably be needed to
			 facilitate the orderly implementation of this section.</text>
					</paragraph></subsection><subsection id="H94F79A62E6E140B0AE2D4CC3E2000041"><enum>(m)</enum><header>References</header><text>Any
			 reference in a Federal law, Executive order, rule, regulation, delegation of
			 authority, or document relating to the Special Trustee, with respect to
			 functions transferred under this section, shall be deemed to be a reference to
			 the Under Secretary.</text>
				</subsection><subsection id="HAAB00FE99E544870868A76F15DC2C607"><enum>(n)</enum><header>Recommended
			 legislation</header><text>Not later than 180 days after the effective date of
			 this title, the Under Secretary, in consultation with the appropriate
			 committees of Congress and the Director of the Office of Management and Budget,
			 shall submit to Congress any recommendations relating to additional technical
			 and conforming amendments to Federal law to reflect the changes made by this
			 section.</text>
				</subsection><subsection id="H32D954622E8D4DE7997238BC49995E9C"><enum>(o)</enum><header>Effect of
			 section</header>
					<paragraph id="H19EB810EEC8940AFAE31F0F2DF203534"><enum>(1)</enum><header>Continuing
			 effect of legal documents</header><text>Any legal document relating to a
			 function transferred by this section that is in effect on the effective date of
			 this section shall continue in effect in accordance with the terms of the
			 document until the document is modified or terminated by—</text>
						<subparagraph id="H2700CFB7A4684AFDBEBB1A4CFE55C613"><enum>(A)</enum><text>the
			 President;</text>
						</subparagraph><subparagraph id="HFC47374EAA7E4EC98760E20AF117A23B"><enum>(B)</enum><text>the Under
			 Secretary;</text>
						</subparagraph><subparagraph id="H8F61B2C9D14F488B8B452676CF928BCE"><enum>(C)</enum><text>a court of
			 competent jurisdiction; or</text>
						</subparagraph><subparagraph id="HCF3C64F715D94F70904DA3720A813C0F"><enum>(D)</enum><text>operation of
			 Federal or State law.</text>
						</subparagraph></paragraph><paragraph id="HD37B5E308108434BA0092D4FE9C43811"><enum>(2)</enum><header>Proceedings not
			 affected</header><text>This section shall not affect any proceeding (including
			 a notice of proposed rulemaking, an administrative proceeding, and an
			 application for a license, permit, certificate, or financial assistance)
			 relating to a function transferred under this section that is pending before
			 the Special Trustee on the effective date of this section.</text>
					</paragraph></subsection><subsection id="H2A8F4B4AF4664075826468B7B09AA770"><enum>(p)</enum><header>Effective
			 date</header><text>This section shall take effect on April 1, 2014, or 180 days
			 following enactment of this Act into law, whichever is earlier.</text>
				</subsection></section><section id="H55836059E1234A8893707CE485E2E36D"><enum>306.</enum><header>Cost savings
			 recommendations</header>
				<subsection id="H15370E034C2C47BA8E1CD8ED80C0F4C9"><enum>(a)</enum><header>Cost savings
			 identification</header><text>Within 60 days of the effective date in section
			 305(p), the Under Secretary shall initiate procedures to—</text>
					<paragraph id="HB5D98672575849B3B5C32A0C1AB1C547"><enum>(1)</enum><text>identify the
			 programs, functions, services, and activities (or any portions of programs,
			 functions, services, or activities) that will not have to operate or carry out
			 as a result of any transfer of functions and personnel under section
			 305;</text>
					</paragraph><paragraph id="HD9D689BE8C734AFD9F693BD15FD06CA9"><enum>(2)</enum><text>identify the
			 amounts that the Secretary would have otherwise expended to operate or carry
			 out each program, function, service, and activity (or any portion of a program,
			 function, service, or activity) identified pursuant to paragraph (1);
			 and</text>
					</paragraph><paragraph id="HE0A6AC880DF3422496CC9F4B37ADA1F7"><enum>(3)</enum><text>provide to the
			 Secretary and the tribal representatives of the Tribal/Interior Budget Council,
			 within 120 days of the effective date in section 305(p), a list of the
			 programs, functions, services, and activities (or any portions of programs,
			 functions, services, or activities) identified pursuant paragraph (1) and the
			 amounts associated with each program, function, service, and activity (or any
			 portion of a program, function, service, or activity) identified pursuant to
			 paragraph (2).</text>
					</paragraph></subsection><subsection id="H453FDF93A50B436EABAD4D3E6B192919"><enum>(b)</enum><header>Tribal
			 recommendations</header><text>Within 120 days of receipt of the information in
			 subsection (a)(3), the tribal representatives of the Tribal/Interior Budget
			 Council may provide recommendations to the Secretary and the Office of
			 Management and Budget on how any amounts or cost savings should be reallocated
			 and/or incorporated into future budget requests.</text>
				</subsection></section><section id="H880C64DFA6F04E35ADC98C345A8FEC63"><enum>307.</enum><header>Hiring
			 preference</header><text display-inline="no-display-inline">In appointing or
			 otherwise hiring any employee to the Office, the Under Secretary shall give
			 preference to Indians in accordance with section 12 of the Act of June 8, 1934
			 (<external-xref legal-doc="usc" parsable-cite="usc/25/472">25 U.S.C. 472</external-xref>).</text>
