		<section id="H8A7E547322D141828362297C27E2677F" section-type="section-one"><enum>1.</enum><header>Congressional administration
			 of the oath of allegiance</header>
			<subsection id="H927952A31ADD499CAD85A5794044C7E1"><enum>(a)</enum><header>Naturalization
			 Authority</header><text display-inline="yes-display-inline">Section 310(b) of
			 the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1421">8 U.S.C. 1421(b)</external-xref>) is amended—</text>
				<paragraph id="H209A4CEC34704C9CA34D00A0CF1274D5"><enum>(1)</enum><text>in the subsection
			 heading, by striking <quote><header-in-text level="subsection" style="OLC">Court Authority</header-in-text></quote> and inserting
			 <quote><header-in-text level="subsection" style="OLC">Authority</header-in-text></quote>;</text>
				</paragraph><paragraph id="H2251F2291DDE41C3B07AB887F8A78A6F"><enum>(2)</enum><text>in paragraph
			 (1)(A)—</text>
					<subparagraph id="H5A80CC28EB084B78BBCB37A0311C6CAC"><enum>(A)</enum><text>by inserting
			 <quote>, by a Member of, or Delegate or Resident Commissioner to, the
			 Congress,</quote> before <quote>or by an eligible court</quote>; and</text>
					</subparagraph><subparagraph id="HFF6AFA10D6B14D26872F33EAE8E88C1D"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:
			 <quote>A Senator shall have the authority to administer such oath of allegiance
			 only to individuals who reside in the State the Senator represents. In the case
			 of a Member of the House of Representatives, including a Delegate or Resident
			 Commissioner to the Congress, the Member shall have the authority to administer
			 such oath of allegiance only to individuals who reside in the congressional
			 district the Member represents.</quote>;</text>
					</subparagraph></paragraph><paragraph id="H75F7C61CDEA041E39C8567BE90C8F50E"><enum>(3)</enum><text>in paragraph (1),
			 by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H2953787D975F496DB35CB9EC9FAD8CCF" style="OLC">
						<subparagraph id="HC2A5F937DA464B7A97B88B0AF7DC19D4"><enum>(C)</enum><header>Limitations on
				Congressional authority</header>
							<clause id="H1D12D30450614856B1E86BBBC8C1C803"><enum>(i)</enum><header>Extent of
				authority</header><text>The authority under this section of a Member of, or
				Delegate or Resident Commissioner to, the Congress is limited solely to the
				administration of the oath of allegiance under section 337(a).</text>
							</clause><clause id="H7C451097FD8448EF82B640598A974B00"><enum>(ii)</enum><header>Period before
				elections</header><text display-inline="yes-display-inline">A Member of, or
				Delegate or Resident Commissioner to, the Congress may not administer the oath
				of allegiance under section 337(a) during the 90-day period which ends on the
				date of any election for Federal, State, or local office in which the Member,
				Delegate, or Resident Commissioner is a candidate.</text>
							</clause><clause id="HD8E94B2C6B604E08A68263FFC0911D6E"><enum>(iii)</enum><header>Time and place
				of ceremony</header><text display-inline="yes-display-inline">A Member of, or
				Delegate or Resident Commissioner to, the Congress shall administer the oath of
				allegiance under section 337(a) only at such times and places as the Secretary
				of Homeland Security may
				designate.</text>
							</clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H5C231859CE534016B7CF67FB497BBC6E"><enum>(4)</enum><text display-inline="yes-display-inline">in paragraph (2)(A), in the matter
			 preceding clause (i), by inserting <quote>or a Member of, or Delegate or
			 Resident Commissioner to, the Congress</quote> after <quote>a
			 court</quote>;</text>
				</paragraph><paragraph id="H51FA1E4776994374A7C50BB37F32E39D"><enum>(5)</enum><text>in paragraph
			 (2)(A)(i), by inserting <quote>or subject to paragraph (1)(C)(ii), the Member
			 of, or Delegate or Resident Commissioner to, the Congress</quote> after
			 <quote>the court</quote>;</text>
				</paragraph><paragraph id="H93D4E74B64F54E2BB465DCF4C5E29D7B"><enum>(6)</enum><text display-inline="yes-display-inline">in paragraph (2)(A)(ii)(I), by inserting
			 <quote>or the Member of, or Delegate or Resident Commissioner to, the
			 Congress</quote> before <quote>such information</quote>;</text>
				</paragraph><paragraph id="H5A9244261019454BBCFB07759DCB1D95"><enum>(7)</enum><text display-inline="yes-display-inline">in paragraph (2)(A)(ii)(II), by inserting
			 <quote>or the Member of, or Delegate or Resident Commissioner to, the
			 Congress</quote> after <quote>the court</quote>; and</text>
				</paragraph><paragraph id="HD17BB844501D47578E7C318F3F67D7ED"><enum>(8)</enum><text>in paragraph
			 (3)(B)—</text>
					<subparagraph id="HFF188DCF9C3B4B89B084D515F1243012"><enum>(A)</enum><text>in the
			 subparagraph heading, by striking <quote><header-in-text level="subparagraph" style="OLC">Authority of attorney general</header-in-text></quote> and
			 inserting <quote><header-in-text level="subparagraph" style="OLC">Timing of
			 Exclusive Authority</header-in-text></quote>;</text>
					</subparagraph><subparagraph id="H37557DEC503F4579B29EC5F9E177746B"><enum>(B)</enum><text>by inserting
			 <quote>neither</quote> after <quote>Subject to subparagraph
			 (C),</quote>;</text>
					</subparagraph><subparagraph id="H540AEE0ABEB3499F813B68DD0FC3B7FC"><enum>(C)</enum><text display-inline="yes-display-inline">by inserting <quote>nor a Member of, or
			 Delegate or Resident Commissioner to, the Congress</quote> after <quote>the
			 Attorney General</quote>; and</text>
					</subparagraph><subparagraph id="HF42A98BA5D7C4DEF90CC935CEF22EC02"><enum>(D)</enum><text>by striking
			 <quote>shall not administer</quote> and inserting <quote>shall
			 administer</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="HA9FDED3065DF41059F3057B79732ADE5"><enum>(b)</enum><header>Oath of
			 renunciation and allegiance</header><text display-inline="yes-display-inline">Section 337 of the Immigration and
			 Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1448">8 U.S.C. 1448</external-xref>) is amended—</text>
				<paragraph id="HCF91A1812FEA44C282348D324E793C0E"><enum>(1)</enum><text>in the first
			 sentence of subsection (a), by inserting <quote>, the Member of the House of
			 Representatives, including a Delegate or Resident Commissioner to the Congress,
			 who represents the congressional district in which the individual resides, a
			 Senator who represents the State in which the individual resides,</quote>
			 before <quote>or a court with jurisdiction</quote>;</text>
				</paragraph><paragraph id="H0783BAC84B3A4C73BECBDC7ACD786C34"><enum>(2)</enum><text>in the first
			 sentence of subsection (c)—</text>
					<subparagraph id="H38223933E9E54686AD4A07933A5EB936"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>(except to the extent
			 that such section limits the authority of a Member of, or Delegate or Resident
			 Commissioner to, the Congress)</quote> after <quote>Notwithstanding section
			 310(b)</quote>; and</text>
					</subparagraph><subparagraph id="HF6EA47E8B7BD44BCB836849A8D7135CB"><enum>(B)</enum><text>by inserting
			 <quote>, oath administration by the Member of the House of Representatives,
			 including a Delegate or Resident Commissioner to the Congress, who represents
			 the congressional district in which the individual resides or a Senator who
			 represents the State in which the individual resides,</quote> after
			 <quote>expedited judicial oath administration ceremony</quote>;</text>
					</subparagraph></paragraph><paragraph id="H6C5EBCDE85554E8BBCD2640811882DA3"><enum>(3)</enum><text>in the third
			 sentence of subsection (c), by inserting <quote>or oath administration by the
			 Member of, or Delegate or Resident Commissioner to, the Congress</quote> before
			 the period; and</text>
				</paragraph><paragraph id="H1E016CE965794938A857F528477F3663"><enum>(4)</enum><text>in subsection (c),
			 by adding at the end the following: <quote>The authority under this section of
			 a Member of, or Delegate or Resident Commissioner to, the Congress shall be
			 subject to section 310(b).</quote>.</text>
				</paragraph></subsection><subsection id="HB292440E5C23451FA48FD5D44EBA3019"><enum>(c)</enum><header>Certificate of
			 naturalization; contents</header><text>Section 338 of the Immigration and
			 Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1449">8 U.S.C. 1449</external-xref>) is amended by inserting <quote>, Member of, or
			 Delegate or Resident Commissioner to, the Congress,</quote> after
			 <quote>location of the official</quote>.</text>
			</subsection><subsection id="H37B50532888B4DAFAA54E23BA09BFE55"><enum>(d)</enum><header>Functions and
			 duties of clerks and records of declarations of intention and applications for
			 naturalization</header><text>Section 339 of the Immigration and Nationality Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/8/1450">8 U.S.C. 1450</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H4C9014E3A9D842B2B0B034942F5FBE95" style="OLC">
					<subsection id="H966DAFF005824F59A43FD43A9C3857A2"><enum>(c)</enum><text display-inline="yes-display-inline">In the case of an oath administration by a
				Member of, or Delegate or Resident Commissioner to, the Congress, the functions
				and duties of clerks of courts described in this section shall be undertaken by
				the Secretary of Homeland
				Security.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H6746DAFF0DA64DA2A0C3648F38E42240"><enum>2.</enum><header>Regulatory
			 Authority</header><text display-inline="no-display-inline">Not later than the
			 date that is 120 days after the date of enactment of this Act, the Secretary of
			 Homeland Security shall issue regulations implementing the amendments made by
			 this Act.</text>
		</section><section id="H4BEA80D2397645869A27004AC4ADD0BC"><enum>3.</enum><header>Clerical
			 amendment</header>
			<subsection id="H0CA338F182BE45368BE3A8B3FB3C8692"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Each of sections 310,
			 337, 338, and 339 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1421">8 U.S.C. 1421</external-xref>, 1448,
			 1449, and 1450) is amended by striking <quote>Attorney General</quote> each
			 place it appears and inserting <quote>Secretary of Homeland
			 Security</quote>.</text>
			</subsection><subsection id="HEC17E72783E149A68E0DCD0BB5F582F5"><enum>(b)</enum><header>Exception</header><text display-inline="yes-display-inline">The amendment made by this section shall
			 not affect the authority of any officer or employee of the Executive Office of
			 Immigration Review (including immigration judges (as defined in section
			 101(b)(4) of the Immigration and Nationality Act)) to administer the oath of
			 allegiance under section 337(a).</text>
